We are Flashbulb – the makers of Trailmakers! We are a Copenhagen based game developer company, located at Knabrostræde 3, 3. sal, 1210 Copenhagen K, Denmark, registered at the Danish Business Authority with company registration number: 37650706.
 
This end user license agreement (“Agreement”) is a document we would like you to read. It is about our game, Trailmakers, (“Game”) and the way you should use it. The instructions and manuals that we provide to the Game are considered part of the Game for the purpose of this Agreement. When you play our Game, the terms of this Agreement (“Terms”) apply.
 
We may decide to change some of these Terms when we think it is necessary, and we will post the changed Agreement on our website and on Steam.
 
If any future changes to this Agreement are unacceptable to you or cause you to no longer be compliant with this Agreement, you may terminate this Agreement in accordance with section 3.

1.License
We grant you a license to download, install and use the Game (“License”). The License is non-exclusive and limited.
 
When you download, install and use the Game, you accept the Terms.
This means that you do not own the Game, but you are allowed to use it in accordance with these Terms.
 
1.1 License limitations
The following limitations apply to the License
-You may only the use the Game on one device at a time
-Any kind of copying, transfer or distribution of the Game requires our permission
-Circumvention of copyright protection is prohibited and considered a copyright infringement
-Reverse engineering and decompiling is not allowed
-You may not use the Game for illegal or harmful purposes
-You may not commercialise the Game in a way not approved explicitly by us
-You may not use cheats, automation software (bots), hacks or any other unauthorized third-party software, tools or content designed to modify the Game experience
-You may not modify, translate or create derivative works based on or utilizing any parts of the Game.
 
You may permanently transfer all of your rights under this Agreement only if the recipient agrees to the Terms, and if you remove and delete the Game completely from your accounts as well as all computers and devices you possess or control.
 
2. Intellectual property
We own all rights to the Game. This includes for example the copyright to source code, characters, setting, text, dialogue and artwork, design rights to user interfaces, trademarks, patents, know-how, trade secrets, rights to names, titles and themes, etc.
 
You are not allowed to use any of our rights without our permission.

3. Termination
This Agreement is effective until terminated. You may terminate the Agreement at any time by deleting and completely removing the Game from all accounts, computer systems and devices in your possession or control.
 
We may at our own discretion give notice to terminate this Agreement in the event that we become aware that you are failing to comply with the Terms.
 
In the event of termination, you must immediately and permanently destroy the Game and all copies in your control and stored on any media whatsoever and on Flashbulb Games' request certify that you have done so.
 
4. Liability
Please do not mess with our property. If you damage some of our property - also including our source code, name, brand, trademarks, content - we will ask you to repay our losses.
 
In the quite unlikely event that our game should be causing any damage or is materially defect, we limit the amount that you may claim to the amount that we actually received from you to get a copy of our game.
 
To the maximum extent permitted by law we are not liable for any lost profits and indirect damages and for the risks connected with property damage, lost data, loss of goodwill, computer failure and errors, or loss of business or other information as a result of possessing or using the Game or by malfunction of the Game.
 
5. Limited warranty
The Game is provided "as is". To the extent permitted by applicable law, the Game is provided without any warranties of any kind.
 
We do specifically not warrant that the operation of the Game will be uninterrupted or error free or free from defects or that errors can be corrected.

Questo accordo di licenza per l'utente finale ("Accordo") è un documento che invitiamo a leggere. Riguarda il nostro gioco, Trailmakers ("Gioco"), e il modo in cui dovrebbe essere utilizzato. Le istruzioni e i manuali che forniamo insieme al Gioco sono considerati parte del Gioco ai fini del presente Accordo. Quando il Gioco viene utilizzato, si applicano i termini del presente Accordo ("Termini").

6. Your remedies
If material defects in the Game should turn up, we will do what is commercially reasonable to correct the errors, and as a last resort pay back some or all of the money we received from you to get a copy of our game.
 
7. Behaviour
Our chat is not monitored or moderated systematically, and we are not responsible for any content provided by other users.
 
In any case we would like you to keep a good and appropriate language and behaviour (also) when in the world of Trailmakers. That means, for example:
-No sexual content or references
-No harassment
-No harmful or violent behaviour
-No swearing
 
If we do not approve your behaviour we may decide to shut your profile down. 
 
8. User Generated Content
Any content that you create or make available through the
Game or services related to the Game, including challenges, skins, in-game constructions, chat posts, replays, screenshots and other game customization is considered user generated content, (“UGC”).
 
If you post, upload or otherwise share any UGC, you grant us the free right to use your UGC as outlined below. We do not need further permission and no form of compensation is necessary.
 
You hereby grant to Flashbulb a worldwide,  non-exclusive, fully paid, royalty-free, irrevocable, perpetual, transferable, and sub-licensable license to use, copy, reproduce, distribute, publish, publicly perform, publicly display, modify, adapt, translate, store the UGC, and create derivative works in any form, format or medium of any kind now known or later developed.
 
You waive all moral rights you might have with respect to any UGC provided to Flashbulb, but we do credit creators of UGC in accordance with industry standard.
 
You may not create, generate, or make available through the Game any UGC to which you do not have the right to grant us such license. In addition, you may not create, generate, or make available through the Game any UGC that is illegal or violates or infringes someone else’s rights, including intellectual property rights or privacy, publicity or moral rights.
 
We reserve the right to - at our own discretion - take down any UGC.

Potremmo decidere di modificare alcune delle presenti Condizioni qualora lo ritenessimo necessario, e in tal caso l’Accordo modificato verrà pubblicato sul nostro sito Web e su Steam.

8.1 Modding
Mods are regarded as all other UGC, but here is some extra info about them. 
When making mods you should always make sure you make your own backup. We change the game with new updates etc. and we can not promise that your mods will continue to work as  intended. A backup will make it easier for you to update and modify your mod to work with whatever changes we made. 

Se eventuali modifiche al presente Accordo dovessero risultare inaccettabili o invalidare l’osservanza del presente Accordo da parte dell’utente, sarà possibile terminare il presente Accordo conformemente alla sezione 3.

When you upload your mods to an online platform through our tools, we reserve the right to remove it. That might happen for a number of reasons such as it not being in line with our intentions with providing a modding tool or if we think the mod is not following our guidelines.

You should know that when you share what you have made, there is a real risk someone is going to copy, modify and share it in their name. We don’t approve of it in any way, but it is hard for us to do anything about. This means when you upload something you acknowledge that we cannot in any way be held responsible for what happens to the mod and how it is used by others. Basically you must accept that we can use, modify, share, and adapt the mod, and allow other people to also do so too.

9. Law and venue
To the maximum extent permitted by local law applicable, this Agreement is subject to Danish Law, and the city court of Copenhagen, Denmark, shall have exclusive jurisdiction over disputes arising from this Agreement.

1. Licenza
Con il presente Accordo concediamo una licenza per scaricare, installare e utilizzare il Gioco ("Licenza"). La Licenza è limitata e non esclusiva.

Quando il Gioco viene scaricato, installato e utilizzato, i Termini vengono accettati.
Ciò significa che l’utente non possiede il Gioco, ma è autorizzato a utilizzarlo in conformità ai Termini del presente Accordo.

1.1 Limitazioni della Licenza
Le limitazioni applicabili alla Licenza sono le seguenti:
- Il Gioco può essere utilizzato solo su un dispositivo per volta
- Qualsiasi tipo di copia, trasferimento o distribuzione del Gioco richiede la nostra autorizzazione
- L'elusione della protezione del copyright è vietata ed è considerata una violazione del copyright
- Il reverse engineering e il decompiling non sono consentiti
- Il Gioco non è utilizzabile per scopi illegali o per arrecare danno
- Il Gioco non può essere commercializzato in un modo non esplicitamente approvato da noi
- Non si possono utilizzare trucchi, software di automazione (bot), hack o altri software, strumenti o contenuti non autorizzati di terze parti progettati per modificare l'esperienza di gioco
- Non è possibile modificare, tradurre o creare opere derivate basate su o utilizzando parti del Gioco.

È possibile cedere in modo permanente tutti i diritti previsti dal presente Accordo solo se il beneficiario accetta i Termini e se si rimuove e si elimina completamente il Gioco dai propri account nonché da tutti i computer e da tutti i dispositivi posseduti o controllati.

2. Proprietà intellettuale
Flashbulb Games possiede tutti i diritti sul Gioco. Ciò include ad esempio il copyright sul codice sorgente, i personaggi, l’ambientazione, i testi, i dialoghi e le grafiche, i diritti sulla progettazione delle interfacce utente, i marchi, i brevetti, il know-how, i segreti commerciali, i diritti su nomi, titoli e temi, ecc.

È vietato l’utilizzo dei nostri diritti senza autorizzazione.

3. Terminazione
Il presente Accordo è in vigore fino alla sua terminazione. L'utente può terminare l’Accordo in qualsiasi momento eliminando e rimuovendo completamente il Gioco da tutti gli account, computer e dispositivi in suo possesso o controllo.

Potremmo, a nostra discrezione, richiedere di terminare il presente Accordo nel caso in cui venissimo a conoscenza del mancato rispetto dei Termini.

In caso di terminazione, l’utente deve distruggere immediatamente e permanentemente il Gioco e tutte le copie in suo possesso o controllo e archiviate su qualsiasi supporto e, su richiesta di Flashbulb Games, certificare di averlo fatto.

4. Responsabilità
Si prega di non manomettere la nostra proprietà. Se dovessero essere danneggiate alcune delle nostre proprietà - compresi il codice sorgente, il nome, il brand, i marchi registrati, i contenuti – verrà richiesto un risarcimento per le perdite.

Nell'improbabile eventualità che il Gioco arrechi un danno o sia materialmente difettoso, limitiamo l'importo richiedibile all'importo che abbiamo effettivamente ricevuto per una copia del Gioco.

Nella misura massima consentita dalla legge, non siamo responsabili per eventuali mancati guadagni, per danni indiretti e per i rischi connessi a danni alla proprietà, perdita di dati, perdita di avviamento, guasti ed errori del computer o perdita nel volume d’affari o di altre informazioni come risultato del possesso o dell’utilizzo del Gioco o di un suo malfunzionamento.

5. Garanzia limitata
Il Gioco è fornito "così com'è". Nella misura consentita dalla legge applicabile, il Gioco è fornito senza garanzie di alcun tipo.

In particolare, non garantiamo che il funzionamento del Gioco sarà ininterrotto o privo di errori o difetti o che gli errori possano essere corretti.

6. Indennizzo
Se dovessero presentarsi difetti materiali nel Gioco, faremo quanto è commercialmente ragionevole per correggere gli errori e, come ultima possibilità, rimborsare in parte o completamente l'importo che abbiamo effettivamente ricevuto per una copia del Gioco.

7. Comportamento
La nostra chat non è monitorata o moderata sistematicamente e non siamo responsabili per i contenuti condivisi dagli altri utenti.

In ogni caso vorremmo che venissero osservati un linguaggio e un comportamento appropriati (anche) nel mondo di Trailmakers. Ciò significa, ad esempio:
- Nessun contenuto o riferimento sessuale
- Nessuna intimidazione
- Nessun comportamento dannoso o violento
- Non imprecare

Se il comportamento dell’utente non fosse appropriato, potremmo decidere di chiuderne il profilo.

8. Contenuti generati dall’utente
Qualsiasi contenuto che venga creato o reso disponibile attraverso il Gioco o servizi ad esso relativi, inclusi sfide, skin, costruzioni di gioco, messaggi di chat, replay, schermate di gioco e altre personalizzazioni sono considerati contenuti generati dall’utente ("UGC").

Se l’utente pubblica, carica o condivide in qualche modo un UGC, ci concede il diritto gratuito di utilizzare l’UGC come descritto di seguito. Non necessitiamo di ulteriori permessi e non è prevista alcuna forma di compenso.

Con la presente si concede a Flashbulb una licenza mondiale, non esclusiva, interamente pagata, esente da diritti, irrevocabile, perpetua, trasferibile e sub-licenziabile per l'uso, la copia, la riproduzione, la distribuzione, la pubblicazione, l'esibizione pubblica, la visualizzazione pubblica, la modifica, l'adattamento, la traduzione, l’archiviazione di un UGC e per la creazione di opere da esso derivate in qualsiasi forma, formato o supporto ora conosciuto o successivamente sviluppato.

L’utente rinuncia a tutti i diritti morali che potrebbe possedere rispetto a qualsiasi UGC fornito a Flashbulb; ciononostante, verranno attribuiti gli UGC ai rispettivi creatori, in conformità agli standard del settore.

Non è possibile creare, generare o rendere disponibile attraverso il Gioco alcun UGC di cui non si possiede il diritto di concessione della licenza. Inoltre, non è possibile creare, generare o rendere disponibile attraverso il Gioco alcun UGC che sia illegale, violi o leda i diritti di terzi, inclusi i diritti di proprietà intellettuale, privacy, pubblicità o i diritti morali.

Ci riserviamo il diritto, a nostra discrezione, di rimuovere qualsiasi UGC.

9. Legge e sede
Nella misura massima consentita dalla legge locale applicabile, il presente Accordo è soggetto alla legge danese e il tribunale della città di Copenaghen avrà giurisdizione esclusiva sulle controversie derivanti dal presente Accordo.
