                MILESTONE 비디오게임 이용 약관<br>MILESTONE S.r.L.이 발행<br><br>최근 수정 날짜:2023년 12월 15일<br>본 약관은 개인정보 보호정책의 일부를 구성하며 <a class="bb_link" href="https://steamcommunity.com/linkfilter/?u=https%3A%2F%2Fmilestone.it%2Flegal-note-and-privacy%2F%EC%97%90%EC%84%9C" target="_blank" rel=" noopener">https://milestone.it/legal-note-and-privacy/에서</a> 확인할 수 있는 개인정보 보호정책과 함께 읽어야 합니다.<br><br>소개<br>Milestone의 비디오게임(이하 '게임')은 Milestone S.r.L.(이하 'Milestone'/'당사'/'저희')이 제공합니다. 회사의 등록 주소는 Via Olona 2, 20123 Milan, Italy입니다. 당사는 이탈리아에 등록된 회사(회사 번호: 10851750967)입니다.<br><br>본 약관에 대한 질문이나 의견이 있는 경우 게임 고객 지원 페이지<a class="bb_link" href="https://steamcommunity.com/linkfilter/?u=http%3A%2F%2F%28https%3A%2F%2Fmilestone.it%2Fit%2Fcontact%2F%29" target="_blank" rel=" noopener">(https://milestone.it/it/contact/)</a><br>(이하 '고객 지원 서비스')를 통해 문의하십시오.<br><br>본 이용 약관(이하 '약관')은 게임의 모든 이용에 적용되고 효력을 발휘합니다. 본 약관은 게임을 이용할 수 있는 플랫폼의 적용 가능한 모든 약관(이하 '플랫폼 약관')에 추가되어 적용됩니다. 따라서 플랫폼 약관은 본 약관에 통합된 것으로 간주됩니다.  <br><br>게임(관련 온라인 서비스 포함)을 이용, 다운로드, 구매 또는 설치하기 전에 다음 내용을 주의 깊게 읽으십시오. 본 약관에 동의하지 않는 경우 게임을 이용, 다운로드 또는 설치할 수 없습니다.<br><br>대부분의 게임 기능을 사용하기 위해서는 인터넷에 연결되어 있어야 하며 온라인 서비스를 사용할 수 있어야 합니다.<br><br>귀하에게는 인터넷에 연결되어 있고 사용하는 장치가 게임을 플레이하고 저장하기 위해 충분한 하드웨어 및 소프트웨어 요구 사항 및 메모리를 보유하고 있고 온라인 서비스를 사용할 수 있는지 확인할 책임이 있습니다.<br><br>게임은 릴리스 당시 STEAM, PLAYSTATION®, XBOX, NINTENDO SWITCH™, AMAZON LUNA 및 EPIC GAMES STORE의 최신 버전에서 작동하도록 개발되었습니다. 플랫폼 소유자는 수시로 소프트웨어를 업데이트할 수 있으며, 업데이트 릴리스와 함께 기능 및 성능이 계속 유지되는지 확인해야 하는 경우 게임을 업데이트하기 위해 최선을 다할 것입니다. 콘솔 또는 PC용 운영체제의 호환 가능한 최신 공개 릴리스를 사용하고 있는지 확인하는 것은 귀하의 의무입니다.<br><br>게임은 MILESTONE 및/또는 라이선스 제공자가 저작권을 소유한 저작물로 구성됩니다. 게임은 판매되지 않으며 사용권이 부여됩니다.  귀하의 라이선스는 게임에 대한 소유권을 인정하지 않습니다.  게임은 본 약관에 따라 최종 사용자만 사용할 수 있습니다. 본 약관에 따르지 않는 게임의 사용, 복제 또는 재배포는 명시적으로 금지됩니다.<br><br>1.제한된 사용 라이선스<br>1.1 Milestone은 본 약관에 따라 귀하가 소유한 호환되는 콘솔 또는 장치에서만, 그리고 귀하의 개인적, 비상업적 용도로만 게임을 다운로드, 설치 및 사용할 수 있는 제한적이고 비독점적인 권한 및 라이선스를 귀하에게 부여합니다.<br>1.2본 약관 및 귀하의 게임 사용은 유형 또는 무형 여부(모든 트랙 또는 바이크 외관 저작물 또는 귀하가 만든 맞춤 라이더/바이크)에 관계없이 게임 내 자산에 대한 소유권을 귀하에게 부여하지 않습니다.<br>1.3본 조항은 Valve S.A.R.L.(EU) 및 Valve Corporation(미국)에서 호스팅하는 Steam 플랫폼(이하 'Steam')을 통해 게임을 제공하는 경우에 적용됩니다. 이는, 게임을 플레이하려면 Steam 계정이 필요하며 Steam 사용에는 Steam 구독 계약이 적용됨을 의미하며 이는 온라인으로 여기에서 확인할 수 있습니다.  Steam 구독 계약은 수시로 변경되며 본 EULA와 일치하지 않거나 상충되는 경우 Steam 구독 계약이 우선합니다. Steam에서는 경우에 따라 게임에 대한 환불을 받을 수 있습니다.  Steam 웹사이트의 'Steam 환불'에서 환불 방법을 확인할 수 있습니다.<br>1.4 PlayStation®, Microsoft Xbox, Nintendo, Amazon Luna 및 Epic Games Store를 포함하되 이에 국한되지 않는 제3자 플랫폼에서 게임을 설치하거나 사용하는 경우 이러한 플랫폼의 약관이 모두 적용됩니다.<br>1.5 귀하와 당사는 본 약관이 Apple Inc. 및 Apple Inc.의 자회사 또는 계열사가 아닌 귀하와 당사 간에서만 체결된다는 것을 인정합니다. 또한 귀하는 당사가 게임 및 그 콘텐츠에 대해 전적으로 책임이 있음을 인정합니다.<br>1.6 Android 장치에서 플레이하는 경우 게임을 사용하려면 Google 계정이 필요할 수 있습니다. 게임에 대한 귀하의 액세스는 귀하의 Google 계정에 연결되며 게임을 사용하려면 Google 정책을 준수해야 합니다.  <br><br>2. 최종 사용자의 의무<br>2.1 귀하는 본 약관에 설명된대로 개인적, 비상업적 용도로 게임을 사용할 수 있지만 본 약관에서 명시적으로 허용하는 경우를 제외하고는 다음을 수행할 자격이 없으며 수행해서는 안됩니다.<br>2.1.1 판매, 양도, 복사, 복제, 번역, 전달, 역설계, 게시, 스트리밍, 배포, 대여, 임대, 재라이선싱, 소스 코드 추출 및 파생, 수정, 개조, 병합, 분해, 디컴파일링, 또는게임이 소셜 미디어에서 게임의 콘텐츠를 공유하는 것을 명시적으로 허용하는 경우를 제외하고 어떤 방식으로든 게임의 복사본이나 복제품 또는 그 일부 또는 이권을 다른 당사자에게 양도하거나 거래하는 행위,  <br>2.1.2 저작권, 상표 또는 기타 고지를 제거, 수정 또는 변조하는 행위,<br>2.1.3속임수, 침해 기법, 자동화 소프트웨어, 봇, 해킹, 모드 또는 게임을 수정하거나 방해하기 위해 설계된 승인되지 않은 제3자 소프트웨어를 사용하는 행위를 포함하되 이에 국한되지 않는 게임 및/또는 온라인 서비스의 정신 또는 의도와 충돌하는 것으로 간주되는 모든 행위,<br>2.1.4 당사가 제공하는 사용자 인터페이스 이외의 수단으로 온라인 서비스 또는 온라인 서비스에 연결된 컴퓨터, 장치, 서버 또는 네트워크에 대한 무단 액세스를 시도하는 행위, 또는<br>2.1.5불법적이거나 부도덕한 목적으로 게임을 사용하는 행위.   <br>2.2미국 법률 및 서비스를 획득한 관할권의 법률에 의해 승인된 경우를 제외하고 귀하는 제품을 사용, 액세스 또는 수출하거나 재수출할 수 없습니다. 특히(다음을 포함하되 이에 국한되지 않음), 게임은 (a) 미국 정부가 금수 조치를 취한 국가 또는 지역으로 또는 (b) 미국 재무부의 특별 지정 국적자 목록 또는 또는 미국 상무부 거부자 목록 또는 법인 목록, EU 통합 제재 목록과 지정된 자에 포함된 누구에게도 수출, 재수출 또는 기타 방식으로 제공될 수 없습니다. 게임을 사용함으로써 귀하는 귀하가 해당 국가 또는 해당 목록에 있지 않음을 진술하고 이를 보증합니다.<br><br>3. 약관의 해지<br>3.1 본 약관과 당사가 귀하에게 부여한 라이선스는 해지될 때까지 유효합니다.<br>3.2 귀하는 언제든지 어떤 이유로든 귀하의 콘솔 또는 PC에서 게임을 삭제 및 제거하여 본 약관을 해지할 수 있습니다.<br>3.3당사는귀하가언제든지어떤이유로든귀하가본약관을준수하지않거나귀하가본약관을준수하지않았다고합리적으로의심되는경우본약관을해지할수있습니다. 당사는본약관을준수하지않는사용자에대해단독재량으로합리적이라고판단하는조치를취할수있습니다. 여기에는사용자의게임및/또는 온라인 서비스에 대한 액세스를 금지하는 것이 포함될 수 있습니다.사용자들의 규정위반에 대한 주요 정보를 숙지하도록 5조 11항에 가재된 “콘텐츠 사용자에 대한 규정” 전체를 주의깊게 읽어주시기 바랍니다.  위반종류 및 특히 누적경고숫자에 따라 밀레스톤은 사용자에게 일정한 날짜동안 사용중지를 결정할 권한을 갖습니다: 1일, 3일, 7일, 15일, 한달. 한달 이상의 중지경고가 될 경우 영구중단처리가 될 수 있습니다.<br>3.4 Milestone은 본 약관 및/또는 게임 및/또는 온라인 서비스의 의도 또는 정신을 위반하거나 그 의도를 벗어난 것으로 간주되는 행위를 정의할 권리를 보유합니다. 하지만, 귀하의 잘못을 수정할 수 있는 경우 당사는 귀하에게 그렇게 할 수 있는 합리적인 기회를 제공할 것입니다. <br>3.5 해지 후 귀하는 더 이상 게임을 사용할 수 없으며 콘솔 또는 장치에서 게임을 삭제하도록 요청받게 됩니다.<br><br>4. 온라인 서비스<br>4.1 Milestone은 '단일 이벤트' 및 '커스텀 챔피언십'  게임 모드를 포함하되 이에 국한되지 않는 게임과 관련된 기타 특정 온라인 기능, 온라인 네트워크 플레이 연결 및 상호작용 및 온라인 기능(이하 '온라인 서비스')을 제공하고 유지할 수 있지만 본 약관에 의거하여 이에 대한 의무를 보유하지 않습니다.<br>4.2 당사는 사용자 콘텐츠를 포함하여 온라인 서비스 또는 온라인 서비스의 특정 부분(있는 경우)이 항상 사용 가능하다고 보장하지 않습니다. <br>4.3 온라인 서비스는 '있는 그대로' 개인적인 용도로만 사용되며 모든 사용은 본 약관을 따라야 합니다.<br><br>연령 제한<br>4.4. 게임을 하기 위해서는 밀레스톤 사용자와 동의를 체결해야 하며 밀레스톤 쿠키와 개인정보정책을 허용해야 합니다.  온라인 상의 기능에 접속하려면 인터넷에 연결되어야 하며 플랫폼 계정이 필요합니다. 관련 계정등록은 13세 이상이 되어야 할 수 있습니다.<br><br>사용자 규칙<br>4.5 또한 귀하는 불법적이거나 민사 또는 형사 책임을 유발하거나 당사 또는 게임에 대한 반감을 불러 일으킬 수 있는 방식으로 행동하지 않을 것에 동의합니다. <br>4.6 게임에서 사전 결정된 메시지를 다른 사용자와 공유할 수 있는 경우 당사는 단독 재량에 따라 어떠한 이유로 든 해당 기능을 제거, 제한, 일시 중지 또는 변경할 수 있습니다.  <br>4.7 귀하는 의심되는 불법, 사기 또는 부적절한 활동을 조사하기 위해 당사와 전적으로 협력할 것에 동의합니다.<br>4.8 다른 사용자의 행동이 본 약관을 위반한다고 생각되면 고객 지원 서비스를 통해 당사에 연락하여 잠재적인 위반 사항 및/또는 책임 있는 사용자에 대한 세부 정보를 알려주십시오. 당사는 모든 위반 사항을 처리하기 위해 합리적인 조치를 취할 것입니다. <br><br>참고: <br>귀하는 전적으로 귀하의 책임 하에 온라인 서비스(있는 경우)를 사용합니다. 사람들이 인터넷을 사용하며 자신의 신원을 속이는 것은 일반적으로 알려진 위험입니다. 사람들은 신뢰할 수 없거나 오해의 소지가 있거나 불법적인 방식으로 정보를 제공하거나 행동할 수 있습니다. Milestone은 게임 및/또는 온라인 서비스의 다른 사용자의 진술이 사실인지 여부를 알 수 없습니다. 이는 귀하만이 내릴 수있는 결정이며 일정한 정도의 주의를 기울이는 것을 권장합니다. 게임을 플레이하고 온라인 서비스 및 그 일부분을 사용함으로써 귀하는 이것이 사실임을 인정하고 그와 관련된 위험을 수락하는 것으로 간주됩니다. 사용자는 자신의 개인 정보를 공개하는 데 특히 주의해야 합니다.<br><br>5. 사용자 콘텐츠의 생성 및 개인화<br>5.1.게임에는 사용자나 게임의 타 사용자가 자신 및/또는 다른 플레이어를 위하여 게임 자체에서 사용할 사용자 콘텐츠(아래 5.1.1항에 정의됨)를 생성하고 온라인 서비스에 업로드, 공유, 제공 또는 전송할 수 있는 편집 기능이 포함될 수 있습니다. 또한 사용자는 당사 또는 제3자에게 통신을 전송하거나, 게임 내에서 사용하기 위해 사용자 콘텐츠 및/또는 정보를 당사 또는 제3자에게 제공할 수 있습니다.<br><br>본 약관의 목적상.<br>5.1.1 사용자 콘텐츠’(단수 ‘사용자 콘텐트’)의 정의에는 게임에 포함될 수 있는 사용자가 편집기 기능을 통해 생성한 모든 콘텐츠가 포함됩니다. 일부 예를 들자면, 사용자 및/또는 다른 사용자가 게임 내에서 사용할 수 있도록 사용자가 온라인 서비스에 업로드하거나 제공하거나 전송한 추적, 장부, 파일럿의 헬멧, 스티커, 번호, 복장 및 차량입니다.<br>5.1.2 '배포’란 사용, 판매, 마케팅, 판촉, 최종 사용자에 대한 재라이선스 부여, 배포 또는 기타 방식으로 제3자가 사용할 수 있도록 제공하는 것을 뜻합니다.<br>5.2 오로지 게임 및 온라인 서비스(이 서비스가 존재하는 경우)의 사용과 관련해서만 본 이용 약관에 따라 사용자는 게임과 온라인 서비스의 일부인 소프트웨어를 사용할 수 있으며(이에 대해 제한적이고 비독점적인 라이선스와 권리가 부여됨), 온라인 서비스를 이용하여 게임의 타 사용자와 통신하고 사용자 콘텐츠를 게시, 전송, 통신 및 제공할 수 있습니다. 이러한 방식으로 사용자는 본 문서를 통하여, 당사가 게임과 관련하여 어떤 방식으로든 해당 사용자 콘텐츠를 사용하고 제공할 수 있는 무제한적이고, 양도 가능하고, 재라이선스 가능하고, 로열티가 없고, 영구적이고, 취소 불가능하고, 비독점적인 권리와 라이선스를 당사에 부여합니다.<br>5.3 당사는 게임을 마케팅 및 런칭하고 온라인 서비스 형태로 관련 엔터테인먼트 서비스를 제공합니다. 이외에도 당사는 사용자 콘텐츠를 전송, 저장, 검색, 호스팅, 포맷팅 또는 번역합니다. 이때 당사는 단지 전달자의 역할을 하며, 콘텐츠의 내용을 선택하거나 변경하지 않습니다. <br>5.4 게임을 설치하고 사용함으로써 사용자는 게시된 콘텐츠나 자료 또는 그 내용에 대해 당사가 통제나 판단을 행사할 필요가 없다는 사실에 기반하여, 사용자가 제공한 사용자 콘텐츠를 당사가 검토할 책임이 없다는 점에 동의하고 확인하게 됩니다. 오해의 소지를 없애기 위해, 사용자 콘텐츠에 표현된 의견은 당사가 별도로 명시하지 않는 한 Milestone의 의견이 아닌 개별 작성자의 의견임을 분명히 하는 바입니다. 특히, 상기 내용에 국한되지 않고, 당사는 사용자 콘텐츠에 표현된 댓글, 의견 또는 피드백에 대해 책임을 지지 않으며 이에 대한 어떠한 의무도 일절 거부합니다. <br>5.5 당사는 당사의 단독적이고 절대적인 재량에 따라 어떠한 이유로든 사용자 콘텐츠(및 사용자 콘텐츠를 공유하거나 생성할 수 있는 능력)를 제거, 제한, 일시 중지 또는 변경할 수 있는 권리를 갖습니다.<br>5.6 사용자는 자신이 게임 및/또는 온라인 서비스에 제공 또는 게시 또는 전송하는 사용자 콘텐츠를 당사가 당사의 재량에 따라 어떠한 목적으로든 사용, 게시, 수정, 변경 및 조정할 수 있다는 사실에 동의합니다.<br>5.7 사용자 콘텐츠가 당사에 의해 제공되는 게임이나 내용에서 파생된 경우, 본 문서를 통하여, 사용자는 자신이 생성한 사용자 콘텐츠 사용자의 모든 지적 재산권을 포함하여 자신이 소유한 사용자 콘텐츠에 존재하는 모든 지적 재산권을 당사에 부여합니다.<br>5.8 당사는 사용자 콘텐츠 또는 온라인 서비스에 포함된 정보 및 내용의 정확성, 현재성 또는 유효성에 대해 어떠한 보증이나 진술도 제공하지 않으며, 해당 정보 또는 자료의 사용으로 인해 발생하는 만약의 손실이나 손해에 대해 책임을 지지 않습니다. <br>5.9 사용자가 본 이용 약관과 일치하지 않는다고 판단되는 사용자 콘텐츠를 발견한 경우, 사용자 콘텐츠의 세부 정보와 함께 지원 서비스를 통해 당사에 연락하여 이를 당사에 신고해 주시기 바랍니다.<br><br>사용자 콘텐츠의 규칙(온라인 서비스가 존재하는 경우 적용 가능함)<br>5.10 사용자는 자신의 사용자 콘텐츠를 게임에 제공하거나 게시하거나 전송하고 5.8항에 명시된 권리를 당사에 부여할 권리가 있으며, 다음과 같은 어떠한 진술, 내용 또는 기타 사용자 콘텐츠도 게임에 제공하거나 게시하거나 전송할 수 없고, 다음의 어떤 방식으로든 온라인 서비스나 게임을 사용하지 않음에 동의합니다.<br>5.10.1 모욕적, 선동적, 외설적, 공격적, 동성애 혐오적이거나, 명예를 훼손하거나, 허위이거나, 증오를 유발하거나, 차별적이거나, 퇴폐적이거나, 공격적이거나, 선동적이거나, 성차별적이거나 인종차별적인 내용,<br>5.10.2 타인을 괴롭히거나 위협하거나, 타 사용자들이 대화를 나누고 읽을 수 있는 가능성을 억제 또는 방해하는 행위(이에는 채팅의 방해 목적으로 일반 플레이어나 개인에게 매크로/스팸을 사용하는 것도 포함됨),<br>5.10.3 지적 재산권 또는 타인의 기타 권리를 침해하는 행위(사용자 콘텐츠가 당사가 제공하는 게임이나 자료에서 파생된 경우),<br>5.10.4 제3자 프로그램, 봇, 스크립트, 바이러스 또는 당사가 때때로 합리적으로 금지하는 기타 수단(이는 일부 사례에 지나지 않음)을 통해 착취를 유발하거나, 게임의 제한된 부분에 접근하기 위해 또는 게임의 ‘정신’에 위배된다고 합리적으로 판단되는 활동을 하기 위해 버그, 예상치 못한 오류를 악용하는 행위,<br>5.10.5 본 이용 약관 또는 제3자 서비스 제공업체의 서비스 약관을 위반하도록 조장하는 행위,<br>5.10.6 불법, 악의적, 오해를 유발하거나(사칭 포함) 차별적이거나, 민형사상 책임을 초래하거나, Milestone, 온라인 서비스 또는 게임의 명성을 위험에 처하게 할 수 있는 행위,<br>5.10.7 제3자의 지적 재산권 또는 기타 권리를 침해하거나, 그러한 행위를 돕거나 조장하거나, 플레이어의 개인 정보(개인 메시지와 같이, 자신의 정보가 아닌 정보)를 배포하는 행위  ,<br>5.10.8 컴퓨터 바이러스, 웜, 논리 폭탄 또는 기타 유해한 소프트웨어나 데이터의 도입이나 기타 방식으로 기술적인 손상을 유발하거나, 게임을 실제로 수정 또는 방해를 시도하거나 게임에 사용되는 컴퓨터나 서버를 과부하 또는 중단시키는 행위,<br>5.10.9 상업적 광고 또는 마케팅 커뮤니케이션으로 간주될 수 있는 행위  ,<br>5.10.10 권유, 도박 또는 의사의 처방전이 필요한 약품 판매(이는 일부 사례에 지나지 않음), 불법적이거나 부적절한 활동을 조장하는 행위,<br>5.10.11 18세 미만의 미성년자 또는 이들과의 만남을 시도하는 자를 대상으로 하는 콘텐츠,<br>5.10.12 개인의 비밀번호, 의료 정보 또는 기밀 정보(이는 일부 사례에 지나지 않음)가 포함된 콘텐츠, <br>5.10.13 당사의 합리적인 통보에 따라 게임의 오용, 게임이나 그 일부, 또는 타 사용자나 네트워크의 계정, 콘솔이나 장치에 대한 무단 액세스를 시도하는 행위  <br>5.10.14 상기 내용의 전부 또는 일부를 권장, 초대, 격려, 지원, 선동 또는 유발하는 행위.<br><br>편집 기능으로 생성 가능한 사용자 콘텐츠(온라인 서비스가 존재하는 경우에 해당)<br>5.11 상기 5.8항에 따라 사용자가 생성하여 온라인 서비스에 업로드하는 모든 사용자 콘텐츠와 관련하여, 사용자 본인은 다음의 내용에 대하여 당사에 비독점적이고, 로열티가 없고, 영구적이고, 취소 불가능한 전 세계적 권리와 라이선스를 부여합니다.<br>5.11.1 온라인 서비스를 통해 사용자 콘텐츠를 배포합니다,<br>5.11.2 사용자 콘텐츠의 스크린샷과 비디오 시퀀스를 사용 및 제공하고, 사용자가 생성한 트랙 또는 오토바이 상징, 그리고 모든 미디어 상의 게임 및/ 또는 온라인 서비스를 장려하기 위하여, 당사의 재량에 따라 그러한 기타 홍보나 마케팅 콘텐츠를 생성 및 제공합니다(제 3자 서비스를 통하는 것 포함),<br>5.11.3 개인맞춤화된 사용자 콘텐츠만을 검토, 홍보 및 마케팅할 목적으로 사용자 콘텐츠의 데모 또는 무료 버전을 유포합니다, <br>5.11.4 하기의 사용자 콘텐츠 배포와 관련하여 사용자가 알고 있는 상표나 상호 또는 사용자 본인의 사용자 콘텐츠를 사용합니다.	<br>5.12 사용자는 당사에 다음 사항을 보증하고 진술합니다(사용자 콘텐츠가 Milestone이 제공한 게임이나 자료에서 파생된 경우).<br>5.12.1사용자는 사용자 콘텐츠 및 그에 포함된 모든 지적 재산권의 소유자 또는 라이선스 수혜자입니다.<br>5.12.2 사용자는 본 조건 및 약관을 체결할 전적인 권한을 소유하며, 이에 포함된 권리, 라이선스 및 양도를 부여할 권리를 소유하며, 그리 하는 데에 필요한 모든 라이선스 및 양도를 보유하고 있습니다.<br>5.13 사용자는 손해보상하고(손해보상에 동의함), 모든 조치, 불만, 절차, 비용 및 손해(불만을 처리하거나 해결하기 위하여 당사의 법률 자문가의 조언에 따라 당사가 지불한 손해 또는 보상 포함) 및, 모든 법정 수수료 또는 기타                 <br>3.3 We may terminate these Terms if you fail to abide by them at any time and for any reason, or where we reasonably suspect that you have failed to abide by any of these Terms.  We may take action that we deem reasonable at our sole discretion against users who do not comply with these Terms. This may include banning users from using or accessing the Game and/or the Online Service. For more information about the kind of infraction you could commit, we recommend you to carefully read the entire paragraph 5.11 “User Content Rules”. Based on the type but especially on the number of reports received, Milestone reserves the right to suspend a user for the following days: one day, three days, seven days, fifteen days, one month. Once the latter is exceeded, it’s possible to incur a permanent suspension.<br>3.4 Milestone reserves the right to determine what conduct it considers to be in violation of, or otherwise outside the intent or spirit of, these Terms and/or the Game and/or the Online Service. However, if your action can be rectified, we shall give you reasonable opportunity to do so. <br>3.5 Following termination, you will no longer be permitted to use any of the Game and you will be required to delete the Game from your console or device.<br>3.6 Milestone Services are no longer available in a region. Should such a circumstance occur, we will publish a communication on our website and/or in the game itself, reporting the interruption of a core feature of a game or all of the Milestone Services in a region.<br><br>4. ONLINE SERVICE.<br><br>4.1 Milestone may, but shall not be obliged to, provide and maintain certain online functions, online network play connectivity and interactivity, and other online features relating to the Game subject to these Terms. These shall include, by way of example, the online ‘Single Event’ and ‘Custom Championship’ game modes (“Online Service”).<br>4.2 We cannot guarantee that the Online Service or a particular part of the Online Service, including any User Content, will always be available. <br>4.3 The Online Service is for personal use only, on an “as is” basis and all use must be in accordance with these Terms.<br><br>Age Restrictions<br>4.4 To be able to play, you must first accept the Milestone user agreement and confirm that you have read MIlestone's privacy and cookie policy. In order to use online functions, you must have an Internet connection and an account on the platform; it is also necessary for a person aged at least thirteen to complete the registration process.<br><br>User Rules<br>4.5 You also agree that you will not in any way behave in a manner which is unlawful or which gives rise to civil or criminal liability, or which might call us or the Game into disrepute. <br>4.6 Where the Game allows you to share pre-determined messages with other users, we shall be entitled to remove, restrict, suspend or alter that ability for any reason at our sole and absolute discretion.  <br>4.7 You will cooperate fully with us to investigate any suspected unlawful, fraudulent or improper activity.<br>4.8 If you feel that the behavior of another user breaches these Terms, please let us know by contacting us via the Support Services with details of the potential breach and/or the user responsible. We will take reasonable steps to deal with any breach. <br><br>Please note: <br>Where the Online Service is available, you use it at entirely your own risk. It is a known risk of internet usage that people are not necessarily who they say they are. People may provide information or behave in a way that is unreliable, misleading, unlawful or illegal. Milestone has no way of telling if statements made by other users of the Game and/or the Online Service are true. This is a decision that can only be made by you, and we recommend exercising caution. By playing the Game and using the Online Service and its parts, you accept that this is the case and accept the associated risk. Users must take particular care in relation to the disclosure of their own personal information.<br><br>5. CREATION AND CUSTOMISATION OF USER CONTENT.<br><br>5.1 the definition of “User Contents” (singular “User Content”) includes any content created by the user through any editor functions which might be included in the Game including, but not limited to, tracks, liveries, helmets, decals, pilot stickers, numbers, suits and vehicles, and which are uploaded, made available or sent by the user to the Online Service, for their own purposes and/or for other users to utilise in the Game.<br><br>For the purposes of these Conditions:<br>5.1.1 The definition of “User Contents” (singular “User Content”) includes any content created by the user through any editor functions which might be included in the Game including, but not limited to, tracks, liveries, helmets, decals, pilot stickers, numbers, suits and vehicles, and which are uploaded, made available or sent by the user to the Online Service, for their own purposes and/or for other users to utilise in the Game.<br>5.1.2 "Distribute" means to use, sell, market, promote, sub-license to end-users, distribute or otherwise make available to third parties.<br>5.2 In relation to the SOLE use of the Game and Online Service (where this service exists) and pursuant to these Terms and Conditions, the user may (and is granted a limited, non-exclusive licence and the right to) use the software that is part of the Game and Online Service to communicate with other users of the Game via the Online Service, and to publish User Content and transmit, communicate and make it available. In this way, the user hereby grants us an unlimited, transferable, sub-licensable, royalty-free, perpetual, irrevocable, non-exclusive licence to use and make available any such User Content in connection with the Game, in any manner or media. <br>5.3 We are committed to marketing and publishing the Game and providing its associated entertainment services in the form of the Online Service. Additionally, we engage in the transmission, storage, retrieval, hosting, formatting or translation of User Content without selection or alteration of the communication content, for which we merely serve as a conduit.<br>5.4 By installing and using the Game, the user agrees and confirms that we are not responsible for reviewing any User Content made available, as we will not be required to exercise any control or give any judgement in relation to the content or published material, or its substance. For the purposes of avoiding any misunderstandings, the opinions expressed in any User Content represent the opinions of the individual authors, and not those of Milestone, unless otherwise specified by us. In particular, but without limitations to the above, we cannot be held responsible, and decline any liability for comments, opinions or observations expressed in any User Content. We shall be entitled to remove, restrict, suspend or alter any User Content (and the ability to share or create User Content, including any Track or Bike Livery) for any reason at our sole and absolute discretion.<br>5.5 We have the right to remove, limit, suspend or alter any User Content (and the ability to share or create User Content) for any reason, at our sole and absolute discretion.<br>5.6 The user accepts that we can use, publish, amend, vary and adapt any User Content which the user should make available, publish or transmit to the Game and/or the Online Service for any reason, at our sole discretion. <br>5.7 To the extent that User Content derives from the Game or material supplied by us, the user hereby assigns us all intellectual property rights subsisting in the User Content which are owned by them, including all intellectual property rights in any User Content created by them.<br>5.8 We do not supply any guarantee, and shall not issue any declaration regarding the accuracy, evaluation or validity of the information and material contained in the User Content or Online Service; nor can we be held responsible for any losses or damage caused by the use of said information or material.<br>5.9 If the user discovers any User Content which they feel contravenes these Terms and Conditions, we would ask them to notify us via support Services and submit details of the User Content concerned..<br><br>User Rules of User Content (applicable where the Online Service exists)<br>5.10 The user agrees and undertakes to have the right to make available, or publish or transmit, their User Contents to the Game, and to grant us the rights specified in clause 5.8. The user shall not make available, nor indeed publish or transmit to the Game, any statement, material or other User Content, or use the Online Service or Game in any way which:<br>5.10.1 is abusive, seditious, pornographic, aggressive, homophobic, defamatory, false, instigates hatred, is discriminatory, obscene, offensive, provocative, sexist or racist;<br>5.10.2 molests or intimidates any person, or inhibits or prevents the ability of other users to communicate or read conversations (including the use of any macros/SPAM for the general base of gamers, or a single individual, in order to interrupt the chat);<br>5.10.3 breaches any Intellectual Property Right or other rights of any person (on condition that the User Content is derived from the Game or the material supplied by us);<br>5.10.4 gives rise to any behaviour involving exploitation through, but not limited to, third-party programmes, bots, scripts, viruses or other means reasonably prohibited by us on an as-and-when basis, or that exploits bugs, unforeseen errors or undocumented features to access restricted parts of the game, or otherwise engages in activities that we reasonably deem are contrary to the "spirit" of the Game;<br>5.10.5 encourages any breach of these Terms and Conditions, or the terms of service of a third-party service provider;<br>5.10.6 are Illegal, malicious, misleading (including impersonation), discriminatory, or give rise to civil or criminal liability, or which might jeopardise the reputation of Milestone, the Online Service or the Game;<br>5.10.7 breaches the intellectual property or other rights of third parties, or facilitates or encourages such a breach, or involves the distribution of personal information of any gamer (other than one’s own, such as private messages);<br>5.10.8 is technically damaging, such as introducing computer viruses, worms, logic bombs or other harmful software or data, or otherwise attempting or effectively modifying or interfering with the Game, or overloading or disrupting any computer or server used by the Game;<br>5.10.9 may be considered commercial or marketing communication;<br>5.10.10 promotes illegal or unlawful activities, including but not limited to solicitation, gambling or the sale of prescription medication;<br>5.10.11 is directed at individuals under the age of 18 or those seeking or attempting to arrange to meet a person under the age of 18;<br>5.10.12 contains any restricted material, including but not limited to passwords, medical information or confidential information of any person; <br>5.10.13 constitutes, in our reasonable opinion, misuse of the Game or an attempt to gain unauthorised access to the Game or its parts, or the accounts of other users or networks, or their console or device; or<br>5.10.14 solicits, invites, encourages, supports, incites or provokes - in whole or in part - any of the above.<br><br>User Contents which can be created using the Editor (applicable where the Online Service exists)<br>5.11 According to Clause 5.8 above, in relation to any User Content created and uploaded by the user on the Online Service, the user shall grant us the right and licence, on a non-exclusive basis, which shall be deemed free of royalties, perpetual and irrevocable, on a worldwide basis, for:<br>5.11.1 distributing their User Content via the Online Service;;<br>5.11.2 using and making available screenshots and video sequences of their User Content, and creating and making available (also through third-party services) any such further promotional and marketing materials at our discretion, for the purposes of promoting the Track or Livery of the motorcycle they have created, the Game and/or the Online Service on all media;<br>5.11.3 distributing the demo or free versions of the User Content with an end to reviewing, promoting and marketing solely the customised User Content; and; <br>5.11.4 using any commercial brand or commercial name of which the user is aware, or their User Content in relation to the distribution of the User Content below. 	<br>5.12 The user guarantees and declares the following to us (on condition that the User Content derives from the Game, or the material supplied by Milestone):<br>5.12.1 that they are the owner or licence holder of the User Content, and all the Intellectual Property Rights pertaining to it;<br>5.12.2 that they have the full power to enter into these Conditions and the Terms herein, and are entitled to grant the rights, licences and assignments contained in them, and that they hold all licences and assignments required to do so;<br>5.13 The user shall indemnify (agree to compensate) and hold Milestone harmless against all actions, claims, proceedings, costs and damages (including any damages or settlements paid by us on the advice of our legal advisors to settle or resolve any claim), and all legal fees or other expenses arising from any breach of the above warranties, or these Terms and Conditions.<br><br>6. WARRANTY AND LIMITATION OF LIABILITY.<br><br>6.1 We warrant that we have used and will use reasonable efforts to ensure that:<br>6.1.1 we are entitled to grant the rights and licenses granted herewith;<br>6.1.2 the Game will be of satisfactory quality;<br>6.1.3 we have used and will use reasonable efforts to ensure that the Game and/or the Online Service will be available for six (6) months from the date on which you purchase the Game; and<br>6.1.4 the Online Service, when made available by us, shall be of satisfactory quality, as described and fit for purpose.<br>6.2 To the maximum extent permitted by law, and save as expressly provided in these Terms, we give no warranty in connection with the Online Service and exclude liability for any loss or damage of any kind, regardless of how it arises, including without limitation any direct, indirect, punitive or consequential loss, regardless of whether it arises from any issue you notify to us, and we shall have no liability to pay any money by way of compensation, including without limitation all liability in relation to:<br>6.2.1 the availability of the Online Service;<br>6.2.2 any incorrect or inaccurate information on the Online Service and all errors, interruptions to or delays in updating the Online Service;<br>6.2.3 the infringement by any person of any Intellectual Property Rights of any third party caused by their use of the Online Service;<br>6.2.4 any amount or kind of loss or damage due to viruses or other malicious software that may infect a user's computer equipment, software, data or other property caused by persons accessing, using or downloading the Online Service; <br>6.2.5 all representations, warranties, conditions and other terms which but for this notice would have effect.<br>6.3 Except as specifically provided in these terms, and to the maximum extent permitted by law:<br>6.3.1 The Game is provided on an "as is" and “as available” basis without warranty or guarantee of any kind (express or implied) other than those set out in these terms;<br>6.3.2 We only accept liability for direct loss as a result of our breach of the warranties in Clause 6.1 above;<br>6.3.3 Our and our licensors’ maximum liability will be limited to €100;<br>6.3.4 We and our licensors will not in any event be liable in any way for any consequential or indirect loss or damage (save to the extent that damage to your console, PC or other digital content which you own is caused by the Game as a result of our failure to use reasonable care and skill in which case you may be entitled to compensation or we may be obliged to repair your device);<br>6.3.5 We do not warrant or guarantee that the operation of the Game and/or the Online Service will be uninterrupted or error-free, or that errors can or will be corrected, or that the Game or the Online Service are free of viruses or other harmful components;<br>6.3.6 You install and use the Game at your own risk.<br><br>7. INDEMNITY AND REMEDIES. <br><br>7.1 You hereby indemnify (agree to compensate), defend and hold harmless Milestone and our affiliates, officers, directors, owners, licensors, service providers, partners, contractors, employees, agents and licensees (collectively, the "Indemnified Parties") from and against any and all any liabilities, claims, costs and expenses (including legal expenses and attorney fees) incurred by the Indemnified Parties in connection with any claim arising out of any breach by you of these Terms, or claims arising directly or indirectly from your use or misuse of the Game (which includes Virtual Items and the Online Service, where existing), and any User Content; and/or any use other than that set out in these Terms. You shall fully cooperate with us in the defense of any such claim and we reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you.<br>7.2 You further agree that the subject matter of these Terms is of a unique character with special value, and that we would suffer irreparable damage if these Terms were not specifically enforced; as a result you agree that we shall be entitled, without bond, other security, or proof of damages, to appropriate equitable remedies (including injunctive relief) with respect to breaches of these Terms, in addition to other remedies as we may otherwise have available under applicable laws.<br>7.3 Our licensors shall be third-party beneficiaries under these Terms and shall be entitled to enforce its provisions and enjoy the benefits of its protections.<br><br>8. OWNERSHIP. <br><br>8.1 All right, title, interest and ownership rights in the Game and any copyright, design right, database right, patents and any rights to inventions, know-how, trade and business names, trade secrets and trade marks (whether registered or unregistered) and any related applications and other intellectual property rights (“Intellectual Property Rights”), in or connected with the Game and each part thereof (including, by way of example only, any titles, code, themes, objects, characters, stories, catchphrases, concepts, artworks, animations, sounds, music, audio-visual effects and methods of operation) are owned by, belong to and vest in us or our licensors. <br>8.2 The Game may contain certain licensed materials and our licensors may act to protect their rights in the event of any breach of these Terms. All trademarks are the property of their respective owners.<br><br>9. SEVERABILITY.<br><br>In the event that any provision of these Terms shall be held by a court or other tribunal of competent jurisdiction to be unenforceable, this provision will be enforced to the maximum extent permissible and the remaining parts of these Terms shall remain in full force and effect. <br><br>10.
