NÄMÄ EHDOT OVAT LISÄYS SELLAISILLA ALUSTOILLA SOVELLETTAVIIN EHTOIHIN, JOILLA TARJOAMME PELIÄ KÄYTTÖÖN (”ALUSTAN EHDOT”). ALUSTAN YLLÄPITÄJÄT VOIVAT AJOITTAIN PÄIVITTÄÄ OHJELMISTOAAN, JA ME PYRIMME PÄIVITTÄMÄÄN PELIÄ TARVITTAESSA VARMISTAAKSEMME, ETTÄ SEN TOIMIVUUS JA SUORITUSKYKY SÄILYVÄT PÄIVITYKSEN JÄLKEEN, MUTTA MEILLÄ EI OLE VELVOLLISUUTTA TEHDÄ SITÄ. SINUN VELVOLLISUUTESI ON VARMISTAA, ETTÄ KÄYTÄT UUSINTA KONSOLILLESI TAI TIETOKONEELLESI SAATAVILLA OLEVAA YHTEENSOPIVAA JULKISTA KÄYTTÖJÄRJESTELMÄVERSIOTA.<br>PELI SISÄLTÄÄ MILESTONEN JA/TAI SEN LISENSSIN MYÖNTÄJÄN TEKIJÄNOIKEUKSIN SUOJATTUJA TÖITÄ. PELIIN MYÖNNETÄÄN LISENSSI, SITÄ EI MYYDÄ.  LISENSSISI EI TARKOITA PELIN OMISTUSOIKEUDEN SIIRTYMISTÄ.  PELI ON TARKOITETTU AINOASTAAN LOPPUKÄYTTÄJIEN KÄYTTÖÖN NÄIDEN EHTOJEN MUKAISESTI. PELIN KÄYTTÖ, KOPIOOINTI TAI UUDELLEENJAKAMINEN NÄIDEN EHTOJEN VASTAISESTI ON NIMENOMAISESTI KIELLETTY.<br><br>1. RAJOITETTU KÄYTTÖOIKEUS.<br><br>1.1 Milestone myöntää sinulle täten rajoitetun, ei-yksinomaisen oikeuden ja lisenssin pelin lataamiseen, asentamiseen ja käyttöön ainoastaan henkilökohtaisiin, ei-kaupallisiin tarkoituksiin omistamillasi yhteensopivilla konsoleilla tai laitteilla näiden ehtojen mukaisesti.<br>1.2 Nämä ehdot ja pelin käyttösi eivät anna sinulle oikeuksia tai omistusoikeutta mihinkään peliin sisältyvään aineelliseen tai aineettomaan omaisuuteen (mukaan lukien luomasi rata tai pyörän tunnusmaalaus tai räätälöity kuljettaja/pyörä).<br>1.3 Tätä kohtaa sovelletaan, jos tarjoamme pelin käyttöön Steam-alustan (”Steam”) välityksellä, jota ylläpitävät Valve S.A.R.L. (EU:ssa) ja Valve Corporation (Yhdysvalloissa). Siinä tapauksessa tarvitset pelin pelaamiseen Steam-tilin ja Steamin käyttö edellyttää Steam-tilaussopimusta, jonka löydät verkosta täältä.  Steam-tilaussopimus muuttuu ajoittain, ja jos se silloin muuttuu yhteensopimattomaksi tämän loppukäyttäjän lisenssisopimuksen kanssa, Steam-tilaussopimus on etusijalla, mikäli ilmenee ristiriitoja. Steam mahdollistaa hyvityksen saamisen pelistä joissakin tapauksissa.  Voit katsoa tarkemmat tiedot Steamin sivustolta täältä: Steamin hyvitykset.<br>1.4 Jos asennat pelin tai pelaat sitä kolmannen osapuolen kanssa, mukaan lukien PlayStation®-, Microsoft Xbox-, Nintendo-, Amazon Luna- ja Epic Games Store -alustat mutta niihin rajoittumatta, kaikkia näiden alustojen ehtoja sovelletaan.<br>1.5 Sinä ja me vahvistamme, että nämä ehdot koskevat vain sinua ja meitä, eivät Apple Inc:a eivätkä Apple Inc:n tytär- tai sisaryhtiöitä. Vahvistat myös, että olemme yksin vastuussa pelistä ja sen sisällöstä.<br>1.6 Jos pelaat Android-laitteella, pelin käyttösi voi edellyttää Google-tiliä. Pelin käyttösi on yhteydessä Google-tiliisi, ja pelin käyttösi edellyttää sinulta Googlen käytäntöjen noudattamista.  <br><br>2. LOPPUKÄYTTÄJÄN VELVOLLISUUDET.<br><br>2.1	Voit käyttää peliä omiin henkilökohtaisiin, ei-kaupallisiin tarkoituksiisi näissä ehdoissa kuvatulla tavalla, mutta sinulla ei ole oikeutta etkä saa tehdä mitään seuraavista, ellei sitä ole nimenomaisesti sallittu näissä ehdoissa:<br>2.1.1 myydä, siirtää, kopioida, kääntää, kommunikoida, purkaa, julkaista, suoratoistaa, jaella, vuokrata, lainata, alilisensoida, muokata, muuntaa, yhdistää tai hajottaa peliä, selvittää sen lähdekoodia, luoda johdannaistuotteita sen pohjalta tai muulla tavoin siirtää tai välittää pelin tai sen osien kopioita muille osapuolille millään tavalla, paitsi silloin kun peli nimenomaisesti sallii sen jakamalla sisältöä pelistä sosiaalisessa mediassa;  <br>2.1.2 muokata, muuntaa tai vahingoittaa tekijänoikeus-, tavaramerkki- tai muuta ilmoitusta;<br>2.1.3 osallistua mihinkään toimintaan, jonka katsomme olevan ristiriidassa pelin tai online-palvelun hengen tai tarkoituksen kanssa, mukaan lukien rajoituksitta sellaisten huijausten, hyväksikäyttöjen, automaattiohjelmistojen, botien, tietomurtojen, muokkausten tai valtuuttamattomien kolmansien osapuolten ohjelmien käyttö, jotka on suunniteltu pelin muokkaamiseen tai häiritsemiseen;<br>2.1.4 yrittää saada valtuuttamatonta käyttöoikeutta online-palveluun tai online-palveluun yhdistettyihin laitteisiin, palvelimiin tai verkkoihin millään muulla tavoin kuin tarjoamamme käyttöliittymän välityksellä; tai<br>2.1.5 käyttää peliä laittomiin tai moraalittomiin tarkoituksiin.   <br>2.2 Tuotteita ei saa käyttää, viedä tai uudelleenviedä muutoin kuin Yhdysvaltojen lain sekä sen oikeudenkäyttöalueen lakien mukaisesti, josta palvelut on hankittu. Erityisesti, mutta ei rajoittuen, pelejä ei saa viedä, uudelleenviedä tai saattaa muutoin käytettäväksi (a) mihinkään maahan tai millekään alueelle, jota koskee Yhdysvaltojen hallituksen asettama kauppakielto, tai (b) kenellekään henkilölle, joka on lisätty Yhdysvaltojen valtiovarainministeriön erikseen nimettyjen kansallisten pakotteiden luetteloon (Specially Designated Nationals List) tai Yhdysvaltojen kauppaministeriön kiellettyjen henkilöiden tai osapuolien luetteloon (Denied person List tai Entity List) tai EU:n yhdistettyyn luetteloon seuraamusten alaisista henkilöistä. Pelejä käyttämällä ilmoitat ja takaat, että et oleskele kyseisissä maissa tai ettet ole millään kyseisistä luetteloista.<br><br>3. SOPIMUKSEN IRTISANOMINEN.<br><br>3.1 Nämä ehdot ja sinulle myöntämämme lisenssit ovat voimassa, kunnes ne irtisanotaan.<br>3.2 Voit irtisanoa nämä ehdot milloin tahansa ja mistä tahansa syystä poistamalla pelin konsolistasi tai tietokoneeltasi.  <br>3.3 Voimme irtisanoa nämä ehdot milloin tahansa, jos et noudata niitä, tai mistä tahansa syystä tai jos meillä on järkevä syy epäillä, ettet ole noudattanut jotain näistä ehdoista.  Voimme ryhtyä täysin oman harkintamme mukaan kohtuullisina pitämiimme toimiin sellaisia käyttäjiä vastaan, jotka eivät noudata näitä ehtoja, mihin voi sisältyä käyttäjien kieltäminen käyttämästä peliä ja/tai online-palvelua. Lisätietojen saamiseksi mahdollisista rikkomuksista, joita saatatte tehdä, pyydämme lukemaan erittäin tarkasti ja kokonaisuudessaan kappaleen 5.11 ”Käyttäjäsisältöä koskevat säännöt”. Milestone varaa oikeuden keskeyttää käyttäjän käyttöoikeus saatujen . rikkomusilmoitusten tyypin ja etenkin määrän perusteella vaihtelevaksi ajaksi: yhdeksi tai kolmeksi päiväksi, viikoksi, kahdeksi viikoksi, kuukaudeksi. Tämän viimeisen rajoituksen täytyttyä saattaa keskeytys jäädä pysyväksi.<br>3.4 Milestone pidättää itsellään oikeuden määrittää, millaista käytöstä se pitää näiden ehtojen, pelin ja/tai online-palvelun tai niiden tarkoituksen tai hengen vastaisena. Jos tekemäsi rikkomus kuitenkin on korjattavissa, annamme sinulle kohtuullisen mahdollisuuden tehdä niin. <br>3.5 Irtisanomisen jälkeen sinulla ei ole enää oikeutta käyttää peliä ja sinun on poistettava peli konsolistasi tai laitteestasi.<br>3.6 Milestonen palvelut eivät ole enää käytettävissä jollain tietyllä alueella. Jos tällainen olosuhde toteutuu, Milestone antaa tilanteesta tiedotteen Internet-sivustollaan ja/tai itse pelissä ilmoittaakseen pelin tai kaikkien Milestonen palvelujen olennaisen toiminnon keskeytyksestä jollain tietyllä alueella.<br><br>4. ONLINE-PALVELU.<br><br>4.1 Milestone saa, mutta sillä ei ole velvollisuutta, tarjota ja ylläpitää tiettyjä online-toimintoja, online-verkkopeliyhteyksiä ja interaktiivisuutta sekä muita peliin liittyviä online-toimintoja, mukaan lukien online-pelitilat Single Event ja Custom Championship (”online-palvelu”) näiden ehtojen mukaisesti.<br>4.2 Emme voi taata, että online-palvelu tai tietty osa siitä, mukaan lukien mahdollinen käyttäjäsisältö, on aina käytettävissä. <br>4.3 Online-palvelu on tarkoitettu ainoastaan henkilökohtaiseen käyttöön, sellaisenaan, ja kaiken käytön on oltava näiden ehtojen mukaista.<br><br>Ikärajoitukset<br>4.4 Pelaamista varten on hyväksyttävä Milestonen ja käyttäjän välinen sopimus sekä Milestonen tietosuoja- ja evästekäytännöt. Online-toimintoihin pääsemiseen tarvitaan Internet-yhteys sekä alustan käyttäjätili, minkä lisäksi rekisteröinnin suorittajan tulee olla vähintään 13-vuotias.<br><br>Käyttäjää koskevat säännöt<br>4.5 Lisäksi lupaat, ettet käyttäydy millään tavalla laittomasti tai tavalla, josta aiheutuu siviili- tai rikosoikeudellinen vastuu tai joka voisi vaikuttaa haitallisesti meidän tai pelin maineeseen. <br>4.6 Jos peli antaa sinun jakaa ennalta määritettyjä viestejä muiden käyttäjien kanssa, meillä on oikeus poistaa, rajoittaa, lykätä tai muuttaa tätä mahdollisuutta mistä tahansa syystä täysin oman harkintamme mukaan.  <br>4.7 Toimit täysin yhteistyössä kanssamme epäillyn laittoman, vilpillisen tai epäasianmukaisen toiminnan tutkinnassa.<br>4.8 Jos sinusta tuntuu, että toisen käyttäjän käytös on näiden ehtojen vastaista, ilmoita siitä meille ottamalla yhteyttä tukipalvelujen kautta ja kertomalla tarkemmin mahdollisesta rikkomuksesta ja/tai siitä vastuussa olevasta käyttäjästä. Ryhdymme kohtuullisiin toimiin mahdollisen rikkomuksen käsittelemiseksi. <br><br>Huomaa: <br>Jos käytät mahdollista online-palvelua, teet sen täysin omalla vastuullasi. Internetin käytön tunnettu riski on, että ihmiset eivät välttämättä kerro oikeaa henkilöllisyyttään. He saattavat antaa tietoja tai käyttäytyä epäluotettavalla, harhaanjohtavalla tai laittomalla tavalla. Milestone ei pysty kertomaan, pitävätkö pelin ja/tai online-palvelun muiden käyttäjien väitteet paikkansa vai eivät. Vain sinä voit päättää tämän asian, ja jonkinasteinen varovaisuus on suositeltavaa. Pelaamalla peliä ja käyttämällä online-palvelua ja sen osia hyväksyt tämän tosiasian sekä siihen liittyvän riskin. Käyttäjien on oltava erityisen varovaisia omien henkilötietojensa paljastamisen suhteen.<br><br>5. KÄYTTÄJÄSISÄLLÖN LUOMINEN JA PERSONOINTI.<br><br>5.1 Peliin saattaa kuulua editoritoiminto, joka sallii sinun tai muiden pelin käyttäjien luoda käyttäjäsisältöä (seuraavassa art. 5.1.1 määritetyllä tavalla) pelissä käytettäväksi, ladattavaksi, jaettavaksi, käyttöön tarjoamiseksi tai lähettämiseksi online-palveluun itsellesi ja/tai muille pelaajille. Lisäksi sinulla on mahdollisuus lähettää viestejä meille tai kolmansille osapuolille ja/tai toimittaa käyttäjäsisältöjä ja/tai tietoja niiden käyttämiseksi pelin sisäisesti tai muutoin joko meidän tai kolmansien osapuolien toimesta.<br><br>Näiden ehtojen tarkoituksissa:<br>5.1.1 ”Käyttäjäsisältöihin” (yksikössä “käyttäjäsisältö”) kuuluu kaikki sisältö, jonka olet luonut editoritoiminnoilla, jotka voidaan sisällyttää peliin, kuten esimerkiksi mutta ei pelkästään, radat, pyörien tunnusmaalaukset, kypärät, tarrat, kuljettajan tarrat, numerot, kilpa-asut ja ajoneuvot, jotka olet ladannut, tarjonnut käyttöön tai lähettänyt online-palveluun itseäsi ja/tai muita käyttäjiä varten pelissä käytettäviksi.<br>5.1.2 ”Jakelu” tarkoittaa käyttöä, myyntiä, markkinointia, myynninedistämistä, loppukäyttäjille alilisensointia, jakelua ja muutoin kolmansien osapuolten käyttöön tarjoamista.<br>5.2 VAIN pelin ja online-palvelun (siellä, missä tämä palvelu on olemassa) käytön yhteydessä ja näiden ehtojen mukaan saat (ja sinulle myönnetään rajoitettu, ei-yksinomainen lisenssi ja oikeus) käyttää ohjelmistoa, joka muodostaa osan pelistä ja online-palvelusta muiden pelin käyttäjien kanssa kommunikointia varten online-palvelua käyttäen sekä käyttäjäsisältöjen julkaisua, lähettämistä, kommunikointia ja käyttöön tarjoamista varten. Näin toimiessasi myönnät meille rajoittamattoman, siirrettävän, alilisensoitavan, maksuttoman, jatkuvan, peruuttamattoman, ei-yksinomaisen oikeuden ja lisenssin tällaisten käyttäjäsisältöjen käyttöön ja käyttöön tarjoamiseen pelin yhteydessä millä tavalla ja medialla tahansa.<br>5.3 Olemme sitoutuneet pelin markkinointi- ja julkaisutoimintaan sekä siihen liittyvien viihdepalveluiden tarjoamiseen online-palvelun muodossa. Sen lisäksi olemme sitoutuneet käyttäjäsisältöjen lähettämiseen, tallentamiseen, noutamiseen, ylläpitämiseen, muotoiluun tai kääntämiseen valitsematta tai muuttamatta sisältöä kommunikaatiossa, jossa toimimme vain kanavana. <br>5.4 Asentamalla pelin ja käyttämällä sitä suostut siihen ja hyväksyt sen, että meillä ei ole velvollisuutta tarkastaa mahdollista käyttäjäsisältöä, joka luovutetaan käyttöömme sillä periaatteella, että meiltä ei vaadita minkäänlaista sisällön tai julkaistun tai sisältöön kuuluvan materiaalin tarkistamista tai arviointia. Epäilyjen välttämiseksi käyttäjäsisällössä ilmaistut mielipiteet tarkoittavat yksittäisten tekijöiden eivätkä Milestonen mielipiteitä, ellemme ole erikseen maininneet muuta. Erityisesti, mutta edellä olevaa rajoittamatta, emme ole vastuussa ja kieltäydymme kaikesta vastuusta missä tahansa käyttäjäsisällössä ilmaistujen kommenttien, mielipiteiden tai huomautusten osalta. <br>5.5 Meillä on oikeus poistaa, rajoittaa, keskeyttää tai muuttaa käyttäjäsisältöä (ja mahdollisuutta jakaa tai luoda käyttäjäsisältöjä) mistä tahansa syystä ja täysin oman harkintamme mukaan.<br>5.6 Suostut siihen, että saatamme käyttää, julkaista, muokata, muuttaa ja mukauttaa käyttäjäsisältöä, jota tarjoat käyttöön, julkaiset tai lähetät peliin ja/tai online-palveluun mistä tahansa syystä oman harkintamme mukaan.<br>5.7 Niiltä osin, kuin käyttäjäsisältö on peräisin pelistä tai meidän tarjoamastamme materiaalista, luovutat täten meille kaikki immateriaalioikeudet, jotka liittyvät omistamaasi käyttäjäsisältöön. Tähän sisältyvät kaikki luotuun käyttäjäsisältöön liittyvät immateriaalioikeudet.<br>5.8 Emme takaa emmekä esitä mitään väitteitä käyttäjäsisällön tai online-palvelun sisältämien tietojen ja materiaalien paikkansapitävyydestä, ajankohtaisuudesta tai voimassaolosta, emmekä vastaa mahdollisista menetyksistä tai vahingoista, joita aiheutuu tällaisten tietojen tai materiaalien käytöstä. <br>5.9 Jos havaitset käyttäjäsisältöä, jonka katsot olevan näiden ehtojen vastaista, pyydämme ilmoittamaan siitä meille ottamalla yhteyttä tukipalvelun kautta ja ilmoittamalla samalla tarkat tiedot käyttäjäsisällöstä.<br><br>Käyttäjäsisältöä koskevat säännöt (voimassa silloin, kun online-palvelu on käytössä)<br>5.10 Hyväksyt ja lupaat, että sinulla on oikeus tarjota käyttöön, julkaista tai lähettää peliin käyttäjäsisältöjäsi, ja myöntää meille kohdassa 5.8 määritetyt oikeudet etkä tarjoa käyttöön, julkaise etkä lähetä peliin väitteitä, materiaalia tai muuta käyttäjäsisältöä etkä käytä online-palvelua tai peliä tavalla, joka:<br>5.10.1 on loukkaava, kapinahenkinen, pornografinen, aggressiivinen, homofobinen, halventava, herjaava, valheellinen, vihamielinen, syrjivä, siveetön, vastenmielinen, kiihottava, seksistinen tai rasistinen;<br>5.10.2 häiritsee, kiusaa tai pelottelee jotakuta tai sekoittaa tai haittaa toisten käyttäjien kykyä kommunikoida tai lukea keskusteluja (tähän sisältyy makrojen/roskapostin lähettäminen yleiseen pelaajatietokantaan tai yksittäiselle henkilölle keskustelun häiritsemiseksi);<br>5.10.3 rikkoo kenen tahansa henkilön immateriaali- tai muita oikeuksia (paitsi siinä määrin, kuin käyttäjäsisältö on peräisin pelistä tai toimittamastamme materiaalista);<br>5.10.4 sisältää riistävää käyttäytymistä muun muassa kolmansien osapuolten ohjelmien, botien, skriptien, virusten tai muiden keinojen avulla, jotka me olemme kerta kerralta kohtuudella kieltäneet tai jotka hyödyntävät vikoja, tahattomia virheitä tai ominaisuuksia, joita ei ole dokumentoitu, päästäkseen pelin rajoitettuihin osiin, tai jotka muutoin muodostavat aktiviteetin, jonka me voimme kohtuudella katsoa olevan pelin hengen vastainen;<br>5.10.5 kannustaa näiden ehtojen tai ulkopuolisen palveluntarjoajan palveluehtojen rikkomiseen;<br>5.10.6 on lainvastainen, pahansuopa, harhaanjohtava (imitointi mukaan lukien) tai syrjivä tai josta aiheutuu siviili- tai rikosoikeudellinen vastuu tai joka saattaa heikentää Milestonen, online-palvelun tai pelin mainetta;<br>5.10.7 rikkoo kolmannen osapuolen immateriaali- tai muita oikeuksia tai edistää tällaista rikkomusta tai kannustaa siihen tai sisältää pelaajan henkilötietojen jakelua (muiden kuin omien, yksityisviestinä);<br>5.10.8 on teknisesti haitallinen, kuten tietokonevirusten, matojen, ehdollisten pommien tai muiden haitallisten ohjelmien tai tietojen liikkeeseenlasku tai muut pyrkimykset todella muokata tai häiritä peliä tai keskeyttää mikä tahansa pelin käyttämä tietokone tai palvelin;<br>5.10.9 voidaan katsoa markkinointi- tai kaupalliseksi viestinnäksi;<br>5.10.10 edistää laitonta tai lainvastaista aktiviteettia, mukaan lukien mutta ei niihin rajoittuen, painostus, uhkapeli tai reseptilääkkeiden myynti;<br>5.10.11 on suunnattu alle 18-vuotiaille tai etsii tai yrittää etsiä keinoja tavoittaa alle 18-vuotias henkilö;<br>5.10.12 sisältää rajoitettua materiaalia, mukaan lukien salasanat, lääketieteelliset tiedot tai luottamukselliset tiedot kenestä tahansa, mutta niihin rajoittumatta; tai<br>5.10.14 pyytää, kutsuu, kannustaa, yllyttää tai provosoi johonkin edellä mainituista tai kaikkiin niistä tai puolustaa niitä.<br><br>Käyttäjäsisällöt, joita on mahdollista luoda Editorilla (koskee tilanteita, joissa on käytettävissä online-palvelu)<br>5.11 Yllä olevan kohdan 5.8 perusteella myönnät meille luomiesi ja online-palveluun lataamiesi käyttäjäsisältöjen ei-yksinomaisen, maksuttoman, jatkuvan, peruuttamattoman, maailmanlaajuisen oikeuden ja lisenssin:<br>5.11.1 jakaa käyttäjäsisältöä online-palvelun kautta;<br>5.11.2 käyttää ja tarjota käyttöön näyttökuvia ja videokatkelmia käyttäjäsisällöstä sekä luoda ja tarjota käyttöön myynninedistämis- ja markkinointimateriaalia (myös ulkopuolisten palveluiden välityksellä) haluamallamme tavalla luomasi radan tai pyörän tunnusmaalauksen, pelin ja/tai online-palvelun myynnin edistämiseksi kaikissa medioissa;<br>5.11.3 jakaa käyttäjäsisällön esityksiä tai ilmaisversioita yksinomaan personoidun käyttäjäsisällön tarkastelu-, myynninedistämis- ja markkinointitarkoituksiin; ja; <br>5.11.4 käyttää mitä tahansa tavaramerkkiä tai kauppanimeä, jolla sinut tai käyttäjäsisältösi tunnetaan alla kuvatun käyttäjäsisällön jakelun yhteydessä. 	<br>5.12 Takaat ja vakuutat meille, että (sillä ehdolla, että käyttäjäsisältö on peräisin pelistä tai Milestonen toimittamasta materiaalista);<br>5.12.1 olet käyttäjäsisällön sekä kaikkien sen sisältämien immateriaalioikeuksien omistaja tai lisenssinhaltija;<br>5.12.2 sinulla on täydet valtuudet sitoutua näihin ehtoihin ja myöntää niihin liittyvät oikeudet, lisenssit ja toimeksiannot ja että sinulla on kaikki tarpeelliset lisenssit ja toimeksiannot, jotka siihen tarvitaa;<br>hyvität (lupaat korvata) Milestonelle kaikki toimet, vaatimukset, oikeudenkäynnit, kustannukset ja vahingot (mukaan lukien vahingonkorvaukset tai korvaukset, joita maksamme sen lainopillisille neuvonantajille reklamaation sopimiseksi) sekä kaikki juridiset kulut tai muut kustannukset, joita aiheutuu edellä mainittujen takuuehtojen tai näiden ehtojen rikkomisesta, sekä estät niistä sille aiheutuvat haitat.<br><br>6. TAKUU JA VASTUUN RAJOITUS.<br><br>Vakuutamme, että olemme pyrkineet ja pyrimme jatkossakin kohtuullisin keinoin varmistamaan:<br>6.1.1 että meillä on oikeus myöntää tässä myönnettävät oikeudet ja lisenssit;<br>6.1.2 että pelin laatu on tyydyttävä;<br>6.1.3 että olemme pyrkineet ja pyrimme jatkossakin kohtuullisin keinoin varmistamaan, että peli ja/tai online-palvelu ovat käytettävissä kuuden (6) kuukauden ajan pelin ostopäivästä lukien; ja<br>6.1.4 että meidän tarjoamamme online-palvelu on laadultaan tyydyttävä, kuvauksen mukainen ja tarkoitukseen sopiva.<br>6.2 Suurimmassa lain sallimassa määrin ja ellei näissä ehdoissa nimenomaisesti muuta mainita, emme anna takuuta online-palvelun yhteydessä ja suljemme pois vastuun kaikenlaisista menetyksistä tai vahingoista, joita aiheutuu rajoituksitta suorista, epäsuorista, rankaisevista tai välillisistä menetyksistä riippumatta siitä, johtuvatko ne meille ilmoittamastasi ongelmasta, eikä meillä ole velvollisuutta maksaa vahingonkorvausta rahana, mukaan lukien rajoituksitta kaikki vastuu, joka liittyy:<br>6.2.1 online-palvelun käytettävyyteen;<br>6.2.2 online-palvelun virheellisiin tai epätarkkoihin tietoihin ja kaikkiin virheisiin, katkoksiin tai viiveisiin online-palvelua päivitettäessä;<br>6.2.3 kenen tahansa suorittamaan kolmannen osapuolen immateriaalioikeuksien rikkomiseen online-palvelua käyttämällä;<br>6.2.4 määrästä tai laadusta riippumatta mihin tahansa viruksista tai muista haittaohjelmista johtuvaan menetykseen tai vahinkoon silloin, kun ne saattavat tarttua käyttäjän ATK-laitteisiin, ohjelmistoihin, dataan tai muuhun omaisuuteen ihmisten käyttäessä tai ladatessa online-palvelua; <br>6.2.5 kaikkiin väitteisiin, takuihin, edellytyksiin ja muihin ehtoihin, jotka olisivat voimassa ilman tätä ilmoitusta.<br>6.3 Ellei muuta näissä ehdoissa nimenomaisesti mainita ja suurimmassa lain sallimassa määrin:<br>6.3.1 peli toimitetaan ”sellaisenaan” ja ”saatavuuden mukaan” ilman minkäänlaista (nimenomaista tai välillistä) takuuta näissä ehdoissa määritettyjen lisäksi;<br>6.3.2 Otamme vastuun ainoastaan suorista menetyksistä, jotka johtuvat siitä, että olemme rikkoneet edellä kohdassa 6.1 mainittuja takuuehtoja;<br>6.3.3 Meidän ja lisenssinantajiemme enimmäisvastuu on 100 €;<br>6.3.4 Me ja lisenssinantajamme emme missään tilanteessa ole millään tavalla vastuussa välillisistä tai epäsuorista menetyksistä tai vahingoista (paitsi niiltä osin kuin konsolillesi, tietokoneellesi tai muulle omistamallesi digitaaliselle sisällölle aiheutunut vahinko johtuu pelistä seurauksena siitä, ettemme ole olleet kohtuullisen huolellisia ja taitavia, jolloin sinulla saattaa olla oikeus korvaukseen tai meillä voi olla velvollisuus korjata laitteesi);<br>6.3.5 Emme vakuuta emmekä takaa, että pelin ja/tai online-palvelun toiminta olisi keskeytymätöntä tai virheetöntä tai että virheet voidaan korjata tai korjataan tai että pelissä tai online-palvelussa ei olisi viruksia tai muita haitallisia komponentteja;<br>6.3.6 Asennat pelin ja käytät sitä omalla vastuullasi.<br><br>7. Sitoudut täten korvaamaan (lupaat kompensoida) Milestonelle ja sisaryhtiöillemme, toimihenkilöillemme, johtajillemme, omistajillemme, lisenssinantajillemme, palveluntarjoajillemme, kumppaneillemme, alihankkijoillemme, työntekijöillemme, välittäjillemme ja lisenssinhaltijoillemme (yhteisesti ”korvaukseen oikeutetuille osapuolille”) kaikki mahdolliset vastuut, vahingot, kustannukset ja kulut (juridiset kulut ja asianajajien palkkiot mukaan lukien), joita korvaukseen oikeutetuille osapuolille aiheutuu näiden ehtojen rikkomisestasi tai vahingoista, joita aiheutuu suoraan tai välillisesti pelin (virtuaaliset tuotteet ja mahdollinen online-palvelu mukaan lukien) käytöstäsi tai väärinkäytöstäsi, käyttäjäsisällöstä ja/tai muusta näiden ehtojen vastaisesta käytöstä, puolustamaan heitä niiltä ja estämään heille niistä aiheutuvat vahingot. OMISTUSOIKEUS. <br><br>8.1 Me tai lisenssinantajamme omistamme kaikki pelin ja sen osien sisäiset ja siihen liittyvät oikeudet, omistusoikeudet ja hyödyt sekä tekijänoikeudet, designoikeudet, tietokantaoikeudet, patentit ja oikeudet keksintöihin, taitotietoon, tuotenimiin ja toiminimiin, liikesalaisuuksiin ja tavaramerkkeihin (olivatpa ne rekisteröityjä tai eivät) ja niihin liittyviin sovelluksiin sekä muut immateriaalioikeudet (”immateriaalioikeudet”) (mukaan lukien esimerkiksi ainoastaan otsikot, koodi, teemat, objektit, hahmot, tarinat, iskulauseet, käsitteet, taideteokset, animaatiot, äänet, musiikki, audiovisuaaliset tehosteet ja käyttötavat), ne kuuluvat ja on uskottu meille. <br>8.2 Peli voi sisältää tiettyjä lisensoituja materiaaleja, ja lisenssinantajamme voivat toimia suojellakseen oikeuksiaan, mikäli näitä ehtoja rikotaan. Kaikki tavaramerkit ovat omistajiensa omaisuutta.<br><br>9. MÄÄRÄYSTEN ITSENÄISYYS.<br><br>Mikäli oikeus tai muu toimivaltainen tuomioistuin katsoo, että jokin näiden ehtojen kohta on täytäntöönpanokelvoton, kyseinen kohta pannaan täytäntöön niin suurelta osin kuin se on sallittua ja loput näistä ehdoista pysyvät täysimääräisesti voimassa. <br><br><br>10. For more information about the kind of infraction you could commit, we recommend you to carefully read the entire paragraph 5.11 “User Content Rules”. Based on the type but especially on the number of reports received, Milestone reserves the right to suspend a user for the following days: one day, three days, seven days, fifteen days, one month. Once the latter is exceeded, it’s possible to incur a permanent suspension.<br>3.4 Milestone reserves the right to determine what conduct it considers to be in violation of, or otherwise outside the intent or spirit of, these Terms and/or the Game and/or the Online Service. However, if your action can be rectified, we shall give you reasonable opportunity to do so. <br>3.5 Following termination, you will no longer be permitted to use any of the Game and you will be required to delete the Game from your console or device.<br>3.6 Milestone Services are no longer available in a region. Should such a circumstance occur, we will publish a communication on our website and/or in the game itself, reporting the interruption of a core feature of a game or all of the Milestone Services in a region.<br><br>4. ONLINE SERVICE.<br><br>4.1 Milestone may, but shall not be obliged to, provide and maintain certain online functions, online network play connectivity and interactivity, and other online features relating to the Game subject to these Terms. These shall include, by way of example, the online ‘Single Event’ and ‘Custom Championship’ game modes (“Online Service”).<br>4.2 We cannot guarantee that the Online Service or a particular part of the Online Service, including any User Content, will always be available. <br>4.3 The Online Service is for personal use only, on an “as is” basis and all use must be in accordance with these Terms.<br><br>Age Restrictions<br>4.4 To be able to play, you must first accept the Milestone user agreement and confirm that you have read MIlestone's privacy and cookie policy. In order to use online functions, you must have an Internet connection and an account on the platform; it is also necessary for a person aged at least thirteen to complete the registration process.<br><br>User Rules<br>4.5 You also agree that you will not in any way behave in a manner which is unlawful or which gives rise to civil or criminal liability, or which might call us or the Game into disrepute. <br>4.6 Where the Game allows you to share pre-determined messages with other users, we shall be entitled to remove, restrict, suspend or alter that ability for any reason at our sole and absolute discretion.  <br>4.7 You will cooperate fully with us to investigate any suspected unlawful, fraudulent or improper activity.<br>4.8 If you feel that the behavior of another user breaches these Terms, please let us know by contacting us via the Support Services with details of the potential breach and/or the user responsible. We will take reasonable steps to deal with any breach. <br><br>Please note: <br>Where the Online Service is available, you use it at entirely your own risk. It is a known risk of internet usage that people are not necessarily who they say they are. People may provide information or behave in a way that is unreliable, misleading, unlawful or illegal. Milestone has no way of telling if statements made by other users of the Game and/or the Online Service are true. This is a decision that can only be made by you, and we recommend exercising caution. By playing the Game and using the Online Service and its parts, you accept that this is the case and accept the associated risk. Users must take particular care in relation to the disclosure of their own personal information.<br><br>5. CREATION AND CUSTOMISATION OF USER CONTENT.<br><br>5.1 the definition of “User Contents” (singular “User Content”) includes any content created by the user through any editor functions which might be included in the Game including, but not limited to, tracks, liveries, helmets, decals, pilot stickers, numbers, suits and vehicles, and which are uploaded, made available or sent by the user to the Online Service, for their own purposes and/or for other users to utilise in the Game.<br><br>For the purposes of these Conditions:<br>5.1.1 The definition of “User Contents” (singular “User Content”) includes any content created by the user through any editor functions which might be included in the Game including, but not limited to, tracks, liveries, helmets, decals, pilot stickers, numbers, suits and vehicles, and which are uploaded, made available or sent by the user to the Online Service, for their own purposes and/or for other users to utilise in the Game.<br>5.1.2 "Distribute" means to use, sell, market, promote, sub-license to end-users, distribute or otherwise make available to third parties.<br>5.2 In relation to the SOLE use of the Game and Online Service (where this service exists) and pursuant to these Terms and Conditions, the user may (and is granted a limited, non-exclusive licence and the right to) use the software that is part of the Game and Online Service to communicate with other users of the Game via the Online Service, and to publish User Content and transmit, communicate and make it available. In this way, the user hereby grants us an unlimited, transferable, sub-licensable, royalty-free, perpetual, irrevocable, non-exclusive licence to use and make available any such User Content in connection with the Game, in any manner or media. <br>5.3 We are committed to marketing and publishing the Game and providing its associated entertainment services in the form of the Online Service. Additionally, we engage in the transmission, storage, retrieval, hosting, formatting or translation of User Content without selection or alteration of the communication content, for which we merely serve as a conduit.<br>5.4 By installing and using the Game, the user agrees and confirms that we are not responsible for reviewing any User Content made available, as we will not be required to exercise any control or give any judgement in relation to the content or published material, or its substance. For the purposes of avoiding any misunderstandings, the opinions expressed in any User Content represent the opinions of the individual authors, and not those of Milestone, unless otherwise specified by us. In particular, but without limitations to the above, we cannot be held responsible, and decline any liability for comments, opinions or observations expressed in any User Content. We shall be entitled to remove, restrict, suspend or alter any User Content (and the ability to share or create User Content, including any Track or Bike Livery) for any reason at our sole and absolute discretion.<br>5.5 We have the right to remove, limit, suspend or alter any User Content (and the ability to share or create User Content) for any reason, at our sole and absolute discretion.<br>5.6 The user accepts that we can use, publish, amend, vary and adapt any User Content which the user should make available, publish or transmit to the Game and/or the Online Service for any reason, at our sole discretion. <br>5.7 To the extent that User Content derives from the Game or material supplied by us, the user hereby assigns us all intellectual property rights subsisting in the User Content which are owned by them, including all intellectual property rights in any User Content created by them.<br>5.8 We do not supply any guarantee, and shall not issue any declaration regarding the accuracy, evaluation or validity of the information and material contained in the User Content or Online Service; nor can we be held responsible for any losses or damage caused by the use of said information or material.<br>5.9 If the user discovers any User Content which they feel contravenes these Terms and Conditions, we would ask them to notify us via support Services and submit details of the User Content concerned..<br><br>User Rules of User Content (applicable where the Online Service exists)<br>5.10 The user agrees and undertakes to have the right to make available, or publish or transmit, their User Contents to the Game, and to grant us the rights specified in clause 5.8. The user shall not make available, nor indeed publish or transmit to the Game, any statement, material or other User Content, or use the Online Service or Game in any way which:<br>5.10.1 is abusive, seditious, pornographic, aggressive, homophobic, defamatory, false, instigates hatred, is discriminatory, obscene, offensive, provocative, sexist or racist;<br>5.10.2 molests or intimidates any person, or inhibits or prevents the ability of other users to communicate or read conversations (including the use of any macros/SPAM for the general base of gamers, or a single individual, in order to interrupt the chat);<br>5.10.3 breaches any Intellectual Property Right or other rights of any person (on condition that the User Content is derived from the Game or the material supplied by us);<br>5.10.4 gives rise to any behaviour involving exploitation through, but not limited to, third-party programmes, bots, scripts, viruses or other means reasonably prohibited by us on an as-and-when basis, or that exploits bugs, unforeseen errors or undocumented features to access restricted parts of the game, or otherwise engages in activities that we reasonably deem are contrary to the "spirit" of the Game;<br>5.10.5 encourages any breach of these Terms and Conditions, or the terms of service of a third-party service provider;<br>5.10.6 are Illegal, malicious, misleading (including impersonation), discriminatory, or give rise to civil or criminal liability, or which might jeopardise the reputation of Milestone, the Online Service or the Game;<br>5.10.7 breaches the intellectual property or other rights of third parties, or facilitates or encourages such a breach, or involves the distribution of personal information of any gamer (other than one’s own, such as private messages);<br>5.10.8 is technically damaging, such as introducing computer viruses, worms, logic bombs or other harmful software or data, or otherwise attempting or effectively modifying or interfering with the Game, or overloading or disrupting any computer or server used by the Game;<br>5.10.9 may be considered commercial or marketing communication;<br>5.10.10 promotes illegal or unlawful activities, including but not limited to solicitation, gambling or the sale of prescription medication;<br>5.10.11 is directed at individuals under the age of 18 or those seeking or attempting to arrange to meet a person under the age of 18;<br>5.10.12 contains any restricted material, including but not limited to passwords, medical information or confidential information of any person; <br>5.10.13 constitutes, in our reasonable opinion, misuse of the Game or an attempt to gain unauthorised access to the Game or its parts, or the accounts of other users or networks, or their console or device; or<br>5.10.14 solicits, invites, encourages, supports, incites or provokes - in whole or in part - any of the above.<br><br>User Contents which can be created using the Editor (applicable where the Online Service exists)<br>5.11 According to Clause 5.8 above, in relation to any User Content created and uploaded by the user on the Online Service, the user shall grant us the right and licence, on a non-exclusive basis, which shall be deemed free of royalties, perpetual and irrevocable, on a worldwide basis, for:<br>5.11.1 distributing their User Content via the Online Service;;<br>5.11.2 using and making available screenshots and video sequences of their User Content, and creating and making available (also through third-party services) any such further promotional and marketing materials at our discretion, for the purposes of promoting the Track or Livery of the motorcycle they have created, the Game and/or the Online Service on all media;<br>5.11.3 distributing the demo or free versions of the User Content with an end to reviewing, promoting and marketing solely the customised User Content; and; <br>5.11.4 using any commercial brand or commercial name of which the user is aware, or their User Content in relation to the distribution of the User Content below. 	<br>5.12 The user guarantees and declares the following to us (on condition that the User Content derives from the Game, or the material supplied by Milestone):<br>5.12.1 that they are the owner or licence holder of the User Content, and all the Intellectual Property Rights pertaining to it;<br>5.12.2 that they have the full power to enter into these Conditions and the Terms herein, and are entitled to grant the rights, licences and assignments contained in them, and that they hold all licences and assignments required to do so;<br>5.13 The user shall indemnify (agree to compensate) and hold Milestone harmless against all actions, claims, proceedings, costs and damages (including any damages or settlements paid by us on the advice of our legal advisors to settle or resolve any claim), and all legal fees or other expenses arising from any breach of the above warranties, or these Terms and Conditions.<br><br>6. WARRANTY AND LIMITATION OF LIABILITY.<br><br>6.1 We warrant that we have used and will use reasonable efforts to ensure that:<br>6.1.1 we are entitled to grant the rights and licenses granted herewith;<br>6.1.2 the Game will be of satisfactory quality;<br>6.1.3 we have used and will use reasonable efforts to ensure that the Game and/or the Online Service will be available for six (6) months from the date on which you purchase the Game; and<br>6.1.4 the Online Service, when made available by us, shall be of satisfactory quality, as described and fit for purpose.<br>6.2 To the maximum extent permitted by law, and save as expressly provided in these Terms, we give no warranty in connection with the Online Service and exclude liability for any loss or damage of any kind, regardless of how it arises, including without limitation any direct, indirect, punitive or consequential loss, regardless of whether it arises from any issue you notify to us, and we shall have no liability to pay any money by way of compensation, including without limitation all liability in relation to:<br>6.2.1 the availability of the Online Service;<br>6.2.2 any incorrect or inaccurate information on the Online Service and all errors, interruptions to or delays in updating the Online Service;<br>6.2.3 the infringement by any person of any Intellectual Property Rights of any third party caused by their use of the Online Service;<br>6.2.4 any amount or kind of loss or damage due to viruses or other malicious software that may infect a user's computer equipment, software, data or other property caused by persons accessing, using or downloading the Online Service; <br>6.2.5 all representations, warranties, conditions and other terms which but for this notice would have effect.<br>6.3 Except as specifically provided in these terms, and to the maximum extent permitted by law:<br>6.3.1 The Game is provided on an "as is" and “as available” basis without warranty or guarantee of any kind (express or implied) other than those set out in these terms;<br>6.3.2 We only accept liability for direct loss as a result of our breach of the warranties in Clause 6.1 above;<br>6.3.3 Our and our licensors’ maximum liability will be limited to €100;<br>6.3.4 We and our licensors will not in any event be liable in any way for any consequential or indirect loss or damage (save to the extent that damage to your console, PC or other digital content which you own is caused by the Game as a result of our failure to use reasonable care and skill in which case you may be entitled to compensation or we may be obliged to repair your device);<br>6.3.5 We do not warrant or guarantee that the operation of the Game and/or the Online Service will be uninterrupted or error-free, or that errors can or will be corrected, or that the Game or the Online Service are free of viruses or other harmful components;<br>6.3.6 You install and use the Game at your own risk.<br><br>7. INDEMNITY AND REMEDIES. <br><br>7.1 You hereby indemnify (agree to compensate), defend and hold harmless Milestone and our affiliates, officers, directors, owners, licensors, service providers, partners, contractors, employees, agents and licensees (collectively, the "Indemnified Parties") from and against any and all any liabilities, claims, costs and expenses (including legal expenses and attorney fees) incurred by the Indemnified Parties in connection with any claim arising out of any breach by you of these Terms, or claims arising directly or indirectly from your use or misuse of the Game (which includes Virtual Items and the Online Service, where existing), and any User Content; and/or any use other than that set out in these Terms. You shall fully cooperate with us in the defense of any such claim and we reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you.<br>7.2 You further agree that the subject matter of these Terms is of a unique character with special value, and that we would suffer irreparable damage if these Terms were not specifically enforced; as a result you agree that we shall be entitled, without bond, other security, or proof of damages, to appropriate equitable remedies (including injunctive relief) with respect to breaches of these Terms, in addition to other remedies as we may otherwise have available under applicable laws.<br>7.3 Our licensors shall be third-party beneficiaries under these Terms and shall be entitled to enforce its provisions and enjoy the benefits of its protections.<br><br>8. OWNERSHIP. <br><br>8.1 All right, title, interest and ownership rights in the Game and any copyright, design right, database right, patents and any rights to inventions, know-how, trade and business names, trade secrets and trade marks (whether registered or unregistered) and any related applications and other intellectual property rights (“Intellectual Property Rights”), in or connected with the Game and each part thereof (including, by way of example only, any titles, code, themes, objects, characters, stories, catchphrases, concepts, artworks, animations, sounds, music, audio-visual effects and methods of operation) are owned by, belong to and vest in us or our licensors. <br>8.2 The Game may contain certain licensed materials and our licensors may act to protect their rights in the event of any breach of these Terms. All trademarks are the property of their respective owners.<br><br>9. SEVERABILITY.<br><br>In the event that any provision of these Terms shall be held by a court or other tribunal of competent jurisdiction to be unenforceable, this provision will be enforced to the maximum extent permissible and the remaining parts of these Terms shall remain in full force and effect. <br><br>10.
