THESE TERMS AND CONDITIONS ("TERMS") APPLY TO AND SHALL BE EFFECTIVE IN RESPECT OF ANY USE OF THE GAME. THESE TERMS ARE IN ADDITION TO THE APPLICABLE TERMS AND CONDITIONS OF ANY PLATFORM ON WHICH WE MAKE THE GAME AVAILABLE (“PLATFORM TERMS”). THE PLATFORM TERMS ARE THEREFORE DEEMED INCORPORATED INTO THESE TERMS.  
PLEASE READ THE FOLLOWING CAREFULLY BEFORE USING, DOWNLOADING, PURCHASING OR INSTALLING THE GAME (WHICH INCLUDES THE RELEVANT ONLINE SERVICE). IF YOU DO NOT AGREE WITH THESE TERMS YOU MAY NOT USE, DOWNLOAD OR INSTALL THE GAME.
PLEASE NOTE THAT THE GAME REQUIRES AN INTERNET CONNECTION AND THE AVAILABILITY OF OUR ONLINE SERVICE FOR MOST OF ITS FUNCTIONS.
YOU ARE RESPONSIBLE FOR ENSURING THAT YOU HAVE AN INTERNET CONNECTION, AND THAT THE DEVICE YOU USE HAS SUFFICIENT HARDWARE AND SOFTWARE REQUIREMENTS AND MEMORY IN ORDER TO PLAY AND STORE THE GAME AND USE THE ONLINE SERVICE.
THE GAME HAS BEEN DEVELOPED TO WORK ON THE LATEST VERSION OF STEAM, PLAYSTATION®, XBOX, NINTENDO SWITCH™, AMAZON LUNA AND EPIC GAMES STORE AT THE TIME OF ITS RELEASE. THE PLATFORM HOLDERS MAY OCCASIONALLY UPDATE THEIR SOFTWARE; WE WILL ENDEAVOR, BUT NOT BE OBLIGATED, TO UPDATE THE GAME IF NECESSARY, TO ENSURE THAT ITS FUNCTIONS AND PERFORMANCE CONTINUE WITH ANY UPDATE RELEASE. IT IS YOUR OBLIGATION TO ENSURE THAT YOU ARE USING THE LATEST COMPATIBLE PUBLIC RELEASE OF ANY OPERATING SYSTEM FOR YOUR CONSOLE OR PC.
THE GAME COMPRISES COPYRIGHT WORKS OF MILESTONE AND/OR ITS LICENSORS. THE GAME IS LICENSED, NOT SOLD.  YOUR LICENSE CONFERS NO TITLE OR OWNERSHIP IN THE GAME.  THE GAME IS SOLELY INTENDED FOR USE BY END USERS ACCORDING TO THESE TERMS. ANY USAGE, REPRODUCTION OR REDISTRIBUTION OF THE GAME NOT IN ACCORDANCE WITH THESE TERMS IS EXPRESSLY PROHIBITED.

1. 	LICENCE D’UTILISATION LIMITÉE.

1. LIMITED USE LICENSE.

1.1 	Milestone vous octroie par les présentes une licence non exclusive et limitée vous permettant de télécharger, installer et utiliser le Jeu à des fins personnelles et non commerciales, uniquement sur les consoles et systèmes compatibles dont vous êtes propriétaire, dans le cadre des présentes Conditions.
1.2 Ces Conditions et votre utilisation du Jeu ne vous octroient aucun droit de propriété sur aucun élément du Jeu, qu’il soit tangible ou non (y compris sur le Circuit ou Livrée de moto ou le pilote/la moto que vous créez).
1.3 Cette disposition s’applique si nous proposons le Jeu via la plateforme Steam (« Steam »), hébergée par Valve S.A.R.L (en Europe) et Valve Corporation (aux États-Unis). Vous devez dans ce cas posséder un compte Steam pour pouvoir jouer au Jeu, et votre utilisation de Steam est sujette à l’Accord de souscription Steam disponible ici. L’Accord de souscription Steam est occasionnellement modifié. En cas d’une éventuelle contradiction avec les présentes, l’Accord de souscription Steam prime. Steam autorise le remboursement du Jeu sous certaines conditions. Elles sont indiquées sur le site Internet Steam à l’adresse suivante : Remboursements Steam.
1.4 Si vous installez ou utiliser le Jeu sur une plateforme tierce, y compris, mais sans que cela soit limitatif, sur les systèmes PlayStation®, Microsoft Xbox, Nintendo, Amazon Luna et Epic Games Store, les conditions d’utilisation de ces plateformes s’appliqueront.
1.5 Milestone et vous reconnaissez passer un accord entre vous et Milestone uniquement, et non avec Apple Inc., ni aucune filiale d’Apple Inc. Vous reconnaissez également que nous sommes seuls responsables du Jeu et de son contenu.
1.6 Si vous jouez sur un appareil Android, votre utilisation du Jeu pourra nécessiter de posséder un compte Google. Votre accès au Jeu sera lié à votre compte Google et vous devrez alors vous conformer aux Règles et Conditions d’utilisation de Google pour utiliser le Jeu.

1.1 Milestone hereby grants you limited, non-exclusive right and license to download, install and use the Game for your personal, non-commercial use only, on compatible consoles or devices that are owned by you, subject to these Terms.
1.2 These Terms, and your use of the Game, do not give you any rights of ownership over any property in the game, whether tangible or intangible (including any Track or Bike livery or customized rider/bike that you create).
1.3 This clause applies if we offer the Game through the Steam platform (“Steam”), which is hosted by Valve S.A.R.L. (in the EU) and Valve Corporation (in the US). Where applicable, you will need a Steam account to play the Game, and your use of Steam is subject to the Steam Subscriber Agreement, which you can find online here.  The Steam Subscriber Agreement changes from time to time; if it becomes inconsistent with this EULA, where conflicts arise, the Steam Subscriber Agreement takes precedence. Steam allows refunds for the Game in certain circumstances.  You can find out how on the Steam website here: Steam Refunds.
1.4 If you install or use the Game on any third party platform including without limitation the PlayStation®, Microsoft Xbox, Nintendo, Amazon Luna and Epic Games Store platforms then the terms of these platforms will all apply.
1.5 You and we acknowledge that these Terms are agreed between you and us only, and not with Apple Inc, nor any subsidiary or affiliate company of Apple Inc. You also acknowledge that we are solely responsible for the Game and the content thereof.
1.6 If you are playing on an Android device, your use of the Game may require you to have a Google account. Your access to the Game will be linked to your Google account and you are required to comply with Google policies to use the Game.

2. OBLIGATIONS DE L’UTILISATEUR FINAL.

2. END USER OBLIGATIONS.

2.1 Vous pouvez utiliser le Jeu à des fins personnelles et non commerciales telles qu’elles sont décrites dans les présentes Conditions, mais vous êtes dans l’obligation de respecter les Conditions suivantes, dans le cadre de ce qu’elles autorisent expressément :
2.1.1 ne pas vendre, transférer, copier, reproduire, traduire, partager, désosser, publier, diffuser sur Internet (stream), distribuer, louer, prêter, céder une licence, détourner le code source, modifier, adapter, fusionner, désassembler, décompiler, créer des œuvres dérivées basées sur le Jeu, ou encore distribuer des exemplaires ou copies du Jeu, de ses différents éléments ou intérêts, de quelque manière que ce soit, à l’exception des cadres expressément prévus par le Jeu, via le partage de contenu du Jeu sur les réseaux sociaux ; 
2.1.2 ne pas supprimer, modifier ou altérer les mentions de droit d’auteur, de marque commerciale ou toute autre mention ;
2.1.3 ne pas participer à des activités jugées contradictoires à l’esprit du Jeu et/ou au Service en ligne, y compris, mais sans que cela soit limitatif, via l’exploitation de bugs, l’utilisation de codes de triche, logiciels d’automatisation, bots, piratages, mods ou tout logiciel tiers non autorisé conçu pour modifier le Jeu ou interférer avec le Jeu ;
2.1.4 ne pas tenter d’accéder sans autorisation au Service en ligne ou aux ordinateurs, périphériques, serveurs ou réseaux connectés au Service en ligne par un autre biais que l’interface utilisateur fournie par nos soins ; ou
2.1.5 ne pas utiliser le Jeu à des fins illégales ou immorales.
2.2 Vous ne pouvez pas utiliser, accéder ou autrement exporter ou réexporter les produits, sauf tel qu’autorisé par la loi des États-Unis et les lois de la juridiction dans laquelle les Services ont été obtenus. Notamment, mais pas exclusivement, les Jeux ne peuvent être exportés, réexportés ou mis à disposition d’une autre manière (a) dans un pays ou une région faisant l’objet d’un embargo de la part du gouvernement des États-Unis, ou (b) à toute personne figurant sur la « U.S. Treasury Department's Specially Designated Nationals List », sur la « U.S. Department of Commerce Denied person List », sur la « Entity List », ou sur la « EU consolidated sanctions list with designated persons ». En utilisant les Jeux, vous déclarez et garantissez que vous n’êtes pas placé dans un tel pays ou sur une telle liste.

2.1 You may use the Game for your own personal, non-commercial use as described in these Terms, but you are not entitled to and may not do any of the following, except to the extent expressly permitted by these Terms:
2.1.1 sell, transfer, copy, reproduce, translate, communicate, reverse engineer, publish, stream, distribute, rent, loan, sub-license, derive source code from, modify, adapt, merge, disassemble, decompile, create derivative works based on or otherwise transfer or deal in copies or reproductions of the Game, or any part or interest in it, to other parties in any way except where the Game expressly permits you to do so by sharing Game content on social media;  
2.1.2 remove, modify or tamper with any copyright, trademark or other notice;
2.1.3 engage in any act that we deem to be in conflict with the spirit or intent of the Game and/or the Online Service, including, without limitation, using cheats, exploits, automation software, bots, hacks, mods or any unauthorized third-party software designed to modify or interfere with the Game;
2.1.4 attempt to gain unauthorized access to the Online Service, or to the computers, devices, servers, or networks connected to the Online Service by any means other than the user interface provided by us; or
2.1.5 use the Game for any unlawful or immoral purposes.   
2.2 You may not use, access or otherwise export or re-export the products except as authorized by United States law and the laws of the jurisdiction in which the Services were obtained. In particular, but without limitation, the Games may not be exported, re-exported or otherwise made available (a) into any country or region embargoed by the U.S. Government, or (b) to anyone on the U.S. Treasury Department's Specially Designated Nationals List or the U.S. Department of Commerce Denied person List or Entity List, EU consolidated sanctions list with designated persons. By using the Games, you represent and warrant that you are not located in any such country or on any such list.

3. RÉSILIATION.

3. TERMINATION.

3.1 Les présentes Conditions et les licences qui vous sont accordées par Milestone restent en vigueur jusqu’à leur résiliation.
3.2 Vous pouvez résilier les présentes Conditions à tout moment et pour quelque raison que ce soit en supprimant le Jeu de votre console, appareil ou ordinateur.
3.3 Nous sommes en droit de résilier les présentes Conditions si vous ne les respectez pas, à tout moment et pour quelque motif que ce soit, ou si nous avons des raisons valables de vous soupçonner de ne pas les respecter. Nous pouvons agir, dans la mesure du raisonnable et à notre seule discrétion, à l’encontre des utilisateurs qui ne respectent pas les présentes Conditions, ce qui inclut le fait d’empêcher certains utilisateurs d’utiliser le Jeu et/ou le Service en ligne ou d’y accéder. Pour plus d’informations sur les infractions que vous pourriez commettre, nous vous conseillons de lire attentivement l’ensemble du paragraphe 5.11 « Règles du Contenu utilisateur ». En fonction du type, mais surtout du nombre d’alertes reçues, Milestone se réserve le droit de suspendre l’utilisateur pendant un nombre de jours variable : un jour, trois jours, sept jours, quinze jours, un mois. Passée cette dernière limite, la suspension permanente est encourue.
3.4 Milestone se réserve le droit de déterminer ce qui consiste une infraction aux présentes Conditions, au Jeu et/ou au Service en ligne, ou ce qui va à l’encontre de leur intention ou esprit. Toutefois, si vous avez la possibilité de corriger le problème, nous vous laisserons la possibilité de le faire.
3.5 Suite à la résiliation, il ne vous sera plus possible d’utiliser le Jeu et il vous sera demandé de supprimer le Jeu de votre console ou système.
3.6 Les Services Milestone ne sont plus disponibles dans une région. Dans le cas où ceci se produirait, nous veillerons à publier un avis sur notre site web et/ou dans le jeu, pour signaler l’interruption d’une fonctionnalité importante dans le jeu ou de tous les Services Milestone au sein d’une région.

3.1 These Terms and the licenses granted to you by us are effective until terminated.
3.2 You may terminate these Terms at any time and for any reason by deleting and removing the Game from your console or PC.  
3.3 We may terminate these Terms if you fail to abide by them at any time and for any reason, or where we reasonably suspect that you have failed to abide by any of these Terms.  We may take action that we deem reasonable at our sole discretion against users who do not comply with these Terms. This may include banning users from using or accessing the Game and/or the Online Service. For more information about the kind of infraction you could commit, we recommend you to carefully read the entire paragraph 5.11 “User Content Rules”. Based on the type but especially on the number of reports received, Milestone reserves the right to suspend a user for the following days: one day, three days, seven days, fifteen days, one month. Once the latter is exceeded, it’s possible to incur a permanent suspension.
3.4 Milestone reserves the right to determine what conduct it considers to be in violation of, or otherwise outside the intent or spirit of, these Terms and/or the Game and/or the Online Service. However, if your action can be rectified, we shall give you reasonable opportunity to do so. 
3.5 Following termination, you will no longer be permitted to use any of the Game and you will be required to delete the Game from your console or device.
3.6 Milestone Services are no longer available in a region. Should such a circumstance occur, we will publish a communication on our website and/or in the game itself, reporting the interruption of a core feature of a game or all of the Milestone Services in a region.

4. SERVICE EN LIGNE.

4. ONLINE SERVICE.

4.1 Milestone peut, sans y être obligé, fournir et maintenir certaines fonctionnalités en ligne, interactivités et connexions du jeu en réseau et en ligne, ainsi que d’autres fonctionnalités en ligne en lien avec le Jeu, y compris, mais sans que cela soit limitatif, les modes de jeu en ligne Épreuve unique et Championnat personnalisé (ci-après le « Service en ligne »), conformément aux présentes Conditions.
4.2 Nous ne pouvons garantir que le Service en ligne ou toute partie du Service en ligne, y compris le Contenu utilisateur s’il existe, sera toujours disponible.
4.3 Le Service en ligne est limité à un usage personnel, fourni « en l’état », et toute utilisation doit être conforme aux présentes Conditions.

4.1 Milestone may, but shall not be obliged to, provide and maintain certain online functions, online network play connectivity and interactivity, and other online features relating to the Game subject to these Terms. These shall include, by way of example, the online ‘Single Event’ and ‘Custom Championship’ game modes (“Online Service”).
4.2 We cannot guarantee that the Online Service or a particular part of the Online Service, including any User Content, will always be available. 
4.3 The Online Service is for personal use only, on an “as is” basis and all use must be in accordance with these Terms.

Restrictions d’âge
4.4 Pour pouvoir jouer, il convient d’accepter l’accord avec l’utilisateur de milestone et reconnaître la politique de confidentialité et de cookies de Milestone. Pour accéder aux fonctions en ligne, il est nécessaire d’avoir une connexion internet et un compte de plateforme, étant précisé que l’inscription doit être effectuée par une personne âgée de treize ans au moins.

Age Restrictions
4.4 To be able to play, you must first accept the Milestone user agreement and confirm that you have read MIlestone's privacy and cookie policy. In order to use online functions, you must have an Internet connection and an account on the platform; it is also necessary for a person aged at least thirteen to complete the registration process.

Règles d’utilisation
4.5 Vous vous engagez à ne pas adopter de comportement illégal ni de comportement risquant d’engager votre responsabilité civile ou pénale, ou qui pourrait ternir la réputation de Milestone ou du Jeu.
4.6 Nous nous réservons le droit de supprimer, limiter, suspendre ou modifier votre capacité à partager des messages prédéfinis avec d’autres utilisateurs, pour quelque raison que ce soit et à notre seule discrétion.
4.7 Vous vous engagez à coopérer avec nous pour enquêter sur tout soupçon d’activité illégale, frauduleuse ou abusive.
4.8 Si vous estimez que le comportement d’un autre utilisateur enfreint les présentes Conditions, veuillez nous le faire savoir par le biais des Services d’assistance en décrivant les éventuelles infractions et/ou l’utilisateur responsable. Nous prendrons des mesures raisonnables pour gérer toute infraction.

User Rules
4.5 You also agree that you will not in any way behave in a manner which is unlawful or which gives rise to civil or criminal liability, or which might call us or the Game into disrepute. 
4.6 Where the Game allows you to share pre-determined messages with other users, we shall be entitled to remove, restrict, suspend or alter that ability for any reason at our sole and absolute discretion.  
4.7 You will cooperate fully with us to investigate any suspected unlawful, fraudulent or improper activity.
4.8 If you feel that the behavior of another user breaches these Terms, please let us know by contacting us via the Support Services with details of the potential breach and/or the user responsible. We will take reasonable steps to deal with any breach.

S’il existe, vous utilisez ce Service en ligne à vos risques et périls. L’utilisation d’Internet comporte un risque bien connu : les autres utilisateurs ne sont pas nécessairement ceux qu’ils prétendent être. Milestone n’a aucun moyen de vérifier la véracité des affirmations formulées par d’autres utilisateurs du Jeu et/ou du Service en ligne. Vous êtes la seule personne à pouvoir décider de la teneur de ces affirmations et nous vous recommandons de faire preuve de prudence. En jouant à ce Jeu et en utilisant le Service en ligne et ses éléments, vous reconnaissez que tel est le cas et vous en acceptez les risques. Veuillez faire preuve de la plus grande prudence lorsque vous communiquez des informations personnelles.

Please note: 
Where the Online Service is available, you use it at entirely your own risk. It is a known risk of internet usage that people are not necessarily who they say they are. People may provide information or behave in a way that is unreliable, misleading, unlawful or illegal. Milestone has no way of telling if statements made by other users of the Game and/or the Online Service are true. This is a decision that can only be made by you, and we recommend exercising caution. By playing the Game and using the Online Service and its parts, you accept that this is the case and accept the associated risk. Users must take particular care in relation to the disclosure of their own personal information.

5. CRÉATION ET PERSONNALISATION DE CONTENU UTILISATEUR.

5. CREATION AND CUSTOMISATION OF USER CONTENT.

5.1 Le Jeu peut inclure une fonction éditeur vous permettant, ainsi qu’à d’autres utilisateurs du Jeu de créer du Contenu Utilisateur (tel que défini au point  5.1.1 qui suit) à utiliser dans le Jeu, charger, partager mettre à disposition ou envoyer sur le Service en ligne pour vous-même et/ou d’autres joueurs. 5.2 Dans le cadre EXCLUSIF de l’utilisation du Jeu et du Service en ligne (si un tel service existe), et conformément aux présentes Conditions, il vous est concédé une licence limitée et non exclusive vous permettant d’utiliser le logiciel intégré au Jeu et au Service en ligne afin de communiquer avec d’autres utilisateurs du Jeu utilisant le Service en ligne et pour publier, transmettre, partager et mettre à disposition du Contenu utilisateur. Ce faisant, par les présentes, vous nous accordez un droit illimité, transmissible, sous-licenciable, libre de droits, perpétuel, irrévocable et non exclusif et la licence pour utiliser et mettre à disposition ledit Contenu utilisateur, en lien avec le Jeu, de quelque manière que ce soit et sur tout support.
5.3 Nous nous engageons à commercialiser et à éditer le Jeu, et à fournir les services de divertissement afférents sous la forme du Service en ligne. De plus, nous nous engageons à transmettre, stocker, récupérer, héberger, mettre en forme et traduire le Contenu Utilisateur sans sélection ni altération de la communication afférente, pour laquelle nous faisons office de simple relais.
5.4 En installant et en utilisant le Jeu, vous acceptez et confirmez ne pas nous tenir responsables de la vérification du Contenu utilisateur mis à disposition, partant du principe que nous ne sommes tenus ni de le contrôler, ni de porter un jugement sur le contenu ou les éléments publiés ou leur contenu. Il est précisé que les opinions exprimées dans tout Contenu Utilisateur représentent les opinions de leurs auteurs respectifs et pas celles de Milestone, sauf indication contraire de notre part. En particulier, mais sans limitation eu égard à ce qui précède, nous ne saurions être tenus pour responsables et déclinons toute responsabilité quant aux commentaires, opinions ou observations exprimés dans n’importe quel Contenu Utilisateur.
5.5 Nous nous réservons le droit de supprimer, limiter, suspendre ou modifier tout Contenu Utilisateur (et la possibilité de partager ou de créer du Contenu Utilisateur, pour quelque raison que ce soit et à notre entière discrétion.
5.6 Vous acceptez que nous puissions utiliser, publier, modifier et adapter tout Contenu utilisateur que vous rendez accessible, publiez ou transmettez au Jeu et/ou au Service en ligne pour quelque raison que ce soit à notre seule discrétion.

For the purposes of these Conditions:
5.1.1 The definition of “User Contents” (singular “User Content”) includes any content created by the user through any editor functions which might be included in the Game including, but not limited to, tracks, liveries, helmets, decals, pilot stickers, numbers, suits and vehicles, and which are uploaded, made available or sent by the user to the Online Service, for their own purposes and/or for other users to utilise in the Game.
5.1.2 "Distribute" means to use, sell, market, promote, sub-license to end-users, distribute or otherwise make available to third parties.
5.2 In relation to the SOLE use of the Game and Online Service (where this service exists) and pursuant to these Terms and Conditions, the user may (and is granted a limited, non-exclusive licence and the right to) use the software that is part of the Game and Online Service to communicate with other users of the Game via the Online Service, and to publish User Content and transmit, communicate and make it available. In this way, the user hereby grants us an unlimited, transferable, sub-licensable, royalty-free, perpetual, irrevocable, non-exclusive licence to use and make available any such User Content in connection with the Game, in any manner or media. 
5.3 We are committed to marketing and publishing the Game and providing its associated entertainment services in the form of the Online Service. Additionally, we engage in the transmission, storage, retrieval, hosting, formatting or translation of User Content without selection or alteration of the communication content, for which we merely serve as a conduit.
5.4 By installing and using the Game, the user agrees and confirms that we are not responsible for reviewing any User Content made available, as we will not be required to exercise any control or give any judgement in relation to the content or published material, or its substance. For the purposes of avoiding any misunderstandings, the opinions expressed in any User Content represent the opinions of the individual authors, and not those of Milestone, unless otherwise specified by us. In particular, but without limitations to the above, we cannot be held responsible, and decline any liability for comments, opinions or observations expressed in any User Content. We shall be entitled to remove, restrict, suspend or alter any User Content (and the ability to share or create User Content, including any Track or Bike Livery) for any reason at our sole and absolute discretion.
5.5 We have the right to remove, limit, suspend or alter any User Content (and the ability to share or create User Content) for any reason, at our sole and absolute discretion.
5.6 The user accepts that we can use, publish, amend, vary and adapt any User Content which the user should make available, publish or transmit to the Game and/or the Online Service for any reason, at our sole discretion. 
5.7 To the extent that User Content derives from the Game or material supplied by us, the user hereby assigns us all intellectual property rights subsisting in the User Content which are owned by them, including all intellectual property rights in any User Content created by them.
5.8 We do not supply any guarantee, and shall not issue any declaration regarding the accuracy, evaluation or validity of the information and material contained in the User Content or Online Service; nor can we be held responsible for any losses or damage caused by the use of said information or material.
5.9 If the user discovers any User Content which they feel contravenes these Terms and Conditions, we would ask them to notify us via support Services and submit details of the User Content concerned..

5.10.3 qui enfreint les Droits de propriété intellectuelle ou d’autres droits personnels (sauf si le Contenu utilisateur est dérivé du Jeu ou d’éléments fournis par nos soins) ;
5.10.4 qui donne lieu à des comportements d’exploitation, via, mais sans s’y limiter, des programmes tiers, bots, scripts, virus ou autres moyens que nous interdirons au cas par cas, ou qui exploitent des bugs, erreurs involontaires ou fonctionnalités n’ayant pas été décrites, pour accéder à des parties restreintes du Jeu ou qui constituent des activités que nous jugeons contraires à « l’esprit » du Jeu ;
5.10.5 qui encourage la violation des présentes Conditions ou celles d’un fournisseur de service tiers;
5.10.6 illégale, malveillante, trompeuse (y compris l’usurpation d’identité), discriminatoire ou d’une façon risquant d’engager votre responsabilité civile ou pénale, ou qui pourrait ternir la réputation de Milestone, le Service en ligne ou du Jeu.
5.10.7 qui enfreint les droits de propriété intellectuelle ou d’autres droits de tiers, qui permet ou encourage de telles infractions, ou qui implique le partage des informations personnelles de tout joueur (autres que les vôtres dans le cadre d’un message privé) ;
5.10.8 qui représente une menace technique, comme l’introduction de virus informatiques, vers, bombes logiques, autres logiciels malveillants ou données dangereuses, ou en tout état de cause, qui tente de ou parvienne à modifier ou interférer avec le Jeu, ou encore qui surcharge ou interrompt le fonctionnement d’un ordinateur ou d’un serveur utilisé par le Jeu.
5.10.9 qui pourrait être considérée comme un message à caractère commercial ou publicitaire ;
5.10.10 qui ferait la promotion d’activité illégales ou illicites, notamment, mais pas exclusivement, le racolage, les paris ou la vente de médicaments délivrés sur ordonnance ;
5.10.11 qui cible des personnes de moins de dix-huit (18) ans, ou qui vise à rencontrer une personne de moins de dix-huit (18) ans ;
5.10.12 qui contient des éléments restreints, y compris, notamment, mais pas exclusivement, des mots de passe, informations médicales ou informations réservées ;
5.10.13 qui constitue, à notre avis raisonnable, une utilisation inappropriée du Jeu ou une tentative d’obtenir un accès non autorisé au Jeu ou à ses éléments, aux comptes d’autres utilisateurs, à d’autres réseaux ou encore à leurs consoles ou appareils ; ou
5.10.14 qui sollicite, invite, encourage, prône, incite ou provoque l’une, plusieurs ou toutes les actions mentionnées ci-dessus.

User Rules of User Content (applicable where the Online Service exists)
5.10 The user agrees and undertakes to have the right to make available, or publish or transmit, their User Contents to the Game, and to grant us the rights specified in clause 5.8. The user shall not make available, nor indeed publish or transmit to the Game, any statement, material or other User Content, or use the Online Service or Game in any way which:
5.10.1 is abusive, seditious, pornographic, aggressive, homophobic, defamatory, false, instigates hatred, is discriminatory, obscene, offensive, provocative, sexist or racist;
5.10.2 molests or intimidates any person, or inhibits or prevents the ability of other users to communicate or read conversations (including the use of any macros/SPAM for the general base of gamers, or a single individual, in order to interrupt the chat);
5.10.3 breaches any Intellectual Property Right or other rights of any person (on condition that the User Content is derived from the Game or the material supplied by us);
5.10.4 gives rise to any behaviour involving exploitation through, but not limited to, third-party programmes, bots, scripts, viruses or other means reasonably prohibited by us on an as-and-when basis, or that exploits bugs, unforeseen errors or undocumented features to access restricted parts of the game, or otherwise engages in activities that we reasonably deem are contrary to the "spirit" of the Game;
5.10.5 encourages any breach of these Terms and Conditions, or the terms of service of a third-party service provider;
5.10.6 are Illegal, malicious, misleading (including impersonation), discriminatory, or give rise to civil or criminal liability, or which might jeopardise the reputation of Milestone, the Online Service or the Game;
5.10.7 breaches the intellectual property or other rights of third parties, or facilitates or encourages such a breach, or involves the distribution of personal information of any gamer (other than one’s own, such as private messages);
5.10.8 is technically damaging, such as introducing computer viruses, worms, logic bombs or other harmful software or data, or otherwise attempting or effectively modifying or interfering with the Game, or overloading or disrupting any computer or server used by the Game;
5.10.9 may be considered commercial or marketing communication;
5.10.10 promotes illegal or unlawful activities, including but not limited to solicitation, gambling or the sale of prescription medication;
5.10.11 is directed at individuals under the age of 18 or those seeking or attempting to arrange to meet a person under the age of 18;
5.10.12 contains any restricted material, including but not limited to passwords, medical information or confidential information of any person; 
5.10.13 constitutes, in our reasonable opinion, misuse of the Game or an attempt to gain unauthorised access to the Game or its parts, or the accounts of other users or networks, or their console or device; or
5.10.14 solicits, invites, encourages, supports, incites or provokes - in whole or in part - any of the above.

5.11 Conformément au paragraphe 5.8 ci-dessus, dans le cadre de tout Contenu utilisateur  que vous créez et chargez sur le Service en ligne, vous nous accordez un droit et une licence non exclusifs, libres de redevance, perpétuels, irrévocables, dans le monde entier, nous permettant :
5.11.1 de distribuer votre Contenu utilisateur via le Service en ligne ;
5.11.2 d’utiliser et mettre à disposition des captures d’écran et des séquences vidéo de votre Contenu utilisateur, de créer et mettre à disposition (y compris via des services tiers) ces autres éléments promotionnels et marketing comme bon nous semble, dans le but de promouvoir le Circuit ou Livrée de moto que vous avez créé, le Jeu et/ou le Service en ligne, et ce, sur tout support ;
5.11.3 de distribuer des versions démo ou gratuites de votre Contenu utilisateur uniquement dans le but de revoir, promouvoir et commercialiser le Contenu utilisateur personnalisé ; et
5.11.4 d’utiliser toute marque commerciale ou tout nom commercial sous lesquels vous ou votre Contenu utilisateur est connu pour la distribution du Contenu utilisateur  ci-dessous.
5.12 Vous nous confirmez et déclarez (sauf si le Contenu utilisateur est dérivé du Jeu ou d’éléments que fournis par Milestone) :
5.12.1 être le propriétaire ou détenteur de licence du Contenu utilisateur et de tous les Droits de Propriété intellectuelle y afférents ;
5.12.2 être habilité(e) à souscrire les présentes Conditions et à accorder les droits, licences et cessions de droit inclus dans les présentes, et posséder toutes les licences et droits nécessaires pour le faire.
5.14 Vous indemniserez (accepterez d’indemniser) et de dégager Milestone de toute responsabilité en cas d’actions en justice, réclamations, procédures et dommages (y compris des dommages ou indemnisations payés par Milestone sur l’avis de nos conseils juridiques, dans un but de compromis ou pour régler une réclamation à l’amiable) et de tous les frais de justice ou autres frais résultant d’une violation des garanties et dispositions des présentes Conditions.

User Contents which can be created using the Editor (applicable where the Online Service exists)
5.11 According to Clause 5.8 above, in relation to any User Content created and uploaded by the user on the Online Service, the user shall grant us the right and licence, on a non-exclusive basis, which shall be deemed free of royalties, perpetual and irrevocable, on a worldwide basis, for:
5.11.1 distributing their User Content via the Online Service;;
5.11.2 using and making available screenshots and video sequences of their User Content, and creating and making available (also through third-party services) any such further promotional and marketing materials at our discretion, for the purposes of promoting the Track or Livery of the motorcycle they have created, the Game and/or the Online Service on all media;
5.11.3 distributing the demo or free versions of the User Content with an end to reviewing, promoting and marketing solely the customised User Content; and; 
5.11.4 using any commercial brand or commercial name of which the user is aware, or their User Content in relation to the distribution of the User Content below. 	
5.12 The user guarantees and declares the following to us (on condition that the User Content derives from the Game, or the material supplied by Milestone):
5.12.1 that they are the owner or licence holder of the User Content, and all the Intellectual Property Rights pertaining to it;
5.12.2 that they have the full power to enter into these Conditions and the Terms herein, and are entitled to grant the rights, licences and assignments contained in them, and that they hold all licences and assignments required to do so;
5.13 The user shall indemnify (agree to compensate) and hold Milestone harmless against all actions, claims, proceedings, costs and damages (including any damages or settlements paid by us on the advice of our legal advisors to settle or resolve any claim), and all legal fees or other expenses arising from any breach of the above warranties, or these Terms and Conditions.


6. GARANTIE ET LIMITATION DE RESPONSABILITÉ.

6.1.2 que le Jeu sera de qualité satisfaisante ;
6.1.3 que le Jeu et/ou le Service en ligne resteront disponibles pendant six (6) mois à compter de la date de votre achat du Jeu ; et
6.1.4 que le Service en ligne, lorsque nous le mettons à disposition, sera de qualité satisfaisante, conforme à sa description et adapté à l’utilisation prévue.
6.2 Dans toute la limite autorisée par la loi, et sauf mention expresse dans les présentes Conditions, nous ne fournissons aucune garantie dans le cadre du Service en ligne et déclinons toute responsabilité quant à toute perte ou tout dommage, incluant, mais sans que cela soit limitatif, tout dommage-intérêt direct, indirect, punitif ou conséquent, qu’il résulte ou non d’un problème que vous nous avez signalé, et nous ne serons pas tenus de vous verser de l’argent en compensation, y compris, mais sans limitation, dans le cadre :
6.2.1 de la disponibilité du Service en ligne ;
6.2.2 de toute information incorrecte ou inexacte sur le Service en ligne et de toute erreur, interruption ou délai dans la mise à jour du Service en ligne ;
6.2.3 d’une infraction par toute personne du Droit de propriété intellectuelle d’un tiers résultant de son utilisation du Service en ligne ;
6.2.4 de pertes ou dommages, quels qu’ils soient, dus à des virus ou autres logiciels malveillants qui auraient pu infecter le matériel informatique de l’utilisateur, ses logiciels, données ou autres biens, résultant de l’accès, de l’utilisation ou du téléchargement du Service en ligne par d’autres personnes ; 
6.2.5 de toutes les déclarations, garanties et autres conditions qui, sans cet avis légal, seraient valides.
6.3 Sauf mention expresse dans les présentes Conditions, et dans toute lamesure autorisée par la loi :
6.3.1 le Jeu est fourni « en l’état », « selon sa disponibilité » et sans garantie quelle qu’elle soit (explicite ou implicite), autre que celles mentionnées dans les présentes Conditions ;
6.3.2 nous assumons uniquement la responsabilité de pertes directes dans le cadre d’une infraction de notre part aux garanties mentionnées dans la disposition 6.1 ci-dessus ;
6.3.3 L’ampleur de notre responsabilité et de celle de nos concédants de licence ne dépassera pas 100 € ;
6.3.4 Milestone et ses concédants de licence ne sauraient être tenus responsables, de quelque manière que ce soit, pour des pertes ou dommages indirects ou conséquents (à l’exception de dégâts subis par votre console, système ou autre contenu numérique dont vous êtes propriétaire, causés par le Jeu suite à notre incapacité à apporter l’attention et les compétences raisonnables attendues. Vous pourriez dans ce cas avoir droit à une indemnisation, ou nous pourrions être tenus de réparer votre appareil) ;
6.3.5 Nous ne garantissons pas que le fonctionnement du Jeu et/ou du Service en ligne sera ininterrompu ou dénué d’erreur, ou que ces erreurs pourront être corrigées ou le seront, ou que le Jeu ou le Service en ligne ne contiendront aucun virus ou autre élément malveillant ;
6.3.6 Vous installez et utilisez le Jeu à vos risques et périls.

6.1 We warrant that we have used and will use reasonable efforts to ensure that:
6.1.1 we are entitled to grant the rights and licenses granted herewith;
6.1.2 the Game will be of satisfactory quality;
6.1.3 we have used and will use reasonable efforts to ensure that the Game and/or the Online Service will be available for six (6) months from the date on which you purchase the Game; and
6.1.4 the Online Service, when made available by us, shall be of satisfactory quality, as described and fit for purpose.
6.2 To the maximum extent permitted by law, and save as expressly provided in these Terms, we give no warranty in connection with the Online Service and exclude liability for any loss or damage of any kind, regardless of how it arises, including without limitation any direct, indirect, punitive or consequential loss, regardless of whether it arises from any issue you notify to us, and we shall have no liability to pay any money by way of compensation, including without limitation all liability in relation to:
6.2.1 the availability of the Online Service;
6.2.2 any incorrect or inaccurate information on the Online Service and all errors, interruptions to or delays in updating the Online Service;
6.2.3 the infringement by any person of any Intellectual Property Rights of any third party caused by their use of the Online Service;
6.2.4 any amount or kind of loss or damage due to viruses or other malicious software that may infect a user's computer equipment, software, data or other property caused by persons accessing, using or downloading the Online Service; 
6.2.5 all representations, warranties, conditions and other terms which but for this notice would have effect.
6.3 Except as specifically provided in these terms, and to the maximum extent permitted by law:
6.3.1 The Game is provided on an "as is" and “as available” basis without warranty or guarantee of any kind (express or implied) other than those set out in these terms;
6.3.2 We only accept liability for direct loss as a result of our breach of the warranties in Clause 6.1 above;
6.3.3 Our and our licensors’ maximum liability will be limited to €100;
6.3.4 We and our licensors will not in any event be liable in any way for any consequential or indirect loss or damage (save to the extent that damage to your console, PC or other digital content which you own is caused by the Game as a result of our failure to use reasonable care and skill in which case you may be entitled to compensation or we may be obliged to repair your device);
6.3.5 We do not warrant or guarantee that the operation of the Game and/or the Online Service will be uninterrupted or error-free, or that errors can or will be corrected, or that the Game or the Online Service are free of viruses or other harmful components;
6.3.6 You install and use the Game at your own risk.

7. INDEMNISATION ET RECOURS.

7. INDEMNITY AND REMEDIES.

7.1 Vous acceptez par les présentes d’indemniser et de dégager de toute responsabilité Milestone et nos affiliés, cadres, directeurs, propriétaires, concédants de licence, fournisseurs de service, partenaires, sous-traitants, employés, agents et concessionnaires de licences (collectivement, les « Parties indemnisées ») vis-à-vis de toute réclamation, plainte, coût et dépense (y compris les frais juridiques et honoraires d’avocats) encourus par les Parties indemnisées dans le cadre de toute plainte découlant de votre infraction aux présentes Conditions, ou de plaintes résultant directement ou indirectement de votre utilisation ou utilisation non autorisée du Jeu (ce qui inclut les Objets virtuels et le Service en ligne, si de tels objets et service existent) et de tout Contenu utilisateur ; et/ou toute utilisation contrevenant aux présentes Conditions. Vous devrez coopérer avec Milestone dans le cadre de la défense contre de telles plaintes, et nous nous réservons le droit, à nos frais, de prendre en charge la défense et le contrôle de toute question faisant autrement l’objet d’une indemnisation de votre part.
7.2 Vous acceptez également le caractère unique de l’objet de ces Conditions et le fait que nous subirions un préjudice irrémédiable si ces Conditions n’étaient pas appliquées ; par conséquent, vous acceptez que Milestone aura droit, sans obligation ni garantie, ou preuve de dommages, à des recours équitables et appropriés (y compris une mesure injonctive) dans le cadre de toute infraction aux présentes, en plus de tout autre recours à notre disposition conformément aux lois en vigueur.
7.3 Nos concédants de licence sont considérés comme des tiers bénéficiaires des présentes Conditions et ont le droit de faire valoir ces dispositions, et de profiter des avantages de ses protections.

7.1 You hereby indemnify (agree to compensate), defend and hold harmless Milestone and our affiliates, officers, directors, owners, licensors, service providers, partners, contractors, employees, agents and licensees (collectively, the "Indemnified Parties") from and against any and all any liabilities, claims, costs and expenses (including legal expenses and attorney fees) incurred by the Indemnified Parties in connection with any claim arising out of any breach by you of these Terms, or claims arising directly or indirectly from your use or misuse of the Game (which includes Virtual Items and the Online Service, where existing), and any User Content; and/or any use other than that set out in these Terms. You shall fully cooperate with us in the defense of any such claim and we reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you.
7.2 You further agree that the subject matter of these Terms is of a unique character with special value, and that we would suffer irreparable damage if these Terms were not specifically enforced; as a result you agree that we shall be entitled, without bond, other security, or proof of damages, to appropriate equitable remedies (including injunctive relief) with respect to breaches of these Terms, in addition to other remedies as we may otherwise have available under applicable laws.
7.3 Our licensors shall be third-party beneficiaries under these Terms and shall be entitled to enforce its provisions and enjoy the benefits of its protections.

8.2 Le Jeu peut contenir certains éléments sous licence et nos concédants peuvent vouloir protéger leurs droits en cas d’infraction à ces Conditions. Toutes les marques commerciales appartiennent à leurs propriétaires respectifs.

8.1 All right, title, interest and ownership rights in the Game and any copyright, design right, database right, patents and any rights to inventions, know-how, trade and business names, trade secrets and trade marks (whether registered or unregistered) and any related applications and other intellectual property rights (“Intellectual Property Rights”), in or connected with the Game and each part thereof (including, by way of example only, any titles, code, themes, objects, characters, stories, catchphrases, concepts, artworks, animations, sounds, music, audio-visual effects and methods of operation) are owned by, belong to and vest in us or our licensors. 
8.2 The Game may contain certain licensed materials and our licensors may act to protect their rights in the event of any breach of these Terms. All trademarks are the property of their respective owners.

As the Milestone Services and applicable laws evolve, we may – and probably will – update these Terms. When we do, we’ll inform the user of the new agreement which will supersede and replace these Terms. The user will be given an opportunity to review any new agreement we present to them and decide whether they wish to agree to the revised terms. If they accept the new agreement, they’ll be able to continue using the Milestone Services. If they don’t, they won’t be able to use the Milestone Services anymore.
