This End User License Agreement ("Agreement") governs your use of the video game "Watching the Sky" ("Product"), including all related software, files, content, updates, and digital materials provided with or for the Product.

By installing, accessing, or using the Product, you agree to be bound by this Agreement. If you do not agree to this Agreement, do not install, access, or use the Product.
1. LICENSE GRANT
Subject to your compliance with this Agreement, the Developer grants you a limited, non-exclusive, non-transferable license to install and use the Product for personal entertainment purposes on supported devices and platforms.
This Agreement does not transfer ownership of the Product or any part of it to you. All rights not expressly granted to you remain with the Developer or the respective rights holders.
2. RESTRICTIONS
You may not, except where expressly permitted by applicable law or by the applicable distribution platform:
(a) sell, rent, lease, sublicense, distribute, or otherwise transfer the Product or any copy of it;
(b) copy, reproduce, or publicly distribute the Product;
(c) reverse engineer, decompile, disassemble, or attempt to derive the source code of the Product;
(d) modify, adapt, translate, or create derivative works based on the Product;
(e) remove, alter, or obscure copyright, trademark, or proprietary notices;
(f) use the Product for unlawful purposes;
(g) bypass, disable, or interfere with technical protection measures;
(h) use cheats, exploits, bots, automation, or unauthorized tools that alter the intended operation of the Product.
Mandatory rights granted to you by applicable law remain unaffected.
3. VIDEOS, STREAMING, AND USER CONTENT
You may create, publish, and monetize videos, livestreams, screenshots, reviews, and other similar content featuring the Product, provided that such content does not misrepresent the Product, imply endorsement by the Developer, contain unlawful material, or violate the rights of third parties.
This permission does not transfer ownership of the Product, its assets, music, logos, trademarks, or other protected materials to you.
4. OWNERSHIP AND INTELLECTUAL PROPERTY
The Product, including but not limited to its software, graphics, audio, music, text, designs, gameplay systems, logos, names, and other creative materials, is protected by copyright, trademark, and other intellectual property laws.
All rights, title, and interest in and to the Product remain with the Developer or the respective rights holders.
5. UNREAL ENGINE AND EPIC GAMES
The Product was developed using Unreal Engine. Unreal Engine is a technology owned by Epic Games, Inc. and/or its affiliates.
Epic Games, Inc. and its affiliates are not parties to this Agreement and have no obligation to you in relation to the Product, including but not limited to any obligation to provide support, maintenance, updates, warranties, refunds, or other services.
To the maximum extent permitted by applicable law, all representations, warranties, conditions, and liabilities related to Unreal Engine are expressly disclaimed. This includes, but is not limited to, any express or implied warranties or conditions of merchantability, fitness for a particular purpose, title, non-infringement, compatibility, performance, security, availability, or error-free operation.
To the maximum extent permitted by applicable law, Epic Games, Inc., its affiliates, licensors, service providers, and suppliers shall not be liable to you for any claims, damages, losses, liabilities, costs, or expenses arising out of or in connection with Unreal Engine or its use in the Product.
Nothing in this Agreement grants you any separate license to use Unreal Engine outside of the Product.
Unreal, Unreal Engine, Epic Games, and their respective logos are trademarks or registered trademarks of Epic Games, Inc. in the United States and elsewhere.
6. THIRD-PARTY SOFTWARE AND SERVICES
The Product may include or use third-party software, middleware, tools, services, or platform features. Such third-party components may be subject to separate terms and conditions.
Your use of third-party platforms, including but not limited to Steam or other digital distribution services, is also subject to the terms, rules, and policies of those platforms.
7. NO WARRANTY
The Product is provided "as is" and "as available."
The Developer does not warrant that the Product will be uninterrupted, error-free, secure, compatible with every hardware or software configuration, or free from defects.
Nothing in this Agreement limits or excludes any mandatory rights you may have under applicable consumer protection laws.
8. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to loss of data, loss of profits, loss of business, loss of goodwill, or hardware or software issues arising from the use of or inability to use the Product.
The Developer's liability for intent, gross negligence, injury to life, body, or health, and mandatory statutory liability remains unaffected where such liability cannot legally be excluded or limited.
9. UPDATES AND CHANGES
The Developer may provide updates, patches, fixes, changes, or additional content for the Product.
The Product may change over time. Features may be added, modified, or removed where permitted by applicable law.
Unless required by applicable law or expressly agreed otherwise, the Developer is not obligated to provide updates, maintenance, or support.
10. PLATFORM TERMS
If you obtain the Product through a third-party platform, such as Steam, the Epic Games Store, or another digital distribution service, your use of the Product may also be subject to that platform's terms, rules, and policies.
In the event of a conflict between this Agreement and mandatory platform terms, the applicable platform terms may prevail to the extent required.
11. TERMINATION
This Agreement remains effective until terminated.
Your rights under this Agreement will terminate automatically if you materially breach its terms. Upon termination, you must stop using the Product and delete any copies in your possession where legally and technically possible.
12. GOVERNING LAW
This Agreement shall be governed by the laws of the Federal Republic of Germany, excluding its conflict of law rules and the United Nations Convention on Contracts for the International Sale of Goods.
Mandatory consumer protection laws of your country of residence remain unaffected.
13. SEVERABILITY
If any provision of this Agreement is found to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect. The invalid, unlawful, or unenforceable provision shall be interpreted, to the extent permitted by applicable law, in a manner that comes as close as possible to the original purpose of the provision. Nothing in this section limits any mandatory rights you may have under applicable law.

The invalid, unlawful, or unenforceable provision shall be interpreted, to the extent permitted by applicable law, in a manner that comes as close as possible to the original purpose of the provision. Nothing in this section limits any mandatory rights you may have under applicable law.
