MAGIX 제품을 위한 라이선스 동의(EULA)

1. 정의:

이 라이선스 동의의 범위에서는 다음 정의가 적용됩니다:

1.1 "MAGIX 제품"은 이 동의에서 허가되는 제품을 지칭하며, 소프트웨어와 경우에 따라 다른 컨텐츠로 구성됩니다.

1.2 "소프트웨어"란 MAGIX 제품에 포함되고 이 동의에서 허가되는 오브젝트 코드 포맷의 컴퓨터 프로그램을 지칭하며, 동봉된 컨텐츠를 제외하고 모든 업데이트와 업그레이드를 포함합니다.

1.3 이 동의에서 "컨텐츠"라 함은 소프트웨어 외에 MAGIX 제품에 포함된 컨텐츠로, 음악 파일, 비디오 파일, 사진 파일, 기타 사운드 및 이러한 파일이 포함된 템플릿을 말합니다.

1.4 "컴퓨터"라 함은 CPU 또는 멀티 코어 프로세스와 연동하여 프로그래밍 가능한 연산 규정을 이용하여 데이터를 처리할 수 있는 물리적 장치 또는 가상의 장치(예: PC, 노트북, 워크스테이션, 가상 기계의 엔티티 등)를 지칭합니다. 네트워크에는 다음 사항이 적용됩니다: MAGIX 제품이 설치되어 있는 서버에 다양한 네트워크 컴퓨터가 액세스하는 경우, 각각의 이 네트워크 컴퓨터(워크스테이션)가 이 라이선스 동의의 범위에서 컴퓨터로 간주됩니다. 즉, 경우에 따라 각각의 네트워크 컴퓨터에 대해 별도의 라이선스가 필요합니다.

1.5 이 동의의 범위에서 "업그레이드"는 MAGIX 제품의 보완 버전입니다.

1.6 "라이선스 위치"는 고객의 특정 컴퓨터에 MAGIX 제품 활성화 후 할당된 라이선스를 지칭합니다.

1.7 이 동의에서 "상업적 목적"이라 함은 소프트웨어 또는 컨텐츠를 상업적으로 이용하고 소프트웨어 또는 컨텐츠를 통해 직간접적인 금전적 이익을 추구하는 것을 말합니다(예: 판매 또는 라이센싱을 통해, 인터넷에 공개 시 광고 연결 등).

2. 계약 대상:

2.1 MAGIX는 여러분("고객")에게 이 동의에서 언급하는 조건 하에서 계약의 유효 기간 동안 비독점적이며 재실시가 불가한, 해당 MAGIX 제품을 시리얼 번호에 저장된 개수의 컴퓨터에서 사용할 권한을 보장합니다. 지적 재산권 및 소프트웨어에 대한 기타 피보호권은 MAGIX에 있습니다. 귀하는 소프트웨어, 컨텐츠, 백업 파일 및 기록에 대한 MAGIX의 지적 재산권에 동의합니다. 계약에 따라 MAGIX 제품을 사용할 책임은 소프트웨어 구매자에게 있습니다.

2.2 업그레이드와 관련하여 다음 사항이 적용됩니다: 기본 제품 소유권자만 각 업그레이드에 대해 권한이 있습니다. 업그레이드 이용은, 귀하가 기본 제품의 소유권자이며 사용자인가에 좌우됩니다. 따라서 제3자에게 업그레이드를 별도로 전달하는 것은 허용되지 않습니다.

2.3 MAGIX 업데이트 보증의 범위에서 전달되는 업데이트와 기능에 대해 다음이 적용됩니다: MAGIX 제품 최초 등록 후 12개월 이내에 제공된 업데이트 및 기능에 대한 라이선스는 12개월이 경과하는 시점으로 제한됩니다. 업데이트 보증이 12개월을 넘어 연장되는 경우, 이러한 제한은 없어집니다.

5. 소프트웨어 및 컨텐츠의 상업적 이용

5.1 소프트웨어
이 소프트웨어는 6번의 제한 사항을 조건으로 상업적으로 이용할 수 있습니다.

5.2 컨텐츠
a) 컨텐츠는 6번의 제한 사항을 조건으로 하여, 이 컨텐츠로 고유한 작업 결과물을 만드는 경우에 한해 상업적 목적으로 사용할 수 있습니다. 이는 MAGIX 제품을 통해 획득한 음악 파일, 비디오 파일 또는 사진 파일과 적합한 템플릿에도 적용됩니다.

b) 이 소프트웨어를 이용하여 만든 작업 결과물과 상관없이 컨텐츠 그 자체를 사용하는 것은 어떤 경우이든 허용되지 않습니다. 특히 템플릿에 포함된 사진은 별도로 사용하기 위해 템플릿에서 추출하면 안 됩니다. 이는 상업적 목적뿐만 아니라 비상업적 목적에도 적용됩니다.

6. 복사 및 대여 금지; 변경 금지

6.1 귀하에게는 MAGIX 제품 및 서식 자료를 전체 또는 그 일부라도 복사할 권한이 없습니다. 백업을 위해 사본을 만드는 것은 예외적으로 허용됩니다.

6.2 MAGIX 제품 및 서식 자료를 절대 영리를 위해 빌려주거나 기타 형태로 영리를 위해 제3자에게 대가를 받고 일시적으로 제공하면 안 됩니다. 이는 영리를 목적으로 대가를 받고 제3자에게 제공한 컴퓨터에 사전 설치한 형태로 임대하는 것에도 적용됩니다.

6.3 §§ 69 d, e UrhG에 따라 소프트웨어를 직접 변경하거나 제3자를 통해 변경하면 안 됩니다. 또한 귀하는 본 소프트웨어를 구성 요소로 분해하거나, 목적 코드로 변환하거나, 디코드하거나, 모방하거나 또는 계약에 규정된 방식 외의 방식으로 이용해서는 안 됩니다.

8. 보증 및 책임:

8.1 최신 기술에 따라 소프트웨어 프로그램 및 관련 기록에서 오류를 배제할 수 없고, 모든 사용 조건 및 고객의 모든 요구 사항에 대해 오류가 없도록 또는 오류 없이 모든 제3의 프로그램 및 하드웨어와 협업할 수 있도록 데이터 처리 프로그램을 개발하는 것이 불가능하다는 점을 알려 드립니다. 따라서 MAGIX는 특정한 속성을 약속하거나 개별적으로 고객이 계획한 용도에 적합하다고 보장하지 않습니다.

8.2 유상의 제품 및 서비스의 경우, MAGIX는 대리인에 의해 초래된, 가벼운 부주의로 인한 손상에 대해, 계약을 벗어난 경우에도, 계약의 목적을 달성하기 위해 준수하는 것이 특히 중요한 의무(주요 의무)가 손상된 경우, 그리고 생명 및 신체 또는 건강을 해친 경우에 한해 보상 책임을 집니다.

8.3 MAGIX가 기본적인 의무를 위반한 결과로 고객이 손해를 입은 경우, 고의 또는 중대한 과실로 인해 생명에 치명적인 상해나 신체에 대한 상해, 건강에 대한 위험이 발생하여 책임을 져야 하는 경우를 제외하고, 손해 배상은 본 계약의 범위 내에서 일반적으로 예상되는 범위에 한정됩니다.

8.4 MAGIX는 고객이 통제할 수 있는 손상이나 합리적인 조치를 통해 고객이 막을 수 있는 손해에 대해서는 배상하지 않습니다. 데이터가 손실되는 경우, MAGIX는 백업 복사본이 있는 경우에 필요한 복구 작업에 대한 비용만을 배상합니다.

8.5 위 규정에도 불구하고, MAGIX의 배상 의무는 어떤 경우이든 라이선스 비용의 4배 또는 각 손해 사례당 구매 비용의 4배로 제한됩니다. MAGIX의 고의 또는 중과실에 의하여 야기된 손실에 대해서는 이러한 책임 면제가 적용되지 않습니다.

8.6 제품과 서비스를 무료로 제공하는 경우, 물적 및 법률적 결함에 대한 보증은 무료 라이선스 부여임을 고려하여 그러한 결함에 대해 MAGIX이 악의적으로 침묵한 경우로 제한됩니다. MAGIX의 기타 다른 책임은 무료 라이선스 부여임을 고려하여 고의와 중과실의 경우로 제한됩니다.

8.7 제조물 책임법에 따른 배상 책임은 영향을 받지 않습니다.

8.8 고객이 입은 손해를 증명하는 책임에 대한 문제는 상기 규정과 관련이 없습니다.

8.9 MAGIX 제품이 온라인 서버를 통해 진행되는 기능을 포함하는 한, MAGIX는 언제든지 프로그램을 조정할 권한이 있습니다. 가용성이 보장되지 않습니다.

9. 타 제조사의 라이선스 규정:

MAGIX 제품이 타 제조사의 소프트웨어나 컨텐츠 또는 제3의 공급자의 링크를 포함하는 한, 제3의 공급자의 라이선스 이용 약관에도 유의해야 합니다. MAGIX 제품이 오픈 소스에 라이선스가 있는 소프트웨어 또는 컨텐츠를 포함하는 경우, 이러한 구성 요소에 대해 예를 들면 이러한 구성 요소의 편집 및 처리에 대해 각각의 오픈 소스 라이선스 이용 약관이 적용됩니다. 각각의 라이선스 이용 약관은 동봉한 파일에서 볼 수 있습니다.

MAGIX는 등록 사용자에게 보장 기간 동안 전자 인터넷 지원을 제공합니다. 이러한 지원에는 설치 관련 질문에 대한 답변이나 설치 시 발생한 문제의 해결을 인터넷이나 전자우편을 통해 제공하는 것이 포함됩니다. 기술 지원은 MAGIX의 재량에 따라 제공되며, 결코 품질 보증 또는 보상 서비스와 관련이 없습니다.

11. 기타:

11.1 본 동의는 계약 대상과 관련한 당사자들의 전체 협약입니다. 구두 약속은 없습니다. MAGIX 또는 MAGIX 소속 직원의 구두 설명은 어떤 경우에도 본 라이선스 약정의 효력을 변경하지 않으며 또한 본 약정에 이의를 제기하는 근거가 될 수 없습니다.

11.2 이 협약의 하나 또는 여러 규정이 무효이거나 무효가 되어도 협약의 나머지 규정이 가지는 효력은 영향을 받지 않습니다. 무효한 규정 대신 의도한 목적에 되도록 가장 가까이 근접한 대체 규정이 적용됩니다. 독일연방공화국의 법률이 적용됩니다.
