Summary:
These are the (legally binding) rules for accessing and playing Nobody Wants to Die and any related downloadable content (hereinafter referred to as the “Game”). You should have a read of this full EULA, but we draw your attention in particular to the following:

Estas son las normas (legalmente vinculantes) para acceder y jugar a Nobody Wants to Die y a cualquier contenido descargable relacionado (en adelante, «el Juego»). Si bien le recomendamos que lea este ALUF por completo, queremos llamar su atención especialmente sobre los siguientes aspectos:

Rules. There are rules (and consequences) regarding what you can and cannot do with Game – please take a look at section 8 which covers this topic. Please note if you break the rules you may be suspended or banned from playing Game, and will lose access to the Game, any DLC and any in-game purchases.
Betas. Game may sometimes release content on a ‘alpha’, ‘beta’ or ‘Early Access’ basis – these may contain bugs and require server / progress resets. For more information on this, please take a look at section 10.
User-Generated Content. You are responsible for making sure any user-generated content you create complies with this EULA and any applicable law. You grant a licence for us to use your UGC as part of the Game, which may be revoked in certain circumstances. Please see section 7 for more information.
Disputes. There are rules and limitations on our liability to you and dispute resolution (including indemnity obligations for those outside the United Kingdom and European Union). For more details, please see sections 17, 18, 19 and 23.

1.	ABOUT THIS EULA

Normas. Aquí se recogen las normas (y las consecuencias) sobre lo que puede y no puede hacer con el Juego. Diríjase al apartado 8, donde se trata ese tema. Tenga en cuenta que si incumple las normas, se le puede suspender o prohibir jugar al Juego, perdiendo el acceso al Juego, cualquier contenido descargable relacionado y cualquier compra dentro del Juego.
Betas. En ocasiones, el Juego puede lanzar contenido en versiones «alpha», «beta» o «de acceso anticipado» que puede contener fallos y exigir reconfiguraciones del servidor o del progreso. Para más información al respecto, diríjase al apartado 10.
Contenido generado por el usuario. Usted es responsable de garantizar que cualquier contenido generado por el usuario cumpla con este ALUF y cualquier ley aplicable. Usted nos concede una licencia para utilizar su contenido generado por el usuario como parte del Juego, la cual puede revocarse en determinadas circunstancias. Consulte el apartado 7 para más información.
Controversias. Aquí se incluyen las disposiciones y limitaciones de nuestra responsabilidad ante usted y la solución de controversias (incluidas las obligaciones de indemnización para los residentes fuera del Reino Unido y la Unión Europea). 1.	SOBRE ESTE ALUF

This End User License Agreement, as amended from time to time (hereinafter referred to as  “EULA”), set forth the terms and govern your use of the Game or parts, components and/or single features thereof , or other products (real and/or virtual) and/or services connected to the Game (including any Ingame Assets) (collectively, “Services”) offered by PLAION GmbH, Embracer Platz 1, A-6604 Hoefen, Austria (hereinafter referred to as “PLAION”). 

El presente Acuerdo de Licencia de Usuario Final, y las modificaciones que se puedan hacer sobre él, (en adelante, «ALUF»), establecen las condiciones y rigen su uso del Juego o de sus diferentes partes, componentes y/o funciones, u otros productos (reales y/o virtuales) y/o servicios relacionados con el Juego (incluido cualquier Elemento del juego) (de forma colectiva, «los Servicios») que ofrece PLAION GmbH, sociedad que tiene su domicilio social en Embracer Platz 1, A-6604 Hoefen, Austria (en adelante, «PLAION»). 

Please read this EULA carefully, as this EULA is a legal document stating your rights and obligations in connection with the use of our Game, including any services you access through the Game and any purchases you make through the Game. By accepting the EULA you agree to be bound by these terms.

Le recomendamos que lea este ALUF con detenimiento, pues constituye un documento legal que establece sus derechos y obligaciones con respecto a su uso de nuestro Juego, lo que incluye los servicios a los que usted accede a través del Juego y cualquier compra que usted realice a través del propio Juego. The Game and any files enabling you to play or perform updates either online or offline including packaging, manuals, etc. (hereinafter called “Materials”) and all works derived from the Game and these Materials are both protected by law, including, without limitation, copyright and trademark law. Use of the Game shall be subject to the terms of this EULA. The Game shall be distributed and rented exclusively by authorized traders and shall be used solely for private purposes. Any use, reproduction or redistribution of the Game not expressly authorized hereunder shall be expressly prohibited.

2.	ACCEPTANCE OF TERMS

Before downloading, installing, accessing and/or using the Game please go through the following EULA precisely. The EULA is an electronic agreement that sets out the legally binding terms of your use of the Game. When you use the Game you acknowledge and agree that you (i) are at least 15 years old (or such other minimum age as is applicable for such an agreement in your country of residence) – if you are between 15 and 18 years old, please speak to your parent / guardian about reviewing this EULA; (ii) have the full legal right, authority and capacity to enter into this EULA; and (iii) have read, understand and agree to be bound by the terms of this EULA. If you do not agree to this EULA, please do not use the Game and/or Services.

Antes de descargar, instalar, iniciar el acceso y/o usar el Juego, es recomendable que revise detenidamente el ALUF. El ALUF es un acuerdo electrónico que establece las condiciones legalmente vinculantes para su uso del Juego. Cuando usted utiliza el Juego, reconoce y confirma: i) tener como mínimo 15 años, o la edad mínima requerida en su país de residencia para celebrar este tipo de acuerdos (si tiene entre 15 y 18 años, deberá pedir a uno de sus progenitores o tutor legal que revise este ALUF); ii) estar facultado y tener la autoridad y capacidad para formalizar este ALUF; y iii) haber leído y entendido y estar de acuerdo para regirse por las disposiciones de este ALUF. Si no acepta este ALUF, deberá abstenerse de utilizar el Juego y/o los Servicios.

THESE TERMS ARE ONLY APPLICABLE FOR THE USE OF THE GAME. FOR OTHER SERVICES; PRODUCTS OR GAMES THAT ARE OFFERED BY PLAION OR BY THIRD PARTIES, OTHER SPECIFIC END USER LICENSE AGREEMENTS MAY APPLY ADDITIONALLY.

ESTAS CONDICIONES SOLO SE APLICAN AL USO DEL JUEGO. EN LO QUE SE REFIERE A OTROS SERVICIOS, PRODUCTOS O JUEGOS OFRECIDOS POR PLAION U OTROS TERCEROS, PODRÁN APLICARSE ADICIONALMENTE OTROS ACUERDOS DE LICENCIA DE USUARIO FINAL ESPECÍFICOS.

3.	PAYMENT OPTIONS

You may pay fees using the methods available for the Services and you agree to the terms and conditions applicable to each payment method you choose. Payment methods may vary. When you provide credit card or other payment information to PLAION and/or its payment providers, you represent to PLAION and/or its payment providers that you are the authorized user of the credit card or other payment method. You must provide current, complete, and accurate information for your billing account. You must promptly update all information to keep your billing account current, complete, and accurate (such as a change in billing address, credit card number, or credit card expiration date), and you must promptly notify PLAION and/or its payment providers if your credit card is canceled (for example, for loss or theft). Changes to such information can be made by contacting PLAION’s or the payment provider’s customer service (as applicable). PLAION reserves the right to utilize third party credit card updating services to obtain current expiration dates on credit cards provided by you. As the account holder, you are responsible for all usages all charges incurred, including applicable taxes, and all purchases made by you or anyone that uses your account, including your family or friends. We may provide links to other websites. Some of these web sites may charge separate fees which are not included in any fees that you may pay to PLAION. Any separate charges or obligations that you incur in your dealings with third parties are your responsibility.

Cualquier pago podrá hacerlo a través de los métodos disponibles para los Servicios y, por este acto, acepta los términos y condiciones aplicables a cada método de pago que elija. Los métodos de pago pueden variar. Al facilitar los datos de su tarjeta de crédito o de otro método de pago a PLAION y/o sus proveedores de pago, manifiesta ante estos que usted es el usuario autorizado de la tarjeta de crédito o del método de pago elegido por usted. Se compromete a proporcionar datos actuales, completos y precisos sobre su cuenta de facturación. Asimismo, debe mantener en todo momento su cuenta de facturación al corriente de modo que los datos estén siempre actualizados, completos y precisos (por ejemplo, si se produce algún cambio en la dirección de facturación, número de tarjeta de crédito o fecha de caducidad de la tarjeta de crédito), debiendo notificar a PLAION y/o sus proveedores de pago en el caso de que su tarjeta de crédito sea cancelada (por ejemplo, por pérdida o robo). Para comunicar cualquier cambio en los datos de facturación, deberá contactar con el servicio de atención al cliente de PLAION o del proveedor de pago (según corresponda). PLAION se reserva el derecho para utilizar los servicios de actualización de tarjetas de crédito de terceros para obtener las fechas de caducidad actualizadas de las tarjetas de crédito que usted proporcione. Como titular de una cuenta, usted es responsable de todos los gastos, incluidos los impuestos aplicables, así como de todas las compras que usted o un tercero (inclusive familiares o amigos) realicen a través de su cuenta. Podemos proporcionar enlaces a otros sitios web. Algunos de estos sitios pueden cobrar precios independientes que no se recojan en los precios que pague a PLAION. Todos los cargos y obligaciones independientes que deriven de operaciones que usted realice con terceros serán responsabilidad de usted.

4.	RIGHT OF USE

By purchasing this Game and subject to the User Requirements (section 8) below, PLAION grants to you a non-exclusive, non-sublicensable, non-transferable, non-assignable, terminable and revocable personal right to install and use the Game on one computer / console. Any other use without PLAION’s prior consent is prohibited. Using the Game is solely intended for your personal, non-commercial use in accordance with this EULA. The creation of backup copies is only allowed within the scope of legal regulations. 

Cuando usted adquiere el Juego y acepta las Obligaciones del usuario (especificadas en el apartado 8), PLAION le concede un derecho personal no exclusivo, no sublicenciable, no transferible, no cedible, cancelable y revocable para instalar y utilizar el Juego en un ordenador/consola. Se prohíbe cualquier otro uso sin el consentimiento previo de PLAION. Solo se prevé un uso personal, no comercial, del Juego de acuerdo con este ALUF. La creación de copias de seguridad únicamente se permitirá dentro del alcance de las disposiciones legales. 

With regard to Games purchased from retailers on original media (e.g., on CD-ROM, DVD, Blu ray etc.) you may permanently transfer all of your rights and obligations related to the use of a Game under this Agreement to another person who agrees to the terms of this EULA by physically transferring the original media, original packaging, and all manuals or other documentation distributed with the Game provided that you permanently delete all copies and installations of the Game in your possession or control. You agree to be solely responsible for any taxes, fees, charges, duties, withholdings, assessments, and similar charges, together with any interest, penalties, and additions imposed in connection with such transfer. Other than as set forth above, PLAION does not recognize any purported transfer of the Games.

Por lo que respecta a los Juegos que haya adquirido a través de comercios en soportes originales (p. ej., CD-ROM, DVD, Blu-ray, etc.), usted podrá transferir de forma permanente todos sus derechos y obligaciones en relación con el uso de un Juego en virtud de este ALUF a otra persona que acepte las disposiciones del ALUF, para cuyo fin deberá transferir el soporte y el material de embalaje físicos originales, así como todos los manuales y otros documentos que acompañen al Juego, siempre que usted elimine de forma permanente la totalidad de copias e instalaciones del Juego que estén en su posesión o bajo su control. Usted acuerda ser el único responsable de los posibles impuestos, gastos, costes, derechos, retenciones, liquidaciones y cargos similares, además de cualesquiera intereses, sanciones y otros añadidos que puedan imponerse en relación con dicha transferencia. Con excepción de la transferencia detallada anteriormente, PLAION no contempla ningún otro tipo de transferencia de los Juegos.

Except as expressly authorized in this EULA, any use of any portion of the Game without our prior written permission is strictly prohibited and constitutes an immediate termination of the license granted herein. Any such unauthorized use may also violate applicable laws, including civil laws (particularly, copyright and trademark laws) and criminal laws, applicable communications regulations and statutes, and similar regulations. Except as expressly stated herein, nothing in this EULA shall be construed as conferring any license or intellectual property rights, whether by estoppel, implication or otherwise. 

A menos que se autorice de forma expresa en este ALUF, se prohíbe terminantemente cualquier uso de cualquier parte del Juego para el que no se haya obtenido nuestro consentimiento previo por escrito y, de producirse, supondrá la cancelación inmediata de la licencia concedida por este ALUF. Todo uso no autorizado de este tipo podrá infringir además las leyes aplicables, tanto en materia civil (en concreto, relativas a derechos de autor y marcas comerciales) como penal, normativas y leyes de comunicaciones aplicables y otros reglamentos similares. Salvo que se indique específicamente en este documento, ninguna disposición de este ALUF deberá interpretarse en el sentido de conferir una licencia o derechos de propiedad intelectual, ya sea por inferencia, exclusión o de otro modo. 

Unauthorized duplication of the Game is a criminal offence and can be punished with a fine, depending on the legislation the user is subject to. Any person who duplicates, distributes or publicly reproduces the Game without permission in any way, or assists another person in doing so, is liable to prosecution. Copied media duplicated without permission may be confiscated by the prosecutor’s office and destroyed.

La duplicación de copias no autorizadas del Juego se considerará un delito penal que puede ser sancionada con el pago de una multa, en función de la legislación aplicable al usuario. Toda persona que haga copias, distribuya o reproduzca públicamente el Juego sin ningún tipo de permiso, o que ayude a un tercero a hacerlo, será susceptible de ser procesada. Los medios copiados que se dupliquen sin permiso podrán ser confiscados por orden de la fiscalía y posteriormente destruidos.

In the event of violation of this EULA, in order to protect our intellectual property, PLAION expressly reserves the right to take all legal measures that it is legally entitled to for the protection of its intellectual property. 

En caso de infringirse el presente ALUF, con vistas a proteger nuestra propiedad intelectual, PLAION se reserva expresamente el derecho a adoptar todas las medidas legales que le correspondan para proteger su propiedad intelectual. 

This license is subject to this EULA and is conditioned upon your agreement with its contents, including, without limitation, the User Requirements below.
5.	PROPRIETARY AND INTELLECTUAL PROPERTY RIGHTS

Esta licencia está supeditada a las disposiciones de este ALUF y a la aceptación por su parte de su contenido, que incluye, entre otro, las Obligaciones del usuario que se especifican más adelante.

All proprietary and intellectual property rights in relation to the Game and Services is the property of PLAION or its licensors. The product is protected by national and international laws, copyright treaties and agreements and other laws. Any reproduction or reproduction of these Materials without the prior approval of PLAION is prohibited. Except as expressly provided in this EULA, all rights are expressly reserved by PLAION.

5.	DERECHOS DE PROPIEDAD Y SOBRE LA PROPIEDAD INTELECTUAL

6.	VIRTUAL INGAME ASSETS

Todos los derechos de propiedad y sobre la propiedad intelectual en relación con el Juego y los Servicios corresponden a PLAION o a sus licenciantes. El producto está protegido por leyes nacionales e internacionales, tratados y acuerdos de derechos de autor y otras leyes. Se prohíbe cualquier uso de estos Materiales, sin la autorización por escrito de PLAION. Salvo que se disponga otra cosa de forma expresa en este ALUF, PLAION se reserva específicamente el conjunto de derechos.

When using the Game you may purchase virtual ingame assets, including, without limitation, weapons, objects, artifacts, currency, items, equipment, and/or other value or status indicators the Game to speed up gameplay and progress in the Game by spending real money (“Ingame Assets”). All Ingame Assets exist on servers only as data. Ingame Assets cannot be exchanged into real money. You understand that you do not own Ingame Assets, but acquire a limited license to use Ingame Assets according to the Game’s gameplay. You acknowledge and agree that such Ingame Assets are accumulated as part of your account and therefore you shall have no ownership or other property interest in any Ingame Assets. PLAION does not provide or guarantee, and expressly disclaims any value, cash or otherwise, real or virtual, attributed to any data residing on servers operated by PLAION, including without limitation the Ingame assets associated with your account. Some Ingame Assets may be usable across different platforms of the Game where you own copies of the Game on those platforms. 

6.	ELEMENTOS VIRTUALES DEL JUEGO

You further acknowledge and agree that PLAION has the right, but not the obligation, to delete, alter, move, remove, or transfer any and all free Ingame Assets, in whole or in part, at any time and for any reason, with or without notice to you, and with no liability of any kind to you. For any paid-for Ingame Assets, we may delete, alter, move, remove or transfer them, in whole or in part, at any time to address a legal, regulatory and/or security issue, or to reflect changes in our business practices or operations. If this happens where the paid-for Ingame Asset has already been purchased by you, then you may be entitled to a full or partial refund.

Durante el uso del Juego, podrá adquirir elementos virtuales en el propio juego, entre otros, armas, objetos, artefactos, divisas, artículos, equipos y/u otros indicadores de valor o estado dentro del Juego que le permitirán avanzar y progresar en el desarrollo del Juego empleando dinero real («Elementos del juego»). La totalidad de Elementos del juego aparecen en los servidores solo como datos. Los Elementos del juego no pueden intercambiarse por dinero real. Usted asume que no será titular de Elementos del juego, sino que adquirirá una licencia limitada para hacer uso de determinados Elementos del juego según su evolución en el Juego. Asimismo acepta y entiende que los Elementos del juego se acumulan como parte de su cuenta y que, por consiguiente, no le corresponderá la titularidad ni ningún otro interés de propiedad en los Elementos del juego. PLAION no contempla ni garantiza, y de forma expresa rechaza cualquier valor, en efectivo o de otro tipo, real o virtual, que pueda atribuirse a cualquier dato recogido en los servidores que opera PLAION, incluidos, entre otros, los Elementos del juego asociados a su cuenta. Algunos Elementos del juego pueden usarse por diferentes plataformas del Juego cuando tenga copias del Juego en dichas plataformas. 

The sale or transfer of items of Ingame Assets or virtual currency between users may only be conducted via services approved of and provided by PLAION, if any, and PLAION may terminate any account that acts in contravention of this prohibition.

Asimismo reconoce y acepta que PLAION tiene derecho, sin estar obligado a ello, a eliminar, modificar, trasladar, retirar o transferir la totalidad o parte de todos y cada uno de los Elementos del juego en cualquier momento y por cualquier razón, sin que tenga la obligación de notificárselo a usted y sin ningún tipo de responsabilidad ante usted. Con respecto a cualquier Elemento del juego que sea de pago, podremos eliminar, modificar, trasladar, retirar o transferir cualquiera de ellos, en su totalidad o en parte, en cualquier momento, bien para responder a cualquier cuestión legal, reglamentaria y/o de seguridad o para reflejar cambios en nuestras prácticas u operaciones empresariales. Si esto ocurriera, y usted ya hubiera adquirido con anterioridad el Elemento del juego de pago en cuestión, tendrá derecho a un reembolso total o parcial.

INGAME ASSETS ARE PAYABLE IN ADVANCE AND ARE NOT REFUNDABLE IN WHOLE OR IN PART. We may offer the ability to users to create, modify, design, upload, embellish, or otherwise alter objects or other elements (“User Generated Content” or “UGC”).

PLAION grants to you a non-exclusive, worldwide, non-transferable, revocable, non-sublicensable right and licence to use certain modkits (for example, a mask modkit) in order for you to create UGC, subject to the terms of this EULA and any further terms notified to you from time to time.

To the extent permitted by applicable laws, you hereby waive any moral rights and rental rights you may have in the UGC you submit. You also grant each user of the Game a non-exclusive license to access your UGC as permitted through the functionality of the Game and under this EULA. If this EULA is terminated, PLAION may continue to use your UGC as set out in this section in certain circumstances (for example, where your UGC has no utility outside the Game, it has been aggregated with other UGC or the Game, or if it was jointly created with another user).

Although our Game and its content can be used to provide you with access to UGC, neither this EULA nor your use of any UGC override the UGC owners’ requirements and restrictions.

By making UGC available through our Game, you represent that: (i) you have the right to create and/or provide and/or post and such content, or its use by us as contemplated in this EULA, does not violate this EULA, applicable law or third party rights (including, without limitation, intellectual rights and personal rights); (ii) the UGC is not defamatory, libelous, false, obscene or offensive; and (iii) the UGC is consistent with all age ratings for the Game. You agree and acknowledge that we cannot control each UGC, nor can we verify the accuracy, correctness or authenticity of the UGC provided. We do not assume any responsibility for any UGC or responsibility for any loss of or damage to any to any UGC made available by you or any third party in connection with the Game. We do not actively monitor, nor are we in any way responsible for, the content of any UGC.

8.	USER REQUIREMENTS

PLAION may suspend or revoke your license to use the Game and/or Services if you violate, or assist others in violating, the points set forth below. You agree that you will not, in whole or in part or under any circumstances, do the following:

Copy or reproduce, translate, reverse engineer, derive source code from, modify, disassemble, decompile display or distribute any part of the Game or other Services in any medium, or create derivative works based on or related to the Game and its contents.
Alter or modify or attempt to alter or modify any part of the Game or other Services.
Use the Game or other Services in connection with surveys, contests, pyramid schemes, chain letters, junk email, spamming or any duplicative or unsolicited messages (commercial or otherwise).
Use any unauthorized process or software that intercepts, collects, reads, or “mines” information generated or stored by the Game or other Services.
Publish, post, upload, transmit, distribute or disseminate content that is beyond the acceptable level of content PLAION has set for its Games and Services such as content that is illegal, harmful, abusive, threatening, harassing, vulgar, distasteful, sexually explicit, political, libelous, defamatory, obscene, embarrassing, unwanted, rude, hateful or racially, ethnically, sexually, or, in a reasonable person’s view, otherwise offensive or objectionable, or encourage others to do so.
Use, upload, transmit, distribute or otherwise make available any material or information, which contain any materials that could infringe any copyright, trademark, patent, trade secret, publicity or privacy right or any other proprietary right or disclose any trade secret of or violate any confidential obligation of any person or entity, unless you have first received permission from the owner of those rights to use the materials in this manner.
Use the Game or other Services in any manner that could damage, disable, overburden, or impair any PLAION server, or the network(s) connected to any PLAION server, or interfere with any other party’s use and enjoyment of the Game.
Take any action to interfere with, interrupt, destroy or limit the functionality of the Game or other Services, or any computer software or hardware or telecommunications equipment.
Upload files that contain viruses, trojan horses, worms, time bombs, cancel bots, corrupted files or data, or any other similar software or programs that may damage the operation of the Game or other Services or other users’ computers.
Restrict or inhibit the use of the Game or other Services by other users in any way (for example, by running programs directed against the website, reverse engineering APIs, harassment, targeted computer attacks, unauthorized modification of the website, etc.).
Attempt to gain unauthorized access to the Game or other Services, computer systems or networks connected to any PLAION server or to any game and/or third party site, through hacking, cracking, distribution of counterfeit software, password mining or any other means.
Use the Game or other Services for fraudulent transactions or other criminal means.
Use, develop or distribute “auto” software programs, “macro” software programs, prohibited robots, spiders or other “cheat utility” software program or applications.
Use any automated devices, such as spiders, robots or data mining techniques to catalog, download, store or otherwise reproduce, store or distribute content available on the Service or to manipulate the Game or other Services and/or a third party site in any manner not consistent with its or their intended purpose(s).
Obtain or attempt to obtain any materials or information through any means not intentionally made available through the Game or other Services.
Advertise or offer to sell or buy any goods or services for any purpose.
Falsify, delete or disable any copyright management information, such as author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded.
Impersonate or create a false identity (such as a celebrity or PLAION representative) for the purpose of misleading others.
Use, download or otherwise copy, or provide (whether or not for a fee) to a person or entity any directory of users or other user or usage information or any portion thereof.
Improperly use support or complaint buttons or make false reports to PLAION administrators.
Use a bulletin board or other communications service in any manner other than for personal communication as an individual user (i.e. not as a corporation or other entity).
Exploit, distribute or publicly communicate any error, miscue or bug which gives an unintended advantage.
Sell, buy, or transfer access to your account.
Maintain more than one account.
Use the Game or other Services to violate any applicable law or regulation.
Encourage or assist anyone else to commit any of the foregoing violations.

Please note that PLAION has adopted and operates a zero tolerance policy. If any such aforementioned behavior is detected, your access to our Games or Services may be terminated with or without additional notice to you.

The Game may be protected by technical protection measures and digital rights management, including, without limitation, physical protection, tattooing (watermarking), digital keys and online activation. A broadband internet connection and the creation of a Nebula account will be necessary to access the Game, including the online functions.

In its sole discretion, PLAION may contact you to propose that you review and evaluate one or more games, aspects of games, online features or any services prior to commercial release for the purpose of identifying program errors and bugs and/or improve their functioning (“Beta Test”).

In connection with the Beta Test, PLAION may provide you, on a temporary basis, a pre-release copy of a game or access to a feature on the PLAION site. You understand and agree that the pre-release copy and all other materials provided to you are confidential or proprietary information of PLAION. “Confidential Information” shall mean any information designated as confidential, any information relating to PLAION’s products, plans, product designs, product costs, product prices, product names, personnel, research, development, know-how and/or source codes, including without limitation its underlying logic and concepts. You shall use Confidential Information solely to the limited extent necessary for the Beta Test. You shall prevent and not allow any Confidential Information to be disclosed, used, sold, assigned, leased, sub-licensed, commercially exploited or marketed in any way or manner. At the earlier of (a) the end of the Beta Test (b) the date that PLAION requests you to return or destroy the Confidential Information you shall immediately discontinue the use of the Confidential Information and return the Confidential Information and all copies thereof in all material forms to PLAION. Notwithstanding the completion of the Beta Test, Confidential Information shall remain confidential in perpetuity. You agree as a condition of participating in a Beta Test to (i) not copy or reproduce the pre-release copy and confidential or proprietary information, (ii) safeguard the pre-release copy and confidential and proprietary information and prevent unauthorized access to, reproduction of, disclosure of and/or unauthorized use of, the pre-release copy and confidential and proprietary information, and (iii) fully comply with the terms and conditions of the Confidentiality EULA.

You must perform the Beta Test personally and must not provide access to pre-release materials to any other person. You will be asked to inform PLAION of your reactions and suggestions following your experience of the games, game elements, content, features and/or services in the Beta Test – please review section 11 (Feedback) for more information on this.

Your obligation to keep the Services and features provided or given access to for the Beta Test confidential until PLAION publicly distributes, or has otherwise disclosed to the public through no fault of yours, each of the Services and the features that you are testing.

Nothing in these guidelines, or on this site, shall be construed as granting you any rights or privileges of any kind with respect to the beta service or content that you find here. Subject to section 18, the Beta Test is provided for testing on an “as is” and “as available” basis and we make no warranty to you of any kind, express or implied. When testing a Beta Test, you may accumulate treasure, experience points, equipment, or other value or status indicators. This data may be reset at any time during the testing process, and it may be reset when the particular Service completes a testing phase. In this case, all player history and data will be erased and each player will return to novice status. You explicitly agree that: (i) participating in a Beta Test is at your own risk and you know that the Game may include known or unknown bugs, (ii) any value or status indicators that you achieve may be erased at any time, (iii) PLAION has no obligation to make these services available without charge for any period of time, nor to make them available at all, (iv) these services may be available only by subscription once the Beta Test process is complete or at any time in the future; (v) this EULA applies to your use of the Services during the Beta Test, and (vi) if it is a closed Beta Test, you will keep all information about the beta Services confidential as stated above and not disclose such information to any other person. Beta Test accounts are non-transferable under any circumstances.

All comments, feedback, suggestions, ideas, criticisms and other data passed on, disclosed or offered to PLAION in the course of the Beta Tests, or more generally in the course of use of the Game or Services, will be exclusively licensed to PLAION on a royalty-free, worldwide, perpetual, irrevocable, sublicensable and transferable basis. You therefore agree not to make your feedback accessible by any means or process to any outside party other than PLAION. You acknowledge that, unless prohibited from doing so under the applicable legislation, PLAION may use, perform, publicly display, reproduce, sell, promote or otherwise exploit the feedback in any way, without restriction and without compensation to you.

Because PLAION has no control over any third party sites and resources, you acknowledge and agree PLAION is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products or other materials available from such sites or resources nor does PLAION endorse any such sites or the products or services assessable on such sites. You further acknowledge and agree that PLAION shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any content, goods or services available on or through any such third party sites or resource(s).

When you play a video game requiring connection to a screen, play at a good distance from the screen and as far away as the connection lead allows. Subject to section 18 below, because of its complex nature, software can never be expected to be completely error-free. Therefore, PLAION cannot guarantee that the contents of the Game will meet your expectations, and that the Game will run glitch-free under any possible conditions. Moreover, PLAION assumes no warranty for specific functions and results of this Game in excess of the current minimum standard of software technology at the time the Game was created. The same applies to the accuracy and/or completeness of the accompanying documentation.

PLAION assumes no further warranties for any direct or indirect damages resulting from the use of the product, unless these damages were caused through malicious intent or gross negligence, or such a warranty is compulsory by law. 
 
In any case, the amount of the warranty is restricted to the purchase price of the Game. Under no circumstances will PLAION assume warranty for any unforeseeable or non-typical damages. Any claims you may have against the distributor where you purchased the Game are not affected by this.

IF YOU ARE DISSATISFIED WITH ANY OF THE CONTENT AND/OR MATERIALS CONTAINED IN THE SERVICES OR WITH ANY OF THESE TERMS, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE ACCESSING AND USING THE SERVICES AND/OR DELETING YOUR ACCOUNT.

FURTHERMORE, PLAION WILL NOT BE LIABLE IN ANY MANNER FOR THE DESTRUCTION, DELETION, MODIFICATION, IMPAIRMENT, “HACKING,” OR ANY OTHER DAMAGE OR LOSS OF ANY KIND CAUSED TO THE GAME OR INGAME ASSETS, INCLUDING, BUT NOT LIMITED TO, THE DELETION OF VIRTUAL CURRENCY AND/OR INVENTORY UPON THE TERMINATION OR EXPIRATION OF YOUR ACCOUNT, OR DISCONTINUATION OF THE GAME OR SERVICES.

To the maximum extent permitted by applicable law, in no event will PLAION or its affiliates and subsidiaries be liable to you (or any third party making claims through you) for any damages whatsoever, including but not limited to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data, or other intangibles, or the cost of procurement of substitute goods or services, unauthorized access to and/or tampering with your personal information or transmissions, arising out of or related to the use, inability to use, unauthorized use, performance, or nonperformance of the services, even if PLAION has been advised previously of the possibility of such damages and whether such claims of damages may have been sustained anywhere in the world in contract, negligence, tort, under statute, in equity, at law, or otherwise. Unless limited or modified by applicable law, the foregoing disclaimers, waivers and limitations shall apply to the maximum extent permitted, even if any remedy fails its essential purpose. Moreover, under no circumstances will PLAION, its licensors or licensees, be held liable for any delay or failure in performance resulting directly or indirectly from an act of force majeure or causes beyond its or their reasonable control. PLAION may change or delete content or features in the services in any way, at any time and for any reason or no reason. The limitations, exclusions and disclaimers in this section and elsewhere in these terms apply to the maximum extent permitted by applicable law.

(a) This section applies to you if you are resident in the United Kingdom or European Union. If you are resident in the United States of America or other non-UK/EU territory, please see section 17 above.

(b) PLAION does not exclude or limit (or seek to exclude or limit) our liability to you where it would be unlawful to do so. This includes our liability for:
•	death or personal injury caused by our negligence (or the negligence of our employees, agents or subcontractors);
•	fraud or fraudulent misrepresentation;
•	breach of your statutory rights as a consumer; or
•	other liability which may not be excluded by applicable law.

PLAION, a su exclusiva discreción, podrán contactar con usted para proponerle que revise y evalúe uno o más juegos, aspectos de juegos, funciones en línea u otros servicios antes de su lanzamiento comercial con el fin de identificar posibles errores y fallos en el programa y/o mejorar su funcionamiento (en adelante, «Prueba beta»).

(c) We only supply the Game and Services for domestic and private use. If you use the Game or Services for any commercial, business or re-sale purposes we will have no liability to you for any loss of profits, loss of business, business interruption or loss of business opportunity.

En el caso de que usted acceda a realizar Pruebas beta, deberá firmar un ALUF de confidencialidad de prueba beta («ALUF de confidencialidad») sobre cada Prueba beta específica y devolvérselo a PLAION ANTES de que se le suministre o se le facilite el acceso a cualquier programa o función.

(d) If we fail to comply with this EULA, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this EULA, or our failure to use reasonable care and skill. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the EULA was agreed to, both we and you knew it might happen. We are not responsible for any loss or damage that is not foreseeable.

En relación con la Prueba beta, PLAION podrán proporcionarle, temporalmente, una copia previa al lanzamiento de un juego o acceso a una función del sitio de PLAION. Usted entiende y acepta que la copia y todos los demás materiales que se le proporcionen antes del lanzamiento comercial son confidenciales, y que la información contenida en ellos es propiedad de PLAION. Por «Información confidencial» se entiende toda la información que se identifique como tal, así como la información que haga referencia a productos, planes y diseños, costes, precios y nombres de productos, equipo humano, estudios, desarrollos, conocimientos técnicos y/o códigos fuente de PLAION, incluida, sin limitación, su lógica y conceptos subyacentes. Usted solo podrá usar la Información confidencial con el alcance limitado necesario para realizar una Prueba beta. Deberá evitar y no permitir la revelación, el uso, la venta, la cesión, el alquiler, la concesión de sublicencias, la explotación comercial o la comercialización, de cualquier forma y por cualquier medio, de la Información confidencial. En el momento en que ocurra la primera de las dos circunstancias siguientes: a) la finalización de la Prueba beta, o b) el vencimiento de la fecha establecida por PLAION para que devuelva o destruya la Información confidencial, deberá interrumpir de forma inmediata su uso de la Información confidencial y devolverla a PLAION junto con todas las copias que conserve de la misma, en todas sus formas materiales. Al margen de la finalización de la Prueba beta, la Información confidencial seguirá siendo confidencial de forma permanente. Como requisito para participar en una Prueba beta, usted acepta: i) no copiar ni reproducir la copia previa al lanzamiento y la información confidencial o privilegiada; ii) salvaguardar la copia previa al lanzamiento y la información confidencial o privilegiada, y evitar el acceso no autorizado, la reproducción, la revelación y/o el uso no autorizado de la copia previa al lanzamiento y de la información confidencial o privilegiada; y iii) cumplir de forma íntegra con las condiciones del ALUF de confidencialidad.

(e) If the Game or Services damage a device or digital content belonging to you, and this is caused by our failure to use reasonable care and skill, we will either repair the damage or pay you compensation. However, we will not be liable for damage which you could have avoided by following our advice to apply an update offered to you free of charge or for damage which was caused by you failing to correctly follow installation instructions or have in place the advised minimum technical requirements.

La Prueba beta debe realizarla usted mismo de forma exclusiva, y no podrá ofrecer acceso a ninguna otra persona sobre los materiales previos al lanzamiento. Tras su experiencia con los juegos, elementos del juego, contenidos, funciones y/o servicios en la Prueba beta, deberá comunicar sus reacciones y sugerencias a PLAION. Consulte el apartado 11 (Comentarios) para más información. 

(f) Subject always to (a) – (e). above: (i) the total liability of PLAION group companies) arising out of or in connection with this EULA will not exceed the total amount you have paid to us under this EULA during the twelve (12) months immediately prior to the event which caused the liability; and (ii) the Game and Services are provided on an “as is” basis and we make no specific warranty or representation in relation to the quality, completeness or accuracy of the Game or Services.

Usted asume que el incumplimiento de las obligaciones anteriores provocaría un daño irreparable a PLAION, y que PLAION tienen derecho (con carácter adicional a otros recursos que tengan a su disposición) a solicitar medidas cautelares de forma unilateral sin fianza para evitar el incumplimiento o un posible incumplimiento de sus obligaciones. Está obligado a mantener en confidencialidad los Servicios y las funciones que se le proporcionen o sobre los que se les dé acceso para realizar la Prueba beta hasta que PLAION distribuyan públicamente o den a conocer de otra forma al público cada uno de los Servicios y funciones que usted está probando, sin que esta revelación esté motivada por alguna incorrección por su parte.

19.	INDEMNITY (NOT APPLICABLE TO USERS IN THE EUROPEAN UNION AND UNITED KINGDOM)

A petición, usted acepta devolver de forma inmediata a PLAION todos los duplicados de la copia previa al lanzamiento y de la información confidencial y privilegiada que PLAION le hayan facilitado. A usted se le ha invitado a probar los Servicios antes de su lanzamiento con el único fin de evaluar la funcionalidad e identificar errores. Ninguna disposición aquí contenida, o en este sitio, deberá interpretarse en el sentido de que a usted se le conceden derechos o privilegios de ningún tipo con respecto al servicio beta o el contenido que usted encuentre en él. En virtud del apartado 18, la Prueba beta se le ofrece tal cual y según disponibilidad para que usted pueda hacer pruebas, sin ningún tipo de garantía, expresa o tácita, por nuestra parte. Cuando usted realice la Prueba beta, podrá acumular tesoros, puntos de experiencia, equipos u otros indicadores de valor o estado, los cuales podrán restablecerse en cualquier momento durante el proceso de la prueba, y también cuando el correspondiente Servicio complete la fase de prueba. En este caso, se borrará todo el historial de jugador y los datos asociados, de manera que cada jugador regresará a su estado inicial desde cero. Usted acepta de forma explícita que: i) la participación en una Prueba beta será bajo su propio riesgo, y asume que el Juego puede contener fallos conocidos o desconocidos; ii) cualquier indicador de valor o estado que usted logre podrá borrarse en cualquier momento; iii) PLAION no tienen ninguna obligación de ofrecer estos servicios sin coste durante un período de tiempo, ni siquiera de ofrecerlos en absoluto; iv) es posible que estos servicios solo se ofrezcan por suscripción una vez que el proceso de Prueba beta se haya completado o en otro momento en el futuro; v) el uso que usted haga de los Servicios durante la Prueba beta se regirá por este ALUF; y vi) en el caso de una Prueba beta cerrada, usted deberá mantener toda la información sobre los Servicios beta en absoluta confidencialidad como se ha indicado anteriormente, y no deberá revelarla a ninguna persona. Las cuentas de la Prueba beta no pueden transferirse bajo ninguna circunstancia.

You understand that you are personally responsible for your behavior while using the Game and Services and agree to indemnify and hold PLAION and its and their affiliates, business partners, distributors, agents, representatives and other authorized users, and their respective officers, directors, employees, and agents (collectively, the “Indemnified Parties”), harmless from and against any loss, damage, liability, cost, or expense of any kind (including attorneys’ fees) that the Indemnified Parties may incur in connection with any claim(s) or threatened claim(s) arising out of or related to your use of the Game, Services or your violation of this EULA, applicable law, or the rights of any third party.

11.	COMENTARIOS

20.	TERMINATION 

Todos los comentarios, observaciones, sugerencias, ideas, críticas y demás información que comunique, revele u ofrezca a PLAION en el transcurso de las Pruebas betas o, de forma más general, durante su uso del Juego o los servicios, pasarán a ser propiedad exclusiva de PLAION con carácter perpetuo, irrevocable, mundial, sin que puedan transferirse o emitirse sublicencias sobre ellos, y sin estar sujetos a cánones. Por consiguiente, acepta no proporcionar por ningún medio o proceso sus comentarios a ningún tercero aparte de PLAION. Usted reconoce que, salvo que la legislación aplicable lo prohíba, PLAION podrán utilizar, presentar, exhibir públicamente, reproducir, vender, promover y explotar los comentarios de cualquier manera, sin ninguna restricción y sin deberle a usted ningún tipo de compensación.

This EULA is valid until it is terminated. Termination implies the destruction of the Game as well as all copies. PLAION may terminate this EULA with immediate effect in the event that you commit a breach of the User Requirements (section 8), User Generated Content (section 7) or any other significant violation of this EULA. In such case you must promptly destroy the Game without substitution and remove the Game client from your hard drive. With termination of this EULA for whatever reason, all licenses granted herein are considered to be immediately terminated, without substitution.

Puede tener acceso a otros sitios web o recursos a través de enlaces contenidos en los juegos y/o sitios web. Dado que PLAION no tiene control sobre ningún sitio y recurso de terceros, usted reconoce y acepta que PLAION no es responsable de la disponibilidad de estos sitios o recursos externos y que no apoya ni asume ninguna responsabilidad por el contenido, la publicidad, los productos u otros materiales mostrados en tales sitios o recursos, ni tampoco apoya tales sitios o los productos o servicios accesibles a través de estos sitios. Usted reconoce y acepta asimismo que PLAION no es responsable, ni se la podrá responsabilizar, directa o indirectamente, de ningún daño o pérdida que con certeza o supuestamente hayan sido causados por o en relación con el uso o la dependencia de cualquier contenido, bien o servicio disponible en o a través de tales sitios o recursos de terceros.

If you are a resident in the United Kingdom or European Union, by law you have the right to withdraw from a purchase of the Game and/or Ingame Assets within fourteen (14) days of your purchase, without giving a reason. HOWEVER, where you make a purchase of the Game and/or Ingame Assets, the relevant platform (e.g. Steam) may obtain your consent to the immediate supply of the Game and/or Ingame Assets and your acknowledgement that you will lose your withdrawal right as soon as that supply begins. This means that you lose your right of withdrawal as soon as your account is provided with access to the Game and/or Ingame Assets (which is typically straight away).

22.	NO ASSIGNMENT 

PLAION le recomienda que tome las siguientes precauciones cuando vaya a utilizar un videojuego. Evite jugar si muestra signos de cansancio y/o falta de sueño. Asegúrese de jugar en un entorno bien iluminado y modere el brillo de su pantalla. Cuando juegue a un juego que requiera conexión a una pantalla, juegue a tanta distancia de la pantalla como le permita la conexión. Durante el juego, haga descansos de entre diez (10) y quince (15) minutos por cada hora de juego.

You may not assign or transfer all or some of your rights or obligations under this EULA without PLAION's prior written approval, and any attempt to do so without such consent shall be void. If the restrictions on the transfer of the Game in this EULA are unenforceable under the laws of your country, this EULA shall be binding on any transferee of the Game and to the extent permitted by the applicable law.

14.	AVISO SOBRE EL RIESGO DE EPILEPSIA

Algunas personas pueden padecer episodios epilépticos que, en algunos casos, conllevan pérdida de conciencia, especialmente cuando se exponen a fuertes estimulaciones luminosas (rápida sucesión de imágenes o repetición de figuras geométricas sencillas, flashes o exposiciones). Estas personas se exponen a riesgos de ataques cuando juegan a determinados videojuegos que contienen estas estimulaciones luminosas, por lo que se recomienda que, antes del uso, lo consulten con su médico. También es importante que padres y madres presten mucha atención a sus hijos cuando juegan a videojuegos. If you live in the European Union, United Kingdom, Norway, Switzerland, or Russia these EULA and your use of the game shall be governed by the laws of your country of residence; and any claim or legal proceeding arising out of or relating to this EULA or the use of the Game or Services shall be subject to the jurisdiction of the courts having jurisdiction under the laws of your country of residence.

For users based in the European Union: In the event that disputes or claims arise in connection with these provisions, the European Commission provides a platform to facilitate the independent and out-of-court resolution of online disputes between consumers and professional suppliers, accessible at the following address: https://ec.europa.eu/consumers/odr/

If you reside in another country this EULA and your use of the Game and Services shall be governed by the laws of Austria, without regard to Austrian conflict of laws principles; and you irrevocably consent to the exclusive jurisdiction of the courts of Austria for the resolution of any such dispute or claim.

24.	UPDATES TO EULA

PLAION no asume garantías por los daños que puedan ocurrir a causa de un manejo inadecuado, en particular por no seguir el manual de instrucciones, no realizar el proceso inicial correcto, llevar a cabo un tratamiento inadecuado o utilizar accesorios inapropiados, salvo que PLAION sea responsable de tales daños.

PLAION reserves the right to modify and update this EULA at any time, for example for safety, security, legal, best practice and/or regulatory reasons and in accordance with applicable laws. If we change our EULA, we will post those changes to this EULA on the Game website (https://nobodywantstodie.games/) and in some cases it will be embedded on the relevant Game platform.  If we make material or significant changes to this EULA, we will notify you by email or by a notice on the applicable websites or during log in. You should check the website periodically for changes, as they are binding on you. Updates to this EULA affecting the Game shall be effective thirty (30) days after publishment or notice. Your continued use of the Game will signify your acceptance of the changes to the amended terms. If you do not agree with the changes to this EULA, you may terminate the license and stop using the Game and Services. Any use of the Game and/or Services after the effective date of the amended terms will constitute your consent to the amended terms.

16.	EXCLUSIÓN DE GARANTÍAS (NO APLICABLE A USUARIOS RESIDENTES EN LA UNIÓN EUROPEA Y EL REINO UNIDO)

25.	EXPORT CONTROL

USTED ENTIENDE QUE EL USO QUE USTED HAGA DEL JUEGO O DE LOS SERVICIOS (LO QUE INCLUYE, ENTRE OTROS, CUALQUIER DESCARGA, PÉRDIDA DE DATOS U OTROS DAÑOS EN SU SISTEMA INFORMÁTICO O DISPOSITIVO MÓVIL) SERÁ POR SU PROPIA CUENTA Y RIESGO. ASUME ASIMISMO QUE TODOS LOS SERVICIOS SE OFRECEN EN EL ESTADO Y LUGAR EN QUE SE ENCUENTRAN, CON ARREGLO A LA DISPONIBILIDAD GEOGRÁFICA Y TEMPORAL, Y QUE PODRÁN SUFRIR CAMBIOS EN CUALQUIER MOMENTO, SIN NECESIDAD DE PREAVISO. USTED RECONOCE QUE PLAION NO OFRECE NINGUNA GARANTÍA RESPECTO A UN FUNCIONAMIENTO SIN INTERRUPCIONES, OPORTUNO, SEGURO O LIBRE DE ERRORES DE LOS SERVICIOS. ENTIENDE QUE PLAION NO GARANTIZA QUE LOS RESULTADOS QUE OBTENGA DE SU USO DE CUALQUIER SERVICIO VAYAN A CUMPLIR SUS EXPECTATIVAS. NINGUNA GARANTÍA DE NINGÚN TIPO, TANTO ORAL COMO ESCRITA, PODRÁ MODIFICAR LAS DISPOSICIONES DE LA EXCLUSIÓN DE GARANTÍAS INCLUIDA EN ESTE ALUF. EN EL CASO DE QUE EL CONTENIDO Y/O LOS MATERIALES DE QUE CONSTAN LOS SERVICIOS O CUALQUIERA DE ESTAS CONDICIONES NO CUMPLIERAN SUS EXPECTATIVAS, LA ÚNICA Y EXCLUSIVA OPCIÓN DE LA QUE DISPONDRÁ SERÁ INTERRUMPIR EL ACCESO Y EL USO DE LOS SERVICIOS Y/O ELIMINAR SU CUENTA.

You may not use, access or otherwise export or re-export the products except as authorized by United States law and the laws of the jurisdiction in which the Services were obtained. In particular, but without limitation, the Game may not be exported, re-exported or otherwise made available (a) into any country or region embargoed by the U.S. Government, or (b) to anyone on the U.S. Treasury Department's Specially Designated Nationals List or the U.S. Department of Commerce Denied person List or Entity List, EU consolidated sanctions list with designated persons. By using the Game, you represent and warrant that you are not located in any such country or on any such list.
26.	FINAL PROVISIONS

CON EL ALCANCE MÁXIMO PERMITIDO POR LA LEY, PLAION RENUNCIA A CUALQUIER TIPO DE DECLARACIÓN, GARANTÍA Y CONDICIÓN (YA SEA EXPRESA, TÁCITA, LEGAL O DE OTRO TIPO, INCLUIDAS, ENTRE OTRAS, GARANTÍAS SOBRE LA COMERCIABILIDAD E IDONEIDAD PARA UN FIN DETERMINADO, TITULARIDAD, FUNCIONAMIENTO SIN INTERRUPCIONES Y/O SIN ERRORES O SOBRE LA NO VULNERACIÓN DE LOS DERECHOS DE PROPIEDAD) EN REFERENCIA A LOS SERVICIOS.

Subject to section 18, this EULA and the policies incorporated herein together with any Game-specific terms or other additional terms you may have agreed upon with PLAION, are the entire agreement between you and PLAION. They supersede any and all prior or contemporaneous agreements between you and PLAION relating to your use of the Services. Your own terms and conditions expressly do not form a part of this EULA. PLAION may assign, subcontract or transfer this EULA, in whole or in part, to a third party or another member of our group if necessary for the support of the Game and/or Services, as part of any reorganization or merger, or for other business reasons provided that this does not negatively affect your rights under this EULA (or alternatively with your consent). Headings are for convenience of reference only and shall not affect the interpretation or construction of this EULA. Failure of PLAION to partially or fully exercise any rights or the waiver of PLAION of any breach of this EULA by you, shall not prevent a subsequent exercise of such right by PLAION or be deemed a waiver by PLAION of any subsequent breach by you of the same or any other term of this EULA. The rights and remedies of PLAION under this EULA and any other applicable agreement between you and PLAION shall be cumulative, and the exercise of any such right or remedy shall not limit PLAION’s right to exercise any other right or remedy.

EL USUARIO DEBERÁ CUBRIR TODOS LOS COSTES RELATIVOS A LA INFRAESTRUCTURA QUE NECESITARÁ PARA PODER UTILIZAR LOS SERVICIOS. EL USUARIO ASUMIRÁ TODOS LOS RIESGOS EN TÉRMINOS DE DEDICACIÓN DE TIEMPO Y ESFUERZO O DE PÉRDIDA DE DATOS (EN PARTICULAR, DE DATOS SOBRE LOS JUEGOS), ASÍ COMO DE LAS POSIBLES INTERRUPCIONES O PÉRDIDAS DE INFORMACIÓN COMERCIAL O DE OTRO TIPO A CONSECUENCIA DE SU USO DE LOS SERVICIOS. ASIMISMO, PLAION NO SERÁ RESPONSABLE EN NINGÚN CASO DE LA DESTRUCCIÓN, ELIMINACIÓN, MODIFICACIÓN, DETERIORO, ACCIÓN DE PIRATERÍA U OTRO TIPO DE DAÑO O PÉRDIDA DE CUALQUIER TIPO QUE SE PRODUZCA EN EL JUEGO O EN LOS ELEMENTOS DEL JUEGO, LO QUE INCLUYE, ENTRE OTROS, LA ELIMINACIÓN DE MONEDA VIRTUAL Y/O DE INVENTARIO TRAS LA CANCELACIÓN O EXPIRACIÓN DE SU CUENTA, O LA INTERRUPCIÓN DEL JUEGO O DE LOS SERVICIOS.

This EULA does not change your rights under the laws of your jurisdiction if the laws of your jurisdiction do not allow it. In the event that certain provisions of this EULA are held unenforceable by a court, those provisions shall be enforced only to the extent permitted by applicable law, and the remaining provisions of this Agreement shall remain in full force and effect.

17.	LIMITACIÓN DE RESPONSABILIDAD (NO APLICABLE A USUARIOS RESIDENTES EN LA UNIÓN EUROPEA Y EL REINO UNIDO)

If a provision of this EULA is or becomes wholly or partially invalid, the validity of the remaining provisions will remain unaffected. This EULA establish and encompass all legal agreements between the parties in relation to the subject matter of their agreement and replaces all former verbal or written agreements, whereby it is assumed that this EULA exists parallel to any applicable terms of use and does not replace them.

Con el alcance máximo que permita la ley aplicable, PLAION, o sus empresas filiales o dependientes, no serán en ningún caso responsables ante usted (o un tercero que formule sus reclamaciones a través de usted) por cualquier tipo de daño, incluidos, entre otros, daños directos, indirectos, especiales, emergentes, punitivos o accesorios; daños por la pérdida de uso, beneficios, datos u otros valores intangibles; el coste de adquisición de bienes o servicios sustitutivos, el acceso no autorizado y/o la alteración de su información personal; trasmisiones que deriven o estén relacionadas con el uso, la incapacidad de uso, el uso no autorizado, la prestación o no prestación de los Servicios, aun cuando PLAION haya sido informada previamente de la posible ocurrencia de tales daños, tanto si las reclamaciones de daños pueden tener su fundamento, en cualquier parte del mundo, en un contrato, negligencia, acuerdo extracontractual, ley, equidad, derecho u otra fuente. Salvo limitación o modificación por la ley aplicable, las exclusiones, renuncias y limitaciones precedentes se aplicarán con el alcance máximo permitido, aun cuando el posible remedio no cumpla su finalidad esencial. Además, PLAION, sus licenciantes o licenciatarios no serán responsables, bajo ninguna circunstancia, de cualquier retraso o incumplimiento en la prestación de los Servicios que derive directa o indirectamente de un acto de fuerza mayor u otra causa que esté fuera de su control razonable. PLAION podrá modificar o eliminar contenidos o funciones de los Servicios de cualquier forma, en cualquier momento y por cualquier motivo, incluso sin motivo. Las limitaciones, exclusiones y renuncias contenidas en este apartado o en otros de este ALUF se aplicarán con el alcance máximo permitido por la ley aplicable.

18.	LIMITACIÓN DE RESPONSABILIDAD (APLICABLE A USUARIOS RESIDENTES EN LA UNIÓN EUROPEA Y EL REINO UNIDO) 

a) Esta sección le será de aplicación si reside en el Reino Unido o en la Unión Europea. Si reside en los Estados Unidos de América o en otro territorio fuera del Reino Unido o la Unión Europea, consulte la sección 18 anterior.

B) PLAION no excluye ni limita (ni pretende excluir o limitar) nuestra responsabilidad ante usted cuando sea ilegal hacerlo. Esto incluye nuestra responsabilidad en caso de:
• muerte o lesión personal por negligencia nuestra (o la de nuestros empleados, agentes o subcontratistas);
• fraude o falsa declaración fraudulenta;
• vulneración de sus derechos legales como consumidor, u
• otra responsabilidad que no pueda excluirse por la ley aplicable.

c) El Juego y los Servicios se suministran únicamente para uso doméstico y privado. Si utiliza el Juego o los Servicios para algún fin comercial, empresarial o de reventa no tendremos ninguna responsabilidad ante usted por ningún tipo de lucro cesante, pérdida de negocio, interrupción de la actividad o pérdida de oportunidad comercial.

d) En el caso de que incumplamos de alguna manera este ALUF, asumiremos la responsabilidad por cualquier pérdida o daño que usted sufra y que sea un resultado previsible de dicho incumplimiento por nuestra parte, o por no haber aplicado el debido cuidado y diligencia. Se considerará que una pérdida o daño son previsibles si resulta obvio que ocurrirá o si, en el momento de acordar el ALUF, tanto usted como nosotros éramos conscientes de que podría ocurrir. No nos responsabilizamos de ninguna pérdida o daño que no sea previsible.

e) Si el Juego o los Servicios causan algún daño a un dispositivo o contenido digital perteneciente a usted, por nuestra falta a la hora de aplicar el debido cuidado y diligencia, repararemos el daño o le compensaremos económicamente. Sin embargo, no nos haremos responsables de los daños que usted podría haber evitado de haber seguido nuestros consejos de aplicar una actualización que se le ofrezca sin coste alguno o de haber respetado las instrucciones de instalación, o si carece de los requisitos técnicos mínimos recomendables.

f) De acuerdo siempre con los apartados a) - e) anteriores: i) la responsabilidad total de PLAION que derive de este ALUF o en relación con este no excederá del importe total que usted nos haya pagado en virtud de este ALUF durante los doce (12) meses inmediatamente anteriores al suceso que haya originado la responsabilidad, y ii) el Juego y los Servicios se ofrecen tal cual, sin ninguna garantía específica o declaración con respecto a la calidad, exhaustividad o precisión del Juego o los Servicios.

19.	INDEMNIZACIÓN (NO APLICABLE A USUARIOS RESIDENTES EN LA UNIÓN EUROPEA Y EL REINO UNIDO)

Usted entiende que es personalmente responsable de su conducta mientras use el Juego y los Servicios, y acuerda indemnizar y eximir de responsabilidad a PLAION y a sus empresas filiales, colaboradores comerciales, distribuidores, agentes, representantes y otros usuarios autorizados, así como a sus respectivos cargos directivos, consejeros, empleados y agentes (de forma colectiva, «Partes indemnizadas»), frente a todas y cualesquiera pérdidas, daños, obligaciones, costes o gastos de cualquier tipo (incluidos los honorarios de letrados) que las Partes indemnizadas puedan soportar en relación con cualquier reclamación, real o supuesta, que derive o esté relacionada con su uso del Juego, los Servicios o su incumplimiento del presente ALUF, la ley aplicable o los derechos de un tercero.

20.	RESCISIÓN 

El presente ALUF será válido mientras no se rescinda. La rescisión conlleva la destrucción del Juego y de todas las copias del mismo. PLAION podrán rescindir este ALUF con efecto inmediato en el caso de que usted incumpla el apartado 8 (Obligaciones del usuario) o el apartado 7 (Contenido generado por el usuario) o infrinja de manera grave el presente ALUF. Llegado el caso, usted deberá destruir con la máxima celeridad el Juego sin que exista otra medida alternativa, y retirar el cliente de Juego de su disco duro. En el caso de rescindirse este ALUF por cualquier razón, todas las licencias concedidas en virtud de este se considerarán canceladas de forma inmediata, sin otra solución alternativa. 

21.	DERECHO DE DESISTIMIENTO

Si reside en el Reino Unido o la Unión Europea, tendrá derecho por ley a desistir de una compra del Juego y/o Elementos del juego en el plazo de 14 días de su compra sin necesidad de especificar ningún motivo. SIN EMBARGO, cuando realice una compra del Juego y/o Elementos del juego, la correspondiente plataforma (p. ej., Steam) podrá obtener su consentimiento para suministrarle inmediatamente el Juego y/o Elementos del juego y su aceptación de que perderá su derecho de desistimiento en cuanto comience el suministro. Esto significa que perderá su derecho de desistimiento tan pronto como su cuenta tenga acceso al Juego y/o Elementos del juego (lo que normalmente ocurre de forma inmediata). 

22.	INTRANSFERIBILIDAD 

Usted no podrá ceder o transferir sus derechos u obligaciones, en su totalidad o en parte, en virtud de este ALUF sin el consentimiento previo por escrito de PLAION, de manera que todo intento de transferir sus derechos u obligaciones al margen de PLAION se considerará nulo. En el caso de que las restricciones sobre la transferencia del Juego en este ALUF no puedan aplicarse en virtud de las leyes de su país, este ALUF será vinculante para cualquier cesionario del Juego con el alcance permitido por la ley aplicable.

23.	LEY APLICABLE

Si reside en la Unión Europea, Reino Unido, Noruega, Suiza o Rusia, el presente ALUF y su uso del Juego se regirán por las leyes de su país de residencia, y toda reclamación o proceso legal que surja o esté relacionado con este ALUF o con el uso del Juego o los Servicios será competencia de los órganos jurisdiccionales que corresponda con arreglo a la legislación de su país de residencia.

Para los usuarios que residen en la Unión Europea: En el caso de que surja alguna controversia o reclamación en relación con estas disposiciones, la Comisión Europea ofrece una plataforma para facilitar la resolución de litigios en línea, de manera independiente y extrajudicial, entre los consumidores y proveedores profesionales, a la que podrá acceder a través de la siguiente dirección: https://ec.europa.eu/consumers/odr/

PLAION no está obligada y no tiene intención de participar en este u otros procesos de Resolución de litigios en línea.

Si reside en otro país, este ALUF y su uso del Juego y los Servicios se regirán por la legislación de Austria, sin que sean de aplicación los principios de conflictos entre leyes nacionales, y por este acto usted acepta someterse a la competencia jurisdiccional exclusiva de los tribunales de Austria para resolver cualquier tipo de controversia o reclamación.

24.	ACTUALIZACIONES SOBRE EL ALUF

PLAION se reserva el derecho a modificar y actualizar este ALUF en cualquier momento, por ejemplo, a los efectos de ampliar la seguridad, incorporar actualizaciones jurídicas, ofrecer mejores prácticas y/o por otros motivos normativos en virtud de la ley aplicable. Si hacemos alguna modificación al presente ALUF, publicaremos los cambios en el sitio web del Juego (https://nobodywantstodie.games/) y, en algunos casos, los incorporaremos en la correspondiente plataforma del Juego. De realizar cambios sustanciales o significativos sobre este ALUF, se los notificaremos por correo electrónico, mediante un aviso en los sitios web aplicables o cuando inicie sesión. Le recomendamos que visite periódicamente el sitio web para comprobar posibles actualizaciones, ya que serán vinculantes para usted. Las actualizaciones sobre este ALUF que afecten al Juego surtirán efecto treinta (30) días después de su publicación o notificación. Entenderemos que acepta los cambios sobre el ALUF si continúa usando el Juego una vez que surtan efecto tales modificaciones. Si no está de acuerdo con los cambios realizados sobre el ALUF, podrá rescindir la licencia y dejar de usar el Juego y los Servicios. La continuación del uso del Juego y/o los Servicios después de la fecha en que las modificaciones se hagan efectivas, se interpretará como un consentimiento por su parte de los cambios sobre el ALUF.

25.	CONTROL DE LA EXPORTACIÓN

Usted no podrá utilizar, acceder o exportar o reexportar de otra forma los productos a menos que esta práctica esté autorizada por el derecho de los Estados Unidos de América y la legislación del país donde se hayan obtenido los Servicios. En particular, a título no limitativo, el Juego no podrá exportarse, reexportarse o disponerse de otra forma: a) a ningún país o región que esté sujeto a un embargo por el Gobierno de los EE. UU.; o b) a ninguna persona que figure en el Listado de Ciudadanos Especialmente Designados del Departamento del Tesoro de EE. UU., en el Listado de Personas Denegadas del Departamento de Comercio de EE. UU. o en la lista consolidada de personas y entidades sujetas a sanciones de la UE. Cuando usted usa el Juego, manifiesta y garantiza no estar ubicado en ninguno de estos países ni figurar en ninguno de estos listados.

26.	DISPOSICIONES FINALES

En virtud del apartado 18, el presente ALUF y las políticas incorporadas a este por referencia, junto con cualquier condición específica del Juego u otra adicional que usted pueda haber acordado con PLAION, constituyen el acuerdo íntegro entre usted y PLAION. El conjunto de estos documentos vinculantes sustituye cualquier acuerdo anterior o existente entre usted y PLAION en relación con su uso de los Servicios. Sus términos y condiciones particulares no forman parte de este ALUF. PLAION puede ceder, subcontratar o transferir este ALUF, en su totalidad o en parte, a un tercero o a otro miembro de nuestro grupo si fuera necesario para apoyar el Juego y/o los Servicios, como parte de cualquier reorganización o fusión, o con otros fines empresariales, siempre que esto no afecte negativamente a sus derechos en virtud de este ALUF (o, alternativamente, con su consentimiento). Los títulos de cada apartado se ofrecen únicamente a modo de referencia, y no afectarán a la interpretación o comprensión de este ALUF. El hecho de que PLAION no ejerza en su totalidad o en parte algún derecho, o la dispensa por parte de PLAION respecto a algún incumplimiento que usted haya cometido sobre este ALUF, no impedirá que PLAION pueda ejercer dicho derecho en el futuro ni deberá entenderse en el sentido de que PLAION vaya a dispensar otros incumplimientos por parte de usted sobre la misma u otra disposición de este ALUF. Los derechos y remedios de los que dispone PLAION en virtud de este ALUF y de cualquier otro acuerdo aplicable entre PLAION y usted serán acumulativos, de tal manera que el ejercicio de cualquiera de estos derechos o remedios no limitará el derecho de PLAION a ejercer cualquier otro derecho o remedio que le corresponda.

Este ALUF no modifica los derechos que le otorguen las leyes de su país si dichas leyes no lo permiten. En el caso de que un órgano jurisdiccional considere inaplicable alguna disposición contenida en este ALUF, dicha disposición solo podrá ejecutarse con el alcance que permita la ley aplicable, manteniéndose el resto de disposiciones de este documento en pleno vigor y efecto.

Si una disposición de este ALUF fuera o resultara inválida en su totalidad o en parte, ello no afectará a la validez del resto de disposiciones. El presente ALUF establece y constituye el acuerdo legal íntegro entre las partes en relación con el asunto del acuerdo y sustituye todos los pactos verbales o escritos anteriores entre ellas, si bien se prevé que este ALUF coexistirá de forma simultánea a cualesquiera condiciones de uso que sean aplicables y no en sustitución de ellas.
