We are Flashbulb – the makers of Rubber Bandits! We are a Copenhagen based game developer company, located at Knabrostræde 3, 3. sal, 1210 Copenhagen K, Denmark, registered at the Danish Business Authority with company registration number: 37650706.
 
This end user license agreement (“Agreement”) is a document we would like you to read. It is about our game, Rubber Bandits, (“Game”) and the way you should use it. The instructions and manuals that we provide to the Game are considered part of the Game for the purpose of this Agreement. When you play our Game, the terms of this Agreement (“Terms”) apply.
 
We may decide to change some of these Terms when we think it is necessary, and we will post the changed Agreement on our website and on Steam.
 
If any future changes to this Agreement are unacceptable to you or cause you to no longer be compliant with this Agreement, you may terminate this Agreement in accordance with section 3.

1.License
We grant you a license to download, install and use the Game (“License”). The License is non-exclusive and limited.
 
When you download, install and use the Game, you accept the Terms.
This means that you do not own the Game, but you are allowed to use it in accordance with these Terms.
 
1.1 License limitations
The following limitations apply to the License
-You may only the use the Game on one device at a time
-Any kind of copying, transfer or distribution of the Game requires our permission
-Circumvention of copyright protection is prohibited and considered a copyright infringement
-Reverse engineering and decompiling is not allowed
-You may not use the Game for illegal or harmful purposes
-You may not commercialise the Game in a way not approved explicitly by us
-You may not use cheats, automation software (bots), hacks or any other unauthorized third-party software, tools or content designed to modify the Game experience
-You may not modify, translate or create derivative works based on or utilizing any parts of the Game.
 
You may permanently transfer all of your rights under this Agreement only if the recipient agrees to the Terms, and if you remove and delete the Game completely from your accounts as well as all computers and devices you possess or control.
 
2. Intellectual property
We own all rights to the Game. This includes for example the copyright to source code, characters, setting, text, dialogue and artwork, design rights to user interfaces, trademarks, patents, know-how, trade secrets, rights to names, titles and themes, etc.
 
You are not allowed to use any of our rights without our permission.

3. Termination
This Agreement is effective until terminated. You may terminate the Agreement at any time by deleting and completely removing the Game from all accounts, computer systems and devices in your possession or control.
 
We may at our own discretion give notice to terminate this Agreement in the event that we become aware that you are failing to comply with the Terms.
 
In the event of termination, you must immediately and permanently destroy the Game and all copies in your control and stored on any media whatsoever and on Flashbulb Games' request certify that you have done so.
 
4. Liability
Please do not mess with our property. If you damage some of our property - also including our source code, name, brand, trademarks, content - we will ask you to repay our losses.
 
In the unlikely event that our game should be causing any damage or is materially defect, we limit the amount that you may claim to the amount that we actually received from you to get a copy of our game.
 
To the maximum extent permitted by law we are not liable for any lost profits and indirect damages and for the risks connected with property damage, lost data, loss of goodwill, computer failure and errors, or loss of business or other information as a result of possessing or using the Game or by malfunction of the Game.
 
5. Limited warranty
The Game is provided "as is". To the extent permitted by applicable law, the Game is provided without any warranties of any kind.
 
We do specifically not warrant that the operation of the Game will be uninterrupted or error free or free from defects or that errors can be corrected.

Ce contrat de licence utilisateur final (« CLUF ») est un document que nous vous invitons à lire. Il concerne notre jeu, Rubber Bandits (le « Jeu »), ainsi que l'utilisation que vous devez en faire. Dans le cadre de ce CLUF, nous considérons les instructions et manuels fournis avec le Jeu comme faisant partie intégrante dudit Jeu. Lorsque vous jouez à notre Jeu, vous êtes soumis aux conditions de ce CLUF (les « Conditions »).

6. Your remedies
If material defects in the Game should turn up, we will do what is commercially reasonable to correct the errors, and as a last resort pay back some or all of the money we received from you to get a copy of our game.
 
7. Behaviour
Our chat is not monitored or moderated systematically, and we are not responsible for any content provided by other users.
 
In any case we would like you to keep a good and appropriate language and behaviour (also) when in the world of Rubber Bandits. That means, for example:
-No sexual content or references
-No harassment
-No harmful or violent behaviour
-No swearing
 
If we do not approve your behaviour we may decide to shut your profile down. 
 
8. User Generated Content
Any content that you create or make available through the
Game or services related to the Game, including challenges, skins, in-game constructions, chat posts, replays, screenshots and other game customization is considered user generated content, (“UGC”).
 
If you post, upload or otherwise share any UGC, you grant us the free right to use your UGC as outlined below. We do not need further permission and no form of compensation is necessary.
 
You hereby grant to Flashbulb a worldwide,  non-exclusive, fully paid, royalty-free, irrevocable, perpetual, transferable, and sub-licensable license to use, copy, reproduce, distribute, publish, publicly perform, publicly display, modify, adapt, translate, store the UGC, and create derivative works in any form, format or medium of any kind now known or later developed.
 
You waive all moral rights you might have with respect to any UGC provided to Flashbulb, but we do credit creators of UGC in accordance with industry standard.
 
You may not create, generate, or make available through the Game any UGC to which you do not have the right to grant us such license. In addition, you may not create, generate, or make available through the Game any UGC that is illegal or violates or infringes someone else’s rights, including intellectual property rights or privacy, publicity or moral rights.
 
We reserve the right to - at our own discretion - take down any UGC.

Nous pouvons être amenés à modifier ces Conditions si nous le jugeons nécessaire, auquel cas nous publierons le CLUF mis à jour sur notre site Internet et sur Steam. 

8.1 Modding
Mods are regarded as all other UGC, but here is some extra info about them. 
When making mods you should always make sure you make your own backup. We change the game with new updates etc. and we can not promise that your mods will continue to work as  intended. A backup will make it easier for you to update and modify your mod to work with whatever changes we made. 

Si l'une de ces modifications vous semblait inacceptable ou engendrait une contradiction entre votre utilisation du jeu et ce CLUF, vous pouvez le résilier conformément au paragraphe 3.

When you upload your mods to an online platform through our tools, we reserve the right to remove it. That might happen for a number of reasons such as it not being in line with our intentions with providing a modding tool or if we think the mod is not following our guidelines.

You should know that when you share what you have made, there is a real risk someone is going to copy, modify and share it in their name. We don’t approve of it in any way, but it is hard for us to do anything about. This means when you upload something you acknowledge that we cannot in any way be held responsible for what happens to the mod and how it is used by others. Basically you must accept that we can use, modify, share, and adapt the mod, and allow other people to also do so too.

9. Law and venue
To the maximum extent permitted by local law applicable, this Agreement is subject to Danish Law, and the city court of Copenhagen, Denmark, shall have exclusive jurisdiction over disputes arising from this Agreement.

1. Licence
Nous vous accordons une licence pour télécharger, installer et utiliser le Jeu (la « Licence »). Cette Licence est non-exclusive et limitée.

Lorsque vous téléchargez, installez et utilisez le jeu, vous acceptez les Conditions. 
Cela signifie que vous ne possédez pas le Jeu, mais que vous avez le droit de vous en servir conformément à ces Conditions.

1.1 Restrictions de la licence
La Licence est sujette aux restrictions suivantes :
- Vous ne pouvez utiliser le jeu que sur un appareil à la fois.
- Toute forme de copie, transfert ou distribution du Jeu nécessite notre autorisation.
- Le contournement de protection est interdit et considéré comme une violation du droit d'auteur.
- La rétro-ingénierie et la décompilation ne sont pas autorisées.
- Le Jeu ne doit pas être utilisé dans un but illégal ou visant à nuire.
- Le Jeu ne peut être commercialisé d'une autre manière que celle que nous avons clairement définie.
- Les codes, robots, programmes pirates ou tout autre logiciel tiers, outil ou contenu non autorisé destiné à modifier l'expérience de jeu sont interdits.
- Les modifications, traductions ou créations de travaux dérivés basés sur, ou utilisant n'importe quelle partie du Jeu ne sont pas autorisées.

Vous pouvez transférer de manière permanente tous vos droits dans le cadre de ce CLUF, à condition que le destinataire accepte les Conditions et que vous supprimiez intégralement le Jeu de vos comptes ainsi que de tout ordinateur ou appareil en votre possession. 

2. Propriété intellectuelle
Nous détenons tous les droits relatifs au Jeu, par exemple les droits d'auteurs concernant le code source, les personnages, le cadre, les textes, les dialogues et les illustrations, les droits de conception concernant les interfaces utilisateur, les marques, brevets, le savoir-faire, les secrets de fabrication, les droits concernant les noms, titres et thèmes, etc. 

Toute utilisation de nos droits sans notre autorisation est interdite.

3. Résiliation
Ce CLUF prend effet jusqu'à sa résiliation. Vous pouvez résilier le CLUF à tout moment en supprimant intégralement le Jeu de tous les comptes, ordinateurs et appareils en votre possession. 

Nous nous réservons le droit de mettre fin au CLUF dans l'éventualité où nous apprendrions que vous n'en respectez pas les Conditions. 

En cas de résiliation, vous devez immédiatement et de façon permanente détruire toute copie du Jeu en votre possession, quel que soit l'appareil. Vous devrez également, à la demande de Flashbulb Games, certifier la destruction du Jeu. 

4. Responsabilité
Veuillez respecter notre propriété. Celle-ci comprend le code source, le nom, les marques, le contenu. En cas de dommages, nous demanderons réparation. 

Dans le cas peu probable où notre jeu causerait des dommages ou comporterait un défaut matériel, nous limitons la somme que vous pourrez nous réclamer à l'équivalent du montant que vous nous avez versé pour obtenir une copie de notre jeu.

Dans la mesure autorisée par la loi, nous ne sommes pas responsables d'un manque à gagner et de dommages indirects, ainsi que des risques liés aux dommages matériels, à la perte de données, de clientèle, aux pannes et erreurs informatiques, ou à la perte de marché ou de toute autre information, dus à la possession, l'utilisation ou le mauvais fonctionnement du Jeu.

5. Limite de garantie 
Le Jeu est fourni « tel quel ». Dans la mesure autorisée par la loi en vigueur, le Jeu est fourni sans garantie d'aucune sorte. 

Plus précisément, nous ne garantissons pas le fonctionnement ininterrompu du Jeu, l'absence d'erreur ou de défaut, ni la correction systématique des erreurs.

6. Vos recours
Dans le cas où un défaut matériel serait présent dans le Jeu, nous ferions tout notre possible dans la mesure du raisonnable pour corriger les problèmes et, en dernier recours, rembourser une partie ou toute la somme que vous nous avez versée pour obtenir une copie de notre jeu. 

7. Conduite
Notre système de discussion n'est pas surveillé ou modéré en permanence. Nous déclinons toute responsabilité quant au contenu fourni par les autres utilisateurs. 

Quoi qu'il en soit, nous souhaiterions que soient adoptés une conduite et un langage appropriés dans le monde de Trailmakers. Cela comprend, par exemple :
- Pas de contenu ou de référence à caractère sexuel
- Pas de harcèlement
- Pas de conduite nuisible ou violente
- Pas de langage injurieux

Si nous jugeons votre conduite déplacée, nous nous réservons le droit de supprimer votre profil.

8. Contenu généré par les utilisateurs
Tout contenu que vous créez ou mettez à disposition dans le 
Jeu ou via les services associés au Jeu, dont les défis, modèles, constructions en jeu, messages, enregistrements, captures d'écran et autres personnalisations du jeu entrent dans la définition du contenu généré par les utilisateurs (« UGC »).

Si vous publiez, téléchargez ou partagez tout UGC, vous nous accordez le droit d'utiliser ledit UGC comme indiqué ci-dessous, sans qu'une autre permission ou une rémunération soit nécessaire.

Vous accordez à Flashbulb par la présente une licence universelle, non exclusive, sans frais, libre de droits, irrévocable, perpétuelle, transférable et pouvant être concédée par une sous-licence d'utiliser, de copier, reproduire, distribuer, publier, présenter ou afficher en public, modifier, adapter, traduire, stocker l'UGC, ainsi que de créer des travaux dérivés, quels que soient leurs forme ou format, qu'ils soient déjà existants ou non. 

Vous renoncez à tous les droits moraux que vous pourriez avoir sur tout UGC fourni à Flashbulb, mais nous citons les créateurs d'UGC conformément aux normes de l'industrie.

Vous n'avez pas l'autorisation de créer, générer, ou mettre à disposition dans le Jeu tout UGC pour lequel vous ne disposez pas de tels droits. En outre, vous n'avez pas l'autorisation de créer, générer, ou mettre à disposition dans le Jeu tout UGC illégal ou enfreignant aux droits d'une autre personne, y compris aux droits d'auteur ou aux droits à la vie privée, aux droits publicitaires ou moraux. 

Nous nous réservons le droit, à notre entière discrétion, de supprimer tout UGC.

9. Droit et juridiction
Dans la mesure permise par la loi locale en vigueur, ce CLUF est soumis au droit danois et le tribunal de Copenhague au Danemark sera le seul compétent sur les litiges découlant du présent CLUF.
