YOU SHOULD CAREFULLY READ THE ENTIRE FOLLOWING END USER LICENSE AGREEMENT BEFORE DOWNLOADING, INSTALLING, USING OR PLAYING THE GAME OR ANY RELATED SOFTWARE (collectively, the “GAME”).  THIS AGREEMENT CONTAINS IMPORTANT TERMS THAT AFFECT YOUR LEGAL RIGHTS.  BY DOWNLOADING, INSTALLING, USING OR PLAYING THE GAME, YOU AGREE TO BE BOUND BY ALL THE TERMS OF THIS AGREEMENT.  IF YOU DO NOT AGREE TO ALL THE TERMS OF THIS AGREEMENT, PLEASE DO NOT (AND YOU ARE NOT PERMITTED TO) DOWNLOAD, INSTALL, USE OR PLAY THE GAME.  
IN ORDER TO PLAY THE GAME AND/OR ACCESS CERTAIN FEATURES, YOU MAY BE REQUIRED TO HAVE AND MAINTAIN A VALID AND ACTIVE USER ACCOUNT WITH ZENIMAX (“ACCOUNT”)
BY DOWNLOADING, INSTALLING, USING OR PLAYING THE GAME YOU CONFIRM THAT YOU HAVE READ THIS END USER LICENSE AGREEMENT, THE ZENIMAX TERMS OF SERVICE AND THE ZENIMAX PRIVACY POLICY AND THAT YOU AGREE TO THE TERMS IN THIS AGREEMENT AND THE TERMS OF SERVICE, (COLLECTIVELY, THIS “AGREEMENT”).  YOU FURTHER ACKNOWLEDGE AND UNDERSTAND THAT ZENIMAX WILL PROCESS YOUR PERSONAL INFORMATION IN ACCORDANCE WITH THE ZENIMAX PRIVACY POLICY (available at https://bethesda.net/en/document/privacy-policy). IF YOU DO NOT ACCEPT THE TERMS OF THIS AGREEMENT, OR YOU HAVE NOT READ AND UNDERSTOOD THE ZENIMAX PRIVACY POLICY, DO NOT DOWNLOAD, INSTALL OR USE THE GAME.
For ease of reference, the ZeniMax “Terms of Service” or the “ZeniMax Terms of Service” that you agreed to at the time you established your Account with ZeniMax may be found at: https://bethesda.net/en/document/terms-of-service.  
This Agreement is between you and ZeniMax Media Inc. (“ZeniMax”). 
AS SET OUT IN SECTION 1 OF THE TERMS OF SERVICE, IF YOU ARE RESIDENT IN THE EEA, UNITED KINGDOM, SWITZERLAND, AUSTRALIA, NEW ZEALAND, TURKEY, JAPAN OR BRAZIL, ZENIMAX ACKNOWLEDGES THAT THERE ARE CERTAIN GUARANTEES, WARRANTIES, TERMS AND CONDITIONS (INCLUDING IN RESPECT OF REFUNDS AND RETURNS AND UNFAIR TERMS) IMPOSED BY THE LAWS RELATING TO THE SUPPLY OF GOODS, SERVICES AND DIGITAL CONTENT WHICH THE LAWS EXPRESSLY PROVIDE MAY NOT BE EXCLUDED, RESTRICTED OR MODIFIED OR MAY ONLY BE LIMITED TO A CERTAIN EXTENT (THE "STATUTORY OBLIGATIONS").  NOTHING IN THIS EULA EXCLUDES, RESTRICTS OR MODIFIES THE STATUTORY OBLIGATIONS OTHERWISE THAN ACCORDING TO SUCH LAWS.
PHOTOSENSITIVITY WARNING:
A very small percentage of individuals may experience epileptic seizures or blackouts when exposed to certain visual images, including without limitation light patterns or flashing lights.  If you experience any of the following symptoms while playing the Game, immediately discontinue use and consult your physician before resuming play: blackouts, seizures, dizziness, altered vision, eye or muscle twitches, jerking or shaking of arms or legs, loss of awareness, disorientation, confusion, any involuntary movement, or convulsions.
The ZeniMax Terms of Service contain a Dispute Resolution and Arbitration Provision, including a Class Action Waiver, (the “Disputes Provision”) that - if you reside in a jurisdiction outside of the EEA/United Kingdom/Switzerland/Australia/New Zealand/Turkey/Japan or Brazil that permits class actions or other collective disputes - affects your rights under the ZeniMax Terms of Service and this End User License Agreement with respect to disputes you may have with ZeniMax.  That Disputes Provision is incorporated into this End User License Agreement by this reference and forms a part of this End User License Agreement as if such provision was fully restated in this End User License Agreement.  You may opt out of the binding individual arbitration and class action waiver as provided in the ZeniMax Terms of Service.  
Any and all uses of the Game are governed by the terms of this End User License Agreement and the ZeniMax Terms of Service.  To play the Game, you must (a) obtain from ZeniMax access to the Game and (b) download the Game Client (as defined below).  The ZeniMax Terms of Service are hereby incorporated into and form a part of this End User License Agreement by this reference as if such provisions were fully restated in this End User License Agreement.  The End User License Agreement is a “EULA” and constitutes “Supplemental Terms” as contemplated by the ZeniMax Terms of Service.  The Game is made available and distributed solely for use by authorized end users according to the terms of this Agreement, including the ZeniMax Terms of Service.  Any use, reproduction, modification or distribution of the Game not expressly authorized by the terms of this Agreement is expressly prohibited.  You agree that the Game, the Game Client, other Game related software, Content (as defined in the Terms of Service) specific to the Game and your access to and use of the Game are all a “Service” for the purposes of this Agreement, including the ZeniMax Terms of Service.  Any rights not granted to you in this Agreement are reserved by ZeniMax. 
You have previously acknowledged that ZeniMax may process your personal information in accordance with the ZeniMax Privacy Policy which is available at https://bethesda.net/en/document/privacy-policy and you have agreed to the ZeniMax Code of Conduct which is available at https://bethesda.net/en/document/code-of-conduct.  The Code of Conduct is incorporated into this End User License Agreement by this reference and forms a part of this End User License Agreement as if it were fully restated in this End User License Agreement.  All personal information collected and processed by ZeniMax in connection with this End User License Agreement will be collected and processed in accordance with the ZeniMax Privacy Policy. 
YOU SHOULD PRINT A COPY OF THIS END USER LICENSE AGREEMENT, THE TERMS OF SERVICE, THE PRIVACY POLICY AND THE CODE OF CONDUCT FOR YOUR RECORDS AND FOR FUTURE REFERENCE.
All software programs and any and all files that are delivered to you or made available to you by ZeniMax, directly or indirectly through a ZeniMax authorized reseller or distributor, (via on-line access, transmission, download or otherwise), including any “patcher”, “installer”, and any updates and modifications to such software programs, and any and all copies and derivative works of such software programs (collectively, with the Game Client (defined below), the “Game”) is the copyrighted work of ZeniMax and its affiliates.  THE GAME IS LICENSED, NOT SOLD, TO YOU.  
1.	LIMITED LICENSE; RESTRICTIONS AND OWNERSHIP
If you agree to this Agreement, you may download and install the computer software (hereafter referred to as the “Game Client”) onto your computer or console for the sole purpose of playing the Game by registering for and accessing an account with the Service (the “Account”).  Additional terms applicable to your Account are set forth in the ZeniMax Terms of Service.  Subject to your compliance with all the terms and conditions in this Agreement, ZeniMax hereby grants, and you hereby accept, a limited, non-transferable, non-exclusive license (a) to download, install, or use the Game Client on one or more computers or consoles owned by you or under your legitimate control, and (b) to use the Game Client solely as part of the Service for your non-commercial entertainment purposes only.  
The ZeniMax Terms of Service include terms and conditions applicable to Virtual Currency (as such term is defined in the ZeniMax Terms of Service), including terms that grant to you a non-exclusive, limited license for Virtual Currency.  Such terms and conditions apply to the Virtual Currency (if any) licensed to you for use with the Game.  The in-Game currency associated with this Game are “Virtual Currency” and are subject to such terms and conditions.
Subject to the Statutory Obligations (as defined in Section 1 of the Terms of Service), this Agreement does not give you any right to obtain reissues or replacements of the Game at any time and ZeniMax is not obliged to supply software updates, upgrades, or expansions for the Game, or even to operate or continue to support the Game for an indefinite period.  
As further described in the ZeniMax Terms of Service, but subject to the Statutory Obligations (as defined in Section 1 of the ZeniMax Terms of Service), ZeniMax may change, modify, suspend, or discontinue any aspect of the Game at any time and ZeniMax may also impose limits on certain features or restrict your access to parts or all of the Game without notice or liability.
In all cases, the licenses granted to you in this Agreement will terminate upon the earlier of termination of this Agreement or termination of your Account, if any, with ZeniMax.  
The ZeniMax Terms of Service include terms and conditions applicable to user generated Content, downloadable Content and other Content and you agree to comply with such terms and conditions. 
2.	SOFTWARE UPDATES AND ANTI-CHEATING AND SECURITY TOOLS.  ZeniMax may deploy or provide patches, updates, improvements, upgrades and modifications to the Game (“Updates”) that must be installed by you in the manner described by ZeniMax in its discretion before you may continue to play the Game.  All such Updates are part of the Game for purposes of this Agreement, the licenses granted to you and the License Limitations set forth in this Agreement.  The terms of this Agreement will govern any Updates provided by ZeniMax that replace and/or supplement the original Game, unless such Updates is accompanied by a separate license agreement in which case the terms of that license agreement will govern.  ZENIMAX HAS IMPLEMENTED TOOLS AND SOFTWARE (“ANTI-CHEAT TOOLS”) DESIGNED TO DETECT AND PREVENT CHEATING AND FRAUD; THESE TECHNOLOGIES MAY SCAN ANY COMPUTER OR DEVICE FROM WHICH YOU DOWNLOAD OR PLAY THE GAME TO DETECT OR IDENTIFY ANY PROGRAMS OR PROCESSES DESIGNED TO “CHEAT,” GAIN AN UNFAIR ADVANTAGE IN THE GAME OR OTHERWISE CIRCUMVENT ANY SECURITY, ANTI-CHEAT OR FRAUD DETECTION PROCESSES  OR TOOLS WE HAVE IMPLEMENTED (“CHEAT PROGRAMS”).  BY USING OR DOWNLOADING THE GAME OR ACCEPTING THIS AGREEMENT, YOU ACKNOWLEDGE AND EXPRESSLY AGREE TO THE ACCESS TO YOUR COMPUTER OR DEVICE  BY THESE ANTI-CHEAT TOOLS TO IDENTIFY OR DETECT CHEAT PROGRAMS.
3.	LIMITATIONS AND RESTRICTIONS.
The Game and/or certain features are a Service offered by ZeniMax and may only be playable online.  In such cases, a persistent Internet connection (which is not supplied by ZeniMax) is required to play the Game. The Game Client alone without a persistent Internet connection does not give you the right or ability to play the Game.  You are responsible for all costs and expenses associated with acquiring any hardware, software (e.g., Internet browsers) or other products or services required to play the Game or access these features.  
In addition to the restrictions, conditions and limitations set forth in the ZeniMax Terms of Service and the ZeniMax Code of Conduct, the license granted to you in this End User License Agreement is subject to the conditions, restrictions and limitations set forth in Section 1 and this Section 3 of this End User License Agreement (collectively, the “License Limitations”). Any use of the Game in violation of the License Limitations will be regarded as an infringement of ZeniMax’s copyrights in and to the Game and will be a breach of this Agreement.  You agree that you will not and will not assist any other person, under any circumstances, to:
A.	in whole or in part, distribute, publicly perform or display, sell, transmit, publish, edit, reproduce, sublicense, rent, lease, loan or otherwise transfer the Game or Content, including without limitation any access keys;
B.	in whole or in part, modify, adapt, translate, reverse engineer, attempt to derive source code from, modify, disassemble, decompile, or create derivative works based on the Game; provided, however, that you may make one (1) copy of the Game Client and the manuals that accompany it for archival purposes only and you may install the relevant Game Client on one or more computers owned by you or under your legitimate control as described in Section 1 above; 
C.	remove any proprietary notices or labels on the Game; or attempt in any manner to circumvent any security measures designed to control access to the Game or any part thereof;  
D.	use cheats, automation software (bots), hacks, mods or any other unauthorized third-party software designed to modify the Game or adversely impact any other persons playing of the Game or his/her experience of playing the Game; 
E.	exploit the Game or any of its parts, including without limitation the Game Client, for any commercial purpose (including without limitation renting, leasing or licensing the Game to others), including without limitation (a) for gathering Virtual Currency (as defined in the ZeniMax Terms of Service), items or resources for sale outside the Game; or (b) performing in-game services in exchange for payment outside the Game, e.g., power-leveling; 
F.	use any unauthorized third-party software that intercepts, “mines”, or otherwise collects information from or through the Game or the Service, including without limitation any software that reads areas of RAM used by the Game to store information about a character or the game environment; provided, however, that ZeniMax may, at its sole and absolute discretion, allow the use of certain third party user interfaces and other third party software; 
G.	modify or cause to be modified any files that are a part of the Game Client in any way not expressly authorized by ZeniMax; 
H.	host, provide or develop matchmaking services for the Game or intercept, emulate or redirect the communication protocols used by ZeniMax in any way, for any purpose, including without limitation unauthorized play over the internet, network play, or as part of content aggregation networks;   
I.	facilitate, create or maintain any unauthorized connection to the Game or the Service, including without limitation (a) any connection to any unauthorized server that emulates, or attempts to emulate, the Service; and (b) any connection using programs or tools not expressly approved by ZeniMax; 
J.	take any action or upload, post, transmit, promote, or distribute any illegal content; 
K.	take any action or upload, post, transmit, promote, or distribute any content that infringes or violates any third party rights; 
L.	engage in, take any action associated with, or participate in any type of child solicitation, grooming behavior, pedophilia, or predatory behavior in any form;  
M.	harass, stalk, threaten, embarrass, spam or do anything else to another user of the Game that is unwanted, such as repeatedly sending unwanted messages or making personal attacks or statements about race, sexual orientation, religion, heritage, etc.; 
N.	take any action or upload, post, transmit, distribute, or communicate your or any person’s real-world personal information; 
O.	impersonate any person or entity, including, but not limited to, ZeniMax, ZeniMax’s partners’ or affiliates’ employees, or falsely state or otherwise misrepresent your affiliation with a person or entity; 
P.	take any action, organize, transmit any content, effectuate or participate in any activity, group, or guild that is harmful, tortuous, abusive, hateful (including “hate speech”), racially, ethnically, religiously or otherwise offensive, obscene, threatening, bullying, vulgar, sexually explicit, defamatory, libelous, infringing, invasive of personal privacy or publicity rights, encourages conduct that would violate a law or is, in a reasonable person's view, objectionable and/or deemed to be in the sole discretion of ZeniMax inappropriate;  
Q.	promote, upload, transmit, encourage or take part in any activity involving hacking, cracking, phishing, taking advantage of exploits or cheats and/or distribution of counterfeit software and/or Virtual Currency or virtual items.  In an effort to continuously improve the Game, you and other users/players discovering exploits, cheats, cracks or other inconsistencies are required to report them to ZeniMax; or 
R.	take any action or upload, post, transmit, promote, or distribute any content that may contain a Trojan horse, virus, worm, spyware, time bombs, cancelbots, corrupted data or other computer programs that you do not own or have permission to freely distribute that may damage, interfere with, intercept, expropriate or disrupt the Game.
Any attempt to do any of the foregoing is a breach of this Agreement and may be a violation of intellectual property rights in the Game.  If you breach these restrictions, you may be subject to prosecution and damages.  
The Game is licensed to you as a single product. Its component parts may not be separated for use on more than one computer.  The Game is licensed, not sold.  Your license confers no title or ownership in the Game or copies thereof.  
4.	OWNERSHIP OF THE GAME.  
ZeniMax and its licensors are and will continue to be the owner of all right, title, and interest in and to the Game and the Service, including without limitation all intellectual property rights and moral rights in and to the Game and all copies thereof (including without limitation any titles, software programs and code, Game related themes, characters, character names, character likenesses, stories, dialog, catch phrases, locations, concepts, artwork, character inventories, structural, landscape and other designs in the Game, animations, sounds, musical compositions and recordings, audio-visual effects, storylines, methods of operation, and any related documentation).  You shall take no action inconsistent with such title or ownership.  The Game is protected by the copyright laws of the United States, international treaties and conventions, and other laws.  The Game may contain materials licensed by third parties, and the licensors of those materials may enforce their rights in the event of any violation of this Agreement.  You acknowledge and agree that you have no interest, monetary or otherwise, in any feature or Content contained in the Game.  This paragraph will survive the termination of this Agreement.  
5.	COLLECTION AND PROCESSING OF PERSONAL INFORMATION
ZeniMax will process your personal information in accordance with the ZeniMax Privacy Policy [https://bethesda.net/en/document/privacy-policy] and we will also use cookies, web beacons and other analytic technologies (together “cookies” herein) and similar mechanisms – including those provided by third parties – to collect, store and transmit information related to your usage of the Service in order to operate, improve and optimize the Service and our other products, to analyze usage, to personalize your experiences using the Service, and otherwise in accordance with the ZeniMax Privacy Policy.  You expressly acknowledge that you have read and understood the: 
•	ZeniMax Privacy Policy [https://bethesda.net/en/document/privacy-policy] which explains how we may collect, use, disclose and otherwise process data about you (including personal information)
•	ZeniMax Cookie Policy [https://bethesda.net/en/document/cookie-policy], which sets forth our use of cookies and your options regarding the same; 
ZeniMax reserves the right to disclose any information ZeniMax deems necessary to (i) ensure your compliance with this Agreement; (ii) satisfy any applicable law, regulation or legal process; and (iii) protect the rights, property and interests of ZeniMax, its employees, other users of the Game or the public.  
6.	MONITORING AND UPDATES.	
If you request any technical support from ZeniMax, subject to your consent ZeniMax may remotely access and review the computer onto which you have loaded the Game Client for purposes of providing technical support and debugging.  As further described in the ZeniMax Terms of Service, ZeniMax may update the Game remotely including without limitation the Game Client residing on your computer, and you hereby grant to ZeniMax your consent to deploy and apply such Updates.  
You understand and agree that (a) any and all Game related character data is stored and is resident on ZeniMax computers and servers and (b) any and all communications that you make within the Game (including, but not limited to, messages solely directed at another player or group of players) traverse through ZeniMax computers and servers and may or may not be monitored by ZeniMax or ZeniMax’s agents.  You expressly consent to such monitoring of such communications that you send and receive.  The ZeniMax Terms of Service and the ZeniMax Privacy Policy include further terms and conditions applicable to the accessing, monitoring and recording of activities and communications on and relating to the Service, including but not limited to when ZeniMax may report incidents to law enforcement and other authorities. All personal information collected and processed by ZeniMax as part of the activities set out in this clause 6 will be collected and processing accordance with the ZeniMax Privacy Policy[https://bethesda.net/en/document/privacy-policy] and the terms of the Agreement.   
7.	TERMINATION.  
This End User License Agreement starts at the time you accept this End User License Agreement and it will remain effective until terminated.  You may terminate this End User License Agreement at any time by (i) permanently destroying all copies of the Game in your possession or control and (ii) removing the Game Client from your hard drive.  Subject to the Statutory Obligations (as defined in Section 1 of the ZeniMax Terms of Service),  ZeniMax may terminate this End User License Agreement at any time for any reason or no reason (including at such time as ZeniMax elects to discontinue offering the Game).  Upon termination by ZeniMax for any reason, all licenses granted in this Agreement (including in the ZeniMax Terms of Service) with respect to the Game that is the subject of this End User License Agreement shall immediately terminate and you must immediately do (i) and (ii) above.  Termination for no reason will be communicated to you by ZeniMax.  
8.	EXPORT RESTRICTIONS.  
The Game may not be exported, re-exported, downloaded or otherwise transferred (i) to or into (collectively, an “Export”) any country which requires an Export license or which the United States Government prohibits Exports, including any such country subject to economic sanctions or (ii) to any person or entity prohibited from receiving goods or services of U.S. origin.  You represent and warrant that you are not located in, under the control of, or a national or resident of any such country or on any such list.  This Section 8 will survive the termination of this Agreement.
9.	WARRANTY.  
If you, the original purchaser, purchased the Game on a physical media (such as a disc) your use of the Game is subject to the limited warranty included with the manual or other packaging material that came with your purchase.
THE ZENIMAX TERMS OF SERVICE INCLUDE PROVISIONS REGARDING THE DISCLAIMER OF REPRESENTATIONS, WARRANTIES AND GUARANTEES (SUBJECT TO THE STATUTORY OBLIGATIONS (AS DEFINED IN SECTION 1 OF THE ZENIMAX TERMS OF SERVICE)) AND SUCH PROVISIONS ARE INCORPORATED INTO THIS END USER LICENSE AGREEMENT BY THIS REFERENCE AND FORMS A PART OF THIS END USER LICENSE AGREEMENT AS IF SUCH PROVISIONS WERE FULLY RESTATED IN THIS END USER LICENSE AGREEMENT.  THIS SECTION 9  SHALL SURVIVE THE TERMINATION OF THIS AGREEMENT.
With respect to software that is enabled for use on or over the Internet, you acknowledge that ZeniMax is not responsible for the Internet or whether it should continue to exist in its present form or whether or not a government or governmental agency, either foreign or domestic, will control, regulate or disband the Internet.  Use of the Internet is at your sole risk.
10.	LIMITATION OF LIABILITY, REIMBURSEMENT.
To the maximum extent permitted by applicable law, and subject to the Statutory Obligations (as defined in Section 1 of the Terms of Service), IN NO EVENT SHALL ZENIMAX OR ANY OF LICENSORS BE LIABLE FOR ANY (I) SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, EXEMPLARY OR OTHER INDIRECT DAMAGES, (II) THIRD PARTY CLAIMS, OR (III) LOSS OR DAMAGE TO ANY SYSTEMS, HARDWARE OR SOFTWARE, RECORDS OR DATA, EVEN IF ADVISED OF OR AWARE OF THE POSSIBILITY OF ANY SUCH DAMAGES AND EVEN IF A LIMITED REMEDY IN THIS AGREEMENT FAILS OF ITS ESSENTIAL PURPOSE.  
SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY.  ACCORDINGLY, SOME OF THE ABOVE MAY NOT APPLY TO YOU.
THE ZENIMAX TERMS OF SERVICE INCLUDE OTHER PROVISIONS REGARDING THE LIMITATION OF LIABILITY AND REMEDIES (SUBJECT TO THE STATUTORY OBLIGATIONS (AS DEFINED IN SECTION 1 OF THE ZENIMAX TERMS OF SERVICE)) AND SUCH PROVISIONS ARE INCORPORATED INTO THIS END USER LICENSE AGREEMENT BY THIS REFERENCE AND FORMS A PART OF THIS END USER LICENSE AGREEMENT AS IF SUCH PROVISIONS WERE FULLY RESTATED IN THIS END USER LICENSE AGREEMENT.  
If (i) you misuse the Game Service or breach this Agreement or (ii) any contributions, actions or omissions by you in connection with your use of the Game Service results in ZeniMax incurring any liabilities, damages, losses, costs and expenses (including without limitation attorneys’ fees and court costs), then you agree to reimburse ZeniMax and its affiliates and other participants of the Service from all such liabilities, damages, losses, costs and expenses.  If a third party sues ZeniMax for either or both of (i) or (ii) above, ZeniMax reserves the right to control the defense and settlement of such third party lawsuit, and you agree to reimburse ZeniMax for the cost of the defense, including, but not limited to, reasonable and documented attorneys’ fees. 
This Section 10 shall survive termination of this Agreement.  
11.	CHANGES TO THE AGREEMENT.  ZeniMax may replace this End User License Agreement with new versions (each a “New EULA”) over time as the Game and the law evolve.  This End User License Agreement will terminate immediately upon the introduction of a New EULA, and you will be given an opportunity to review the New EULA in accordance with the change provisions set out in the ZeniMax Terms of Service.  New EULAs will not be applied retroactively.  Your continued use of the Software and play of the Game after a modification of the EULA will be deemed as your acceptance of any modified terms.
12.	U.S. GOVERNMENT RESTRICTED RIGHTS.  The Game is a Commercial Item developed exclusively at private expense and comprised of “commercial computer software” and “commercial computer software documentation”, as these terms are defined in the applicable acquisition regulations, including without limitation the Federal Acquisition Regulation (“FAR”) at 48 C.F.R. 2.101.  The Game is licensed to U.S. Government End Users subject to the terms of this Agreement, as specified in 48 C.F.R. 12.212 (Computer Software) and 12.211 (Technical Data) ( for civilian agencies), and as specified in 48 C.F.R. 227.7202-3 and 48 C.F.R. 227.7202-4, consistent with 48 C.F.R. 227.7202 (for Department of Defense entities).  Solely with respect to the U.S. Government’s rights in the Game, this U.S. Government License Rights clause is in lieu of, and supersedes, any other FAR, DFARS, or other clause or provision of the contract under which this Game is obtained.  The Manufacturer is ZeniMax.  
13.	GOVERNING LAW.
For residents of North America, this Agreement and all Disputes (as defined in the Disputes Provision) shall be governed by the laws of the State of Maryland, USA, excluding its conflicts of laws rules and principles that would result in another State or country’s laws applying to this Agreement or any Disputes, and excluding the United Nations Convention on Contracts for the International Sale of Goods, the Uniform Computer Information Transactions Act (“UCITA”), and any laws based on UCITA.  For clarity, the terms in this paragraph shall control over any conflicting terms in the ZeniMax Terms of Service, including without limitation any terms that would result in another State’s or country’s laws applying to this Agreement or any Disputes.
If you reside outside of North America, then this Agreement and all Disputes shall be governed by the laws of England, excluding its conflicts-of-law rules and principles that would result in another State or country’s laws applying to this Agreement or any Disputes, and excluding the United Nations Convention on Contracts for the International Sale of Goods.  Local mandatory laws may be applied.
Notwithstanding the Disputes Provision, you agree that ZeniMax shall be entitled to injunctive relief, specific performance and equitable remedies with respect to breaches of Sections 1 or 3 of this Agreement, in addition to such other remedies as ZeniMax may otherwise have under applicable law.  
This Section 13 will survive the termination of this Agreement.
14.	MISCELLANEOUS.  This End User License Agreement along with the ZeniMax Terms of Service and the ZeniMax Code of Conduct constitute and contain the entire agreement between you and ZeniMax with respect to the subject matter hereof and supersedes any prior oral or written agreements. This End User License Agreement shall coexist with, and shall not supersede, the ZeniMax Terms of Service or the ZeniMax Privacy Policy.  To the extent that the provisions of this End User License Agreement conflict with the provisions of the ZeniMax Terms of Service, and unless expressly indicated otherwise in this Agreement, the conflicting provisions in this End User License Agreement shall control and shall govern.  Except as specifically provided in the Disputes Provision, if any part of this Agreement is held invalid or unenforceable, that portion shall be interpreted in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of such part, and the remaining portions of this Agreement shall remain in full force and effect.  The failure of ZeniMax to exercise or enforce any right or provision of this Agreement will not constitute waiver of such right or provision.  Any waiver of any provision of this Agreement will be effective only if in a writing signed by ZeniMax.  You agree that this Agreement and ZeniMax’s enforcement of this Agreement, are not intended to confer and do not confer any rights or remedies upon any person other than you and ZeniMax.  This Section 14 shall survive the termination of this Agreement for any reason.  
I hereby acknowledge that I have read and understand all the terms and conditions in this Agreement.  BY CLICKING AGREE, I acknowledge and agree to be bound by all the terms and conditions of this Agreement, which includes my express consent to ZeniMax’s use of Anti-Cheat Tools as described herein.

게임 또는 관련 소프트웨어(“게임”으로 총칭)를 다운로드, 설치, 사용 또는 플레이하기 전에 다음의 최종 사용자 사용권 계약 전체 내용을 자세히 읽어보시기 바랍니다.  본 계약에는 귀하의 법적 권리에 영향을 주는 중요한 약관이 포함되어 있습니다.  귀하는 게임을 다운로드, 설치, 사용 또는 플레이함으로써 본 계약의 모든 약관에 구속되는 데 동의하게 됩니다.  본 계약의 모든 약관에 동의하지 않는 경우 게임을 다운로드, 설치, 사용 또는 플레이하지 마십시오(이러한 행동은 허용되지 않습니다).  
게임 플레이 및/또는 특정 기능 이용을 위해서는 유효하고 활성화된 ZENIMAX 계정(“계정”)을 소유하고 유지해야 합니다
귀하는 게임을 다운로드, 설치, 사용 또는 플레이함으로써 본 최종 사용자 사용권 계약, ZENIMAX 서비스 약관, ZENIMAX 개인정보 처리방침을 읽었음을 확인하고 본 계약과 서비스 약관(본 “계약”으로 총칭)에 동의하게 됩니다.  나아가 귀하는 ZENIMAX가 ZENIMAX의 개인정보 처리방침(https://bethesda.net/ko/document/privacy-policy에서 확인 가능)에 따라 개인정보를 처리한다는 점을 확인하고 이해합니다. 본 계약의 약관에 동의하지 않거나 ZENIMAX 개인정보 처리방침을 읽어보고 이해하지 않은 경우 게임을 다운로드, 설치 또는 사용하지 마십시오.
간편한 참조를 위해 귀하가 ZeniMax 계정을 생성할 때 동의한 ZeniMax “서비스 약관” 또는 “ZeniMax 서비스 약관”은 https://bethesda.net/ko/document/terms-of-service에서 확인할 수 있습니다.  
본 계약은 귀하와 ZeniMax Media Inc.(“ZeniMax”) 사이에 체결됩니다. 
서비스 약관 섹션 1에 명시된 바와 같이 귀하가 유럽 경제 지역(EEA), 영국, 스위스, 호주, 뉴질랜드, 터키, 일본 또는 브라질 거주자인 경우 ZENIMAX는 상품, 서비스 및 디지털 콘텐츠의 공급과 관련하여 법이 요구하는 특정 보장, 보증, 약관 및 조건(환불, 반품 및 불공정 약관과 관련된 내용 포함)이 있다는 점을 인정합니다. 이때 해당 법이 명시적으로 규정하는 상품, 서비스 및 디지털 콘텐츠는 제외, 제한 또는 변경될 수 없거나 특정 범위로 제한될 수만 있습니다(“법정 의무”).  해당 법률을 따르는 경우를 제외하고, 본 EULA의 어떠한 내용도 법정 의무를 배제, 제한 또는 변경하지 않습니다.

극소수의 사람들은 빛의 패턴이나 깜박이는 불빛을 포함하되 이에 국한되지 않는 특정 시각적 이미지에 노출되었을 때 간질 발작이나 기절을 겪게 될 수 있습니다.  게임 플레이 중 기절, 발작, 어지러움, 시력 저하, 눈 또는 근육 경련, 팔 또는 다리의 흔들림이나 떨림, 의식 상실, 방향 감각 상실, 정신 착란, 비자발적 움직임 또는 경기와 같은 증상이 나타나는 경우, 즉시 사용을 중단하고 의사와 상담한 후에 플레이를 재개하십시오.
ZeniMax 서비스 약관에는 집단 소송 면제 조항을 포함한 분쟁 해결 및 중재 조항(“분쟁 조항”)이 있습니다. 해당 조항은 귀하가 집단 소송이나 기타 집합적 분쟁을 허용하는 EEA/영국/스위스/호주/뉴질랜드/터키/일본 또는 브라질 이외의 관할권에 거주하는 경우 귀하가 ZeniMax를 상대로 갖는 분쟁과 관련하여 ZeniMax 서비스 약관과 본 최종 사용자 사용권 계약에 따른 귀하의 권리에 영향을 미칩니다.  해당 분쟁 조항은 이 언급으로 본 최종 사용자 사용권 계약에 포함되며 해당 조항이 본 최종 사용자 사용권 계약에서 완전히 명시된 것처럼 본 최종 사용자 사용권 계약의 일부를 형성합니다.  귀하는 ZeniMax 서비스 약관에 규정된 바와 같이 법적 구속력이 있는 개인 중재 및 집단 소송 면제 조항을 선택하지 않을 수 있습니다.  
게임의 모든 사용은 본 최종 사용자 사용권 계약 약관과 ZeniMax 서비스 약관의 지배를 받습니다.  게임을 플레이하려면 (a) ZeniMax로부터 게임 액세스 권한을 받고 (b) 게임 클라이언트(아래에 규정된 바와 같음)를 다운로드해야 합니다.  ZeniMax 서비스 약관은 이로써 본 최종 사용자 사용권 계약에 포함되며 이 언급으로 해당 조항이 본 최종 사용자 사용권 계약에서 완전히 명시된 것처럼 본 최종 사용자 사용권 계약의 일부를 형성합니다.  최종 사용자 사용권 계약은 “EULA”라고 하며 ZeniMax 서비스 약관에 의해 고려되는 “보충 약관”에 해당합니다.  게임은 ZeniMax 서비스 약관을 포함한 본 계약 약관에 따라 승인된 최종 사용자의 사용을 위해서만 이용 가능하도록 제작되고 배포됩니다.  본 계약 약관에 의해 명시적으로 승인되지 않은 게임의 사용, 복제, 변경 또는 배포는 명백히 금지됩니다.  귀하는 게임, 게임 클라이언트, 기타 게임 관련 소프트웨어, 게임에 특정된 콘텐츠(서비스 약관에 규정된 바와 같음), 귀하의 게임 접근과 사용은 모두 ZeniMax 서비스 약관을 포함한 본 계약 목적에 따른 “서비스”라는 점에 동의합니다.  본 계약에서 귀하에게 부여되지 않은 모든 권한은 ZeniMax가 보유합니다. 
귀하는 이전에 ZeniMax가 ZeniMax 개인정보 처리방침(https://bethesda.net/ko/document/privacy-policy에서 확인 가능)에 따라 귀하의 개인정보를 처리할 수 있다는 것을 확인했고 ZeniMax 행동 강령(https://bethesda.net/ko/document/code-of-conduct에서 확인 가능)에 동의했습니다.  행동 강령은 이 언급으로 본 최종 사용자 사용권 계약에 포함되며 해당 강령이 본 최종 사용자 사용권 계약에서 완전히 명시된 것처럼 본 최종 사용자 사용권 계약의 일부를 형성합니다.  본 최종 사용자 사용권 계약과 관련하여 ZeniMax가 수집 및 처리하는 모든 개인정보는 ZeniMax 개인정보 처리방침에 따라 수집 및 처리됩니다. 
기록 목적과 향후 참고를 위해 귀하는 본 최종 사용자 사용권 계약, 서비스 약관, 개인정보 처리방침 및 행동 강령의 사본을 인쇄해두어야 합니다.
ZeniMax에 의해 직접 또는 ZeniMax 공인 재판매인이나 유통업자를 통해 간접적으로(온라인 액세스, 전송, 다운로드 또는 기타 방식) 귀하에게 제공되거나 귀하가 사용하도록 허가된 “패치”와 “설치”를 포함한 모든 소프트웨어 프로그램과 모든 파일, 해당 소프트웨어 프로그램의 업데이트와 수정 사항 그리고 해당 소프트웨어 프로그램의 모든 사본과 파생 작업물(게임 클라이언트(아래에서 규정)를 포함해 “게임”으로 총칭)은 ZeniMax와 그 계열사의 저작물입니다.  게임은 귀하에게 사용권이 부여되는 것이며 판매되는 것이 아닙니다.  
1.	한정된 사용권, 제한 사항 및 소유권.
귀하가 이 계약에 동의하는 경우, 귀하는 서비스 계정(이하 "계정") 등록과 액세스를 통해 오직 게임을 플레이하기 위한 목적으로만 컴퓨터 소프트웨어(이하 "게임 클라이언트"로 지칭)를 귀하의 컴퓨터나 콘솔에 다운로드 및 설치할 수 있습니다.  귀하의 계정에 적용되는 다른 약관은 ZeniMax 서비스 약관에 명시되어 있습니다.  귀하가 본 계약의 모든 약관과 조건을 준수하는 경우 ZeniMax는 귀하에게 (a) 귀하가 소유하거나 합법적 제어 권한을 가지고 있는 한 대 이상의 컴퓨터나 콘솔에서 게임 클라이언트를 다운로드, 설치 또는 사용하고, (b) 오직 귀하의 비상업적인 오락 목적만을 위한 서비스의 일환으로 게임 클라이언트를 사용할 수 있는 제한적이고 양도 불가능하며 비독점적인 사용권을 부여하며 귀하는 이에 동의합니다.  
ZeniMax 서비스 약관에는 귀하에게 가상 화폐(ZeniMax 서비스 약관에 규정된 용어를 따름)에 대한 비독점적이고 제한적인 사용권을 부여하는 약관을 포함하여 가상 화폐에 적용되는 약관과 조건이 포함됩니다.  해당 약관과 조건은 게임 사용을 위해 귀하에게 사용권이 부여된 가상 화폐(해당하는 경우)에 적용됩니다.  본 게임과 연계된 게임 내 재화는 "가상 화폐"이며 해당 약관과 조건의 적용 대상입니다.
법정 의무(서비스 약관 섹션 1에 규정된 바와 같음)에 따라 본 계약은 귀하에게 언제라도 게임의 재발행 또는 대체 사항을 획득할 권한을 부여하지 않으며 ZeniMax에게는 무기한으로 게임을 위한 소프트웨어 업데이트, 업그레이드 또는 확장을 제공하거나 게임을 운영하거나 지원을 계속할 의무가 없습니다.  
ZeniMax 서비스 약관에 추가로 설명된 바와 같이, 그러나 법정 의무(ZeniMax 서비스 약관 섹션 1에 규정된 바와 같음)를 따라 ZeniMax는 언제라도 Game의 특정 부분을 변경, 수정, 보류 또는 중단할 수 있고 ZeniMax는 통지 또는 책임 없이 특정 기능을 제한하거나 게임의 일부 혹은 전부에 대한 귀하의 접근을 제한할 수 있습니다.
모든 경우, 본 계약에서 귀하에게 부여된 사용권은 본 계약의 해지일 또는 귀하의 ZeniMax 계정 해지일(계정이 있는 경우) 중 더 빠른 시기에 종료됩니다.  
ZeniMax 서비스 약관에는 사용자 생성 콘텐츠, 다운로드 가능한 콘텐츠 및 기타 콘텐츠에 적용되는 약관과 적용이 포함되며 귀하는 그러한 약관과 조건을 준수하는 데 동의합니다. 
2.	소프트웨어 업데이트와 부정행위 방지 및 보안 도구.  ZeniMax는 귀하가 게임을 계속 플레이하기 전에 ZeniMax가 재량에 따라 안내한 방식으로 귀하에 의해 설치되어야 하는 게임에 대한 패치, 업데이트, 개선 사항, 업그레이드, 수정 사항(“업데이트”)을 배포 또는 제공할 수 있습니다.  그러한 업데이트는 모두 본 계약, 귀하에게 부여된 사용권 그리고 본 계약에 명시된 사용권 제한 사항의 목적을 위해 게임에 일부로 포함됩니다.  본 계약의 약관은 원래의 게임을 대체 및/또는 보충하기 위해 ZeniMax에서 제공하는 모든 업데이트에 적용됩니다. 단, 그러한 업데이트에 별도의 사용권 계약이 수반되는 경우 해당 사용권 계약의 약관이 적용됩니다.  ZENIMAX는 부정행위와 사기를 감지하고 방지하기 위해 고안된 도구와 소프트웨어(“부정행위 방지 도구”)를 도입했습니다. 이러한 기술은 “부정행위”를 하거나, 게임에서 불공정한 이득을 취하거나, ZENIMAX가 도입한 보안, 부정행위 방지 또는 사기 감지 절차 혹은 도구를 피하고자 설계된 프로그램이나 절차(“부정행위 프로그램”)를 감지하고 파악하기 위해 귀하가 게임을 다운로드하거나 플레이하는 컴퓨터 또는 기기를 스캔할 수 있습니다.  귀하는 게임을 사용 또는 다운로드하거나 본 계약에 동의함으로써 이러한 부정행위 방지 도구를 사용해 귀하의 컴퓨터 또는 기기에 접근하여 부정행위 프로그램을 파악하거나 감지하는 것을 인정하며 명백하게 동의합니다.
3.	제한과 제약.
게임 및/또는 특정 기능은 ZeniMax에서 제공하는 서비스이며 온라인에서만 플레이할 수 있습니다.  그러한 경우, 게임을 플레이하려면 지속적인 인터넷 연결(ZeniMax에서 제공하지 않음)이 필요합니다. 지속적인 인터넷 연결이 없는 게임 클라이언트는 게임을 플레이할 권리 또는 능력을 주지 않습니다.  귀하는 게임을 플레이하거나 이러한 기능을 이용하는 데 필요한 하드웨어, 소프트웨어(예: 인터넷 브라우저) 또는 기타 제품이나 서비스를 획득하는 것과 관련된 모든 비용과 경비를 부담해야 합니다.  
ZeniMax 서비스 약관과 ZeniMax 행동 강령에 명시된 제약, 조건 및 제한 사항 이외에도 본 최종 사용자 사용권 계약에서 귀하에게 부여된 사용권에는 본 최종 사용자 사용권 계약의 섹션 1과 본 섹션 3에 명시된 조건, 제약 및 제한 사항(“사용권 제한 사항”으로 총칭)도 적용됩니다. 사용권 제한 사항을 위반하는 모든 게임 사용은 ZeniMax의 저작권과 게임을 침해한 것으로 간주하며 본 계약을 위반하게 됩니다.  귀하는 어떠한 상황에서도 다음의 행위를 하지 않고 타인이 다음의 행위를 하도록 돕지 않겠다고 동의합니다.
A.	액세스 키를 포함하되 이에 국한되지 않고 게임이나 콘텐츠를 전부 또는 일부를 배포, 공개 실행 또는 전시, 판매, 전송, 게재, 편집, 복제, 2차 사용권 부여, 임차, 임대, 대여 또는 달리 이동시키는 행위.
B.	전부 또는 일부를 변경, 각색, 번역, 역설계, 소스 코드 유추 시도, 수정, 역어셈블, 역컴파일하거나 게임에 기반하여 파생 작업물을 생성하는 행위. 단, 귀하는 상기 섹션 1의 설명된 바와 같이 귀하가 소유하고 있거나 귀하가 합법적 제어 권한을 가진 한 대 이상의 컴퓨터에서 기록 보관 목적으로만 게임 클라이언트 및 그와 수반되는 매뉴얼의 사본을 한(1) 개 소유할 수 있습니다. 
C.	게임의 등록 상표 공지 또는 라벨을 제거하거나 게임 혹은 그 일부에 대한 접근을 제어하도록 고안된 보안 조치를 피하는 방식을 시도하는 행위.  
D.	부정행위, 자동화 소프트웨어(봇), 해킹, 모드 또는 게임을 변경하도록 고안된 기타 승인되지 않은 제삼자 소프트웨어를 사용하거나 게임을 플레이하는 타인 또는 게임을 플레이하는 타인의 경험에 부정적인 영향을 미치는 행위. 
E.	(a) 게임 외부에서 판매하기 위해 가상 화폐(ZeniMax 서비스 약관에 규정된 바에 따름), 아이템 또는 자원을 수집하거나 (b) 게임 외부에서의 지급을 대가로 게임 내 서비스를 수행하는 경우(예: 빠른 레벨 업)를 포함하되 이에 국한되지 않는 상업적 목적(게임을 임차, 임대하거나 다른 사람에게 사용권 부여하는 경우를 포함하되 이에 국한되지 않음)을 위해 게임 클라이언트를 포함하되 이에 국한되지 않는 게임이나 그 일부를 부당하게 이용하는 행위. 
F.	캐릭터나 게임 환경에 관한 정보를 저장하기 위해 게임에서 사용하는 RAM 영역을 읽는 소프트웨어를 포함하되 이에 국한되지 않고 게임 또는 서비스에서 혹은 게임 또는 서비스를 통해 정보를 가로채고, “채굴” 또는 달리 수집하는 승인되지 않은 타사 소프트웨어를 사용하는 행위. 단, ZeniMax는 유일하고 절대적인 재량으로 특정 제삼자 사용자 인터페이스와 기타 제삼자 소프트웨어의 사용을 허용할 수 있습니다. 
G.	ZeniMax가 명시적으로 승인하지 않은 방식으로 게임 클라이언트에 포함된 파일을 변경하거나 변경을 야기하는 행위. 
H.	승인되지 않은 인터넷상에서의 플레이, 네트워크 플레이 또는 콘텐츠 통합 네트워트에 포함되는 경우를 포함하되 이에 국한되지 않는 목적으로 게임에 경쟁 상대가 되는 서비스를 호스팅, 제공 또는 개발하거나 어떤 방식으로든 ZeniMax가 사용하는 커뮤니케이션 프로토콜을 방해, 모방하거나 방향을 조정하는 행위.   
I.	(a) 서비스를 모방하거나 모방을 시도하는 승인되지 않은 서버와의 연결, (b) ZeniMax가 명시적으로 승인하지 않은 프로그램이나 도구를 사용하는 연결을 포함하되 이에 국한되지 않고 게임 또는 서비스에 대해 승인되지 않은 연결을 이용하거나, 발생시키거나 유지하는 행위. 
J.	불법 콘텐츠와 관련된 행동을 취하거나 불법 콘텐츠를 업로드, 게시, 전송, 홍보 또는 배포하는 행위. 
K.	제삼자의 권리를 침해하거나 위반하는 콘텐츠와 관련된 행동을 취하거나 해당 콘텐츠를 업로드, 게시, 전송, 홍보 또는 배포하는 행위. 
L.	모든 유형의 아동 유괴, 그루밍 범죄, 소아성애 또는 모든 형태의 약탈 행위에 관여하거나, 관련된 행동을 취하거나, 참여하는 행위.  
M.	게임의 다른 사용자에게 반복적으로 원하지 않는 메시지를 보내거나 인신공격을 하거나 인종, 성적 지향, 종교, 유산 등에 관한 발언을 하는 등 괴롭힘, 스토킹, 협박, 수모, 스팸 등을 가하는 행위. 
N.	본인 또는 타인의 실제 개인정보와 관련된 행동을 취하거나 해당 정보를 업로드, 게시, 전송, 배포 또는 전달하는 행위. 
O.	ZeniMax, ZeniMax의 파트너 또는 계열사의 직원을 포함하되 이에 국한되지 않고 어떤 개인이나 단체를 사칭하거나 개인 또는 단체와의 소속 상태를 허위로 진술하거나 표명하는 행위. 
P.	유해하거나, 악의적, 모욕적, 혐오적이거나(“혐오 발언” 포함), 인종, 윤리, 종교적으로 혹은 달리 불쾌하거나, 외설적이거나, 협박성이 있거나, 타인을 따돌리거나, 저속적, 성적으로 노골적이거나, 비방적, 명예 훼손적이거나, 법적 권리를 침해하거나, 개인정보 또는 퍼블리시티권을 침해하는 활동, 그룹 또는 길드에서 관련 행동을 하거나, 조직하거나, 콘텐츠를 전송하거나, 관련 목적을 이루거나, 참여하거나, 법률을 위반하거나 합리적인 개인의 관점에서 볼 때 불쾌하거나 ZeniMax에서 단독 재량으로 부적절하다고 간주할 수 있는 행동을 장려하는 행위.  
Q.	위조 소프트웨어 및/또는 가상 화폐 혹은 가상 아이템의 해킹, 크래킹, 피싱, 부당한 사용 또는 속임수를 통한 이익 취득 및/또는 배포와 관련된 활동을 홍보, 업로드, 전송, 장려하거나 이러한 활동에 참여하는 행위.  게임을 지속해서 개선하기 위한 노력에 따라, 부당한 이용, 부정행위, 크래킹 또는 기타 위반 사항을 발견한 귀하와 다른 사용자/플레이어는 해당 사항을 ZeniMax에 보고해야 합니다. 
R.	트로이목마, 바이러스, 웜, 스파이웨어, 시한폭탄, 캔슬보트, 손상된 데이터 또는 귀하가 소유하거나 자유롭게 배포할 권한을 갖고 있지 않은 다른 컴퓨터 프로그램을 포함할 수 있고 게임을 손상하거나, 방해하거나, 게임에 지장을 주거나, 게임을 도용 또는 파괴하는 콘텐츠와 관련된 행동을 취하거나 해당 콘텐츠를 업로드, 게시, 전송, 홍보 또는 배포하는 행위.
앞서 언급된 행동을 하려는 모든 시도는 본 계약을 위반하는 것이며 게임의 지식재산권을 침해할 수 있습니다.  이러한 제한 사항을 위반하는 경우 기소 및 피해를 받게 될 수 있습니다.  
게임은 단일 제품으로서 귀하에게 사용권이 부여됩니다. 한 대 이상의 컴퓨터에서 사용하기 위해 그 구성 부품을 분리해서는 안 됩니다.  게임은 사용권이 부여되는 것이며, 판매되는 것이 아닙니다.  귀하의 사용권은 게임이나 그 복제물에 대한 권리 또는 소유권을 부여하지 않습니다.  
4.	게임의 소유권.  
ZeniMax와 그 사용권 제공자는 게임과 그 모든 복제물(모든 타이틀, 소프트웨어 프로그램 및 코드, 게임 관련 테마, 캐릭터, 캐릭터 이름, 캐릭터 유사성, 스토리, 대화, 유명 문구, 위치, 콘셉트, 아트워크, 캐릭터 인벤토리, 게임의 구조, 풍경 및 기타 디자인, 애니메이션, 사운드, 음악 구성 및 녹음, 오디오 시각 효과, 스토리 전개, 운영 방식 및 기타 관련 문서를 포함하되 이에 국한되지 않음)에 포함되어 있고 게임과 그 모든 복제물에 대한 모든 지식재산권과 저작인격권을 포함하되 이에 국한되지 않고 게임 및 서비스에 포함되어 있고 게임 및 서비스에 대한 모든 권한, 권리 및 이익의 소유주이며 계속해서 그럴 것입니다.  귀하는 그러한 권리 또는 소유권에 모순되는 행동을 취해서는 안 됩니다.  게임은 미국 저작권법, 국제 협약 및 조약, 기타 법률의 보호를 받습니다.  게임에는 제삼자가 사용권을 부여하는 자료를 포함할 수 있으며 본 계약에 대한 위반 발생 시 해당 자료의 사용권 제공자는 보유한 권리를 행사할 수 있습니다.  귀하는 귀하에게 게임에 포함된 기능이나 콘텐츠에서 금전적 혹은 기타 이익을 취하지 않는다는 점을 확인하고 이에 동의합니다.  이 문단은 본 계약의 해지 시에도 존속합니다.  
5.	개인정보의 수집과 처리
ZeniMax는 ZeniMax 개인정보 처리방침[https://bethesda.net/ko/document/privacy-policy]에 따라 귀하의 개인정보를 처리하며, 또한 본 서비스와 당사의 기타 제품을 운영, 개선 및 최적화하고, 사용 방식을 분석하고, 귀하의 서비스 경험을 개인화하고, ZeniMax 개인정보 처리방침을 준수하기 위해 쿠키, 웹 비콘 및 기타 분석 기술(본 문서에서는 “쿠키”로 총칭)과 유사 메커니즘(제삼자가 제공하는 메커니즘 포함)을 사용하여 귀하의 서비스 사용 관련 정보를 수집, 저장 및 전송합니다.  귀하는 아래의 문서를 읽고 이해했음을 명시적으로 확인합니다.

ZeniMax는 ZeniMax가 (i) 귀하의 본 계약 준수를 확인하고 (ii) 관련 법률, 규정 및 법적 절차를 충족하고 (iii) ZeniMax와 그 직원, 게임의 다른 사용자 또는 대중의 권리, 재산 및 이익을 보호하기 위해 필요하다고 간주하는 정보를 공개할 권리를 가집니다.  
6.	모니터링 및 업데이트.	
귀하가 ZeniMax의 기술 지원을 요청하면 ZeniMax는 귀하가 동의하는 경우 기술 지원 제공과 디버깅을 위한 목적으로 귀하가 게임 클라이언트를 로드한 컴퓨터에 원격으로 액세스하여 검토할 수 있습니다.  ZeniMax 서비스 약관에 추가로 설명된 바와 같이, ZeniMax는 귀하의 컴퓨터에 있는 게임 클라이언트를 포함하되 이에 국한되지 않는 게임을 원격으로 업데이트할 수 있으며 귀하는 이로써 ZeniMax가 그러한 업데이트를 배포 및 적용할 수 있도록 승인합니다.  
귀하는 (a) 모든 게임 관련 캐릭터 데이터는 ZeniMax 컴퓨터와 서버에 저장되고 보존되며 (b) 귀하가 게임에서 하는 모든 커뮤니케이션(다른 플레이어 또는 플레이어 그룹에 단독으로 전송된 메시지를 포함하되 이에 국한되지 않음)은 ZeniMax 컴퓨터와 서버를 거치고 ZeniMax 또는 ZeniMax의 대행사에 의해 모니터링되거나 모니터링되지 않을 수 있다는 점을 이해하고 이에 동의합니다.  귀하는 귀하가 보내고 받는 해당 커뮤니케이션에 대한 그러한 모니터링에 명백히 동의합니다.  ZeniMax 서비스 약관과 ZeniMax 개인정보 처리방침에는 ZeniMax가 법률 집행 기관과 기타 관계 당국에 사건을 보고할 수 있는 시기를 포함하되 이에 국한되지 않고 서비스상의/서비스와 관련된 활동과 커뮤니케이션에 대한 액세스, 모니터링 및 기록에 적용될 수 있는 추가적인 약관과 조건이 포함되어 있습니다. 이 조항 6에 명시된 활동의 일환으로 ZeniMax가 수집 및 처리하는 모든 개인정보는 ZeniMax 개인정보 처리 방침[https://bethesda.net/ko/document/privacy-policy]과 본 계약의 약관에 따라 수집되고 처리됩니다.   
7.	계약 해지.  
본 최종 사용자 사용권 계약은 본 최종 사용자 사용권 계약에 동의한 시점에 발효되며 계약 해지 시까지 유효합니다.  귀하는 (i) 귀하가 소유 또는 관리하는 게임의 모든 복제물을 영구적으로 파기하고 (ii) 하드 드라이브에서 게임 클라이언트를 제거함으로써 언제든지 본 최종 사용자 사용권 계약을 해지할 수 있습니다.  법정 의무(ZeniMax 서비스 약관 섹션 1에 규정된 바와 같음)에 따라 ZeniMax는 언제든지 어떤 이유에서든 혹은 이유의 유무와 관계없이 본 최종 사용자 사용권 계약을 해지할 수 있습니다(ZeniMax가 게임 서비스를 중단하기로 선택하는 경우 포함).  어떤 이유에서든 ZeniMax가 계약을 해지하면 본 최종 사용자 사용권 계약이 적용되는 게임과 관련하여 본 계약(ZeniMax 서비스 약관 포함)에 의해 부여된 모든 사용권은 즉시 종료되며 귀하는 즉시 상기된 (i) 및 (ii) 절차를 수행해야 합니다.  ZeniMax는 이유가 없는 계약 해지 통지를 귀하에게 전달합니다.  
8.	수출 금지.  
게임은 (i) 수출 라이선스를 요구하거나 경제 제재가 적용되는 국가를 포함하여 미국 정부가 수출을 금지한 국가, 또는 (ii) 출처가 미국인 상품 또는 서비스를 받지 못하도록 금지된 개인이나 단체로 수출, 재수출, 다운로드 또는 달리 이동(“수출”로 총칭)되어서는 안 됩니다.  귀하는 귀하가 그러한 국가에 있거나, 그러한 국가의 통제를 받거나, 그러한 국가의 국적인 또는 거주민이거나 그러한 명단에 포함되어 있지 않다는 사실을 주장하고 보증합니다.  이 섹션 8은 본 계약의 해지 시에도 존속합니다.
9.	보증.  
원구매자인 귀하가 물리적 매체(예: 디스크)에 있는 게임을 구매한 경우, 귀하의 게임 사용은 구매 시 함께 제공된 매뉴얼 또는 기타 포장 자재에 포함된 제한 보증의 적용 대상이 됩니다.
ZENIMAX 서비스 약관은 주장, 보증 및 보장의 면책과 관련된 조항을 포함하고 있으며(법정 의무(ZENIMAX 서비스 약관 섹션 1에 규정된 바와 같음) 적용) 해당 조항은 이 언급으로 본 최종 사용자 사용권 계약에 포함되고 해당 조항이 본 최종 사용자 사용권 계약에서 완전히 명시된 것처럼 본 최종 사용자 사용권 계약의 일부를 형성합니다.  이 섹션 9는 본 계약의 해지 시에도 존속합니다.
인터넷상에서 또는 인터넷으로 사용할 수 있는 소프트웨어와 관련하여, 귀하는 ZeniMax가 인터넷에 대해 또는 인터넷이 기존의 형태로 계속 존재하는지의 여부, 해외 혹은 국내 정부나 정부 기관이 인터넷을 통제, 규제 또는 중단하는지의 여부를 책임지지 않는다는 점을 인정합니다.  인터넷 사용에 따르는 위험은 오직 귀하가 부담합니다.
10.	책임 제한, 배상.
관련 법률이 허용하는 최대의 범위까지 그리고 법정 의무(서비스 약관 섹션 1에 규정된 바와 같음)에 따라, ZENIMAX나 사용권 제공자는 어떠한 경우에도 (i) 특수적, 부차적, 부수적, 처벌적, 징벌적 또는 기타 간접적 피해, (ii) 제삼자의 손해배상 청구 또는 (iii) 시스템, 하드웨어 또는 소프트웨어, 기록 또는 데이터의 손실이나 손상에 대하여 그러한 피해의 가능성을 권고받았거나 인지했더라도, 그리고 본 계약의 한정적 구제 조치가 기본 목적을 이행하지 못하더라도 그에 대한 책임을 지지 않습니다.  
일부 관할권에서는 책임의 제한 또는 면제를 허용하지 않습니다.  따라서 상기된 내용의 일부는 귀하에게 적용되지 않을 수 있습니다.
ZENIMAX 서비스 약관에는 책임의 제한과 구제 조치(법정 의무(ZENIMAX 서비스 약관 섹션 1에 규정된 바와 같음) 적용)에 관한 다른 조항이 포함되어 있으며 해당 조항은 이 언급으로 본 최종 사용자 사용권 계약에 포함되고 해당 조항이 본 최종 사용자 사용권 계약에서 완전히 명시된 것처럼 본 최종 사용자 사용권 계약의 일부를 형성합니다.  
(i) 귀하가 게임 서비스를 남용하거나 본 계약을 위반하는 경우 또는 (ii) 귀하의 게임 서비스 이용과 관련하여 귀하에 의한 기여, 작위 또는 부작위가 ZeniMax에 책임, 피해, 손실, 비용 및 지출(변호사 수수료 및 법정 비용을 포함하되 이에 국한되지 않음)을 발생시키는 경우, 귀하는 ZeniMax와 그 게열사 및 기타 서비스 참여자에게 그러한 모든 책임, 피해, 손실, 비용 및 지출을 배상하는 데 동의합니다.  제삼자가 상기된 (i) 및/또는 (ii)의 내용을 근거로 ZeniMax에 소송을 제기하는 경우 ZeniMax는 해당 제삼자 소송에 대한 변호와 합의를 통제할 권리를 가지며 귀하는 합리적으로 기록된 변호사 수수료를 포함하되 이에 국한되지 않는 변호 비용을 ZeniMax에 배상하는 데 동의합니다. 
이 섹션 10은 계약의 해지 시에도 존속합니다.  
11.	본 계약의 변경.  ZeniMax는 시간이 지나면서 게임과 법이 변경됨에 따라 본 최종 사용자 사용권 계약을 새 버전(각각 “신규 EULA”)으로 대체할 수 있습니다.  본 최종 사용자 사용권 계약은 신규 EULA의 시행과 함께 즉시 해지되며 귀하는 ZeniMax 서비스 약관에 명시된 변경 조항에 따라 신규 EULA를 검토할 기회를 얻게 됩니다.  신규 EULA는 소급 적용되지 않습니다.  EULA 변경 후에도 계속 소프트웨어를 사용하고 게임을 플레이하면 변경된 약관에 동의한 것으로 간주합니다.
12.	미국 정부의 제한적 권리.  게임은 민간 자금으로 단독 개발되고 “상업용 컴퓨터 소프트웨어”와 “상업용 컴퓨터 소프트웨어 문서”로 구성된 상업용 항목이며 이러한 용어는 연방 조달 규정(“FAR”) 48 C.F.R. 2. 101을 포함하되 이에 국한되지 않으며 해당하는 조달 규정에 정의되어 있습니다.  게임은 48 C.F.R. 12.212(컴퓨터 소프트웨어) 및 12.211(기술 데이터)(민간 기관 대상)에 명시되어 있고, 48 C.F.R. 227.7202-3과 48 C.F.R. 227.7202-4에 명시되어 있고, 48 C.F.R. 227.7202 (국방부 조직 대상)에 부합하는 본 계약 조건의 대상인 미국 정부 최종 사용자에게 사용권이 부여됩니다.  오직 게임 내 미국 정부의 권리와 관련하여 이 미국 정부 사용권 권리 구절은 이 게임을 취득한 다른 FAR, DFARS, 또는 기타 계약 구절 또는 조항을 대신하고 대체합니다.  제조사는 ZeniMax입니다.  
13.	준거법.
북미 거주자에 대해 본 계약과 모든 분쟁(분쟁 조항에서 규정된 바와 같음)은 미국 메릴랜드주법의 지배를 받되, 본 계약이나 모든 분쟁에 적용되는 다른 주 혹은 국가의 법률로 이어지는 법률 규정과 원칙의 충돌을 제외하고, 국제물품매매계약에 관한 국제연합협약, 통일 컴퓨터 정보 거래법(“UCITA”), 그리고 UCITA에 기반한 법률을 제외합니다.  명확성을 위해 이 문단의 약관은 본 계약이나 모든 분쟁에 적용되는 다른 주 혹은 국가의 법률로 이어지는 약관을 포함하되 이에 국한되지 않고 ZeniMax 서비스 약관의 충돌 약관을 지배합니다.
귀하가 북미 이외의 지역에 거주하는 경우, 본 계약과 모든 분쟁은 영국법의 지배를 받되, 본 계약이나 모든 분쟁에 적용되는 다른 주 혹은 국가의 법률로 이어지는 국제사법 규정과 원칙을 제외하고, 국제물품매매계약에 관한 국제연합협약을 제외합니다.  현지의 강행 규정이 적용될 수 있습니다.
분쟁 조항에도 불구하고, 귀하는 ZeniMax가 본 계약의 섹션 1 또는 3의 위반과 관련하여 ZeniMax가 해당하는 법에 따라 달리 가질 수 있는 다른 구제 조치 이외에도 금지 명령 구제, 특정 수행 및 형평 구제 조치를 시행할 권리를 가진다는 점에 동의합니다.  
이 섹션 13은 계약의 해지 시에도 존속합니다.
14.	기타.  본 최종 사용자 사용권 계약은 ZeniMax 서비스 약관 및 ZeniMax 행동 강령과 함께 이 문서의 주제와 관련하여 귀하와 ZeniMax 간의 완전한 계약을 구성하고 포함하며 이전의 구두 또는 서면 계약을 대체합니다. 본 최종 사용자 사용권 계약은 ZeniMax 서비스 약관 또는 ZeniMax 개인정보 처리방침과 공존하며 이를 대체하지 않습니다.  본 최종 사용자 사용권 계약의 조항이 ZeniMax 서비스 약관의 조항과 충돌하는 범위 안에서, 그리고 본 계약에 달리 명시되어 있지 않은 한, 본 최종 사용자 사용권 계약의 충돌 조항이 통제하고 지배합니다.  분쟁 조항에서 구체적으로 규정된 부분을 제외하고, 본 계약의 일부가 무효 또는 시행 불가능한 경우 해당 부분은 관련 법에 부합하는 방식으로 해당 부분의 본래 의도를 최대한 가깝게 반영하도록 해석되어야 하며, 본 계약의 나머지 부분은 완전히 유효한 상태로 유지됩니다.  ZeniMax가 본 계약의 어떠한 권리 혹은 조항을 행사 또는 시행하지 않더라도 그러한 권리나 조항의 포기로 간주되지 않습니다.  본 계약의 조항에 대한 권리 포기는 ZeniMax가 서명한 문서에 의해서만 효력을 갖습니다.  귀하는 본 계약과 ZeniMax의 본 계약 시행이 귀하와 ZeniMax 이외의 다른 사람에게 권리 또는 구제 조치를 부여할 의도가 없고 부여하지 않는다는 점에 동의합니다.  이 섹션 14는 이유를 불문하고 본 계약 해지 시에도 존속합니다.  
본인은 이 문서에서 본인이 본 계약의 모든 약관과 조건을 읽고 이해하였음을 확인합니다.  본인은 '동의'를 클릭함으로써 본 문서에 기재되어 있는 ZeniMax의 부정행위 방지 도구 사용에 대한 본인의 명시적 동의를 포함하여 본 계약의 모든 약관 및 조건에 구속되는 것을 확인하고 이에 동의합니다.
