THESE TERMS ARE IN ADDITION TO THE APPLICABLE TERMS AND CONDITIONS OF ANY PLATFORM ON WHICH WE MAKE THE GAME AVAILABLE (“PLATFORM TERMS”). THE PLATFORM TERMS ARE THEREFORE DEEMED INCORPORATED INTO THESE TERMS.  
PLEASE READ THE FOLLOWING CAREFULLY BEFORE USING, DOWNLOADING, PURCHASING OR INSTALLING THE GAME (WHICH INCLUDES THE RELEVANT ONLINE SERVICE). IF YOU DO NOT AGREE WITH THESE TERMS YOU MAY NOT USE, DOWNLOAD OR INSTALL THE GAME.
PLEASE NOTE THAT THE GAME REQUIRES AN INTERNET CONNECTION AND THE AVAILABILITY OF OUR ONLINE SERVICE FOR MOST OF ITS FUNCTIONS.
YOU ARE RESPONSIBLE FOR ENSURING THAT YOU HAVE AN INTERNET CONNECTION, AND THAT THE DEVICE YOU USE HAS SUFFICIENT HARDWARE AND SOFTWARE REQUIREMENTS AND MEMORY IN ORDER TO PLAY AND STORE THE GAME AND USE THE ONLINE SERVICE.
THE GAME HAS BEEN DEVELOPED TO WORK ON THE LATEST VERSION OF STEAM, PLAYSTATION®, XBOX, NINTENDO SWITCH™, AMAZON LUNA AND EPIC GAMES STORE AT THE TIME OF ITS RELEASE. THE PLATFORM HOLDERS MAY OCCASIONALLY UPDATE THEIR SOFTWARE; WE WILL ENDEAVOR, BUT NOT BE OBLIGATED, TO UPDATE THE GAME IF NECESSARY, TO ENSURE THAT ITS FUNCTIONS AND PERFORMANCE CONTINUE WITH ANY UPDATE RELEASE. IT IS YOUR OBLIGATION TO ENSURE THAT YOU ARE USING THE LATEST COMPATIBLE PUBLIC RELEASE OF ANY OPERATING SYSTEM FOR YOUR CONSOLE OR PC.
THE GAME COMPRISES COPYRIGHT WORKS OF MILESTONE AND/OR ITS LICENSORS. THE GAME IS LICENSED, NOT SOLD.  YOUR LICENSE CONFERS NO TITLE OR OWNERSHIP IN THE GAME. 1. LIMITED USE LICENSE.

1. BEPERKTE LICENTIE.

1.1 Milestone hereby grants you limited, non-exclusive right and license to download, install and use the Game for your personal, non-commercial use only, on compatible consoles or devices that are owned by you, subject to these Terms.
1.2 These Terms, and your use of the Game, do not give you any rights of ownership over any property in the game, whether tangible or intangible (including any Track or Bike livery or customized rider/bike that you create).
1.3 This clause applies if we offer the Game through the Steam platform (“Steam”), which is hosted by Valve S.A.R.L. (in the EU) and Valve Corporation (in the US). Where applicable, you will need a Steam account to play the Game, and your use of Steam is subject to the Steam Subscriber Agreement, which you can find online here.  The Steam Subscriber Agreement changes from time to time; if it becomes inconsistent with this EULA, where conflicts arise, the Steam Subscriber Agreement takes precedence. Steam allows refunds for the Game in certain circumstances.  You can find out how on the Steam website here: Steam Refunds.
1.4 If you install or use the Game on any third party platform including without limitation the PlayStation®, Microsoft Xbox, Nintendo, Amazon Luna and Epic Games Store platforms then the terms of these platforms will all apply.
1.5 You and we acknowledge that these Terms are agreed between you and us only, and not with Apple Inc, nor any subsidiary or affiliate company of Apple Inc. You also acknowledge that we are solely responsible for the Game and the content thereof.
1.6 If you are playing on an Android device, your use of the Game may require you to have a Google account. Your access to the Game will be linked to your Google account and you are required to comply with Google policies to use the Game.

1.1 Milestone verleent u hierbij een beperkt, niet-exclusief recht en licentie om de Game te downloaden, te installeren en te gebruiken voor uitsluitend uw persoonlijke, niet-commerciële gebruik op compatibele consoles of apparaten die uw eigendom zijn, onder deze Voorwaarden.
1.2 Deze Voorwaarden en uw gebruik van de Game geven u geen rechten op enige eigendom in de Game, ongeacht of deze materieel of immaterieel is (met inbegrip van die van de Circuits of Motordesigns of gepersonaliseerde motorrijders/motoren die u creëert).
1.3 Deze clausule is van toepassing wanneer wij de Game via het Steam-platform (“Steam”) aanbieden, dat is gehost door Valve S.A.R.L. (in de EU) en door Valve Corporation (in de VS). In dat geval dient u over een Steam-account te beschikken om de Game te kunnen spelen, waarbij uw gebruik van Steam is onderworpen aan de Steam Subscriber Agreement, die u hier online vindt. De Steam Subscriber Agreement wordt van tijd tot tijd gewijzigd en wanneer hij onverenigbaar wordt met deze EULA, zal in geval van geschillen de Steam Subscriber Agreement voorrang hebben. 1.4 Als u de Game installeert of gebruikt op platforms van derden, met inbegrip van maar niet beperkt tot, PlayStation®, Microsoft Xbox, Nintendo, Amazon Luna en Epic Games Store platforms, zijn de voorwaarden van deze platforms van toepassing.
1.5 Zowel u al wij erkennen dat deze Voorwaarden tussen u en ons zijn overeengekomen, en niet met Apple Inc, noch met enige dochter- of gelieerde onderneming van Apple Inc. U erkent eveneens dat alleen wij aansprakelijk zijn voor de Game en de inhoud hiervan.
1.6 Indien u op een Android-apparaat speelt, kan het voor uw gebruik van de Game nodig zijn dat u een Google-account hebt.  Uw toegang tot de Game zal gekoppeld zijn aan uw Google-account en u bent verplicht het Google-beleid op het gebruik van de Game in acht te nemen.

2. END USER OBLIGATIONS.

2. VERPLICHTINGEN VAN DE EINDGEBRUIKER.

2.1 You may use the Game for your own personal, non-commercial use as described in these Terms, but you are not entitled to and may not do any of the following, except to the extent expressly permitted by these Terms:
2.1.1 sell, transfer, copy, reproduce, translate, communicate, reverse engineer, publish, stream, distribute, rent, loan, sub-license, derive source code from, modify, adapt, merge, disassemble, decompile, create derivative works based on or otherwise transfer or deal in copies or reproductions of the Game, or any part or interest in it, to other parties in any way except where the Game expressly permits you to do so by sharing Game content on social media;  
2.1.2 remove, modify or tamper with any copyright, trademark or other notice;
2.1.3 engage in any act that we deem to be in conflict with the spirit or intent of the Game and/or the Online Service, including, without limitation, using cheats, exploits, automation software, bots, hacks, mods or any unauthorized third-party software designed to modify or interfere with the Game;
2.1.4 attempt to gain unauthorized access to the Online Service, or to the computers, devices, servers, or networks connected to the Online Service by any means other than the user interface provided by us; or
2.1.5 use the Game for any unlawful or immoral purposes.   
2.2 You may not use, access or otherwise export or re-export the products except as authorized by United States law and the laws of the jurisdiction in which the Services were obtained. In particular, but without limitation, the Games may not be exported, re-exported or otherwise made available (a) into any country or region embargoed by the U.S. Government, or (b) to anyone on the U.S. Treasury Department's Specially Designated Nationals List or the U.S. Department of Commerce Denied person List or Entity List, EU consolidated sanctions list with designated persons. By using the Games, you represent and warrant that you are not located in any such country or on any such list.

2.1 U mag de Game gebruiken voor uw persoonlijke, niet-commerciële gebruik zoals beschreven in deze Voorwaarden, maar u bent niet gerechtigd om een van de volgende handelingen te verrichten, behalve voor zover dit uitdrukkelijk is toegestaan in deze Voorwaarden:
2.1.1 het verkopen, overdragen, kopiëren, reproduceren, vertalen, communiceren, onderwerpen aan reverse-engineering, publiceren, streamen, distribueren, verhuren, uitlenen, in sublicentie geven, afleiden van de broncode, wijzigen, aanpassen, samenvoegen, demonteren, decompileren, creëren van afgeleide werken op basis van, of het anderszins overdragen of verhandelen van kopieën of reproducties van de Game of enig deel of belang in de Game aan andere partijen op welke wijze ook, behalve wanneer de Game u dit uitdrukkelijk toestaat door middel van het delen van inhoud van de Game op sociale media;  
2.1.2 het verwijderen en wijzigen van of knoeien met enig auteursrecht, handelsmerk of andere mededelingen; 
2.1.3 het verrichten van handelingen die wij in strijd achten met de geest of de bedoeling van de Game en/of de Online Service, inclusief maar niet beperkt tot, het gebruik van cheats, exploits, automatiseringssoftware, bots, hacks, mods of ongeautoriseerde software van derden die bedoeld is om de Game te wijzigen of te verstoren;
2.1.4 het pogen om ongeautoriseerde toegang te verkrijgen tot de Online Service, of tot de computers, apparaten, servers of netwerken die op een andere manier dan via de door ons geleverde gebruikersinterface met de Online Service zijn verbonden; of
2.1.5 het gebruik van de Game voor illegale of immorele doeleinden.   
2.2 U mag de producten niet gebruiken, hier toegang toe hebben of op andere wijze exporteren of opnieuw exporteren, behalve zoals toegestaan door de wetgeving van de Verenigde Staten en de wetten van het rechtsgebied waarin de Diensten zijn verkregen. Met name, maar zonder hiertoe beperkt te zijn, mogen de Games niet worden geëxporteerd, opnieuw geëxporteerd of op andere wijze beschikbaar worden gesteld (a) in een land of regio die door de regering van de VS onder embargo is geplaatst, of (b) aan iedereen die op de Specially Designated Nationals List van het Ministerie van Financiën van de VS, de Denied Person List of Entity List van het Ministerie van Handel van de VS, of de geconsolideerde sanctielijst van de EU met aangewezen personen staat. Door gebruik te maken van de Games, verklaart en garandeert u dat u zich niet in een dergelijk land bevindt of op een dergelijke lijst staat.

3. TERMINATION.

3. BEËINDIGING.

3.1 These Terms and the licenses granted to you by us are effective until terminated.
3.2 You may terminate these Terms at any time and for any reason by deleting and removing the Game from your console or PC.  
3.3 We may terminate these Terms if you fail to abide by them at any time and for any reason, or where we reasonably suspect that you have failed to abide by any of these Terms.  We may take action that we deem reasonable at our sole discretion against users who do not comply with these Terms. This may include banning users from using or accessing the Game and/or the Online Service. For more information about the kind of infraction you could commit, we recommend you to carefully read the entire paragraph 5.11 “User Content Rules”. Based on the type but especially on the number of reports received, Milestone reserves the right to suspend a user for the following days: one day, three days, seven days, fifteen days, one month. Once the latter is exceeded, it’s possible to incur a permanent suspension.
3.4 Milestone reserves the right to determine what conduct it considers to be in violation of, or otherwise outside the intent or spirit of, these Terms and/or the Game and/or the Online Service. However, if your action can be rectified, we shall give you reasonable opportunity to do so. 
3.5 Following termination, you will no longer be permitted to use any of the Game and you will be required to delete the Game from your console or device.
3.6 Milestone Services are no longer available in a region. Should such a circumstance occur, we will publish a communication on our website and/or in the game itself, reporting the interruption of a core feature of a game or all of the Milestone Services in a region.

3.1 Deze Voorwaarden en de u door ons verleende licenties zijn van kracht tot het moment van beëindiging. 
3.2 U kunt deze Voorwaarden op ieder moment beëindigen door de Game van uw console of PC te wissen en te verwijderen.  
3.3 Wij kunnen deze Voorwaarden beëindigen indien u deze op welk moment en om welke reden ook niet naleeft of indien wij redelijkerwijs vermoeden dat u zich niet aan een van deze Voorwaarden hebt gehouden. Wij kunnen naar eigen goeddunken maatregelen nemen die wij redelijk achten, tegen gebruikers die zich niet aan deze Voorwaarden houden, waaronder het verbieden aan gebruikers van het gebruik van of de toegang tot de Game en/of de Online Service. Voor meer informatie over overtredingen die u kunt begaan, raden wij aan het punt 5.11 “Regels voor Gebruikersinhoud” goed te lezen. Op grond van het soort, en vooral het aantal ontvangen meldingen, behoudt Milestone zich het recht voor om de gebruiker een variabel aantal dagen te schorsen: één dag, drie dagen, zeven dagen, een maand. Na verstrijking van deze laatste termijn, kan tot permanente schorsing worden overgegaan.
3.4 Milestone behoudt zich het recht voor om te bepalen welk gedrag in strijd is met, of anderszins buiten de bedoeling of de geest valt van deze Voorwaarden en/of de Game en/of de Online Service. Als echter hetgeen u hebt gedaan kan worden rechtgezet, zullen wij u daartoe redelijkerwijs in de gelegenheid stellen. 
3.5 Na beëindiging kunt u niets meer van de Game gebruiken en wordt u verzocht om de Game van uw console of ander apparaat te wissen.
3.6 De diensten van Milestone zijn niet langer beschikbaar in een gebied. Indien zich een dergelijke omstandigheid voordoet, zullen wij een bericht plaatsen op onze website en/of in het spel zelf, waarin de onderbreking van een substantiële functionaliteit van een spel of van alle Milestone Services in een gebied wordt aangegeven.

4. ONLINE SERVICE.

4.1 Milestone may, but shall not be obliged to, provide and maintain certain online functions, online network play connectivity and interactivity, and other online features relating to the Game subject to these Terms. These shall include, by way of example, the online ‘Single Event’ and ‘Custom Championship’ game modes (“Online Service”).
4.2 We cannot guarantee that the Online Service or a particular part of the Online Service, including any User Content, will always be available. 
4.3 The Online Service is for personal use only, on an “as is” basis and all use must be in accordance with these Terms.

4.1 Milestone kan, maar is niet verplicht, bepaalde online functies, online netwerkspel-connectiviteit en interactiviteit en andere online functies met betrekking tot de Game leveren en onderhouden, zoals, maar niet beperkt tot, de online “Enkel evenement”- en “Gepersonaliseerd Kampioenschap”-spelmodussen (“Online Service”), die aan deze Voorwaarden zijn onderworpen.
4.2 Wij staan er niet voor in dat de Online Service of een bepaald deel van de Online Service, inclusief alle Gebruikersinhoud, altijd beschikbaar is. 
4.3 De Online Service is uitsluitend voor persoonlijk gebruik op een “as is”-basis en ieder gebruik moet in overeenstemming met deze Voorwaarden zijn.

Age Restrictions
4.4 To be able to play, you must first accept the Milestone user agreement and confirm that you have read MIlestone's privacy and cookie policy. In order to use online functions, you must have an Internet connection and an account on the platform; it is also necessary for a person aged at least thirteen to complete the registration process.

Leeftijdsbeperkingen
4.4 Om te kunnen spelen moet de gebruiker akkoord gaan met de gebruikersovereenkomst van Milestone en het privacy- en cookiebeleid aanvaarden. Voor toegang tot de onlinefuncties zijn een internetverbinding en een platformaccount vereist. De registratie van het account moet worden gedaan door een persoon dertien jaar of ouder.

User Rules
4.5 You also agree that you will not in any way behave in a manner which is unlawful or which gives rise to civil or criminal liability, or which might call us or the Game into disrepute. 
4.6 Where the Game allows you to share pre-determined messages with other users, we shall be entitled to remove, restrict, suspend or alter that ability for any reason at our sole and absolute discretion.  
4.7 You will cooperate fully with us to investigate any suspected unlawful, fraudulent or improper activity.
4.8 If you feel that the behavior of another user breaches these Terms, please let us know by contacting us via the Support Services with details of the potential breach and/or the user responsible. We will take reasonable steps to deal with any breach.

Gebruikersregels
4.5 U gaat er verder mee akkoord dat u op geen enkele wijze onwettig gedrag aan de dag zal leggen of gedrag dat tot burgerlijke of strafrechtelijke aansprakelijkheid leidt of ons of de Game in diskrediet zou kunnen brengen. 
4.6 Wanneer het in de Game mogelijk is om vooraf bepaalde berichten met andere gebruikers te delen, hebben wij het recht om deze mogelijkheid om welke reden ook naar eigen goeddunken te verwijderen, te beperken, te onderbreken of te wijzigen.  
4.7 U zult volledig met ons samenwerken om elk vermoeden van onwettige, frauduleuze of ongepaste activiteiten te onderzoeken.
4.8 Als u meent dat het gedrag van een andere gebruiker in strijd is met deze Voorwaarden, verzoeken wij u ons dit te laten weten door contact met ons op te nemen via de Ondersteunende Diensten met details over de mogelijke inbreuk en/of de verantwoordelijke gebruiker. Wij zullen redelijke stappen ondernemen om een eventuele inbreuk aan te pakken.

Please note: 
Where the Online Service is available, you use it at entirely your own risk. It is a known risk of internet usage that people are not necessarily who they say they are. People may provide information or behave in a way that is unreliable, misleading, unlawful or illegal. Milestone has no way of telling if statements made by other users of the Game and/or the Online Service are true. This is a decision that can only be made by you, and we recommend exercising caution. By playing the Game and using the Online Service and its parts, you accept that this is the case and accept the associated risk. Users must take particular care in relation to the disclosure of their own personal information.

Indien de Online Service beschikbaar is, gebruikt u deze uitsluitend op eigen risico. Het internetgebruik brengt het risico met zich mee dat mensen niet noodzakelijkerwijs zijn wie ze zeggen dat ze zijn. Mensen kunnen informatie verstrekken of zich gedragen op een wijze die onbetrouwbaar, misleidend, onwettig of illegaal is. Milestone kan op geen enkele wijze weten of uitspraken van andere gebruikers van de Game en/of de Online Service waar zijn. Dit is een beslissing die u alleen moet nemen en daarom is een zekere mate van voorzichtigheid aanbevolen. Door de Game te spelen en de Online Service en zijn onderdelen te gebruiken, gaat u hiermee akkoord en aanvaardt u het risico dat hieraan verbonden is. Gebruikers moeten met name zorgvuldig omgaan met het openbaar maken van hun persoonlijke gegevens.

5. CREATION AND CUSTOMISATION OF USER CONTENT.

5.1 De Game kan beschikken over een editorfunctie waarmee u en andere gebruikers van de Game eigen Gebruikersinhoud (zoals gedefinieerd in onderstaand punt 5.1.1) om in de Game zelf te gebruiken, kunnen creëren, uploaden, delen, beschikbaar stellen of naar de Online Service sturen voor uzelf en/of voor andere spelers. Ook hebt u de mogelijkheid berichten aan ons of aan derden te sturen en/of de Gebruikersinhoud en/of informatie te verstrekken over het gebruik hiervan binnen de Game of binnen een ander door ons of derden verschafte inhoud).

5.1 the definition of “User Contents” (singular “User Content”) includes any content created by the user through any editor functions which might be included in the Game including, but not limited to, tracks, liveries, helmets, decals, pilot stickers, numbers, suits and vehicles, and which are uploaded, made available or sent by the user to the Online Service, for their own purposes and/or for other users to utilise in the Game.

Voor de doeleinden van deze Voorwaarden:
5.1.1 de definitie van Gebruikersinhoud omvat iedere inhoud die u creëert via de editorfuncties die in de Game beschikbaar kunnen zijn, met inbegrip van maar niet beperkt tot, circuits, motordesign, helmen, stickers van de piloot, nummers, overalls en voertuigen, de Online Service stuurt voor uw gebruik en/of dat van anderen in de Game, en die u uploadt, beschikbaar maakt of naar de Online Service stuurt voor uw gebruik en/of dat van anderen in de Game.
5.1.2 “Distribueren” betekent het gebruiken, verkopen, marketen, promoten, in sublicentie aan eindgebruikers geven, verspreiden en op andere wijze beschikbaar voor derden stellen.
5.2 In verband met UITSLUITEND het gebruik van de Game en de Online Service (indien deze service beschikbaar is) en onder deze Voorwaarden, mag u (en hebt u een beperkte, niet-exclusieve licentie en recht op) de software gebruiken die deel uitmaakt van de Game en de Online Service om met andere gebruikers van de Game via de Online Service te communiceren en Gebruikersinhoud te posten, te verzenden, mee te delen en beschikbaar te stellen. Door dit te doen, verleent u ons een onbeperkt, overdraagbaar, sublicentieerbaar, royaltyvrij, permanent, onherroepelijk, niet-exclusief recht en licentie om deze Gebruikersinhoud in verband met de Game op iedere wijze en via alle media te gebruiken of beschikbaar te stellen.
5.3 Wij houden ons bezig met de marketing en publicatie van de Game en leveren de bijbehorende entertainmentdiensten in de vorm van de Online Service. Hiernaast houden wij ons bezig met het verzenden, opslaan, ophalen, hosten, formatteren of vertalen van Gebruikersinhoud zonder selectie of wijziging van de inhoud van de mededeling, waarvoor wij slechts een kanaal vormen. 
5.4 Door de Game te installeren en te gebruiken, gaat u ermee akkoord en erkent u dat wij niet verantwoordelijk zijn voor het herzien van Gebruikersinhoud die beschikbaar is gemaakt, op basis van het feit dat wij niet verplicht zijn controles of beoordelingen uit te voeren van de inhoud of het hierin geposte of bevatte materiaal. Voor alle duidelijkheid: de opinies die in de Gebruikersinhoud zijn bevat, zijn de opinies van de afzonderlijke auteurs en niet die van Milestone, tenzij anders door ons is aangegeven. Met name, maar niet tot het bovenstaande beperkt, zijn wij niet verantwoordelijk voor en wijzen wij iedere aansprakelijkheid af met betrekking tot eventueel commentaar, opinies of opmerkingen die in de Gebruikersinhoud worden geuit. 
5.5 Wij hebben het recht om naar eigen goeddunken alle Gebruikersinhoud te verwijderen, te beperken, te onderbreken of te wijzigen (evenals de mogelijkheid om Gebruikersinhoud te delen of te creëren, met inbegrip van Circuits of Motordesigns), om welke reden ook.
5.6 U gaat ermee akkoord dat wij de door u beschikbaar gestelde Gebruikersinhoud om welke reden ook naar eigen goeddunken mogen gebruiken, publiceren, wijzigen en aanpassen, of in de Game en/of de Online Service posten of deze hiernaar verzenden.
5.7 Voor zover uw Gebruikersinhoud is afgeleid van de Game of van door ons verstrekt materiaal, draagt u hierbij alle Intellectuele Eigendomsrechten op uw Gebruikersinhoud aan ons over, met inbegrip van alle Intellectuele Eigendomsrechten in de door u gecreëerde Gebruikersinhoud.
5.8 Wij geven geen garantie en leggen geen verklaring af met betrekking tot de juistheid, actualiteit of geldigheid van de informatie en het materiaal in de Gebruikersinhoud of de Online Service, en zijn niet aansprakelijk voor enig verlies of schade voortkomend uit het gebruik van deze informatie of dit materiaal. 
5.9 Als u Gebruikersinhoud tegenkomt die volgens u in strijd is met deze Voorwaarden, verzoeken wij u ons hiervan op de hoogte te stellen door contact met ons op te nemen via de Ondersteunende Diensten met de details van de Gebruikersinhoud.

For the purposes of these Conditions:
5.1.1 The definition of “User Contents” (singular “User Content”) includes any content created by the user through any editor functions which might be included in the Game including, but not limited to, tracks, liveries, helmets, decals, pilot stickers, numbers, suits and vehicles, and which are uploaded, made available or sent by the user to the Online Service, for their own purposes and/or for other users to utilise in the Game.
5.1.2 "Distribute" means to use, sell, market, promote, sub-license to end-users, distribute or otherwise make available to third parties.
5.2 In relation to the SOLE use of the Game and Online Service (where this service exists) and pursuant to these Terms and Conditions, the user may (and is granted a limited, non-exclusive licence and the right to) use the software that is part of the Game and Online Service to communicate with other users of the Game via the Online Service, and to publish User Content and transmit, communicate and make it available. In this way, the user hereby grants us an unlimited, transferable, sub-licensable, royalty-free, perpetual, irrevocable, non-exclusive licence to use and make available any such User Content in connection with the Game, in any manner or media. 
5.3 We are committed to marketing and publishing the Game and providing its associated entertainment services in the form of the Online Service. Additionally, we engage in the transmission, storage, retrieval, hosting, formatting or translation of User Content without selection or alteration of the communication content, for which we merely serve as a conduit.
5.4 By installing and using the Game, the user agrees and confirms that we are not responsible for reviewing any User Content made available, as we will not be required to exercise any control or give any judgement in relation to the content or published material, or its substance. For the purposes of avoiding any misunderstandings, the opinions expressed in any User Content represent the opinions of the individual authors, and not those of Milestone, unless otherwise specified by us. In particular, but without limitations to the above, we cannot be held responsible, and decline any liability for comments, opinions or observations expressed in any User Content. We shall be entitled to remove, restrict, suspend or alter any User Content (and the ability to share or create User Content, including any Track or Bike Livery) for any reason at our sole and absolute discretion.
5.5 We have the right to remove, limit, suspend or alter any User Content (and the ability to share or create User Content) for any reason, at our sole and absolute discretion.
5.6 The user accepts that we can use, publish, amend, vary and adapt any User Content which the user should make available, publish or transmit to the Game and/or the Online Service for any reason, at our sole discretion. 
5.7 To the extent that User Content derives from the Game or material supplied by us, the user hereby assigns us all intellectual property rights subsisting in the User Content which are owned by them, including all intellectual property rights in any User Content created by them.
5.8 We do not supply any guarantee, and shall not issue any declaration regarding the accuracy, evaluation or validity of the information and material contained in the User Content or Online Service; nor can we be held responsible for any losses or damage caused by the use of said information or material.
5.9 If the user discovers any User Content which they feel contravenes these Terms and Conditions, we would ask them to notify us via support Services and submit details of the User Content concerned..

Regels voor Gebruikersinhoud (van toepassing wanneer de Online Service bestaat)
5.10 U gaat ermee akkoord en erkent dat u het recht hebt om uw Gebruikersinhoud beschikbaar te maken, te posten op of te verzenden naar de Game en ons de rechten toe te kennen die in punt 5.8 zijn beschreven, en dat u geen verklaringen, materiaal of andere Gebruikersinhoud beschikbaar maakt, post op of naar de Game verzendt, noch de Online Service of de Game op enigerlei wijze gebruikt, die:
5.10.1 aanstootgevend, opruiend, pornografisch, agressief, homofoob, lasterlijk, smadelijk, onwaar, haatdragend, discriminerend, obsceen, beledigend, haatzaaiend, seksistisch of racistisch is;
5.10.2 personen lastigvalt, treitert of intimideert of de mogelijkheid van andere gebruikers om te communiceren of conversaties te lezen (met inbegrip van het gebruik van macro’s/SPAM tegen ofwel het algemene spelersbestand of een afzonderlijke persoon met het doel de chat te verstoren) dwarsboomt of verhindert; 
5.10.3 inbreuk maakt op de Intellectuele Eigendomsrechten of andere rechten van een persoon (behoudens voor zover uw Gebruikersinhoud voortkomt uit de Game of uit door ons geleverd materiaal);
5.10.4 uitbuitend gedrag vertoont, door middel van maar niet beperkt tot, programma’s van derden, bots, scripts, virussen of andere middelen die wij van tijd tot tijd redelijkerwijs verbieden, of die gebruik maken van bugs, onbedoelde fouten of functies die niet gedocumenteerd zijn, om toegang te krijgen tot afgeschermde gebieden van de Game of die op een andere manier een activiteit vormen die wij redelijkerwijze in strijd achten met de “geest” van de Game;
5.10.5 aanmoedigt tot schending van deze Voorwaarden of van de voorwaarden van een externe dienstverlene;
5.10.6 onwettig, boosaardig, misleidend (met inbegrip van imitatie), discriminerend is of aanleiding geeft tot burgerlijke of strafrechtelijke aansprakelijkheid of die Milestone, de Online Service of de Game in diskrediet kan brengen;
5.10.7 inbreuk maakt op de Intellectuele Eigendomsrechten of andere rechten van derden of een dergelijke inbreuk vergemakkelijkt of aanmoedigt, of leidt tot de verspreiding van persoonlijke informatie van een speler (anders dan uw eigen informatie, als privébericht);
5.10.8 technisch gezien schadelijk is, zoals het introduceren van computervirussen, wormen, logische bommen of andere kwaadaardige software of schadelijke gegevens, of die op andere wijze een poging doet – of dit verwezenlijkt – de Game te wijzigen of te verstoren of een door de Game gebruikte computer of server te overbelasten of te ontregelen;
5.10.9 kan worden beschouwd als marketing- of commerciële communicatie;
5.10.10 illegale of onwettige activiteiten bevordert, met inbegrip van maar niet beperkt tot, instigatie, gokken of het verkopen van receptgeneesmiddelen;
5.10.11 gericht is op personen jonger dan 18 jaar of waarin wordt geprobeerd een afspraak tot stand te brengen met personen jonger dan 18 jaar;
5.10.12 beschermd materiaal bevat, met inbegrip van maar niet beperkt tot, wachtwoorden, medische informatie of vertrouwelijke informatie van een persoon; 
5.10.13 naar ons redelijk oordeel misbruik maakt van de Game of een poging doet om ongeautoriseerde toegang te krijgen tot de Game of delen daarvan, of tot de accounts van andere gebruikers of netwerken of hun console of apparaat; of
5.10.14 om bovengenoemde zaken verzoekt, hiertoe uitnodigt of oproept, deze aanmoedigt, verdedigt of uitlokt.

User Rules of User Content (applicable where the Online Service exists)
5.10 The user agrees and undertakes to have the right to make available, or publish or transmit, their User Contents to the Game, and to grant us the rights specified in clause 5.8. The user shall not make available, nor indeed publish or transmit to the Game, any statement, material or other User Content, or use the Online Service or Game in any way which:
5.10.1 is abusive, seditious, pornographic, aggressive, homophobic, defamatory, false, instigates hatred, is discriminatory, obscene, offensive, provocative, sexist or racist;
5.10.2 molests or intimidates any person, or inhibits or prevents the ability of other users to communicate or read conversations (including the use of any macros/SPAM for the general base of gamers, or a single individual, in order to interrupt the chat);
5.10.3 breaches any Intellectual Property Right or other rights of any person (on condition that the User Content is derived from the Game or the material supplied by us);
5.10.4 gives rise to any behaviour involving exploitation through, but not limited to, third-party programmes, bots, scripts, viruses or other means reasonably prohibited by us on an as-and-when basis, or that exploits bugs, unforeseen errors or undocumented features to access restricted parts of the game, or otherwise engages in activities that we reasonably deem are contrary to the "spirit" of the Game;
5.10.5 encourages any breach of these Terms and Conditions, or the terms of service of a third-party service provider;
5.10.6 are Illegal, malicious, misleading (including impersonation), discriminatory, or give rise to civil or criminal liability, or which might jeopardise the reputation of Milestone, the Online Service or the Game;
5.10.7 breaches the intellectual property or other rights of third parties, or facilitates or encourages such a breach, or involves the distribution of personal information of any gamer (other than one’s own, such as private messages);
5.10.8 is technically damaging, such as introducing computer viruses, worms, logic bombs or other harmful software or data, or otherwise attempting or effectively modifying or interfering with the Game, or overloading or disrupting any computer or server used by the Game;
5.10.9 may be considered commercial or marketing communication;
5.10.10 promotes illegal or unlawful activities, including but not limited to solicitation, gambling or the sale of prescription medication;
5.10.11 is directed at individuals under the age of 18 or those seeking or attempting to arrange to meet a person under the age of 18;
5.10.12 contains any restricted material, including but not limited to passwords, medical information or confidential information of any person; 
5.10.13 constitutes, in our reasonable opinion, misuse of the Game or an attempt to gain unauthorised access to the Game or its parts, or the accounts of other users or networks, or their console or device; or
5.10.14 solicits, invites, encourages, supports, incites or provokes - in whole or in part - any of the above.

Gebruikersinhoud die met de Editor kan worden gecreëerd (van toepassing wanneer de Online Service bestaat)
5.11 Overeenkomstig bovenstaand punt 5.8, verleent u ons hierbij met betrekking tot iedere Gebruikersinhoud die u creëert en op de Online service uploadt, een niet-exclusief, royaltyvrij, permanent, wereldwijd recht en licentie voor:
5.11.1 de distributie van uw Gebruikersinhoud via de Online Service;
5.11.2 het gebruiken en beschikbaar stellen van uw schermafbeeldingen en videoreeksen van uw Gebruikersinhoud, en ander promotie- en marketingmateriaal te creëren en beschikbaar te stellen (ook via diensten van derden) dat wij geschikt achten om het door u gecreëerde Circuit of Motordesign, de Game en/of de Online Service via alle media te promoten;
5.11.3 de distributie van demo- of gratis versies van uw Gebruikersinhoud, uitsluitend om uw gepersonaliseerde Gebruikersinhoud te herzien, te promoten en op de markt te brengen; en
5.11.4 het gebruik van alle handelsmerken of handelsnamen waaronder u of uw Gebruikersinhoud bekend staat, in verband met de onderstaande distributie van de Gebruikersinhoud. 	
5.12 U garandeert en verklaart ons (behoudens voor zover uw Gebruikersinhoud voortkomt uit de Game of uit door Milestone geleverd materiaal) dat:
5.12.1 u de eigenaar of licentiehouder bent van de Gebruikersinhoud en van alle Intellectuele Eigendomsrechten hierop;
5.12.2 u volledig bevoegd bent om deze Voorwaarden aan te gaan en gerechtigd bent om de hierin bevatte rechten, licenties en toekenningen te verlenen en over alle vereiste licenties en toekenningen te beschikken die nodig zijn om dit te doen;
5.13 U zult Milestone vrijwaren van (u gaat akkoord met vergoeding) en schadeloos stellen voor alle vorderingen, claims, procedures, kosten en schade (met inbegrip van alle schade of de vergoedingen die wij op advies van onze juridische adviseurs hebben betaald om minnelijke overeenstemming te bereiken of een vordering te vereffenen), en alle juridische kosten of andere uitgaven of kosten voortvloeiend uit een schending van de bovenstaande garanties of van deze Voorwaarden.

User Contents which can be created using the Editor (applicable where the Online Service exists)
5.11 According to Clause 5.8 above, in relation to any User Content created and uploaded by the user on the Online Service, the user shall grant us the right and licence, on a non-exclusive basis, which shall be deemed free of royalties, perpetual and irrevocable, on a worldwide basis, for:
5.11.1 distributing their User Content via the Online Service;;
5.11.2 using and making available screenshots and video sequences of their User Content, and creating and making available (also through third-party services) any such further promotional and marketing materials at our discretion, for the purposes of promoting the Track or Livery of the motorcycle they have created, the Game and/or the Online Service on all media;
5.11.3 distributing the demo or free versions of the User Content with an end to reviewing, promoting and marketing solely the customised User Content; and; 
5.11.4 using any commercial brand or commercial name of which the user is aware, or their User Content in relation to the distribution of the User Content below. 	
5.12 The user guarantees and declares the following to us (on condition that the User Content derives from the Game, or the material supplied by Milestone):
5.12.1 that they are the owner or licence holder of the User Content, and all the Intellectual Property Rights pertaining to it;
5.12.2 that they have the full power to enter into these Conditions and the Terms herein, and are entitled to grant the rights, licences and assignments contained in them, and that they hold all licences and assignments required to do so;
5.13 The user shall indemnify (agree to compensate) and hold Milestone harmless against all actions, claims, proceedings, costs and damages (including any damages or settlements paid by us on the advice of our legal advisors to settle or resolve any claim), and all legal fees or other expenses arising from any breach of the above warranties, or these Terms and Conditions.

6. GARANTIE EN AANSPRAKELIJKHEIDSBEPERKING.

6. WARRANTY AND LIMITATION OF LIABILITY.

6.1 Wij garanderen dat wij redelijke inspanningen hebben geleverd en zullen leveren om te waarborgen dat:
6.1.1 wij gerechtigd zijn om de onderstaande rechten en licenties toe te kennen;
6.1.2 de Game van voldoende kwaliteit is;
6.1.3 we redelijke inspanningen hebben geleverd en zullen leveren om ervoor te zorgen dat de Game en/of de Online Service beschikbaar zijn voor een periode van zes (6) maanden vanaf de datum waarop u de Game aanschaft; en
6.1.4 de Online Service, wanneer deze door ons beschikbaar wordt gesteld, van voldoende kwaliteit is, zoals is beschreven en geschikt voor zijn doel is.
6.2 Voor zover wettelijk toegestaan, en behoudens hetgeen uitdrukkelijk is bepaald in deze Voorwaarden, geven wij geen garantie in verband met de Online Service en wijzen wij iedere aansprakelijkheid af voor enig verlies of schade van welke aard ook en hoe dan ook ontstaan, met inbegrip van, maar niet beperkt tot, directe, indirecte of gevolgschade of schadevergoeding met een boetekarakter, ongeacht of deze voortkomen uit een probleem dat u ons meldt, en zijn wij niet aansprakelijk voor de betaling van enige schadevergoeding, met inbegrip van, maar niet beperkt tot, alle aansprakelijkheid met betrekking tot:
6.2.1 de beschikbaarheid van de Online Service;
6.2.2 onjuiste of onnauwkeurige informatie op de Online Service en alle fouten en onderbrekingen van of vertragingen in het bijwerken van de Online Service;
6.2.3 de schending door wie dan ook van de Intellectuele Eigendomsrechten van derden, ten gevolge van hun gebruik van de Online Service;
6.2.4 de mate van of het type van verlies of schade als gevolg van virussen of andere kwaadaardige software die de computerapparatuur, software, gegevens of andere eigendommen van een gebruiker kunnen infecteren, veroorzaakt door de toegang, het gebruik of het downloaden door personen van de Online Service; 
6.2.5 alle verklaringen, garanties, voorwaarden en andere bepalingen, die zonder deze kennisgeving van kracht zouden zijn.
6.3 Behoudens hetgeen in deze Voorwaarden is bepaald en voor zover wettelijk toegestaan:
6.3.1 wordt de Game op een “as is”- en “as available”-basis geleverd zonder enige (expliciete of impliciete) garantie, naast de in deze Voorwaarden beschreven garantie;
6.3.2 wij zullen uitsluitend aansprakelijk zijn voor directe schade als gevolg van onze schending van de garanties in bovenstaande clausule 6.1;
6.3.3 Onze maximale aansprakelijkheid en die van onze licentiegevers zal beperkt zijn tot €100;
6.3.4 Wij en onze licentiegevers zijn in geen geval op enige wijze aansprakelijk voor gevolgschade of indirecte schade (behoudens voor zover de schade aan uw console, pc of andere digitale content die u in uw bezit hebt, wordt veroorzaakt door de Game als gevolg van het feit dat wij geen redelijke zorg en vakkundigheid aan de dag hebben gelegd, in welk geval u recht hebt op een vergoeding of wij verplicht kunnen zijn uw apparaat te repareren);
6.3.5 Wij garanderen niet dat de werking van de Game en/of de Online Service ononderbroken of foutloos zal zijn of dat fouten kunnen of zullen worden gecorrigeerd, of dat de Game of de Online Service vrij is van virussen of andere schadelijke componenten;
6.3.6 U installeert en gebruikt de Game op eigen risico.

6.1 We warrant that we have used and will use reasonable efforts to ensure that:
6.1.1 we are entitled to grant the rights and licenses granted herewith;
6.1.2 the Game will be of satisfactory quality;
6.1.3 we have used and will use reasonable efforts to ensure that the Game and/or the Online Service will be available for six (6) months from the date on which you purchase the Game; and
6.1.4 the Online Service, when made available by us, shall be of satisfactory quality, as described and fit for purpose.
6.2 To the maximum extent permitted by law, and save as expressly provided in these Terms, we give no warranty in connection with the Online Service and exclude liability for any loss or damage of any kind, regardless of how it arises, including without limitation any direct, indirect, punitive or consequential loss, regardless of whether it arises from any issue you notify to us, and we shall have no liability to pay any money by way of compensation, including without limitation all liability in relation to:
6.2.1 the availability of the Online Service;
6.2.2 any incorrect or inaccurate information on the Online Service and all errors, interruptions to or delays in updating the Online Service;
6.2.3 the infringement by any person of any Intellectual Property Rights of any third party caused by their use of the Online Service;
6.2.4 any amount or kind of loss or damage due to viruses or other malicious software that may infect a user's computer equipment, software, data or other property caused by persons accessing, using or downloading the Online Service; 
6.2.5 all representations, warranties, conditions and other terms which but for this notice would have effect.
6.3 Except as specifically provided in these terms, and to the maximum extent permitted by law:
6.3.1 The Game is provided on an "as is" and “as available” basis without warranty or guarantee of any kind (express or implied) other than those set out in these terms;
6.3.2 We only accept liability for direct loss as a result of our breach of the warranties in Clause 6.1 above;
6.3.3 Our and our licensors’ maximum liability will be limited to €100;
6.3.4 We and our licensors will not in any event be liable in any way for any consequential or indirect loss or damage (save to the extent that damage to your console, PC or other digital content which you own is caused by the Game as a result of our failure to use reasonable care and skill in which case you may be entitled to compensation or we may be obliged to repair your device);
6.3.5 We do not warrant or guarantee that the operation of the Game and/or the Online Service will be uninterrupted or error-free, or that errors can or will be corrected, or that the Game or the Online Service are free of viruses or other harmful components;
6.3.6 You install and use the Game at your own risk.

7. VRIJWARING EN RECHTSMIDDELEN.

7. INDEMNITY AND REMEDIES.

7.1 Hierbij verklaart u Milestone en onze gelieerde ondernemingen, functionarissen, directeuren, eigenaren, licentiegevers, dienstverleners, partners, onderaannemers, werknemers, agenten en licentiehouders (gezamenlijk de "Gevrijwaarde partijen") te vrijwaren (gaat akkoord met vergoeding) van, verdedigen tegen en schadeloos te stellen voor alle aansprakelijkheden, vorderingen, kosten en uitgaven (met inbegrip van juridische kosten en honoraria) die door de Gevrijwaarde Partijen worden gemaakt in verband met vorderingen, voortvloeiend uit een schending van uw kant van deze Voorwaarden, of vorderingen die direct of indirect voortvloeien uit uw gebruik of misbruik van de Game (waaronder Virtuele items en de Online Service, indien aanwezig), of enige Gebruikersinhoud; en/of uit enig ander gebruik dat niet overeenstemt met de bepalingen van deze Voorwaarden. U zult uw volledige medewerking aan ons verlenen voor de verdediging tegen dergelijke vorderingen en wij behouden ons het recht voor om, op eigen kosten, de exclusieve verdediging en controle over een zaak op ons te nemen, die anders onder uw vrijwaring zou vallen.
7.2 U gaat er verder mee akkoord dat het onderwerp van deze Voorwaarden van unieke aard is en een bijzondere waarde heeft en dat wij onherstelbare schade zouden lijden als deze Voorwaarden niet specifiek zouden worden afgedwongen, en daarom stemt u ermee in dat wij, zonder depot of andere zekerheid of bewijs van schade, recht hebben op passende billijke rechtsmiddelen (met inbegrip van een voorlopige voorziening) met betrekking tot schendingen van deze Voorwaarden, naast andere rechtsmiddelen die wij verder op grond van de toepasselijke wetgeving tot onze beschikking kunnen hebben.
7.3 Onze licentiegevers zijn onder deze Voorwaarden derde begunstigden en hebben het uitdrukkelijke recht om de bepalingen ervan af te dwingen en de voordelen van de bescherming hiervan te benutten.

7.1 You hereby indemnify (agree to compensate), defend and hold harmless Milestone and our affiliates, officers, directors, owners, licensors, service providers, partners, contractors, employees, agents and licensees (collectively, the "Indemnified Parties") from and against any and all any liabilities, claims, costs and expenses (including legal expenses and attorney fees) incurred by the Indemnified Parties in connection with any claim arising out of any breach by you of these Terms, or claims arising directly or indirectly from your use or misuse of the Game (which includes Virtual Items and the Online Service, where existing), and any User Content; and/or any use other than that set out in these Terms. You shall fully cooperate with us in the defense of any such claim and we reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you.
7.2 You further agree that the subject matter of these Terms is of a unique character with special value, and that we would suffer irreparable damage if these Terms were not specifically enforced; as a result you agree that we shall be entitled, without bond, other security, or proof of damages, to appropriate equitable remedies (including injunctive relief) with respect to breaches of these Terms, in addition to other remedies as we may otherwise have available under applicable laws.
7.3 Our licensors shall be third-party beneficiaries under these Terms and shall be entitled to enforce its provisions and enjoy the benefits of its protections.

8.1 Alle rechten, aanspraken op, belangen en eigendomsrechten in de Game en alle auteursrechten, modelrechten, databaserechten, octrooien en rechten op uitvindingen, knowhow, handels- en bedrijfsnamen, handelsgeheimen en handelsmerken (al dan niet geregistreerd) en alle aanvragen daarvoor en andere intellectuele eigendomsrechten (“Intellectuele Eigendomsrechten”) in of verband houdend met de Game en elk onderdeel daarvan (waaronder bij wijze van voorbeeld titels, codes, thema's, objecten, personages, verhalen, slogans, concepten, kunstwerken, animaties, geluiden, muziek, audiovisuele effecten en werkwijzen) zijn eigendom van, behoren toe aan en berusten bij ons of onze licentiegevers. 
8.2 De Game kan bepaalde in licentie gegeven materialen bevatten en onze licentiegevers kunnen optreden om hun rechten te beschermen in het geval van een inbreuk op deze Voorwaarden. Alle handelsmerken zijn eigendom van hun respectievelijke eigenaren.

8.1 All right, title, interest and ownership rights in the Game and any copyright, design right, database right, patents and any rights to inventions, know-how, trade and business names, trade secrets and trade marks (whether registered or unregistered) and any related applications and other intellectual property rights (“Intellectual Property Rights”), in or connected with the Game and each part thereof (including, by way of example only, any titles, code, themes, objects, characters, stories, catchphrases, concepts, artworks, animations, sounds, music, audio-visual effects and methods of operation) are owned by, belong to and vest in us or our licensors. 
8.2 The Game may contain certain licensed materials and our licensors may act to protect their rights in the event of any breach of these Terms. All trademarks are the property of their respective owners.

9. SCHEIDBAARHEID.

9. SEVERABILITY.

In het geval dat een bepaling van deze Voorwaarden door een bevoegde rechtbank of gerechtelijke instantie niet afdwingbaar wordt geacht, zal deze bepaling in de maximaal toegestane mate worden afgedwongen en zullen de overige delen van deze Voorwaarden volledig van kracht blijven.

In the event that any provision of these Terms shall be held by a court or other tribunal of competent jurisdiction to be unenforceable, this provision will be enforced to the maximum extent permissible and the remaining parts of these Terms shall remain in full force and effect.

10. TOEPASSELIJKE WETGEVING.

10. APPLICABLE LAW.

10.1 Voor zover toegestaan door de plaatselijke wetgeving van het land waar u de Game koopt of gebruikt (met inbegrip van Virtuele items en de Online Service) zijn deze Voorwaarden onderworpen aan het Engelse recht. 
10.2 Indien het Engelse recht niet kan worden toegepast in het land waar u de Game hebt gekocht of gebruikt, is de plaatselijke wetgeving van toepassing. 
10.3 De Game (en elk onderdeel ervan, met inbegrip van Virtuele items en de Online Service) is bedoeld voor gebruik en mag alleen worden gebruikt in landen waar dit gebruik wettelijk is toegestaan.

As the Milestone Services and applicable laws evolve, we may – and probably will – update these Terms. When we do, we’ll inform the user of the new agreement which will supersede and replace these Terms. The user will be given an opportunity to review any new agreement we present to them and decide whether they wish to agree to the revised terms. If they accept the new agreement, they’ll be able to continue using the Milestone Services. If they don’t, they won’t be able to use the Milestone Services anymore.
