THESE TERMS ARE IN ADDITION TO THE APPLICABLE TERMS AND CONDITIONS OF ANY PLATFORM ON WHICH WE MAKE THE GAME AVAILABLE (“PLATFORM TERMS”). THE PLATFORM TERMS ARE THEREFORE DEEMED INCORPORATED INTO THESE TERMS.  
PLEASE READ THE FOLLOWING CAREFULLY BEFORE USING, DOWNLOADING, PURCHASING OR INSTALLING THE GAME (WHICH INCLUDES THE RELEVANT ONLINE SERVICE). IF YOU DO NOT AGREE WITH THESE TERMS YOU MAY NOT USE, DOWNLOAD OR INSTALL THE GAME.
PLEASE NOTE THAT THE GAME REQUIRES AN INTERNET CONNECTION AND THE AVAILABILITY OF OUR ONLINE SERVICE FOR MOST OF ITS FUNCTIONS.
YOU ARE RESPONSIBLE FOR ENSURING THAT YOU HAVE AN INTERNET CONNECTION, AND THAT THE DEVICE YOU USE HAS SUFFICIENT HARDWARE AND SOFTWARE REQUIREMENTS AND MEMORY IN ORDER TO PLAY AND STORE THE GAME AND USE THE ONLINE SERVICE.
THE GAME HAS BEEN DEVELOPED TO WORK ON THE LATEST VERSION OF STEAM, PLAYSTATION®, XBOX, NINTENDO SWITCH™, AMAZON LUNA AND EPIC GAMES STORE AT THE TIME OF ITS RELEASE. THE PLATFORM HOLDERS MAY OCCASIONALLY UPDATE THEIR SOFTWARE; WE WILL ENDEAVOR, BUT NOT BE OBLIGATED, TO UPDATE THE GAME IF NECESSARY, TO ENSURE THAT ITS FUNCTIONS AND PERFORMANCE CONTINUE WITH ANY UPDATE RELEASE. IT IS YOUR OBLIGATION TO ENSURE THAT YOU ARE USING THE LATEST COMPATIBLE PUBLIC RELEASE OF ANY OPERATING SYSTEM FOR YOUR CONSOLE OR PC.
THE GAME COMPRISES COPYRIGHT WORKS OF MILESTONE AND/OR ITS LICENSORS. THE GAME IS LICENSED, NOT SOLD.  YOUR LICENSE CONFERS NO TITLE OR OWNERSHIP IN THE GAME.  THE GAME IS SOLELY INTENDED FOR USE BY END USERS ACCORDING TO THESE TERMS. ANY USAGE, REPRODUCTION OR REDISTRIBUTION OF THE GAME NOT IN ACCORDANCE WITH THESE TERMS IS EXPRESSLY PROHIBITED.

1. LIMITED USE LICENSE.

1. LICENCIA DE USO LIMITADO.

1.1 Milestone hereby grants you limited, non-exclusive right and license to download, install and use the Game for your personal, non-commercial use only, on compatible consoles or devices that are owned by you, subject to these Terms.
1.2 These Terms, and your use of the Game, do not give you any rights of ownership over any property in the game, whether tangible or intangible (including any Track or Bike livery or customized rider/bike that you create).
1.3 This clause applies if we offer the Game through the Steam platform (“Steam”), which is hosted by Valve S.A.R.L. (in the EU) and Valve Corporation (in the US). Where applicable, you will need a Steam account to play the Game, and your use of Steam is subject to the Steam Subscriber Agreement, which you can find online here.  The Steam Subscriber Agreement changes from time to time; if it becomes inconsistent with this EULA, where conflicts arise, the Steam Subscriber Agreement takes precedence. Steam allows refunds for the Game in certain circumstances.  You can find out how on the Steam website here: Steam Refunds.
1.4 If you install or use the Game on any third party platform including without limitation the PlayStation®, Microsoft Xbox, Nintendo, Amazon Luna and Epic Games Store platforms then the terms of these platforms will all apply.
1.5 You and we acknowledge that these Terms are agreed between you and us only, and not with Apple Inc, nor any subsidiary or affiliate company of Apple Inc. You also acknowledge that we are solely responsible for the Game and the content thereof.
1.6 If you are playing on an Android device, your use of the Game may require you to have a Google account. Your access to the Game will be linked to your Google account and you are required to comply with Google policies to use the Game.

1.1 Por la presente, Milestone le otorga una licencia y el derecho limitado y no exclusivo para descargar, instalar y usar el juego únicamente para su uso personal y no comercial, solo en consolas y dispositivos compatibles que sean de su propiedad, según estos términos.
1.2 Estos términos y el uso que usted haga del juego no le otorgan ningún derecho de propiedad sobre ninguna pertenencia en el juego, ya sea tangible o intangible (lo que incluye cualquier pista o diseño de motocicleta o moto/piloto personalizado que usted cree).
1.3 Esta cláusula se aplica si ofrecemos el juego a través de la plataforma Steam (“Steam”), que hospedan Valve S.A.R.L. (en la UE) y Valve Corporation (en los EE. UU.). 2. END USER OBLIGATIONS.

2. OBLIGACIONES DEL USUARIO FINAL.

2.1 You may use the Game for your own personal, non-commercial use as described in these Terms, but you are not entitled to and may not do any of the following, except to the extent expressly permitted by these Terms:
2.1.1 sell, transfer, copy, reproduce, translate, communicate, reverse engineer, publish, stream, distribute, rent, loan, sub-license, derive source code from, modify, adapt, merge, disassemble, decompile, create derivative works based on or otherwise transfer or deal in copies or reproductions of the Game, or any part or interest in it, to other parties in any way except where the Game expressly permits you to do so by sharing Game content on social media;  
2.1.2 remove, modify or tamper with any copyright, trademark or other notice;
2.1.3 engage in any act that we deem to be in conflict with the spirit or intent of the Game and/or the Online Service, including, without limitation, using cheats, exploits, automation software, bots, hacks, mods or any unauthorized third-party software designed to modify or interfere with the Game;
2.1.4 attempt to gain unauthorized access to the Online Service, or to the computers, devices, servers, or networks connected to the Online Service by any means other than the user interface provided by us; or
2.1.5 use the Game for any unlawful or immoral purposes.   
2.2 You may not use, access or otherwise export or re-export the products except as authorized by United States law and the laws of the jurisdiction in which the Services were obtained. In particular, but without limitation, the Games may not be exported, re-exported or otherwise made available (a) into any country or region embargoed by the U.S. Government, or (b) to anyone on the U.S. Treasury Department's Specially Designated Nationals List or the U.S. Department of Commerce Denied person List or Entity List, EU consolidated sanctions list with designated persons. By using the Games, you represent and warrant that you are not located in any such country or on any such list.

2.1 Puede disponer del juego para su propio uso personal y no comercial como se describe en estos términos, pero no tiene derecho ni debe hacer ninguna de las acciones siguientes excepto en la medida en que estos términos lo permitan de forma expresa:
2.1.1 vender, transferir, copiar, reproducir, traducir, comunicar, realizar ingeniería inversa, publicar, retransmitir, distribuir, alquilar, prestar, sublicenciar, extraer código fuente, modificar, adaptar, mezclar, desensamblar, descompilar, crear obras derivadas basadas en, transferir o traficar con copias o reproducciones del juego o de cualquier parte o interés con terceros y en modo alguno, excepto cuando el juego se lo permita de forma expresa a través de la compartición de contenidos del juego en redes sociales;
2.1.2 quitar, modificar o alterar cualquier copyright, marca registrada u otro tipo de aviso;
2.1.3 participar en cualquier actuación que estimemos que entra en conflicto con el espíritu o el propósito del juego o el servicio en línea, lo que incluye, entre otras, usar trampas, exploits, software de automatización, bots, hackeos, mods o cualquier software de terceros no autorizado diseñado para modificar o interferir en el juego;
2.1.4 intentar obtener acceso no autorizado al servicio en línea o a los ordenadores, dispositivos, servidores o redes conectadas al servicio en línea por cualquier otro medio que no sea la interfaz de usuario que nosotros proporcionamos; o
2.1.5 usar el juego para cualquier propósito ilegal o inmoral.   
2.2 El usuario no podrá utilizar los productos, acceder a ellos, exportarlos o reexportarlos de cualquier otra forma, excepto donde esté autorizado por la legislación de los Estados Unidos y por las leyes de la jurisdicción en la que se obtuvieron los Servicios. En particular, como ejemplo pero sin limitarse a ello, los Juegos no pueden ser exportados, reexportados o puestos a disposición de otro modo (a) en los países o regiones que estén sometidos a embargo por el Gobierno de Estados Unidos, o (b) a personas que figuren en las listas negras de Estados Unidos, como la Specially Designated Nationals List del Departamento del Tesoro y la Denied Persons List o la Entity List del Departamento del Comercio, o que hagan parte de las personas designadas en la lista consolidada de sanciones de la Unión Europea. Al utilizar los Juegos, usted declara y garantiza que no se encuentra en ninguno de esos países y que no está incluido en ninguna de esas listas.

3. TERMINATION.

3. RESOLUCIÓN.

3.1 These Terms and the licenses granted to you by us are effective until terminated.
3.2 You may terminate these Terms at any time and for any reason by deleting and removing the Game from your console or PC.  
3.3 We may terminate these Terms if you fail to abide by them at any time and for any reason, or where we reasonably suspect that you have failed to abide by any of these Terms.  We may take action that we deem reasonable at our sole discretion against users who do not comply with these Terms. This may include banning users from using or accessing the Game and/or the Online Service. For more information about the kind of infraction you could commit, we recommend you to carefully read the entire paragraph 5.11 “User Content Rules”. Based on the type but especially on the number of reports received, Milestone reserves the right to suspend a user for the following days: one day, three days, seven days, fifteen days, one month. Once the latter is exceeded, it’s possible to incur a permanent suspension.
3.4 Milestone reserves the right to determine what conduct it considers to be in violation of, or otherwise outside the intent or spirit of, these Terms and/or the Game and/or the Online Service. However, if your action can be rectified, we shall give you reasonable opportunity to do so. 
3.5 Following termination, you will no longer be permitted to use any of the Game and you will be required to delete the Game from your console or device.
3.6 Milestone Services are no longer available in a region. Should such a circumstance occur, we will publish a communication on our website and/or in the game itself, reporting the interruption of a core feature of a game or all of the Milestone Services in a region.

3.3 Nosotros podemos resolver estos términos si usted no los acatase en cualquier momento y por cualquier razón, o cuando tengamos una sospecha razonable de que usted no acata cualquier parte de estos términos. Podemos llevar a cabo acciones que nosotros juzguemos razonables a nuestra sola discreción contra usuarios que no cumplan estos términos, lo que puede incluir la prohibición a los usuarios de utilizar o acceder al juego o al servicio en línea. 3.4 Milestone se reserva el derecho de determinar qué conducta se considera que viola o está fuera del espíritu o el propósito de estos términos, el juego o el servicio en línea. Sin embargo, si lo que usted haya hecho puede enmendarse, le daremos una oportunidad razonable para hacerlo. 
3.5 Tras la resolución, usted ya no tendrá permiso para usar el juego y se le exigirá que lo borre de su consola o dispositivo.
3.6 Los Servicios de Milestone no están más disponibles en una región. En dicha circunstancia, publicaremos un aviso en nuestro sitio web y/o en el propio juego, para comunicar la interrupción de una funcionalidad sustancial de un juego o de todos los Servicios de Milestone en una región.

4. ONLINE SERVICE.

4. SERVICIO EN LÍNEA.

4.1 Milestone may, but shall not be obliged to, provide and maintain certain online functions, online network play connectivity and interactivity, and other online features relating to the Game subject to these Terms. These shall include, by way of example, the online ‘Single Event’ and ‘Custom Championship’ game modes (“Online Service”).
4.2 We cannot guarantee that the Online Service or a particular part of the Online Service, including any User Content, will always be available. 
4.3 The Online Service is for personal use only, on an “as is” basis and all use must be in accordance with these Terms.

4.1 Milestone puede, aunque no está obligado a hacerlo, proveer y mantener cierta funcionalidad en línea, interactividad y conectividad de juego de red en línea y otras características en línea relacionadas con el juego, entre otras, los modos de juego “Prueba individual” y “Campeonato personalizado” (“Servicio en línea”), siempre sujetos a estos términos..

Age Restrictions
4.4 To be able to play, you must first accept the Milestone user agreement and confirm that you have read MIlestone's privacy and cookie policy. In order to use online functions, you must have an Internet connection and an account on the platform; it is also necessary for a person aged at least thirteen to complete the registration process.

User Rules
4.5 You also agree that you will not in any way behave in a manner which is unlawful or which gives rise to civil or criminal liability, or which might call us or the Game into disrepute. 
4.6 Where the Game allows you to share pre-determined messages with other users, we shall be entitled to remove, restrict, suspend or alter that ability for any reason at our sole and absolute discretion.  
4.7 You will cooperate fully with us to investigate any suspected unlawful, fraudulent or improper activity.
4.8 If you feel that the behavior of another user breaches these Terms, please let us know by contacting us via the Support Services with details of the potential breach and/or the user responsible. We will take reasonable steps to deal with any breach.

4.5 Está además de acuerdo en que no tendrá en ningún caso una conducta que sea ilegal, que acarree responsabilidades penales o civiles, o que pueda desprestigiarnos a nosotros o al juego. 
4.6 Cuando el juego le permita compartir mensajes predeterminados con otros usuarios, tendremos derecho a borrar, restringir, suspender o alterar esa capacidad por cualquier razón, a nuestra sola y absoluta discreción.
4.7 Usted cooperará totalmente con nosotros cuando investiguemos cualquier sospecha de actividad ilegal, fraudulenta o inapropiada.
4.8 Si cree que el comportamiento de otro usuario infringe estos términos, le rogamos que nos lo haga saber contactando con nosotros a través del servicio al cliente, con detalles sobre la potencial infracción o el usuario responsable. Tomaremos los pasos razonables para lidiar con cualquier infracción.

Please note: 
Where the Online Service is available, you use it at entirely your own risk. It is a known risk of internet usage that people are not necessarily who they say they are. People may provide information or behave in a way that is unreliable, misleading, unlawful or illegal. Milestone has no way of telling if statements made by other users of the Game and/or the Online Service are true. This is a decision that can only be made by you, and we recommend exercising caution. By playing the Game and using the Online Service and its parts, you accept that this is the case and accept the associated risk. Users must take particular care in relation to the disclosure of their own personal information.

5. CREATION AND CUSTOMISATION OF USER CONTENT.

5.1 the definition of “User Contents” (singular “User Content”) includes any content created by the user through any editor functions which might be included in the Game including, but not limited to, tracks, liveries, helmets, decals, pilot stickers, numbers, suits and vehicles, and which are uploaded, made available or sent by the user to the Online Service, for their own purposes and/or for other users to utilise in the Game.

5.1 El Juego puede incluir una función de editor que permite al usuario o a otros usuarios del Juego generar Contenidos de Usuario (tal y como se define en la cláusula 5.1.1 siguiente) para utilizar en el mismo Juego, para cargar, compartir, poner a disposición o publicar en el Servicio en línea, para sí mismo y/o para otros jugadores. Además, el usuario puede enviar comunicaciones a nosotros o a terceros y/o proporcionar los Contenidos de Usuario y/o la información para su uso dentro del Juego o de otro género por parte nuestra o de terceros.

For the purposes of these Conditions:
5.1.1 The definition of “User Contents” (singular “User Content”) includes any content created by the user through any editor functions which might be included in the Game including, but not limited to, tracks, liveries, helmets, decals, pilot stickers, numbers, suits and vehicles, and which are uploaded, made available or sent by the user to the Online Service, for their own purposes and/or for other users to utilise in the Game.
5.1.2 "Distribute" means to use, sell, market, promote, sub-license to end-users, distribute or otherwise make available to third parties.
5.2 In relation to the SOLE use of the Game and Online Service (where this service exists) and pursuant to these Terms and Conditions, the user may (and is granted a limited, non-exclusive licence and the right to) use the software that is part of the Game and Online Service to communicate with other users of the Game via the Online Service, and to publish User Content and transmit, communicate and make it available. In this way, the user hereby grants us an unlimited, transferable, sub-licensable, royalty-free, perpetual, irrevocable, non-exclusive licence to use and make available any such User Content in connection with the Game, in any manner or media. 
5.3 We are committed to marketing and publishing the Game and providing its associated entertainment services in the form of the Online Service. Additionally, we engage in the transmission, storage, retrieval, hosting, formatting or translation of User Content without selection or alteration of the communication content, for which we merely serve as a conduit.
5.4 By installing and using the Game, the user agrees and confirms that we are not responsible for reviewing any User Content made available, as we will not be required to exercise any control or give any judgement in relation to the content or published material, or its substance. For the purposes of avoiding any misunderstandings, the opinions expressed in any User Content represent the opinions of the individual authors, and not those of Milestone, unless otherwise specified by us. In particular, but without limitations to the above, we cannot be held responsible, and decline any liability for comments, opinions or observations expressed in any User Content. We shall be entitled to remove, restrict, suspend or alter any User Content (and the ability to share or create User Content, including any Track or Bike Livery) for any reason at our sole and absolute discretion.
5.5 We have the right to remove, limit, suspend or alter any User Content (and the ability to share or create User Content) for any reason, at our sole and absolute discretion.
5.6 The user accepts that we can use, publish, amend, vary and adapt any User Content which the user should make available, publish or transmit to the Game and/or the Online Service for any reason, at our sole discretion. 
5.7 To the extent that User Content derives from the Game or material supplied by us, the user hereby assigns us all intellectual property rights subsisting in the User Content which are owned by them, including all intellectual property rights in any User Content created by them.
5.8 We do not supply any guarantee, and shall not issue any declaration regarding the accuracy, evaluation or validity of the information and material contained in the User Content or Online Service; nor can we be held responsible for any losses or damage caused by the use of said information or material.
5.9 If the user discovers any User Content which they feel contravenes these Terms and Conditions, we would ask them to notify us via support Services and submit details of the User Content concerned..

 5.1.1 La definición de «Contenidos de Usuario» (en singular «Contenido de Usuario») incluye cualquier contenido generado por el usuario utilizando las funciones del editor que puedan incluirse en el Juego, incluyendo pero no limitándose a circuitos, libreas, cascos, pegatinas, adhesivos de piloto, números, monos y vehículos, y cargado, puesto a disposición o enviado por el usuario al Servicio en línea, para sí mismo y/o para que otros usuarios lo utilicen en el Juego.
5.1.2 «Distribuir» significa utilizar, vender, comercializar, promocionar, conceder en sublicencia a usuarios finales, distribuir o, de otra manera, poner a disposición de terceros..
5.2 En relación con el SOLO uso del Juego y del Servicio en línea (cuando dicho servicio exista) y de conformidad con los presentes Términos y Condiciones, el usuario podrá (y se le concede una licencia limitada y no exclusiva y el derecho para) utilizar el software que forma parte del Juego y del Servicio en línea para comunicarse con otros usuarios del Juego utilizando el Servicio en línea y para publicar, transmitir, comunicar y poner a disposición los Contenidos de Usuario. De este modo, por la presente, el usuario nos concede un derecho ilimitado, transferible, concedido en sublicencia, libre de derechos, perpetuo, irrevocable, no exclusivo y la licencia para utilizar y poner a disposición estos Contenidos de Usuario en relación con el Juego en cualquier forma o soporte.
5.3 Nos comprometemos en la actividad de marketing y en la publicación del Juego y en el suministro de los servicios de entretenimiento relacionados en forma de Servicio en línea. Además, nos dedicamos a la transmisión, almacenamiento, recuperación, alojamiento, formateo o traducción de los Contenidos de Usuario sin seleccionar ni alterar el contenido de la comunicación para la que actuamos meramente como conducto. 
5.4 Al instalar y utilizar el Juego, el usuario acepta y confirma que no somos responsables de revisar ningún Contenido de Usuario que se ponga a disposición sobre la base de que no estaremos obligados a ejercer ningún control o juicio sobre el contenido o material publicado o sobre su contenido.  Para evitar cualquier duda, las opiniones expresadas en cualquier Contenido de Usuario representan las opiniones de cada uno de los autores y no las de Milestone, a menos que indiquemos lo contrario. En particular, pero sin limitarnos a lo anterior, no somos responsables y declinamos toda responsabilidad por comentarios, opiniones u observaciones expresados en cualquier Contenido de Usuario. 
5.5 Tenemos derecho a eliminar, restringir, suspender o alterar cualquier Contenido de Usuario (y la capacidad de compartir o generar Contenidos de Usuario) por cualquier motivo, a nuestra entera y absoluta discreción.
5.6 El Usuario acepta que podamos utilizar, publicar, modificar, variar y adaptar cualquier Contenido de Usuario que el mismo usuario ponga a disposición o publique o transmita al Juego y/o al Servicio en línea por cualquier motivo, a nuestra discreción.
5.7 En la medida en que el Contenido de Usuario se derive del Juego o de material proporcionado por nosotros, con la presente, el usuario nos cede todos los Derechos de Propiedad Intelectual que subsistan en el Contenido de Usuario de su propiedad, incluidos todos los Derechos de Propiedad Intelectual de cualquier Contenido de Usuario que haya generado.
5.8 No damos garantía y no hacemos declaración alguna en relación con la exactitud, valor o validez de la información y del material contenidos en el Contenido de Usuario o en el Servicio en línea y no seremos responsables de ninguna pérdida o daño causado por el uso de dicha información o material.

User Rules of User Content (applicable where the Online Service exists)
5.10 The user agrees and undertakes to have the right to make available, or publish or transmit, their User Contents to the Game, and to grant us the rights specified in clause 5.8. The user shall not make available, nor indeed publish or transmit to the Game, any statement, material or other User Content, or use the Online Service or Game in any way which:
5.10.1 is abusive, seditious, pornographic, aggressive, homophobic, defamatory, false, instigates hatred, is discriminatory, obscene, offensive, provocative, sexist or racist;
5.10.2 molests or intimidates any person, or inhibits or prevents the ability of other users to communicate or read conversations (including the use of any macros/SPAM for the general base of gamers, or a single individual, in order to interrupt the chat);
5.10.3 breaches any Intellectual Property Right or other rights of any person (on condition that the User Content is derived from the Game or the material supplied by us);
5.10.4 gives rise to any behaviour involving exploitation through, but not limited to, third-party programmes, bots, scripts, viruses or other means reasonably prohibited by us on an as-and-when basis, or that exploits bugs, unforeseen errors or undocumented features to access restricted parts of the game, or otherwise engages in activities that we reasonably deem are contrary to the "spirit" of the Game;
5.10.5 encourages any breach of these Terms and Conditions, or the terms of service of a third-party service provider;
5.10.6 are Illegal, malicious, misleading (including impersonation), discriminatory, or give rise to civil or criminal liability, or which might jeopardise the reputation of Milestone, the Online Service or the Game;
5.10.7 breaches the intellectual property or other rights of third parties, or facilitates or encourages such a breach, or involves the distribution of personal information of any gamer (other than one’s own, such as private messages);
5.10.8 is technically damaging, such as introducing computer viruses, worms, logic bombs or other harmful software or data, or otherwise attempting or effectively modifying or interfering with the Game, or overloading or disrupting any computer or server used by the Game;
5.10.9 may be considered commercial or marketing communication;
5.10.10 promotes illegal or unlawful activities, including but not limited to solicitation, gambling or the sale of prescription medication;
5.10.11 is directed at individuals under the age of 18 or those seeking or attempting to arrange to meet a person under the age of 18;
5.10.12 contains any restricted material, including but not limited to passwords, medical information or confidential information of any person; 
5.10.13 constitutes, in our reasonable opinion, misuse of the Game or an attempt to gain unauthorised access to the Game or its parts, or the accounts of other users or networks, or their console or device; or
5.10.14 solicits, invites, encourages, supports, incites or provokes - in whole or in part - any of the above.

5.10 El usuario acepta y se compromete a tener derecho, a poner a disposición o publicar o transmitir al Juego sus Contenidos de Usuario y a concedernos los derechos establecidos en la cláusula 5.8 y no pondrá a disposición o publicará o transmitirá al Juego ninguna declaración, material u otro Contenido de Usuario ni utilizará el Servicio en línea o el Juego de ninguna manera:
5.10.1 que sea abusiva, sediciosa, pornográfica, agresiva, homófoba, difamatoria, falsa, que incite al odio, discriminatoria, obscena, ofensiva, incendiaria, sexista o racista;
5.10.2 que acose o intimide a cualquier persona o inhiba o impida la capacidad de otros usuarios para comunicarse o leer conversaciones (esto incluye el uso de cualquier macro/SPAM para la base general de jugadores o de una sola persona para interrumpir el chat);
5.10.3 que infrinja cualquier Derecho de Propiedad Intelectual u otros derechos de cualquier persona (siempre que el Contenido de Usuario se derive del Juego o del material proporcionado por nosotros);
5.10.4 que dé lugar a un comportamiento explotador, por medio de, pero sin limitarse a, programas de terceros, bots, scripts, virus u otros medios que estén razonablemente prohibidos por nosotros en cada momento o que aprovechen bugs, errores imprevistos o funcionalidades que no hayan sido documentadas, para acceder a partes restringidas del Juego o que constituyan de otro modo actividades que razonablemente consideremos contrarias al «espíritu» del Juego;
5.10.5 que fomente cualquier incumplimiento de estos Términos o Condiciones o de los términos de servicio de un proveedor de servicios externo;
5.10.6 que sea ilegal, malintencionado, engañoso (incluida la suplantación), discriminatorio o dé lugar a responsabilidad civil o penal o que ponga en peligro la reputación de Milestone, el Servicio en línea o el Juego;
5.10.7 que infrinja la propiedad intelectual u otros derechos de terceros o facilite o fomente dicha infracción o implique la distribución de información personal de cualquier jugador (diferente de las suyas propias, como mensaje privado);
5.10.8 que sea técnicamente perjudicial, como la introducción de virus informáticos, gusanos, bombas lógicas u otro software o datos malintencionados, o intente modificar o interfiera de cualquier otro modo en el Juego o sobrecargue o interrumpa cualquier ordenador o servidor utilizado por el Juego;
5.10.9 que pueda considerarse una comunicación comercial o de marketing;
5.10.10 que promueva actividades ilegales o ilícitas, incluidas a modo de ejemplo pero sin limitarse a la captación de clientes, los juegos de azar o la venta de medicamentos sujetos a prescripción médica;
5.10.11 que se dirija a personas menores de 18 años o que busquen o intenten concertar una cita con una persona menor de 18 años;
5.10.12 que contenga cualquier material restringido, incluso, pero sin limitarse a contraseñas, información médica o información confidencial de cualquier persona; 
5.10.13 que constituya, en nuestra opinión razonable, un uso indebido del Juego o un intento de obtener acceso no autorizado al Juego o a partes del mismo o a las cuentas de otros usuarios o redes o a sus consolas o dispositivos; o
5.10.14 que solicite, invite, fomente, apoye, incite o provoque todo o parte de lo anterior.

User Contents which can be created using the Editor (applicable where the Online Service exists)
5.11 According to Clause 5.8 above, in relation to any User Content created and uploaded by the user on the Online Service, the user shall grant us the right and licence, on a non-exclusive basis, which shall be deemed free of royalties, perpetual and irrevocable, on a worldwide basis, for:
5.11.1 distributing their User Content via the Online Service;;
5.11.2 using and making available screenshots and video sequences of their User Content, and creating and making available (also through third-party services) any such further promotional and marketing materials at our discretion, for the purposes of promoting the Track or Livery of the motorcycle they have created, the Game and/or the Online Service on all media;
5.11.3 distributing the demo or free versions of the User Content with an end to reviewing, promoting and marketing solely the customised User Content; and; 
5.11.4 using any commercial brand or commercial name of which the user is aware, or their User Content in relation to the distribution of the User Content below. 	
5.12 The user guarantees and declares the following to us (on condition that the User Content derives from the Game, or the material supplied by Milestone):
5.12.1 that they are the owner or licence holder of the User Content, and all the Intellectual Property Rights pertaining to it;
5.12.2 that they have the full power to enter into these Conditions and the Terms herein, and are entitled to grant the rights, licences and assignments contained in them, and that they hold all licences and assignments required to do so;
5.13 The user shall indemnify (agree to compensate) and hold Milestone harmless against all actions, claims, proceedings, costs and damages (including any damages or settlements paid by us on the advice of our legal advisors to settle or resolve any claim), and all legal fees or other expenses arising from any breach of the above warranties, or these Terms and Conditions.

Contenidos de Usuario generados mediante Editor (aplicables cuando exista el Servicio en línea)
5.11 Sobre la base de la Cláusula 5.8 anterior, en relación con cualquier Contenido de Usuario generado y cargado por el usuario en el Servicio en línea, el usuario nos concede un derecho y una licencia no exclusivos, libres de regalías, perpetuos, irrevocables y en todo el mundo para:
5.11.1 distribuir su Contenido de Usuario a través del Servicio en línea;
5.11.2 utilizar y poner a disposición capturas de pantalla y secuencias de vídeo de su Contenido de Usuario y generar y poner a disposición (incluso a través de servicios de terceros) otros materiales promocionales y de marketing que consideremos adecuados para promocionar la Trazado o la Librea de la motocicleta que haya generado, el Juego y/o el Servicio Online en todos los soportes;
5.11.3 distribuir la demostración o las versiones gratuitas del Contenido de Usuario con el único fin de revisar, promocionar y comercializar únicamente el Contenido de Usuario personalizado; y 
5.11.4 utilizar cualquier marca o nombre comercial conocido por el usuario o su Contenido de Usuario en relación con la distribución del Contenido de Usuario a la que se hace referencia a continuación.
5.12 El usuario nos garantiza y declara que (siempre que el Contenido de Usuario se derive del Juego o del material proporcionado por Milestone):
5.12.1 que es el propietario o el licenciatario del Contenido de Usuario y de todos los Derechos de Propiedad Intelectual contenidos en el mismo;
5.12.2 que tiene plenos poderes para suscribir los presentes Términos y Condiciones y tiene derecho a conceder los derechos, licencias y prestaciones allí contenidos y dispone de todas las licencias y prestaciones necesarias para ello;
5.13 El usuario indemnizará (aceptará indemnizar) y mantendrá indemne a Milestone frente a todas las acciones, reclamaciones, procedimientos, costes y daños (incluidos los daños o compensaciones pagados por nosotros por consejo de nuestros asesores jurídicos para entablar o resolver cualquier reclamación) y todos los gastos legales o de otro tipo o los derivados de cualquier incumplimiento de las garantías anteriores o de estos Términos y Condiciones.

6. WARRANTY AND LIMITATION OF LIABILITY.

6.1 We warrant that we have used and will use reasonable efforts to ensure that:
6.1.1 we are entitled to grant the rights and licenses granted herewith;
6.1.2 the Game will be of satisfactory quality;
6.1.3 we have used and will use reasonable efforts to ensure that the Game and/or the Online Service will be available for six (6) months from the date on which you purchase the Game; and
6.1.4 the Online Service, when made available by us, shall be of satisfactory quality, as described and fit for purpose.
6.2 To the maximum extent permitted by law, and save as expressly provided in these Terms, we give no warranty in connection with the Online Service and exclude liability for any loss or damage of any kind, regardless of how it arises, including without limitation any direct, indirect, punitive or consequential loss, regardless of whether it arises from any issue you notify to us, and we shall have no liability to pay any money by way of compensation, including without limitation all liability in relation to:
6.2.1 the availability of the Online Service;
6.2.2 any incorrect or inaccurate information on the Online Service and all errors, interruptions to or delays in updating the Online Service;
6.2.3 the infringement by any person of any Intellectual Property Rights of any third party caused by their use of the Online Service;
6.2.4 any amount or kind of loss or damage due to viruses or other malicious software that may infect a user's computer equipment, software, data or other property caused by persons accessing, using or downloading the Online Service; 
6.2.5 all representations, warranties, conditions and other terms which but for this notice would have effect.
6.3 Except as specifically provided in these terms, and to the maximum extent permitted by law:
6.3.1 The Game is provided on an "as is" and “as available” basis without warranty or guarantee of any kind (express or implied) other than those set out in these terms;
6.3.2 We only accept liability for direct loss as a result of our breach of the warranties in Clause 6.1 above;
6.3.3 Our and our licensors’ maximum liability will be limited to €100;
6.3.4 We and our licensors will not in any event be liable in any way for any consequential or indirect loss or damage (save to the extent that damage to your console, PC or other digital content which you own is caused by the Game as a result of our failure to use reasonable care and skill in which case you may be entitled to compensation or we may be obliged to repair your device);
6.3.5 We do not warrant or guarantee that the operation of the Game and/or the Online Service will be uninterrupted or error-free, or that errors can or will be corrected, or that the Game or the Online Service are free of viruses or other harmful components;
6.3.6 You install and use the Game at your own risk.

6.1 Garantizamos que nos esforzamos y nos esforzaremos de forma razonable para asegurar que:
6.1.1 tenemos permiso para conceder los derechos y las licencias otorgados en lo sucesivo;
6.1.2 el juego tendrá una calidad satisfactoria;

6.2 En la medida en que lo permita la ley y salvo que se estipule de forma expresa en estos términos, no damos ninguna garantía en relación al servicio en línea y excluimos toda responsabilidad por cualquier pérdida, daño o perjuicio que puedan derivarse (lo que incluye, entre otros, cualquier pérdida directa, indirecta, disciplinaria o consecuente, derive o no de cualquier problema que usted nos notifique), y no tendremos en ningún caso la responsabilidad de pagar ninguna cantidad de dinero como compensación (lo que incluye, entre otras, cualquier responsabilidad) en relación con::
6.2.1 la disponibilidad del servicio en línea;
6.2.2 cualquier información incorrecta o inexacta sobre el servicio en línea y todos los errores, interrupciones o demoras en la actualización del servicio en línea;
6.2.3 la infracción por parte de cualquier persona de cualesquiera derechos de propiedad intelectual de cualquier tercero causada por el uso del servicio en línea;
6.2.4 cualquier cantidad o tipo de pérdida o daño debidos a virus u otro software malicioso que pueda infectar software, datos o equipo informático de un usuario u otra propiedad, y causados por las personas que acceden, usan o descargan el servicio en línea; 
6.2.5 todas las responsabilidades, garantías, condiciones y otros términos que se aplicarían si no hubiera sido por este aviso.
6.3 Excepto que se estipule de forma explícita en estos términos y en la medida en que lo permita la ley:
6.3.1 el juego se ofrece “tal cual” y “según está disponible”, sin ninguna garantía de ningún tipo (expresa o implícita) aparte de las establecidas en estos términos;
6.3.2 solo aceptamos responsabilidades por pérdidas directas como resultado de nuestro incumplimiento de las garantías en la cláusula 6.1 anterior;
6.3.3 nuestra responsabilidad máxima y la de nuestros licenciantes estará limitada a 100 €;
6.3.4 nosotros y nuestros licenciantes no seremos en ningún caso responsables en modo alguno de cualquier daño o pérdida indirectos o consecuentes (salvo si se da el caso de que el daño a su consola, PC u otro contenido digital que usted posea sea causado por el juego como resultado de un error nuestro al no ejercer el cuidado y la habilidad razonables, en cuyo caso usted tiene derecho a una compensación o estaremos obligados a reparar su dispositivo);
6.3.5 no garantizamos que el funcionamiento del juego o del servicio en línea sea interrumpido, esté libre de errores, que esos errores puedan o vayan a ser corregidos, o que el juego o el servicio en línea estén libres de virus u otros componentes dañinos;
6.3.6 usted instala y usa el juego por su cuenta y riesgo.

7. INDEMNITY AND REMEDIES.

7. INDEMNIZACIONES Y COMPENSACIONES.

7.1 You hereby indemnify (agree to compensate), defend and hold harmless Milestone and our affiliates, officers, directors, owners, licensors, service providers, partners, contractors, employees, agents and licensees (collectively, the "Indemnified Parties") from and against any and all any liabilities, claims, costs and expenses (including legal expenses and attorney fees) incurred by the Indemnified Parties in connection with any claim arising out of any breach by you of these Terms, or claims arising directly or indirectly from your use or misuse of the Game (which includes Virtual Items and the Online Service, where existing), and any User Content; and/or any use other than that set out in these Terms. You shall fully cooperate with us in the defense of any such claim and we reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you.
7.2 You further agree that the subject matter of these Terms is of a unique character with special value, and that we would suffer irreparable damage if these Terms were not specifically enforced; as a result you agree that we shall be entitled, without bond, other security, or proof of damages, to appropriate equitable remedies (including injunctive relief) with respect to breaches of these Terms, in addition to other remedies as we may otherwise have available under applicable laws.
7.3 Our licensors shall be third-party beneficiaries under these Terms and shall be entitled to enforce its provisions and enjoy the benefits of its protections.

7.1 Por la presente, usted defenderá y eximirá a Milestone y nuestros afiliados, directores, propietarios, licenciantes, proveedores de servicios, socios, empleados, agentes y licenciatarios (colectivamente, las “partes indemnizadas”) de y contra cualquier responsabilidad, reclamación, coste y gasto (lo que incluye los gastos legales y los honorarios de los abogados) sufridos por las partes indemnizadas en relación con cualquier demanda que se derive de cualquier infracción de estos términos en la que usted incurra, o con demandas que se deriven de forma directa o indirecta del uso correcto o incorrecto que usted haga del juego (lo que incluye a los artículos virtuales y el servicio en línea, si existe), cualquier contenido generado por el usuario o cualquier uso que no sea de acuerdo con estos términos, e indemnizará (está de acuerdo en compensar) por ello a Milestone. Usted cooperará por completo con nosotros en la defensa de cualquier reclamación de esa naturaleza y nos reservamos el derecho, por cuenta propia, de asumir la defensa y control exclusivos de cualquier asunto que le obligue a usted a proporcionar una indemnización.
7.2 Además, usted está de acuerdo en que el asunto del que son sujetos estos términos es de un carácter único con un valor especial y que el daño que se nos produciría sería irreparable si no se impusiera el cumplimiento de estos términos y, por lo tanto, usted está de acuerdo en que nosotros tendremos derecho, sin fianza, otra seguridad o prueba de los daños a compensaciones justas y apropiadas (lo que incluye medidas cautelares) en lo que respecta a infracciones de estos términos, además de otras compensaciones que estén a nuestra disposición bajo las leyes aplicables.
7.3 Nuestros licenciantes serán terceros beneficiarios bajo estos términos y tendrán derecho expreso a imponer sus provisiones y disfrutar de los beneficios de sus protecciones.

8. OWNERSHIP.

8.1 All right, title, interest and ownership rights in the Game and any copyright, design right, database right, patents and any rights to inventions, know-how, trade and business names, trade secrets and trade marks (whether registered or unregistered) and any related applications and other intellectual property rights (“Intellectual Property Rights”), in or connected with the Game and each part thereof (including, by way of example only, any titles, code, themes, objects, characters, stories, catchphrases, concepts, artworks, animations, sounds, music, audio-visual effects and methods of operation) are owned by, belong to and vest in us or our licensors. 
8.2 The Game may contain certain licensed materials and our licensors may act to protect their rights in the event of any breach of these Terms. All trademarks are the property of their respective owners.

In the event that any provision of these Terms shall be held by a court or other tribunal of competent jurisdiction to be unenforceable, this provision will be enforced to the maximum extent permissible and the remaining parts of these Terms shall remain in full force and effect.

10.2 In the event that English Law cannot apply in the country you obtained or use the Game, local law will apply. 
10.3 The Game (and each part of it, including Virtual Items and the Online Service) is intended for use and may only be used in countries where all such use is lawful.

As the Milestone Services and applicable laws evolve, we may – and probably will – update these Terms. When we do, we’ll inform the user of the new agreement which will supersede and replace these Terms. The user will be given an opportunity to review any new agreement we present to them and decide whether they wish to agree to the revised terms. If they accept the new agreement, they’ll be able to continue using the Milestone Services. If they don’t, they won’t be able to use the Milestone Services anymore.
