BEFORE ACCESSING AND PLAYING THE GAME, USING THE RELATED SERVICES OR ACCESSING ANY GAME RELATED WEBSITES, APPS ETC. (THE GAME, RELATED SERVICES, APPS, AVALANCHE APEX ACCOUNT AND THE WEBSITES HEREINAFTER THE “GAME”), PLEASE READ THIS AGREEMENT CAREFULLY. PLEASE NOTE THAT BY ACCESSING AND PLAYING THE GAME YOU AGREE TO ABIDE BY THIS END USER LICENSE AGREEMENT AND A LEGALLY BINDING AGREEMENT IS CREATED BETWEEN AVALANCHE STUDIOS GROUP AB (“AVALANCHE STUDIOS GROUP”) AND YOU WHETHER OR NOT YOU ARE A REGISTERED PLAYER OF THE GAME (“END USER”). IF YOU ARE AN END USER BASED IN THE UNITED STATES CERTAIN PROVISIONS OF THE AGREEMENT SPECIFICALLY APPLIES TO YOU, FOR EXAMPLE SECTIONS 23 AND 24, UNDER WHICH YOU AGREE TO ARBITRATE CERTAIN CLAIMS INSTEAD OF GOING TO COURT AND AGREE NOT TO BRING CLASS ACTIONS CLAIMS. IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS OF THIS AGREEMENT, PLEASE DO NOT ACCESS AND PLAY THE GAME. AVALANCHE STUDIOS GROUP RESERVES THE RIGHT TO TEMPORARILY OR PERMANENTLY DISABLE ACCESS TO THE GAME FOR ANYONE WHO VIOLATES THIS AGREEMENT. AVALANCHE STUDIOS GROUP MAY DISABLE ACCESS TO THE GAME AT ITS DISCRETION AND MAY DO SO WITHOUT NOTICE. ALL CONTENT IS OPERATED BY AVALANCHE STUDIOS GROUP AND ITS AFFILIATES.

RELACIONADOS CON EL JUEGO (EN ADELANTE, EL JUEGO, LOS SERVICIOS, LAS APLICACIONES, LA CUENTA DE AVALANCHE APEX Y LOS SITIOS WEB RELACIONADOS SE DENOMINARÁN EN SU CONJUNTO COMO EL «JUEGO»), LEA DETENIDAMENTE EL PRESENTE ACUERDO. TENGA EN CUENTA QUE, AL ACCEDER Y JUGAR AL JUEGO SE COMPROMETE A CUMPLIR ESTE ACUERDO DE LICENCIA DE USUARIO FINAL, Y EN EL MISMO ACTO, SE CREA UN ACUERDO LEGALMENTE VINCULANTE ENTRE AVALANCHE STUDIOS GROUP AB (EN ADELANTE, «AVALANCHE STUDIOS GROUP») Y USTED (EL «USUARIO FINAL»), CON INDEPENDENCIA DE QUE SE HAYA REGISTRADO EN EL JUEGO O NO. SI ES USTED UN USUARIO FINAL RESIDENTE EN LOS ESTADOS UNIDOS, HAY ALGUNAS DISPOSICIONES DEL PRESENTE ACUERDO QUE SE LE APLICAN ESPECÍFICAMENTE, COMO POR EJEMPLO LAS QUE SE RECOGEN EN LAS SECCIONES 23 Y 24, POR LAS QUE SE COMPROMETE A SOMETER A UN ARBITRAJE DETERMINADAS RECLAMACIONES EN LUGAR DE ACUDIR A LOS TRIBUNALES Y A NO PRESENTAR DEMANDAS COLECTIVAS. SI NO ACEPTA LAS CONDICIONES DE ESTE ACUERDO, NO ACCEDA NI JUEGUE AL JUEGO. AVALANCHE STUDIOS GROUP PUEDE BLOQUEAR EL ACCESO AL JUEGO DE FORMA TEMPORAL O PERMANENTE A CUALQUIERA QUE INCUMPLA ESTE ACUERDO. AVALANCHE STUDIOS GROUP PUEDE BLOQUEAR EL ACCESO AL JUEGO CUANDO ASÍ LO CONSIDERE Y PUEDE HACERLO SIN PREVIO AVISO. AVALANCHE STUDIOS GROUP Y SUS AFILIADOS SE ENCARGAN DE GESTIONAR TODO EL CONTENIDO.

1. Acceptance
This document (“End User License Agreement”, “Agreement”, “EULA”) is a legal agreement between you (“You” or “the user”) and Avalanche Studios Group AB corp.reg.no 556675-1748, a Swedish corporation, with business offices at Västgötagatan 5, SE-11827 Stockholm, Sweden (“Avalanche Studios Group”) and governs your use of the Game, whether or not you are a registered End User of the Game.

1. Aceptación
Este documento («Acuerdo de licencia de usuario final», «Acuerdo», «EULA») es un contrato de naturaleza legal acordado entre usted («Usted» o «el Usuario») y Avalanche Studios Group AB, una empresa sueca con n.º de registro mercantil 556675-1748y sede social registrada en Västgötagatan 5, SE-11827 Estocolmo, Suecia («Avalanche Studios Group»). El Acuerdo rige el uso del Juego por su parte, con independencia de que sea un usuario final registrado o no.

To accept this EULA, create an account to play or access the Game, or otherwise access or play the game, you must be 13 years of age or older. If you are older than 13 years, but younger than 18 or otherwise not able to enter into Agreements by yourself, you must have your parents, parental guardian or legal guardian accept and confirm this Agreement on your behalf.

Para aceptar este CLUF, crear una cuenta para jugar o acceder al Juego, o bien, acceder o jugar al Juego, usted deberá tener un mínimo de 13 años de edad. Si es mayor de 13 años, pero menor de 18 años o no puede celebrar acuerdos por sí mismo, deberá solicitar a uno de sus progenitores o tutores legales que acepten y confirmen este acuerdo en su nombre.

If you are younger than 13 years old, or if you are younger than 18 years old and do not have your parents’ or guardians’ consent to this Agreement, you may not access or play the Game. Parents and guardians are responsible for the acts of children under 18 years of age when using or accessing the Game. If, under applicable law, the minimum age for entering into contracts differ from the above, then the applicable law in your country of residence shall apply.

Si es menor de 13 años, o si es menor de 18 años y no cuenta con el consentimiento de sus progenitores o tutores para este acuerdo, no podrá acceder ni jugar al Juego. Los progenitores y tutores son responsables de los actos de los menores de 18 años cuando utilicen o accedan al Juego. Si, en virtud de la legislación aplicable, la edad mínima para celebrar contratos difiere de la anterior, se aplicará la legislación vigente en su país de residencia.

PLEASE NOTE THAT BY ACCESSING AND PLAYING THE GAME YOU AGREE TO ABIDE BY AND BE BOUND BY THIS AGREEMENT. AVALANCHE STUDIOS GROUP OWNS OR CONTROLS ALL INTELLECTUAL PROPERTY RIGHTS IN AND TO THE GAME AND PERMITS YOU TO PLAY THE GAME ONLY IN ACCORDANCE WITH THESE TERMS. YOUR PLAYING OF THE GAME CONSTITUTES YOUR ACCEPTANCE OF THE AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS OF THIS AGREEMENT, PLEASE DO NOT ACCESS AND PLAY THE GAME.

TENGA PRESENTE QUE AL ACCEDER Y JUGAR AL JUEGO SE COMPROMETE A CUMPLIR ESTE ACUERDO, QUE SERÁ VINCULANTE PARA USTED. AVALANCHE STUDIOS GROUP POSEE O CONTROLA TODOS LOS DERECHOS DE PROPIEDAD INTELECTUAL RELACIONADOS CON EL JUEGO Y SOLO LE PERMITE JUGAR SI CUMPLE CON ESTAS CONDICIONES. AL JUGAR AL JUEGO ACEPTA LAS CONDICIONES DE ESTE ACUERDO. SI NO ACEPTA LAS CONDICIONES DE ESTE ACUERDO, NO ACCEDA NI JUEGUE AL JUEGO.

2. Access to the Game
To access and play the Game you must create an account with a platform/service provider, unless the Game is expressly provided in a form or venue where an account is not required such as a physical copy inserted into a console or PC, or an arcade or game console. You may not, under any circumstances, whether intentionally, or through negligence or inaction, allow or enable others or to access your account. Avalanche Studios Group reserves the right to disable or block accounts without notice. You are not permitted to transfer your account, any in game currency, characters etc. to another person or entity, unless specifically permitted in writing by Avalanche Studios Group. Please refer to the Privacy Policy for further information regarding age limitations while accessing the Game.

2. Acceso al Juego
Para acceder y jugar al Juego, debe registrar una cuenta con un proveedor de servicios o plataforma, salvo que el formato o medio del Juego no lo requieran, como una copia física insertada en una consola o PC, o una consola de Juegos o arcade. Está terminantemente prohibido permitir o facilitar que otros accedan a su cuenta, sea de manera intencionada, por negligencia o inactividad. Avalanche Studios Group se reserva el derecho a cancelar o bloquear cuentas sin previo aviso. Se prohíbe transferir su cuenta, dinero, personajes u otros elementos del Juego a otras personas o entidades, salvo que lo autorice Avalanche Studios Group por escrito. To access the Game, you may be required to create an Avalanche Apex Connect Account with Avalanche Studios Group. For information regarding data collection in connection with the Avalanche Apex Connect Account please see the applicable Privacy Policy.

3. Third Party Accounts
If enabled by Avalanche Studios Group in its sole discretion, you may establish an account with account data provided to Avalanche Studios Group by a third party such as a gaming platform, social networking service etc. in which case you may have a separate, additional account relationship with such third party.

4. Registration
You acknowledge and agree that you will (a) provide true, accurate, current, and complete information as requested when registering an account and (b) maintain and update this registration information to keep it true, accurate, current, and complete. You are solely responsible for maintaining the confidentiality of your account and password and for restricting access to any computer, console, smart phone, tablet etc. that you use for accessing the Game and you hereby accept sole responsibility for all activities that occur under your account or password. Avalanche Studios Group, its affiliates and service providers reserve the right to restrict or terminate access to the Game, refuse service, terminate accounts, remove or edit content, or cancel orders in its sole discretion for any reason whatsoever, including, without limitation, if you provide registration information which is false, inaccurate, not current, or incomplete. For information regarding how Avalanche Studios Group handles personal data you transmit through the Game please visit the Privacy Policy. Please note that your access to and playing of the Game constitutes your acceptance of the Privacy Policy.

4. Registro
Usted reconoce y acepta que a) la información que facilite al registrar una cuenta será veraz, precisa, completa y actual; y que b) actualizará dicha información cuando sea necesario para mantener su veracidad, precisión, completitud y actualización. Usted se hace responsable de mantener la confidencialidad de su cuenta y su contraseña, y de restringir el acceso a cualquier ordenador, consola, «smartphone», tableta o sistema que utilice para acceder al Juego. Por la presente, acepta la responsabilidad exclusiva de todas las actividades que se realicen en su cuenta o usando su contraseña. En el caso de que facilite unos datos de registro que sean falsos, inexactos, incompletos o que no estén actualizados, Avalanche Studios Group, sus afiliados y sus proveedores de servicios se reservan el derecho a restringir o cancelar el acceso al Juego, negarse a prestar servicios, eliminar cuentas, borrar o editar contenidos, o cancelar pedidos sin ninguna restricción cuando así lo consideren necesario. 5. Products and services
Avalanche Studios Group reserves the right to add, modify, or delete/cancel the Game, including your access to the Game at any time. Avalanche Studios Group makes no representation or warranty as to the completeness or accuracy of the Game nor does it represent or warrant that the Game will be available at all times or at any time. The Game may be incomplete, may contain errors etc. Avalanche Studios Group makes no commitment and expressly disclaims any duty to fix any errors or lack of functionality in the Game. The Game is provided on an “as is” basis without any express warranties.

5. Productos y servicios
Avalanche Studios Group se reserva el derecho de añadir, modificar, borrar o cancelar el Juego o su acceso en cualquier momento. Avalanche Studios Group no ofrece ninguna garantía con respecto al estado de finalización o la precisión del Juego, y tampoco garantiza que esté disponible en todo momento. 6. Payment
You agree to fully pay for the Game and any and all products and services ordered in the Game. You are responsible for providing Avalanche Studios Group and/or the platform/service providers with valid credit card information to secure payment. Avalanche Studios Group and/or the platform/service providers reserves the right to cancel any order if the credit card information you provide is not valid. Payment may be processed in cooperation with third party payment service providers, like PayPal etc. Avalanche Studios Group or the platform/service providers confirm all subscriptions, purchases and may send initial login or activation information by email once Avalanche Studios Group or the platform/service provider have had the opportunity to confirm your purchase.

6. Pagos
Usted se compromete a pagar por el Juego y todos los productos y servicios que adquiera a través de él. Es su responsabilidad facilitar a Avalanche Studios Group y a los proveedores del servicio o la plataforma los datos de una tarjeta de crédito válida para garantizar estos pagos. 7. Payment terms
In order to access and play the Game, access certain additional content, premium services etc. you may be required to pay certain fees (the Game and any applicable premium services and access to additional content are provided to paying users only). You can find the current fees and payment terms at the platform/service provider’s Game access pages, the game webpage etc. Avalanche Studios Group may also offer other products and services in the Game etc., either for free, for one-time fees or for recurring fees. Avalanche Studios Group and/or the platform/service provider may amend the fees and payment terms at any time. If any fees are subject to any type of applicable taxes, Avalanche Studios Group or the platform/service provider may charge you for any such taxes, in addition to any fees.

7. Condiciones de los pagos
Para acceder y jugar al Juego, o acceder a determinados contenidos o servicios prémium, puede que tenga que pagar una cuota. Tanto el Juego como los servicios prémium asociados y el acceso a los contenidos adicionales son exclusivos de los usuarios de pago. ALL FEES ARE PAYABLE IN ADVANCE AND ARE NOT REFUNDABLE IN WHOLE OR IN PART, UNLESS STATED OTHERWISE IN THIS AGREEMENT OR IN THE PLATFORM/SERVICE PROVIDER’S TERMS AND CONDITIONS.

LAS CUOTAS SE ABONARÁN POR ANTICIPADO Y NO SE REEMBOLSARÁN NI PARCIAL NI TOTALMENTE SALVO QUE SE ESPECIFIQUE LO CONTRARIO EN EL PRESENTE ACUERDO O EN LAS CONDICIONES DE LOS PROVEEDORES DEL SERVICIO O LA PLATAFORMA.

However, a remaining portion of the payment may be credited in Avalanche Studios Group’s and/or the platform/service provider sole discretion should you decide to upgrade your services. When you purchase the Game and any product or service in the Game or in relation to the Game you authorize Avalanche Studios Group or the platform/service provider to automatically charge your credit card the fees in accordance with the payment terms. You are responsible for paying all applicable taxes (including those Avalanche Studios Group or the platform/service provider are not required to collect) and for all hardware, software, Internet, and related equipment (where applicable; platform specific VR headsets/screen etc.) and other costs you incur to access and play the Game. Avalanche Studios Group and/or the platform/service providers reserves the right to change the fees and availability of the Game at any time without notice; provided, however, such price change will not affect your purchase price for orders that Avalanche Studios Group or the platform/service provider has already actually received from you and processed, unless expressly stated otherwise in your payment terms. You are responsible for reviewing the Game for changes in the fees or payment terms.

8. Access
In consideration of the payment of any applicable fees and subject to your registering for an account and compliance with the terms contained herein, Avalanche Studios Group or the platform/service provider will, upon receipt of your payment if applicable, provide you with a limited, non-exclusive, revocable license to access the Game and enable you to access and play the Game subject to the other applicable provisions, limitations and restrictions in this Agreement. You may not upload or republish the Game or Game Content on any Internet, Intranet or Extranet sites or incorporate the information in any other database or compilation, and any other use of the Game or Game Content is strictly prohibited. Notwithstanding the foregoing, you may stream and record your playing of the Game on channels like Twitch etc. provided that such use is done in good taste and does not infringe the intellectual property rights of Avalanche Studios Group. If Avalanche Studios Group or the platform/service provider are unable to process your payment at any time, your access to certain services, content etc. may be suspended or terminated at Avalanche Studios Group’s or the platform/service provider’s discretion. Avalanche Studios Group may suspend or revoke your license if you violate, or assist others in violating the Terms and Service agreement that applies to the Game.

8. Acceso
Como contraprestación por el pago de las cuotas correspondientes, Avalanche Studios Group o los proveedores del servicio o la plataforma (una vez obtenido el recibo del pago, cuando proceda) le proporcionarán una licencia limitada, no exclusiva y revocable para acceder al Juego, y le permitirán acceder y jugar al Juego conforme a las demás disposiciones, limitaciones y restricciones de este Acuerdo, siempre que registre una cuenta y cumpla con las condiciones que aquí se recogen. Queda prohibido subir o volver a publicar el Juego o contenidos del Juego en cualquier página de Internet, intranet o extranet, así como incorporar la información a cualquier base de datos o compilación. Asimismo, queda terminantemente prohibido cualquier otro uso del Juego o sus contenidos. Sin perjuicio de lo anterior, usted sí puede transmitir en directo o grabar sus partidas del Juego utilizando plataformas como Twitch y demás, siempre que al hacerlo no atente contra las normas del decoro y el buen gusto, no infrinja los derechos de propiedad intelectual de Avalanche Studios Group. Si Avalanche Studios Group o los proveedores del servicio o la plataforma no pudieran procesar sus pagos en algún momento, cabe la posibilidad de que Avalanche Studios Group o los proveedores del servicio o la plataforma, si así lo deciden, suspendan o cancelen su acceso a determinados servicios, contenidos, etc. Avalanche Studios Group puede suspender o retirar su licencia en caso de que incumpla o ayude a otros a incumplir las condiciones del Juego.

9. Delivery of products and services
Avalanche Studios Group provides the Game on an “as is” basis. Avalanche Studios Group or the platform/service provider shall endeavor to deliver the Game that you have ordered to you within a reasonable amount of time. However, technical problems may delay or prevent delivery and except as set forth in the next sentence, Avalanche Studios Group or the platform/service provider shall have no liability to you with respect to delays or delivery problems. Your sole remedy with respect to the Game, a purchased product or service that is not delivered within a reasonable amount of time after ordering is to either receive a replacement of the Game, product or service, or a refund of the purchase price paid for the Game, product or service, as determined by Avalanche Studios Group or the platform/service provider in their sole discretion.

9. Entrega de productos y servicios
Avalanche Studios Group ofrece el Juego tal cual. Avalanche Studios Group o los proveedores del servicio o la plataforma procurarán entregarle el Juego que haya encargado dentro de un plazo razonable. Sin embargo, puede haber problemas técnicos que retrasen o impidan dicha entrega. En estos casos, ni Avalanche Studios Group ni los proveedores del servicio o la plataforma serán responsables ante Usted por demoras o problemas en la entrega, salvo en la medida en que se expresa en la siguiente frase. La única compensación que podrá recibir por un retraso excesivo en la recepción del Juego, un producto o un servicio adquirido es un reemplazo del Juego, producto o servicio en cuestión, o el reembolso del precio de compra que pagara por ellos, según determine Avalanche Studios Group o los proveedores del servicio o la plataforma a su total discreción.

10. Links to other Games
The Game, platforms etc. may contain links to other games, websites, services etc. Avalanche Studios Group does not review or evaluate any games, websites, services etc. linked to in the Game or the platform and is not responsible for the accuracy, copyright compliance, legality, decency, or appropriateness of the content on these games, websites, services etc. nor is it responsible for the advertising, products, or other materials that may appear in or are offered by such games, websites, services, the platforms etc. You should carefully review the respective conditions of use for each of these games, websites, services etc. Under no circumstances shall Avalanche Studios Group be held responsible or liable, directly or indirectly, for any loss or damages caused or alleged to have been caused by your use of or reliance on any content, products, goods, or services etc. available on such Games, websites, services, platforms etc.

11. Indemnification
Your access to and playing of the Game constitutes your agreement to defend, indemnify, and hold harmless Avalanche Studios Group, its parents and affiliates, licensors and partners, the platform/service providers and their respective members, employees, contractors, officers, and directors, from and against any actions, claims, demands, liability and expenses, including reasonable attorneys’ fees, arising out of your use or misuse of the Game including related services by a third party with the use of your account.

11. Indemnización

12. Termination
This Agreement is effective until amended by Avalanche Studios Group in its sole discretion. Avalanche Studios Group may change, suspend, or discontinue all or any aspect of the Game at any time for any reason without prior notice or liability, including, without limitation, the availability of the Game or any feature, without prior notice or liability. Avalanche Studios Group may cease to provide the Game or any or all of the products and services offered in connection with the Games, terminate this Agreement, and cancel all of the rights granted to you under this Agreement at any time for any reason without prior notice or liability. Avalanche Studios Group may, but is not obligated to, communicate such termination to you in any of the following manners: (i) in a notice in the Game; (ii) via electronic mail; (iii) in the EULA, or (iv) in another manner that Avalanche Studios Group deems suitable to inform you of the termination. If Avalanche Studios Group terminates the Game, you will not receive a refund of paid fees. In the event of any termination hereunder sections 1, 3, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 24, 25, 26, 27, 28 and 29 of this Agreement will survive termination.

12. Rescisión
Este Acuerdo sigue vigente hasta que Avalanche Studios Group decida, a su total discreción, modificarlo. TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, AVALANCHE STUDIOS GROUP DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

YOU HEREBY ACKNOWLEDGE THAT THIS PARAGRAPH SHALL APPLY TO ALL CONTENT, PRODUCTS AND SERVICES AVAILABLE IN OR IN RELATION TO THE GAME. POR LA PRESENTE, USTED RECONOCE QUE ESTE PÁRRAFO SE APLICA A TODOS LOS CONTENIDOS, PRODUCTOS Y SERVICIOS DISPONIBLES EN EL JUEGO O RELACIONADOS CON ÉL. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AVALANCHE STUDIOS GROUP BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, INTERRUPTION, LOSS OF INFORMATION, OR ANY OTHER PECUNIARY LOSS (HOWEVER ARISING, INCLUDING, WITHOUT LIMITATION, NEGLIGENCE) ARISING OUT OF THE POSSESSION OF, USE OF OR INABILITY TO USE THE GAME, OR PRODUCTS AND SERVICES YOU HAVE PURCHASED OR USE IN OR IN CONNECTION WITH THE GAME, OR DEFECT IN OR CAUSED BY THE GAME, OR PRODUCTS AND SERVICES YOU HAVE PURCHASED OR USE IN OR IN CONNECTION WITH THE GAME, INCLUDING BUT NOT LIMITED TO COMPROMISING THE SECURITY OF YOUR COMPUTER, OPERATING SYSTEM OR FILES, OR THE PROVISION OF OR FAILURE TO PROVIDE SUPPORT, EVEN IF YOU HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AVALANCHE STUDIOS GROUP’S ENTIRE LIABILITY UNDER ANY PROVISION OF THIS AGREEMENT SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID BY YOU FOR THE GAME, PRODUCTS AND SERVICES DURING THE TWELVE MONTHS PRECEDING THE CLAIM.

EN LA MEDIDA EN QUE LO PERMITA LA LEGISLACIÓN VIGENTE, AVALANCHE STUDIOS GROUP NO SE HACE RESPONSABLE BAJO NINGUNA CIRCUNSTANCIA DE DAÑOS INDIRECTOS, CONTINGENTES, ESPECIALES O RESULTANTES DE NINGÚN TIPO (INCLUIDOS, ENTRE OTROS, LOS DERIVADOS DEL LUCRO CESANTE, LA INTERRUPCIÓN O LA PÉRDIDA DE INFORMACIÓN) NI DE NINGÚN OTRO PERJUICIO PECUNIARIO (INCLUIDOS LOS QUE SE DERIVEN DE UNA NEGLIGENCIA, ENTRE OTROS) COMO CONSECUENCIA DE LA POSESIÓN, EL USO O LA IMPOSIBILIDAD DE USAR EL JUEGO O LOS PRODUCTOS Y SERVICIOS ADQUIRIDOS O UTILIZADOS POR USTED EN EL JUEGO O EN RELACIÓN CON ESTE. AVALANCHE STUDIOS GROUP TAMPOCO SE HACE RESPONSABLE DE LOS DEFECTOS DEL JUEGO O PROVOCADOS POR ÉL O LOS PRODUCTOS Y SERVICIOS ADQUIRIDOS O UTILIZADOS POR USTED EN EL JUEGO O EN RELACIÓN CON ESTE (INCLUIDOS, ENTRE OTROS, CUALQUIER CIRCUNSTANCIA QUE COMPROMETA LA SEGURIDAD DE SU EQUIPO, SUS ARCHIVOS O SU SISTEMA OPERATIVO, LA PRESTACIÓN DE ASISTENCIA O LA NEGATIVA A PRESTARLA), AUN EN EL CASO DE QUE ESTUVIERA USTED AL CORRIENTE DE QUE PODÍAN PRODUCIRSE TALES DAÑOS. EN LA MEDIDA EN QUE LO PERMITA LA LEGISLACIÓN VIGENTE, LA RESPONSABILIDAD MÁXIMA DE AVALANCHE STUDIOS GROUP EN RELACIÓN CON CUALQUIERA DE LAS DISPOSICIONES DEL PRESENTE ACUERDO SE LIMITARÁ A LA CANTIDAD QUE HAYA PAGADO USTED POR EL JUEGO, LOS PRODUCTOS Y LOS SERVICIOS EN LOS DOCE MESES ANTERIORES A LA RECLAMACIÓN.

15. Seizure warning, motion sickness etc.
In rare instances, some users may experience seizures when exposed to certain light patterns or flashing lights. Exposure to certain light patterns or backgrounds on a video monitor or virtual reality headset may induce an epileptic seizure, motion sickness even in persons who have no history of prior seizures or epilepsy. Avalanche Studios Group takes no responsibility for such effects and end results and you are accessing and playing the Game on your own risk. Nor does Avalanche Studios Group take any responsibility for motion sickness, any balance problem that may occur from the playing of the Game etc.

15. Aviso sobre convulsiones, mareos, etc.

16. Trademarks and Game marks
The names, logos, characters, brands and product and service names appearing in the Game and related services are trademarks/service marks or registered trademarks/service marks of Avalanche Studios Group or third parties (the respective holders). The use of any such trademark or service mark without express written consent of the respective holder is strictly prohibited.

17. Intellectual Property Rights

You acknowledge and agree that all content, design elements, and materials available in the Game, for example graphics, logos, designs, characters, objects, environments, worlds, icons, scripts and service names (“Avalanche Studios Group Content”) are owned by Avalanche Studios Group and/or its partners and licensors and protected by copyrights, trademarks, patents, trade secrets, and/or other proprietary rights of Avalanche Studios Group and/or its partners and licensors. Avalanche Studios Group and its partners and licensors retain all right, title and interest in and to the Avalanche Studios Group Content. You may not use, copy, reproduce, modify, republish, upload, post, transmit or distribute any Avalanche Studios Group Content in any form or for any means, unless expressly permitted in this Agreement. Avalanche Studios Group’s trademarks and trade dress may not be used, including as part of trademarks and/or as part of domain names, in connection with any product or service in any manner that is likely to cause confusion and may not be copied, imitated, or used, in whole or in part, without the prior written permission of Avalanche Studios Group. In addition, you may not sell, license, rent, perform, display, create derivative works from, or in any way use or exploit Avalanche Studios Group Content in any way unless expressly permitted in this Agreement. You agree not to disassemble, decompile or reverse engineer any software or other component of the Game or Avalanche Studios Group Content. Unless explicitly stated herein, nothing in this Agreement shall be construed as conferring to you any license to intellectual property rights, whether by estoppel, implication or otherwise. You agree not to assert against Avalanche Studios Group and affiliates any claim, action or proceeding for infringement of any patents, patent rights or other intellectual property rights.

End User License to play the Game
By registering an account and paying the applicable fees you obtain a personal, single, revocable license to play the Game in accordance with section 8. All references in this Agreement to the “purchase” of the Game shall mean the obtaining of a license to play the Game, and all references to “sale” or “selling” of the Game shall mean the granting of a license to play the Game.

End User Intellectual Property
In the Game you may create certain content (“Submissions”). Except for the Avalanche Studios Group Content contained therein, any intellectual property right and title to such Submissions shall remain and where applicable shall become your intellectual property, created and submitted by you for use in the Game. That portion of a Submission that is not Avalanche Studios Group Content is sometimes referred to herein as “End User Content”. By publishing any Submission containing End User Content in the Game you represent and warrant that you have all rights necessary to grant the licenses contained herein. Furthermore, you represent and warrant that there is no suit, action or claim or other legal or administrative proceeding now pending or threatened which might directly or indirectly affect any of your End User Content, or any part thereof, or which might in any way impair the rights granted by you hereunder.

Avalanche Studios Group License to End User Intellectual Property
You agree that Avalanche Studios Group shall be given the irrevocable, sub-licensable, perpetual, worldwide, royalty free, fully paid up, right and license to utilize, perform, reproduce, incorporate into the Game and sequels, modify, edit, publicly perform, publicly display, distribute and make derivative works from your End User Content as contained in the Submissions in the Game and sequels, on its Websites and in any and all media now known or hereafter devised for marketing and promotional purposes and to feature your End User Content and Submissions, and any derivative works created therefrom, in its products and services. For example, Avalanche Studios Group may use your End User Content and Submissions in marketing and promotional materials for the Game, on social media platforms, in merchandising materials etc.

18. Prohibited use
You agree to abide by all applicable laws and regulations when playing the Game. Your continued access to the Game and right to play the Game is subject to proper conduct. Without limiting Avalanche Studios Group’s rights to control the Game’s environment, and the conduct of the End Users within that environment, Avalanche Studios Group prohibits the following practices that Avalanche Studios Group has determined detract from the overall user experience and you are strictly prohibited from:

Use of your own or third-party software, the Game or any information accessible through the System, to bypass or modify any System login architecture or create or provide any other means through which any System may be accessed and/or the Game may be used by others in ways other than those intended by Avalanche Studios Group;
Disrespecting the rights of others and their rights to play and enjoy the Game. You may not defraud, harass, threaten, or cause distress and/or unwanted attention to other players;
When naming any object, character, team, guild or clan etc. you may not use sexually explicit, harmful, threatening, abusive, defamatory, obscene, hateful, racially or ethnically offensive language;
You may not post or communicate any player's real world information (name, address, account name, etc.) in the Game, on the Websites or in any other forum or media, or make public anyone’s identification documents or sensitive financial information or posting such information in the Game or other permitted websites;
You may not harvest or collect email addresses or other contact information of other users from the Game by electronic or other means, for example for the purposes of sending unsolicited emails or other unsolicited communications;
You may not solicit personal information from anyone under 18 or solicit passwords or personally identifying information for commercial or unlawful purposes;
You may not use sexually explicit, harmful, threatening, abusive, defamatory, obscene, hateful, racially or ethnically offensive language or images;
You may not post material that includes graphic depictions of gratuitous or excessive violence, includes profane or obscene language or gestures, advocates intoxication or substance abuse, promotes gender, political or religious stereotypes, makes negative or disrespectful comments etc. about religions or reflects adversely on the name, reputation or goodwill of Avalanche Studios Group;
You may not post, upload or link to any sexually explicit, harmful, threatening, abusive, defamatory, obscene, hateful, racially or ethnically offensive imagery or content;
You may not impersonate, harass, dox or otherwise cause distress to Avalanche Studios Group, its employees, representatives etc.;
You may not impersonate another person, misrepresenting your affiliation with an entity or person, hiding or attempting to hide your identity or otherwise conducting fraud;
You may not violate, or encourage others to violate, any local, state, national, or international laws or regulations;
You may not market, promote, advertise, or solicit products or services in the Game;
You may not modify any part of the Game, or Clients, Servers etc.;
You may not advertise the intent to or commit the act of buying, selling, trading, sharing, or transferring access to the Game;
You may not advertise the intent to or commit the act of buying or selling items for cash or trading items in the Game;
You may not use the Game for any illegal purpose, arrange for the exchange or transfer of any pirated or illegal software in the Game;
You may not use the Game and/or User Created Content in a manner not compliant with applicable laws, terms and conditions contained herein and any applicable guidelines;
You may not use User Created Content in other games, products or services;
You will follow the instructions of authorized personnel in or related to the Game;
You may not organize nor be a member of any pledges or groups within the Game that are based on or espouse any racist, sexist, anti-religious, anti-ethnic, anti-gay, or other hate mongering philosophies;
You may not provide false information or intentionally hide any information when registering for your account in the Game;
You will not attempt to interfere with, hack into, or decipher any transmissions to or from the servers or platforms running the Game;
You will not exploit any bug in the Game and you will not communicate the existence of any such exploitable bug (bugs that grant the user unnatural or unintended benefits) either directly or through public posting, to any other user of the Game. Bugs related to the Game should promptly be reported to the support team in the channels identified in section 29.
You will not attempt to play the Game on any server or platform that is not controlled or authorized by Avalanche Studios Group, its designees or platform/service providers;
You will not create, use, or provide any server emulator or other site where the Game may be played, and you will not post or distribute any utilities, emulators or other software tools related to the Game without the express written permission of Avalanche Studios Group;
You will not register for a User account on behalf of an individual other than yourself, or register for a User account on behalf of any group or entity;
Using Avalanche Studios Group’s copyrights or trademarks or any confusingly similar marks;
Uploading invalid data, viruses, worms, or other software agents to the Game;
Collecting information from other End Users without obtaining their consent; or
Otherwise use the Game in any manner that breaches the terms and conditions of this Agreement or the Privacy Policy.
Avalanche Studios Group and the platform/service providers can delete End User Content and Submissions or close down your account and stop your access to the Game for any reason, at any time, in our sole discretion, without notice, including, but not limited to if we believe that you violate this Agreement or the Privacy Policy.

Realizar acciones que supongan una carga desproporcionada o irrazonable del sistema del Juego.
Usar software propio o de terceros para modificar el contenido del Juego o su entorno, o cambiar la manera en la que se juega o los servicios que ofrece.
Usar software propio o de terceros, el Juego o cualquier información accesible a través del sistema para omitir o modificar la arquitectura de inicio de sesión del sistema, o crear o proveer otros medios a través de los cuales otros puedan acceder a los sistemas o al Juego de manera distinta a la que Avalanche Studios Group ha dispuesto.

No debe publicar ni comunicar en el mundo real los datos de ningún jugador (nombre, domicilio, nombre de la cuenta, etc.) en el Juego, los sitios web o cualquier foro o medio, hacer públicos documentos que los identifiquen o información financiera sensible, ni publicar dicha información en el Juego u otros sitios web permitidos.
No debe recopilar direcciones de correo electrónico ni cualquier otro tipo de información de contacto de los usuarios del Juego a través de medios electrónicos o de cualquier otro tipo, por ejemplo, con la finalidad de enviar correos no deseados u otro tipo de comunicaciones.
No debe solicitar información personal de los menores de 18 años ni solicitar contraseñas o información que identifique personalmente para fines comerciales o ilegales.
No debe usar palabras ni imágenes sexualmente explícitas, dañinas, amenazantes, abusivas, difamatorias, obscenas, que promuevan el odio o sean racial o étnicamente ofensivas.
No debe publicar material que incluya representaciones gráficas de violencia excesiva o injustificada, lo que incluye lenguaje o gestos obscenos o profanos, que inciten al consumo de sustancias prohibidas o la embriaguez, promuevan estereotipos religiosos, políticos o de género, hagan comentarios negativos o irrespetuosos sobre las religiones o afecten negativamente a la reputación y al buen nombre de Avalanche Studios Group.
No debe publicar, cargar ni enlazar contenido o imágenes sexualmente explícitas, dañinas, amenazantes, abusivas, difamatorias, obscenas, que promuevan el odio o sean racial o étnicamente ofensivas.
No debe suplantar, acosar, revelar información ni perjudicar de ninguna manera a Avalanche Studios Group, sus empleados, representantes, etc.
No debe suplantar la identidad de otra persona, mentir sobre su afiliación hacia una entidad o persona, ocultar o intentar esconder su identidad ni cometer cualquier otro tipo de fraude.
No debe violar ni incitar a otros a violar los reglamentos o las leyes internacionales, nacionales, estatales o locales.
No debe comerciar, fomentar, publicitar ni solicitar productos o servicios en el Juego.
No debe modificar partes del Juego, sus clientes, servidores, etc.
No debe comprar, vender, intercambiar ni transferir el acceso al Juego, ni promover la intención de hacerlo.
No debe comprar, vender artículos a cambio de dinero o para intercambiar artículos en el Juego, ni anunciar su intención de hacerlo.
No debe usar el Juego para fines ilegales, organizar el intercambio ni transferir software ilegal o pirateado en el Juego.
No debe utilizar el Juego ni el Contenido creado por usuarios de una manera que no cumpla con las leyes aplicables, los términos y las condiciones recogidos en este documento y las directrices aplicables.
No debe utilizar el Contenido creado por usuarios en otros juegos, productos o servicios.
Seguirá las instrucciones del personal autorizado o relacionado con el Juego.
No debe organizar ni debe ser miembro de ningún grupo o acción dentro del Juego que se centre en o apoye filosofías que promuevan el odio, ya sean racistas, sexistas, antirreligiosas, antiétnicas, homófobas o de cualquier otra índole discriminatoria.
No debe proporcionar información falsa ni ocultar intencionadamente información al registrar su cuenta en el Juego.
No intentará interferir, piratear o descifrar ningún tipo de transmisión en los servidores o plataformas del Juego.
No abusará de ningún error del Juego y no comunicará la existencia de tales errores (que podrían conceder al usuario beneficios involuntarios), ya sea de manera directa o a través de un medio público a otro usuario del Juego. Los errores relacionados con el Juego deben ser remitidos lo antes posible a al equipo de soporte mediante los canales indicados en la sección 29.
No intentará jugar al Juego en servidores ni plataformas que no estén controlados o autorizados por Avalanche Studios Group, sus representantes o los proveedores del servicio o la plataforma.
No creará, usará ni proporcionará emuladores del servicio o de otros sitios donde se pueda jugar al Juego, y no publicará ni distribuirá utilidades, emuladores u otras herramientas de software relacionadas con el Juego sin el consentimiento expreso por escrito de Avalanche Studios Group.
No registrará cuentas de usuario a nombre de individuos distintos de Usted, ni registrará cuentas de usuario a nombre de grupos o entidades.
No usará las marcas comerciales ni los derechos de autor de Avalanche Studios Group o cualquier otra marca que se preste a confusión.

Avalanche Studios Group y los proveedores del servicio o la plataforma pueden borrar el Contenido de usuario final y las Obras o suspender su cuenta y su acceso al Juego por cualquier motivo, en cualquier momento, según nuestro criterio exclusivo y sin previo aviso, lo que incluye pero no se limita a que consideremos que Usted ha violado este Acuerdo o la Política de privacidad.

19. Communication and Feedback
Avalanche Studios Group may from time to time contact you by any appropriate information channel to keep you up to date with news about for example the Game, new products and services, updates, campaigns, promotions, faults, issues relating to technical aspects and/or the usability of the Game, payment methods etc. Avalanche Studios Group may occasionally ask you to provide information on your experiences of playing the Game etc. which will be used to improve the quality and provision of the Game etc. You are not required to provide any ideas, feedback or suggestions (collectively, “Feedback”) to Avalanche Studios Group. Any and all information which is submitted by you is submitted voluntarily. To the extent you do provide any Feedback to Avalanche Studios Group, you agree to assign and hereby do assign all right, title and interest in and to such Feedback to Avalanche Studios Group and acknowledge that Avalanche Studios Group may freely use, reproduce, modify, distribute, make, have made, sell, offer for sale, import and otherwise exploit in any manner such Feedback without payment of any royalties or other consideration to you. You can stop the delivery of promotional messages from Avalanche Studios Group by following the specific instructions in promotional messages or by our customer support. These communication choices do not apply to mandatory service communications that are considered part of the Game, which you may receive periodically.

20. Electronic communications
When you play the Game, or send emails to us, you are communicating with us electronically. You agree to receive communications from us electronically and communicate with us electronically. We will communicate with you by e-mail or by posting notices in the Game or by any other means Avalanche Studios Group finds suitable. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically (whether by email, posting notice in the Game or otherwise) satisfy any legal requirement that such communications be in writing.

21. User Disputes
You are solely responsible for your interactions with other users of the Game. We reserve the right, but have no obligation, to monitor disputes between you and other users.

22. Arbitration
If you are located within the United States of America, the following applies to you: Any claim (excluding claims for injunctive or other equitable relief) where the total amount of the award sought by either party is less than $10,000 shall be resolved via binding non-appearance-based arbitration initiated through the American Arbitration Association (“AAA”). The AAA Rules are available online at www.adr.org or by calling the AAA at 1-800-778-7879. In any such arbitration, the parties and AAA must comply with the following rules: (a) the arbitration shall be conducted by telephone, online and/or be solely based on written submissions, the specific manner shall be chosen by the party initiating the arbitration; (b) the arbitration shall not involve any personal appearance by the parties or witnesses unless otherwise mutually agreed by the parties; (c) the arbitrator may award injunctive or declaratory relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party’s individual claim; and (d) any judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction. Nothing in this Agreement shall prevent either party from seeking remedies in small claims court of competent jurisdiction.

22. Arbitraje

23. Class action waiver
YOU AGREE THAT ANY CLAIMS SUBJECT TO ARBITRATION UNDER SECTION 22 MUST BE MADE IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

23. Renuncia a demandas colectivas
USTED ACEPTA QUE TODAS LAS RECLAMACIONES SUJETAS A ARBITRAJE DE ACUERDO CON LA SECCIÓN 22 SE DEBERÁN REALIZAR A TÍTULO INDIVIDUAL, Y NO COMO REPRESENTANTE NI PARTICIPANTE DE UNA DEMANDA COLECTIVA.

24. Claims
YOU AND AVALANCHE STUDIOS GROUP AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THIS AGREEMENT MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.

24. Reclamaciones
AVALANCHE STUDIOS GROUP Y USTED ACEPTAN QUE CUALQUIER RECLAMACIÓN QUE PUDIERA SURGIR DEL PRESENTE CONTRATO O RELACIONADA CON ÉL DEBERÁ INICIARSE EN UN PLAZO DE UN (1) AÑO DESDE QUE APAREZCA EL MOTIVO PARA RECLAMAR. EN CASO CONTRARIO, LA CAUSA DE LA DEMANDA QUEDA PRESCRITA.

25. Governing law
(a) If you are located outside of the United States of America this Agreement shall be governed by and construed in accordance with the laws of Sweden, without giving effect to any principles of conflicts of law, and the parties hereby agree to the sole and exclusive jurisdiction of the courts of Sweden, with the district court of Stockholm (Stockholms Tingsrätt) as first venue, to resolve any disputes arising out of or relating to this Agreement.

25. Legislación aplicable

(b) If you are located within the United States of America, and unless otherwise required by a mandatory law of any jurisdiction, this Agreement shall be governed by and construed in accordance with the laws of the state of New York, without giving effect to any principles of conflicts of law. You agree that any action arising out of or relating to this Agreement that is not subject to mandatory arbitration as set forth above in section 22 shall be filed only in the state or federal courts in and for New York County, New York and you hereby agree and submit to the personal jurisdiction of such courts for the purposes of litigating any such action.

(c) Notwithstanding anything to the contrary, Avalanche Studios Group may apply to any court of competent jurisdiction for payments, injunctive or other equitable relief.

26. Severability
If for any reason any provision of this Agreement shall be held invalid or unenforceable in whole or in part in any applicable jurisdiction, such provision shall, as to such jurisdiction, be ineffective only to the extent of such invalidity or unenforceability without in any manner affecting the validity or enforceability thereof in any other jurisdiction or the remaining provisions hereof in any jurisdiction.

26. Separabilidad
Si por algún motivo alguna de las disposiciones de este Acuerdo resultaran nulas o imposibles de ejecutar en parte o en su totalidad por cualquier jurisdicción aplicable, tales disposiciones quedarán sin efecto para dicha jurisdicción, en la medida en que dicha invalidez o incapacidad de ejecución no afecte de ninguna manera la validez o la ejecución por parte de cualquier otra jurisdicción o a las estipulaciones restantes en cualquier otra jurisdicción.

27. Modification
Avalanche Studios Group reserves the right, at its discretion, to update or revise this Agreement at any time. Avalanche Studios Group will post such changes in the Game, its webpage and or forums etc. related to the Game and these additional or revised terms will become part of the Agreement. Please check the EULA document periodically for changes. Your continued playing of the Game constitutes your binding acceptance of the EULA, including any changes or modifications made by Avalanche Studios Group as permitted above.

27. Modificación
Avalanche Studios Group se reserva el derecho, según su criterio, de actualizar o revisar este Acuerdo en cualquier momento. Avalanche Studios Group publicará dichos cambios en el Juego, su página web, foros u otros medios relacionados con el Juego, y las condiciones adicionales o actualizadas pasarán a formar parte de este Acuerdo. Consulte de manera periódica el Acuerdo para consultar posibles cambios. El uso continuo del Juego constituye la aceptación vinculante del Acuerdo, incluidos aquellos cambios y modificaciones realizados por Avalanche Studios Group tal y como se ha permitido anteriormente.

28. Entire agreement
This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof, and supersedes all previous written or oral agreements between the parties with respect to such subject matter. Avalanche Studios Group may assign its rights under this Agreement without notice to you. You may not assign your rights under this Agreement.

Este Acuerdo constituye el acuerdo completo de las partes con respecto al asunto tratado y tiene prioridad sobre todos los acuerdos previos, ya fueran orales o escritos, entre las partes con respecto al asunto tratado.
