Terms of Use for Omega Crafter 利用規約

1. For the purpose of these terms use for OmegaこのOmega Crafter (hereinafter referred to as “Terms of Use”), the following terms shall have the meaning as defined in each item.利用規約（以下「本規約」という。）において、以下の用語は、次の各号に定める意味を有する。
(1) “PFN”「PFN」とは、株式会社Preferred shall refer to Preferred Networks, Inc.Networksをいう。
(2) “Omega「Omega Crafter” shall refer to the game contents which is in the middle of development by PFN.Crafter」とは、PFNが開発を進めるゲームコンテンツをいう。
(3) “Intellectual Property Rights” collectively shall refer to the following: 「知的財産権」とは、次に定めるものを総称していう。
① Copyright (including rights set forth in Article 27 and Article 28 of the Copyright Act and moral rights.), patent right, utility model right, design right, and trademark right,著作権（著作権法第27条及び第28条に定める権利並びに著作者人格権を含む。）、特許権、実用新案権、意匠権及び商標権
② Right to receive a patent, right to receive registration of a utility model, right to receive design registration, and right rising from filing an application for trademark registration,特許を受ける権利、実用新案登録を受ける権利、意匠登録を受ける権利及び商標登録出願により生じた権利
③ Rights that are equivalent those in ① or ② above in a foreign country, and外国における上記①又は②に定める権利に相当する権利
④ Right to manage as confidential and use technical information that has intellectual property value and can be made anonymous.技術情報のうち秘匿することが可能なものであって、かつ、財産的価値のあるものを利用し、秘密として管理する権利
2. This本規約は、ユーザによるOmega TermsCrafterの利用に関する条件を定める。本規約は、全てのユーザに適用され、ユーザは、本規約に定める事項を遵守しなければならない。ユーザは、本規約に同意する場合に限り、Omega ofCrafterを利用することができる。なお、これらの同意は、ユーザがOmega UseCrafterの利用を開始する際にPFNに提供され、ユーザがOmega setCrafterの利用に必要な手続き又は操作をした場合は、当該同意を有効に行ったものとみなす。ユーザが未成年である場合は、親権者等の法定代理人又は監督義務者の同意（これらの者による本規約への同意を含む。）を得た場合に限り、Omega forthCrafterを利用することができる。なお、未成年であるユーザがOmega the conditions for the use of the Omega Crafter by User. This Terms of Use shall apply all Users and all Users must comply with the matters set forth in this Terms of Use. User may use the Omega Crafter only when they consent to this Terms of Use. This consent will be provided to PFN upon the start of use of the Omega Crafter by User and any procedures and /or operations which are needed to use the Omega Crafter shall be deemed to valid consent for this Terms of Use. When User is a minor, only to the extent consent is given by a legal representative, such as a person in parental authority or guardianship (including when such person gives consent to this Terms of Use), User may use the Omega Crafter. When User who is a minor makes any procedures and /or operations which are needed to use the Omega Crafter, the legal representative, such as a person in parental authority or guardianship, shall be deemed to have effectively given such consent.Crafterの利用に必要な手続き又は操作をした場合は、その親権者等の法定代理人又は監督義務者が当該同意を有効に行ったものとみなす。
3. All Intellectual Property of Omega CrafterCrafter及びそれに関連する一切の知的財産権は、PFN又はPFNにその許諾を行う者に帰属する。Omega and those related to Omega Crafter shall belong to PFN or licenser for PFN. Providing Omega Crafter by PFN shall neither change ownership of such Intellectual Property nor provide any right for such Intellectual Property to User.Crafterの提供は、ユーザに対して当該知的財産権に関して、一切の権利変動及び権利設定を行うものではない。
4. Usersユーザは、以下の条件を遵守する限りにおいて、Omega may transmit the information with regards to Omega Crafter, including live game streaming, as long as they comply with the following conditions. PFN shall not take any responsibility for these transmissions. Crafterに係る情報発信（ゲーム実況配信を含む。以下同じ。）を行うことができる。なお、PFNは、当該情報発信に関して、一切の責任を負わない。
 Do not transmit information in a manner that mislead the public into believing that you are sponsored or provided by PFN or its affiliated companies.PFN又はその関係会社から協賛や提供を受けているかのように誤信させる内容又は方法による情報発信を行わないこと
 Do not send information with contents or methods that are intended to advertise or announce products or goods other than Omega CrafterCrafter以外の製品又は商品の宣伝又は告知を目的とする内容又は方法による情報発信を行わないこと
 To comply with laws and regulations and the terms and conditions established by the platform used when transmitting information.情報発信に際して、法令及び利用するプラットホームが制定する規約を遵守すること
 Do not transmit information in a manner or content that unreasonably infringes on the rights or interests of PFN or any third party.PFN及び第三者の権利又は利益を不当に侵害する内容又は方法による情報発信を行わないこと
 Do not transmit information in a manner or content that offends public order and morals, or that is intended to spread political beliefs, religious ideology, or other specific principles or claims.公序良俗に反する内容又は方法による情報発信、政治的信条又は宗教的思想その他特定の主義主張の拡散を目的とした情報発信を行わないこと
5. PFNPFNは、Omega shallCrafterの提供に際して取得するユーザの個人情報について、PFNが別途定めるプライバシーポリシー（ appropriately handle User‘s personal information obtained in relation to providing Omega Crafter in accordance with Privacy Policy (https://www.preferred.jp/en/policy/)https://www.preferred.jp/ja/policy/ separately stipulated by PFN, and User shall consent to this.）に沿ってこれを適切に取り扱うものとし、ユーザはこれに同意する。
6. Usersユーザは、Omega may not engage in any of the following actions.Crafterの利用に際して、以下の行為を行ってはならない。
(1) ActPFNによるOmega ofCrafterの提供において予定している利用目的又は利用態様と異なる目的又は態様でOmega using Omega Crafter for a purpose or form that differs from the purpose of use or form of use expected when using Omega CrafterCrafterを利用する行為
(2) ActPFN又は他のユーザに対する不当な要求その他PFNによるOmega of making an unfair demand against the PFN or other Users, or otherwise hindering the provision of Omega Crafter by PFNCrafterの提供に支障を与える行為
(3) Act that violates the laws, regulations, court rulings, decisions, orders, or legally binding measures enacted by the administrative agency法令、裁判所の判決、決定もしくは命令又は法令上拘束力のある行政庁の措置に違反する行為
(4) Act過度に暴力的な表現、児童ポルノに当たる表現、露骨な性的表現、人種、国籍、信条、性別、社会的身分、門地等による差別につながる表現、特定の思想・信条を第三者に強要し又は過度に強調する表現、その他反社会的な内容を含み他人に不快感を与える表現を用いてOmega of using Omega Crafter excessively violent expressions; child pornography; explicit sexual contents; expressions that could lead to discrimination based on race, nationality, beliefs, gender, social status, family origin, etc.; expressions that force or excessively emphasize particular thoughts or beliefs to third parties; or other expressions that contain antisocial content and will make others uncomfortableCrafterを利用する行為
(5) Act that may damage public order or morality公の秩序又は善良の風俗を害するおそれのある行為
(6) Act of making unauthorized access, or equivalent action不正アクセスその他これに類する行為
(7) Act of posting and requesting personal information in chatチャットにおける個人情報の投稿及びその要求
(8) Act of assisting any of the above acts上記のいずれかに該当する行為を助長する行為
(9) Other acts deemed inappropriate by PFNその他PFNが不適当と認める行為
7. PFN shall take no responsibility for any disputes, damages or other problems between Users arising from the use of chat function.PFNは、ユーザによるチャット機能の使用に伴うユーザ間の紛争、損害その他一切のトラブルについて何らの責任を負わない。
8. User represents and warrants that it is not, was not in the past, and does not use antisocial forces (referring to an organized crime group define in Article 2, Item (ii), of the Act on Prevention of Unjust Acts by Organized Crime Group Members (Act No. 77 of 1991 (including the subsequent amendments), organized crime member as defined in Item (vi) of the same Act, quasi member of an organized crime group, affiliate company of an organized crime group, corporate racketeer, a group engaging in criminal activities under the pretext of conducting social campaign crime group specialized in intellectual crimes, or other group or individual that pursue economic profit using force or fraudulent means; the same shall apply hereinafter.). In addition, User will not damage the reputation or trust of PFN, hinder the operations of or make unfair demands against PFN by claiming to be antisocial forces, nor have a relationship with antisocial forces.ユーザは、自らが反社会的勢力（暴力団員による不当な行為の防止等に関する法律（平成三年法律第七十七号（その後の改正を含む。）第2条第2号に定める暴力団、同第6号に定める暴力団員、暴力団準構成員、暴力団関係企業、総会屋、社会運動標榜ゴロ、特殊知能暴力集団等その他暴力、威力又は詐欺的手法を駆使して経済的利益を追求する集団又は個人をいう。以下同じ。）でないこと、反社会的勢力でなかったこと、反社会的勢力を利用しないこと、反社会的勢力を名乗るなどしてPFNの名誉又は信用を毀損し、業務の妨害を行い又は不当要求行為をなさないこと、及び反社会的勢力と関係しないことを表明し保証する。
9. The laws of Japan shall apply to the interpretation and application of this Terms of Use. With regards to matters not stipulated in this Terms of Use or questions concerning the interpretation of each provision in this Terms of Use, PFN and User shall discuss in good faith and attempt to resolve such matter in accordance with the intent of this Terms of Use.本規約の解釈及び適用にあたっては日本法を適用する。本規約に定めのない事項又は本規約の各条項に関する解釈上の疑義については、本規約の趣旨に従い、PFN及びユーザにおいて誠意をもって協議し、解決を図る。
10. PFNPFN及びユーザは、Omega and User agree that for all disputes arising in relation to or as a result of the Omega Crafter or this Terms of Use, the Tokyo District Court shall be the exclusive court of competent jurisdiction for the first hearing.
11. This English version of Terms of Use is an English translation of the Japanese version. If there is a conflict between them, the Japanese version will take precedence.Crafter又は本規約に関連又は起因して生じた一切の紛争については、東京地方裁判所を第一審の専属的管轄裁判所とすることに合意する。

                “Intellectual Property Rights” collectively shall refer to the following: 
                「知的財産権」とは、次に定めるものを総称していう。
                <br>①

                Crafter及びそれに関連する一切の知的財産権は、PFN又はPFNにその許諾を行う者に帰属する。Omega

                Users

                <br>7.

                ユーザは、自らが反社会的勢力（暴力団員による不当な行為の防止等に関する法律（平成三年法律第七十七号（その後の改正を含む。）第2条第2号に定める暴力団、同第6号に定める暴力団員、暴力団準構成員、暴力団関係企業、総会屋、社会運動標榜ゴロ、特殊知能暴力集団等その他暴力、威力又は詐欺的手法を駆使して経済的利益を追求する集団又は個人をいう。以下同じ。）でないこと、反社会的勢力でなかったこと、反社会的勢力を利用しないこと、反社会的勢力を名乗るなどしてPFNの名誉又は信用を毀損し、業務の妨害を行い又は不当要求行為をなさないこと、及び反社会的勢力と関係しないことを表明し保証する。
