                "Touhou Creator" Terms of Service
                <br><br>
                本規約は、しろ（以下、「開発者」といいます）が提供するゲーム『東方クリエイター』（以下、「本サービス」といいます）のオンライン機能の利用条件を定めるものです。本サービスのオンライン機能を利用するユーザーは、本規約に同意したものとみなします。
                These Terms of Service (these "Terms") set forth the conditions for use of the online features of the game "Touhou Creator" (the "Service"), provided by Shiro (the "Developer"). By using the online features of the Service, users are deemed to have agreed to these Terms.

                第1条（東方Projectの二次創作およびガイドラインについて）
                Article 1 (Touhou Project Fan Creations and the Guidelines)
                <br>1. 
                本サービスは、「上海アリス幻樂団」様が制作する『東方Project』の二次創作ゲームです。本サービスの内容および提供について、上海アリス幻樂団様は一切の責任を負いません。本サービスに関するお問い合わせを上海アリス幻樂団様へ送ることはお控えください。
                The Service is a fan-made derivative game based on "Touhou Project," created by Team Shanghai Alice. Team Shanghai Alice bears no responsibility whatsoever for the content or provision of the Service. Please refrain from sending inquiries about the Service to Team Shanghai Alice.

                ユーザーは、本サービスの利用（特にユーザー作成データのアップロード等）にあたり、上海アリス幻樂団様が定める「東方Projectの二次創作ガイドライン」を必ず通読し、その内容を遵守するものとします。
                When using the Service (in particular, when uploading user-created data), users shall read through the "Guidelines for Touhou Project Fan Creators" established by Team Shanghai Alice and comply with them.

                第2条（ユーザー作成コンテンツの取り扱い）
                Article 2 (Handling of User-Generated Content)
                <br>
                ユーザーが本サービスを通じて作成・アップロードしたデータ（ステージ、弾幕データなど。以下、「UGC」といいます）の著作権は、原則として作成したユーザーに帰属します。
                Copyright in the data that users create and upload through the Service (stages, danmaku (bullet pattern) data, and the like; hereinafter "UGC") belongs, in principle, to the user who created it.
                <br>
                ユーザーは、UGCをアップロードした時点で、開発者が本サービスの運営、配信、およびプロモーションの目的で当該UGCを無償かつ非独占的に利用・改変・公開することを許諾したものとみなします。
                By uploading UGC, the user is deemed to have granted the Developer a royalty-free, non-exclusive license to use, modify, and publish that UGC for the purposes of operating, distributing, and promoting the Service.

                開発者は、UGCが不適切であると判断した場合、ユーザーへの事前の通知なく当該データを削除する権利を有します。
                If the Developer determines that any UGC is inappropriate, the Developer reserves the right to delete the data without prior notice to the user.

                第3条（禁止事項）
                Article 3 (Prohibited Acts)

                ユーザーは、本サービスの利用にあたり、以下の行為をしてはなりません。
                In using the Service, users must not engage in any of the following acts:

                ・上海アリス幻樂団様の定める「東方Projectの二次創作ガイドライン」に違反する行為、または違反するおそれのあるUGC（データ、テキスト等）を作成・アップロードする行為
                - Acts that violate the "Guidelines for Touhou Project Fan Creators" established by Team Shanghai Alice, or creating or uploading UGC (data, text, etc.) that violates, or is likely to violate, the Guidelines

                ・チート行為、データの改ざん、または不具合を意図的に利用する行為
                - Cheating, tampering with data, or deliberately exploiting bugs
                <br>
                ・他のユーザーを不快にさせる、または公序良俗に反するユーザー名の登録、およびUGCの作成
                - Registering a username, or creating UGC, that offends other users or is contrary to public order and morals
                <br>
                ・サーバーに過度な負担をかける行為
                - Placing an excessive load on the server
                <br>
                ・その他、開発者が不適切と判断する行為
                - Any other act that the Developer deems inappropriate

                第4条（免責事項・サービスの変更と停止）
                Article 4 (Disclaimer; Changes to and Suspension of the Service)

                本サービスは個人によって開発・運営されており、商業的な品質や厳格な運用体制を保証するものではありません。ユーザーは、以下の事項に同意した上で本サービスを利用するものとします。
                The Service is developed and operated by an individual, and no commercial-grade quality or rigorous operational structure is guaranteed. Users shall use the Service only upon agreeing to the following:

                データの消失:

                サーバーの不具合、メンテナンス、またはその他の予期せぬ理由により、ランキングデータやユーザーが作成・アップロードしたUGCが予告なく消失・リセットされる場合があります。開発者はデータの復旧義務を負わず、データの消失による一切の損害について責任を負いません。
                of data: Ranking data and UGC created or uploaded by users may be lost or reset without notice due to server malfunctions, maintenance, or other unforeseen causes. The Developer has no obligation to restore lost data and accepts no liability whatsoever for any damage arising from the loss of data.

                サービスの停止:

                開発者の都合により、事前の予告なく本サービスの全部または一部（オンライン機能など）の提供を一時停止、または終了する場合があります。
                of the Service: The Developer may, at the Developer's own discretion and without prior notice, suspend or terminate the provision of all or part of the Service (including its online features).

                開発者は、本サービスに事実上または法律上の瑕疵（安全性、信頼性、正確性、完全性、有効性、特定の目的への適合性、セキュリティなどに関する欠陥、エラーやバグ、権利侵害などを含みます）がないことを明示的にも黙示的にも保証しておりません。
                The Developer makes no warranty, express or implied, that the Service is free from factual or legal defects (including defects relating to safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, and security, as well as errors, bugs, and infringements of rights).

                第5条（規約の変更）
                Article 5 (Changes to these Terms)

                開発者は、必要と判断した場合には、ユーザーに通知することなくいつでも本規約を変更することができるものとします。
                The Developer may change these Terms at any time, without notice to users, whenever the Developer deems it necessary.

                しろ（以下、「開発者」）は、『東方クリエイター』（以下、「本サービス」）におけるユーザーの情報の取り扱いについて、以下のとおりプライバシーポリシーを定めます。
                Shiro (the "Developer") establishes the following Privacy Policy regarding the handling of users' information in "Touhou Creator" (the "Service").

                When users use the online features of the Service (leaderboards, asynchronous multiplayer battles, data sharing, and the like), the following information is collected and used for the following purposes:

                リーダーボードへの表示、および他のユーザーへゲームデータを配信・共有するため。

                Purpose: To display them on leaderboards, and to distribute and share game data with other users.

                不正行為（チート、ランキングの過度な操作等）の監視・防止、および規約違反者に対するオンライン機能のアクセス制限（BAN対応）を行うため。
                identifiers (hardware IDs, etc.)<br>Purpose: To monitor and prevent misconduct (such as cheating and excessive manipulation of rankings), and to restrict violators' access to the online features (i.e., bans).

                開発者は、取得した情報を、法令に基づく場合を除き、ユーザーの同意を得ることなく第三者に提供・販売・開示することはありません。
                The Developer will not provide, sell, or disclose the collected information to any third party without the user's consent, except as required by law.

                データの管理と削除

                取得したデータは本サービスの運営に必要な期間保存されますが、個人運営の性質上、サーバーの容量制限や予期せぬ障害により、事前の予告なくデータが削除される場合があります。
                The collected data will be retained for as long as necessary for the operation of the Service. However, given that the Service is operated by an individual, data may be deleted without prior notice due to server capacity limits or unexpected failures.
