I TITOLARI DELLE PIATTAFORME POSSONO AGGIORNARE IL PROPRIO SOFTWARE DI TANTO IN TANTO E SI IMPEGNERANNO, MA NON SARANNO OBBLIGATI, AD AGGIORNARE IL GIOCO SE NECESSARIO AL FINE DI GARANTIRE CHE LA SUA FUNZIONALITÀ E LE SUE PRESTAZIONI CONTINUINO IN EVENTUALI SUCCESSIVI AGGIORNAMENTI. È OBBLIGO DELL’UTENTE GARANTIRE DI UTILIZZARE L’ULTIMA VERSIONE COMPATIBILE DI QUALSIASI SISTEMA OPERATIVO PER LA SUA CONSOLE O IL SUO PC.<br>IL GIOCO COMPRENDE LE OPERE DI COPYRIGHT DI MILESTONE E/O DEI SUOI CONCESSORI DI LICENZA. IL GIOCO VIENE CONCESSO IN LICENZA, NON VENDUTO. LA LICENZA DELL’UTENTE NON CONFERISCE ALCUN TITOLO O PROPRIETÀ QUANTO AL GIOCO. IL GIOCO DEVE ESSERE USATO SOLO DA PARTE DI UTENTI FINALI SECONDO I PRESENTI TERMINI E LE PRESENTI CONDIZIONI. QUALSIASI UTILIZZO, RIPRODUZIONE O RIDISTRIBUZIONE DEL GIOCO NON CONFORME AI PRESENTI TERMINI E ALLE PRESENTI CONDIZIONI È ESPRESSAMENTE PROIBITO.<br><br>1. LICENZA D’USO LIMITATA.<br><br>1.1 	Milestone concede all’utente un diritto limitato e non esclusivo e la licenza di scaricare, installare e utilizzare il gioco per uso personale e non commerciale solo su console o dispositivi compatibili di proprietà dell’utente, soggetti ai presenti Termini e alle presenti Condizioni.<br>1.2 I presenti Termini Livrea della motoe le presenti Condizioni e l’uso del Gioco da parte dell’utente non conferiscono all’utente alcun diritto di proprietà su alcuna proprietà del gioco, tangibile o intangibile (fra cui qualsiasi Tracciato o Livrea della moto o pilota/moto personalizzata creata dall’utente).<br>1.3 La presente clausola si applica se offriamo il Gioco attraverso la piattaforma Steam (“Steam”), gestita da Valve S.A.R.L. (nell’UE) e da Valve Corporation (negli Stati Uniti d’America). In tal caso, ciò significa che l’utente necessita di un account Steam per usufruire del Gioco e che l’uso di Steam è soggetto al Contratto di sottoscrizione a Steam, consultabile online qui. Il Contratto di sottoscrizione a Steam è soggetto a cambiamenti, e qualora diventi incoerente con il presente EULA, in caso di conflitti, ha la precedenza. In alcuni casi, Steam consente all’utente di ottenere un rimborso per il gioco. L’utente può scoprirne le modalità sul sito di Steam qui: Rimborsi di Steam.<br>1.4 Se l’utente installa o utilizza il Gioco su una piattaforma di terze parti, comprese, a titolo esemplificativo, le piattaforme PlayStation®, Xbox di Microsoft, Nintendo, Amazon Luna ed Epic Games Store verranno applicate le condizioni di queste piattaforme.<br>1.5 Noi e l’utente riconosciamo che i presenti Termini e le presenti Condizioni sono stipulati solo tra l’utente e noi, e non con Apple Inc., né alcuna società controllata o affiliata di Apple Inc. L’utente riconosce anche che siamo gli unici responsabili del Gioco e del suo contenuto.<br>1.6 Se l’utente gioca su un dispositivo Android, l’utilizzo del gioco potrebbe richiedere l’utilizzo di un account Google. L’accesso dell’utente al gioco sarà collegato al suo account Google e gli verrà richiesto di rispettare le norme di Google per utilizzare il gioco.<br><br>2. OBBLIGHI DELL’UTENTE FINALE<br><br>2.1 L’utente può utilizzare il gioco per uso personale e non commerciale come descritto nei presenti Termini e nelle presenti Condizioni, ma non ha diritto e non deve intraprendere nessuna delle seguenti azioni se non nei limiti espressamente consentiti dai presenti Termini e dalle presenti Condizioni<br>2.1.1 vendere, trasferire, copiare, riprodurre, tradurre, comunicare, decodificare, pubblicare, trasmettere, distribuire, affittare, prestare, concedere in sub-licenza, derivare il codice sorgente, modificare, adattare, unire, disassemblare, decompilare, creare opere derivate basate su o trasferire o gestire in altro modo copie o riproduzioni del Gioco o di qualsiasi sua parte o interesse ad altre parti, ad eccezione del luogo in cui il Gioco consenta espressamente di farlo attraverso la condivisione di contenuti del Gioco sui social media;<br>2.1.2 rimuovere, modificare o manomettere qualsiasi copyright, marchio di fabbrica o altra notifica;<br>2.1.3 impegnarsi in qualsiasi atto che riteniamo sia in conflitto con lo spirito o l’intento del Gioco e/o del Servizio Online, inclusi, senza limitazioni, l’utilizzo di trucchi, exploit, software di automazione, bot, hack, mod o qualsiasi software di terze parti non autorizzato progettato per modificare o interferire con il Gioco;<br>2.1.4 tentare di ottenere l’accesso non autorizzato al Servizio Online o a computer, dispositivi, server o reti collegati al servizio online con qualsiasi mezzo diverso dall’interfaccia utente fornita da noi; o<br>2.1.5 utilizzare il gioco per scopi illegali o immorali.<br>2.2 All’utente non è consentito usare i prodotti, accedere agli stessi, né esportarli o ri-esportarli in altro modo, salvo ove ciò sia autorizzato dalla legge statunitense e dalle leggi della giurisdizione in cui sono stati ottenuti i Servizi. In particolare, a titolo meramente esemplificativo e non esaustivo, i Giochi non possono essere esportati, ri-esportati o resi altrimenti disponibili (a) in Paesi o regioni soggetti a embargo da parte del Governo degli Stati Uniti, ovvero (b) a soggetti inseriti nelle liste nere statunitensi, come la Specially Designated Nationals List del Ministero del Tesoro e la Denied persons List o la Entity List del ministero del Commercio, ovvero che figurano tra i soggetti designati nell’elenco consolidato delle sanzioni dell'UE. Utilizzando i Giochi, l’utente dichiara e garantisce di non trovarsi in alcuno di tali Paesi e di non essere incluso in alcuna di tali liste.<br><br>3. RISOLUZIONE.<br><br>3.1 I presenti Termini e le presenti Condizioni e le licenze concesse all’utente da noi sono efficaci fino alla loro risoluzione.<br>3.2 L’utente può risolvere i presenti Termini e le presenti Condizioni in qualsiasi momento e per qualsiasi motivo eliminando e rimuovendo il Gioco dalla propria console o dal proprio PC.<br>3.3 Possiamo risolvere i presenti Termini e le presenti Condizioni in caso di inosservanza da parte dell’utente in qualsiasi momento e per qualsiasi ragione o laddove si sospetti ragionevolmente che l’utente non abbia rispettato qualcuno dei presenti Termini e qualcuna della presenti Condizioni. Possiamo adottare i provvedimenti che riteniamo ragionevoli a nostra esclusiva discrezione nei confronti degli utenti che non rispettano i presenti Termini e le presenti Condizioni, il che può contemplare il divieto imposto agli utenti di utilizzare o accedere al Gioco e/o al Servizio Online. Per maggiori informazioni su quali infrazioni potreste commettere, vi raccomandiamo di leggere attentamente l'intero paragrafo 5.11 "Regole del Contenuto utente". In base alla tipologia ma soprattutto al numero di segnalazioni ricevute, Milestone si riserva il diritto di sospendere l'utente per un numero di giorni variabile: un giorno, tre giorni, sette giorni, quindici giorni, un mese. Superato quest'ultimo limite, è possibile incorrere nella sospensione permanente.<br>3.4 Milestone riserva il diritto di determinare quale condotta ritiene essere in violazione di o esulare, in altro modo, dall’intento o dallo spirito dei presenti Termini e dalle presenti Condizioni e/o dal Gioco e/o dal Servizio Online. Tuttavia, se la condotta dell’utente può essere rettificata, gli concederemo una ragionevole opportunità per farlo.<br>3.5 Dopo la risoluzione, all’utente non sarà più consentito utilizzare nessuno dei Giochi e gli verrà richiesto di rimuovere il Gioco dalla sua console o dal suo dispositivo.<br>3.6 I Servizi Milestone non sono più disponibili in una regione. Qualora si verificasse una simile circostanza, sarà nostra premura pubblicare una comunicazione sul nostro sito web e/o nel gioco stesso, per segnalare l’interruzione di una funzionalità sostanziale di un gioco o di tutti i Servizi Milestone in una regione.<br><br><br>4. SERVIZIO ONLINE.<br><br>4.1 Milestone può, ma non è obbligata a, fornire e mantenere determinate funzionalità online, connettività di gioco in rete online e interattività e altre funzionalità online relative al Gioco incluse, senza limitazioni, le modalità di gioco online “Evento singolo” e “Campionato personalizzato” (“Servizio Online“) soggette ai presenti Termini e alle presenti Condizioni.<br>4.2 Non possiamo garantire che il Servizio Online o una sua parte specifica, incluso qualsiasi contenuto utente, se esistente, sarà sempre disponibile.<br>4.3 Il Servizio Online è esclusivamente per uso personale, su base “così com’è” e ogni utilizzo deve essere conforme ai presenti Termini e alle presenti Condizioni.<br><br>Limitazioni d’età<br>4.4 Per utilizzare il Servizio Online, laddove esistente, l’utente deve avere almeno 13 anni. Utilizzando il Servizio Online, l’utente conferma quindi di avere 13 anni o più. Per accedere alle funzionalità online del videogame è necessario che l'account di piattaforma (Sony, Microsoft, o altra) sia appartenente ad un soggetto che abbia almeno tredici anni di età.<br><br>Regole dell’utente<br>4.5 L’utente accetta inoltre che non si comporterà in alcun modo in un modo illegale o che comporta responsabilità civile o penale o che potrebbe mettere in cattiva reputazione noi o il Gioco.<br>4.6 Laddove il Gioco consenta all’utente di condividere messaggi predeterminati con altri utenti, saremo autorizzati a rimuovere, limitare, sospendere o alterare tale abilità per qualsiasi motivo a nostra sola e assoluta discrezione.<br>4.7 L’utente collaborerà pienamente con noi per indagare in merito a qualsiasi attività sospetta illecita, fraudolenta o impropria.<br>4.8 Se l’utente ritiene che il comportamento di un altro utente viola le presenti Condizioni e i presenti Termini, è pregato di comunicarcelo contattandoci tramite i Servizi di supporto fornendoci i dettagli della potenziale violazione e/o dell’utente responsabile. Adotteremo misure ragionevoli per risolvere eventuali violazioni.<br><br>Si prega di notare:<br>Laddove esiste, l’utente utilizza il Servizio Online a proprio rischio e pericolo. Un rischio noto di utilizzo di Internet è che le persone non sono necessariamente chi dicono di essere. Le persone possono fornire informazioni o comportarsi in modo inaffidabile, fuorviante o illegale. Milestone non ha modo di asserire se le affermazioni di altri utenti del Gioco e/o del Servizio Online sono veritiere. Questa è una decisione che può essere presa solo dall’utente e si raccomanda l’esercizio di un certo grado di cautela. Giocando al Gioco e utilizzando il Servizio Online e le sue parti, l’utente accetta quanto sopra e accetta il rischio associato ad esso. Gli utenti devono prestare particolare attenzione in relazione alla divulgazione delle proprie informazioni personali.<br><br><br>5. CREAZIONE E PERSONALIZZAZIONE DEL CONTENUTO DELL’UTENTE.<br><br>5.1 Il Gioco può includere una funzione di editor che consente all’utente o ad altri utenti del Gioco di creare Contenuti Utente (come definiti nel successivo art. 5.1.1) da utilizzare nel Gioco stesso,, da caricare,  condividere, rendere disponibili o inviare sul Servizio Online per se stesso e/o per altri giocatori. Inoltre, l’utente ha la possibilità di inviare comunicazioni a noi o a terzi e/o di fornire i Contenuti Utente e/o informazioni per il loro uso all’interno del Gioco o di altro genere da parte nostra o di terzi.<br><br>Ai fini delle presenti Condizioni:<br>5.1.1 la definizione di “Contenuti Utente” (al singolare “Contenuto Utente”) include qualsiasi contenuto creato dall’utente mediante le funzioni di editor che possono essere incluse nel Gioco,  quali, a titolo esemplificativo e non esaustivo, tracciati, livree,  caschi, adesivi, adesivi del pilota, numeri, tute e veicoli,  e caricato, reso disponibile o inviato dall’utente al Servizio Online, per se stesso e/o per altri utenti da utilizzare nel Gioco.<br>5.1.2 “Distribuire” significa utilizzare, vendere, commercializzare, promuovere, concedere in sub-licenza agli utenti finali, distribuire o altrimenti rendere disponibili a terze parti.<br>5.2 In relazione al SOLO uso del Gioco e del Servizio Online (laddove esiste questo servizio) e in virtù ai presenti Termini e le presenti Condizioni, l’utente può (e gli viene concessa una licenza limitata e non esclusiva e il diritto a) utilizzare il software che fa parte del Gioco e del Servizio Online per comunicare con altri utenti del Gioco utilizzando il Servizio Online e pubblicare, trasmettere, comunicare e rendere disponibili i Contenuti Utente. In tal modo, con la presente, l’utente ci concede un diritto illimitato, trasferibile, sublicenziabile, esente da diritti, perpetuo, irrevocabile, non esclusivo e la licenza di utilizzare e rendere disponibili tali Contenuti Utente in relazione al Gioco in qualsiasi modo o supporto.<br>5.3 Siamo impegnati nell’attività di marketing e pubblicazione del Gioco e nella fornitura dei relativi servizi di intrattenimento sotto forma di Servizio Online. In aggiunta, siamo impegnati nella trasmissione, nell’archiviazione, nel recupero, nell’hosting, nella formattazione o nella traduzione dei Contenuti Utente senza selezione o alterazione del contenuto della comunicazione per la quale operiamo meramente da tramite.<br>5.4 Installando e utilizzando il Gioco, l’utente accetta e conferma che non abbiamo la responsabilità di rivedere l’eventuale Contenuto Utente che sia reso disponibile sulla base del fatto che non ci sarà richiesto di esercitare alcun controllo o giudizio sul contenuto o sul materiale pubblicato o il suo contenuto. A scanso di equivoci, le opinioni espresse in qualsiasi Contenuto Utente . rappresentano le opinioni dei singoli autori e non quelle di Milestone, salvo ove diversamente specificato da noi. In particolare, ma senza limitazioni a quanto sopra, non siamo responsabili e decliniamo ogni responsabilità in merito a commenti, opinioni o osservazioni espressi in qualsiasi Contenuto Utente.<br>5.5 Abbiamo il diritto di rimuovere, limitare, sospendere o alterare qualsiasi Contenuto Utente (e la possibilità di condividere o creare Contenuti Utente,) per qualsiasi motivo, a nostra sola e assoluta discrezione.<br>5.6 L’utente accetta che possiamo usare, pubblicare, modificare, variare e adattare il Contenuto Utente che l’utente stesso rende disponibile o pubblica o trasmette al Gioco e/o al Servizio Online per qualsiasi motivo a nostra discrezione.<br>5.7 Nella misura in cui il Contenuto Utente deriva dal Gioco o dal materiale fornito da noi, con la presente, l’utente ci assegna tutti i Diritti di proprietà intellettuale sussistenti nel Contenuto Utente di sua proprietà, compresi tutti i diritti di proprietà intellettuale in qualsiasi Contenuto Utente da lui creato.<br>5.8 Non forniamo alcuna garanzia e non rilasciamo alcuna dichiarazione in merito all’accuratezza, alla valuta o alla validità delle informazioni e del materiale contenuto nel Contenuto Utente o nel Servizio Online e non siamo responsabili di eventuali perdite o danni causati dall’uso di tali informazioni o materiale.<br>5.9 Se l’utente scopre qualsiasi Contenuto Utente che ritiene essere in contrasto con i presenti Termini e le presenti Condizioni, lo preghiamo di segnalarcelo contattandoci tramite i Servizi di supporto con i dettagli del Contenuto Utente.<br><br>Regole del Contenuto Utente (applicabili laddove esiste il Servizio Online)<br>5.10 L’utente accetta e si impegna ad avere il diritto di rendere disponibile o di pubblicare o trasmettere al Gioco i suoi Contenuti Utente e a concederci i diritti indicati nella clausola 5.8 e non renderà disponibile, né pubblicherà o trasmetterà al Gioco alcuna dichiarazione, materiale o altro Contenuto Utente, né utilizzerà il Servizio Online o il Gioco in alcun modo:<br>5.10.1 che risulta essere abusivo, sedizioso, pornografico, aggressivo, omofobico, diffamatorio, falso, istigatore all’odio, discriminatorio, osceno, offensivo, incendiario, sessista o razzista;<br>5.10.2 che molesta o intimidisce qualsiasi persona o inibisce o impedisce la capacità degli altri utenti di comunicare o leggere conversazioni (ciò include l’uso di qualsiasi macro/SPAM per la base generale dei giocatori o un singolo individuo al fine di interrompere la chat);<br>5.10.3 che viola qualsiasi Diritto di Proprietà Intellettuale o altri diritti di qualsiasi persona (a patto che il Contenuto Utente sia derivato dal Gioco o dal materiale fornito da noi);<br>5.10.4 che dà origine a comportamenti di sfruttamento, tramite, ma non limitati a, programmi di terze parti, bot, script, virus o altri mezzi che sono ragionevolmente vietati da noi di volta in volta o che sfruttano bug, errori non previsti o funzionalità che non sono state documentate, per accedere a parti del Gioco limitate o che altrimenti costituiscono attività che ragionevolmente riteniamo contrarie allo “spirito” del Gioco;<br>5.10.5 che incoraggia qualsiasi violazione delle presenti Condizioni e dei presenti Termini o dei termini di servizio di un fornitore di servizi di terzi;<br>5.10.6 illegale, malevolo, fuorviante (inclusa l’impersonificazione), discriminatorio o che dà origine a responsabilità civile o penale o che potrebbe mettere a repentaglio la reputazione di Milestone, del Servizio Online o del Gioco;<br>5.10.7 viola la proprietà intellettuale o altri diritti di terze parti o facilita o incoraggia tale violazione o comporta la distribuzione delle informazioni personali di qualsiasi giocatore (diverse dalle proprie, come messaggio privato);<br>5.10.8 tecnicamente dannoso come l’introduzione di virus informatici, worm, bombe logiche o altri software o dati dannosi o, in altro modo, tenta o modifica effettivamente o interferisce con il Gioco o sovraccarica o interrompe qualsiasi computer o server utilizzato dal Gioco;<br>5.10.9 che può essere considerato una comunicazione commerciale o di marketing;<br>5.10.10 che promuove attività illegali o illecite incluse, a titolo esemplificativo ma non esaustivo, la sollecitazione, il gioco d’azzardo o la vendita di medicinali soggetti a prescrizione medica;<br>5.10.11 che è rivolto a persone di età inferiore ai 18 anni o che cercano o tentano di accordarsi per incontrare una persona di età inferiore ai 18 anni;<br>5.10.12 che contiene qualsiasi materiale limitato, incluse ma non limitate a, password, informazioni mediche o informazioni riservate di qualsiasi persona;<br>5.10.13 che costituisce, a nostro ragionevole avviso, un uso improprio del Gioco o un tentativo di ottenere l’accesso non autorizzato al Gioco o sue parti o agli account di altri utenti o reti o della loro console o dispositivo; o<br>5.10.14 che sollecita, invita, incoraggia, sostiene, incita o provoca in tutto o in parte quanto sopra.<br><br>Contenuti Utente creabili tramite Editor (applicabili laddove esiste il Servizio Online)<br>5.11 In base alla Clausola 5.8 di cui sopra, in relazione a qualsiasi Contenuto Utente creato e caricato dall’utente sul Servizio Online, l’utente stesso ci concede un diritto e una licenza non esclusivi, esenti da royalty, perpetui, irrevocabili, in tutto il mondo e per:<br>5.11.1 distribuire il suo Contenuto Utente tramite il Servizio Online;<br>5.11.2 utilizzare e rendere disponibili schermate e sequenze video del suo Contenuto Utente e creare e rendere disponibili (anche tramite servizi di terze parti) tali altri materiali promozionali e di marketing a nostro piacimento al fine di promuovere il Tracciato o Livrea della moto che ha creato, il Gioco e/o il Servizio Online su tutti i supporti;<br>5.11.3 distribuire la dimostrazione o versioni gratuite del Contenuto Utente allo scopo di rivedere, promuovere e commercializzare unicamente il Contenuto Utente personalizzato; e<br>5.11.4 utilizzare qualsiasi marchio commerciale o nome commerciale di cui è a conoscenza l’utente o il suo Contenuto Utente in relazione alla distribuzione del Contenuto Utente di cui sotto.<br>5.12 L’utente ci garantisce e ci dichiara che (a patto che il Contenuto Utente sia derivato dal Gioco o dal materiale fornito da Milestone);<br>5.12.1 di essere il proprietario o il licenziatario del Contenuto Utente e di tutti i Diritti di Proprietà Intellettuale ivi contenuti;<br>5.12.2 di avere il pieno potere di stipulare le presenti Condizioni e i presenti Termini e di avere il diritto di concedere i diritti, le licenze e gli incarichi in esso contenuti e di disporre di tutte le licenze e gli incarichi necessari a farlo;<br>5.13 L’utente indennizzerà (acconsentirà a risarcire) e terrà indenne Milestone contro tutte le azioni, i reclami, i procedimenti, i costi e i danni (compresi eventuali danni o risarcimenti da noi pagati su consiglio dei nostri consulenti legali per impegnarsi in o risolvere qualsiasi reclamo) e tutte le spese legali o altre spese o quelle derivanti da qualsiasi violazione delle suddette garanzie o dei presenti Termini e delle presenti Condizioni.<br><br><br>6. The user shall not make available, nor indeed publish or transmit to the Game, any statement, material or other User Content, or use the Online Service or Game in any way which:<br>5.10.1 is abusive, seditious, pornographic, aggressive, homophobic, defamatory, false, instigates hatred, is discriminatory, obscene, offensive, provocative, sexist or racist;<br>5.10.2 molests or intimidates any person, or inhibits or prevents the ability of other users to communicate or read conversations (including the use of any macros/SPAM for the general base of gamers, or a single individual, in order to interrupt the chat);<br>5.10.3 breaches any Intellectual Property Right or other rights of any person (on condition that the User Content is derived from the Game or the material supplied by us);<br>5.10.4 gives rise to any behaviour involving exploitation through, but not limited to, third-party programmes, bots, scripts, viruses or other means reasonably prohibited by us on an as-and-when basis, or that exploits bugs, unforeseen errors or undocumented features to access restricted parts of the game, or otherwise engages in activities that we reasonably deem are contrary to the "spirit" of the Game;<br>5.10.5 encourages any breach of these Terms and Conditions, or the terms of service of a third-party service provider;<br>5.10.6 are Illegal, malicious, misleading (including impersonation), discriminatory, or give rise to civil or criminal liability, or which might jeopardise the reputation of Milestone, the Online Service or the Game;<br>5.10.7 breaches the intellectual property or other rights of third parties, or facilitates or encourages such a breach, or involves the distribution of personal information of any gamer (other than one’s own, such as private messages);<br>5.10.8 is technically damaging, such as introducing computer viruses, worms, logic bombs or other harmful software or data, or otherwise attempting or effectively modifying or interfering with the Game, or overloading or disrupting any computer or server used by the Game;<br>5.10.9 may be considered commercial or marketing communication;<br>5.10.10 promotes illegal or unlawful activities, including but not limited to solicitation, gambling or the sale of prescription medication;<br>5.10.11 is directed at individuals under the age of 18 or those seeking or attempting to arrange to meet a person under the age of 18;<br>5.10.12 contains any restricted material, including but not limited to passwords, medical information or confidential information of any person; <br>5.10.13 constitutes, in our reasonable opinion, misuse of the Game or an attempt to gain unauthorised access to the Game or its parts, or the accounts of other users or networks, or their console or device; or<br>5.10.14 solicits, invites, encourages, supports, incites or provokes - in whole or in part - any of the above.<br><br>User Contents which can be created using the Editor (applicable where the Online Service exists)<br>5.11 According to Clause 5.8 above, in relation to any User Content created and uploaded by the user on the Online Service, the user shall grant us the right and licence, on a non-exclusive basis, which shall be deemed free of royalties, perpetual and irrevocable, on a worldwide basis, for:<br>5.11.1 distributing their User Content via the Online Service;;<br>5.11.2 using and making available screenshots and video sequences of their User Content, and creating and making available (also through third-party services) any such further promotional and marketing materials at our discretion, for the purposes of promoting the Track or Livery of the motorcycle they have created, the Game and/or the Online Service on all media;<br>5.11.3 distributing the demo or free versions of the User Content with an end to reviewing, promoting and marketing solely the customised User Content; and; <br>5.11.4 using any commercial brand or commercial name of which the user is aware, or their User Content in relation to the distribution of the User Content below. 	<br>5.12 The user guarantees and declares the following to us (on condition that the User Content derives from the Game, or the material supplied by Milestone):<br>5.12.1 that they are the owner or licence holder of the User Content, and all the Intellectual Property Rights pertaining to it;<br>5.12.2 that they have the full power to enter into these Conditions and the Terms herein, and are entitled to grant the rights, licences and assignments contained in them, and that they hold all licences and assignments required to do so;<br>5.13 The user shall indemnify (agree to compensate) and hold Milestone harmless against all actions, claims, proceedings, costs and damages (including any damages or settlements paid by us on the advice of our legal advisors to settle or resolve any claim), and all legal fees or other expenses arising from any breach of the above warranties, or these Terms and Conditions.<br><br>6. WARRANTY AND LIMITATION OF LIABILITY.<br><br>6.1 We warrant that we have used and will use reasonable efforts to ensure that:<br>6.1.1 we are entitled to grant the rights and licenses granted herewith;<br>6.1.2 the Game will be of satisfactory quality;<br>6.1.3 we have used and will use reasonable efforts to ensure that the Game and/or the Online Service will be available for six (6) months from the date on which you purchase the Game; and<br>6.1.4 the Online Service, when made available by us, shall be of satisfactory quality, as described and fit for purpose.<br>6.2 To the maximum extent permitted by law, and save as expressly provided in these Terms, we give no warranty in connection with the Online Service and exclude liability for any loss or damage of any kind, regardless of how it arises, including without limitation any direct, indirect, punitive or consequential loss, regardless of whether it arises from any issue you notify to us, and we shall have no liability to pay any money by way of compensation, including without limitation all liability in relation to:<br>6.2.1 the availability of the Online Service;<br>6.2.2 any incorrect or inaccurate information on the Online Service and all errors, interruptions to or delays in updating the Online Service;<br>6.2.3 the infringement by any person of any Intellectual Property Rights of any third party caused by their use of the Online Service;<br>6.2.4 any amount or kind of loss or damage

INDEMNITY AND REMEDIES. <br><br>7.1 You hereby indemnify (agree to compensate), defend and hold harmless Milestone and our affiliates, officers, directors, owners, licensors, service providers, partners, contractors, employees, agents and licensees (collectively, the "Indemnified Parties") from and against any and all any liabilities, claims, costs and expenses (including legal expenses and attorney fees) incurred by the Indemnified Parties in connection with any claim arising out of any breach by you of these Terms, or claims arising directly or indirectly from your use or misuse of the Game (which includes Virtual Items and the Online Service, where existing), and any User Content; and/or any use other than that set out in these Terms. You shall fully cooperate with us in the defense of any such claim and we reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you.<br>7.2 You further agree that the subject matter of these Terms is of a unique character with special value, and that we would suffer irreparable damage if these Terms were not specifically enforced; as a result you agree that we shall be entitled, without bond, other security, or proof of damages, to appropriate equitable remedies (including injunctive relief) with respect to breaches of these Terms, in addition to other remedies as we may otherwise have available under applicable laws.<br>7.3 Our licensors shall be third-party beneficiaries under these Terms and shall be entitled to enforce its provisions and enjoy the benefits of its protections.<br><br>8. OWNERSHIP. <br><br>8.1 All right, title, interest and ownership rights in the Game and any copyright, design right, database right, patents and any rights to inventions, know-how, trade and business names, trade secrets and trade marks (whether registered or unregistered) and any related applications and other intellectual property rights (“Intellectual Property Rights”), in or connected with the Game and each part thereof (including, by way of example only, any titles, code, themes, objects, characters, stories, catchphrases, concepts, artworks, animations, sounds, music, audio-visual effects and methods of operation) are owned by, belong to and vest in us or our licensors. <br>8.2 The Game may contain certain licensed materials and our licensors may act to protect their rights in the event of any breach of these Terms. All trademarks are the property of their respective owners.<br><br>9. SEVERABILITY.<br><br>In the event that any provision of these Terms shall be held by a court or other tribunal of competent jurisdiction to be unenforceable, this provision will be enforced to the maximum extent permissible and the remaining parts of these Terms shall remain in full force and effect. <br><br>10.
