1. Software License
(1) All copyright and related intellectual property rights in and to this software program, its update programs and this software program updated by the update programs (collectively the “Product”) are owned by Koei Tecmo Games Co., Ltd. (“Koei Tecmo”) or its licensors.
(2) The Product is licensed, not sold, for your use. All rights not specifically granted are reserved by Koei Tecmo or its licensors. 
(3) Subject to your consent to this Agreement, Koei Tecmo grants you the non-exclusive, non-transferable and non-sublicensable right to install the Product on only one (1) computer and use the Product solely for your personal use.
(4) With respect to the Product you have installed on the computer pursuant to section (3) above, you may install the same Product on another computer as long as you completely delete the Product from the first computer.
(5) Except when you install the Product on the computer under section (3) and (4) above, you may not copy the Product.

1. Softwarelizenz
(1) Sämtliche Urheberrechte und anderen geistigen Eigentumsrechte an und aus diesem Softwareprogramm, seinen Updateprogrammen und diesem Softwareprogramm in der durch die Updateprogramme aktualisierten Version (zusammen das "Produkt") sind Eigentum von Koei Tecmo Games Co., Ltd. ("Koei Tecmo") oder seinen Lizenzgebern.
(2) Sie erhalten lediglich eine Lizenz zur Nutzung des Produkts, das Produkt wird Ihnen nicht verkauft. Alle Rechte, die Ihnen nicht ausdrücklich eingeräumt werden, verbleiben bei Koei Tecmo und/oder seinen Lizenzgebern. 
(3) Vorbehaltlich Ihrer Zustimmung zu dieser Vereinbarung gewährt Koei Tecmo Ihnen das nicht-exklusive, nicht-übertragbare und nicht-unterlizenzierbare Recht, das Produkt auf nur einem einzigen (1) Computer zu installieren und das Produkt ausschließlich für Ihren persönlichen Gebrauch zu nutzen.
(4) In Bezug auf das Produkt, dass Sie gemäß Punkt (3) oben auf dem Computer installiert haben, dürfen Sie das Produkt auf einem anderen Computer installieren, sofern Sie das Produkt vom ersten Computer restlos löschen.
(5) Abgesehen von der Installation auf dem Computer gemäß den Punkten (3) und (4) oben dürfen Sie das Produkt nicht kopieren.

2. Prohibited Actions
When using the Product hereunder, you may not:
・	except as otherwise expressly provided herein, copy, modify, alter or transfer the Product;
・	combine the Product with any other software;
・	rent, lease or otherwise exploit the Product commercially;
・	transmit or make ready to be transmitted to the public the Product in whole or in part via the internet or any other method without Koei Tecmo’s express written approval; 
・	reverse engineer, derive source code, modify, decompile, disassemble or otherwise analyze the Product;
・	breach any terms and conditions hereof;
・	interrupt Koei Tecmo’s smooth operation when you use the Product and contact Koei Tecmo’s customer support set forth in Article 4 below;
・	cause disadvantage, damage or uncomfortable feelings to other purchasers of the Product or any other third party;
・	act against public order and good morals;
・	commit a crime or an illegal act or otherwise violate any laws or regulations;
・	infringe Koei Tecmo’s reputation, intellectual property rights or other rights or profit;
・	repeatedly make the same, similar inquiries etc. to Koei Tecmo about the Product;
・	conduct any other acts that Koei Tecmo deems to be inappropriate;
・	directly or indirectly, evoke or facilitate any of acts listed in the preceding items;
・	conduct any act that Koei Tecmo reasonably determines falls under or possibly falls under any of the preceding items;

2. Verbotene Handlungen
Wenn Sie das Produkt gemäß dieser Vereinbarung nutzen, ist es Ihnen verboten:
・	das Produkt zu kopieren, zu modifizieren, zu verändern oder zu übertragen, sofern dies in dieser Vereinbarung nicht ausdrücklich anderweitig geregelt ist;
・	das Produkt mit anderer Software zu kombinieren;
・	das Produkt zu vermieten, zu verpachten oder anderweitig kommerziell zu nutzen;
・	das Produkt oder Teile des Produkts ohne die ausdrückliche schriftliche Zustimmung von Koei Tecmo über das Internet oder andere Methoden an die Öffentlichkeit zu übertragen oder die Übertragung an die Öffentlichkeit zu ermöglichen oder vorzubereiten; 
・	das Produkt rückzuentwickeln, den Quellcode des Produkts abzuleiten, das Produkt zu modifizieren, zu dekompilieren, zu disassemblieren oder anderweitig zu analysieren;
・	in irgendeiner Weise gegen die Bedingungen und Bestimmungen dieser Vereinbarung zu verstoßen;
・	bei der Nutzung des Produkts und beim Kontaktieren von Koei Tecmos Kundendienst gemäß Abschnitt 4 unten den reibungslosen Betrieb von Koei Tecmo zu stören;
・	anderen Käufern des Produkts oder Dritten Nachteile, Schäden oder Unbehagen zu bereiten;
・	sich wider die öffentliche Ordnung und die gute Moral zu verhalten;
・	ein Verbrechen oder eine illegale Handlung zu begehen oder anderweitig gegen Gesetze oder Vorschriften zu verstoßen;
・	den Ruf, die geistigen Eigentumsrechte oder andere Rechte oder Vorteile oder Gewinne von Koei Tecmo zu verletzen oder zu schädigen;
・	wiederholt dieselben oder ähnliche Anfragen usw. bezüglich des Produkts an Koei Tecmo zu richten;
・	andere Handlungen vorzunehmen, die nach alleinigem Ermessen von Koei Tecmo unangemessen sind;
・	mittelbar oder unmittelbar eine oder mehrere in dieser Liste oben aufgeführte Handlungen auszulösen oder zu fördern;
・	Handlungen zu vollziehen, die nach dem vernünftigen Ermessen von Koei Tecmo unter einen der oben genannten Punkte fallen oder möglicherweise fallen könnten.

3. Scope of Warranty and Liability
(1) If the Product doesn’t work as prescribed in the manual provided by Koei Tecmo and you can’t substantially use the Product due to the cause contributable to Koei Tecmo, Koei Tecmo, at its own discretion, shall allow you to re-download the Product, fix the Product (including distribution of update programs) or refund the price of the Product to you, for sixty (60) days after your purchase with respect to the Product sold for Japan or for ninety (90) days after your purchase with respect to the Product sold for territories other than Japan, as the case may be.
(2) Section (1) above shall apply only if Koei Tecmo could confirm the record of your purchase of the Product. If Koei Tecmo refunds to you under section (1) above, you shall completely delete the Product from the computer on which the Product is installed.  
(3) Section (1) above shall not apply if the malfunction or the defect of the Product is due to any of followings:
・	Use of the Product breaching any terms and conditions hereof;
・	your modification or alteration of the Product or combination of the Product and any other product;
・	your willful or negligent misuse of the Product or other uses under an abnormal condition of the Product; or
・	any defect or malfunction of the computer on which the Product is installed or other hardware connected to the computer, or non-conformance of the computer to system requirements or communication environment required for the Product.
(4) THE PRODUCT IS PROVIDED "AS IS".  KOEI TECMO MAKES NO WARRANTIES OF ANY KIND, EXPRESS, IMPLIED OR OTHERWISE, REGARDING THE COMPLETENESS, ACCURACY, USEFULNESS, PERFORMANCE, OR APPROPRIATENESS OF THE PRODUCT, INCLUDING, BUT, NOT LIMITED TO, FITNESS OR SUITABILITY FOR A PARTICULAR PURPOSE AND FREEDOM FROM ANY BUGS AND ANY OTHER DEFECTS.
(5) Koei Tecmo may at any time modify a part of the Product (including distribution of update programs) without giving prior notice to you. UNDER NO CIRCUMSTANCES SHALL KOEI TECMO BE LIABLE FOR ANY DAMAGES OR LOSS OF PROFIT INCURRED BY YOU ARISING OUT OF SUCH MODIFICATION OF THE PRODUCT. 
(6) TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAWS, EXCEPT AS OTHERWISE EXPRESSLY PROVIDED HEREIN, UNDER NO CIRCUMSTANCES SHALL KOEI TECMO BE LIABLE FOR ANY INCIDENTAL, INDIRECT, SPECIAL, CONSEQUENTIAL OR FUTURE DAMAGES OR LOSS ETC. INCURRED BY YOU ARISING OUT OF USE, UNAVAILABILITY OR DISCONTINUANCE OF THE PRODUCT, EVEN IF KOEI TECMO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR LOSS OR SUCH DAMAGES OR LOSS COULD HAVE BEEN REASONABLY FORESEEN. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAWS, UNDER NO CIRCUMSTANCES SHALL KOEI TECMO’S LIABILITY TO YOU HEREUNDER EXCEED THE ACTUAL PRICE PAID BY YOU FOR THE PRODUCT UNLESS IT’S DUE TO OUR WILLFUL MISCONDUCT OR NEGLIGENCE. 

3. Umfang der Gewährleistung und Haftung
(1) Wenn das Produkt nicht wie im von Koei Tecmo bereitgestellten Handbuch beschrieben funktioniert und Sie das Produkt aufgrund von in den Verantwortungsbereich von Koei Tecmo fallenden Umständen nicht im Wesentlichen nutzen können, so wird Koei Tecmo für einen Zeitraum von sechzig (60) Tagen nach Ihrem Kauf für Käufe in Japan bzw. neunzig (90) Tagen nach Ihrem Kauf für Käufe in anderen Gebieten als Japan nach seinem alleinigen Ermessen ein erneutes Herunterladen des Produkts gewähren, den Mangel am Produkt beheben (insbesondere durch Bereitstellung von Updateprogrammen) oder Ihnen den Kaufpreis des Produkts erstatten.
(2) Punkt (1) oben gilt nur, wenn Koei Tecmo Ihren Kauf des Produkts verifizieren kann. Wenn Koei Tecmo Ihnen gemäß Punkt (1) oben den Kaufpreis des Produkts erstattet, müssen Sie das Produkt von dem Computer, auf dem es installiert ist, vollständig löschen.  
(3) Punkt (1) oben gilt nicht, wenn die Fehlfunktion oder der Mangel des Produkts durch eine der folgenden Ursachen bedingt ist:
・	eine gegen die Bedingungen dieser Vereinbarung verstoßende Nutzung des Produkts;
・	eine durch Sie erfolgte Modifikation oder Abänderung des Produkts oder Kombination des Produkts mit einem anderen Produkt;
・	eine durch Sie erfolgte vorsätzliche oder fahrlässige Fehlnutzung des Produkts oder eine andere Nutzung unter abnormalen Bedingungen des Produkts; oder
・	ein Mangel oder eine Fehlfunktion des Computers, auf dem das Produkt installiert ist, oder anderer mit dem Computer verbundener Hardware oder eine Nichterfüllung der für die Nutzung des Produkts erforderlichen Systemanforderungen oder Kommunikationstechnologien durch den Computer.
(4) DAS PRODUKT WIRD "WIE BESEHEN" BEREITGESTELLT.  KOEI TECMO GIBT KEINERLEI AUSDRÜCKLICHE, STILLSCHWEIGENDE ODER SONSTIGE GEWÄHRLEISTUNG HINSICHTLICH DER VOLLSTÄNDIGKEIT, KORREKTHEIT, NÜTZLICHKEIT, LEISTUNG ODER ANGEMESSENHEIT DES PRODUKTS, INSBESONDERE KEINE GEWÄHRLEISTUNG DER EIGNUNG FÜR EINEN BESTIMMTEN ZWECK ODER DER FREIHEIT VON BUGS ODER ANDEREN MÄNGELN.
(5) Koei Tecmo kann Teile des Produkts jederzeit modifizieren (insbesondere durch Bereitstellung von Updateprogrammen), ohne Sie vorher darüber in Kenntnis zu setzen. UNTER KEINEN UMSTÄNDEN HAFTET KOEI TECMO FÜR SCHÄDEN ODER ENTGANGENE GEWINNE, DIE IHNEN DURCH EINE DERARTIGE MODIFIZIERUNG DES PRODUKTS ENTSTEHEN. 
(6) SOWEIT NACH GELTENDEM RECHT ZULÄSSIG UND SOWEIT IN DIESER VEREINBARUNG NICHT AUSDRÜCKLICH ANDERWEITIG FESTGELEGT, HAFTET KOEI TECMO UNTER KEINEN UMSTÄNDEN FÜR BEILÄUFIG ENTSTANDENE, INDIREKTE, KONKRETE, MITTELBARE ODER ZUKÜNFTIGE SCHÄDEN ODER VERLUSTE ODER ÄHNLICHES, DIE IHNEN DURCH DIE NUTZUNG, DIE UNMÖGLICHKEIT DER NUTZUNG ODER DIE EINSTELLUNG DES PRODUKTS ENTSTEHEN, SELBST WENN KOEI TECMO AUF DIE MÖGLICHKEIT SOLCHER SCHÄDEN ODER VERLUSTE HINGEWIESEN WURDE ODER SOLCHE SCHÄDEN ODER VERLUSTE NACH VERNÜNFTIGEN MAßSTÄBEN VORHERSEHBAR GEWESEN WÄREN. SOWEIT NACH GELTENDEM RECHT ZULÄSSIG ÜBERSTEIGT DIE HAFTUNG VON KOEI TECMO AUS DIESER VEREINBARUNG IHNEN GEGENÜBER UNTER KEINEN UMSTÄNDEN DEN TATSÄCHLICH VON IHNEN FÜR DAS PRODUKT ENTRICHTETEN KAUFPREIS, SOFERN DIE HAFTUNG NICHT DURCH VORSÄTZLICHES FEHLVERHALTEN ODER FAHRLÄSSIGKEIT UNSERERSEITS BEGRÜNDET IST. 

4. Customer Support
You agree and acknowledge that Koei Tecmo shall provide you with customer support for the Product subject to the following terms and conditions:
・	Koei Tecmo shall provide you with customer support for the Product only for the period of three (3) years from its commercial launch date; 
・	Any inquiries with respect to the Product from you to our customer support division shall be made by a phone call or filling out a web form specified by Koei Tecmo;
・	Please see the Product’s user manual for the contact of Koei Tecmo’s customer support;
・	Koei Tecmo shall, at its own discretion, determine whether to answer and what to answer to your inquiry;
・	We might not answer depending on your inquiry; and
・	KOEI TECMO MAKES NO WARRANTIES OF ANY KIND, EXPRESS, IMPLIED OR OTHERWISE, REGARDING THE COMPLETENESS, ACCURACY, USEFULNESS, PERFORMANCE, OR APPROPRIATENESS OF KOEI TECMO’S ANSWER TO YOUR INQUIRY.

4. Kundendienst
Sie erklären sich damit einverstanden, dass Koei Tecmo Ihnen gemäß den folgenden Bedingungen Kundendienst für das Projekt bereitstellt:
・	Koei Tecmo stellt Ihnen lediglich für einen Zeitraum von drei (3) Jahren nach offiziellem Verkaufsstart des Produkts Kundendienst für das Produkt bereit; 
・	alle Ihre Anfragen an unseren Kundendienst in Bezug auf das Produkt erfolgen durch einen Telefonanruf oder durch das Ausfüllen eines von Koei Tecmo bereitgestellten Webformulars;
・	die Kontaktdaten des Kundendiensts von Koei Tecmo entnehmen Sie dem Handbuch des Produkts;
・	Koei Tecmo entscheidet nach seinem alleinigen Ermessen, ob und was es auf Ihre Anfrage antwortet;
・	je nach Art der Anfrage behalten wir uns das Recht vor, keine Antwort erteilen zu müssen; und
・	KOEI TECMO GIBT KEINERLEI AUSDRÜCKLICHE, STILLSCHWEIGENDE ODER SONSTIGE GEWÄHRLEISTUNG HINSICHTLICH DER VOLLSTÄNDIGKEIT, KORREKTHEIT, NÜTZLICHKEIT, LEISTUNG ODER ANGEMESSENHEIT VON KOEI TECMOS ANTWORT AUF IHRE ANFRAGE.

5. Registration for use of the Product
(1) In order to use the Product, you need to install the Steam client software and complete the Steam registration (including creating a Steam account). 
(2) If you haven’t installed the Steam client software, you need to install the Steam client software in order to use the Product.
(3) If you haven’t completed the Steam registration (including creating a Steam account), you need to complete the Steam registration (including creating a Steam account) accepting STEAM SUBSCRIBER AGREEMENT in order to use the Product.

5. Registrierung für die Nutzung des Produkts
(1) Um das Produkt zu nutzen, müssen Sie die Steam-Client-Software installieren und die Steam-Registrierung (inklusive Anlegen eines Steam-Kontos) abschließen. 
(2) Wenn Sie die Steam-Client-Software noch nicht installiert haben, müssen Sie die Steam-Client-Software installieren, um das Produkt zu nutzen.
(3) Wenn Sie die Steam-Registrierung (inklusive Anlegen eines Steam-Kontos) noch nicht abgeschlossen haben, müssen Sie die Steam-Registrierung (inklusive Anlegen eines Steam-Kontos) abschließen und die STEAM-ABONNEMENTVEREINBARUNG annehmen, um das Produkt zu nutzen.

6. The Internet connection for use of the Product
(1) When you install the Steam client software and complete the Steam registration set forth in Article 5 above, you shall prepare all necessary hardware/service and bear and pay all necessary charge for internet service provider, communication expense, etc.
(2) You agree that certain information on your computer will be sent and Koei Tecmo may collect and use such information if you install the Steam client software and complete the Steam registration set forth in Article 5 above.

6. Internetverbindung für die Nutzung des Produkts
(1) Wenn Sie gemäß Abschnitt 5 oben die Steam-Client-Software installieren und die Steam-Registrierung abschließen, bereiten Sie alle notwendigen Hardwaregeräte/Dienste vor und tragen alle notwendigen Kosten für Internetanschluss, Datenübertragung und andere Kosten dieser Art.
(2) Sie erklären sich damit einverstanden, dass bestimmte Informationen von Ihrem Computer übertragen werden und dass Koei Tecmo diese Informationen erfassen und nutzen kann, wenn Sie gemäß Abschnitt 5 oben die Steam-Client-Software installieren und die Steam-Registrierung abschließen.

7. Termination of this Agreement
Koei Tecmo may immediately terminate the license hereunder in case of your breach hereof. In this case, you shall, according to Koei Tecmo’s instructions, delete the Product (including all components and copies thereof) from the computer (including a hard drive or other storage device) on which the Product is installed. 

7. Kündigung dieser Vereinbarung
Koei Tecmo hat das Recht, diese Lizenzvereinbarung fristlos zu kündigen, wenn Sie gegen die darin enthaltenen Bedingungen verstoßen. In diesem Fall löschen Sie gemäß der Anweisungen von Koei Tecmo das Produkt (einschließlich aller Komponenten und Kopien) von dem Computer (einschließlich der Festplatte oder eines anderen Speichermediums), auf dem das Produkt installiert ist. 

8. Export Control
You shall not export, directly or indirectly, the Product in whole or in part in any form, to any country without first obtaining necessary export license or other governmental approval of Japanese government or the relevant country’s government.

8. Ausfuhrbeschränkung
Sie dürfen das Produkt weder vollständig noch in Teilen sowie weder direkt noch indirekt in andere Länder ausführen, ohne zuvor die notwendige Ausfuhrerlaubnis oder sonstige Regierungsgenehmigung von der Regierung Japans bzw. des relevanten Staates eingeholt zu haben.

9. General Provisions
(1) If any provision of this Agreement or part thereof is held to be invalid or unenforceable under any laws or regulations, the remaining provisions hereof shall remain in full force and effect.
(2) This Agreement shall be governed by the laws of Japan.
(3) In the event of any dispute, this English version of this Agreement shall prevail over any other language versions.
(4) Any and all disputes arising out of or in connection with this Agreement shall be submitted to the exclusive jurisdiction of the Tokyo District Court in the first instance.

9. Allgemeine Bestimmungen
(1) Sollten einzelne Bestimmungen dieser Vereinbarung unwirksam oder undurchführbar sein oder nach Inkrafttreten der Vereinbarung unwirksam oder undurchführbar werden, bleibt davon die Wirksamkeit der Vereinbarung im Übrigen unberührt.
(2) Diese Vereinbarung unterliegt den Gesetzen Japans.
(3) Bei Streitigkeiten gilt ausschließlich die englische Fassung dieser Vereinbarung, alle übrigen Sprachfassungen dienen lediglich dem groben Verständnis.
(4) Sämtliche Streitigkeiten im Zusammenhang mit dieser Vereinbarung unterliegen in erster Instanz der alleinigen und ausschließlichen Gerichtsbarkeit des Bezirksgerichts von Tokio.
