                LICENCIA DE UTILIZACIÓN DEL PRODUCTO 
                MULTIMEDIA
                 PRODUCT LICENSE AGREEMENT
                </div><br>
                Please read carefully this agreement (the "license") between you ("user") and Nacon ltd. ("Nacon") before downloading and using the game in any way, including the software, documentation, or any other digital media, and any other materials related to the game (together the "media product"). <br>If user is a minor under the age of 15, user may only create an account with nacon, download the media product and subscribe to the license with the consent of at least one parent (or person with parental authority).<br>If user is a minor over the age of 15, he or she may create an account with nacon, download the multimedia product and purchase the license alone, but his or her parents (or holders of parental authority) may request deletion of the account and termination of the license.<br>By downloading and/or using the multimedia product in any way, the user accepts the license. If the user does not accept the terms of the license, the user may not download and/or use the multimedia product in any way. <br>The provisions of this license are subject to the mandatory provisions of the applicable law, which may grant the user specific rights.
                TE ROGAMOS QUE LEAS ATENTAMENTE ESTE CONTRATO (LA «LICENCIA») QUE SE ESTABLECE ENTRE TÚ (EL «USUARIO») Y LA SOCIEDAD NACON SA («NACON») ANTES DE DESCARGAR EL JUEGO O REALIZAR CUALQUIER USO DEL MISMO, QUE INCLUYE EL SOFTWARE, SU DOCUMENTACIÓN Y CUALQUIER OTRO SOPORTE DIGITAL EVENTUAL, ASÍ COMO TODO ELEMENTO QUE GUARDE RELACIÓN (EN CONJUNTO, EL «PRODUCTO MULTIMEDIA»). <br><br>SI EL USUARIO ES MENOR DE EDAD Y TIENE MENOS DE 15 AÑOS, ÚNICAMENTE PODRÁ CREAR UNA CUENTA DE NACON, DESCARGAR EL PRODUCTO MULTIMEDIA Y SUSCRIBIR LA LICENCIA CON LA AUTORIZACIÓN DE COMO MÍNIMO UNO DE SUS PADRES (O UNO DE LOS TITULARES DE LA PATRIA POTESTAD).<br>SI EL USUARIO ES MENOR DE EDAD Y TIENE MÁS DE 15 AÑOS, PODRÁ CREAR UNA CUENTA DE NACON, DESCARGAR EL PRODUCTO MULTIMEDIA Y SUSCRIBIR LA LICENCIA SOLO, PERO SUS PADRES (O LOS TITULARES DE LA PATRIA POTESTAD) PODRÁN SOLICITAR LA ELIMINACIÓN DE SU CUENTA Y RESCINDIR LA LICENCIA.<br><br>MARCAR LA CASILLA «ACEPTO» (CLIC VINCULANTE), ASÍ COMO COMENZAR A DESCARGAR O UTILIZAR DE CUALQUIER FORMA EL PRODUCTO MULTIMEDIA SUPONE LA ACEPTACIÓN DE LA LICENCIA POR PARTE DEL USUARIO. SI EL USUARIO RECHAZA LOS TÉRMINOS DE LA LICENCIA, NO PODRÁ DESCARGAR EL PRODUCTO MULTIMEDIA NI REALIZAR NINGÚN USO DEL MISMO.<br><br>LAS DISPOSICIONES DEL PRESENTE DOCUMENTO SE ESTIPULAN SIN PERJUICIO DE LAS DISPOSICIONES IMPERATIVAS DE LA LEGISLACIÓN APLICABLE, SUSCEPTIBLES DE OTORGAR AL USUARIO DERECHOS ESPECÍFICOS.

                La descompilación, ingeniería inversa o desensamblaje del Producto Multimedia, aunque sea con fines de interoperabilidad.<br><br>El Usuario no podrá de ningún modo transferir, vender, revender, subautorizar, alquilar ni poner a disposición el Producto Multimedia que ha adquirido, independientemente de los medios que quiera emplear para ello (y que incluyen las descargas en una red de comunicaciones electrónicas), ni ninguno de sus elementos integrantes (incluido, en su caso, el código de activación asociado a dicho Producto Multimedia). <br><br><div class="bb_h2">
                4.	
                Modification of the
                Actualizaciones</div><br>NACON no está obligada a proporcionar al Usuario actualizaciones, restablecimientos ni nuevas versiones (en lo sucesivo, las «Actualizaciones») del software del Producto Multimedia. Sin embargo, en el caso de que NACON pusiera una de estas Actualizaciones a disposición del Usuario, este deberá contar con una licencia válida de la versión anterior del Producto
                 Multimedia 
                Product or any of its constituent parts or the creation of any derivative work;<br>
                para poder utilizarla, y esta se facilitará sujeta a las condiciones de la presente Licencia. El Usuario reconoce, además, que NACON se reserva el derecho a detener o limitar el mantenimiento de antiguas versiones de sus productos, sea o no de manera progresiva. Además, el Usuario se compromete a descargar y utilizar las Actualizaciones a su disposición con el fin de beneficiarse plenamente de las garantías ofrecidas por NACON. <br><br><div class="bb_h2">
                5.	
                Modification, circumvention or removal of technical protection measures of the
                Entrada en vigor - Rescisión de la Licencia</div><br>La Licencia entrará en vigor en el momento de la primera utilización del Producto Multimedia.<br><br>Asimismo, NACON la rescindirá automáticamente, de pleno derecho y sin notificación previa, en caso de un incumplimiento grave por parte del Usuario de cualquiera de sus obligaciones, o del incumplimiento de cualquier obligación esencial de acuerdo a los términos y las condiciones de la Licencia. El Usuario, por su parte, podrá revocarla automáticamente y de pleno derecho destruyendo y desinstalando el Producto
                 Multimedia 
                Product and its constituent parts and systems of digital rights management related thereto;<br>
                y todos sus elementos integrantes. <br><br><div class="bb_h2">
                6.	
                Correction by the User or by a third party chosen by the User of any errors, anomalies and bugs in the
                Garantías</div><br><div class="bb_h2">6.1 Garantía comercial.</div> NACON ha invertido en este Producto
                 Multimedia

                todos sus conocimientos en materia de entretenimiento interactivo para garantizar al Usuario una entera satisfacción y numerosas horas de diversión. <br><br>Si, de todos modos, en los noventa (90) días siguientes a la fecha de compra del Producto Multimedia, este resultase, en condiciones normales de uso, defectuoso o no conforme a las características funcionales y técnicas descritas en las instrucciones facilitadas, NACON se compromete a la sustitución gratuita del Producto Multimedia, siempre que esté disponible (o, en su defecto, al reembolso integral de su valor de compra), de acuerdo a las condiciones expuestas a continuación:<br><br>Para que la copia defectuosa del Producto Multimedia pueda reemplazarse (o, de lo contrario, reembolsarse), el Usuario debe: <br><br>1) Ponerse en contacto con el servicio de soporte técnico de NACON. Tras describir brevemente el supuesto fallo del Producto Multimedia en cuestión, NACON confirmará si, efectivamente, se trata de un defecto. <br><br>2) En caso de que así se confirmase, NACON permitirá al Usuario descargar sin gastos adicionales una nueva copia del Producto Multimedia (o, en su defecto, le enviará un nuevo ejemplar físico del Producto Multimedia o restituirá su precio de compra a la mayor brevedad posible). <br><br>NACON se reserva el derecho a eliminar el código de activación asociado al Producto Multimedia en caso de que el Usuario lo devuelva de conformidad con las condiciones arriba expuestas.<br><br><div class="bb_h2">6.2 Garantías legales.</div> Sin perjuicio de la garantía comercial descrita en el anterior apartado, se recuerda al Usuario que el vendedor del Producto Multimedia sigue obligado a cumplir las garantías legales aplicables. En concreto, en el caso de los consumidores con residencia en territorio francés, las relativas a la falta de conformidad del producto a lo establecido en el contrato, y las relacionadas con los defectos críticos en las condiciones previstas en el artículo L.211-4 y siguientes del Código de Consumo, y en los artículos del 1641 al 1649 del Código Civil, respectivamente. Dichas garantías figuran detalladas en el Anexo 1.<br><br><div class="bb_h2">
                7.	
                The provision or transmission of the

Por tanto, si el defecto o incumplimiento constatado por el Usuario se deriva de este uso inapropiado, o de un caso de fuerza mayor, NACON no cubrirá ninguna de las garantías previstas en el Artículo 6 de la Licencia.<br><br>Dentro de los límites establecidos por la legislación aplicable, NACON se exime, en consecuencia, de todas las garantías relativas al valor de mercado del Producto Multimedia, a la satisfacción del Usuario, a su aptitud para responder a un uso
                 particular 
                through an electronic communications network (telephone, internet, set top box, connected television, without this list being restrictive);<br>
                o a la no infracción.<br><br><div class="bb_h2">
                8.	
                Decompiling, reverse engineering or disassembling the

                 Multimedia 
                Product, even for interoperability purposes.<br>The User may not transfer, sell, resell, sub-license, rent or otherwise make available the

                Product acquired by him/her by any means whatsoever (including by way of downloading on an electronic communications network), nor any of its constituent elements (including, where applicable, the activation code associated with the Multimedia Product). <br><br><div class="bb_h2">4. Updates</div>

                is not obliged to provide the User with updates, upgrades or new versions (hereinafter, "Updates") of the Multimedia Product software. However, in the event that NACON makes an Update available to the User, the User must have a valid license for the previous version in order to use the Update, which shall be provided under the terms of this License. The User further acknowledges that NACON reserves the right, progressively or not, to cease or limit the maintenance of older versions. Therefore, the User agrees to download and use any Update made available in order to fully benefit from the guarantees made by NACON. <br><br><div class="bb_h2">5. Effective date - Termination of the License</div>The License becomes effective upon the first use of the Multimedia Product.<br>It shall be automatically terminated by NACON without notice in the event of a serious breach of any of its obligations or a breach of any of its essential obligations under the terms and conditions of the License by the User. It is automatically terminated by the User by the destruction and/or uninstallation by the User of the Multimedia Product and all its constituent parts. <br><br><div class="bb_h2">6. Guarantees</div><div class="bb_h2">6.1 Commercial warranty. </div>NACON has applied all its know-how in the field of interactive entertainment to this Multimedia Product to guarantee the User complete satisfaction and many hours of entertainment. <br>If, however, within ninety (90) days from the date of purchase of the Multimedia Product, it proves, under normal conditions of use, to be defective or not in compliance with the functional and technical characteristics described in the instructions provided, NACON undertakes to replace the Multimedia Product free of charge if it is available (or, failing that, to reimburse it in full at its purchase value), under the conditions defined below.  <br>In order for the defective copy of the Multimedia Product to be replaced (or, if applicable, refunded), the User must: <br>1) Contact NACON's technical support. After briefly describing the defect in the Multimedia Product, NACON will confirm whether it is indeed a defect. <br>2) If this confirmation is given by NACON, NACON shall allow the User to download a new copy of the Multimedia Product at 
                no 
                additional cost (or if necessary, send a new physical copy of the Multimedia Product or return the purchase price as soon as possible). <br>NACON reserves the right to delete the activation code associated with the Multimedia Product in the event that it is returned by the User under the above conditions.<br><br><div class="bb_h2">6.2 Legal guarantees. </div>Independently of the commercial warranty granted above, the User is reminded that the seller of the Multimedia Product remains bound by the applicable legal warranties, and in particular, with regard to consumer Users residing on French territory, of the defects of conformity of the good to the contract and of redhibitory defects under the conditions provided for in Article L.211-4 et seq. of the French Consumer Code, and in Articles 1641 to 1649 of the French Civil Code, respectively. The details of these guarantees are given in Appendix 1.<br><br><div class="bb_h2">7. Limitation of warranty</div>THE MULTIMEDIA PRODUCT IS PROVIDED AS IS AND WITHOUT WARRANTY OTHER THAN THAT PROVIDED IN ARTICLE 6 OF THE LICENSE. In particular, NACON does not guarantee the continuous or error-free operation of the Multimedia Product or the correction of errors. <br>The User expressly acknowledges that any use of the Multimedia Product that does not comply with the instructions for use, the minimum recommended specifications, and the latest version made available, is at his/her own risk. Therefore, if the defect or non-compliance noted by the User is the result of such improper use, as well as a case of force majeure, none of the guarantees provided for in Article 6 of the License shall be due by NACON.<br>Within the limits imposed by the applicable law, NACON therefore excludes any warranty regarding the market value of the Multimedia Product, the satisfaction of the User, its suitability for a particular purpose or the absence of infringement.<br><br><div class="bb_h2">8. Liability</div>In no event shall NACON be liable for any indirect, incidental, special, consequential or other damages arising out of (1) the use or inability to use the Multimedia Product, (2) the improper use or malfunction of the Multimedia Product or an older unsupported version, (3) the loss or alteration of any data or information, and/or (4) the loss of any income or business resulting from the possession or use of the Multimedia Product, even if NACON has been advised of the possibility of such damage.<br>In particular, NACON shall not be held liable for the use of the Multimedia Product contrary to the precautions for use set forth in the instructions for use.<br>The User assumes all costs of repair and/or correction of the Multimedia Product, as well as all risks related to loss of profits, loss or alteration of data, errors, loss of commercial information or other resulting from the possession of the Multimedia Product or its use. <br>In any event, NACON's liability shall not exceed the purchase price of the Multimedia Product.

                 Encouraging or glorifying violence. In particular, the content may not represent scenes of violence, torture or mutilation in an outrageous manner;
                	No fomente o glorifique la violencia. En concreto, el contenido no podrá representar de manera gratuita escenas de violencia, tortura o mutilación;
                 <br>-
                 Sexual, explicit or not, or tending to provoke sexual excitement. The content may not depict, encourage or glorify violence, pain or humiliation in a sexual context. Content may not depict minors in a sexualized context;
                	No sea de carácter sexual, de manera explícita o tácita, ni esté diseñado para provocar excitación sexual. El contenido no podrá representar, fomentar o glorificar situaciones de violencia, dolor o humillación en un contexto sexual. Asimismo, no podrá representar en ningún caso a menores de edad en un contexto sexualizado;

                 Applicable law
                	Legislación aplicable – Jurisdicción competente</div><br>La presente Licencia está sujeta a la legislación francesa, excepto en el caso de conflicto de leyes. En caso de disputa relativa a la creación, interpretación, ejecución o rescisión de la Licencia, los tribunales franceses competentes de acuerdo a la legislación francesa serán los únicos con competencia al respecto, incluso en caso de urgencia o de que haya múltiples demandados.<br><br><br> <br><div class="bb_h2">Anexo 1: Garantías legales</div>Artículo L.211-4 del Código de Consumo francés: «El vendedor está obligado a entregar un producto conforme al contrato y es responsable de cualquier defecto que exista en el momento de la entrega del mismo. Asimismo, responderá de cualquier falta de conformidad resultante del embalaje, las instrucciones de montaje o la instalación, en caso de que el contrato le ponga a cargo de ello o se haya realizado bajo su responsabilidad».<br>Artículo L.211-5 del Código de Consumo francés: «Para considerarse conforme al contrato, el bien debe: 1.° Ser adecuado para el uso habitualmente asociado a dicho producto o, de lo contrario:

                corresponder a la descripción dada por el vendedor y poseer las cualidades que este haya presentado al comprador mediante una muestra o modelo; - presentar las cualidades que un comprador pueda esperar legítimamente teniendo en cuenta las declaraciones públicas realizadas por el vendedor, el productor o su representante, especialmente a través de publicidad o del etiquetado; 2.° O presentar las características definidas de común acuerdo por las partes, o ser adecuado para un uso concreto especial requerido por el comprador que se haya puesto en conocimiento del vendedor y que este último haya aceptado».<br>Artículo L.211-8 del Código de Consumo francés: «El comprador tiene derecho a exigir la conformidad del bien al contrato. Sin embargo, no podrá impugnar dicha conformidad apelando a un defecto que conociera o que no pudiera ignorar en el momento de vincularse al contrato. Esto también se aplica cuando ese defecto tenga su origen en materiales que él mismo haya suministrado».<br>Artículo L.211-9 del Código de Consumo francés: «En caso de falta de conformidad, el comprador puede elegir entre la reparación o la sustitución del bien. En todo caso, el vendedor podría no proceder según la elección del comprador si esta implicase un coste manifiestamente desproporcionado respecto a la otra modalidad, teniendo en cuenta el valor del bien y la importancia del defecto. En tal eventualidad, deberá proceder, salvo imposibilidad, de acuerdo a la modalidad no elegida por el comprador».<br>Artículo L.211-10 del Código de Consumo francés: «Si la reparación y la sustitución del bien fueran imposibles, el comprador podrá devolver el bien y recibir a cambio el precio de compra, o bien conservarlo y recibir un reembolso parcial. El comprador dispondrá de la misma opción: 1.° Si la solución exigida, propuesta o convenida en aplicación del artículo L. 211-9 no pudiera llevarse a cabo en el transcurso de un mes tras la reclamación interpuesta; 2.° O si esta solución comportase algún inconveniente importante para el comprador habida cuenta de la naturaleza del bien o el uso que quisiera darle. En todo caso, la venta no quedará cancelada si la falta de conformidad es de carácter menor».<br>Artículo L.211-11 del Código de Consumo francés: «La aplicación de lo dispuesto en los artículos L.211-9 y L.211-10 no comportará gasto alguno para el comprador. Dichas disposiciones no impedirán la concesión de indemnizaciones por daños y perjuicios».<br>Artículo L.211-12 del Código de Consumo francés: «Toda posible acción que resulte de la falta de conformidad del bien prescribe en el plazo de dos años a partir de la fecha de entrega del mismo».<br>Artículo 1641 del Código Civil francés: «El vendedor está obligado a proporcionar una garantía por los defectos ocultos en el artículo vendido que puedan inutilizarlo para el uso al que estaba destinado, o que mermen dicha finalidad hasta el punto de que el comprador, de haberlo sabido, no hubiese realizado la compra, o solo lo hubiera hecho a menor precio».<br>Artículo 1643: «El vendedor se responsabilizará de los defectos ocultos del bien aunque los ignorase, a menos que se haya estipulado de antemano su exención de toda garantía».<br>Artículo 1644 del Código Civil francés: «En los casos descritos en los artículos 1641 y 1643, el comprador tiene la opción de devolver el bien y recuperar el precio pagado, o de conservarlo y recibir un reembolso parcial».<br>Artículo 1648, párrafo

He is then obliged to proceed, unless it is impossible, according to the method not chosen by the buyer.”<br>Article L.211-10 of the French Consumer Code: "If repair and replacement of the goods are impossible, the buyer may return the goods and have the price refunded or keep the goods and have part of the price refunded. The same option is open to him: 1° If the solution requested, proposed or agreed upon in application of article L. 211-9 cannot be implemented within one month of the buyer's complaint; 2° Or if this solution cannot be implemented without major inconvenience for the buyer, given the nature of the goods and the use he is seeking. However, the sale cannot be cancelled if the lack of conformity is minor.”<br>Article L.211-11 of the French Consumer Code: "The application of the provisions of articles L.211-9 and L.211-10 is without any cost for the buyer.
