THESE TERMS AND CONDITIONS ("TERMS") APPLY TO AND SHALL BE EFFECTIVE IN RESPECT OF ANY USE OF THE GAME. THESE TERMS ARE IN ADDITION TO THE APPLICABLE TERMS AND CONDITIONS OF ANY PLATFORM ON WHICH WE MAKE THE GAME AVAILABLE (“PLATFORM TERMS”). THE PLATFORM TERMS ARE THEREFORE DEEMED INCORPORATED INTO THESE TERMS.  
PLEASE READ THE FOLLOWING CAREFULLY BEFORE USING, DOWNLOADING, PURCHASING OR INSTALLING THE GAME (WHICH INCLUDES THE RELEVANT ONLINE SERVICE). IF YOU DO NOT AGREE WITH THESE TERMS YOU MAY NOT USE, DOWNLOAD OR INSTALL THE GAME.
PLEASE NOTE THAT THE GAME REQUIRES AN INTERNET CONNECTION AND THE AVAILABILITY OF OUR ONLINE SERVICE FOR MOST OF ITS FUNCTIONS.
YOU ARE RESPONSIBLE FOR ENSURING THAT YOU HAVE AN INTERNET CONNECTION, AND THAT THE DEVICE YOU USE HAS SUFFICIENT HARDWARE AND SOFTWARE REQUIREMENTS AND MEMORY IN ORDER TO PLAY AND STORE THE GAME AND USE THE ONLINE SERVICE.
THE GAME HAS BEEN DEVELOPED TO WORK ON THE LATEST VERSION OF STEAM, PLAYSTATION®, XBOX, NINTENDO SWITCH™, AMAZON LUNA AND EPIC GAMES STORE AT THE TIME OF ITS RELEASE. THE PLATFORM HOLDERS MAY OCCASIONALLY UPDATE THEIR SOFTWARE; WE WILL ENDEAVOR, BUT NOT BE OBLIGATED, TO UPDATE THE GAME IF NECESSARY, TO ENSURE THAT ITS FUNCTIONS AND PERFORMANCE CONTINUE WITH ANY UPDATE RELEASE. IT IS YOUR OBLIGATION TO ENSURE THAT YOU ARE USING THE LATEST COMPATIBLE PUBLIC RELEASE OF ANY OPERATING SYSTEM FOR YOUR CONSOLE OR PC.
THE GAME COMPRISES COPYRIGHT WORKS OF MILESTONE AND/OR ITS LICENSORS. THE GAME IS LICENSED, NOT SOLD.  YOUR LICENSE CONFERS NO TITLE OR OWNERSHIP IN THE GAME.  THE GAME IS SOLELY INTENDED FOR USE BY END USERS ACCORDING TO THESE TERMS. ANY USAGE, REPRODUCTION OR REDISTRIBUTION OF THE GAME NOT IN ACCORDANCE WITH THESE TERMS IS EXPRESSLY PROHIBITED.

1. LIMITED USE LICENSE.

1. BEGRÄNSAD ANVÄNDARLICENS.

1.1 Milestone hereby grants you limited, non-exclusive right and license to download, install and use the Game for your personal, non-commercial use only, on compatible consoles or devices that are owned by you, subject to these Terms.
1.2 These Terms, and your use of the Game, do not give you any rights of ownership over any property in the game, whether tangible or intangible (including any Track or Bike livery or customized rider/bike that you create).
1.3 This clause applies if we offer the Game through the Steam platform (“Steam”), which is hosted by Valve S.A.R.L. (in the EU) and Valve Corporation (in the US). Where applicable, you will need a Steam account to play the Game, and your use of Steam is subject to the Steam Subscriber Agreement, which you can find online here.  The Steam Subscriber Agreement changes from time to time; if it becomes inconsistent with this EULA, where conflicts arise, the Steam Subscriber Agreement takes precedence. Steam allows refunds for the Game in certain circumstances.  You can find out how on the Steam website here: Steam Refunds.
1.4 If you install or use the Game on any third party platform including without limitation the PlayStation®, Microsoft Xbox, Nintendo, Amazon Luna and Epic Games Store platforms then the terms of these platforms will all apply.
1.5 You and we acknowledge that these Terms are agreed between you and us only, and not with Apple Inc, nor any subsidiary or affiliate company of Apple Inc. You also acknowledge that we are solely responsible for the Game and the content thereof.
1.6 If you are playing on an Android device, your use of the Game may require you to have a Google account. Your access to the Game will be linked to your Google account and you are required to comply with Google policies to use the Game.  

1.1 Milestone beviljar dig härmed en begränsad och icke-exklusiv rätt och licens att ladda ner, installera och använda spelet för personligt, icke-kommersiellt bruk. Det ska endast användas på kompatibla konsoler eller enheter som ägs av dig, som omfattas av dessa användarvillkor.
1.2 Dessa villkor, och att du använder spelet, ger dig ingen äganderätt till någon av egenskaperna i spelet vare sig materiella eller immateriella (inklusive eventuella specialanpassade banor- eller motorcyklar eller specialanpassningar på förare / motocykel som du gör).
1.3 Denna klausul gäller om vi erbjuder spelet via Steam-plattformen ("Steam"), som administreras av Valve S.A.R.L. (i EU) och Valve Corporation (i USA). Om detta är fallet, betyder det att du behöver ett Steam-konto för att spela spelet, och att din användning av Steam omfattas av Steams abonnentavtal, som du kan hitta online här.  Steams abonnentavtal kan utsättas för ändringar, och om det blir oförenligt med detta EULA, i de fall det uppstår konflikter, har Steams abonnentavtal företräde. 1.4 Om du installerar eller använder spelet på någon tredjepartsplattform inklusive, såsom exempel, PlayStation®, Microsoft Xbox och Nintendo plattformarna, Amazon Luna och Epic Games Store, gäller användarvillkoren för dessa plattformar.
1.5 Du och vi bekräftar att dessa villkor endast ingås mellan dig och oss, och inte med Apple Inc, och inte heller något dotterbolag eller filial till Apple Inc. Du bekräftar också att vi ensamma ansvarar för spelet och dess innehåll.
1.6 Om du spelar på en Android-enhet kan användningen av spelet kräva att du har ett Google-konto. Ditt tillträde till spelet kommer att kopplas till ditt Google-konto och du måste följa Googles policy för att använda spelet.  

2. END USER OBLIGATIONS.

2. SLUTANVÄNDARENS SKYLDIGHETER.

2.1 You may use the Game for your own personal, non-commercial use as described in these Terms, but you are not entitled to and may not do any of the following, except to the extent expressly permitted by these Terms:
2.1.1 sell, transfer, copy, reproduce, translate, communicate, reverse engineer, publish, stream, distribute, rent, loan, sub-license, derive source code from, modify, adapt, merge, disassemble, decompile, create derivative works based on or otherwise transfer or deal in copies or reproductions of the Game, or any part or interest in it, to other parties in any way except where the Game expressly permits you to do so by sharing Game content on social media;  
2.1.2 remove, modify or tamper with any copyright, trademark or other notice;
2.1.3 engage in any act that we deem to be in conflict with the spirit or intent of the Game and/or the Online Service, including, without limitation, using cheats, exploits, automation software, bots, hacks, mods or any unauthorized third-party software designed to modify or interfere with the Game;
2.1.4 attempt to gain unauthorized access to the Online Service, or to the computers, devices, servers, or networks connected to the Online Service by any means other than the user interface provided by us; or
2.1.5 use the Game for any unlawful or immoral purposes.   
2.2 You may not use, access or otherwise export or re-export the products except as authorized by United States law and the laws of the jurisdiction in which the Services were obtained. In particular, but without limitation, the Games may not be exported, re-exported or otherwise made available (a) into any country or region embargoed by the U.S. Government, or (b) to anyone on the U.S. Treasury Department's Specially Designated Nationals List or the U.S. Department of Commerce Denied person List or Entity List, EU consolidated sanctions list with designated persons. By using the Games, you represent and warrant that you are not located in any such country or on any such list.

2.1 Du kan använda spelet för eget personligt, icke-kommersiellt bruk såsom beskrivet i dessa villkor, men du har inte rätt till och får inte göra något av följande, förutom i den utsträckning som uttryckligen tillåts av dessa villkor:
2.1.1 till andra parter sälja, överföra, kopiera, reproducera, översätta, kommunicera, utföra reverse engineering, publicera, strömma, distribuera, hyra, låna, upplåta underlicens, härleda källkod från, modifiera, anpassa, sammanfoga, demontera, dekompilera, skapa derivatverk baserat på eller på annat sätt överföra eller handla i kopior eller reproduktioner av spelet eller någon del eller intresse i det på något sätt, utom när spelet uttryckligen tillåter dig att göra det genom att dela innehåll från spelet på sociala medier  
2.1.2 avlägsna, ändra eller manipulera med upphovsrätt, varumärke eller annat meddelande
2.1.3 delta i handlingar som vi anser vara i konflikt med andan eller avsikten med spelet och / eller onlinetjänsten, inklusive, men utan begränsning till, fusk, utnyttjande, automatiseringsprogramvara, bots, hacks, mods eller någon obehörig tredje parts programvara utformad för att modifiera eller störa spelet 
2.1.4 försöka få obehörig åtkomst till onlinetjänsten eller till datorer, enheter, servrar eller nätverk som är anslutna till onlinetjänsten på något annat sätt än genom det användargränssnitt som tillhandahålls av oss; eller
2.1.5 använda spelet för olagliga eller omoraliska ändamål.   
2.2	2.2 Du får inte använda, få åtkomst till eller på annat sätt exportera eller återexportera produkterna förutom i enlighet med USA:s lagstiftning och lagstiftningen i den jurisdiktion i vilken Tjänsterna erhållits. Spelen får i synnerhet inte, men utan begränsning, exporteras, återexporteras eller på annat sätt göras tillgängliga (a) i ett land eller en region som USA:s regering förbjudit, eller (b) till någon på USA:s finansdepartements lista över speciellt utpekade medborgare eller USA:s handelsdepartements lista eller enhetslista över personer som omfattas av förbud, eller EU:s konsoliderade sanktionsförteckning för personer. Genom att använda Spelen, representerar du och garanterar du att du inte befinner dig i något sådant land eller finns på någon sådan lista.

3. TERMINATION.

3. UPPSÄGNING.

3.1 These Terms and the licenses granted to you by us are effective until terminated.
3.2 You may terminate these Terms at any time and for any reason by deleting and removing the Game from your console or PC.  
3.3 We may terminate these Terms if you fail to abide by them at any time and for any reason, or where we reasonably suspect that you have failed to abide by any of these Terms.  We may take action that we deem reasonable at our sole discretion against users who do not comply with these Terms. This may include banning users from using or accessing the Game and/or the Online Service. For more information about the kind of infraction you could commit, we recommend you to carefully read the entire paragraph 5.11 “User Content Rules”. Based on the type but especially on the number of reports received, Milestone reserves the right to suspend a user for the following days: one day, three days, seven days, fifteen days, one month. Once the latter is exceeded, it’s possible to incur a permanent suspension.
3.4 Milestone reserves the right to determine what conduct it considers to be in violation of, or otherwise outside the intent or spirit of, these Terms and/or the Game and/or the Online Service. However, if your action can be rectified, we shall give you reasonable opportunity to do so. 
3.5 Following termination, you will no longer be permitted to use any of the Game and you will be required to delete the Game from your console or device.
3.6 Milestone Services are no longer available in a region. Should such a circumstance occur, we will publish a communication on our website and/or in the game itself, reporting the interruption of a core feature of a game or all of the Milestone Services in a region.

3.1. Dessa villkor och de licenser som vi har beviljat dig är giltiga tills de sägs upp. 
3.2 Du kan säga upp dessa villkor när som helst och med vilken anledning som helst genom att radera och ta bort spelet från din konsol eller PC.  
3.3 Om du inte följer dessa villkor eller om vi rimligen misstänker att du har misslyckats med att följa något av dessa villkor kan vi när som helst och av vilken anledning som helst säga upp dem. Vi kan vidta åtgärder som vi anser rimliga, efter eget gottfinnande, mot användare som inte följer dessa villkor, vilket kan inkludera att banna användare att använda eller få tillgång spelet och / eller onlinetjänsten. För mer information om vilka överträdelser du kan begå rekommenderar vi att du noggrant läser hela punkt 5.11 “Regler för användarinnehåll”. Beroende på typen men framför allt på antalet inkomna anmälningar förbehåller sig Milestone rätten att stänga av användaren i olika antal dagar: en dag, tre dagar, sju dagar, femton dagar, en månad. Om den senare gränsen överskrids kan användaren bli permanent avstängd.
3.4 Milestone förbehåller sig rätten att bestämma vilket beteende de anser vara i strid med eller på annat sätt inte överensstämmer med avsikten eller andan i dessa villkor och / eller spelet och / eller onlinetjänsten. Men om det du har gjort kan rättas till kommer vi ge dig en rimlig möjlighet att göra det. 
3.5 Efter uppsägningen får du inte längre använda någon del av spelet och du måste radera spelet från din konsol eller enhet.
3.6 Milestone-tjänsterna är inte längre tillgängliga i en region. Om en sådan omständighet inträffar kommer vi att lägga ut ett meddelande på vår webbplats och/eller i själva spelet. I meddelandet kommer vi att ange att en väsentlig funktion i ett spel eller alla Milestone-tjänster i en region har avbrutits.

4. ONLINE SERVICE.

4. ONLINETJÄNSTER.

4.1 Milestone may, but shall not be obliged to, provide and maintain certain online functions, online network play connectivity and interactivity, and other online features relating to the Game subject to these Terms. These shall include, by way of example, the online ‘Single Event’ and ‘Custom Championship’ game modes (“Online Service”).
4.2 We cannot guarantee that the Online Service or a particular part of the Online Service, including any User Content, will always be available. 
4.3 The Online Service is for personal use only, on an “as is” basis and all use must be in accordance with these Terms.

4.1 Milestone kan, men ska inte vara skyldig att, tillhandahålla och underhålla viss online-funktionalitet, online-nätverksspel-anslutningar och interaktivitet och andra onlinefunktioner relaterade till spelet, inklusive, men utan begränsning till, online-lägena "Single Event" och "Custom Championship" (”Onlinetjänst”) enligt dessa villkor.
4.2 Vi kan inte garantera att onlinetjänsten eller en viss del av onlinetjänsten, inklusive alla användarinnehåll, om de finns, alltid kommer att finnas tillgängliga.  
4.3 Onlinetjänsten är endast avsedd för personligt bruk på "som den är" -basis och all användning måste ske i enlighet med dessa villkor.

Age Restrictions
4.4 To be able to play, you must first accept the Milestone user agreement and confirm that you have read MIlestone's privacy and cookie policy. In order to use online functions, you must have an Internet connection and an account on the platform; it is also necessary for a person aged at least thirteen to complete the registration process.

Åldersbegränsningar
4.4 För att spela är det nödvändigt att samtycka till Milestones användaravtal och acceptera Milestones policy för integritetsskydd och kakor. För att få tillgång till onlinefunktionerna behövs en internetuppkoppling och ett användarkonto på plattformen. Registreringen måste dessutom utföras av en person som är minst tretton år gammal.

User Rules
4.5 You also agree that you will not in any way behave in a manner which is unlawful or which gives rise to civil or criminal liability, or which might call us or the Game into disrepute. 
4.6 Where the Game allows you to share pre-determined messages with other users, we shall be entitled to remove, restrict, suspend or alter that ability for any reason at our sole and absolute discretion.  
4.7 You will cooperate fully with us to investigate any suspected unlawful, fraudulent or improper activity.
4.8 If you feel that the behavior of another user breaches these Terms, please let us know by contacting us via the Support Services with details of the potential breach and/or the user responsible. We will take reasonable steps to deal with any breach.

4.5 Du samtycker vidare till att du inte på något sätt kommer att bete dig olagligt eller på något sätt som ger upphov till civilrättsligt eller straffrättsligt ansvar eller som kan leda till att vi eller spelet vanhedras.  
4.6 I de fall spelet tillåter dig att dela förutbestämda meddelanden med andra användare, har vi rätt att ta bort, begränsa, avbryta eller förändra denna förmåga helt och hållet enligt vårt eget gottfinnande.  
4.7 Du kommer att samarbeta fullt ut med oss för att undersöka eventuella misstänkta bedrägerier, olaglig eller obehörig aktivitet. 
4.8 Om du tycker att beteendet hos en annan användare bryter mot dessa villkor, vänligen meddela oss genom att kontakta oss via supporttjänsterna med information om den potentiella överträdelsen och / eller den ansvarige användaren. Vi kommer att vidta rimliga åtgärder för att hantera alla överträdelser. 

Please note: 
Where the Online Service is available, you use it at entirely your own risk. It is a known risk of internet usage that people are not necessarily who they say they are. People may provide information or behave in a way that is unreliable, misleading, unlawful or illegal. Milestone has no way of telling if statements made by other users of the Game and/or the Online Service are true. This is a decision that can only be made by you, and we recommend exercising caution. By playing the Game and using the Online Service and its parts, you accept that this is the case and accept the associated risk. Users must take particular care in relation to the disclosure of their own personal information.

Milestone har ingen möjlighet att avgöra om uttalanden från andra användare av spelet och / eller onlinetjänsten är sanningsenliga. 5. CREATION AND CUSTOMISATION OF USER CONTENT.

5.1 the definition of “User Contents” (singular “User Content”) includes any content created by the user through any editor functions which might be included in the Game including, but not limited to, tracks, liveries, helmets, decals, pilot stickers, numbers, suits and vehicles, and which are uploaded, made available or sent by the user to the Online Service, for their own purposes and/or for other users to utilise in the Game.

5.1 Spelet kan innehålla en redigeringsfunktion som gör att du eller andra användare av spelet kan skapa användarinnehåll (enligt definitionen i art. 5.1.1) som kan användas i spelet, laddas upp, delas och göras tillgängligt eller skickas till onlinetjänsten för dig själv och / eller andra spelare. Användaren har dessutom möjlighet att skicka meddelanden till oss eller tredje parter och / eller att bidra med användarinnehållet och / eller information för dess användning i spelet eller av oss eller av tredje parter.

For the purposes of these Conditions:
5.1.1 The definition of “User Contents” (singular “User Content”) includes any content created by the user through any editor functions which might be included in the Game including, but not limited to, tracks, liveries, helmets, decals, pilot stickers, numbers, suits and vehicles, and which are uploaded, made available or sent by the user to the Online Service, for their own purposes and/or for other users to utilise in the Game.
5.1.2 "Distribute" means to use, sell, market, promote, sub-license to end-users, distribute or otherwise make available to third parties.
5.2 In relation to the SOLE use of the Game and Online Service (where this service exists) and pursuant to these Terms and Conditions, the user may (and is granted a limited, non-exclusive licence and the right to) use the software that is part of the Game and Online Service to communicate with other users of the Game via the Online Service, and to publish User Content and transmit, communicate and make it available. In this way, the user hereby grants us an unlimited, transferable, sub-licensable, royalty-free, perpetual, irrevocable, non-exclusive licence to use and make available any such User Content in connection with the Game, in any manner or media. 
5.3 We are committed to marketing and publishing the Game and providing its associated entertainment services in the form of the Online Service. Additionally, we engage in the transmission, storage, retrieval, hosting, formatting or translation of User Content without selection or alteration of the communication content, for which we merely serve as a conduit.
5.4 By installing and using the Game, the user agrees and confirms that we are not responsible for reviewing any User Content made available, as we will not be required to exercise any control or give any judgement in relation to the content or published material, or its substance. For the purposes of avoiding any misunderstandings, the opinions expressed in any User Content represent the opinions of the individual authors, and not those of Milestone, unless otherwise specified by us. In particular, but without limitations to the above, we cannot be held responsible, and decline any liability for comments, opinions or observations expressed in any User Content. We shall be entitled to remove, restrict, suspend or alter any User Content (and the ability to share or create User Content, including any Track or Bike Livery) for any reason at our sole and absolute discretion.
5.5 We have the right to remove, limit, suspend or alter any User Content (and the ability to share or create User Content) for any reason, at our sole and absolute discretion.
5.6 The user accepts that we can use, publish, amend, vary and adapt any User Content which the user should make available, publish or transmit to the Game and/or the Online Service for any reason, at our sole discretion. 
5.7 To the extent that User Content derives from the Game or material supplied by us, the user hereby assigns us all intellectual property rights subsisting in the User Content which are owned by them, including all intellectual property rights in any User Content created by them.
5.8 We do not supply any guarantee, and shall not issue any declaration regarding the accuracy, evaluation or validity of the information and material contained in the User Content or Online Service; nor can we be held responsible for any losses or damage caused by the use of said information or material.
5.9 If the user discovers any User Content which they feel contravenes these Terms and Conditions, we would ask them to notify us via support Services and submit details of the User Content concerned..

För syftet med dessa Användarvillkor:
5.1.1 Definitionen av ”användarinnehåll” inkluderar allt innehåll som skapats av användaren med hjälp av de redigeringsfunktioner som kan ingå i spelet, som till exempel, men inte begränsat till, banor, specialanpassningar,  hjälmar, dekaler, förardekaler, siffror, dräkter och fordon och som du laddar upp, gör tillgängliga eller skickar till onlinetjänsten för att du själv och / eller andra användare ska kunna använda dem i spelet.
5.1.2 ”Distribuera” betyder använda, sälja, marknadsföra, lansera, upplåta underlicens till slutanvändare, distribuera och på annat sätt göra tillgängligt för tredje parter.
5.2 ENDAST i samband med användningen av spelet och onlinetjänsten (där denna tjänst finns) och då användningen omfattas av dessa villkor, får du (och ges du en begränsad, icke-exklusiv licens och rätt att) använda programvaran som ingår i spelet och onlinetjänsten för att kommunicera med andra användare av spelet med hjälp av onlinetjänsten och posta, överföra, kommunicera och för att göra användarinnehåll tillgängligt. Genom att göra detta samtycker du härmed till att ge oss en obegränsad, överförbar, underlicensierbar, royaltyfri, evig, oåterkallelig, icke-exklusiv rättighet och licens att använda och göra sådant användarinnehåll tillgängligt i samband med spelet oavsett form eller media.
5.3 Vi arbetar med att marknadsföra och publicera spelet och tillhandahålla relaterade underhållningstjänster i form av onlinetjänsten. Dessutom arbetar vi med överföring, lagring, hämtning, administrering, formatering eller översättning av användarinnehåll utan att välja eller ändra innehållet av kommunikationen för vilken vi endast agerar som länk. 
5.4 Genom att installera och använda spelet samtycker du till och accepterar att vi inte har något ansvar att granska något användarinnehåll som ställs till förfogande, på grundval av att vi inte är skyldiga att utöva någon kontroll eller bedömning av innehållet eller materialet som publicerats eller finns däri. För att undanröja alla tvivel tydliggör vi att åsikter som uttrycks i något användarinnehåll är de enskilda författarnas synpunkter och inte Milestones, om inte annat anges av oss. I synnerhet, men utan begränsning till det som angetts ovan, är vi inte ansvariga för och frånskriver oss allt ansvar för eventuella kommentarer, åsikter eller synpunkter som uttrycks i något användarinnehåll. 
5.5 Vi har rätt att ta bort, begränsa, avbryta eller förändra allt användarinnehåll (och möjligheten att dela eller skapa användarinnehåll) av vilken anledning som helst efter vårt eget gottfinnande.
5.6 Du samtycker till att vi kan använda, publicera, redigera, modifiera och anpassa användarinnehållet du gör tillgängligt, eller postar eller överför till spelet och / eller onlinetjänsten av vilken anledning som helst efter vårt eget gottfinnande. 
5.7 I den utsträckning ditt användarinnehåll härrör från spelet eller materialet som tillhandahålls av oss, överlåter du härmed till oss alla immateriella rättigheter som finns i användarinnehåll som ägs av dig, detta inkluderar alla immateriella rättigheter i alla användarinnehåll som du skapar.
5.8 Vi ger ingen garanti och gör ingen framställan om tillförlitlighet, värde eller giltighet av informationen och materialet i användarinnehållet eller onlinetjänsten och är inte ansvariga för förlust eller skada som orsakas till följd av användning av sådan information eller sådant material.

User Rules of User Content (applicable where the Online Service exists)
5.10 The user agrees and undertakes to have the right to make available, or publish or transmit, their User Contents to the Game, and to grant us the rights specified in clause 5.8. The user shall not make available, nor indeed publish or transmit to the Game, any statement, material or other User Content, or use the Online Service or Game in any way which:
5.10.1 is abusive, seditious, pornographic, aggressive, homophobic, defamatory, false, instigates hatred, is discriminatory, obscene, offensive, provocative, sexist or racist;
5.10.2 molests or intimidates any person, or inhibits or prevents the ability of other users to communicate or read conversations (including the use of any macros/SPAM for the general base of gamers, or a single individual, in order to interrupt the chat);
5.10.3 breaches any Intellectual Property Right or other rights of any person (on condition that the User Content is derived from the Game or the material supplied by us);
5.10.4 gives rise to any behaviour involving exploitation through, but not limited to, third-party programmes, bots, scripts, viruses or other means reasonably prohibited by us on an as-and-when basis, or that exploits bugs, unforeseen errors or undocumented features to access restricted parts of the game, or otherwise engages in activities that we reasonably deem are contrary to the "spirit" of the Game;
5.10.5 encourages any breach of these Terms and Conditions, or the terms of service of a third-party service provider;
5.10.6 are Illegal, malicious, misleading (including impersonation), discriminatory, or give rise to civil or criminal liability, or which might jeopardise the reputation of Milestone, the Online Service or the Game;
5.10.7 breaches the intellectual property or other rights of third parties, or facilitates or encourages such a breach, or involves the distribution of personal information of any gamer (other than one’s own, such as private messages);
5.10.8 is technically damaging, such as introducing computer viruses, worms, logic bombs or other harmful software or data, or otherwise attempting or effectively modifying or interfering with the Game, or overloading or disrupting any computer or server used by the Game;
5.10.9 may be considered commercial or marketing communication;
5.10.10 promotes illegal or unlawful activities, including but not limited to solicitation, gambling or the sale of prescription medication;
5.10.11 is directed at individuals under the age of 18 or those seeking or attempting to arrange to meet a person under the age of 18;
5.10.12 contains any restricted material, including but not limited to passwords, medical information or confidential information of any person; 
5.10.13 constitutes, in our reasonable opinion, misuse of the Game or an attempt to gain unauthorised access to the Game or its parts, or the accounts of other users or networks, or their console or device; or
5.10.14 solicits, invites, encourages, supports, incites or provokes - in whole or in part - any of the above.

5.10.1 är kränkande, uppviglande, pornografiskt, aggressivt, homofobiskt, förtalande, skadligt, osant, hetsar till hat, diskriminerande, obscent, kränkande, provocerande, sexistiskt eller rasistiskt;
5.10.2 trakasserar, eller skrämmer någon person eller döljer eller hindrar andra användares förmåga att kommunicera eller läsa konversationer (detta inkluderar användning av makro / SPAM till antingen den allmänna eller enskild persons spelarbas för att störa chatt) 
5.10.3 kommer att kränka immateriella rättigheter eller någon persons andra rättigheter (förutsatt att ditt användarinnehåll härrör från spelet eller material som tillhandahålls av oss)
5.10.4 involverar exploaterande beteende, genom men inte begränsat till, tredjepartsprogram, bots, script, virus eller andra medel som tidvis är skäligen förbjudna av oss, eller som utnyttjar buggar, oavsiktliga fel eller funktioner som inte har dokumenterats, för att få åtkomst till begränsade delar av spelet eller som på annat sätt utgör aktivitet som vi rimligen anser mot spelets ”anda”
5.10.5 uppmuntrar alla överträdelser mot dessa villkor eller av en tredjepartsleverantörs användarvillkor

5.10.8 är tekniskt skadligt såsom införande av datavirus, maskar, logikbomber eller annan skadlig programvara eller skadliga data, eller på annat sätt försöker eller faktiskt ändrar eller stör spelet eller överbelastar eller stör någon dator eller server som används av spelet
5.10.9 kan betraktas som en marknadsföring eller kommersiell kommunikation
5.10.10 främjar olaglig eller obehörig verksamhet inklusive men inte begränsat till värvning, vadslagning eller försäljning av receptbelagda läkemedel
5.10.11 riktar sig till personer under 18 år eller som söker eller försöker göra något arrangemang för att träffa en person under 18 år
5.10.12 innehåller eventuellt begränsat material, inklusive men inte begränsat till lösenord, medicinsk information eller konfidentiell information som tillhör någon person
5.10.13 utgör, enligt vår rimliga åsikt, missbruk av spelet eller ett försök att få obehörig tillgång till spelet eller delar därav, eller till andra användares konton eller nätverk eller deras konsol eller enhet, eller
5.10.14 begär, uppmanar, uppmuntrar, förespråkar, sporrar eller provocerar något eller allt ovanstående.

User Contents which can be created using the Editor (applicable where the Online Service exists)
5.11 According to Clause 5.8 above, in relation to any User Content created and uploaded by the user on the Online Service, the user shall grant us the right and licence, on a non-exclusive basis, which shall be deemed free of royalties, perpetual and irrevocable, on a worldwide basis, for:
5.11.1 distributing their User Content via the Online Service;;
5.11.2 using and making available screenshots and video sequences of their User Content, and creating and making available (also through third-party services) any such further promotional and marketing materials at our discretion, for the purposes of promoting the Track or Livery of the motorcycle they have created, the Game and/or the Online Service on all media;
5.11.3 distributing the demo or free versions of the User Content with an end to reviewing, promoting and marketing solely the customised User Content; and; 
5.11.4 using any commercial brand or commercial name of which the user is aware, or their User Content in relation to the distribution of the User Content below. 	
5.12 The user guarantees and declares the following to us (on condition that the User Content derives from the Game, or the material supplied by Milestone):
5.12.1 that they are the owner or licence holder of the User Content, and all the Intellectual Property Rights pertaining to it;
5.12.2 that they have the full power to enter into these Conditions and the Terms herein, and are entitled to grant the rights, licences and assignments contained in them, and that they hold all licences and assignments required to do so;
5.13 The user shall indemnify (agree to compensate) and hold Milestone harmless against all actions, claims, proceedings, costs and damages (including any damages or settlements paid by us on the advice of our legal advisors to settle or resolve any claim), and all legal fees or other expenses arising from any breach of the above warranties, or these Terms and Conditions.

5.11.2 använda och göra tillgängliga skärmbilder och videosekvenser av ditt användarinnehåll och skapa och göra tillgängliga (inklusive via tredjepartstjänster) eventuellt annat marknadsföringsmaterial och reklam enligt vår önskan, i syfte att marknadsföra: specialanpassning av banor och motorcyklar som du har skapat, spelet och / eller onlinetjänsten i alla media
5.11.3 distribuera demonstrationer eller gratisversioner av ditt användarinnehåll för att granska och marknadsföra endast ditt personliga användarinnehåll och  
5.11.4 använda varumärken eller firmanamn som du känner till eller ditt användarinnehåll i samband med distributionen av det nedan angivna användarinnehållet. 	
5.12 Du garanterar och uppger (förutsatt att ditt användarinnehåll härrör från spelet eller material som tillhandahålls av Milestone):
5.12.1 att du är ägare eller licensinnehavare av användarinnehållet och alla immateriella rättigheter däri
5.12.2 att du har full makt att ingå dessa villkor och har rätt att bevilja de rättigheter, licenser och uppdrag som finns i den och har alla nödvändiga licenser och uppdrag som krävs för att göra det
5.13 Du kommer att ersätta (acceptera att kompensera) och hålla Milestone skadelös för alla handlingar, fordringar, förfaranden, kostnader och skadestånd (inklusive alla skador eller ersättningar som betalats av oss på förslag av våra juridiska rådgivare för att svara på eller lösa eventuella fordringar) och alla juridiska kostnader eller andra utgifter eller de som följer brott mot ovan nämnda garantier och villkor.

6. WARRANTY AND LIMITATION OF LIABILITY.

6. GARANTI OCH BEGRÄNSNING AV ANSVAR.

6.1 We warrant that we have used and will use reasonable efforts to ensure that:
6.1.1 we are entitled to grant the rights and licenses granted herewith;
6.1.2 the Game will be of satisfactory quality;
6.1.3 we have used and will use reasonable efforts to ensure that the Game and/or the Online Service will be available for six (6) months from the date on which you purchase the Game; and
6.1.4 the Online Service, when made available by us, shall be of satisfactory quality, as described and fit for purpose.
6.2 To the maximum extent permitted by law, and save as expressly provided in these Terms, we give no warranty in connection with the Online Service and exclude liability for any loss or damage of any kind, regardless of how it arises, including without limitation any direct, indirect, punitive or consequential loss, regardless of whether it arises from any issue you notify to us, and we shall have no liability to pay any money by way of compensation, including without limitation all liability in relation to:
6.2.1 the availability of the Online Service;
6.2.2 any incorrect or inaccurate information on the Online Service and all errors, interruptions to or delays in updating the Online Service;
6.2.3 the infringement by any person of any Intellectual Property Rights of any third party caused by their use of the Online Service;
6.2.4 any amount or kind of loss or damage due to viruses or other malicious software that may infect a user's computer equipment, software, data or other property caused by persons accessing, using or downloading the Online Service; 
6.2.5 all representations, warranties, conditions and other terms which but for this notice would have effect.
6.3 Except as specifically provided in these terms, and to the maximum extent permitted by law:
6.3.1 The Game is provided on an "as is" and “as available” basis without warranty or guarantee of any kind (express or implied) other than those set out in these terms;
6.3.2 We only accept liability for direct loss as a result of our breach of the warranties in Clause 6.1 above;
6.3.3 Our and our licensors’ maximum liability will be limited to €100;
6.3.4 We and our licensors will not in any event be liable in any way for any consequential or indirect loss or damage (save to the extent that damage to your console, PC or other digital content which you own is caused by the Game as a result of our failure to use reasonable care and skill in which case you may be entitled to compensation or we may be obliged to repair your device);
6.3.5 We do not warrant or guarantee that the operation of the Game and/or the Online Service will be uninterrupted or error-free, or that errors can or will be corrected, or that the Game or the Online Service are free of viruses or other harmful components;
6.3.6 You install and use the Game at your own risk.

6.1 Vi garanterar att vi har ansträngt oss och kommer att anstränga oss på rimlig nivå för att säkerställa att:
6.1.1 Vi har rätt att bevilja de rättigheter och licenser som beviljas nedan
6.1.2 Spelet kommer att vara av tillfredsställande kvalitet  
6.1.3 Vi har ansträngt oss och kommer att anstränga oss på rimlig nivå för att säkerställa att spelet och / eller onlinetjänsten kommer att finnas tillgänglig i sex (6) månader från det datum då du köper spelet; och  
6.1.4 Onlinetjänsten, när den görs tillgänglig av oss, ska vara av tillfredsställande kvalitet, såsom beskrivet, och passande för ändamålet.
6.2 Så långt tillämplig lag medger, och förutsatt det som uttryckligen anges i dessa villkor, ger vi ingen garanti i samband med onlinetjänsten och utesluter ansvar för förlust eller skada av något slag som uppstår, inklusive och utan begränsning, till direkta, indirekta, straffskadestånd eller följdförluster oavsett om dessa uppstår till följd av något problem som du meddelar oss. Vi har dessutom inget ansvar för att betala någon kompensation, inklusive utan begränsning, inget ansvar i samband med:
6.2.1 tillgängligheten av onlinetjänsten 
6.2.2 all felaktig eller inkorrekt information om onlinetjänsten och alla fel, avbrott eller förseningar vid uppdatering av onlinetjänsten  
6.2.3 någon persons överträdelse av tredje parts immateriella rättigheter orsakade av deras användning av onlinetjänsten
6.2.4 någon mängd eller typ av förlust eller skada orsakad av virus eller annan skadlig programvara som kan smitta en användares datorutrustning, programvara, data eller annan egendom, som orsakas av personer som går in på, använder eller laddar ner onlinetjänsten 
6.2.5 alla framställningar, garantier, villkor och andra klausuler som gäller, med undantag för detta meddelande.
6.3 Förutom vad som specifikt anges i dessa användarvillkor och så långt tillämplig lag medger: 
6.3.1 tillhandahålls spelet "som det är" och "som tillgängligt” utan andra garantier eller löften (uttryckliga eller underförstådda) än de som anges i dessa villkor
6.3.2 accepterar vi endast ansvar för direkt förlust till följd av brott som vi utfört mot garantierna i punkt 6.1 ovan 
6.3.3 Vårt och våra licensgivares maximala ansvar kommer att begränsas till € 100
6.3.4 Vi och våra licensgivare är under inga omständigheter ansvariga för någon följd eller indirekt förlust eller skada (förutom i den mån skador på din konsol, PC eller annat digitalt innehåll som du äger orsakas av spelet, som ett resultat av att vi inte använde rimlig vård och skicklighet, i vilket fall du kan ha rätt till ersättning eller vi kan vara skyldiga att reparera din enhet)
6.3.5 Vi garanterar inte och säkrar inte att driften av spelet och / eller onlinetjänsten kommer att vara oavbruten eller felfri eller att fel kan eller kommer att korrigeras, eller att spelet eller onlinetjänsten är fri från virus eller andra skadliga komponenter 
6.3.6 Du installerar och använder spelet på egen risk.

7. INDEMNITY AND REMEDIES. 

7. SKADESTÅND OCH ÅTGÄRDER. 

7.1 You hereby indemnify (agree to compensate), defend and hold harmless Milestone and our affiliates, officers, directors, owners, licensors, service providers, partners, contractors, employees, agents and licensees (collectively, the "Indemnified Parties") from and against any and all any liabilities, claims, costs and expenses (including legal expenses and attorney fees) incurred by the Indemnified Parties in connection with any claim arising out of any breach by you of these Terms, or claims arising directly or indirectly from your use or misuse of the Game (which includes Virtual Items and the Online Service, where existing), and any User Content; and/or any use other than that set out in these Terms. You shall fully cooperate with us in the defense of any such claim and we reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you.
7.2 You further agree that the subject matter of these Terms is of a unique character with special value, and that we would suffer irreparable damage if these Terms were not specifically enforced; as a result you agree that we shall be entitled, without bond, other security, or proof of damages, to appropriate equitable remedies (including injunctive relief) with respect to breaches of these Terms, in addition to other remedies as we may otherwise have available under applicable laws.
7.3 Our licensors shall be third-party beneficiaries under these Terms and shall be entitled to enforce its provisions and enjoy the benefits of its protections.

7.1. Du betalar härmed ut ersättning (samtycker till att kompensera), försvarar och håller Milestone skadelös, såsom våra dotterbolag, sambandstjänstemän, styrelseledamöter, ägare, licensgivare, tjänsteleverantörer, partners, entreprenörer, anställda, agenter och licensinnehavare (kollektivt "de skadeställda parterna”). Dessa hålls skadelösa från och mot alla eventuella skulder, fordringar, kostnader och utgifter (inklusive rättsliga kostnader och advokatavgifter) som de skadeställda parterna har ådragit sig i samband med eventuella fordringar som uppstår till följd av en överträdelse från dig av dessa villkor, eller fordringar som uppstår direkt eller indirekt på grund av din användning eller ditt missbruk av spelet (som inkluderar virtuella artiklar och onlinetjänsten, i de fall denna finns), allt användarinnehåll; och / eller annan användning på annat sätt än i enlighet med dessa användarvillkor.  Du ska full ut samarbeta med oss för att försvara alla sådana anspråk och vi förbehåller oss rätten att på egen bekostnad åta det exklusiva försvaret och kontrollen av alla ärenden som annars är föremål för kompensation av dig.
7.2 Du samtycker vidare till att ämnet för dessa villkor är av en unik karaktär med speciellt värde och att vi skulle bli oåterkalleligt skadade om dessa villkor inte specifikt verkställs. Du samtycker därför till att vi utan förpliktelse ska ha rätt till annan säkerhet eller bevis på skadestånd, till lämpliga rättvisa rättsmedel (inklusive att begära föreläggande) med avseende på överträdelser av dessa villkor, förutom sådana andra rättsmedel som vi annars kan ha tillgängliga, enligt tillämpliga lagar.
7.3 Våra licensgivare ska vara tredjepartsmottagare enligt dessa villkor och har uttrycklig rätt att verkställa sina bestämmelser och åtnjuta fördelarna med sina skydd.

8. OWNERSHIP.

8.1 All right, title, interest and ownership rights in the Game and any copyright, design right, database right, patents and any rights to inventions, know-how, trade and business names, trade secrets and trade marks (whether registered or unregistered) and any related applications and other intellectual property rights (“Intellectual Property Rights”), in or connected with the Game and each part thereof (including, by way of example only, any titles, code, themes, objects, characters, stories, catchphrases, concepts, artworks, animations, sounds, music, audio-visual effects and methods of operation) are owned by, belong to and vest in us or our licensors. 
8.2 The Game may contain certain licensed materials and our licensors may act to protect their rights in the event of any breach of these Terms. All trademarks are the property of their respective owners.

8.1 Alla rättigheter, intressen och äganderätt i spelet och eventuell upphovsrätt, designrätt, databasrätt, patent och eventuella rättigheter till uppfinningar, know-how, handels- och företagsnamn, handelshemligheter och varumärken (oavsett om de är registrerade eller oregistrerade) och alla tillämpningar därtill och andra immateriella rättigheter ("immateriella rättigheter"), i eller kopplade till spelet och varje del därav (inklusive exempelvis bara titlar, kod, teman, objekt, karaktärer, berättelser, textfraser, begrepp, konstverk, animationer, ljud, musik, audiovisuella effekter och metoder för drift) ägs av och tillhör oss och våra licensgivare. 
8.2 Spelet kan innehålla vissa licensierade material och våra licensgivare kan agera för att skydda sina rättigheter i händelse av brott mot dessa villkor. Alla varumärken tillhör sina respektive ägare.

9. SEVERABILITY.

9. UPPDELNING AV AVTAL.

In the event that any provision of these Terms shall be held by a court or other tribunal of competent jurisdiction to be unenforceable, this provision will be enforced to the maximum extent permissible and the remaining parts of these Terms shall remain in full force and effect.

10.1 To the maximum extent permitted by the local law applicable in the country in which you obtain or use the Game (including Virtual Items and the Online Service), these Terms are subject to English Law. 
10.2 In the event that English Law cannot apply in the country you obtained or use the Game, local law will apply. 
10.3 The Game (and each part of it, including Virtual Items and the Online Service) is intended for use and may only be used in countries where all such use is lawful.

Purchase and use of items are subject to the Network Terms of Service and User Agreement. This online service has been sublicensed to you by Sony Interactive Entertainment America. 

As the Milestone Services and applicable laws evolve, we may – and probably will – update these Terms. When we do, we’ll inform the user of the new agreement which will supersede and replace these Terms. The user will be given an opportunity to review any new agreement we present to them and decide whether they wish to agree to the revised terms. If they accept the new agreement, they’ll be able to continue using the Milestone Services. If they don’t, they won’t be able to use the Milestone Services anymore.
