We are Flashbulb – the makers of Rubber Bandits! We are a Copenhagen based game developer company, located at Knabrostræde 3, 3. sal, 1210 Copenhagen K, Denmark, registered at the Danish Business Authority with company registration number: 37650706.
 
This end user license agreement (“Agreement”) is a document we would like you to read. It is about our game, Rubber Bandits, (“Game”) and the way you should use it. The instructions and manuals that we provide to the Game are considered part of the Game for the purpose of this Agreement. When you play our Game, the terms of this Agreement (“Terms”) apply.
 
We may decide to change some of these Terms when we think it is necessary, and we will post the changed Agreement on our website and on Steam.
 
If any future changes to this Agreement are unacceptable to you or cause you to no longer be compliant with this Agreement, you may terminate this Agreement in accordance with section 3.

1.License
We grant you a license to download, install and use the Game (“License”). The License is non-exclusive and limited.
 
When you download, install and use the Game, you accept the Terms.
This means that you do not own the Game, but you are allowed to use it in accordance with these Terms.
 
1.1 License limitations
The following limitations apply to the License
-You may only the use the Game on one device at a time
-Any kind of copying, transfer or distribution of the Game requires our permission
-Circumvention of copyright protection is prohibited and considered a copyright infringement
-Reverse engineering and decompiling is not allowed
-You may not use the Game for illegal or harmful purposes
-You may not commercialise the Game in a way not approved explicitly by us
-You may not use cheats, automation software (bots), hacks or any other unauthorized third-party software, tools or content designed to modify the Game experience
-You may not modify, translate or create derivative works based on or utilizing any parts of the Game.
 
You may permanently transfer all of your rights under this Agreement only if the recipient agrees to the Terms, and if you remove and delete the Game completely from your accounts as well as all computers and devices you possess or control.
 
2. Intellectual property
We own all rights to the Game. This includes for example the copyright to source code, characters, setting, text, dialogue and artwork, design rights to user interfaces, trademarks, patents, know-how, trade secrets, rights to names, titles and themes, etc.
 
You are not allowed to use any of our rights without our permission.

3. Termination
This Agreement is effective until terminated. You may terminate the Agreement at any time by deleting and completely removing the Game from all accounts, computer systems and devices in your possession or control.
 
We may at our own discretion give notice to terminate this Agreement in the event that we become aware that you are failing to comply with the Terms.
 
In the event of termination, you must immediately and permanently destroy the Game and all copies in your control and stored on any media whatsoever and on Flashbulb Games' request certify that you have done so.
 
4. Liability
Please do not mess with our property. If you damage some of our property - also including our source code, name, brand, trademarks, content - we will ask you to repay our losses.
 
In the unlikely event that our game should be causing any damage or is materially defect, we limit the amount that you may claim to the amount that we actually received from you to get a copy of our game.
 
To the maximum extent permitted by law we are not liable for any lost profits and indirect damages and for the risks connected with property damage, lost data, loss of goodwill, computer failure and errors, or loss of business or other information as a result of possessing or using the Game or by malfunction of the Game.
 
5. Limited warranty
The Game is provided "as is". To the extent permitted by applicable law, the Game is provided without any warranties of any kind.
 
We do specifically not warrant that the operation of the Game will be uninterrupted or error free or free from defects or that errors can be corrected.

Diese Endbenutzer-Lizenzvereinbarung ("Vereinbarung") ist ein Dokument, das Sie bitte lesen sollten. Es geht um unser Spiel, Rubber Bandits, ("Spiel") und die Art und Weise, wie Sie es benutzen sollten. Die Anweisungen und Handbücher, die wir dem Spiel zur Verfügung stellen, gelten als Teil des Spiels im Sinne dieser Vereinbarung. Wenn Sie unser Spiel spielen, gelten die Bedingungen dieser Vereinbarung ("Bedingungen").

6. Your remedies
If material defects in the Game should turn up, we will do what is commercially reasonable to correct the errors, and as a last resort pay back some or all of the money we received from you to get a copy of our game.
 
7. Behaviour
Our chat is not monitored or moderated systematically, and we are not responsible for any content provided by other users.
 
In any case we would like you to keep a good and appropriate language and behaviour (also) when in the world of Rubber Bandits. That means, for example:
-No sexual content or references
-No harassment
-No harmful or violent behaviour
-No swearing
 
If we do not approve your behaviour we may decide to shut your profile down. 
 
8. User Generated Content
Any content that you create or make available through the
Game or services related to the Game, including challenges, skins, in-game constructions, chat posts, replays, screenshots and other game customization is considered user generated content, (“UGC”).
 
If you post, upload or otherwise share any UGC, you grant us the free right to use your UGC as outlined below. We do not need further permission and no form of compensation is necessary.
 
You hereby grant to Flashbulb a worldwide,  non-exclusive, fully paid, royalty-free, irrevocable, perpetual, transferable, and sub-licensable license to use, copy, reproduce, distribute, publish, publicly perform, publicly display, modify, adapt, translate, store the UGC, and create derivative works in any form, format or medium of any kind now known or later developed.
 
You waive all moral rights you might have with respect to any UGC provided to Flashbulb, but we do credit creators of UGC in accordance with industry standard.
 
You may not create, generate, or make available through the Game any UGC to which you do not have the right to grant us such license. In addition, you may not create, generate, or make available through the Game any UGC that is illegal or violates or infringes someone else’s rights, including intellectual property rights or privacy, publicity or moral rights.
 
We reserve the right to - at our own discretion - take down any UGC.

Wir können beschließen, einige dieser Bedingungen zu ändern, wenn wir es für notwendig halten, und wir werden die geänderte Vereinbarung auf unserer Website und auf Steam veröffentlichen. 

8.1 Modding
Mods are regarded as all other UGC, but here is some extra info about them. 
When making mods you should always make sure you make your own backup. We change the game with new updates etc. and we can not promise that your mods will continue to work as  intended. A backup will make it easier for you to update and modify your mod to work with whatever changes we made. 

Wenn zukünftige Änderungen an dieser Vereinbarung für Sie unannehmbar sind oder dazu führen, dass Sie diese Vereinbarung nicht mehr einhalten, können Sie diese Vereinbarung gemäß Abschnitt 3 kündigen.

When you upload your mods to an online platform through our tools, we reserve the right to remove it. That might happen for a number of reasons such as it not being in line with our intentions with providing a modding tool or if we think the mod is not following our guidelines.

You should know that when you share what you have made, there is a real risk someone is going to copy, modify and share it in their name. We don’t approve of it in any way, but it is hard for us to do anything about. This means when you upload something you acknowledge that we cannot in any way be held responsible for what happens to the mod and how it is used by others. Basically you must accept that we can use, modify, share, and adapt the mod, and allow other people to also do so too.

9. Law and venue
To the maximum extent permitted by local law applicable, this Agreement is subject to Danish Law, and the city court of Copenhagen, Denmark, shall have exclusive jurisdiction over disputes arising from this Agreement.

1. Lizenz
Wir gewähren Ihnen eine Lizenz zum Herunterladen, Installieren und Benutzen des Spiels ("Lizenz"). Die Lizenz ist nicht exklusiv und beschränkt.

Mit dem Herunterladen, Installieren und Benutzen des Spiels akzeptieren Sie die Nutzungsbedingungen. 
Das bedeutet, dass Sie das Spiel nicht besitzen, aber Sie dürfen es in Übereinstimmung mit diesen Bedingungen nutzen.

1.1 Lizenzbeschränkungen
Die folgenden Einschränkungen gelten für die Lizenz
- Sie dürfen das Spiel nur auf einem Gerät gleichzeitig nutzen.
- Jegliche Art der Vervielfältigung, Übertragung oder Verbreitung des Spiels bedarf unserer Zustimmung.
- Die Umgehung des Urheberrechtsschutzes ist verboten und gilt als Urheberrechtsverletzung.
- Reverse Engineering und Dekompilierung sind nicht erlaubt.
- Sie dürfen das Spiel nicht für illegale oder schädliche Zwecke verwenden.
- Sie dürfen das Spiel nicht in einer Weise kommerzialisieren, die nicht ausdrücklich von uns genehmigt wurde.
- Sie dürfen keine Cheats, Automatisierungssoftware (Bots), Hacks oder andere nicht autorisierte Software, Tools oder Inhalte von Drittanbietern verwenden, die dazu bestimmt sind, das Spielerlebnis zu verändern.
- Es ist Ihnen nicht gestattet, Teile des Spiels zu modifizieren, zu übersetzen oder abgeleitete Werke zu erstellen.

Sie können alle Ihre Rechte aus dieser Vereinbarung nur dann dauerhaft übertragen, wenn der Empfänger den Bedingungen zustimmt und wenn Sie das Spiel vollständig von Ihren Konten sowie von allen Computern und Geräten, die Sie besitzen oder kontrollieren, entfernen und löschen. 

2. Geistiges Eigentum
Wir besitzen alle Rechte am Spiel. Dazu gehören z.B. das Urheberrecht an Quellcode, Zeichen, Satz, Text, Dialog und Artwork, Designrechte an Benutzeroberflächen, Marken, Patente, Know-how, Geschäftsgeheimnisse, Namens-, Titel- und Themenrechte, etc. 

Es ist Ihnen nicht gestattet, unsere Rechte ohne unsere Zustimmung zu nutzen.

3. Kündigung
Diese Vereinbarung gilt bis zur Kündigung. Sie können den Vertrag jederzeit kündigen, indem Sie das Spiel von allen Konten, Computersystemen und Geräten, die sich in Ihrem Besitz oder unter Ihrer Kontrolle befinden, löschen und vollständig entfernen. 

Wir können diese Vereinbarung nach eigenem Ermessen kündigen, wenn uns bekannt wird, dass Sie die Bedingungen nicht einhalten. 

Im Falle einer Kündigung sind Sie verpflichtet, das Spiel und alle Kopien, die sich unter Ihrer Kontrolle befinden und auf jeglichen Datenträgern gespeichert sind, unverzüglich und dauerhaft zu vernichten, und auf Verlangen von Flashbulb Games zu bestätigen, dass Sie dies getan haben. 

4. Haftung
Bitte missbrauchen Sie unser Eigentum nicht. Wenn Sie einen Teil unseres Eigentums beschädigen - einschließlich Quellcode, Name, Marke, Marke, Warenzeichen, Inhalt - werden wir Sie bitten, unsere Verluste zu erstatten. 

Für den unwahrscheinlichen Fall, dass unser Spiel einen Schaden verursacht oder einen Sachmangel aufweist, beschränken wir den Betrag, den Sie geltend machen können, auf den Betrag, den wir tatsächlich von Ihnen erhalten haben, um eine Kopie unseres Spiels zu erhalten.

Soweit gesetzlich zulässig, haften wir nicht für entgangenen Gewinn und indirekte Schäden sowie für Risiken im Zusammenhang mit Sachschäden, Datenverlust, Verlust von Geschäftswerten, Computerausfällen und Fehlern, Verlust von geschäftlichen oder sonstigen Informationen infolge des Besitzes oder der Nutzung des Spiels oder durch Fehlfunktionen des Spiels.

5. Begrenzte Garantie 
Das Spiel wird im vorliegenden Zustand zur Verfügung gestellt. Soweit gesetzlich zulässig, wird das Spiel ohne jegliche Garantien jeglicher Art zur Verfügung gestellt. 

Wir übernehmen insbesondere keine Gewähr dafür, dass der Betrieb des Spiels ununterbrochen, fehlerfrei oder ohne Mängel erfolgt oder dass Fehler korrigiert werden können.

6. Ihre Rechtsbehelfe
Sollten sich Materialmängel im Spiel zeigen, werden wir das wirtschaftlich Sinnvolle tun, um die Fehler zu korrigieren, und als letztes Mittel einen Teil oder das gesamte Geld, das wir von Ihnen für eine Kopie unseres Spiels erhalten haben, zurückzahlen. 

7. Verhalten
Unser Chat wird nicht systematisch überwacht oder moderiert, und wir sind nicht verantwortlich für Inhalte, die von anderen Nutzern zur Verfügung gestellt werden. 

Auf jeden Fall möchten wir, dass Sie eine vernünftige und angemessene Sprache und Verhaltensweise (auch) in der Welt der Trailmaker pflegen. Das bedeutet zum Beispiel:
- Keine sexuellen Inhalte oder Anspielungen
- Keine Belästigung
- Kein störendes oder gewalttätiges Verhalten
- Kein Fluchen

Wenn wir Ihr Verhalten nicht gutheißen, können wir beschließen, Ihr Profil zu schließen.  

8. Benutzergenerierte Inhalte
Jeglicher Inhalt, den Sie durch 
das Spiel oder die damit verbundenen Dienste erstellen oder zur Verfügung stellen, einschließlich Herausforderungen, Skins, In-Game-Konstruktionen, Chat-Posts, Replays, Screenshots und andere Spielanpassungen, wird als benutzergenerierter Inhalt ("UGC") betrachtet.

Wenn Sie einen UGC posten, hochladen oder anderweitig freigeben, gewähren Sie uns das kostenlose Recht, Ihren UGC wie unten beschrieben zu nutzen. Wir benötigen keine weitere Genehmigung und es ist keine Form der Entschädigung erforderlich.

Sie erteilen Flashbulb hiermit eine weltweite, nicht-exklusive, voll bezahlte, gebührenfreie, unwiderrufliche, dauerhafte, übertragbare und sublizenzierbare Lizenz zur Nutzung, zum Kopieren, Reproduzieren, Verteilen, Veröffentlichen, zur öffentlichen Aufführung, öffentlichen Wiedergabe, zum Modifizieren, Anpassen, Übersetzen, Speichern der UGC und zum Erstellen abgeleiteter Werke in jeder Form, jedem Format oder Medium jeglicher Art, die jetzt bekannt sind oder später entwickelt werden. 

Sie verzichten auf alle moralischen Rechte, die Sie in Bezug auf alle UGCs haben könnten, die Flashbulb zur Verfügung gestellt werden, aber wir kreditieren die Urheber von UGCs in Übereinstimmung mit dem Industriestandard.

Sie dürfen keine UGC erstellen, generieren oder über das Spiel zur Verfügung stellen, deren Lizenz Sie nicht erteilen dürfen. Darüber hinaus dürfen Sie über das Spiel keine UGC erstellen, generieren oder zur Verfügung stellen, die illegal sind oder die Rechte Dritter verletzen oder beeinträchtigen, einschließlich der Rechte an geistigem Eigentum oder der Privatsphäre, der Öffentlichkeit oder der moralischen Rechte. 

Wir behalten uns das Recht vor, nach eigenem Ermessen jeden UGC zu entfernen.

9. Recht und Gerichtsstand
Soweit es das örtliche Recht zulässt, unterliegt diese Vereinbarung dem dänischen Recht, und das Stadtgericht Kopenhagen, Dänemark, hat die ausschließliche Zuständigkeit für Streitigkeiten, die sich aus dieser Vereinbarung ergeben.
