Frontier는 분실, 도난 또는 손상된 CD 키/인증 코드를 교체해주지 않습니다.<br> <br>1. 인정 사항<br>1.1 귀하는 해당 기기가 귀하의 소유인지 여부를 불문하고, 기기상에서 이루어지거나, 기기와 관련되는 게임 이용에 대해서 이 EULA의 조건에 따른 책임을 지기로 수락합니다. 귀하는 게임을 이용하기 위해서 귀하가 사용하지만 소유하지는 않는 기기에 대해서는 해당 소유자로부터 허락을 받아야 합니다. 귀하와 기기의 소유자는 해당 기기의 인터넷 이용에 대해서 귀하 및 해당 소유자의 인터넷 서비스 제공자로부터 요금을 청구받을 수 있습니다.<br> <br>1.2 게임에는 다른 제3자의 웹사이트에 대한 링크가 포함될 수 있습니다. 이러한 웹사이트는 Frontier가 관리하는 것이 아니며, 당사는 귀하가 점유하고 관리하는 하나의 단일 기기에서 게임을 구동하고 이용하는 행위.<br>(b) 게임을 이러한 하나의 기기에서 또 다른 기기로 옮기는 행위. 단, 게임이 어느 한 시점에 오로지 하나의 기기에서만 이용되고, 게임이 이용되는 기기가 그 이용 시점에 귀하의 점유 및 관리하에 있는 경우에 한합니다.<br> <br>2.2 이 계약에 따라 명시적으로 부여되지 않은 모든 권리는 법률상 허용되는 범위까지 Frontier와 그 라이선스 부여자들에 유보됩니다. 이 EULA에 따른 귀하의 게임 이용 권리는 귀하가 항상 이 EULA의 조건을 엄격히 준수할 것을 조건으로 합니다.<br> <br>3. 라이선스 제약사항<br>귀하는 다음 행위를 해서는 안 됩니다.<br>(a) 해당 네트워크에 있는 하나 이상의 다른 기기에 배포하거나, 그러한 배포 효과가 나게 할 목적으로 게임을 네트워크 서버에 구동하는 행위<br> <br>(b) 이 EULA에 의해서 명시적으로 허용된 경우 및 관련 법률에 의해서 명시적으로 허용된 범위까지를 제외하고, 게임의 전부 또는 일부에 대해서 임대, 리스, 서브 라이선스 설정, 대여, 이익 또는 소득을 위한 활용, 복사, 수정, 개작, 병합, 번역, 역설계, 디컴파일, 디스어셈블 또는 2차 저작물 생성 행위를 하거나, 게임 또는 그 일부를 어떤 방식으로든 사용, 복제, 배포, 번역, 방송, 공개 실행, 검색 시스템에서의 저장 또는 그 밖에 처리하는 행위<br>(c) 게임의 목적이나 경험을 수정하거나 무산시키기 위해서 고안된 치트, 자동화 소프트웨어, 해킹, 모드 또는 기타 허용되지 않은 소프트웨어를 사용하는 행위<br> <br>(d) 캐릭터 또는 게임 환경에 관한 것을 포함해서, 타인 또는 게임에 관한 정보를 대량 수확하거나 그 밖의 방식으로 수집하는, 허용되지 않은 소프트웨어를 사용하는 행위<br> <br>(e) 게임 또는 온라인 기능을 이용하거나, 게임 또는 온라인 기능으로부터 콘텐츠나 정보를 복사하기 위해서 로봇, 스파이더, 스크래퍼 또는 그 밖의 자동화 수단이나 수동적 수단을 사용하는 행위<br> <br>(f) 게임 또는 온라인 기능의 인증 조치를 조사하거나, 살펴보거나, 그 취약성을 테스트하거나, 위반하는 행위<br> <br>(g) 게임 또는 온라인 기능에 의해서 사용되거나 뒷받침되는 기술에 적용되는 기술 통제 또는 수출 법률 및 규정을 위반하는 행위<br> <br>4. 적정 이용을 위한 제약사항<br>4.1 귀하는 게임 또는 온라인 기능을 부적법한 방법으로, 부적법한 목적을 위해서, 또는 이 EULA에 부합되지 않는 방식으로 사용해서는 안 되며, 게임, 온라인 기능 또는 운영체제를 해킹하거나, 악성 코드(바이러스 또는 해로운 데이터 포함)를 삽입하는 등, 기만적이거나 악의적인 행위를 해서는 안 됩니다.<br> <br> <br>4.2 귀하는 이 EULA에 의해서 해당 이용에 대한 라이선스를 부여받은 범위를 넘어서서, 게임 또는 온라인 기능의 이용과 관련해서 당사 또는 제3자의 지적재산권을 침해해서는 안 됩니다.<br> <br>4.3 귀하는 게임 또는 온라인 기능의 이용과 관련해서 부적법하거나, 명예를 훼손하거나, 공격적인 자료를 전송해서는 안 됩니다.<br> <br>4.4 귀하는 당사의 시스템이나 보안에 대해서 손해를 입히거나, 불가능하게 하거나, 손상시키거나, 과부하를 가하거나, 훼손하는 방식, 또는 게임이나 온라인 기능에 대한 다른 이용자의 경험을 방해하는 방식으로 게임 또는 온라인 기능을 이용해서는 안 됩니다.<br> <br>4.5 귀하는 게임, 온라인 기능 또는 당사의 시스템으로부터 정보나 데이터를 수집하거나 대량 수확해서는 안 되며, 게임 또는 온라인 기능을 운영하는 서버들과 주고받는 전송을 해독하려고 시도해서는 안 됩니다. <br> <br>5. 지적재산권<br>5.1 귀하는 게임 및 온라인 기능에 대한 모든 소유권, 지적 재산, 영업비밀 및 그 밖의 모든 사적 재산권(컴퓨터 코드, 테마, 대상 캐릭터, 캐릭터 이름, 스토리, 장소, 개념, 아트워크, 스토리라인, 유사성, 저작인격권, 구조적 디자인 또는 풍경 디자인, 음악적 구성, 대화, 배치물, 또는 그 밖에 미국 또는 국제적 지적재산보호 법률에 의해 보호되는 콘텐츠를 포함하되 이에 국한되지 않음)이 Frontier의 소유이거나, Frontier에 의해서 라이선스가 부여된 것이라는 점, 게임에 대한 권리는 귀하에게 판매되는 것이 아니라 단지 라이선스가 부여되는 것이라는 점(2항에서 부여된 라이선스를 전제로 함), 그리고 귀하는 이 EULA의 조건에 따라 게임 또는 온라인 기능을 이용할 수 있는 권리 이외에는 그에 대해 어떠한 권리도 갖는 것이 아니라는 점을 인정합니다.<br> <br>5.2 귀하는 귀하가 과거의 게임플레이나 보관된 게임플레이, 배치물, 게임 진행, 캐릭터 또는 게임 내의 그 밖의 성취사항에 대해서 어떠한 사적 권리도 취득하지 못한다는 점을 인정합니다.<br> <br>5.3 귀하는 귀하가 소스 코드 형태로 게임에 액세스할 수 있는 권리가 없다는 점을 인정합니다.<br> <br>6. 요금 및 결제<br>6.1 게임을 이용하려면, 귀하는 요금을 지급해야 합니다. 귀하는 소정의 요금을 지급하고 게임 내에 있는 아이템 또는 온라인 기능을 통해 제공되는 아이템을 구매할 수도 있습니다.<br> <br>6.2 귀하는 구매하기 전에 게임 이용에 대해 적용되는 요금을 곧바로 고지받을 것입니다. 현재 적용되는 게임 이용 요금은 <a class="bb_link" href="https://steamcommunity.com/linkfilter/?u=https%3A%2F%2Fwww.frontierstore.net%EC%97%90%EC%84%9C" target="_blank" rel=" noopener">https://www.frontierstore.net에서</a> 확인할 수 있습니다. 요금이나 비용을 지급하지 않는 것은 이 EULA에 대한 중대한 위반이 됩니다. 당사는 당사의 전적인 재량에 따라 언제든지 요금과 결제 조건을 변경할 수 있습니다.<br> <br>6.3 당사는 당사의 전적인 재량에 따라, 특별 행사 또는 프로모션과 관련해서 게임의 다운로드와 관련된 일체의 요금을 면제할 수도 있습니다.<br> <br>7. 게임 기능 및 뇌전증 경고<br> <br> <br>7.1 온라인 기능<br> <br>7.1.1 게임에서는 Frontier나 그 계열사, 또는 이들을 대행할 권한을 부여받은 제3자가 운영하는 소정의 온라인 서비스를 이용할 수 있도록 허용하며, 이를 통해서 게임 이용자들은 온라인 포럼 및 콘텐츠 공유 등 게임과 관련된 소정의 온라인 또는 멀티플레이어 기능과 서비스("온라인 기능")를 즐길 수 있게 됩니다. 하지만, 이러한 서비스와 온라인 기능에서는 추가 요금의 결제를 요구할 수도 있습니다. 아울러, 이러한 온라인 기능 및 이러한 서비스의 일부로서 제공되는 기타 상품 또는 정보에 접속하고 이용하기 위해서는 등록 절차가 완료되어야 할 수도 있고, 개인 식별 가능 정보의 사용 및 처리를 규율하는 개인정보 취급방침 등 추가적인 이용 조건에 대한 수락이 요구될 수도 있습니다. 이 게임의 모든 구매자들이 이러한 서비스(게임과 관련된 온라인 기능 포함)에 등록하거나, 그 혜택을 받을 수 있는 것은 아닙니다. 이러한 서비스와 온라인 기능은 귀하의 국가에서 제공되지 않을 수도 있고, 어느 기간 동안 제공될 것이라고 보장되지도 않으며, 언제든지 정지 또는 철회될 수 있고, 연령 제한을 적용받을 수도 있습니다. "기여물")를 소유하지 않으며, 귀하는 해당 기여물이 게임 또는 온라인 기능의 다른 이용자에 의해서 공유, 복사 및 보관되는 경우를 제외하고, 언제든지 이러한 기여물의 삭제를 요청할 수 있습니다. 귀하는 게임 및/또는 온라인 기능에 의해서 제공되거나, 게임 및/또는 온라인 기능을 통해서 귀하가 게시, 업로드, 입력 또는 제출한 게임 요소의 모든 배치물(각각 "배치물")에 대한 모든 권리를 Frontier가 소유하게 된다는 점에 동의합니다. 기여물 및/또는 배치물의 게시, 업로드, 입력, 제공 또는 제출 행위를 하는 경우, 귀하는 이러한 기여물 및/또는 배치물과 그 2차 저작물에 대해서, 현재 알려져 있거나 향후에 발견되는 일체의 방식으로, 사용, 복사, 복제, 공표, 2차 저작물 생성, 배포, 전송, 트랜스코딩, 번역, 방송, 기타 통신 행위를 하고, 공개적으로 전시, 실행, 처리, 분석, 사용 및 상업화할 수 있는, 취소 불가능하고, 전 세계적이며, 서브 라이선스를 설정할 수 있고, 영구적이며, 무제한적이고, 양도 가능하며, 대가가 전부 지급되고, 로열티가 무료인 권리를 Frontier와 그 계열사들에 부여하는 것입니다. <br> <br>7.1.3 게임 또는 온라인 기능을 통해서 귀하가 게시, 업로드, 입력 또는 제출한 각각의 기여물 및/또는 배치물에 대해서는 귀하 자신이 그 위험을 부담하며, 귀하는 이러한 기여물 및/또는 배치물을 그렇게 사용할 수 있는 적법하고 완전한 권리를 귀하가 가지고 있다는 점, 그리고 그것은 비밀이거나 제3자의 사적인 재산이 아니며, 귀하가 법률 또는 계약상 제한을 위반해서 그것을 사용하는 것이 아니라는 점을 이 계약에 의해서 확언하고 보증합니다.<br> <br>7.1.4 귀하는 Frontier가 기여물 및/또는 배치물을 사용하거나, 배포하거나, 배포를 지속해야 할 의무가 없으며, 어떠한 사유로든 이러한 기여물 및/또는 배치물을 제한하거나 제거할 수 있는 권리가 있지만 그래야할 의무는 없다는 점을 이해하고, 이에 동의합니다.<br> <br>7.1.5 귀하는 귀하의 전적인 재량에 따라, 해당되는 게임 또는 온라인 기능으로부터 기여물 및/또는 배치물을 삭제할 수 있습니다. 귀하가 그렇게 하는 경우, Frontier는 더 이상 해당 기여물 및/또는 배치물을 이용하거나, 배포하거나, 전송하거나, 통신하거나, 공개적으로 전시하거나, 공개적으로 실행할 수 있는 권리가 없습니다. 단, (a) Frontier가 게임 내에서 배포하도록 수락되거나, 게임 내에서 사용되도록 허용하는 방식으로 배포되는 기여물 및/또는 배치물에 대해서 이러한 권리를 계속 행사할 수 있고, (b) 귀하의 삭제가 이미 기여물 및/또는 배치물의 사본을 취득한 회사 또는 개인의 권리에 영향을 미치지 않는 경우에는 예외입니다.<br> <br>7.1.6 귀하는 귀하의 기여물 및/또는 배치물에 대한 Frontier의 배려가 귀하에 대한 보상의 전부라는 점, 그리고 귀하는 Frontier 및 그 밖의 회사나 개인에 대해 부여된 권리와 관련해서 그 밖의 권리 또는 보상을 요구할 권리가 없다는 점에 동의합니다.<br> <br>7.2 이용 데이터<br>7.2.1 당사는 이 EULA의 일부를 구성하는 개인정보 취급방침에 명시된 바에 따라, 귀하가 게임을 이용하는 동안 때때로 귀하의 기기에 관한 정보를 수집할 수 있습니다. 이러한 정보에는 귀하의 게임 ID, 게임 성취사항, 점수 및 성적, IP 주소, MAC 주소 또는 그 밖의 기기 ID, 기타 기기 사용 정보, 또는 귀하의 게임 이용에 관한 그 밖의 정보 및 통계도 포함될 수 있습니다. 이 정보는 귀하가 인터넷에서 게임을 플레이하는 것을 돕기 위해서뿐만 아니라(게임에 온라인 기능이 포함된 경우), 향후에 당사가 게임과 서비스를 향상시킬 수 있도록 당사의 고객들이 게임을 이용하는 방법, 그들의 행동과 선호사항을 당사가 보다 잘 이해할 수 있도록 돕기 위해서도 사용될 수 있습니다.<br> <br>7.3 다른 이용자들과의 통신 및 상호작용<br>7.3.1 게임 및/또는 온라인 기능에서는 문자 및 음성 등의 수단으로 이용자들 상호간에 통신을 할 수 있게 해줄 수도 있습니다. 이러한 기능을 이용하는 경우, 귀하는 반드시 상식적이고 양호한 방법을 사용해야 하고, 귀하의 행동, 행위 및 통신은 다른 이용자들을 배려해야 하며, 귀하는 직접 또는 간접으로 타인에 대해서 공격적이거나, 위협하거나, 해를 가하거나, 괴롭히는 행위를 해서는 안 되며, 인종, 민족, 종교, 성별 또는 성적 성향에 기초한 차별 금지 법률 등 일체의 관련 법률을 위반해서는 안 됩니다.<br> <br>7.3.2 Frontier는 다른 이용자들과 당사의 커뮤니티를 보호하기 위해서 7.3.1항에 기술된 통신 내용의 전부 또는 일부에 대한 기록, 모니터링 및 보관을 할 수 있는 권리를 유보하지만, 그래야할 If you are in the process of downloading the Game, you have the right to withdraw from the transaction without charge and for any reason prior to completing the download of the Game. You agree that all rights in any arrangement of game elements that are provided by the Game and/or Online Features and posted, uploaded, inputted or submitted by you via the Game and/or Online Features (each an “Arrangement”) are owned by Frontier.  By posting, uploading, inputting, providing or submitting a Contribution and/or Arrangement you are granting Frontier and its affiliates a nonexclusive, irrevocable, worldwide, sublicenseable, perpetual, unlimited, assignable, fully paid up and royalty-free right to use, copy, reproduce, publish, prepare derivative works of, distribute, transmit, transcode, translate, broadcast, and otherwise communicate publicly display and publicly perform, process, analyze, use and commercialize, in any way now known or in the future discovered, such Contribution and/or Arrangement and derivative works of such Contribution and/or Arrangement. <br> <br>7.1.3 Each Contribution and/or Arrangement posted, uploaded, inputted, or submitted by you via the Game or any Online Feature is at your own risk and you hereby represent and warrant that you have the full legal right to so use such Contribution and/or Arrangement and that it is not confidential or proprietary to any third party, nor are you using it in violation of any law or contractual restriction.<br> <br>7.1.4 You understand and agree that Frontier is not obligated to use, distribute, or continue to distribute copies of any Contribution and/or Arrangement and reserves the right, but not the obligation, to restrict or remove such Contribution and/or Arrangement for any reason.<br> <br>7.1.5 You may, in your sole discretion, choose to remove a Contribution and/or Arrangement from the applicable Game or Online Features. If you do so, Frontier will no longer have the right to use, distribute, transmit, communicate, publicly display or publicly perform the Contribution and/or Arrangement, except that (a) Frontier may continue to exercise these rights for any Contribution and/or Arrangement that is accepted for distribution in-game or distributed in a manner that allows it to be used in-game, and (b) your removal will not affect the rights of any company or individual who has already obtained access to a copy of the Contribution and/or Arrangement.<br> <br>7.1.6 You agree that Frontier’s consideration of your Contribution and/or Arrangement is your full compensation, and you are not entitled to any other rights or compensation in connection with the rights granted to Frontier and to other companies or individuals.<br> <br>7.2 Usage Data<br>7.2.1 We may from time to time during your Use of the Game collect information about your device, as specified in the Privacy Policy, which forms part of this EULA. This information may also include your Game ID, Game achievements, scores and performances, IP address, MAC address or other device ID, other device use information or other information and statistics regarding your usage of the Game. This information may be used not only to help you play the Game over the Internet (where the Game contains Online Features) but also to help us better understand how our customers are using the Game, their behaviour and preferences, so that we can improve our Games and services in the future.<br> <br>7.3 Communication and interaction with other users<br>7.3.1 The Game and/or Online Features may allow communications between users by means including but not limited to text and voice. When using such features you must use common sense and good manners, your behaviour, conduct and communications must be considerate to other users and you must not be directly or indirectly offensive, threatening, harassing or bullying to others or violate any applicable laws including but not limited to anti-discrimination legislation based on race, ethnicity, religion, gender or sexual orientation.<br> <br>7.3.2 Frontier reserves the right, but not the obligation, to record, monitor and retain all or some of the communications described in clause 7.3.1 in order to safeguard other users and our community. You acknowledge that Frontier shall have the right, but not the obligation, to pre-screen, refuse, move or remove any content available through the Game or the Online Features, including, but not limited to, content that violates any law or this EULA, the Privacy Policy, or any other applicable legal or contractual obligation.<br> <br>7.3.3 By accepting these terms and conditions you hereby agree that any information collected as described in Clause 7.3.2 that is deemed to be illegal or to contravene the rights of Frontier, our employees, customers, or any other individual during Use of the Game or the Online Features may be reported to the police or other appropriate authorities, and; ii) agree to be bound by the Community Codes of Conduct for the Game, the latest version of which may be viewed here.<br> <br>7.4 Patches and Updates<br>We may deploy or provide patches, updates and modifications to the Game that must be installed in order for you to continue to play the Game. We may update the Game remotely (including without limitation the Game client on your device), and you hereby grant us your consent to deploy and apply such patches, updates and modifications.<br> <br>7.5Epilepsy Warning<br>A small number of users may be susceptible to epileptic seizures or loss of consciousness when exposed to certain flashing lights or light patterns.  Such individuals may experience a seizure while watching certain images or playing a video Game.  If you or anyone in your family has ever had symptoms related to epilepsy (seizures or loss of consciousness) when exposed to flashing lights, please consult a medical professional and take all necessary precautions prior to playing the Game.  If you experience any of the following symptoms while playing any video Game: dizziness, eye or muscle twitches, loss of consciousness, disorientation, convulsions, involuntary movements, discontinue use of that video Game immediately and consult a medical professional.<br> <br>8. Termination<br>8.1 Without prejudice to any other rights, Frontier may terminate this EULA immediately without notice if you fail to comply with the terms and conditions of this EULA. In the event of termination, all rights granted to you under this EULA shall cease and you must destroy all copies of the Game and all of its component parts (including any Game stored on the hard disk of any device). All provisions of this EULA relating to disclaimers or warranties, limitations of liability, remedies, damages, Frontier’s proprietary rights and/or any terms intended expressly or by implication to survive termination or expiry shall survive termination, including, without limitation Clauses 3-5, and 10-13.<br> <br>8.2 The Online Features are provided over the internet as provided by Frontier.  You acknowledge that the Online Features are provided by Frontier at its discretion and may be terminated or otherwise discontinued by Frontier at any time.<br> <br>9. Limited Warranty and Support<br>9.1 The Game (along with any services provided by us in connection with it, including but not limited to the Online Features) is provided "as is" and without warranty of any kind, to the maximum extent permitted by law. You assume all risk associated with Using the Game or the Online Features.<br> <br>9.2 To the maximum extent permitted by law, we disclaim all representations, warranties, conditions or other terms (whether express or implied) including but not limited to implied warranties and/or conditions of merchantability, satisfactory quality, non-infringement of intellectual property rights and fitness for a particular purpose. While we endeavour to ensure that the Online Features are available at most times, we do not guarantee that they will always be available, nor that they will not become unavailable while a user is Using the Game. The Online Features may become unavailable for reasons including but not limited to the performance of maintenance, the updating of software, emergency situations and equipment or network failures.<br> <br>9.3 Without prejudice to the generality of the above, we do not warrant that the Game is error-free or that it will operate without interruption, nor that we will repair any errors in the Game.<br> <br>9.4 We do not warrant that the Game will operate on all devices and operating systems. It is your responsibility to refer to the minimum required technical specifications contained on the relevant product page required for effective Use of the Game and the Online Features.<br> <br>9.5 If you require technical assistance, please contact our support team via <a class="bb_link" href="https://steamcommunity.com/linkfilter/?u=https%3A%2F%2Fsupport.frontier.co.uk" target="_blank" rel=" noopener">https://support.frontier.co.uk</a>. You will be responsible for all connection charges.<br> <br>10. Limitation of Liability; Remedies<br>10.1 We only supply the Game (including the Online Features) for domestic and private use. You agree not to use the Game for any commercial, business or resale purposes and we have no liability to you for any loss of profit, loss of information, loss of business, business interruption, or loss of business opportunity arising out of the use of or inability to use the Game, even if we have been advised of the possibility of such damages.<br> <br>10.2 We are only responsible for loss or damage you suffer that is a foreseeable result of our breach of this EULA or our negligence, subject to the limitations specified in clause 10.3, but we are not responsible for any unforeseeable loss or damage. Loss or damage is foreseeable under this EULA if it is an obvious consequence of our breach or if it was contemplated by you and us at the time we granted this EULA. Except as otherwise specified in this clause 10, in no event shall Frontier, our partners, our affiliates, or our respective licensors and suppliers be liable for any, indirect, punitive, incidental or special damages arising out of or in any way connected with any Use of the Game or the Online Features (including any delay or inability to Use the Game or the Online Features) including, without limitation, loss of data, computer failure or malfunction, or any and all other damages or losses arising out of the Use of the Game or Online Features, whether based on contract, tort, strict liability or otherwise.<br> <br>10.3 Notwithstanding clause 10.2, our maximum aggregate liability under, in connection with, ARISING OUT OF, OR RELATED TO this EULA or your use of the Game (including the Online Features), whether in contract, tort (including negligence) or otherwise, shall in all circumstances be limited to the amount actually paid by you for the Game. This does not apply to the types of loss set out in clause 10.4.  Because Some Jurisdictions do not allow the exclusion or limitation of liability for certain damages, the above limitations may not apply to you. <br> <br>10.4 Nothing in this EULA shall limit or exclude our liability to you for: (i) death or personal injury resulting from our negligence; (ii) fraud or fraudulent misrepresentation; and (iii) any other liability that cannot be excluded or limited by law.<br> <br>10.5 You understand that the Game may be updated at any time and in doing so no obligation to provide such updates to you pursuant to this EULA or otherwise shall arise.<br> <br>10.6 If you breach or threaten to breach any provision in this EULA, you agree that Frontier shall be irreparably harmed, and, without any additional findings of irreparable injury or harm or other considerations of public policy, Frontier shall be entitled to receive an injunction compelling specific performance by you of your obligations under this EULA without the necessity of posting any bond or other security. <br> <br>11. Governing Law; Forum Selection<br>11.1 Subject to clauses 11.2,  11.3 and 12 below, this EULA and any claim or dispute of whatever nature (including any non-contractual dispute) arising out of or relating to this EULA shall be governed by, and construed in accordance with, the laws of England whose courts shall have non-exclusive jurisdiction over all disputes arising under or in connection with this EULA, unless and to the extent only that the laws and/or jurisdiction relating to transactions with consumers in a particular jurisdiction require this EULA to be governed by and construed in accordance with the laws of such jurisdiction and/or require any dispute relating to this EULA to be subject to the jurisdiction of a court or other tribunal in such jurisdiction in order for this EULA to be binding and enforceable, in which event the local laws and/or jurisdiction of such jurisdiction shall apply, to the extent so required. You consent to personal jurisdiction of and venue in the courts within or having jurisdiction over such country, and waive any objection you might otherwise have had on the basis of the doctrine of forum non conveniens.<br> <br>11.2 In the case of any claim of dispute of any nature (including non-contractual dispute) arising our of or relating to any Use of the Game by a user physically located within the United States of America at the time of the Use of the Game giving rise to such claim or dispute and subject to clause 12 below, clause 11.1 shall not apply and this EULA and any claim or dispute of whatever nature (including any non-contractual dispute) arising out of or relating to this EULA shall be governed by, and construed in accordance with, the laws of the state of Nevada, USA, not including its conflict of law principles. Subject to clause 12 below, each party irrevocably agrees that any legal action, dispute, suit or proceeding brought by it in any way arising out of this Agreement must be brought solely and exclusively in the courts located in the state of Nevada, and irrevocably accepts and submits to the sole and exclusive jurisdiction of each of the aforesaid courts in personam.<br> <br>11.3 Neither the United Nations Convention on Contracts for the International Sale of Goods nor the United Nations convention on the Limitation Period in the International Sale of Goods, as amended, shall apply to this EULA.<br> <br>12. DISPUTE RESOLUTION/BINDING ARBITRATION/CLASS ACTION WAIVER<br> <br>IF YOU USE THE GAME IN THE USA, PLEASE READ THIS CLAUSE 12 CAREFULLY BECAUSE IT REQUIRES YOU TO ARBITRATE CERTAIN DISPUTES AND CLAIMS WITH FRONTIER AND LIMITS THE MANNER IN WHICH YOU CAN SEEK RELIEF FROM FRONTIER. IF YOU USE THE GAME IN A COUNTRY OTHER THAN THE USA, THIS CLAUSE 12 DOES NOT APPLY TO YOU.<br> <br>This clause 12 will apply to the maximum extent permitted by applicable law. If you and Frontier cannot resolve a dispute by informal negotiation within thirty (30) days of providing the other party with written notice of a dispute, any other effort to resolve the dispute will be conducted exclusively by final, binding arbitration conducted by the American Arbitration Association in accordance with its Commercial Arbitration Rules and governed by the Federal Arbitration Act. The arbitration will be conducted in Clark County and the arbitrator will follow Nevada law in adjudicating the dispute. The parties waive the right to seek punitive damages and the arbitrator will not award such damages. Any court with jurisdiction over the parties may enforce the arbitrator’s award.<br> <br>YOU ACKNOWLEDGE AND AGREE THAT YOU ARE GIVING UP THE RIGHT TO LITIGATE ALL DISPUTES IN COURT BEFORE A JUDGE OR JURY. <br> <br>No Class Arbitrations, Class Actions or Representative Actions. You and Frontier agree that any dispute arising out of or related to this EULA, is personal to you and Frontier and that such dispute will be resolved solely through individual arbitration and will not be brought as a class arbitration, class action, or any other type of representative proceeding. You and Frontier agree that there will be no class arbitration or arbitration in which an individual attempts to resolve a dispute as a representative of another individual or group of individuals. Further, you and Frontier agree that a dispute cannot be brought as a class or other type of representative action, whether within or outside of arbitration, or on behalf of any other individual or group of individuals.<br> <br>Any arbitration conducted pursuant to this Agreement will be between Frontier and you individually. If the agreement in this clause not to bring or participate in an arbitration on a class-action basis should be found unenforceable, you and Frontier agree that it will not be severable, and that this entire clause 12 will be deemed unenforceable and any dispute will be resolved in court and not by collective arbitration. <br> <br>13. Miscellaneous<br>13.1 We may transfer our rights and obligations under this EULA to another entity, but this will not affect your rights or obligations under this EULA. You may only transfer your rights or obligations under this EULA to another person if we agree in writing.<br> <br>13.2 Each of the provisions of this EULA operates separately. If any court or competent authority decides that any of them are unlawful or unenforceable, the remainder of the EULA will remain in full force and effect.<br> <br>13.3 In the event of a conflict between the terms of this EULA and the Conditions of Use, the provisions of this EULA shall prevail.
