THESE TERMS AND CONDITIONS ("TERMS") APPLY TO AND SHALL BE EFFECTIVE IN RESPECT OF ANY USE OF THE GAME. THESE TERMS ARE IN ADDITION TO THE APPLICABLE TERMS AND CONDITIONS OF ANY PLATFORM ON WHICH WE MAKE THE GAME AVAILABLE (“PLATFORM TERMS”). THE PLATFORM TERMS ARE THEREFORE DEEMED INCORPORATED INTO THESE TERMS.  
PLEASE READ THE FOLLOWING CAREFULLY BEFORE USING, DOWNLOADING, PURCHASING OR INSTALLING THE GAME (WHICH INCLUDES THE RELEVANT ONLINE SERVICE). IF YOU DO NOT AGREE WITH THESE TERMS YOU MAY NOT USE, DOWNLOAD OR INSTALL THE GAME.
PLEASE NOTE THAT THE GAME REQUIRES AN INTERNET CONNECTION AND THE AVAILABILITY OF OUR ONLINE SERVICE FOR MOST OF ITS FUNCTIONS.
YOU ARE RESPONSIBLE FOR ENSURING THAT YOU HAVE AN INTERNET CONNECTION, AND THAT THE DEVICE YOU USE HAS SUFFICIENT HARDWARE AND SOFTWARE REQUIREMENTS AND MEMORY IN ORDER TO PLAY AND STORE THE GAME AND USE THE ONLINE SERVICE.
THE GAME HAS BEEN DEVELOPED TO WORK ON THE LATEST VERSION OF STEAM, PLAYSTATION®, XBOX, NINTENDO SWITCH™, AMAZON LUNA AND EPIC GAMES STORE AT THE TIME OF ITS RELEASE. THE PLATFORM HOLDERS MAY OCCASIONALLY UPDATE THEIR SOFTWARE; WE WILL ENDEAVOR, BUT NOT BE OBLIGATED, TO UPDATE THE GAME IF NECESSARY, TO ENSURE THAT ITS FUNCTIONS AND PERFORMANCE CONTINUE WITH ANY UPDATE RELEASE. IT IS YOUR OBLIGATION TO ENSURE THAT YOU ARE USING THE LATEST COMPATIBLE PUBLIC RELEASE OF ANY OPERATING SYSTEM FOR YOUR CONSOLE OR PC.
THE GAME COMPRISES COPYRIGHT WORKS OF MILESTONE AND/OR ITS LICENSORS. THE GAME IS LICENSED, NOT SOLD.  YOUR LICENSE CONFERS NO TITLE OR OWNERSHIP IN THE GAME.  THE GAME IS SOLELY INTENDED FOR USE BY END USERS ACCORDING TO THESE TERMS. ANY USAGE, REPRODUCTION OR REDISTRIBUTION OF THE GAME NOT IN ACCORDANCE WITH THESE TERMS IS EXPRESSLY PROHIBITED.

1. LIMITED USE LICENSE.

1. LICENÇA DE USO LIMITADO.

1.1 Milestone hereby grants you limited, non-exclusive right and license to download, install and use the Game for your personal, non-commercial use only, on compatible consoles or devices that are owned by you, subject to these Terms.
1.2 These Terms, and your use of the Game, do not give you any rights of ownership over any property in the game, whether tangible or intangible (including any Track or Bike livery or customized rider/bike that you create).
1.3 This clause applies if we offer the Game through the Steam platform (“Steam”), which is hosted by Valve S.A.R.L. (in the EU) and Valve Corporation (in the US). Where applicable, you will need a Steam account to play the Game, and your use of Steam is subject to the Steam Subscriber Agreement, which you can find online here.  The Steam Subscriber Agreement changes from time to time; if it becomes inconsistent with this EULA, where conflicts arise, the Steam Subscriber Agreement takes precedence. Steam allows refunds for the Game in certain circumstances.  You can find out how on the Steam website here: Steam Refunds.
1.4 If you install or use the Game on any third party platform including without limitation the PlayStation®, Microsoft Xbox, Nintendo, Amazon Luna and Epic Games Store platforms then the terms of these platforms will all apply.
1.5 You and we acknowledge that these Terms are agreed between you and us only, and not with Apple Inc, nor any subsidiary or affiliate company of Apple Inc. You also acknowledge that we are solely responsible for the Game and the content thereof.
1.6 If you are playing on an Android device, your use of the Game may require you to have a Google account. Your access to the Game will be linked to your Google account and you are required to comply with Google policies to use the Game.

1.1 A Milestone confere-lhe um direito e licença limitados e não exclusivos para baixar, instalar e usar o Jogo para seu uso pessoal e não comercial somente em consoles ou dispositivos compatíveis que sejam de sua propriedade, sujeitos a estes Termos.
1.2 Estes Termos, e seu uso do Jogo, não lhe confere quaisquer direitos de titularidade em qualquer propriedade no jogo tangível ou intangível (inclusive qualquer slogan de Pista ou Moto ou para motociclista/moto customizado que você criar).
1.3 Esta cláusula aplica-se se oferecermos o Jogo através da plataforma Steam (“Steam”), que é hospedada pela Valve S.A.R.L. (na EU) e Valve Corporation (nos EUA). Se assim for, significa que precisa ter uma conta Steam para jogar o Jogo, e seu uso de Steam está sujeito ao Contrato de Assinante Steam, que pode encontrar online here.  O Contrato de Assinante Steam é alterado de tempos em tempos, e se porventura se tornar inconsistente com este EULA então, em caso de conflito, o Contrato de Assinante Steam tem precedência.  Em alguns casos, a Steam permite obter um reembolso pelo Jogo.  No site abaixo estão indicadas as informações para obter o reembolso: Steam Refunds.
1.4 Se instalar ou usar o Jogo em qualquer plataforma de terceiros, incluindo, sem limitação, as plataformas PlayStation®, Microsoft Xbox, Nintendo, Amazon Luna e Epic Games Store serão então aplicáveis todos os termos dessas plataformas.
1.5 Ambos reconhecemos que estes Termos são celebrados apenas entre nós, e não com Apple Inc, nem com qualquer empresa subsidiária ou afiliada da Apple Inc. Você também reconhece que somos os únicos responsáveis pelo Jogo e o seu conteúdo.
1.6 Se estiver jogando em um dispositivo Android seu uso do Jogo poderá exigir que tenha uma conta do Google. O seu acesso ao Jogo será vinculado à sua conta do Google e deverá cumprir as políticas do Google para usar o Jogo.

2. END USER OBLIGATIONS.

2. OBRIGAÇÕES DO USUÁRIO FINAL.

2.1 You may use the Game for your own personal, non-commercial use as described in these Terms, but you are not entitled to and may not do any of the following, except to the extent expressly permitted by these Terms:
2.1.1 sell, transfer, copy, reproduce, translate, communicate, reverse engineer, publish, stream, distribute, rent, loan, sub-license, derive source code from, modify, adapt, merge, disassemble, decompile, create derivative works based on or otherwise transfer or deal in copies or reproductions of the Game, or any part or interest in it, to other parties in any way except where the Game expressly permits you to do so by sharing Game content on social media;  
2.1.2 remove, modify or tamper with any copyright, trademark or other notice;
2.1.3 engage in any act that we deem to be in conflict with the spirit or intent of the Game and/or the Online Service, including, without limitation, using cheats, exploits, automation software, bots, hacks, mods or any unauthorized third-party software designed to modify or interfere with the Game;
2.1.4 attempt to gain unauthorized access to the Online Service, or to the computers, devices, servers, or networks connected to the Online Service by any means other than the user interface provided by us; or
2.1.5 use the Game for any unlawful or immoral purposes.   
2.2 You may not use, access or otherwise export or re-export the products except as authorized by United States law and the laws of the jurisdiction in which the Services were obtained. In particular, but without limitation, the Games may not be exported, re-exported or otherwise made available (a) into any country or region embargoed by the U.S. Government, or (b) to anyone on the U.S. Treasury Department's Specially Designated Nationals List or the U.S. Department of Commerce Denied person List or Entity List, EU consolidated sanctions list with designated persons. By using the Games, you represent and warrant that you are not located in any such country or on any such list.

2.1 Você pode usar o Jogo para seu uso pessoal, uso não comercial, como descrito nestes Termos, mas não tem o direito e não pode efetuar nada de quanto a seguir, exceto na medida expressamente permitida por estes Termos: 
2.1.1 vender, transferir, copiar, reproduzir, traduzir, comunicar, engenharia reversa, publicar, transmitir, distribuir, alugar, emprestar, sublicenciar, derivar código fonte, alterar, adaptar, fundir, desmontar, descompilar, criar trabalhos derivados baseados ou porventura transferir ou negociar em cópias ou reproduções do Jogo ou qualquer parte ou interesse nele por terceiros de qualquer forma, exceto quando o Jogo permitir expressamente que o faça através do compartilhamento de conteúdo do Jogo em redes sociais;  
2.1.2 remover, alterar ou adulterar qualquer direito autoral, marca registrada ou outra informação;
2.1.3 participar de qualquer ato que consideremos estar em conflito com o espírito ou a intenção do Jogo e/ou do Serviço Online, incluindo, sem limitação, o uso de fraudes, explorações, software de automação, bots, hacks, moderadores ou qualquer software de terceiros não autorizado destinado a modificar ou interferir com o Jogo;
2.1.4 tentar obter acesso não autorizado ao Serviço Online, ou aos computadores, dispositivos, servidores, ou redes conectadas ao Serviço Online mediante qualquer outro meio que não seja a interface de usuário fornecida por nós; ou 
2.1.5 uso do Jogo para qualquer finalidade ilegal ou imoral.   
2.2 Ao usuário não é permitido usar os produtos, ter acesso aos mesmos, nem exportá-los ou reexportá-los, de outro modo, salvo quando isso seja autorizado pela lei dos Estados Unidos e pelas leis da jurisdição em que os Serviços tiverem sido obtidos.  Em particular e simplesmente a título de exemplo e não exaustivo,  os Jogos não podem ser exportados, reexportados ou disponibilizados (a) em Países ou regiões sujeitos a embargo por parte do Governo dos Estados Unidos, ou (b) a sujeitos inseridos nas listas negras dos Estados Unidos, tal como a Specially Designated Nationals List do Ministério do Tesouro e a Denied persons List ou a Entity List do Ministério do Comércio ou que  estejam incluídos entre os sujeito designados no elenco consolidado das sanções da UE. Utilizando os Jogos, o usuário declara e garante não se encontrar em nenhum desses Países e não estar incluído em nenhum desses elencos.

3. TERMINATION.

3. CONCLUSÃO.

3.1 These Terms and the licenses granted to you by us are effective until terminated.
3.2 You may terminate these Terms at any time and for any reason by deleting and removing the Game from your console or PC.  
3.3 We may terminate these Terms if you fail to abide by them at any time and for any reason, or where we reasonably suspect that you have failed to abide by any of these Terms.  We may take action that we deem reasonable at our sole discretion against users who do not comply with these Terms. This may include banning users from using or accessing the Game and/or the Online Service. For more information about the kind of infraction you could commit, we recommend you to carefully read the entire paragraph 5.11 “User Content Rules”. Based on the type but especially on the number of reports received, Milestone reserves the right to suspend a user for the following days: one day, three days, seven days, fifteen days, one month. Once the latter is exceeded, it’s possible to incur a permanent suspension.
3.4 Milestone reserves the right to determine what conduct it considers to be in violation of, or otherwise outside the intent or spirit of, these Terms and/or the Game and/or the Online Service. However, if your action can be rectified, we shall give you reasonable opportunity to do so. 
3.5 Following termination, you will no longer be permitted to use any of the Game and you will be required to delete the Game from your console or device.
3.6 Milestone Services are no longer available in a region. Should such a circumstance occur, we will publish a communication on our website and/or in the game itself, reporting the interruption of a core feature of a game or all of the Milestone Services in a region.

3.1 Estes Termos e licenças que lhe fornecemos tem eficácia até a conclusão.
3.2 Você poderá rescindir estes Termos em qualquer momento por qualquer razão  apagando e removendo o Jogo de seu console ou PC.  
3.3 Nós poderemos rescindir estes Termos se você não os cumprir a qualquer momento e por qualquer motivo ou se suspeitarmos razoavelmente que não cumpriu qualquer um destes Termos.    Poderemos tomar medidas que considerarmos cabíveis, a nosso critério exclusivo, contra usuários que não cumpram estes Termos, o que poderá incluir a proibição de usuários de usar ou acessar o Jogo e/ou o Serviço Online. Para mais informações sobre quais são as infrações que poderia cometer, recomendamos que leia com atenção na integra o parágrafo 5.11 “Regras do Conteúdo de Usuário”. Dependendo do tipo mas sobretudo do número de sinalizações recebidas, Milestone se reserva o direito de suspender o usuário para um número variável de dias: um dia, três dias, sete dias, quinze dias, um mês. Superado este último limite, poderá incorrer em suspensão permanente
3.4 A Milestone reserva-se o direito de estabelecer qual conduta está sendo violada ou, por outro lado, fora da intenção ou espírito destes Termos e/ou do Jogo e/ou do Serviço Online. Entretanto, se o que você tiver feito puder ser corrigido lhe daremos uma oportunidade plausível para fazê-lo. 
3.5 Após a conclusão, não poderá mais usar qualquer Jogo e será solicitado a apagar o Jogo de seu console ou dispositivo.
3.6 Os Serviços Milestone não estão disponíveis em uma região. Caso se verifique uma circunstância semelhante, teremos o cuidado de publicar uma comunicação no nosso website e/ou no próprio jogo, para assinalar a interrupção de uma funcionalidade substancial de um jogo ou de todos os Serviços Milestone em uma região

4. ONLINE SERVICE.

4. SERVIÇO ONLINE.

4.1 Milestone may, but shall not be obliged to, provide and maintain certain online functions, online network play connectivity and interactivity, and other online features relating to the Game subject to these Terms. These shall include, by way of example, the online ‘Single Event’ and ‘Custom Championship’ game modes (“Online Service”).
4.2 We cannot guarantee that the Online Service or a particular part of the Online Service, including any User Content, will always be available. 
4.3 The Online Service is for personal use only, on an “as is” basis and all use must be in accordance with these Terms.

4.1 A Milestone poderá, mas não será obrigada a, fornecer e manter determinadas funcionalidades online, conectividade e interatividade de jogos de rede online e outras funcionalidades online relacionadas com o Jogo, incluindo, sem limitação, os modos de jogo online 'Evento Único' e 'Campeonato Personalizado' ("Serviço Online") sujeitos a estes Termos. 
4.2 Não podemos garantir que o Serviço Online ou uma parte específica do Serviço Online, inclusive qualquer Conteúdo de Usuário, se existente, estará sempre disponível. 
4.3 O Serviço Online é apenas para uso pessoal, “tal como é” e todo uso deve estar de acordo com estes Termos.

Age Restrictions
4.4 To be able to play, you must first accept the Milestone user agreement and confirm that you have read MIlestone's privacy and cookie policy. In order to use online functions, you must have an Internet connection and an account on the platform; it is also necessary for a person aged at least thirteen to complete the registration process.

4.4 Para  jogar é necessário aceitar o acordo com o usuário da Milestone e ter em conta a política sobre a privacidade e sobre os cookies da Milestone. Para aceder às funcionalidades online são exigidas uma conexão à internet e uma conta da plataforma. Além disso é necessário que o respetivo registo seja efetuado por um sujeito com, pelo menos, treze anos de idade.

User Rules
4.5 You also agree that you will not in any way behave in a manner which is unlawful or which gives rise to civil or criminal liability, or which might call us or the Game into disrepute. 
4.6 Where the Game allows you to share pre-determined messages with other users, we shall be entitled to remove, restrict, suspend or alter that ability for any reason at our sole and absolute discretion.  
4.7 You will cooperate fully with us to investigate any suspected unlawful, fraudulent or improper activity.
4.8 If you feel that the behavior of another user breaches these Terms, please let us know by contacting us via the Support Services with details of the potential breach and/or the user responsible. We will take reasonable steps to deal with any breach.

4.5 Concorda também que de maneira nenhuma terá uma conduta que possa ser ilegal ou que dê origem a responsabilidade civil ou criminal ou que possa desacreditar-nos ou ao Jogo. 
4.6 Quando o Jogo permite compartilhar mensagens predefinidas com outros usuários, teremos o direito de remover, restringir, suspender ou alterar essa opção por qualquer motivo a nosso critério exclusivo.  
4.7 Você colaborará totalmente conosco para investigar qualquer atividade suspeita, fraudulenta ou imprópria.
4.8 No caso de perceber que o comportamento de outro usuário viola estes Termos pedimos para informar-nos entrando em contato conosco através dos Serviços de Apoio com detalhes da possível violação e/ou o usuário responsável. Tomaremos as medidas cabíveis para resolver qualquer violação.

Please note: 
Where the Online Service is available, you use it at entirely your own risk. It is a known risk of internet usage that people are not necessarily who they say they are. People may provide information or behave in a way that is unreliable, misleading, unlawful or illegal. Milestone has no way of telling if statements made by other users of the Game and/or the Online Service are true. This is a decision that can only be made by you, and we recommend exercising caution. By playing the Game and using the Online Service and its parts, you accept that this is the case and accept the associated risk. Users must take particular care in relation to the disclosure of their own personal information.

Atenção: 
Quando existente, o uso do Serviço Online é totalmente por sua conta e risco. É um risco conhecido no uso de Internet que as pessoas não são necessariamente quem dizem ser. As pessoas podem fornecer informações ou comportar-se de uma forma não confiável, enganosa, ilícita ou ilegal. A Milestone não tem como saber se as declarações feitas pelos outros usuários do Jogo e/ou do Serviço Online são verdadeiras. Esta é uma decisão que pode ser tomada apenas por você e recomenda-se tomar um pouco de cuidado.  Ao jogar o Jogo e usando o Serviço Online e suas partes você aceita que este é o caso e aceita o risco associado ao mesmo.  Os usuários devem tomar muito cuidado em relação à divulgação de suas próprias informações pessoais.

5. CREATION AND CUSTOMISATION OF USER CONTENT.

5. CRIAÇÃO E PERSONALIZAÇÃO DOS CONTEÚDOS DO USUÁRIO.

5.1 the definition of “User Contents” (singular “User Content”) includes any content created by the user through any editor functions which might be included in the Game including, but not limited to, tracks, liveries, helmets, decals, pilot stickers, numbers, suits and vehicles, and which are uploaded, made available or sent by the user to the Online Service, for their own purposes and/or for other users to utilise in the Game.

5.1 O Jogo pode incluir uma função de Editor que permite ao usuário o a outros usuários do Jogo a criação de Conteúdos do Usuário (como definidos no artigo 5.1.1 seguinte) a serem utilizados no âmbito do mesmo Jogo, a serem carregados, compartilhados, disponibilizados ou enviados para o Serviço Online para si mesmo e/ou para outros jogadores. Além disso, o Usuário tem a possibilidade de enviar comunicações a nós ou a terceiros e/ou fornecer os Conteúdos do Usuário e/ou informações para seu uso no âmbito do Jogo ou de outra tipologia, por nossa parte ou por parte de terceiros.

For the purposes of these Conditions:
5.1.1 The definition of “User Contents” (singular “User Content”) includes any content created by the user through any editor functions which might be included in the Game including, but not limited to, tracks, liveries, helmets, decals, pilot stickers, numbers, suits and vehicles, and which are uploaded, made available or sent by the user to the Online Service, for their own purposes and/or for other users to utilise in the Game.
5.1.2 "Distribute" means to use, sell, market, promote, sub-license to end-users, distribute or otherwise make available to third parties.
5.2 In relation to the SOLE use of the Game and Online Service (where this service exists) and pursuant to these Terms and Conditions, the user may (and is granted a limited, non-exclusive licence and the right to) use the software that is part of the Game and Online Service to communicate with other users of the Game via the Online Service, and to publish User Content and transmit, communicate and make it available. In this way, the user hereby grants us an unlimited, transferable, sub-licensable, royalty-free, perpetual, irrevocable, non-exclusive licence to use and make available any such User Content in connection with the Game, in any manner or media. 
5.3 We are committed to marketing and publishing the Game and providing its associated entertainment services in the form of the Online Service. Additionally, we engage in the transmission, storage, retrieval, hosting, formatting or translation of User Content without selection or alteration of the communication content, for which we merely serve as a conduit.
5.4 By installing and using the Game, the user agrees and confirms that we are not responsible for reviewing any User Content made available, as we will not be required to exercise any control or give any judgement in relation to the content or published material, or its substance. For the purposes of avoiding any misunderstandings, the opinions expressed in any User Content represent the opinions of the individual authors, and not those of Milestone, unless otherwise specified by us. In particular, but without limitations to the above, we cannot be held responsible, and decline any liability for comments, opinions or observations expressed in any User Content. We shall be entitled to remove, restrict, suspend or alter any User Content (and the ability to share or create User Content, including any Track or Bike Livery) for any reason at our sole and absolute discretion.
5.5 We have the right to remove, limit, suspend or alter any User Content (and the ability to share or create User Content) for any reason, at our sole and absolute discretion.
5.6 The user accepts that we can use, publish, amend, vary and adapt any User Content which the user should make available, publish or transmit to the Game and/or the Online Service for any reason, at our sole discretion. 
5.7 To the extent that User Content derives from the Game or material supplied by us, the user hereby assigns us all intellectual property rights subsisting in the User Content which are owned by them, including all intellectual property rights in any User Content created by them.
5.8 We do not supply any guarantee, and shall not issue any declaration regarding the accuracy, evaluation or validity of the information and material contained in the User Content or Online Service; nor can we be held responsible for any losses or damage caused by the use of said information or material.
5.9 If the user discovers any User Content which they feel contravenes these Terms and Conditions, we would ask them to notify us via support Services and submit details of the User Content concerned..

Nos termos destas Condições:
5.1.1 A definição de “Conteúdos do Usuário” (no singular “Conteúdo do Usuário”) abrange qualquer conteúdo criado pelo Usuário mediante as funções de Editor que podem estar incluídas no Jogo,  tais como, a título exemplificativo e não exaustivo, pistas, cores e motivos personalizados, capacetes, adesivos, adesivos do piloto, macacões e veículos, e carregado, disponibilizado ou enviado pelo Usuário ao Serviço Online, para si mesmo e/ou para os demais usuários, a ser utilizado no âmbito do Jogo.
5.1.2 “Distribuir” significa utilizar, vender, comercializar, promover, conceder em sublicença aos usuários finais, distribuir ou de qualquer outra forma disponibilizar a terceiros.
5.2 Em relação UNICAMENTE ao uso do Jogo e do Serviço Online (se e quando tal serviço existir) e em virtude destes Termos e Condições, o Usuário pode (e para tal lhe é concedida uma licença limitada e não exclusiva e o direito a) utilizar o software que é parte do Jogo e do Serviço Online para comunicar com os demais usuários do Jogo, mediante o Serviço Online, e publicar, transmitir, comunicar e disponibilizar os Conteúdos do Usuário. Desta forma, com a presente, o Usuário concede-nos um direito ilimitado, transferível, sublicenciável, isento de direitos, perpétuo, irrevogável, não exclusivo e a licença de utilizar e disponibilizar tais Conteúdos do Usuário em relação ao Jogo, em qualquer modalidade ou suporte.
5.3 Estamos empenhados na atividade de marketing e publicação do Jogo e no fornecimento dos relativos serviços de entretenimento sob forma de Serviço Online. Ademais, estamos empenhados na transmissão, arquivamento, recuperação, hosting, formatação ou tradução dos Conteúdos do Usuário sem seleção ou alteração do conteúdo da comunicação, para a qual operamos unicamente como trâmites.
5.4 Instalando Ao instalar e utilizar o Jogo, o Usuário aceita e confirma que não temos a responsabilidade de rever o eventual Conteúdo do Usuário que tenha sido disponibilizado, com base no fato que não seremos solicitados a exercer qualquer controle ou juízo sobre o conteúdo ou sobre o material publicado ou seu conteúdo. Para maior clareza, destacamos que as opiniões manifestadas em qualquer Conteúdo do Usuário representam as opiniões dos respectivos autores e não as de Milestone, salvo quando diversamente especificado por nós. Especialmente, mas sem limitações a quanto indicado acima, não somos responsáveis e declinamos quaisquer responsabilidades a respeito de comentários, opiniões ou observações manifestados em qualquer Conteúdo do Usuário.
5.5 Temos o direito de remover, limitar, suspender ou alterar qualquer Conteúdo do Usuário (e a possibilidade de compartilhar ou criar Conteúdos do Usuário) por qualquer razão, a nosso exclusivo critério.
5.6 O usuário aceita que possamos usar, publicar, alterar, variar e adaptar o Conteúdo do Usuário que o mesmo usuário tenha disponibilizado ou publicado ou transmitido ao Jogo e/ou ao Serviço Online, por qualquer razão, a nosso critério.
5.7 Na medida em que o Conteúdo do Usuário derive do Jogo ou do material por nós fornecido, com a presente, o usuário nos atribui todos os Direitos de propriedade intelectual existentes sobre o Conteúdo do Usuário de sua propriedade, inclusive todos os direitos de propriedade intelectual em qualquer Conteúdo do Usuário criado por ele.
5.8 Não fornecemos nenhuma garantia nem emitimos qualquer declaração a respeito da acurácia, da atualização ou da validade das informações e do material contido no Conteúdo do Usuário ou no Serviço Online e não somos responsáveis por eventuais perdas ou danos causados pelo uso de tais informações ou material. 
5.9 Se o usuário descobrir qualquer Conteúdo do Usuário que, a seu ver, contrarie estes Termos e Condições, pedimos a gentileza que o sinalize, entrando em contato conosco mediante os Serviços de suporte com os detalhes do Conteúdo do Usuário.

User Rules of User Content (applicable where the Online Service exists)
5.10 The user agrees and undertakes to have the right to make available, or publish or transmit, their User Contents to the Game, and to grant us the rights specified in clause 5.8. The user shall not make available, nor indeed publish or transmit to the Game, any statement, material or other User Content, or use the Online Service or Game in any way which:
5.10.1 is abusive, seditious, pornographic, aggressive, homophobic, defamatory, false, instigates hatred, is discriminatory, obscene, offensive, provocative, sexist or racist;
5.10.2 molests or intimidates any person, or inhibits or prevents the ability of other users to communicate or read conversations (including the use of any macros/SPAM for the general base of gamers, or a single individual, in order to interrupt the chat);
5.10.3 breaches any Intellectual Property Right or other rights of any person (on condition that the User Content is derived from the Game or the material supplied by us);
5.10.4 gives rise to any behaviour involving exploitation through, but not limited to, third-party programmes, bots, scripts, viruses or other means reasonably prohibited by us on an as-and-when basis, or that exploits bugs, unforeseen errors or undocumented features to access restricted parts of the game, or otherwise engages in activities that we reasonably deem are contrary to the "spirit" of the Game;
5.10.5 encourages any breach of these Terms and Conditions, or the terms of service of a third-party service provider;
5.10.6 are Illegal, malicious, misleading (including impersonation), discriminatory, or give rise to civil or criminal liability, or which might jeopardise the reputation of Milestone, the Online Service or the Game;
5.10.7 breaches the intellectual property or other rights of third parties, or facilitates or encourages such a breach, or involves the distribution of personal information of any gamer (other than one’s own, such as private messages);
5.10.8 is technically damaging, such as introducing computer viruses, worms, logic bombs or other harmful software or data, or otherwise attempting or effectively modifying or interfering with the Game, or overloading or disrupting any computer or server used by the Game;
5.10.9 may be considered commercial or marketing communication;
5.10.10 promotes illegal or unlawful activities, including but not limited to solicitation, gambling or the sale of prescription medication;
5.10.11 is directed at individuals under the age of 18 or those seeking or attempting to arrange to meet a person under the age of 18;
5.10.12 contains any restricted material, including but not limited to passwords, medical information or confidential information of any person; 
5.10.13 constitutes, in our reasonable opinion, misuse of the Game or an attempt to gain unauthorised access to the Game or its parts, or the accounts of other users or networks, or their console or device; or
5.10.14 solicits, invites, encourages, supports, incites or provokes - in whole or in part - any of the above.

Regras do Conteúdo de Usuário (aplicáveis onde e quando existir o Serviço Online)
5.10 O usuário aceita e compromete-se a disponibilizar ou publicar ou transmitir ao Jogo seus Conteúdos do Usuário e a nos conceder os direitos indicados na Cláusula 5.8 e não disponibilizará, nem publicará ou transmitirá ao Jogo qualquer declaração, material ou outro Conteúdo do Usuário, nem utilizará o Serviço Online ou o Jogo em nenhuma forma que:
5.10.1 possa resultar abusiva, subversiva, pornográfica, agressiva, homofóbica, difamatória, falsa, instigadora de ódio, discriminatória, obscena, ofensiva, fomentadora, sexista ou racista;
5.10.2 incomode ou intimide qualquer pessoa ou iniba ou impeça a capacidade dos demais usuários de comunicar ou ler conversas (com inclusão do uso de qualquer macro/SPAM para a base geral dos jogadores ou de um único indivíduo, com o fito de interromper a chat);
5.10.3 viole qualquer Direito de Propriedade Intelectual ou outros direitos de qualquer pessoa (desde que o Conteúdo do Usuário derive do Jogo ou do material por nós fornecido);
5.10.4 dê origem a comportamentos de exploração mediante, mas não limitadamente a isso, programas de terceiros, bot, scripts, vírus ou outros meios que são razoavelmente proibidos por nós, a cada ocasião, ou que desfrutem bugs, erros não previstos ou funcionalidades não documentadas para ter acesso a partes do Jogo restritas ou que, de outra forma, representem atividade que, razoavelmente, consideramos contrárias ao “espírito” do Jogo;
5.10.5 encoraje qualquer violação destes Termos e Condições ou dos termos do serviço de um fornecedor de serviços de terceiros;
5.10.6 seja ilegal, malévola, enganosa (inclusive em caso de imitação), discriminatória ou que origine responsabilidades civis ou penais ou que poderia pôr em risco a reputação de Milestone, do Serviço Online ou do Jogo; 
5.10.7 viole a propriedade intelectual ou outros direitos de terceiros, ou encoraje tal violação ou implique a divulgação das informações pessoais de qualquer jogador (diferentes das próprias, como mensagem privada);
5.10.8 seja tecnicamente danosa, como a introdução de vírus informáticos,  worm, bombas lógicas ou outros programas ou dados maliciosos ou ainda, em outra forma, tente ou consiga efetivamente alterar ou interferir com o Jogo ou sobrecarregue ou interrompa qualquer computador ou servidor utilizado pelo Jogo;
5.10.9 possa ser considerada uma comunicação comercial ou de marketing;
5.10.10 promova atividades ilegais ou ilícitas, com inclusão, a título exemplificativo e não limitativo, do aliciamento, do jogo de azar ou da venda de remédios comercializáveis somente com receita médica;
5.10.11 esteja dirigida a pessoas menores de 18 anos ou tente combinar encontros com pessoas de idade inferior a 18 anos;
5.10.12 contenha qualquer material limitado, incluindo, mas não limitado a isso, senhas, informações sanitárias ou reservadas, de qualquer pessoa; 
5.10.13 constitui, constitua, segundo nosso parecer razoável, um uso impróprio do Jogo ou uma tentativa de obter o acesso não autorizado ao Jogo ou a suas partes o às contas de outros usuários ou redes ou do console ou dispositivo destes; ou ainda
5.10.14 solicite, convide, encoraje, suporte, alimente ou provoque, total ou parcialmente, tudo quanto indicado acima.

User Contents which can be created using the Editor (applicable where the Online Service exists)
5.11 According to Clause 5.8 above, in relation to any User Content created and uploaded by the user on the Online Service, the user shall grant us the right and licence, on a non-exclusive basis, which shall be deemed free of royalties, perpetual and irrevocable, on a worldwide basis, for:
5.11.1 distributing their User Content via the Online Service;;
5.11.2 using and making available screenshots and video sequences of their User Content, and creating and making available (also through third-party services) any such further promotional and marketing materials at our discretion, for the purposes of promoting the Track or Livery of the motorcycle they have created, the Game and/or the Online Service on all media;
5.11.3 distributing the demo or free versions of the User Content with an end to reviewing, promoting and marketing solely the customised User Content; and; 
5.11.4 using any commercial brand or commercial name of which the user is aware, or their User Content in relation to the distribution of the User Content below. 	
5.12 The user guarantees and declares the following to us (on condition that the User Content derives from the Game, or the material supplied by Milestone):
5.12.1 that they are the owner or licence holder of the User Content, and all the Intellectual Property Rights pertaining to it;
5.12.2 that they have the full power to enter into these Conditions and the Terms herein, and are entitled to grant the rights, licences and assignments contained in them, and that they hold all licences and assignments required to do so;
5.13 The user shall indemnify (agree to compensate) and hold Milestone harmless against all actions, claims, proceedings, costs and damages (including any damages or settlements paid by us on the advice of our legal advisors to settle or resolve any claim), and all legal fees or other expenses arising from any breach of the above warranties, or these Terms and Conditions.

Conteúdos Usuário que podem ser criados mediante Editor (aplicáveis onde e quando existir o Serviço Online)
5.11 Com base na Cláusula 5.8 acima, em relação a qualquer Conteúdo do Usuário criado e carregado pelo usuário no Serviço Online, o mesmo usuário nos concede um direito e uma licença não exclusivos, isentos de royalties, perpétuos, irrevogáveis, no mundo inteiro e finalizados a:
5.11.1 Distribuir seu Conteúdo do Usuário mediante o Serviço Online; 
5.11.2 utilizar e disponibilizar telas e sequências vídeo de seu Conteúdo do Usuário e criar e disponibilizar (inclusive mediante serviços de terceiros) esses outros materiais promocionais e de marketing a nosso critério, com o objetivo de promover a Pista ou a Personalização e as Cores da moto que criou, o Jogo e/ou o Serviço Online, em todos os suportes;
5.11.3 Distribuir a versão demo ou eventuais versões gratuitas do Conteúdo do Usuário com o objetivo de rever, promover e comercializar unicamente o Conteúdo do Usuário personalizado; e; 
5.11.4 utilizar qualquer marca ou nome comercial dos quais o usuário tenha conhecimento ou seu Conteúdo do Usuário em relação à distribuição do Conteúdo do Usuário nos termos deste Instrumento.
5.12 O usuário garante-nos e declara-nos que (desde que o Conteúdo do Usuário seja derivado do Jogo ou do material fornecido por Milestone):
5.12.1 é proprietário ou detém a licença do Conteúdo do Usuário e de todos os Direitos de Propriedade Intelectual relativos);
5.12.2 tem o pleno poder de firmar os presentes Termos e Condições e tem o direito de conceder os direitos, as licenças e as atribuições neles contemplados, bem como de dispor de todas as licenças e as atribuições necessárias para tal;
5.13 O usuário indenizará (concordará em ressarcir) e manterá isenta Milestone contra qualquer ação, reclamação, procedimentos, custas e danos (inclusive eventuais danos ou ressarcimentos por nós pagos em função de orientação de nossos consultores jurídicos para definir ou resolver qualquer controvérsia) bem como todas as despesas legais ou outras custas, também aquelas derivantes de qualquer violação das garantias citadas acima ou destes Termos e Condições.

6. WARRANTY AND LIMITATION OF LIABILITY.


6. GARANTIA E LIMITAÇÃO DE RESPONSABILIDADE.

6.1 We warrant that we have used and will use reasonable efforts to ensure that:
6.1.1 we are entitled to grant the rights and licenses granted herewith;
6.1.2 the Game will be of satisfactory quality;
6.1.3 we have used and will use reasonable efforts to ensure that the Game and/or the Online Service will be available for six (6) months from the date on which you purchase the Game; and
6.1.4 the Online Service, when made available by us, shall be of satisfactory quality, as described and fit for purpose.
6.2 To the maximum extent permitted by law, and save as expressly provided in these Terms, we give no warranty in connection with the Online Service and exclude liability for any loss or damage of any kind, regardless of how it arises, including without limitation any direct, indirect, punitive or consequential loss, regardless of whether it arises from any issue you notify to us, and we shall have no liability to pay any money by way of compensation, including without limitation all liability in relation to:
6.2.1 the availability of the Online Service;
6.2.2 any incorrect or inaccurate information on the Online Service and all errors, interruptions to or delays in updating the Online Service;
6.2.3 the infringement by any person of any Intellectual Property Rights of any third party caused by their use of the Online Service;
6.2.4 any amount or kind of loss or damage due to viruses or other malicious software that may infect a user's computer equipment, software, data or other property caused by persons accessing, using or downloading the Online Service; 
6.2.5 all representations, warranties, conditions and other terms which but for this notice would have effect.
6.3 Except as specifically provided in these terms, and to the maximum extent permitted by law:
6.3.1 The Game is provided on an "as is" and “as available” basis without warranty or guarantee of any kind (express or implied) other than those set out in these terms;
6.3.2 We only accept liability for direct loss as a result of our breach of the warranties in Clause 6.1 above;
6.3.3 Our and our licensors’ maximum liability will be limited to €100;
6.3.4 We and our licensors will not in any event be liable in any way for any consequential or indirect loss or damage (save to the extent that damage to your console, PC or other digital content which you own is caused by the Game as a result of our failure to use reasonable care and skill in which case you may be entitled to compensation or we may be obliged to repair your device);
6.3.5 We do not warrant or guarantee that the operation of the Game and/or the Online Service will be uninterrupted or error-free, or that errors can or will be corrected, or that the Game or the Online Service are free of viruses or other harmful components;
6.3.6 You install and use the Game at your own risk.

Garantimos que fizemos e faremos todos os esforços plausíveis para garantir que:
6.1.1 estamos autorizados a garantir os direitos e licenças aqui concedidos; 
6.1.2 o Jogo será de qualidade satisfatória;
6.1.3 fizemos e faremos todos os esforços razoáveis para garantir que o Jogo e/ou o Serviço Online estará disponível durante seis (6) meses a partir da data da compra do Jogo; e 
6.1.4 o Serviço Online, quando disponibilizado por nós será de qualidade satisfatória, conforme descrito e próprio para a finalidade.
6.2 Até o limite máximo permitido por lei, e salvo conforme expressamente previsto nestes Termos, não damos qualquer garantia em relação ao Serviço Online e excluímos a responsabilidade por qualquer perda ou dano de qualquer tipo que possa surgir, inclusive sem limitação, por qualquer perda direta, indireta, punitiva ou consequente, independentemente de tal resultar ou não de qualquer problema que nos seja notificado, e não teremos qualquer responsabilidade pelo pagamento de qualquer soma a título de compensação, incluindo, sem limitação, toda a responsabilidade em relação à:
6.2.1. disponibilidade do Serviço Online; 
6.2.2. qualquer informação incorreta ou imprecisa no Serviço Online e todos os erros, interrupções ou atrasos na atualização do Serviço Online; 
6.2.3 a violação por parte de qualquer pessoa de qualquer Direito de Propriedade Intelectual de terceiros causada pelo uso do Serviço Online; 
6.2.4 qualquer montante ou tipo de perda ou dano devido a vírus ou outro software pernicioso que possa infetar o equipamento informático, software, dados ou outros bens do usuário causados por pessoas que acessam, utilizam ou baixam o Serviço Online; 
6.2.5 todas as declarações, garantias, condições e outros termos que, exceto por este aviso, teriam efeito.
6.3 Exceto conforme especificamente previsto nestes termos e no limite máximo permitido por lei: 
6.3.1 O Jogo é fornecido "tal como está" e "tal como disponível" sem garantias de qualquer espécie (expressa ou implícita) que não as estabelecidas nestes termos;
6.3.2 só aceitamos responsabilidade por perda direta como resultado de nossa violação das garantias na Cláusula 6.1 acima;
6.3.3 A nossa responsabilidade máxima e de nossos licenciadores será limitada a €100,00;
6.3.4 Nós e nossos licenciadores não seremos, em nenhuma hipótese, responsáveis por qualquer perda ou dano consequente ou indireto (exceto na medida em que sejam danos no seu console, PC ou outro conteúdo digital de sua propriedade que  sejam causados pelo Jogo como resultado de nossa falha para tomar cuidado e habilidade razoáveis, portanto, nesse caso poderá ter direito a compensação ou poderemos ser obrigados a reparar seu dispositivo);
6.3.5 Não garantimos que o funcionamento do Jogo e/ou do Serviço Online será ininterrupto ou livre de erros ou que os erros podem ou serão corrigidos, ou que o Jogo ou o Serviço Online estão livres de vírus ou outros componentes prejudiciais.
6.3.6 Você instala e utiliza o Jogo por sua própria conta e risco.

7. INDEMNITY AND REMEDIES.

7. INDENIZAÇÃO E RECURSOS.

7.1 You hereby indemnify (agree to compensate), defend and hold harmless Milestone and our affiliates, officers, directors, owners, licensors, service providers, partners, contractors, employees, agents and licensees (collectively, the "Indemnified Parties") from and against any and all any liabilities, claims, costs and expenses (including legal expenses and attorney fees) incurred by the Indemnified Parties in connection with any claim arising out of any breach by you of these Terms, or claims arising directly or indirectly from your use or misuse of the Game (which includes Virtual Items and the Online Service, where existing), and any User Content; and/or any use other than that set out in these Terms. You shall fully cooperate with us in the defense of any such claim and we reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you.
7.2 You further agree that the subject matter of these Terms is of a unique character with special value, and that we would suffer irreparable damage if these Terms were not specifically enforced; as a result you agree that we shall be entitled, without bond, other security, or proof of damages, to appropriate equitable remedies (including injunctive relief) with respect to breaches of these Terms, in addition to other remedies as we may otherwise have available under applicable laws.
7.3 Our licensors shall be third-party beneficiaries under these Terms and shall be entitled to enforce its provisions and enjoy the benefits of its protections.

7.1 Pelo presente, você indeniza (concorda em compensar), defende e isenta a Milestone e nossas afiliadas, administradores, diretores, proprietários, licenciadores, prestadores de serviços, parceiros, contratados, empregados, agentes e licenciados (coletivamente, as "Partes Indenizadas") de qualquer responsabilidade, reclamação, custos e despesas (incluindo despesas legais e honorários advocatícios) incorridos pelas Partes Indenizadas em relação a qualquer reclamação decorrente de qualquer violação destes Termos ou reclamações decorrentes direta ou indiretamente de seu uso ou mau uso do Jogo (que inclui Itens Virtuais e o Serviço Online, quando existentes), qualquer Conteúdo de Usuário; e/ou qualquer outro uso que não esteja de acordo com os termos destes Termos.  O usuário deverá colaborar plenamente conosco na defesa de qualquer reclamação desse tipo e reservamo-nos o direito de, às nossas próprias custas, assumir a defesa e o controle exclusivos de qualquer assunto sujeito a indenização de sua parte.
7.2 Você também concorda que o objeto destes Termos é de caráter único com valor especial e que seríamos irreparavelmente prejudicados se estes Termos não fossem especificamente aplicados e, portanto, você concorda que teremos o direito, sem vínculo, outra garantia ou prova de danos, a recursos equitativos adequados (incluindo medidas preventivas) com relação a violações destes Termos, além de outros recursos nesse sentido que possamos ter à disposição de acordo com as leis aplicáveis.
7.3 Nossos licenciadores serão terceiros beneficiários ao abrigo destes Termos e terão o direito expresso de fazer cumprir as suas disposições e de usufruir dos benefícios destas proteções.

8. OWNERSHIP.

8.1 All right, title, interest and ownership rights in the Game and any copyright, design right, database right, patents and any rights to inventions, know-how, trade and business names, trade secrets and trade marks (whether registered or unregistered) and any related applications and other intellectual property rights (“Intellectual Property Rights”), in or connected with the Game and each part thereof (including, by way of example only, any titles, code, themes, objects, characters, stories, catchphrases, concepts, artworks, animations, sounds, music, audio-visual effects and methods of operation) are owned by, belong to and vest in us or our licensors. 
8.2 The Game may contain certain licensed materials and our licensors may act to protect their rights in the event of any breach of these Terms. All trademarks are the property of their respective owners.

8.1 Todos os direitos, título, interesse e direitos de propriedade sobre o Jogo e qualquer direito autoral, direito de design, direito de base de dados, patentes e quaisquer direitos de invenções, know-how, nomes comerciais e da empresa, segredos comerciais e marcas comerciais (registrados ou não registrados) e quaisquer aplicações para isso e outros direitos de propriedade intelectual ("Direitos de Propriedade Intelectual"), em ou ligados ao Jogo e a cada sua parte (incluindo, a título de exemplo, apenas quaisquer títulos, códigos, temas, objetos, personagens, histórias, frases, conceitos, obras de arte, animações, sons, música, efeitos audiovisuais e métodos de funcionamento) são de nossa propriedade, nos pertencem ou ou de nossos licenciadores. 
8.2 O Jogo pode conter certos materiais licenciados e nossos licenciadores podem atuar para proteger seus direitos no caso de qualquer violação destes Termos. Todas as marcas registradas são propriedade de seus respectivos proprietários.

9. SEVERABILITY.

In the event that any provision of these Terms shall be held by a court or other tribunal of competent jurisdiction to be unenforceable, this provision will be enforced to the maximum extent permissible and the remaining parts of these Terms shall remain in full force and effect.

No caso em que qualquer disposição destes Termos for considerada inaplicável por um tribunal ou outro tribunal de jurisdição competente, tal disposição será aplicada na máxima extensão permitida e as partes restantes destes Termos permanecerão em plena vigência e efeito.

10. APPLICABLE LAW.

10.1 To the maximum extent permitted by the local law applicable in the country in which you obtain or use the Game (including Virtual Items and the Online Service), these Terms are subject to English Law. 
10.2 In the event that English Law cannot apply in the country you obtained or use the Game, local law will apply. 
10.3 The Game (and each part of it, including Virtual Items and the Online Service) is intended for use and may only be used in countries where all such use is lawful.

As the Milestone Services and applicable laws evolve, we may – and probably will – update these Terms. When we do, we’ll inform the user of the new agreement which will supersede and replace these Terms. The user will be given an opportunity to review any new agreement we present to them and decide whether they wish to agree to the revised terms. If they accept the new agreement, they’ll be able to continue using the Milestone Services. If they don’t, they won’t be able to use the Milestone Services anymore.

Quando isso se verificar, pedimos ao usuário para aceitar um novo acordo que irá anular os presentes Termos substituindo-se a esses.
