Dependendo do tipo mas sobretudo do número de sinalizações recebidas, Milestone se reserva o direito de suspender o usuário para um número variável de dias: um dia, três dias, sete dias, quinze dias, um mês. Superado este último limite, poderá incorrer em suspensão permanente<br>3.4 A Milestone reserva-se o direito de estabelecer qual conduta está sendo violada ou, por outro lado, fora da intenção ou espírito destes Termos e/ou do Jogo e/ou do Serviço Online. Entretanto, se o que você tiver feito puder ser corrigido lhe daremos uma oportunidade plausível para fazê-lo. <br>3.5 Após a conclusão, não poderá mais usar qualquer Jogo e será solicitado a apagar o Jogo de seu console ou dispositivo.<br>3.6 Os Serviços Milestone não estão disponíveis em uma região. Caso se verifique uma circunstância semelhante, teremos o cuidado de publicar uma comunicação no nosso website e/ou no próprio jogo, para assinalar a interrupção de uma funcionalidade substancial de um jogo ou de todos os Serviços Milestone em uma região<br><br>4. SERVIÇO ONLINE.<br><br>4.1 A Milestone poderá, mas não será obrigada a, fornecer e manter determinadas funcionalidades online, conectividade e interatividade de jogos de rede online e outras funcionalidades online relacionadas com o Jogo, incluindo, sem limitação, os modos de jogo online 'Evento Único' e 'Campeonato Personalizado' ("Serviço Online") sujeitos a estes Termos. <br>4.2 Não podemos garantir que o Serviço Online ou uma parte específica do Serviço Online, inclusive qualquer Conteúdo de Usuário, se existente, estará sempre disponível. <br>4.3 O Serviço Online é apenas para uso pessoal, “tal como é” e todo uso deve estar de acordo com estes Termos.<br><br>Restrições de Idade<br>4.4 Para  jogar é necessário aceitar o acordo com o usuário da Milestone e ter em conta a política sobre a privacidade e sobre os cookies da Milestone. Para aceder às funcionalidades online são exigidas uma conexão à internet e uma conta da plataforma. Além disso é necessário que o respetivo registo seja efetuado por um sujeito com, pelo menos, treze anos de idade.<br><br>Regras do Usuário<br>4.5 Concorda também que de maneira nenhuma terá uma conduta que possa ser ilegal ou que dê origem a responsabilidade civil ou criminal ou que possa desacreditar-nos ou ao Jogo. <br>4.6 Quando o Jogo permite compartilhar mensagens predefinidas com outros usuários, teremos o direito de remover, restringir, suspender ou alterar essa opção por qualquer motivo a nosso critério exclusivo.  <br>4.7 Você colaborará totalmente conosco para investigar qualquer atividade suspeita, fraudulenta ou imprópria.<br>4.8 No caso de perceber que o comportamento de outro usuário viola estes Termos pedimos para informar-nos entrando em contato conosco através dos Serviços de Apoio com detalhes da possível violação e/ou o usuário responsável. Tomaremos as medidas cabíveis para resolver qualquer violação. <br><br>Atenção: <br>Quando existente, o uso do Serviço Online é totalmente por sua conta e risco. É um risco conhecido no uso de Internet que as pessoas não são necessariamente quem dizem ser. As pessoas podem fornecer informações ou comportar-se de uma forma não confiável, enganosa, ilícita ou ilegal. A Milestone não tem como saber se as declarações feitas pelos outros usuários do Jogo e/ou do Serviço Online são verdadeiras. Esta é uma decisão que pode ser tomada apenas por você e recomenda-se tomar um pouco de cuidado.  Ao jogar o Jogo e usando o Serviço Online e suas partes você aceita que este é o caso e aceita o risco associado ao mesmo.  Os usuários devem tomar muito cuidado em relação à divulgação de suas próprias informações pessoais.<br><br>5. CRIAÇÃO E PERSONALIZAÇÃO DOS CONTEÚDOS DO USUÁRIO.<br><br>5.1 O Jogo pode incluir uma função de Editor que permite ao usuário o a outros usuários do Jogo a criação de Conteúdos do Usuário (como definidos no artigo 5.1.1 seguinte) a serem utilizados no âmbito do mesmo Jogo, a serem carregados, compartilhados, disponibilizados ou enviados para o Serviço Online para si mesmo e/ou para outros jogadores. Além disso, o Usuário tem a possibilidade de enviar comunicações a nós ou a terceiros e/ou fornecer os Conteúdos do Usuário e/ou informações para seu uso no âmbito do Jogo ou de outra tipologia, por nossa parte ou por parte de terceiros.<br><br>Nos termos destas Condições:<br>5.1.1 A definição de “Conteúdos do Usuário” (no singular “Conteúdo do Usuário”) abrange qualquer conteúdo criado pelo Usuário mediante as funções de Editor que podem estar incluídas no Jogo,  tais como, a título exemplificativo e não exaustivo, pistas, cores e motivos personalizados, capacetes, adesivos, adesivos do piloto, macacões e veículos, e carregado, disponibilizado ou enviado pelo Usuário ao Serviço Online, para si mesmo e/ou para os demais usuários, a ser utilizado no âmbito do Jogo.<br>5.1.2 “Distribuir” significa utilizar, vender, comercializar, promover, conceder em sublicença aos usuários finais, distribuir ou de qualquer outra forma disponibilizar a terceiros.<br>5.2 Em relação UNICAMENTE ao uso do Jogo e do Serviço Online (se e quando tal serviço existir) e em virtude destes Termos e Condições, o Usuário pode (e para tal lhe é concedida uma licença limitada e não exclusiva e o direito a) utilizar o software que é parte do Jogo e do Serviço Online para comunicar com os demais usuários do Jogo, mediante o Serviço Online, e publicar, transmitir, comunicar e disponibilizar os Conteúdos do Usuário. Desta forma, com a presente, o Usuário concede-nos um direito ilimitado, transferível, sublicenciável, isento de direitos, perpétuo, irrevogável, não exclusivo e a licença de utilizar e disponibilizar tais Conteúdos do Usuário em relação ao Jogo, em qualquer modalidade ou suporte.<br>5.3 Estamos empenhados na atividade de marketing e publicação do Jogo e no fornecimento dos relativos serviços de entretenimento sob forma de Serviço Online. Ademais, estamos empenhados na transmissão, arquivamento, recuperação, hosting, formatação ou tradução dos Conteúdos do Usuário sem seleção ou alteração do conteúdo da comunicação, para a qual operamos unicamente como trâmites.<br>5.4 Instalando Ao instalar e utilizar o Jogo, o Usuário aceita e confirma que não temos a responsabilidade de rever o eventual Conteúdo do Usuário que tenha sido disponibilizado, com base no fato que não seremos solicitados a exercer qualquer controle ou juízo sobre o conteúdo ou sobre o material publicado ou seu conteúdo. Para maior clareza, destacamos que as opiniões manifestadas em qualquer Conteúdo do Usuário representam as opiniões dos respectivos autores e não as de Milestone, salvo quando diversamente especificado por nós. <br>5.10.7 viole a propriedade intelectual ou outros direitos de terceiros, ou encoraje tal violação ou implique a divulgação das informações pessoais de qualquer jogador (diferentes das próprias, como mensagem privada);<br>5.10.8 seja tecnicamente danosa, como a introdução de vírus informáticos,  worm, bombas lógicas ou outros programas ou dados maliciosos ou ainda, em outra forma, tente ou consiga efetivamente alterar ou interferir com o Jogo ou sobrecarregue ou interrompa qualquer computador ou servidor utilizado pelo Jogo;<br>5.10.9 possa ser considerada uma comunicação comercial ou de marketing;<br>5.10.10 promova atividades ilegais ou ilícitas, com inclusão, a título exemplificativo e não limitativo, do aliciamento, do jogo de azar ou da venda de remédios comercializáveis somente com receita médica;<br>5.10.11 esteja dirigida a pessoas menores de 18 anos ou tente combinar encontros com pessoas de idade inferior a 18 anos;<br>5.10.12 contenha qualquer material limitado, incluindo, mas não limitado a isso, senhas, informações sanitárias ou reservadas, de qualquer pessoa; <br>5.10.13 constitui, constitua, segundo nosso parecer razoável, um uso impróprio do Jogo ou uma tentativa de obter o acesso não autorizado ao Jogo ou a suas partes o às contas de outros usuários ou redes ou do console ou dispositivo destes; ou ainda<br>5.10.14 solicite, convide, encoraje, suporte, alimente ou provoque, total ou parcialmente, tudo quanto indicado acima.<br><br>Conteúdos Usuário que podem ser criados mediante Editor (aplicáveis onde e quando existir o Serviço Online)<br>5.11 Com base na Cláusula 5.8 acima, em relação a qualquer Conteúdo do Usuário criado e carregado pelo usuário no Serviço Online, o mesmo usuário nos concede um direito e uma licença não exclusivos, isentos de royalties, perpétuos, irrevogáveis, no mundo inteiro e finalizados a:<br>5.11.1 Distribuir seu Conteúdo do Usuário mediante o Serviço Online; <br>5.11.2 utilizar e disponibilizar telas e sequências vídeo de seu Conteúdo do Usuário e criar e disponibilizar (inclusive mediante serviços de terceiros) esses outros materiais promocionais e de marketing a nosso critério, com o objetivo de promover a Pista ou a Personalização e as Cores da moto que criou, o Jogo e/ou o Serviço Online, em todos os suportes;<br>5.11.3 Distribuir a versão demo ou eventuais versões gratuitas do Conteúdo do Usuário com o objetivo de rever, promover e comercializar unicamente o Conteúdo do Usuário personalizado; e; <br>5.11.4 utilizar qualquer marca ou nome comercial dos quais o usuário tenha conhecimento ou seu Conteúdo do Usuário em relação à distribuição do Conteúdo do Usuário nos termos deste Instrumento.<br>5.12 O usuário garante-nos e declara-nos que (desde que o Conteúdo do Usuário seja derivado do Jogo ou do material fornecido por Milestone):<br>5.12.1 é proprietário ou detém a licença do Conteúdo do Usuário e de todos os Direitos de Propriedade Intelectual relativos);<br>5.12.2 tem o pleno poder de firmar os presentes Termos e Condições e tem o direito de conceder os direitos, as licenças e as atribuições neles contemplados, bem como de dispor de todas as licenças e as atribuições necessárias para tal;<br>5.13 O usuário indenizará (concordará em ressarcir) e manterá isenta Milestone contra qualquer ação, reclamação, procedimentos, custas e danos (inclusive eventuais danos ou ressarcimentos por nós pagos em função de orientação de nossos consultores jurídicos para definir ou resolver qualquer controvérsia) bem como todas as despesas legais ou outras custas, também aquelas derivantes de qualquer violação das garantias citadas acima ou destes Termos e Condições.<br><br><br>6. INDENIZAÇÃO E RECURSOS. <br><br>7.1 Pelo presente, você indeniza (concorda em compensar), defende e isenta a Milestone e nossas afiliadas, administradores, diretores, proprietários, licenciadores, prestadores de serviços, parceiros, contratados, empregados, agentes e licenciados (coletivamente, as "Partes Indenizadas") de qualquer responsabilidade, reclamação, custos e despesas (incluindo despesas legais e honorários advocatícios) incorridos pelas Partes Indenizadas em relação a qualquer reclamação decorrente de qualquer violação destes Termos ou reclamações decorrentes direta ou indiretamente de seu uso ou mau uso do Jogo (que inclui Itens Virtuais e o Serviço Online, quando existentes), qualquer Conteúdo de Usuário; e/ou qualquer outro uso que não esteja de acordo com os termos destes Termos.  O usuário deverá colaborar plenamente conosco na defesa de qualquer reclamação desse tipo e reservamo-nos o direito de, às nossas próprias custas, assumir a defesa e o controle exclusivos de qualquer assunto sujeito a indenização de sua parte.<br>7.2 Você também concorda que o objeto destes Termos é de caráter único com valor especial e que seríamos irreparavelmente prejudicados se estes Termos não fossem especificamente aplicados e, portanto, você concorda que teremos o direito, sem vínculo, outra garantia ou prova de danos, a recursos equitativos adequados (incluindo medidas preventivas) com relação a violações destes Termos, além de outros recursos nesse sentido que possamos ter à disposição de acordo com as leis aplicáveis.<br>7.3 Nossos licenciadores serão terceiros beneficiários ao abrigo destes Termos e terão o direito expresso de fazer cumprir as suas disposições e de usufruir dos benefícios destas proteções.<br><br>8. The user shall not make available, nor indeed publish or transmit to the Game, any statement, material or other User Content, or use the Online Service or Game in any way which:<br>5.10.1 is abusive, seditious, pornographic, aggressive, homophobic, defamatory, false, instigates hatred, is discriminatory, obscene, offensive, provocative, sexist or racist;<br>5.10.2 molests or intimidates any person, or inhibits or prevents the ability of other users to communicate or read conversations (including the use of any macros/SPAM for the general base of gamers, or a single individual, in order to interrupt the chat);<br>5.10.3 breaches any Intellectual Property Right or other rights of any person (on condition that the User Content is derived from the Game or the material supplied by us);<br>5.10.4 gives rise to any behaviour involving exploitation through, but not limited to, third-party programmes, bots, scripts, viruses or other means reasonably prohibited by us on an as-and-when basis, or that exploits bugs, unforeseen errors or undocumented features to access restricted parts of the game, or otherwise engages in activities that we reasonably deem are contrary to the "spirit" of the Game;<br>5.10.5 encourages any breach of these Terms and Conditions, or the terms of service of a third-party service provider;<br>5.10.6 are Illegal, malicious, misleading (including impersonation), discriminatory, or give rise to civil or criminal liability, or which might jeopardise the reputation of Milestone, the Online Service or the Game;<br>5.10.7 breaches the intellectual property or other rights of third parties, or facilitates or encourages such a breach, or involves the distribution of personal information of any gamer (other than one’s own, such as private messages);<br>5.10.8 is technically damaging, such as introducing computer viruses, worms, logic bombs or other harmful software or data, or otherwise attempting or effectively modifying or interfering with the Game, or overloading or disrupting any computer or server used by the Game;<br>5.10.9 may be considered commercial or marketing communication;<br>5.10.10 promotes illegal or unlawful activities, including but not limited to solicitation, gambling or the sale of prescription medication;<br>5.10.11 is directed at individuals under the age of 18 or those seeking or attempting to arrange to meet a person under the age of 18;<br>5.10.12 contains any restricted material, including but not limited to passwords, medical information or confidential information of any person; <br>5.10.13 constitutes, in our reasonable opinion, misuse of the Game or an attempt to gain unauthorised access to the Game or its parts, or the accounts of other users or networks, or their console or device; or<br>5.10.14 solicits, invites, encourages, supports, incites or provokes - in whole or in part - any of the above.<br><br>User Contents which can be created using the Editor (applicable where the Online Service exists)<br>5.11 According to Clause 5.8 above, in relation to any User Content created and uploaded by the user on the Online Service, the user shall grant us the right and licence, on a non-exclusive basis, which shall be deemed free of royalties, perpetual and irrevocable, on a worldwide basis, for:<br>5.11.1 distributing their User Content via the Online Service;;<br>5.11.2 using and making available screenshots and video sequences of their User Content, and creating and making available (also through third-party services) any such further promotional and marketing materials at our discretion, for the purposes of promoting the Track or Livery of the motorcycle they have created, the Game and/or the Online Service on all media;<br>5.11.3 distributing the demo or free versions of the User Content with an end to reviewing, promoting and marketing solely the customised User Content; and; <br>5.11.4 using any commercial brand or commercial name of which the user is aware, or their User Content in relation to the distribution of the User Content below. 	<br>5.12 The user guarantees and declares the following to us (on condition that the User Content derives from the Game, or the material supplied by Milestone):<br>5.12.1 that they are the owner or licence holder of the User Content, and all the Intellectual Property Rights pertaining to it;<br>5.12.2 that they have the full power to enter into these Conditions and the Terms herein, and are entitled to grant the rights, licences and assignments contained in them, and that they hold all licences and assignments required to do so;<br>5.13 The user shall indemnify (agree to compensate) and hold Milestone harmless against all actions, claims, proceedings, costs and damages (including any damages or settlements paid by us on the advice of our legal advisors to settle or resolve any claim), and all legal fees or other expenses arising from any breach of the above warranties, or these Terms and Conditions.<br><br>6. WARRANTY AND LIMITATION OF LIABILITY.<br><br>6.1 We warrant that we have used and will use reasonable efforts to ensure that:<br>6.1.1 we are entitled to grant the rights and licenses granted herewith;<br>6.1.2 the Game will be of satisfactory quality;<br>6.1.3 we have used and will use reasonable efforts to ensure that the Game and/or the Online Service will be available for six (6) months from the date on which you purchase the Game; and<br>6.1.4 the Online Service, when made available by us, shall be of satisfactory quality, as described and fit for purpose.<br>6.2 To the maximum extent permitted by law, and save as expressly provided in these Terms, we give no warranty in connection with the Online Service and exclude liability for any loss or damage of any kind, regardless of how it arises, including without limitation any direct, indirect, punitive or consequential loss, regardless of whether it arises from any issue you notify to us, and we shall have no liability to pay any money by way of compensation, including without limitation all liability in relation to:<br>6.2.1 the availability of the Online Service;<br>6.2.2 any incorrect or inaccurate information on the Online Service and all errors, interruptions to or delays in updating the Online Service;<br>6.2.3 the infringement by any person of any Intellectual Property Rights of any third party caused by their use of the Online Service;<br>6.2.4 any amount or kind of loss or damage due to viruses or other malicious software that may infect a user's computer equipment, software, data or other property caused by persons accessing, using or downloading the Online Service; <br>6.2.5 all representations, warranties, conditions and other terms which but for this notice would have effect.<br>6.3 Except as specifically provided in these terms, and to the maximum extent permitted by law:<br>6.3.1 The Game is provided on an "as is" and “as available” basis without warranty or guarantee of any kind (express or implied) other than those set out in these terms;<br>6.3.2 We only accept liability for direct loss as a result of our breach of the warranties in Clause 6.1 above;<br>6.3.3 Our and our licensors’ maximum liability will be limited to €100;<br>6.3.4 We and our licensors will not in any event be liable in any way for any consequential or indirect loss or damage (save to the extent that damage to your console, PC or other digital content which you own is caused by the Game as a result of our failure to use reasonable care and skill in which case you may be entitled to compensation or we may be obliged to repair your device);<br>6.3.5 We do not warrant or guarantee that the operation of the Game and/or the Online Service will be uninterrupted or error-free, or that errors can or will be corrected, or that the Game or the Online Service are free of viruses or other harmful components;<br>6.3.6 You install and use the Game at your own risk.<br><br>7. INDEMNITY AND REMEDIES. <br><br>7.1 You hereby indemnify (agree to compensate), defend and hold harmless Milestone and our affiliates, officers, directors, owners, licensors, service providers, partners, contractors, employees, agents and licensees (collectively, the "Indemnified Parties") from and against any and all any liabilities, claims, costs and expenses (including legal expenses and attorney fees) incurred by the Indemnified Parties in connection with any claim arising out of any breach by you of these Terms, or claims arising directly or indirectly from your use or misuse of the Game (which includes Virtual Items and the Online Service, where existing), and any User Content; and/or any use other than that set out in these Terms. You shall fully cooperate with us in the defense of any such claim and we reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you.<br>7.2 You further agree that the subject matter of these Terms is of a unique character with special value, and that we would suffer irreparable damage if these Terms were not specifically enforced; as a result you agree that we shall be entitled, without bond, other security, or proof of damages, to appropriate equitable remedies (including injunctive relief) with respect to breaches of these Terms, in addition to other remedies as we may otherwise have available under applicable laws.<br>7.3 Our licensors shall be third-party beneficiaries under these Terms and shall be entitled to enforce its provisions and enjoy the benefits of its protections.<br><br>8. OWNERSHIP. <br><br>8.1 All right, title, interest and ownership rights in the Game and any copyright, design right, database right, patents and any rights to inventions, know-how, trade and business names, trade secrets and trade marks (whether registered or unregistered) and any related applications and other intellectual property rights (“Intellectual Property Rights”), in or connected with the Game and each part thereof (including, by way of example only, any titles, code, themes, objects, characters, stories, catchphrases, concepts, artworks, animations, sounds, music, audio-visual effects and methods of operation) are owned by, belong to and vest in us or our licensors. <br>8.2 The Game may contain certain licensed materials and our licensors may act to protect their rights in the event of any breach of these Terms. All trademarks are the property of their respective owners.<br><br>9. SEVERABILITY.<br><br>In the event that any provision of these Terms shall be held by a court or other tribunal of competent jurisdiction to be unenforceable, this provision will be enforced to the maximum extent permissible and the remaining parts of these Terms shall remain in full force and effect. <br><br>10.
