End User License Agreement (EULA) for "Transience" Game

This End User License Agreement ("EULA") is a legal agreement between you and Resurgent Games Ltd. ("Resurgent Games") for the use of the game "Transience" and its related content ("Game"). By installing, accessing, or using the Game, you agree to be bound by the terms and conditions of this EULA.

Copyright © December 2025 Resurgent Games Ltd. All rights reserved. "Transience" and the Resurgent Games Ltd. logo are trademarks of Resurgent Games Ltd. All other trademarks and trade names are the property of their respective owners.

Ownership of Intellectual Property:
Resurgent Games Ltd. holds all intellectual property rights related to the Game, including but not limited to game design, artwork, characters, storyline, music, and sound effects.

License Grant:
The Game is licensed, not sold, to you for personal, non-commercial use only. Resurgent Games Ltd. grants you a non-exclusive, non-transferable, revocable license to use the Game on your device(s) in accordance with the terms and conditions set forth in this agreement.

Restrictions:
a. You may not sublicense, lease, rent, distribute, or otherwise transfer the Game or any part of it to any third party.
b. You may not modify, reverse engineer, decompile, or create derivative works of the Game, in whole or in part.
c. You shall not use the Game for any unlawful purpose or in a manner that violates any applicable laws or regulations.

Ownership:
Resurgent Games Ltd. retains all rights, title, and interest in and to the Game, including all intellectual property rights therein.

Updates and Support:
Resurgent Games Ltd. may, at its sole discretion, provide updates, enhancements, or support for the Game. We are under no obligation to provide such updates or support.

Termination:
This license is effective until terminated. Your rights under this license will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the Game and destroy all copies in your possession or control.

Disclaimer of Warranty:
The Game is provided "as is" without warranty of any kind, and Resurgent Games Ltd. disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Game will be error-free or uninterrupted.

Limitation of Liability:
To the maximum extent permitted by applicable law, Resurgent Games Ltd. shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or in connection with the use or inability to use the Game, even if we have been advised of the possibility of such damages.

Governing Law and Dispute Resolution:
These licensing terms shall be governed by and construed in accordance with the laws of the Province of Saskatchewan, Canada. Any dispute arising under or relating to these licensing terms shall be resolved exclusively by the courts located in the Province of Saskatchewan, and you consent to the personal jurisdiction of such courts.

For information regarding the collection, use, and sharing of data when using the Game, please refer to the Privacy Policy effective December 2025 available within the Game and on the Resurgent Games Ltd. website.
