We are Flashbulb – the makers of Trailmakers! We are a Copenhagen based game developer company, located at Knabrostræde 3, 3. sal, 1210 Copenhagen K, Denmark, registered at the Danish Business Authority with company registration number: 37650706.
 
This end user license agreement (“Agreement”) is a document we would like you to read. It is about our game, Trailmakers, (“Game”) and the way you should use it. The instructions and manuals that we provide to the Game are considered part of the Game for the purpose of this Agreement. When you play our Game, the terms of this Agreement (“Terms”) apply.
 
We may decide to change some of these Terms when we think it is necessary, and we will post the changed Agreement on our website and on Steam.
 
If any future changes to this Agreement are unacceptable to you or cause you to no longer be compliant with this Agreement, you may terminate this Agreement in accordance with section 3.

1.License
We grant you a license to download, install and use the Game (“License”). The License is non-exclusive and limited.
 
When you download, install and use the Game, you accept the Terms.
This means that you do not own the Game, but you are allowed to use it in accordance with these Terms.
 
1.1 License limitations
The following limitations apply to the License
-You may only the use the Game on one device at a time
-Any kind of copying, transfer or distribution of the Game requires our permission
-Circumvention of copyright protection is prohibited and considered a copyright infringement
-Reverse engineering and decompiling is not allowed
-You may not use the Game for illegal or harmful purposes
-You may not commercialise the Game in a way not approved explicitly by us
-You may not use cheats, automation software (bots), hacks or any other unauthorized third-party software, tools or content designed to modify the Game experience
-You may not modify, translate or create derivative works based on or utilizing any parts of the Game.
 
You may permanently transfer all of your rights under this Agreement only if the recipient agrees to the Terms, and if you remove and delete the Game completely from your accounts as well as all computers and devices you possess or control.
 
2. Intellectual property
We own all rights to the Game. This includes for example the copyright to source code, characters, setting, text, dialogue and artwork, design rights to user interfaces, trademarks, patents, know-how, trade secrets, rights to names, titles and themes, etc.
 
You are not allowed to use any of our rights without our permission.

3. Termination
This Agreement is effective until terminated. You may terminate the Agreement at any time by deleting and completely removing the Game from all accounts, computer systems and devices in your possession or control.
 
We may at our own discretion give notice to terminate this Agreement in the event that we become aware that you are failing to comply with the Terms.
 
In the event of termination, you must immediately and permanently destroy the Game and all copies in your control and stored on any media whatsoever and on Flashbulb Games' request certify that you have done so.
 
4. Liability
Please do not mess with our property. If you damage some of our property - also including our source code, name, brand, trademarks, content - we will ask you to repay our losses.
 
In the quite unlikely event that our game should be causing any damage or is materially defect, we limit the amount that you may claim to the amount that we actually received from you to get a copy of our game.
 
To the maximum extent permitted by law we are not liable for any lost profits and indirect damages and for the risks connected with property damage, lost data, loss of goodwill, computer failure and errors, or loss of business or other information as a result of possessing or using the Game or by malfunction of the Game.
 
5. Limited warranty
The Game is provided "as is". To the extent permitted by applicable law, the Game is provided without any warranties of any kind.
 
We do specifically not warrant that the operation of the Game will be uninterrupted or error free or free from defects or that errors can be corrected.

Este contrato de licencia para el usuario final («Contrato») es un documento que recomendamos encarecidamente que leas. Trata sobre nuestro juego, Trailmakers («Juego»), y de la forma en la que deberías utilizarlo. Las instrucciones y manuales que proporcionamos con el Juego se consideran parte del mismo a efectos de este Contrato. Cuando juegas a nuestro Juego, se aplican las condiciones («Condiciones») de este Contrato.

6. Your remedies
If material defects in the Game should turn up, we will do what is commercially reasonable to correct the errors, and as a last resort pay back some or all of the money we received from you to get a copy of our game.
 
7. Behaviour
Our chat is not monitored or moderated systematically, and we are not responsible for any content provided by other users.
 
In any case we would like you to keep a good and appropriate language and behaviour (also) when in the world of Trailmakers. That means, for example:
-No sexual content or references
-No harassment
-No harmful or violent behaviour
-No swearing
 
If we do not approve your behaviour we may decide to shut your profile down. 
 
8. User Generated Content
Any content that you create or make available through the
Game or services related to the Game, including challenges, skins, in-game constructions, chat posts, replays, screenshots and other game customization is considered user generated content, (“UGC”).
 
If you post, upload or otherwise share any UGC, you grant us the free right to use your UGC as outlined below. We do not need further permission and no form of compensation is necessary.
 
You hereby grant to Flashbulb a worldwide,  non-exclusive, fully paid, royalty-free, irrevocable, perpetual, transferable, and sub-licensable license to use, copy, reproduce, distribute, publish, publicly perform, publicly display, modify, adapt, translate, store the UGC, and create derivative works in any form, format or medium of any kind now known or later developed.
 
You waive all moral rights you might have with respect to any UGC provided to Flashbulb, but we do credit creators of UGC in accordance with industry standard.
 
You may not create, generate, or make available through the Game any UGC to which you do not have the right to grant us such license. In addition, you may not create, generate, or make available through the Game any UGC that is illegal or violates or infringes someone else’s rights, including intellectual property rights or privacy, publicity or moral rights.
 
We reserve the right to - at our own discretion - take down any UGC.

Es posible que decidamos cambiar algunas de estas Condiciones si lo estimamos necesario, e informaremos de los cambios del Contrato en nuestra página web y en Steam. 

8.1 Modding
Mods are regarded as all other UGC, but here is some extra info about them. 
When making mods you should always make sure you make your own backup. We change the game with new updates etc. and we can not promise that your mods will continue to work as  intended. A backup will make it easier for you to update and modify your mod to work with whatever changes we made. 

Si cualquier cambio futuro en el Contrato te parece inaceptable o hace que no puedas seguir cumpliendo con las Condiciones del mismo, puedes rescindir el Contrato conforme a la sección 3.

When you upload your mods to an online platform through our tools, we reserve the right to remove it. That might happen for a number of reasons such as it not being in line with our intentions with providing a modding tool or if we think the mod is not following our guidelines.

You should know that when you share what you have made, there is a real risk someone is going to copy, modify and share it in their name. We don’t approve of it in any way, but it is hard for us to do anything about. This means when you upload something you acknowledge that we cannot in any way be held responsible for what happens to the mod and how it is used by others. Basically you must accept that we can use, modify, share, and adapt the mod, and allow other people to also do so too.

9. Law and venue
To the maximum extent permitted by local law applicable, this Agreement is subject to Danish Law, and the city court of Copenhagen, Denmark, shall have exclusive jurisdiction over disputes arising from this Agreement.

1. Licencia
Te otorgamos una licencia («Licencia») para descargar, instalar y utilizar el Juego. La Licencia es limitada y de no exclusividad.

Cuando descargas, instalas y utilizas el Juego, estás aceptando las Condiciones del Contrato. 
Esto significa que no eres dueño del Juego, sino que se te permite utilizarlo de acuerdo con estas Condiciones.

1.1 Restricciones de la Licencia
Estás sujeto a estas restricciones de uso de la Licencia:
- Solo puedes utilizar el Juego en un dispositivo al mismo tiempo.
- Cualquier tipo de copia, transferencia o distribución del Juego requiere una autorización expresa por nuestra parte.
- Eludir la protección de los derechos de autor está prohibido y se considera una infracción de derechos de autor.
- No se permite la realización de ingeniería inversa y de descompilación.
- No se permite la utilización del Juego con propósitos ilegales o nocivos.
- No se permite la comercialización del Juego sin una aprobación expresa por nuestra parte.
- No se permite la utilización de trucos, trampas, software de automatización (bots), pirateos, o cualquier otro tipo de software de terceros no autorizado, así como el uso de herramientas o contenido diseñado para modificar la experiencia de juego.
- No se permite la modificación, traducción o creación de obras derivadas basadas en el juego, o la utilización de cualquier parte del mismo para tales fines.

Puedes transferir permanentemente todos tus derechos de este Acuerdo solo si el destinatario está de acuerdo con las Condiciones, y solo si borras todo el contenido del Juego de tus cuentas y de los dispositivos y ordenadores en los que lo hayas instalado o almacenado. 

2. Propiedad intelectual
Nuestra compañía se reserva todos los derechos del Juego. Esto incluye, por ejemplo, los derechos de autor del código fuente, personajes, ambientación, texto, diálogos y diseño artístico, derechos del diseño de la interfaz de usuario, marcas, patentes, conocimientos, secretos comerciales, derechos de los nombres, títulos y aspectos, etc. 

No se permite la utilización de ninguno de nuestros derechos sin nuestro consentimiento expreso.

3. Rescisión contractual
Este Contrato es válido hasta que sea rescindido. Puedes rescindir el Contrato en cualquier momento eliminando por completo el Juego de todas las cuentas, sistemas informáticos y dispositivos que poseas o utilices. 

Podemos rescindir este Contrato bajo nuestro propio criterio en el caso de no cumplimiento por tu parte de las Condiciones de uso. 

En el caso de rescisión, debes eliminar el juego de forma permanente e inmediata, así como todas las copias del mismo que dispongas y que tengas almacenadas en cualquier dispositivo, y debes certificar ante Flashbulb Games que has actuado conforme a estas directrices. 

4. Responsabilidad
Por favor, no estropees nuestra propiedad. Si dañas de alguna forma nuestra propiedad, incluyendo código fuente, nombre, marcas comerciales o contenido; te pediremos una compensación por las pérdidas causadas. 

En el caso improbable de que nuestro juego origine algún tipo de daño o que esté físicamente defectuoso, limitamos la cantidad que puedes reclamar al dinero que recibimos por tu parte al adquirir una copia del mismo.

En la medida que lo permita la ley, no nos hacemos responsables de ninguna pérdida ganancial o de daños indirectos o riesgos derivados de daño a la propiedad, pérdida de datos, pérdida de clientela, fallos y errores informáticos como resultado de la posesión o uso del Juego, o del mal funcionamiento del mismo.

5. Garantía limitada 
El Juego se proporciona «tal cual». En la medida que lo permita la ley, el Juego se proporciona sin ningún tipo de garantía. 

No garantizamos de manera específica que el funcionamiento del juego será ininterrumpido o libre de errores o defectos, o que dichos errores sean corregidos.

6. Tus recursos
Si aparecen defectos materiales en el Juego, haremos lo que esté en nuestra mano para corregirlos, y como último recurso, reembolsaremos parte o la totalidad del dinero que recibimos por tu parte para obtener una copia de nuestro juego. 

7. Comportamiento
Nuestro chat no está supervisado o moderado de manera sistemática, y no nos hacemos responsables de cualquier tipo de contenido compartido por otros usuarios. 

En cualquier caso, nos gustaría que mantuvieras un lenguaje y comportamiento adecuados mientras estás en el mundo de Trailmakers. Esto implica, por ejemplo, que:
- No compartas ningún tipo de contenido o referencias sexuales.
- No acoses a otros jugadores.
- No mantengas un comportamiento perjudicial o violento.
- No utilices lenguaje ofensivo o vulgar.

Si no aprobamos tu comportamiento, puede que decidamos cerrar tu perfil.  

8. Contenido generado por el usuario
Cualquier tipo de contenido que crees o modifiques a través del 
Juego o de los servicios relacionados con el mismo, incluyendo desafíos, aspectos, construcciones dentro del juego, entradas de chat, repeticiones, capturas de pantalla, y otros ejemplos de personalización de juego se consideran contenido generado por el usuario («CGU»).

Si publicas, subes o compartes de algún modo cualquier tipo de CGU, nos das el derecho de utilizar tu CGU como se indica a continuación. No necesitamos permiso de ningún tipo y no tenemos la obligación de proporcionan compensación alguna.

Por la presente, otorgas a Flashbulb una licencia internacional, de no exclusividad, pagada, exenta de derechos, irrevocable, perpetua, transferible y sublicenciable para copiar, reproducir, distribuir, publicar, mostrar y representar en público, modificar, adaptar, traducir y almacenar el CGU, y crear obras derivadas de cualquier forma, formato o medio de cualquier tipo disponible ahora o en el futuro. 

Renuncias a todos los derechos morales que puedas tener con respecto a cualquier CGU proporcionado a Flashbulb, pero nosotros reconocemos a los creadores del CGU de acuerdo con la práctica habitual de la industria.

No se te permite crear, generar o poner a disposición del resto en el Juego cualquier CGU al que no tengas derecho de concedernos su licencia. Además, no se te permite crear, generar, o poner a disposición del resto en el Juego cualquier CGU ilegal o que viole o infrinja los derechos de terceros, incluyendo propiedad intelectual, derechos de privacidad, publicidad o derechos morales. 

Nos reservamos el derecho de eliminar bajo nuestro propio criterio cualquier tipo de CGU.

9. Legislación y competencia judicial
En la medida que lo permita la ley local, este Contrato está sujeto a la legislación de Dinamarca, y el tribunal de Copenhague (Dinamarca) tiene jurisdicción exclusiva sobre cualquier disputa derivada de este Contrato.
