                GRANT
                LICENTIEVERLENING.<br>1.1 UBISOFT (of haar licentieverleners) verleent u hierbij een niet-exclusieve, niet-overdraagbare, niet-commerciële en persoonlijke licentie, zonder het recht om sublicenties te verlenen (hierna verder te noemen: "Licentie") om het Product (geheel of gedeeltelijk) of ieder Product (hierna de Licentie) te installeren en/of te gebruiken gedurende de tijd totdat ofwel u ofwel UBISOFT deze EULA beëindigt. Het is u in geen geval toegestaan en u mag anderen niet toestaan om het Product of deze Licentie voor commerciële doeleinden te gebruiken zonder een licentie daartoe van UBISOFT verkregen te hebben. Updates, upgrades, patches en wijzigingen kunnen nodig zijn om het Product op sommige hardware te kunnen blijven gebruiken. DIT PRODUCT IS GELICENTIEERD EN DERHALVE NIET VERKOCHT AAN U.<br><br>Indien dat van toepassing is, kunnen bepaalde onderdelen van het Product functionaliteiten van derden gebruiken, waarvan sommige beheerd worden door derde providers waarvoor aanvullende voorwaarden en/of kosten kunnen gelden. U dient aan deze aanvullende voorwaarden te voldoen (bijvoorbeeld indien het Product een VoIP-applicatie bevat, dan moet u voldoen aan de bijbehorende overeenkomst voor draadloze gegevensoverdracht wanneer u het Product gebruikt). Neem aandachtig kennis van deze aanvullende bepalingen en kosten.<br><br>1.2 Het is u niet toegestaan om, direct of indirect (i) het Product of enige onderdelen daarvan commercieel te verkopen, verhuren, leasen, licentiëren, distribueren, verhandelen of exploiteren; (ii) dit Product geheel of gedeeltelijk te onderwerpen aan reverse engineering, dit Product te decompileren, ontmantelen, aan te passen, te reproduceren of afgeleide werken daarvan te creëren (tenzij indien het Product u in de gelegenheid stelt om via een specifieke functionaliteit door gebruikers gegenereerde content te creëren, genereren of in te dienen waarvoor u een account moet aanmaken en aan de Gebruiksvoorwaarden moet voldoen); (iii) “auto”, “trainer”, “script” of "macro” computerprogramma’s of enige andere “cheat” of “hack” programma’s of softwaretoepassingen voor dit Product te creëren, te gebruiken en/of te distribueren (ongeacht of dat in een online game met meerdere spelers, in een game met één speler over het internet of binnen een lokaal netwerk plaatsvindt); (iv) enige indicaties van auteursrechten of handelsmerken of indicaties van ander auteurschap en oorspronkelijke informatie, kennisgevingen of labels op of binnen het Product te verwijderen, te veranderen, ongedaan te maken of te omzeilen; en (v) dit Product of enige kopie of aanpassing daarvan te onderwerpen aan uitvoer of wederuitvoer in schending van enige toepasselijke wet- en regelgeving.<br><br>1.3 Bij het gebruik van het Product komt u overeen dat u zich zult houden aan alle toepasselijke wetten, regels en regelgevingen. U komt tevens overeen om te voldoen aan bepaalde gedragsregels die van toepassing zijn op uw gebruik van het Product (hierna verder te noemen: "Gedragsregels"), die niet uitputtend zijn en die te allen tijde door UBISOFT gewijzigd kunnen worden. In alle gevallen mag u het Product uitsluitend gebruiken in overeenstemming met het geanticipeerde gebruik van het Product.<br><br>Als voorbeeld, en zonder beperking van de rechten van UBISOFT om actie tegen u te ondernemen, is het u niet toegestaan:<br><br>a. Enig materiaal (tekst, woorden, beelden, geluiden, video’s, etc.) aan te maken, te gebruiken, te delen en/of te publiceren door enig middel in verband met het Product, waarbij een geheimhoudingsplicht geschonden wordt, een intellectueel eigendomsrecht of een privacyrecht van een individu geschonden wordt of aangezet wordt tot het plegen van een onrechtmatige daad (in het bijzonder piraterij, kraken of verspreiding van namaaksoftware);<br><br>b. De normale functionering van het gehele of een gedeelte van het Product, of de toegankelijkheid daarvan voor andere gebruikers, of de functionering van de partnernetwerken van het Product te wijzigen, verstoren, blokkeren, abnormaal te belasten, te onderbreken, te vertragen en/of te hinderen, of een poging te doen tot voornoemde;<br><br>c. Enig virus, Trojaans paard, worm, bom, beschadigd bestand en/of een vergelijkbaar vernietigend systeem of vergelijkbare beschadigde data in verband met het Product over te zenden of te propageren, en/of om op enige wijze een aanval op de servers en/of het Product van UBISOFT en/of die van haar serviceproviders en partners te organiseren, daaraan deel te nemen of daarbij betrokken te zijn;<br><br>d. Alternatieve methoden van gebruik van de Producten, bijvoorbeeld serveremulatoren, te creëren, te leveren of te gebruiken;<br><br>e. In chats te spammen, of dat nu voor persoonlijke of commerciële doeleinden is, door de conversatiestroom te onderbreken met herhaalde postings van een zelfde aard;<br><br>f. Enige materiaal of content door te sturen of te communiceren die, uitsluitend te beoordelen door UBISOFT, geacht wordt beledigend te zijn, inclusief zonder beperking taal die schadelijk, dreigend, onwettig, beledigend, intimiderend, lasterlijk, kleinerend, obsceen, seksueel expliciet, discriminerend, of etnisch of anderszins ontoelaatbaar is;<br><br>g. Enige andere gebruikers van het Product te intimideren of te bedreigen;<br><br>h. Oneigenlijk gebruik te maken van de helpdienst of de claimknoppen, of onware rapporten te sturen naar leden van het personeel van UBISOFT;<br><br>i. Valselijk te beweren een werknemer of vertegenwoordiger van UBISOFT of haar partners en/of agenten te zijn;<br><br>j. Valselijk een goedkeuring in verband met het Product of met UBISOFT te claimen.<br><br>2. EIGENDOMSRECHT.<br>Elke aanspraak, alle eigendomsrechten en intellectuele eigendomsrechten in en op het Product (inclusief, zonder beperking, alle tekst, grafische voorstellingen, muziek of geluid, alle berichten of informatie, fictieve karakters, namen, thema’s, objecten, decors, kostuums, effecten, dialogen, slagzinnen, plaatsen, karakters, diagrammen, concepten, choreografieën, video’s, audiovisuele effecten, domeinnamen en alle overige elementen die deel uitmaken van het Product, afzonderlijk of gecombineerd) en alle kopieën daarvan zijn de eigendom van USIFOFT of haar licentieverleners. Het Product is beschermd door nationale en internationale wetten, auteursrechtverdragen en conventies en overige wetten. Dit Product kan bepaalde gelicentieerde materialen bevatten en de licentieverleners van UBISOFT kunnen, in dat geval, hun rechten beschermen in geval van enige schending van onderhavige EULA. Elke reproductie of representatie van deze gelicentieerde materialen op enige wijze en om welke reden dan ook is verboden zonder de voorafgaande toestemming van UBISOFT en, indien van toepassing, die van de licentieverleners en vertegenwoordigers van UBISOFT. Tenzij uitdrukkelijk uiteengezet in deze EULA, zijn alle rechten die niet krachtens deze Overeenkomst aan u verleend worden, uitdrukkelijk voorbehouden door UBISOFT.<br><br>Deze Licentie verstrekt geen aanspraak of eigendomsrecht op het Product en kan niet geïnterpreteerd worden als een verkoop van enige rechten op het Product.<br><br>3. TOEGANG TOT HET PRODUCT<br>3.1 HET PRODUCT WORDT BESCHERMD DOOR DIGITAL RIGHTS MANAGEMENT SOFTWARE (“DRM SOFTWARE”) EN DENUVO ANTI-SABOTAGE-TECHNOLOGIE (“ANTI-SABOTAGE-TECHNOLOGIE”). U KOMT HIERBIJ OVEREEN, NEEMT KENNIS VAN EN STEMT IN MET HET VOLGENDE MET BETREKKING TOT DE DRM SOFTWARE: (I) DOOR DE INSTALLATIE VAN HET PRODUCT ZAL DE DRM SOFTWARE OP UW COMPUTER GEÏNSTALLEERD WORDEN; (II) DE DRM SOFTWARE KAN HET AANTAL INSTALLATIES VAN HET PRODUCT BEPERKEN; (III) DE DRM SOFTWARE KAN AANVULLENDE ONDERDELEN OP UW COMPUTER INSTALLEREN DIE VEREIST ZIJN VOOR KOPIEERBESCHERMING; EN (IV) GEDURENDE DE INSTALLATIE EN/OF DE EERSTE LANCERING VAN HET PRODUCT, KAN EEN ONLINE VERBINDING VEREIST ZIJN OM HET PRODUCT VIA DE DRM SOFTWARE TE ONTGRENDELEN EN (V) SOMMIGE BESTANDEN VAN DE ANTI-SABOTAGE-TECHNOLOGIE KUNNEN ACHTERBLIJVEN OP UW COMPUTER ZELFS NADAT HET PRODUCT IS VERWIJDERD.<br><br>IN GEEN GEVAL ZAL UBISOFT AANSPRAKELIJK ZIJN IN VERBAND MET DE COMPONENTEN DIE DOOR ENIGE DRM SOFTWARE

ER KUNNEN LEEFTIJDSBEPERKINGEN GELDEN VOOR TOEGANG TOT ONLINE DIENSTEN EN FUNCTIES IN OVEREENSTEMMING MET DE LOKALE WETGEVING.<br><br>3.2 Indien u het Product op een Compatibele Mobiele Terminal gebruikt, is dit artikel 3.2 van toepassing op u en uw gebruik van het Product:<br><br>Ten behoeve van deze EULA duidt de term “Compatibele Mobiele Terminal" elk draagbaar apparaat aan dat in staat is om verbinding te maken met het internet om toegang te krijgen tot de Producten. De term Compatibele Mobiele Terminals dekt met name mobiele telefoons, smartphones, tablets en persoonlijke digitale assistenten (PDA’s).<br><br>a. Toegang tot het Product. Om het Product op een Compatibele Mobiele Terminal te gebruiken, moet u toegang hebben tot een elektronisch communicatienetwerk. De verbindingskosten (inclusief, zonder beperking, de kosten van mobiele providers en/of dragers) zijn uitsluitend voor uw rekening. U erkent hierbij dat de kwaliteit van de Producten, de responsietijd of de toegang tot bepaalde functionaliteiten afhankelijk kan zijn van de capaciteiten van uw Compatibele Mobiele Terminal en van het elektronische communicatienetwerk.

UBISOFT maakt gebruik van analytische tools van derden om informatie met betrekking tot de gaming gewoonten en het gebruik van het

You also agree to comply with certain rules of conduct that govern Your use of the Product (“Rules of Conduct”), which are not meant to be exhaustive and can be modified at any time by UBISOFT. OWNERSHIP.<br>All title, ownership rights and intellectual property rights in and to the Product (including, without limitation, all text, graphics, music or sounds, all messages or items of information, fictional characters, names, themes, objects, scenery, costumes, effects, dialogues, slogans, places, characters, diagrams, concepts, choreographies, videos, audio-visual effects, domain names and any other elements which are part of the Product, individually or in combination) and any and all copies thereof are owned by UBISOFT or its licensors. The Product is protected by national and international laws, copyright treaties and conventions and other laws.
