BEFORE ACCESSING AND PLAYING THE GAME, USING THE RELATED SERVICES OR ACCESSING ANY GAME RELATED WEBSITES, APPS ETC. (THE GAME, RELATED SERVICES, APPS, AVALANCHE APEX ACCOUNT AND THE WEBSITES HEREINAFTER THE “GAME”), PLEASE READ THIS AGREEMENT CAREFULLY. PLEASE NOTE THAT BY ACCESSING AND PLAYING THE GAME YOU AGREE TO ABIDE BY THIS END USER LICENSE AGREEMENT AND A LEGALLY BINDING AGREEMENT IS CREATED BETWEEN AVALANCHE STUDIOS GROUP AB (“AVALANCHE STUDIOS GROUP”) AND YOU WHETHER OR NOT YOU ARE A REGISTERED PLAYER OF THE GAME (“END USER”). IF YOU ARE AN END USER BASED IN THE UNITED STATES CERTAIN PROVISIONS OF THE AGREEMENT SPECIFICALLY APPLIES TO YOU, FOR EXAMPLE SECTIONS 23 AND 24, UNDER WHICH YOU AGREE TO ARBITRATE CERTAIN CLAIMS INSTEAD OF GOING TO COURT AND AGREE NOT TO BRING CLASS ACTIONS CLAIMS. IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS OF THIS AGREEMENT, PLEASE DO NOT ACCESS AND PLAY THE GAME. AVALANCHE STUDIOS GROUP RESERVES THE RIGHT TO TEMPORARILY OR PERMANENTLY DISABLE ACCESS TO THE GAME FOR ANYONE WHO VIOLATES THIS AGREEMENT. AVALANCHE STUDIOS GROUP MAY DISABLE ACCESS TO THE GAME AT ITS DISCRETION AND MAY DO SO WITHOUT NOTICE. ALL CONTENT IS OPERATED BY AVALANCHE STUDIOS GROUP AND ITS AFFILIATES.

OBSERVE QUE AO ACESSAR E JOGAR O JOGO, VOCÊ CONCORDA EM CUMPRIR ESTE CONTRATO DE LICENÇA DO USUÁRIO FINAL, E UM CONTRATO JURIDICAMENTE VINCULANTE É CRIADO ENTRE O AVALANCHE STUDIOS GROUP AB (“AVALANCHE STUDIOS GROUP”) E VOCÊ, QUER SEJA UM JOGADOR REGISTRADO DO JOGO OU NÃO ("USUÁRIO FINAL"). SE VOCÊ FOR UM USUÁRIO FINAL LOCALIZADO NOS ESTADOS UNIDOS, CERTAS CLÁUSULAS DO CONTRATO SE APLICARÃO ESPECIFICAMENTE NO SEU CASO COMO, POR EXEMPLO, AS SEÇÕES 23 E 24, POR MEIO DAS QUAIS VOCÊ CONCORDA COM A ARBITRAGEM DE CERTAS REIVINDICAÇÕES, EM VEZ DE RECORRER AOS TRIBUNAIS, E CONCORDA EM NÃO FAZER REIVINDICAÇÕES DE AÇÃO COLETIVA. SE VOCÊ NÃO CONCORDA COM OS TERMOS E CONDIÇÕES DESTE CONTRATO, POR FAVOR, NÃO ACESSE NEM JOGUE O JOGO. O AVALANCHE STUDIOS GROUP SE RESERVA O DIREITO DE TEMPORÁRIA OU PERMANENTEMENTE REMOVER O ACESSO AO JOGO DE QUALQUER INDIVÍDUO QUE VIOLAR ESTE CONTRATO. O AVALANCHE STUDIOS GROUP PODE REMOVER O ACESSO AO JOGO A SEU CRITÉRIO E SEM AVISO. TODO O CONTEÚDO É OPERADO PELO AVALANCHE STUDIOS GROUP E SUAS AFILIADAS.

1. Acceptance
This document (“End User License Agreement”, “Agreement”, “EULA”) is a legal agreement between you (“You” or “the user”) and Avalanche Studios Group AB corp.reg.no 556675-1748, a Swedish corporation, with business offices at Västgötagatan 5, SE-11827 Stockholm, Sweden (“Avalanche Studios Group”) and governs your use of the Game, whether or not you are a registered End User of the Game.

To accept this EULA, create an account to play or access the Game, or otherwise access or play the game, you must be 13 years of age or older. If you are older than 13 years, but younger than 18 or otherwise not able to enter into Agreements by yourself, you must have your parents, parental guardian or legal guardian accept and confirm this Agreement on your behalf.

Para aceitar este EULA, criar uma conta para jogar ou acessar o Jogo, ou de outra forma acessar ou jogar o jogo, você deve ter mais 13 anos de idade. Se você tiver mais de 13 anos, mas menos de 18 anos, ou de outra forma não puder aceitar os termos do Contrato por si mesmo, seus pais, responsáveis legais ou tutores legais devem aceitar e confirmar os termos do Contrato em seu nome.

If you are younger than 13 years old, or if you are younger than 18 years old and do not have your parents’ or guardians’ consent to this Agreement, you may not access or play the Game. Parents and guardians are responsible for the acts of children under 18 years of age when using or accessing the Game. If, under applicable law, the minimum age for entering into contracts differ from the above, then the applicable law in your country of residence shall apply.

Se você tiver menos de 13 anos, ou se for menor de 18 anos e não tiver o consentimento de seus pais ou responsáveis legais para este Contrato, você não poderá acessar ou jogar o Jogo. Os pais e os responsáveis legais são responsáveis pelos atos de crianças menores de 18 anos de idade ao usarem ou acessarem o Jogo. PLEASE NOTE THAT BY ACCESSING AND PLAYING THE GAME YOU AGREE TO ABIDE BY AND BE BOUND BY THIS AGREEMENT. AVALANCHE STUDIOS GROUP OWNS OR CONTROLS ALL INTELLECTUAL PROPERTY RIGHTS IN AND TO THE GAME AND PERMITS YOU TO PLAY THE GAME ONLY IN ACCORDANCE WITH THESE TERMS. YOUR PLAYING OF THE GAME CONSTITUTES YOUR ACCEPTANCE OF THE AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS OF THIS AGREEMENT, PLEASE DO NOT ACCESS AND PLAY THE GAME.

OBSERVE QUE AO ACESSAR E JOGAR O JOGO, VOCÊ CONCORDA EM CUMPRIR E FICAR VINCULADO A ESTE CONTRATO. O AVALANCHE STUDIOS GROUP DETÉM OU CONTROLA TODOS OS DIREITOS DE PROPRIEDADE INTELECTUAL EM RELAÇÃO AO JOGO, E PERMITE QUE VOCÊ O JOGUE SOMENTE DE ACORDO COM ESTES TERMOS. JOGAR O JOGO SIGNIFICA QUE VOCÊ ACEITOU O CONTRATO. SE VOCÊ NÃO CONCORDA COM OS TERMOS E CONDIÇÕES DESTE CONTRATO, POR FAVOR, NÃO ACESSE NEM JOGUE O JOGO.

2. Access to the Game
To access and play the Game you must create an account with a platform/service provider, unless the Game is expressly provided in a form or venue where an account is not required such as a physical copy inserted into a console or PC, or an arcade or game console. You may not, under any circumstances, whether intentionally, or through negligence or inaction, allow or enable others or to access your account. Avalanche Studios Group reserves the right to disable or block accounts without notice. You are not permitted to transfer your account, any in game currency, characters etc. to another person or entity, unless specifically permitted in writing by Avalanche Studios Group. Please refer to the Privacy Policy for further information regarding age limitations while accessing the Game.

2. Acesso ao Jogo

To access the Game, you may be required to create an Avalanche Apex Connect Account with Avalanche Studios Group. For information regarding data collection in connection with the Avalanche Apex Connect Account please see the applicable Privacy Policy.

3. Third Party Accounts
If enabled by Avalanche Studios Group in its sole discretion, you may establish an account with account data provided to Avalanche Studios Group by a third party such as a gaming platform, social networking service etc. in which case you may have a separate, additional account relationship with such third party.

You acknowledge and agree that you will (a) provide true, accurate, current, and complete information as requested when registering an account and (b) maintain and update this registration information to keep it true, accurate, current, and complete. You are solely responsible for maintaining the confidentiality of your account and password and for restricting access to any computer, console, smart phone, tablet etc. that you use for accessing the Game and you hereby accept sole responsibility for all activities that occur under your account or password. Avalanche Studios Group, its affiliates and service providers reserve the right to restrict or terminate access to the Game, refuse service, terminate accounts, remove or edit content, or cancel orders in its sole discretion for any reason whatsoever, including, without limitation, if you provide registration information which is false, inaccurate, not current, or incomplete. For information regarding how Avalanche Studios Group handles personal data you transmit through the Game please visit the Privacy Policy. Please note that your access to and playing of the Game constitutes your acceptance of the Privacy Policy.

4. Registro

Por meio deste documento, você aceita total responsabilidade por todas as atividades que ocorrerem na sua conta ou com a sua senha. O Avalanche Studios Group, suas afiliadas e seus provedores de serviços se reservam o direito de restringir ou encerrar o acesso ao Jogo, recusar serviço, encerrar contas, remover ou editar conteúdo ou cancelar pedidos, ao seu critério exclusivo, por qualquer razão, incluindo, mas não limitado a você fornecer informações de registro que sejam falsas, imprecisas, desatualizadas ou incompletas. 5. Products and services
Avalanche Studios Group reserves the right to add, modify, or delete/cancel the Game, including your access to the Game at any time. Avalanche Studios Group makes no representation or warranty as to the completeness or accuracy of the Game nor does it represent or warrant that the Game will be available at all times or at any time. The Game may be incomplete, may contain errors etc. Avalanche Studios Group makes no commitment and expressly disclaims any duty to fix any errors or lack of functionality in the Game. The Game is provided on an “as is” basis without any express warranties.

5. Produtos e serviços
O Avalanche Studios Group se reserva o direito de adicionar, modificar ou excluir/cancelar o Jogo, incluindo seu acesso a ele a qualquer momento. 6. Payment
You agree to fully pay for the Game and any and all products and services ordered in the Game. You are responsible for providing Avalanche Studios Group and/or the platform/service providers with valid credit card information to secure payment. Avalanche Studios Group and/or the platform/service providers reserves the right to cancel any order if the credit card information you provide is not valid. Payment may be processed in cooperation with third party payment service providers, like PayPal etc. Avalanche Studios Group or the platform/service providers confirm all subscriptions, purchases and may send initial login or activation information by email once Avalanche Studios Group or the platform/service provider have had the opportunity to confirm your purchase.

6. Pagamento
Você concorda em pagar integralmente pelo Jogo e por todos os produtos e serviços comprados no Jogo. Você é responsável por fornecer ao Avalanche Studios Group e/ou aos provedores de plataforma/serviços informações de cartão de crédito válidas para garantir o pagamento. 7. Payment terms
In order to access and play the Game, access certain additional content, premium services etc. you may be required to pay certain fees (the Game and any applicable premium services and access to additional content are provided to paying users only). You can find the current fees and payment terms at the platform/service provider’s Game access pages, the game webpage etc. Avalanche Studios Group may also offer other products and services in the Game etc., either for free, for one-time fees or for recurring fees. Avalanche Studios Group and/or the platform/service provider may amend the fees and payment terms at any time. If any fees are subject to any type of applicable taxes, Avalanche Studios Group or the platform/service provider may charge you for any such taxes, in addition to any fees.

7. Termos de pagamento

ALL FEES ARE PAYABLE IN ADVANCE AND ARE NOT REFUNDABLE IN WHOLE OR IN PART, UNLESS STATED OTHERWISE IN THIS AGREEMENT OR IN THE PLATFORM/SERVICE PROVIDER’S TERMS AND CONDITIONS.

TODAS AS TARIFAS DEVEM SER PAGAS COM ANTECEDÊNCIA E NÃO SÃO TOTAL NEM PARCIALMENTE REEMBOLSÁVEIS, A NÃO SER QUE DECLARADO O CONTRÁRIO NESTE CONTRATO OU NOS TERMOS E CONDIÇÕES DO PROVEDOR DE PLATAFORMA/SERVIÇOS.

However, a remaining portion of the payment may be credited in Avalanche Studios Group’s and/or the platform/service provider sole discretion should you decide to upgrade your services. When you purchase the Game and any product or service in the Game or in relation to the Game you authorize Avalanche Studios Group or the platform/service provider to automatically charge your credit card the fees in accordance with the payment terms. You are responsible for paying all applicable taxes (including those Avalanche Studios Group or the platform/service provider are not required to collect) and for all hardware, software, Internet, and related equipment (where applicable; platform specific VR headsets/screen etc.) and other costs you incur to access and play the Game. Avalanche Studios Group and/or the platform/service providers reserves the right to change the fees and availability of the Game at any time without notice; provided, however, such price change will not affect your purchase price for orders that Avalanche Studios Group or the platform/service provider has already actually received from you and processed, unless expressly stated otherwise in your payment terms. You are responsible for reviewing the Game for changes in the fees or payment terms.

O Avalanche Studios Group e/ou os provedores de plataforma/serviços se reservam o direito de mudar as tarifas e a disponibilidade do Jogo a qualquer momento, sem aviso, desde que, porém, tal mudança não afete o preço de compra de pedidos que o Avalanche Studios Group ou o provedor de plataforma/serviços já tenha recebido de você e processado, a não ser que expressamente indicado o contrário nos seus termos de pagamento. Você é responsável por rever o Jogo em busca de mudanças nas tarifas ou nos termos de pagamento.

8. Access
In consideration of the payment of any applicable fees and subject to your registering for an account and compliance with the terms contained herein, Avalanche Studios Group or the platform/service provider will, upon receipt of your payment if applicable, provide you with a limited, non-exclusive, revocable license to access the Game and enable you to access and play the Game subject to the other applicable provisions, limitations and restrictions in this Agreement. You may not upload or republish the Game or Game Content on any Internet, Intranet or Extranet sites or incorporate the information in any other database or compilation, and any other use of the Game or Game Content is strictly prohibited. Notwithstanding the foregoing, you may stream and record your playing of the Game on channels like Twitch etc. provided that such use is done in good taste and does not infringe the intellectual property rights of Avalanche Studios Group. If Avalanche Studios Group or the platform/service provider are unable to process your payment at any time, your access to certain services, content etc. may be suspended or terminated at Avalanche Studios Group’s or the platform/service provider’s discretion. Avalanche Studios Group may suspend or revoke your license if you violate, or assist others in violating the Terms and Service agreement that applies to the Game.

8. Acesso
Em consideração ao pagamento de quaisquer tarifas aplicáveis e sujeito ao seu registro de uma conta e ao cumprimento dos termos contidos aqui, o Avalanche Studios Group ou o provedor de plataforma/serviços fornecerá a você, mediante recebimento do seu pagamento, se aplicável, uma licença limitada, não exclusiva e revogável de acesso ao Jogo, e permitirá que você acesse e jogue o Jogo sujeito a outras cláusulas, limitações e restrições aplicáveis presentes neste Contrato. Você não pode fazer upload ou republicar o Jogo ou o Conteúdo do Jogo em quaisquer sites de Internet, Intranet ou Extranet ou incorporar as informações em qualquer outro banco de dados ou compilação, e qualquer outro uso do Jogo ou do Conteúdo do Jogo é estritamente proibido. Apesar do supracitado, você poderá transmitir por stream e gravar suas partidas jogando o Jogo em canais como a Twitch etc., desde que tal uso seja feito com bom gosto e não viole os direitos de propriedade intelectual do Avalanche Studios Group. Se o Avalanche Studios Group ou o provedor de plataforma/serviços não conseguir processar seu pagamento a qualquer momento, seu acesso a certos serviços, conteúdos etc. poderá ser suspenso ou encerrado a critério do Avalanche Studios Group ou do provedor de plataforma/serviços. O Avalanche Studios Group pode suspender ou revogar sua licença se você violar ou ajudar outros indivíduos a violarem os Termos e Serviços que se aplicam ao Jogo.

9. Delivery of products and services
Avalanche Studios Group provides the Game on an “as is” basis. Avalanche Studios Group or the platform/service provider shall endeavor to deliver the Game that you have ordered to you within a reasonable amount of time. However, technical problems may delay or prevent delivery and except as set forth in the next sentence, Avalanche Studios Group or the platform/service provider shall have no liability to you with respect to delays or delivery problems. Your sole remedy with respect to the Game, a purchased product or service that is not delivered within a reasonable amount of time after ordering is to either receive a replacement of the Game, product or service, or a refund of the purchase price paid for the Game, product or service, as determined by Avalanche Studios Group or the platform/service provider in their sole discretion.

9. Entrega de produtos e serviços
O Avalanche Studios Group fornece o Jogo "no estado em que ele se encontra". O Avalanche Studios Group ou o provedor de plataforma/serviços se empenhará em lhe entregar o Jogo que você adquiriu em um tempo razoável. 11. Indemnification
Your access to and playing of the Game constitutes your agreement to defend, indemnify, and hold harmless Avalanche Studios Group, its parents and affiliates, licensors and partners, the platform/service providers and their respective members, employees, contractors, officers, and directors, from and against any actions, claims, demands, liability and expenses, including reasonable attorneys’ fees, arising out of your use or misuse of the Game including related services by a third party with the use of your account.

11. Indenização

12. Termination
This Agreement is effective until amended by Avalanche Studios Group in its sole discretion. Avalanche Studios Group may change, suspend, or discontinue all or any aspect of the Game at any time for any reason without prior notice or liability, including, without limitation, the availability of the Game or any feature, without prior notice or liability. Avalanche Studios Group may cease to provide the Game or any or all of the products and services offered in connection with the Games, terminate this Agreement, and cancel all of the rights granted to you under this Agreement at any time for any reason without prior notice or liability. Avalanche Studios Group may, but is not obligated to, communicate such termination to you in any of the following manners: (i) in a notice in the Game; (ii) via electronic mail; (iii) in the EULA, or (iv) in another manner that Avalanche Studios Group deems suitable to inform you of the termination. If Avalanche Studios Group terminates the Game, you will not receive a refund of paid fees. In the event of any termination hereunder sections 1, 3, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 24, 25, 26, 27, 28 and 29 of this Agreement will survive termination.

12. Rescisão
Este Contrato permanecerá em vigor até ser retificado a exclusivo critério do Avalanche Studios Group. THE GAME IS PROVIDED BY AVALANCHE STUDIOS GROUP ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, AVALANCHE STUDIOS GROUP DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

YOU HEREBY ACKNOWLEDGE THAT THIS PARAGRAPH SHALL APPLY TO ALL CONTENT, PRODUCTS AND SERVICES AVAILABLE IN OR IN RELATION TO THE GAME. AVALANCHE STUDIOS GROUP TAKES NO RESPONSIBILITY FOR THE ACCURACY, SAFE DELIVERIES, AND FUNCTIONALITY OF SMS/TEXTING SERVICES ETC. A OPERAÇÃO E AS FUNÇÕES DO JOGO PODEM SER AFETADAS POR VÁRIOS FATORES, QUE ESTÃO FORA DO CONTROLE DO AVALANCHE STUDIOS GROUP E, ATÉ A EXTENSÃO MÁXIMA PERMITIDA PELA LEI APLICÁVEL, EM NENHUMA CIRCUNSTÂNCIA, O AVALANCHE STUDIOS GROUP, SUAS MATRIZES, AFILIADAS E SEUS LICENCIADOS, PARCEIROS E/OU PROVEDORES DE PLATAFORMA/SERVIÇOS (COLETIVAMENTE, "AVALANCHE STUDIOS GROUP" PARA OS OBJETIVOS DESTA SEÇÃO 13 E DA SEÇÃO 14 A SEGUIR) SERÃO RESPONSÁVEIS POR DANOS QUE RESULTEM DO USO OU INCAPACIDADE DE USAR OU JOGAR O JOGO, INCLUINDO, MAS NÃO LIMITADO A VOCÊ TER CONFIADO EM QUALQUER INFORMAÇÃO OBTIDA DO JOGO OU DO AVALANCHE STUDIOS GROUP DE OUTRA FORMA, OU QUE RESULTEM DE ERROS, OMISSÕES, INTERRUPÇÕES, EXCLUSÃO DE ARQUIVOS OU E-MAILS, BLOGS, BATE-PAPOS, DEFEITOS, VÍRUS, ATRASOS DE OPERAÇÃO OU TRANSMISSÃO OU QUALQUER FALHA DE DESEMPENHO, QUER TENHAM RESULTADO OU NÃO DE CASOS FORTUITOS, FALHAS DE COMUNICAÇÃO, ROUBO, DESTRUIÇÃO OU ACESSO NÃO AUTORIZADO AOS REGISTROS, PROGRAMAS, JOGOS ETC. DOAVALANCHE STUDIOS GROUP. POR MEIO DESTE DOCUMENTO, VOCÊ RECONHECE QUE ESTE PARÁGRAFO SE APLICARÁ A TODO O CONTEÚDO, PRODUTOS E SERVIÇOS DISPONÍVEIS NO JOGO OU EM RELAÇÃO A ELE. O AVALANCHE STUDIOS GROUP NÃO SE RESPONSABILIZA PELA PRECISÃO, ENTREGA SEGURA E FUNCIONALIDADE DE SERVIÇOS DE SMS/TEXTO ETC. ATÉ A EXTENSÃO MÁXIMA PERMITIDA PELA LEI APLICÁVEL, EM NENHUMA CIRCUNSTÂNCIA O AVALANCHE STUDIOS GROUP SERÁ RESPONSÁVEL POR DANOS INDIRETOS, INCIDENTAIS, ESPECIAIS OU CONSEQUENTES DECORRENTES DO USO DO JOGO OU DA COMPRA DE QUALQUER PRODUTO OU SERVIÇO DENTRO DELE, MESMO QUE VOCÊ TENHA SIDO AVISADO SOBRE A POSSIBILIDADE DE TAIS DANOS. SHOULD THE GAME, OR PRODUCTS AND SERVICES YOU HAVE PURCHASED OR USE IN OR IN CONNECTION WITH THE GAME PROVE DEFECTIVE, YOU ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION IF NEEDED.

SE O JOGO OU OS PRODUTOS E SERVIÇOS QUE VOCÊ COMPROU OU USA NO JOGO OU EM CONEXÃO COM ELE SE MOSTRAREM DEFEITUOSOS, VOCÊ ASSUMIRÁ O CUSTO DE TODOS OS SERVIÇOS, REPAROS OU CORREÇÕES NECESSÁRIAS, CASO SEJAM NECESSÁRIAS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AVALANCHE STUDIOS GROUP BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, INTERRUPTION, LOSS OF INFORMATION, OR ANY OTHER PECUNIARY LOSS (HOWEVER ARISING, INCLUDING, WITHOUT LIMITATION, NEGLIGENCE) ARISING OUT OF THE POSSESSION OF, USE OF OR INABILITY TO USE THE GAME, OR PRODUCTS AND SERVICES YOU HAVE PURCHASED OR USE IN OR IN CONNECTION WITH THE GAME, OR DEFECT IN OR CAUSED BY THE GAME, OR PRODUCTS AND SERVICES YOU HAVE PURCHASED OR USE IN OR IN CONNECTION WITH THE GAME, INCLUDING BUT NOT LIMITED TO COMPROMISING THE SECURITY OF YOUR COMPUTER, OPERATING SYSTEM OR FILES, OR THE PROVISION OF OR FAILURE TO PROVIDE SUPPORT, EVEN IF YOU HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AVALANCHE STUDIOS GROUP’S ENTIRE LIABILITY UNDER ANY PROVISION OF THIS AGREEMENT SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID BY YOU FOR THE GAME, PRODUCTS AND SERVICES DURING THE TWELVE MONTHS PRECEDING THE CLAIM.

ATÉ A EXTENSÃO MÁXIMA PERMITIDA PELA LEI APLICÁVEL, EM NENHUM CASO, O AVALANCHE STUDIOS GROUP SERÁ RESPONSÁVEL POR DANOS ESPECIAIS, INCIDENTAIS, INDIRETOS OU CONSEQUENTES, INCLUINDO, MAS NÃO LIMITADO AOS DANOS POR PERDA DE LUCROS, INTERRUPÇÃO, PERDA DE INFORMAÇÕES OU QUALQUER OUTRO PREJUÍZO PECUNIÁRIO (SEJA COMO SURGIREM, INCLUINDO, MAS NÃO LIMITADO À NEGLIGÊNCIA) DECORRENTES DA POSSE, USO OU INCAPACIDADE DE USAR O JOGO OU OS PRODUTOS E SERVIÇOS QUE VOCÊ COMPROU OU USA NO JOGO OU EM CONEXÃO COM ELE, OU DE DEFEITO NO JOGO OU CAUSADO POR ELE OU POR PRODUTOS E SERVIÇOS QUE VOCÊ COMPROU OU USA NO JOGO OU EM CONEXÃO COM ELE, INCLUINDO, MAS NÃO LIMITADO A COMPROMETER A SEGURANÇA DO SEU COMPUTADOR, SISTEMA OPERACIONAL OU ARQUIVOS, OU A PRESTAÇÃO DE SUPORTE OU FALHA EM PRESTAR SUPORTE, MESMO QUE VOCÊ TENHA SIDO AVISADO SOBRE A POSSIBILIDADE DE TAIS DANOS. ATÉ A EXTENSÃO MÁXIMA PERMITIDA PELA LEI APLICÁVEL, TODA A RESPONSABILIDADE DO AVALANCHE STUDIOS GROUP SOB QUALQUER CLÁUSULA DESTE CONTRATO SERÁ LIMITADA AO VALOR PAGO POR VOCÊ PELO JOGO, PRODUTOS E SERVIÇOS DURANTE OS DOZES MESES ANTERIORES À REIVINDICAÇÃO.

15. Seizure warning, motion sickness etc.
In rare instances, some users may experience seizures when exposed to certain light patterns or flashing lights. Exposure to certain light patterns or backgrounds on a video monitor or virtual reality headset may induce an epileptic seizure, motion sickness even in persons who have no history of prior seizures or epilepsy. Avalanche Studios Group takes no responsibility for such effects and end results and you are accessing and playing the Game on your own risk. Nor does Avalanche Studios Group take any responsibility for motion sickness, any balance problem that may occur from the playing of the Game etc.

16. Trademarks and Game marks
The names, logos, characters, brands and product and service names appearing in the Game and related services are trademarks/service marks or registered trademarks/service marks of Avalanche Studios Group or third parties (the respective holders). The use of any such trademark or service mark without express written consent of the respective holder is strictly prohibited.

17. Intellectual Property Rights

You acknowledge and agree that all content, design elements, and materials available in the Game, for example graphics, logos, designs, characters, objects, environments, worlds, icons, scripts and service names (“Avalanche Studios Group Content”) are owned by Avalanche Studios Group and/or its partners and licensors and protected by copyrights, trademarks, patents, trade secrets, and/or other proprietary rights of Avalanche Studios Group and/or its partners and licensors. Avalanche Studios Group and its partners and licensors retain all right, title and interest in and to the Avalanche Studios Group Content. You may not use, copy, reproduce, modify, republish, upload, post, transmit or distribute any Avalanche Studios Group Content in any form or for any means, unless expressly permitted in this Agreement. Avalanche Studios Group’s trademarks and trade dress may not be used, including as part of trademarks and/or as part of domain names, in connection with any product or service in any manner that is likely to cause confusion and may not be copied, imitated, or used, in whole or in part, without the prior written permission of Avalanche Studios Group. In addition, you may not sell, license, rent, perform, display, create derivative works from, or in any way use or exploit Avalanche Studios Group Content in any way unless expressly permitted in this Agreement. You agree not to disassemble, decompile or reverse engineer any software or other component of the Game or Avalanche Studios Group Content. Unless explicitly stated herein, nothing in this Agreement shall be construed as conferring to you any license to intellectual property rights, whether by estoppel, implication or otherwise. You agree not to assert against Avalanche Studios Group and affiliates any claim, action or proceeding for infringement of any patents, patent rights or other intellectual property rights.

End User License to play the Game
By registering an account and paying the applicable fees you obtain a personal, single, revocable license to play the Game in accordance with section 8. All references in this Agreement to the “purchase” of the Game shall mean the obtaining of a license to play the Game, and all references to “sale” or “selling” of the Game shall mean the granting of a license to play the Game.

End User Intellectual Property
In the Game you may create certain content (“Submissions”). Except for the Avalanche Studios Group Content contained therein, any intellectual property right and title to such Submissions shall remain and where applicable shall become your intellectual property, created and submitted by you for use in the Game. That portion of a Submission that is not Avalanche Studios Group Content is sometimes referred to herein as “End User Content”. By publishing any Submission containing End User Content in the Game you represent and warrant that you have all rights necessary to grant the licenses contained herein. Furthermore, you represent and warrant that there is no suit, action or claim or other legal or administrative proceeding now pending or threatened which might directly or indirectly affect any of your End User Content, or any part thereof, or which might in any way impair the rights granted by you hereunder.

Avalanche Studios Group License to End User Intellectual Property
You agree that Avalanche Studios Group shall be given the irrevocable, sub-licensable, perpetual, worldwide, royalty free, fully paid up, right and license to utilize, perform, reproduce, incorporate into the Game and sequels, modify, edit, publicly perform, publicly display, distribute and make derivative works from your End User Content as contained in the Submissions in the Game and sequels, on its Websites and in any and all media now known or hereafter devised for marketing and promotional purposes and to feature your End User Content and Submissions, and any derivative works created therefrom, in its products and services. For example, Avalanche Studios Group may use your End User Content and Submissions in marketing and promotional materials for the Game, on social media platforms, in merchandising materials etc.

18. Prohibited use
You agree to abide by all applicable laws and regulations when playing the Game. Your continued access to the Game and right to play the Game is subject to proper conduct. Without limiting Avalanche Studios Group’s rights to control the Game’s environment, and the conduct of the End Users within that environment, Avalanche Studios Group prohibits the following practices that Avalanche Studios Group has determined detract from the overall user experience and you are strictly prohibited from:

Taking any action that imposes an unreasonable or disproportionately large load on the System of the Game;
Use of your own or third-party software to modify any content appearing within the Game, its environment or change how the Game is played or services used;
Use of your own or third-party software, the Game or any information accessible through the System, to bypass or modify any System login architecture or create or provide any other means through which any System may be accessed and/or the Game may be used by others in ways other than those intended by Avalanche Studios Group;
Disrespecting the rights of others and their rights to play and enjoy the Game. You may not defraud, harass, threaten, or cause distress and/or unwanted attention to other players;
When naming any object, character, team, guild or clan etc. you may not use sexually explicit, harmful, threatening, abusive, defamatory, obscene, hateful, racially or ethnically offensive language;
You may not post or communicate any player's real world information (name, address, account name, etc.) in the Game, on the Websites or in any other forum or media, or make public anyone’s identification documents or sensitive financial information or posting such information in the Game or other permitted websites;
You may not harvest or collect email addresses or other contact information of other users from the Game by electronic or other means, for example for the purposes of sending unsolicited emails or other unsolicited communications;
You may not solicit personal information from anyone under 18 or solicit passwords or personally identifying information for commercial or unlawful purposes;
You may not use sexually explicit, harmful, threatening, abusive, defamatory, obscene, hateful, racially or ethnically offensive language or images;
You may not post material that includes graphic depictions of gratuitous or excessive violence, includes profane or obscene language or gestures, advocates intoxication or substance abuse, promotes gender, political or religious stereotypes, makes negative or disrespectful comments etc. about religions or reflects adversely on the name, reputation or goodwill of Avalanche Studios Group;
You may not post, upload or link to any sexually explicit, harmful, threatening, abusive, defamatory, obscene, hateful, racially or ethnically offensive imagery or content;
You may not impersonate, harass, dox or otherwise cause distress to Avalanche Studios Group, its employees, representatives etc.;
You may not impersonate another person, misrepresenting your affiliation with an entity or person, hiding or attempting to hide your identity or otherwise conducting fraud;
You may not violate, or encourage others to violate, any local, state, national, or international laws or regulations;
You may not market, promote, advertise, or solicit products or services in the Game;
You may not modify any part of the Game, or Clients, Servers etc.;
You may not advertise the intent to or commit the act of buying, selling, trading, sharing, or transferring access to the Game;
You may not advertise the intent to or commit the act of buying or selling items for cash or trading items in the Game;
You may not use the Game for any illegal purpose, arrange for the exchange or transfer of any pirated or illegal software in the Game;
You may not use the Game and/or User Created Content in a manner not compliant with applicable laws, terms and conditions contained herein and any applicable guidelines;
You may not use User Created Content in other games, products or services;
You will follow the instructions of authorized personnel in or related to the Game;
You may not organize nor be a member of any pledges or groups within the Game that are based on or espouse any racist, sexist, anti-religious, anti-ethnic, anti-gay, or other hate mongering philosophies;
You may not provide false information or intentionally hide any information when registering for your account in the Game;
You will not attempt to interfere with, hack into, or decipher any transmissions to or from the servers or platforms running the Game;
You will not exploit any bug in the Game and you will not communicate the existence of any such exploitable bug (bugs that grant the user unnatural or unintended benefits) either directly or through public posting, to any other user of the Game. Bugs related to the Game should promptly be reported to the support team in the channels identified in section 29.
You will not attempt to play the Game on any server or platform that is not controlled or authorized by Avalanche Studios Group, its designees or platform/service providers;
You will not create, use, or provide any server emulator or other site where the Game may be played, and you will not post or distribute any utilities, emulators or other software tools related to the Game without the express written permission of Avalanche Studios Group;
You will not register for a User account on behalf of an individual other than yourself, or register for a User account on behalf of any group or entity;
Using Avalanche Studios Group’s copyrights or trademarks or any confusingly similar marks;
Uploading invalid data, viruses, worms, or other software agents to the Game;
Collecting information from other End Users without obtaining their consent; or
Otherwise use the Game in any manner that breaches the terms and conditions of this Agreement or the Privacy Policy.
Avalanche Studios Group and the platform/service providers can delete End User Content and Submissions or close down your account and stop your access to the Game for any reason, at any time, in our sole discretion, without notice, including, but not limited to if we believe that you violate this Agreement or the Privacy Policy.

Desrespeitar os direitos de outros indivíduos e os direitos deles de jogar e usufruir do Jogo. Você não pode defraudar, assediar, ameaçar ou causar aflição e/ou atrair atenção indesejada para outros jogadores;
Ao dar nome a qualquer objeto, personagem, equipe, guilda ou clã etc., usar linguagem sexualmente explícita, prejudicial, ameaçadora, abusiva, difamatória, obscena, odiosa e racial ou etnicamente ofensiva;
Postar ou comunicar informações do mundo real (nome, endereço, nome da conta etc.) de qualquer jogador no Jogo, nos sites ou em qualquer outro fórum ou mídia, ou publicar os documentos de identificação ou informações financeiras sigilosas de qualquer pessoa, ou postar tais informações no Jogo ou em outros sites permitidos;
Coletar endereços de e-mail ou outras informações de contato de outros usuários do Jogo, por meios eletrônicos ou não para, por exemplo, enviar e-mails ou outras comunicações não solicitadas;
Solicitar informações pessoais de qualquer indivíduo menor de 18 anos ou pedir senhas ou informações de identificação pessoal para fins comerciais ou ilegais;
Usar linguagem ou imagens sexualmente explícitas, prejudiciais, ameaçadoras, abusivas, difamatórias, obscenas, odiosas e nem racial ou etnicamente ofensivas;
Você não pode postar material que inclua representações gráficas de violência desnecessária ou excessiva; inclua linguagem ou gestos profanos ou obscenos; defenda a intoxicação ou o abuso de substâncias; promova estereótipos políticos, religiosos ou de gênero; tenha comentários negativos, desrespeitosos etc. sobre religiões; ou afete negativamente o nome, a reputação ou o aviamento do Avalanche Studios Group;
Postar, fazer upload ou fornecer link para imagens ou conteúdos sexualmente explícitos, prejudiciais, ameaçadores, abusivos, difamatórios, obscenos, odiosos e nem racial ou etnicamente ofensivos;
Assumir falsamente a identidade, assediar, divulgar informações sem autorização ou causar aflição de qualquer maneira ao Avalanche Studios Group, seus empregados, representantes, etc.;
Passar-se por outra pessoa, descrever enganosamente sua afiliação com uma entidade ou pessoa, ocultar ou tentar ocultar sua identidade ou realizar outro tipo de fraude;
Violar ou encorajar outros a violarem quaisquer leis ou regulamentos locais, estaduais, nacionais ou internacionais;
Comercializar, promover, anunciar ou solicitar produtos ou serviços no Jogo;
Modificar qualquer parte do Jogo, ou de seus Clientes, Servidores etc.;
Anunciar a intenção de comprar, vender, trocar, compartilhar ou transferir o acesso ao Jogo, ou cometer um desses atos;
Anunciar a intenção de comprar ou vender itens com ou por dinheiro ou de trocar itens no Jogo, ou cometer um desses atos;
Usar o Jogo para algo ilegal ou providenciar a troca ou transferência de software pirata ou ilegal no Jogo;
Usar o Jogo e/ou o Conteúdo Criado pelo Usuário em não conformidade com a legislação, termos e condições aplicáveis aqui contidos e quaisquer diretrizes aplicáveis;
Usar o Conteúdo Criado pelo Usuário em outros jogos, produtos ou serviços;
Não seguir as instruções de pessoal autorizado no Jogo ou em relação a ele;
Organizar ou ser membro de quaisquer compromissos ou grupos dentro do Jogo que se baseiem ou adotem filosofias racistas, sexistas, antirreligiosas, antiétnicas, homofóbicas ou que promovam o ódio;
Fornecer informações falsas ou ocultar intencionalmente quaisquer informações ao registrar sua conta no Jogo;
Tentar interferir, hackear ou decifrar quaisquer transmissões para ou dos servidores ou plataformas que executam o Jogo;
Explorar quaisquer bugs no Jogo ou comunicar a existência de bugs exploráveis (bugs que concedam benefícios não naturais ou não pretendidos ao usuário) diretamente ou por meio de postagem pública a qualquer outro usuário do Jogo. Bugs relacionados ao Jogo devem ser prontamente comunicadospara a equipe de suporte por meio dos canais indicados na seção 29.
Tentar jogar o Jogo em qualquer servidor ou plataforma que não sejam controlados ou autorizados pelo Avalanche Studios Group, pelos seus designados ou pelos provedores de plataforma/serviços;
Criar, usar ou fornecer qualquer emulador de servidor ou outro site onde o Jogo possa ser jogado e postar ou distribuir quaisquer utilitários, emuladores ou outras ferramentas de software relacionados ao Jogo sem a permissão expressa por escrito do Avalanche Studios Group;
Registrar uma conta de usuário em nome de outro indivíduo ou de qualquer grupo ou entidade;
Usar os direitos autorais ou marcas registradas da Avalanche Studios Group ou qualquer marca cuja semelhança possa causar confusão;
Fazer o upload de dados inválidos, vírus, worms ou outros agentes de software no Jogo;
Coletar informações de outros Usuários Finais sem o consentimento deles; ou
Usar o Jogo de qualquer maneira que viole os termos e condições deste Contrato ou a Política de Privacidade.
O Avalanche Studios Group e os provedores de plataforma/serviços podem excluir o Conteúdo do Usuário Final e os Envios ou encerrar sua conta e interromper seu acesso ao Jogo por qualquer motivo, a qualquer momento, a nosso exclusivo critério e sem aviso, inclusive se acreditarmos que você está violando este Contrato ou a Política de Privacidade, mas não limitado a isso.

19. Communication and Feedback
Avalanche Studios Group may from time to time contact you by any appropriate information channel to keep you up to date with news about for example the Game, new products and services, updates, campaigns, promotions, faults, issues relating to technical aspects and/or the usability of the Game, payment methods etc. Avalanche Studios Group may occasionally ask you to provide information on your experiences of playing the Game etc. which will be used to improve the quality and provision of the Game etc. You are not required to provide any ideas, feedback or suggestions (collectively, “Feedback”) to Avalanche Studios Group. Any and all information which is submitted by you is submitted voluntarily. To the extent you do provide any Feedback to Avalanche Studios Group, you agree to assign and hereby do assign all right, title and interest in and to such Feedback to Avalanche Studios Group and acknowledge that Avalanche Studios Group may freely use, reproduce, modify, distribute, make, have made, sell, offer for sale, import and otherwise exploit in any manner such Feedback without payment of any royalties or other consideration to you. You can stop the delivery of promotional messages from Avalanche Studios Group by following the specific instructions in promotional messages or by our customer support. These communication choices do not apply to mandatory service communications that are considered part of the Game, which you may receive periodically.

20. Electronic communications
When you play the Game, or send emails to us, you are communicating with us electronically. You agree to receive communications from us electronically and communicate with us electronically. We will communicate with you by e-mail or by posting notices in the Game or by any other means Avalanche Studios Group finds suitable. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically (whether by email, posting notice in the Game or otherwise) satisfy any legal requirement that such communications be in writing.

You are solely responsible for your interactions with other users of the Game. We reserve the right, but have no obligation, to monitor disputes between you and other users.

22. Arbitration
If you are located within the United States of America, the following applies to you: Any claim (excluding claims for injunctive or other equitable relief) where the total amount of the award sought by either party is less than $10,000 shall be resolved via binding non-appearance-based arbitration initiated through the American Arbitration Association (“AAA”). The AAA Rules are available online at www.adr.org or by calling the AAA at 1-800-778-7879. In any such arbitration, the parties and AAA must comply with the following rules: (a) the arbitration shall be conducted by telephone, online and/or be solely based on written submissions, the specific manner shall be chosen by the party initiating the arbitration; (b) the arbitration shall not involve any personal appearance by the parties or witnesses unless otherwise mutually agreed by the parties; (c) the arbitrator may award injunctive or declaratory relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party’s individual claim; and (d) any judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction. Nothing in this Agreement shall prevent either party from seeking remedies in small claims court of competent jurisdiction.

22. Arbitragem

23. Class action waiver
YOU AGREE THAT ANY CLAIMS SUBJECT TO ARBITRATION UNDER SECTION 22 MUST BE MADE IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

23. Renúncia à Ação Coletiva

24. Claims
YOU AND AVALANCHE STUDIOS GROUP AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THIS AGREEMENT MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.

24. Reivindicações

25. Governing law
(a) If you are located outside of the United States of America this Agreement shall be governed by and construed in accordance with the laws of Sweden, without giving effect to any principles of conflicts of law, and the parties hereby agree to the sole and exclusive jurisdiction of the courts of Sweden, with the district court of Stockholm (Stockholms Tingsrätt) as first venue, to resolve any disputes arising out of or relating to this Agreement.

(b) If you are located within the United States of America, and unless otherwise required by a mandatory law of any jurisdiction, this Agreement shall be governed by and construed in accordance with the laws of the state of New York, without giving effect to any principles of conflicts of law. You agree that any action arising out of or relating to this Agreement that is not subject to mandatory arbitration as set forth above in section 22 shall be filed only in the state or federal courts in and for New York County, New York and you hereby agree and submit to the personal jurisdiction of such courts for the purposes of litigating any such action.

(c) Notwithstanding anything to the contrary, Avalanche Studios Group may apply to any court of competent jurisdiction for payments, injunctive or other equitable relief.

26. Severability
If for any reason any provision of this Agreement shall be held invalid or unenforceable in whole or in part in any applicable jurisdiction, such provision shall, as to such jurisdiction, be ineffective only to the extent of such invalidity or unenforceability without in any manner affecting the validity or enforceability thereof in any other jurisdiction or the remaining provisions hereof in any jurisdiction.

26. Desvinculação
Se por qualquer motivo qualquer cláusula deste Contrato for considerada inválida ou inexequível, no todo ou em parte, em qualquer jurisdição aplicável, tal cláusula será, para tal jurisdição, ineficaz somente até a extensão de tal invalidade ou inexequibilidade sem, de qualquer forma, afetar a validade ou exequibilidade dela em qualquer outra jurisdição ou as cláusulas restantes deste documento em qualquer jurisdição.

27. Modification
Avalanche Studios Group reserves the right, at its discretion, to update or revise this Agreement at any time. Avalanche Studios Group will post such changes in the Game, its webpage and or forums etc. related to the Game and these additional or revised terms will become part of the Agreement. Please check the EULA document periodically for changes. Your continued playing of the Game constitutes your binding acceptance of the EULA, including any changes or modifications made by Avalanche Studios Group as permitted above.

27. Modificação
O Avalanche Studios Group se reserva o direito, ao seu critério, de atualizar e revisar este Contrato a qualquer momento. O Avalanche Studios Group postará as alterações no Jogo, na sua página de Internet e/ou nos fóruns etc. relacionados ao Jogo, e os termos adicionais ou revisados se tornarão parte do Contrato. Por favor, leia o EULA periodicamente para ver as alterações. Você continuar jogando o Jogo representa sua aceitação vinculante do EULA, incluindo quaisquer alterações feitas pelo Avalanche Studios Group, conforme permitido acima.

28. Entire agreement
This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof, and supersedes all previous written or oral agreements between the parties with respect to such subject matter. Avalanche Studios Group may assign its rights under this Agreement without notice to you. You may not assign your rights under this Agreement.
