BEFORE ACCESSING AND PLAYING THE GAME, USING THE RELATED SERVICES OR ACCESSING ANY GAME RELATED WEBSITES, APPS ETC. (THE GAME, RELATED SERVICES, APPS, AVALANCHE APEX ACCOUNT AND THE WEBSITES HEREINAFTER THE “GAME”), PLEASE READ THIS AGREEMENT CAREFULLY. PLEASE NOTE THAT BY ACCESSING AND PLAYING THE GAME YOU AGREE TO ABIDE BY THIS END USER LICENSE AGREEMENT AND A LEGALLY BINDING AGREEMENT IS CREATED BETWEEN AVALANCHE STUDIOS GROUP AB (“AVALANCHE STUDIOS GROUP”) AND YOU WHETHER OR NOT YOU ARE A REGISTERED PLAYER OF THE GAME (“END USER”). IF YOU ARE AN END USER BASED IN THE UNITED STATES CERTAIN PROVISIONS OF THE AGREEMENT SPECIFICALLY APPLIES TO YOU, FOR EXAMPLE SECTIONS 23 AND 24, UNDER WHICH YOU AGREE TO ARBITRATE CERTAIN CLAIMS INSTEAD OF GOING TO COURT AND AGREE NOT TO BRING CLASS ACTIONS CLAIMS. IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS OF THIS AGREEMENT, PLEASE DO NOT ACCESS AND PLAY THE GAME. AVALANCHE STUDIOS GROUP RESERVES THE RIGHT TO TEMPORARILY OR PERMANENTLY DISABLE ACCESS TO THE GAME FOR ANYONE WHO VIOLATES THIS AGREEMENT. AVALANCHE STUDIOS GROUP MAY DISABLE ACCESS TO THE GAME AT ITS DISCRETION AND MAY DO SO WITHOUT NOTICE. ALL CONTENT IS OPERATED BY AVALANCHE STUDIOS GROUP AND ITS AFFILIATES.

SI VOUS ÊTES UN UTILISATEUR FINAL BASÉ AUX ÉTATS-UNIS, CERTAINES DISPOSITIONS DU PRÉSENT CONTRAT S'APPLIQUENT À VOUS, COMME PAR EXEMPLE LES SECTIONS 23 ET 24 INDIQUANT QUE VOUS ACCEPTEZ D'EFFECTUER UNE REQUÊTE EN ARBITRAGE AU LIEU DE SAISIR LA JUSTICE ET DE NE PAS DÉPOSER DE RECOURS COLLECTIF. SI VOUS N'ÊTES PAS D'ACCORD AVEC LES CONDITIONS DU PRÉSENT CONTRAT, MERCI DE NE PAS ACCÉDER NI JOUER AU JEU. AVALANCHE STUDIOS GROUP SE RÉSERVE LE DROIT DE RETIRER L'ACCÈS AU JEU, DE MANIÈRE TEMPORAIRE OU PERMANENTE, À QUICONQUE ENFREINT LE PRÉSENT CONTRAT. AVALANCHE STUDIOS GROUP EST SUSCEPTIBLE DE RETIRER L'ACCÈS AU JEU À SA SEULE DISCRÉTION ET SANS NOTIFICATION. LA TOTALITÉ DU CONTENU DU JEU EST GÉRÉE PAR AVALANCHE STUDIOS GROUP ET SES SOCIÉTÉS AFFILIÉES.

1. Acceptance
This document (“End User License Agreement”, “Agreement”, “EULA”) is a legal agreement between you (“You” or “the user”) and Avalanche Studios Group AB corp.reg.no 556675-1748, a Swedish corporation, with business offices at Västgötagatan 5, SE-11827 Stockholm, Sweden (“Avalanche Studios Group”) and governs your use of the Game, whether or not you are a registered End User of the Game.

1. Adhésion

To accept this EULA, create an account to play or access the Game, or otherwise access or play the game, you must be 13 years of age or older. If you are older than 13 years, but younger than 18 or otherwise not able to enter into Agreements by yourself, you must have your parents, parental guardian or legal guardian accept and confirm this Agreement on your behalf.

If you are younger than 13 years old, or if you are younger than 18 years old and do not have your parents’ or guardians’ consent to this Agreement, you may not access or play the Game. Parents and guardians are responsible for the acts of children under 18 years of age when using or accessing the Game. If, under applicable law, the minimum age for entering into contracts differ from the above, then the applicable law in your country of residence shall apply.

YOUR PLAYING OF THE GAME CONSTITUTES YOUR ACCEPTANCE OF THE AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS OF THIS AGREEMENT, PLEASE DO NOT ACCESS AND PLAY THE GAME.

2. Access to the Game
To access and play the Game you must create an account with a platform/service provider, unless the Game is expressly provided in a form or venue where an account is not required such as a physical copy inserted into a console or PC, or an arcade or game console. You may not, under any circumstances, whether intentionally, or through negligence or inaction, allow or enable others or to access your account. Avalanche Studios Group reserves the right to disable or block accounts without notice. You are not permitted to transfer your account, any in game currency, characters etc. to another person or entity, unless specifically permitted in writing by Avalanche Studios Group. Please refer to the Privacy Policy for further information regarding age limitations while accessing the Game.

2. Accès au Jeu

To access the Game, you may be required to create an Avalanche Apex Connect Account with Avalanche Studios Group. For information regarding data collection in connection with the Avalanche Apex Connect Account please see the applicable Privacy Policy.

3. Third Party Accounts
If enabled by Avalanche Studios Group in its sole discretion, you may establish an account with account data provided to Avalanche Studios Group by a third party such as a gaming platform, social networking service etc. in which case you may have a separate, additional account relationship with such third party.

You acknowledge and agree that you will (a) provide true, accurate, current, and complete information as requested when registering an account and (b) maintain and update this registration information to keep it true, accurate, current, and complete. You are solely responsible for maintaining the confidentiality of your account and password and for restricting access to any computer, console, smart phone, tablet etc. that you use for accessing the Game and you hereby accept sole responsibility for all activities that occur under your account or password. Avalanche Studios Group, its affiliates and service providers reserve the right to restrict or terminate access to the Game, refuse service, terminate accounts, remove or edit content, or cancel orders in its sole discretion for any reason whatsoever, including, without limitation, if you provide registration information which is false, inaccurate, not current, or incomplete. For information regarding how Avalanche Studios Group handles personal data you transmit through the Game please visit the Privacy Policy. Please note that your access to and playing of the Game constitutes your acceptance of the Privacy Policy.

4. Inscription

5. Products and services
Avalanche Studios Group reserves the right to add, modify, or delete/cancel the Game, including your access to the Game at any time. Avalanche Studios Group makes no representation or warranty as to the completeness or accuracy of the Game nor does it represent or warrant that the Game will be available at all times or at any time. The Game may be incomplete, may contain errors etc. Avalanche Studios Group makes no commitment and expressly disclaims any duty to fix any errors or lack of functionality in the Game. The Game is provided on an “as is” basis without any express warranties.

5. Produits et services
Avalanche Studios Group se réserve le droit d'enrichir, modifier ou supprimer/annuler le Jeu, y compris votre accès au Jeu, à tout moment. 6. Payment
You agree to fully pay for the Game and any and all products and services ordered in the Game. You are responsible for providing Avalanche Studios Group and/or the platform/service providers with valid credit card information to secure payment. Avalanche Studios Group and/or the platform/service providers reserves the right to cancel any order if the credit card information you provide is not valid. Payment may be processed in cooperation with third party payment service providers, like PayPal etc. Avalanche Studios Group or the platform/service providers confirm all subscriptions, purchases and may send initial login or activation information by email once Avalanche Studios Group or the platform/service provider have had the opportunity to confirm your purchase.

6. Paiement

7. Payment terms
In order to access and play the Game, access certain additional content, premium services etc. you may be required to pay certain fees (the Game and any applicable premium services and access to additional content are provided to paying users only). You can find the current fees and payment terms at the platform/service provider’s Game access pages, the game webpage etc. Avalanche Studios Group may also offer other products and services in the Game etc., either for free, for one-time fees or for recurring fees. Avalanche Studios Group and/or the platform/service provider may amend the fees and payment terms at any time. If any fees are subject to any type of applicable taxes, Avalanche Studios Group or the platform/service provider may charge you for any such taxes, in addition to any fees.

7. Conditions relatives au paiement

ALL FEES ARE PAYABLE IN ADVANCE AND ARE NOT REFUNDABLE IN WHOLE OR IN PART, UNLESS STATED OTHERWISE IN THIS AGREEMENT OR IN THE PLATFORM/SERVICE PROVIDER’S TERMS AND CONDITIONS.

However, a remaining portion of the payment may be credited in Avalanche Studios Group’s and/or the platform/service provider sole discretion should you decide to upgrade your services. When you purchase the Game and any product or service in the Game or in relation to the Game you authorize Avalanche Studios Group or the platform/service provider to automatically charge your credit card the fees in accordance with the payment terms. You are responsible for paying all applicable taxes (including those Avalanche Studios Group or the platform/service provider are not required to collect) and for all hardware, software, Internet, and related equipment (where applicable; platform specific VR headsets/screen etc.) and other costs you incur to access and play the Game. Avalanche Studios Group and/or the platform/service providers reserves the right to change the fees and availability of the Game at any time without notice; provided, however, such price change will not affect your purchase price for orders that Avalanche Studios Group or the platform/service provider has already actually received from you and processed, unless expressly stated otherwise in your payment terms. You are responsible for reviewing the Game for changes in the fees or payment terms.

8. Access
In consideration of the payment of any applicable fees and subject to your registering for an account and compliance with the terms contained herein, Avalanche Studios Group or the platform/service provider will, upon receipt of your payment if applicable, provide you with a limited, non-exclusive, revocable license to access the Game and enable you to access and play the Game subject to the other applicable provisions, limitations and restrictions in this Agreement. You may not upload or republish the Game or Game Content on any Internet, Intranet or Extranet sites or incorporate the information in any other database or compilation, and any other use of the Game or Game Content is strictly prohibited. Notwithstanding the foregoing, you may stream and record your playing of the Game on channels like Twitch etc. provided that such use is done in good taste and does not infringe the intellectual property rights of Avalanche Studios Group. If Avalanche Studios Group or the platform/service provider are unable to process your payment at any time, your access to certain services, content etc. may be suspended or terminated at Avalanche Studios Group’s or the platform/service provider’s discretion. Avalanche Studios Group may suspend or revoke your license if you violate, or assist others in violating the Terms and Service agreement that applies to the Game.

8. Accès
En contrepartie du paiement de tous frais applicables, et à condition que vous créiez un compte et vous conformiez aux conditions du présent Contrat, Avalanche Studios Group ou le fournisseur de plateforme/service vous fournira, à la réception de votre paiement lorsque ce sera applicable, une licence limitée, non exclusive et révocable pour accéder au Jeu et vous permettra d'accéder et de jouer au Jeu, dans le cadre des autres dispositions, limitations et restrictions applicables du présent Contrat. Vous ne téléchargerez ni ne republierez le Jeu ou du contenu du Jeu sur quelque site Internet, Intranet ou Extranet que ce soit, ni n'incorporerez ces informations dans une base de données ou compilation, et tout autre usage du Jeu ou du contenu du Jeu est strictement interdit. Nonobstant ce qui précède, vous pouvez diffuser et enregistrer vos parties sur des chaînes telles que Twitch, etc., à condition que cette utilisation n'implique rien de déplacé et ne porte pas atteinte aux droits de propriété intellectuelle d'Avalanche Studios Group. Si Avalanche Studios Group ou le fournisseur de plateforme/service n'est pas en mesure de traiter votre paiement à tout moment, votre accès à certains services, contenus etc. peut être suspendu ou clôturé à la discrétion d'Avalanche Studios Group ou du fournisseur de plateforme/service. Avalanche Studios Group se réserve le droit de suspendre ou révoquer votre licence si vous enfreignez, ou aidez d'autres personnes à enfreindre les conditions d'utilisation applicables au Jeu.

9. Delivery of products and services
Avalanche Studios Group provides the Game on an “as is” basis. Avalanche Studios Group or the platform/service provider shall endeavor to deliver the Game that you have ordered to you within a reasonable amount of time. However, technical problems may delay or prevent delivery and except as set forth in the next sentence, Avalanche Studios Group or the platform/service provider shall have no liability to you with respect to delays or delivery problems. Your sole remedy with respect to the Game, a purchased product or service that is not delivered within a reasonable amount of time after ordering is to either receive a replacement of the Game, product or service, or a refund of the purchase price paid for the Game, product or service, as determined by Avalanche Studios Group or the platform/service provider in their sole discretion.

9. Livraison des produits et services

10. Links to other Games

11. Indemnification
Your access to and playing of the Game constitutes your agreement to defend, indemnify, and hold harmless Avalanche Studios Group, its parents and affiliates, licensors and partners, the platform/service providers and their respective members, employees, contractors, officers, and directors, from and against any actions, claims, demands, liability and expenses, including reasonable attorneys’ fees, arising out of your use or misuse of the Game including related services by a third party with the use of your account.

11. Indemnisation

12. Termination
This Agreement is effective until amended by Avalanche Studios Group in its sole discretion. Avalanche Studios Group may change, suspend, or discontinue all or any aspect of the Game at any time for any reason without prior notice or liability, including, without limitation, the availability of the Game or any feature, without prior notice or liability. Avalanche Studios Group may cease to provide the Game or any or all of the products and services offered in connection with the Games, terminate this Agreement, and cancel all of the rights granted to you under this Agreement at any time for any reason without prior notice or liability. Avalanche Studios Group may, but is not obligated to, communicate such termination to you in any of the following manners: (i) in a notice in the Game; (ii) via electronic mail; (iii) in the EULA, or (iv) in another manner that Avalanche Studios Group deems suitable to inform you of the termination. If Avalanche Studios Group terminates the Game, you will not receive a refund of paid fees. In the event of any termination hereunder sections 1, 3, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 24, 25, 26, 27, 28 and 29 of this Agreement will survive termination.

12. Résiliation

Avalanche Studios Group peut cesser de fournir le Jeu, certains ou tous les produits et services offerts en lien avec les jeux, résilier le présent Contrat et annuler tous les droits qui vous sont accordés par le présent Contrat, à tout moment, pour quelque raison que ce soit, sans préavis et sans engager sa responsabilité. THE GAME IS PROVIDED BY AVALANCHE STUDIOS GROUP ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, AVALANCHE STUDIOS GROUP DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

D'AVALANCHE STUDIOS GROUP. VOUS ACCEPTEZ PAR LA PRÉSENTE QUE CE PARAGRAPHE S'APPLIQUE À TOUT CONTENU, TOUS PRODUITS ET SERVICES DISPONIBLES DANS LE JEU OU EN LIEN AVEC LE JEU. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AVALANCHE STUDIOS GROUP BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, INTERRUPTION, LOSS OF INFORMATION, OR ANY OTHER PECUNIARY LOSS (HOWEVER ARISING, INCLUDING, WITHOUT LIMITATION, NEGLIGENCE) ARISING OUT OF THE POSSESSION OF, USE OF OR INABILITY TO USE THE GAME, OR PRODUCTS AND SERVICES YOU HAVE PURCHASED OR USE IN OR IN CONNECTION WITH THE GAME, OR DEFECT IN OR CAUSED BY THE GAME, OR PRODUCTS AND SERVICES YOU HAVE PURCHASED OR USE IN OR IN CONNECTION WITH THE GAME, INCLUDING BUT NOT LIMITED TO COMPROMISING THE SECURITY OF YOUR COMPUTER, OPERATING SYSTEM OR FILES, OR THE PROVISION OF OR FAILURE TO PROVIDE SUPPORT, EVEN IF YOU HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AVALANCHE STUDIOS GROUP’S ENTIRE LIABILITY UNDER ANY PROVISION OF THIS AGREEMENT SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID BY YOU FOR THE GAME, PRODUCTS AND SERVICES DURING THE TWELVE MONTHS PRECEDING THE CLAIM.

DANS LES LIMITES AUTORISÉES PAR LA LOI EN VIGUEUR, AVALANCHE STUDIOS GROUP NE POURRA EN AUCUN CAS ÊTRE TENU RESPONSABLE DE TOUT DÉGÂT SPÉCIAL, ACCIDENTEL, INDIRECT OU CONSÉQUENT QUEL QU'IL SOIT, Y COMPRIS, SANS S'Y LIMITER, LES DÉGÂTS LIÉS À LA PERTE DE PROFITS, L'INTERRUPTION, LA PERTE D'INFORMATIONS OU TOUTE AUTRE PERTE PÉCUNIAIRE (DÉCOULANT, Y COMPRIS, SANS S'Y LIMITER, DE NÉGLIGENCE) DÉCOULANT DE LA POSSESSION, DE L'UTILISATION OU DE L'IMPOSSIBILITÉ D'UTILISER LE JEU, D'UN DÉFAUT DU JEU OU OCCASIONNÉ PAR LE JEU, OU LES PRODUITS ET SERVICES QUE VOUS AVEZ ACHETÉS OU UTILISEZ DANS LE JEU OU EN LIEN AVEC LE JEU, Y COMPRIS, SANS S'Y LIMITER, LA COMPROMISSION DE LA SÉCURITÉ DE VOTRE ORDINATEUR, VOTRE SYSTÈME D'EXPLOITATION OU VOS FICHIERS, OU LA PRESTATION OU UN DÉFAUT DE PRESTATION D'ASSISTANCE, MÊME SI VOUS AVEZ ÉTÉ PRÉVENU DE LA POSSIBILITÉ DESDITS DÉGÂTS. DANS LES LIMITES AUTORISÉES PAR LA LOI EN VIGUEUR, EN APPLICATION D'UNE DISPOSITION DU PRÉSENT CONTRAT, LA RESPONSABILITÉ D'AVALANCHE STUDIOS GROUP EST LIMITÉE AU MONTANT EFFECTIVEMENT PAYÉ PAR VOUS POUR LE JEU, LES PRODUITS ET SERVICES AU COURS DES DOUZE MOIS PRÉCÉDANT LA REQUÊTE.

15. Seizure warning, motion sickness etc.
In rare instances, some users may experience seizures when exposed to certain light patterns or flashing lights. Exposure to certain light patterns or backgrounds on a video monitor or virtual reality headset may induce an epileptic seizure, motion sickness even in persons who have no history of prior seizures or epilepsy. Avalanche Studios Group takes no responsibility for such effects and end results and you are accessing and playing the Game on your own risk. Nor does Avalanche Studios Group take any responsibility for motion sickness, any balance problem that may occur from the playing of the Game etc.

15. Avertissement concernant l'épilepsie, la cinétose...

16. Trademarks and Game marks
The names, logos, characters, brands and product and service names appearing in the Game and related services are trademarks/service marks or registered trademarks/service marks of Avalanche Studios Group or third parties (the respective holders). The use of any such trademark or service mark without express written consent of the respective holder is strictly prohibited.

17. Intellectual Property Rights

You acknowledge and agree that all content, design elements, and materials available in the Game, for example graphics, logos, designs, characters, objects, environments, worlds, icons, scripts and service names (“Avalanche Studios Group Content”) are owned by Avalanche Studios Group and/or its partners and licensors and protected by copyrights, trademarks, patents, trade secrets, and/or other proprietary rights of Avalanche Studios Group and/or its partners and licensors. Avalanche Studios Group and its partners and licensors retain all right, title and interest in and to the Avalanche Studios Group Content. You may not use, copy, reproduce, modify, republish, upload, post, transmit or distribute any Avalanche Studios Group Content in any form or for any means, unless expressly permitted in this Agreement. Avalanche Studios Group’s trademarks and trade dress may not be used, including as part of trademarks and/or as part of domain names, in connection with any product or service in any manner that is likely to cause confusion and may not be copied, imitated, or used, in whole or in part, without the prior written permission of Avalanche Studios Group. In addition, you may not sell, license, rent, perform, display, create derivative works from, or in any way use or exploit Avalanche Studios Group Content in any way unless expressly permitted in this Agreement. You agree not to disassemble, decompile or reverse engineer any software or other component of the Game or Avalanche Studios Group Content. Unless explicitly stated herein, nothing in this Agreement shall be construed as conferring to you any license to intellectual property rights, whether by estoppel, implication or otherwise. You agree not to assert against Avalanche Studios Group and affiliates any claim, action or proceeding for infringement of any patents, patent rights or other intellectual property rights.

End User License to play the Game
By registering an account and paying the applicable fees you obtain a personal, single, revocable license to play the Game in accordance with section 8. All references in this Agreement to the “purchase” of the Game shall mean the obtaining of a license to play the Game, and all references to “sale” or “selling” of the Game shall mean the granting of a license to play the Game.

End User Intellectual Property
In the Game you may create certain content (“Submissions”). Except for the Avalanche Studios Group Content contained therein, any intellectual property right and title to such Submissions shall remain and where applicable shall become your intellectual property, created and submitted by you for use in the Game. That portion of a Submission that is not Avalanche Studios Group Content is sometimes referred to herein as “End User Content”. By publishing any Submission containing End User Content in the Game you represent and warrant that you have all rights necessary to grant the licenses contained herein. Furthermore, you represent and warrant that there is no suit, action or claim or other legal or administrative proceeding now pending or threatened which might directly or indirectly affect any of your End User Content, or any part thereof, or which might in any way impair the rights granted by you hereunder.

Avalanche Studios Group License to End User Intellectual Property
You agree that Avalanche Studios Group shall be given the irrevocable, sub-licensable, perpetual, worldwide, royalty free, fully paid up, right and license to utilize, perform, reproduce, incorporate into the Game and sequels, modify, edit, publicly perform, publicly display, distribute and make derivative works from your End User Content as contained in the Submissions in the Game and sequels, on its Websites and in any and all media now known or hereafter devised for marketing and promotional purposes and to feature your End User Content and Submissions, and any derivative works created therefrom, in its products and services. For example, Avalanche Studios Group may use your End User Content and Submissions in marketing and promotional materials for the Game, on social media platforms, in merchandising materials etc.

18. Prohibited use
You agree to abide by all applicable laws and regulations when playing the Game. Your continued access to the Game and right to play the Game is subject to proper conduct. Without limiting Avalanche Studios Group’s rights to control the Game’s environment, and the conduct of the End Users within that environment, Avalanche Studios Group prohibits the following practices that Avalanche Studios Group has determined detract from the overall user experience and you are strictly prohibited from:

18. Utilisation non autorisée
Vous consentez au respect de toutes les lois et réglementations applicables lorsque vous jouez au Jeu. Votre accès au Jeu et votre droit de jouer au Jeu sont sujets à votre bonne conduite. Taking any action that imposes an unreasonable or disproportionately large load on the System of the Game;
Use of your own or third-party software to modify any content appearing within the Game, its environment or change how the Game is played or services used;
Use of your own or third-party software, the Game or any information accessible through the System, to bypass or modify any System login architecture or create or provide any other means through which any System may be accessed and/or the Game may be used by others in ways other than those intended by Avalanche Studios Group;
Disrespecting the rights of others and their rights to play and enjoy the Game. You may not defraud, harass, threaten, or cause distress and/or unwanted attention to other players;
When naming any object, character, team, guild or clan etc. you may not use sexually explicit, harmful, threatening, abusive, defamatory, obscene, hateful, racially or ethnically offensive language;
You may not post or communicate any player's real world information (name, address, account name, etc.) in the Game, on the Websites or in any other forum or media, or make public anyone’s identification documents or sensitive financial information or posting such information in the Game or other permitted websites;
You may not harvest or collect email addresses or other contact information of other users from the Game by electronic or other means, for example for the purposes of sending unsolicited emails or other unsolicited communications;
You may not solicit personal information from anyone under 18 or solicit passwords or personally identifying information for commercial or unlawful purposes;
You may not use sexually explicit, harmful, threatening, abusive, defamatory, obscene, hateful, racially or ethnically offensive language or images;
You may not post material that includes graphic depictions of gratuitous or excessive violence, includes profane or obscene language or gestures, advocates intoxication or substance abuse, promotes gender, political or religious stereotypes, makes negative or disrespectful comments etc. about religions or reflects adversely on the name, reputation or goodwill of Avalanche Studios Group;
You may not post, upload or link to any sexually explicit, harmful, threatening, abusive, defamatory, obscene, hateful, racially or ethnically offensive imagery or content;
You may not impersonate, harass, dox or otherwise cause distress to Avalanche Studios Group, its employees, representatives etc.;
You may not impersonate another person, misrepresenting your affiliation with an entity or person, hiding or attempting to hide your identity or otherwise conducting fraud;
You may not violate, or encourage others to violate, any local, state, national, or international laws or regulations;
You may not market, promote, advertise, or solicit products or services in the Game;
You may not modify any part of the Game, or Clients, Servers etc.;
You may not advertise the intent to or commit the act of buying, selling, trading, sharing, or transferring access to the Game;
You may not advertise the intent to or commit the act of buying or selling items for cash or trading items in the Game;
You may not use the Game for any illegal purpose, arrange for the exchange or transfer of any pirated or illegal software in the Game;
You may not use the Game and/or User Created Content in a manner not compliant with applicable laws, terms and conditions contained herein and any applicable guidelines;
You may not use User Created Content in other games, products or services;
You will follow the instructions of authorized personnel in or related to the Game;
You may not organize nor be a member of any pledges or groups within the Game that are based on or espouse any racist, sexist, anti-religious, anti-ethnic, anti-gay, or other hate mongering philosophies;
You may not provide false information or intentionally hide any information when registering for your account in the Game;
You will not attempt to interfere with, hack into, or decipher any transmissions to or from the servers or platforms running the Game;
You will not exploit any bug in the Game and you will not communicate the existence of any such exploitable bug (bugs that grant the user unnatural or unintended benefits) either directly or through public posting, to any other user of the Game. Bugs related to the Game should promptly be reported to the support team in the channels identified in section 29.
You will not attempt to play the Game on any server or platform that is not controlled or authorized by Avalanche Studios Group, its designees or platform/service providers;
You will not create, use, or provide any server emulator or other site where the Game may be played, and you will not post or distribute any utilities, emulators or other software tools related to the Game without the express written permission of Avalanche Studios Group;
You will not register for a User account on behalf of an individual other than yourself, or register for a User account on behalf of any group or entity;
Using Avalanche Studios Group’s copyrights or trademarks or any confusingly similar marks;
Uploading invalid data, viruses, worms, or other software agents to the Game;
Collecting information from other End Users without obtaining their consent; or
Otherwise use the Game in any manner that breaches the terms and conditions of this Agreement or the Privacy Policy.
Avalanche Studios Group and the platform/service providers can delete End User Content and Submissions or close down your account and stop your access to the Game for any reason, at any time, in our sole discretion, without notice, including, but not limited to if we believe that you violate this Agreement or the Privacy Policy.

Ne pas respecter le droit de jouer et de profiter du Jeu d'autrui. Vous ne devez pas escroquer, harceler, menacer, ou causer le désarroi et/ou l'attention non sollicitée envers les autres joueurs ;
Lorsque vous nommerez un objet, un personnage, une équipe, une guilde, un clan, etc. vous ne devez pas utiliser de termes sexuellement explicites, nocifs, menaçants, insultants, diffamatoires, obscènes, haineux, ou racistes ;
Vous ne devez pas publier ou communiquer d'information du monde réel de tout utilisateur (nom, adresse, nom de compte, etc.) dans le Jeu, sur les sites Web ou sur tout autre forum ou média, ni rendre public tout document d'identification ou toute information financière sensible, ni publier ces informations dans le Jeu ou sur d'autres sites Web autorisés ;
Vous ne devez pas collecter ou vous procurer d'adresses e-mail ou toute autre information de contact d'autres utilisateurs dans le Jeu, par des moyens électroniques ou autres, par exemple dans le but d'envoyer des e-mails non sollicités ou d'autres communications non sollicitées ;
Vous ne devez pas demander d'informations personnelles à toute personne mineure, ni de mots de passe ou d'informations d'identification personnelle à des fins commerciales ou illégales ;
Vous ne devez pas utiliser de termes ou des images sexuellement explicites, nocifs, menaçants, insultants, diffamatoires, obscènes, haineux, ou racistes ;
Vous ne devez pas publier d'éléments incluant des représentations graphiques de violence gratuite ou excessive, des paroles ou gestes obscènes ou blasphématoires, promouvant l'intoxication ou l'abus de drogues, promouvant des stéréotypes sexistes, politiques ou religieux, tenant des propos négatifs ou irrespectueux, etc. envers les religions, ou pouvant porter atteinte au nom, à la réputation ou au fonds commercial d'Avalanche Studios Group ;
Vous ne devez pas diffuser, télécharger ou envoyer des liens vers des images ou contenus sexuellement explicites, nocifs, menaçants, insultants, diffamatoires, obscènes, haineux, ou racistes ;
Vous ne devez pas tenter de vous faire passer pour, harceler, révéler des informations sur ou causer du désarroi de quelque manière que ce soit à Avalanche Studios Group, ses employés, représentants... ;
Vous ne devez pas tenter de vous faire passer pour quelqu'un d'autre, présenter de manière erronée vos rapports avec une entité ou une personne, masquer ou tenter de masquer votre identité, ou vous livrer à quelque fraude que ce soit ;
Vous ne devez pas enfreindre ni encourager quiconque à enfreindre des lois ou réglementations locales, nationales ou internationales ;
Vous ne devez pas faire la promotion ou la publicité, ou solliciter de produits ou services dans le Jeu ;
Vous ne devez pas modifier de partie du Jeu, des clients, serveurs, etc. ;
Vous ne devez pas exprimer l'intention, ni commettre l'acte d'acheter, vendre, échanger, partager ou transférer l'accès au Jeu ;
Vous ne devez pas exprimer l'intention, ni commettre l'acte d'acheter ou de vendre des objets en échange d'argent ou d'échanger des objets dans le Jeu ;
Vous ne devez pas utiliser le Jeu à des fins illégales quelles qu'elles soient, vous livrer à l'échange ou au transfert de logiciels piratés ou illégaux dans le Jeu ;
Vous ne devez pas utiliser le Jeu et/ou le contenu créé par la communauté à l'encontre des lois en vigueur, ainsi que des conditions d'utilisation présentement mentionnées ou de toute autre politique en vigueur ;
Vous ne pouvez pas utiliser le contenu créé par la communauté dans d'autres jeux, produits ou services ;
Vous suivrez les instructions du personnel autorisé dans ou en lien avec le Jeu ;
Vous ne devez pas organiser ou être membre de tout groupe dans le Jeu qui serait basé ou qui adopterait des philosophies racistes, sexistes, anti-religieuses, ethnophobes ou homophobes ou incitant à la haine ;
Vous ne devez pas fournir d'informations erronées ni cacher intentionnellement des informations lorsque vous créez votre compte dans le Jeu ;
Vous ne tenterez pas d'interférer avec, de pirater ou de déchiffrer toute transmission à destination ou en provenance des serveurs ou plateformes du Jeu ;
Vous ne profiterez pas d'un bug quel qu'il soit dans le Jeu et vous ne révélerez pas l'existence d'un tel bug exploitable (bugs conférant à l'utilisateur des bénéfices anormaux ou non prévus), que ce soit de manière directe ou via une publication publique, aux autres utilisateurs du Jeu. Les bugs concernant le Jeu devraient nous être immédiatement signalés à l'équipe d'assistance aux adresses renseignées dans la section 29.
Vous ne tenterez pas de jouer au Jeu à partir d'un serveur ou d'une plateforme qui n'est pas contrôlé(e) ou autorisé(e) par Avalanche Studios Group, ses délégués ou fournisseurs de plateforme/service ;
Vous ne créerez pas, n'utiliserez pas et ne mettrez pas à disposition d'émulateur de serveur ou tout autre site où le Jeu pourrait être joué, et vous ne publierez ni ne distribuerez de services, émulateurs ou autres outils liés au Jeu sans le consentement formel et écrit d'Avalanche Studios Group ;
Vous ne créerez pas de compte utilisateur pour le compte de quelqu'un d'autre ni pour le compte d'un groupe ou d'une entité ;
Vous ne devez pas utiliser de droits d'auteur ou de marques commerciales d'Avalanche Studios Groups, ou quelque marque similaire présentant un risque de confusion que ce soit ;
Vous ne devez pas télécharger de données invalides, virus, vers, ou tout autre agent logiciel dans le Jeu ;
Vous ne devez pas collecter d'informations provenant d'autres utilisateurs finaux sans leur consentement ; ni
Utiliser le Jeu de quelque manière que ce soit enfreignant les clauses et conditions du présent Contrat ou de la Charte de confidentialité.
Avalanche Studios Group et les fournisseurs de plateforme/service peuvent à tout moment, et pour quelque raison que ce soit, supprimer du Contenu et des Soumissions d'utilisateur final ou fermer votre compte et mettre un terme à votre accès au Jeu à leur seule discrétion, sans préavis, y compris, sans s'y limiter, si nous estimons que vous enfreignez le présent Contrat ou la Charte de confidentialité.

19. Communication and Feedback
Avalanche Studios Group may from time to time contact you by any appropriate information channel to keep you up to date with news about for example the Game, new products and services, updates, campaigns, promotions, faults, issues relating to technical aspects and/or the usability of the Game, payment methods etc. Avalanche Studios Group may occasionally ask you to provide information on your experiences of playing the Game etc. which will be used to improve the quality and provision of the Game etc. You are not required to provide any ideas, feedback or suggestions (collectively, “Feedback”) to Avalanche Studios Group. Any and all information which is submitted by you is submitted voluntarily. To the extent you do provide any Feedback to Avalanche Studios Group, you agree to assign and hereby do assign all right, title and interest in and to such Feedback to Avalanche Studios Group and acknowledge that Avalanche Studios Group may freely use, reproduce, modify, distribute, make, have made, sell, offer for sale, import and otherwise exploit in any manner such Feedback without payment of any royalties or other consideration to you. You can stop the delivery of promotional messages from Avalanche Studios Group by following the specific instructions in promotional messages or by our customer support. These communication choices do not apply to mandatory service communications that are considered part of the Game, which you may receive periodically.

19. Communications et retours

20. Electronic communications
When you play the Game, or send emails to us, you are communicating with us electronically. You agree to receive communications from us electronically and communicate with us electronically. We will communicate with you by e-mail or by posting notices in the Game or by any other means Avalanche Studios Group finds suitable. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically (whether by email, posting notice in the Game or otherwise) satisfy any legal requirement that such communications be in writing.

21. User Disputes
You are solely responsible for your interactions with other users of the Game. We reserve the right, but have no obligation, to monitor disputes between you and other users.

22. Arbitration
If you are located within the United States of America, the following applies to you: Any claim (excluding claims for injunctive or other equitable relief) where the total amount of the award sought by either party is less than $10,000 shall be resolved via binding non-appearance-based arbitration initiated through the American Arbitration Association (“AAA”). The AAA Rules are available online at www.adr.org or by calling the AAA at 1-800-778-7879. In any such arbitration, the parties and AAA must comply with the following rules: (a) the arbitration shall be conducted by telephone, online and/or be solely based on written submissions, the specific manner shall be chosen by the party initiating the arbitration; (b) the arbitration shall not involve any personal appearance by the parties or witnesses unless otherwise mutually agreed by the parties; (c) the arbitrator may award injunctive or declaratory relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party’s individual claim; and (d) any judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction. Nothing in this Agreement shall prevent either party from seeking remedies in small claims court of competent jurisdiction.

22. Arbitrage
Si vous résidez aux États-Unis d'Amérique, ce qui suit s'applique : Toute réclamation (à l'exception des réclamations demandant des mesures injonctives et autres compensations équitables) dont le verdict demandé par l'une ou l'autre partie s'élève à plus de 10 000 $ sera résolue par une procédure d'arbitrage contraignant, sans comparution, entreprise auprès de l'American Arbitration Association (« A.A.A »). Lors d'un tel arbitrage, les parties et l'A.A.A. doivent respecter les règles suivantes : (a) l'arbitrage sera effectué par téléphone, en ligne ou à partir de déclarations écrites, les modalités exactes étant choisies par la partie demandant l'arbitrage ; (b) l'arbitrage n'impliquera aucune comparution des parties et des témoins, à moins que les parties y aient mutuellement consenti ; (c) l'arbitre peut ordonner des mesures injonctives ou une sentence déclaratoire uniquement en faveur de la partie qui demande compensation et uniquement dans la mesure nécessaire pour accorder la compensation demandée par la réclamation individuelle de cette partie ; (d) toute sentence prononcée par l'arbitre peut être présentée devant tout tribunal compétent. Rien dans le présent Contrat ne peut empêcher une des parties d'exercer des recours auprès des cours des petites créances compétentes.

23. Class action waiver
YOU AGREE THAT ANY CLAIMS SUBJECT TO ARBITRATION UNDER SECTION 22 MUST BE MADE IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

23. Renonciation de recours collectif
VOUS ACCEPTEZ QUE TOUTE RÉCLAMATION SUJETTE À ARBITRAGE SELON LA SECTION 22 DOIVE ÊTRE EFFECTUÉE À TITRE PERSONNEL ET NON EN TANT QUE DEMANDEUR OU UTILISATEUR À UN RECOURS COLLECTIF OU UNE ACTION DE GROUPE.

24. Claims
YOU AND AVALANCHE STUDIOS GROUP AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THIS AGREEMENT MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.

24. Réclamations
VOUS ET AVALANCHE STUDIOS GROUP ACCEPTEZ QUE TOUT MOTIF DE POURSUITE AYANT POUR ORIGINE OU LIÉ AU PRÉSENT CONTRAT DOIVE ÊTRE INVOQUÉ DANS UN DÉLAI D'UN (1) AN APRÈS LA CONSTATATION DE LA CAUSE D'ACTION. AUTREMENT, UNE TELLE CAUSE D'ACTION EST FORCLOSE DE MANIÈRE PERMANENTE.

25. Governing law
(a) If you are located outside of the United States of America this Agreement shall be governed by and construed in accordance with the laws of Sweden, without giving effect to any principles of conflicts of law, and the parties hereby agree to the sole and exclusive jurisdiction of the courts of Sweden, with the district court of Stockholm (Stockholms Tingsrätt) as first venue, to resolve any disputes arising out of or relating to this Agreement.

25. Loi applicable

(b) If you are located within the United States of America, and unless otherwise required by a mandatory law of any jurisdiction, this Agreement shall be governed by and construed in accordance with the laws of the state of New York, without giving effect to any principles of conflicts of law. You agree that any action arising out of or relating to this Agreement that is not subject to mandatory arbitration as set forth above in section 22 shall be filed only in the state or federal courts in and for New York County, New York and you hereby agree and submit to the personal jurisdiction of such courts for the purposes of litigating any such action.

(b) Si vous résidez aux États-Unis d'Amérique, et sauf disposition contraire de droit impératif d'aucune juridiction, le présent accord est régi et interprété conformément aux lois de l'état de New York, sans égard à aucun principe de conflit de droit. (c) Notwithstanding anything to the contrary, Avalanche Studios Group may apply to any court of competent jurisdiction for payments, injunctive or other equitable relief.

26. Severability
If for any reason any provision of this Agreement shall be held invalid or unenforceable in whole or in part in any applicable jurisdiction, such provision shall, as to such jurisdiction, be ineffective only to the extent of such invalidity or unenforceability without in any manner affecting the validity or enforceability thereof in any other jurisdiction or the remaining provisions hereof in any jurisdiction.

26. Divisibilité
Si, pour quelque raison que ce soit, l'une des dispositions du présent Contrat devait être jugée invalide ou non-exécutable, en totalité ou en partie, par un tribunal d'une juridiction compétente, alors la disposition en question ne sera pas applicable uniquement dans la limite de cette invalidité et l'inapplicabilité, sans affecter pour autant la validité ou l'exécutabilité de cette disposition dans toute autre juridiction ou le reste des dispositions du présent Contrat dans toute juridiction.

27. Modification
Avalanche Studios Group reserves the right, at its discretion, to update or revise this Agreement at any time. Avalanche Studios Group will post such changes in the Game, its webpage and or forums etc. related to the Game and these additional or revised terms will become part of the Agreement. Please check the EULA document periodically for changes. Your continued playing of the Game constitutes your binding acceptance of the EULA, including any changes or modifications made by Avalanche Studios Group as permitted above.

27. Modification
Avalanche Studios Group se réserve le droit à sa discrétion de mettre à jour ou de réviser le présent Contrat à tout moment. Avalanche Studios Group publiera ces modifications dans le Jeu, sur sa page Web et/ou sur des forums, etc. liés au Jeu et ces clauses supplémentaires ou modifiées feront partie intégrante du présent Contrat. Veuillez vérifier régulièrement si le CLUF a fait l'objet de modifications. L'utilisation du Jeu constitue une acceptation de fait du CLUF, y compris des changements ou modifications effectuées par Avalanche Studios Group dans le cadre de ce qui est autorisé ci-avant.

28. Entire agreement
This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof, and supersedes all previous written or oral agreements between the parties with respect to such subject matter. Avalanche Studios Group may assign its rights under this Agreement without notice to you. You may not assign your rights under this Agreement.

28. Intégralité du contrat
Le présent Contrat constitue la totalité de l'accord entre les parties à l'égard de l'objet des présentes et remplace tout accord écrit ou oral préalable entre les partis à l'égard de cet objet. Avalanche Studios Group peut céder ses droits découlant du présent Contrat sans préavis. Vous ne pouvez pas céder vos droits en vertu du présent Contrat.

29. Disclosure
