We are Flashbulb – the makers of Trailmakers! We are a Copenhagen based game developer company, located at Knabrostræde 3, 3. sal, 1210 Copenhagen K, Denmark, registered at the Danish Business Authority with company registration number: 37650706.
 
This end user license agreement (“Agreement”) is a document we would like you to read. It is about our game, Trailmakers, (“Game”) and the way you should use it. The instructions and manuals that we provide to the Game are considered part of the Game for the purpose of this Agreement. When you play our Game, the terms of this Agreement (“Terms”) apply.
 
We may decide to change some of these Terms when we think it is necessary, and we will post the changed Agreement on our website and on Steam.
 
If any future changes to this Agreement are unacceptable to you or cause you to no longer be compliant with this Agreement, you may terminate this Agreement in accordance with section 3.

1.License
We grant you a license to download, install and use the Game (“License”). The License is non-exclusive and limited.
 
When you download, install and use the Game, you accept the Terms.
This means that you do not own the Game, but you are allowed to use it in accordance with these Terms.
 
1.1 License limitations
The following limitations apply to the License
-You may only the use the Game on one device at a time
-Any kind of copying, transfer or distribution of the Game requires our permission
-Circumvention of copyright protection is prohibited and considered a copyright infringement
-Reverse engineering and decompiling is not allowed
-You may not use the Game for illegal or harmful purposes
-You may not commercialise the Game in a way not approved explicitly by us
-You may not use cheats, automation software (bots), hacks or any other unauthorized third-party software, tools or content designed to modify the Game experience
-You may not modify, translate or create derivative works based on or utilizing any parts of the Game.
 
You may permanently transfer all of your rights under this Agreement only if the recipient agrees to the Terms, and if you remove and delete the Game completely from your accounts as well as all computers and devices you possess or control.
 
2. Intellectual property
We own all rights to the Game. This includes for example the copyright to source code, characters, setting, text, dialogue and artwork, design rights to user interfaces, trademarks, patents, know-how, trade secrets, rights to names, titles and themes, etc.
 
You are not allowed to use any of our rights without our permission.

3. Termination
This Agreement is effective until terminated. You may terminate the Agreement at any time by deleting and completely removing the Game from all accounts, computer systems and devices in your possession or control.
 
We may at our own discretion give notice to terminate this Agreement in the event that we become aware that you are failing to comply with the Terms.
 
In the event of termination, you must immediately and permanently destroy the Game and all copies in your control and stored on any media whatsoever and on Flashbulb Games' request certify that you have done so.
 
4. Liability
Please do not mess with our property. If you damage some of our property - also including our source code, name, brand, trademarks, content - we will ask you to repay our losses.
 
In the quite unlikely event that our game should be causing any damage or is materially defect, we limit the amount that you may claim to the amount that we actually received from you to get a copy of our game.
 
To the maximum extent permitted by law we are not liable for any lost profits and indirect damages and for the risks connected with property damage, lost data, loss of goodwill, computer failure and errors, or loss of business or other information as a result of possessing or using the Game or by malfunction of the Game.
 
5. Limited warranty
The Game is provided "as is". To the extent permitted by applicable law, the Game is provided without any warranties of any kind.
 
We do specifically not warrant that the operation of the Game will be uninterrupted or error free or free from defects or that errors can be corrected.

Denne slutbrugerlicensaftale ("aftale") er et dokument, vi gerne vil have, at du læser. Den omhandler vores spil Trailmakers ("spil") og den måde, du bør anvende det på. De vejledninger og manualer, vi leverer i spillet, opfattes som dele af spillet i forhold til denne aftale. Når du spiller vores spil, gælder betingelserne i denne aftale ("betingelser").

6. Your remedies
If material defects in the Game should turn up, we will do what is commercially reasonable to correct the errors, and as a last resort pay back some or all of the money we received from you to get a copy of our game.
 
7. Behaviour
Our chat is not monitored or moderated systematically, and we are not responsible for any content provided by other users.
 
In any case we would like you to keep a good and appropriate language and behaviour (also) when in the world of Trailmakers. That means, for example:
-No sexual content or references
-No harassment
-No harmful or violent behaviour
-No swearing
 
If we do not approve your behaviour we may decide to shut your profile down. 
 
8. User Generated Content
Any content that you create or make available through the
Game or services related to the Game, including challenges, skins, in-game constructions, chat posts, replays, screenshots and other game customization is considered user generated content, (“UGC”).
 
If you post, upload or otherwise share any UGC, you grant us the free right to use your UGC as outlined below. We do not need further permission and no form of compensation is necessary.
 
You hereby grant to Flashbulb a worldwide,  non-exclusive, fully paid, royalty-free, irrevocable, perpetual, transferable, and sub-licensable license to use, copy, reproduce, distribute, publish, publicly perform, publicly display, modify, adapt, translate, store the UGC, and create derivative works in any form, format or medium of any kind now known or later developed.
 
You waive all moral rights you might have with respect to any UGC provided to Flashbulb, but we do credit creators of UGC in accordance with industry standard.
 
You may not create, generate, or make available through the Game any UGC to which you do not have the right to grant us such license. In addition, you may not create, generate, or make available through the Game any UGC that is illegal or violates or infringes someone else’s rights, including intellectual property rights or privacy, publicity or moral rights.
 
We reserve the right to - at our own discretion - take down any UGC.

Vi kan vælge at ændre nogle af disse betingelser, når vi finder det nødvendigt, og vi vil offentliggøre den ændrede aftale på vores webside og på Steam. 

8.1 Modding
Mods are regarded as all other UGC, but here is some extra info about them. 
When making mods you should always make sure you make your own backup. We change the game with new updates etc. and we can not promise that your mods will continue to work as  intended. A backup will make it easier for you to update and modify your mod to work with whatever changes we made. 

Hvis fremtidige ændringer af denne aftale er uacceptable eller forårsager, at du ikke længere kan overholde denne aftale, kan du opsige denne aftale som beskrevet i afsnit 3.

When you upload your mods to an online platform through our tools, we reserve the right to remove it. That might happen for a number of reasons such as it not being in line with our intentions with providing a modding tool or if we think the mod is not following our guidelines.

You should know that when you share what you have made, there is a real risk someone is going to copy, modify and share it in their name. We don’t approve of it in any way, but it is hard for us to do anything about. This means when you upload something you acknowledge that we cannot in any way be held responsible for what happens to the mod and how it is used by others. Basically you must accept that we can use, modify, share, and adapt the mod, and allow other people to also do so too.

9. Law and venue
To the maximum extent permitted by local law applicable, this Agreement is subject to Danish Law, and the city court of Copenhagen, Denmark, shall have exclusive jurisdiction over disputes arising from this Agreement.

1. Licens
Vi giver dig en licens til at downloade, installere og bruge spillet ("licens"). Licensen er ikke-eksklusiv og begrænset.

Når du downloader, installerer og anvender spillet, accepterer du betingelserne. 
Dette betyder, at du ikke ejer spillet, men har tilladelse til at anvende det i overensstemmelse med disse betingelser.

1.1 Licensbegrænsninger
Følgende begrænsninger gælder for licensen
- Du må kun bruge spillet på én enhed ad gangen
- Alle former for kopiering, overførsel eller distribution af spillet kræver vores tilladelse
- Tilsidesættelse af kopibeskyttelse er forbudt og vil blive opfattet som overtrædelse af ophavsretten
- Det er ikke tilladt at foretage reverse engineering eller dekompilering
- Du må ikke anvende spillet til ulovlige eller skadelige formål
- Du må ikke kommercialisere spillet på nogen måder, der ikke er udtrykkeligt godkendt af os
- Du må ikke bruge snyd, automatiseringssoftware (bots), hacks eller andre former for uautoriseret tredjepartssoftware, -redskaber eller -indhold designet til at modificere spiloplevelsen
- Du må ikke modificere, oversætte eller basere værker, der er baseret på eller anvender dele af spillet.

Du kan kun overføre alle dine rettigheder i denne aftale permanent, hvis modtageren accepterer betingelserne, og hvis du fjerner og sletter spillet fuldstændigt fra dine konti, såvel som alle computere og enheder, du ejer eller kontrollerer. 

2. Intellektuel ejendom
Vi ejer alle rettigheder til spillet. Dette omfatter for eksempel ophavsret til kildekode, figurer, spilverden, tekst, dialog og grafik, designrettigheder til brugerflader, varemærker, patenter, know-how, forretningshemmeligheder, navnerettigheder, titler, temaer osv. 

Du må ikke anvende nogen af vores rettigheder uden vores tilladelse.

3. Opsigelse
Denne aftale er gældende, indtil den opsiges. Du kan opsige aftalen når som helst ved at slette og fuldstændigt fjerne spillet fra alle konti, computersystemer og enheder, du ejer eller kontrollerer. 

Vi kan vælge at give varsel om opsigelse af aftalen, såfremt vi bliver gjort opmærksomme på, at du ikke overholder betingelserne. 

I tilfælde af opsigelse skal du øjeblikkeligt og permanent destruere spillet og alle eksemplarer, du kontrollerer og har lagret på alle medier, og på Flashbulb Games' forlangende bekræfte, at du har gjort dette. 

4. Ansvar
Lad venligst være med at ødelægge vores ejendom. Hvis du beskadiger noget af vores ejendom – deriblandt vores kildekode, navn, mærke, varemærker og indhold – vil vi bede dig om at erstatte vores tab. 

I det temmelig usandsynlige tilfælde, at vores spil skulle forårsage nogen former for skade eller er defekt, begrænses det beløb, du kan kræve som dækning, til det beløb, vi har modtaget fra dig som betaling for et eksemplar af spillet.

Vi kan, i lovens videste udstrækning, ikke holdes ansvarlige for mistede indtægter og indirekte skader eller for risici forbundet med ejendomsskade, mistede data, tab af goodwill, computernedbrud og -fejl, eller tab af forretning eller andre oplysninger som følge af besiddelse eller anvendelse af spillet eller funktionsfejl i spillet.

5. Begrænset garanti 
Spillet leveres, "som det er". I det omfang, gældende lovgivning tillader det, leveres spillet uden nogen former for garantier. 

Vi garanterer ikke specifikt, at driften af spillet vil være uafbrudt, fejlfri eller fri for defekter, eller at fejl kan rettes.

6. Dine midler
Hvis spillet viser sig at indeholde defekter, vil vi i en kommercielt rimelig grad forsøge at rette fejlene og som sidste udvej betale nogle af eller alle pengene, vi har modtaget fra dig for et eksemplar af spillet, tilbage. 

7. Opførsel
Vores chat bliver ikke overvåget eller modereret systematisk, og vi er ikke ansvarlige for indhold produceret af andre brugere. 

Uanset hvad vil vi gerne bede dig om at benytte et godt og passende sprog og opføre dig ordentligt, også inde i Trailmakers-verdenen. Dette indebærer for eksempel:
- Intet seksuelt indhold eller hentydninger
- Ingen chikane
- Ingen skadelig eller voldelig adfærd
- Ingen bandeord

Hvis din opførsel er uacceptabel, kan vi vælge at lukke din profil.  

8. Brugerproduceret indhold
Alt indhold, du producerer eller gør tilgængeligt gennem 
spillet eller tjenester knyttet til spillet, deriblandt udfordringer, overflader, konstruktioner i spillet, chat-indlæg, gengivelser, skærmbilleder og andre former for spiltilpasning, vil blive opfattet som brugerproduceret indhold (user generated content, "UGC").

Hvis du opslår, uploader eller på anden vis deler UGC, giver du os ret til at anvende dit UGC gratis som beskrevet herunder. Vi behøver ikke yderligere tilladelser, og ingen former for kompensation er nødvendige.

Du giver hermed Flashbulb en verdensomspændende, ikke-eksklusiv, fuldt betalt, royalty-fri, uigenkaldelig, evig, overførbar og sub-udlicensérbar licens til at anvende, kopiere, reproducere, distribuere, udgive, offentligt fremvise, modificere, tilpasse, oversætte og lagre UGC samt skabe værker baseret på det i alle former, formater eller medier, som er kendt nu, eller som senere bliver udviklet. 

Du fralægger dig alle moralske rettigheder, du måtte have i forhold til det UGC, du leverer til Flashbulb, men vi krediterer producenter af UGC i henhold til branchestandarderne.

Du må ikke skabe, generere eller via spillet gøre noget UGC tilgængeligt, som du ikke har retten til at give os sådan en licens til. Derudover må du ikke skabe, generere eller via spillet gøre noget UGC tilgængeligt, som er ulovligt eller overtræder eller krænker andres rettigheder, deriblandt intellektuelle ejendomsrettigheder eller fortroligheds-, offentligheds- eller moralske rettigheder. 

Vi forbeholder os retten til efter vores eget forgodtbefindende at fjerne UGC.

9. Lov og retskreds
I lovens videste udstrækning er denne aftale underlagt dansk lovgivning, og Københavns byret i Danmark vil præsidere med eneret over uoverensstemmelser, der måtte opstå i forbindelse med denne aftale.
