This End-User License Agreement (“Agreement”) is a legal contract between you (“User”) and the licensor, Ki-nodes Studio, regarding the software product Nekogumi (“Game”). By downloading, installing, or continuing to use the Game, you agree to the terms set forth in this Agreement.

1. Grant of License

The licensor grants you a non-exclusive, non-transferable, revocable license to install and use Nekogumi for private, non-commercial purposes.

2. Restrictions

You may not:

Modify, reverse engineer, decompile, or disassemble the Game;

Resell, rent, redistribute, or sublicense the Game;

Use the Game for commercial or public purposes;

Bypass any access controls or licensing mechanisms;

Use game content—including characters, lore, visuals, text, or audio—as input or source material for any artificial intelligence or machine learning system;

Publish translations or derivative works without prior permission;

Commercially distribute or monetize mods, fan games, or other derivative works based on the Game without prior written consent.

3. Third-Party Platforms

Use of the Game on platforms such as Steam or Epic Games Store is subject to each platform’s respective terms of service and privacy policy. These platforms may also control features such as achievements, cloud saves, and access to downloadable content.
Refunds for purchases made through these platforms are processed according to their respective refund policies. Ki-nodes Studio does not control or process refunds and cannot override decisions made by these platforms.

4. Ownership

The Game and all intellectual property remain the exclusive property of Ki-nodes Studio. No ownership rights are transferred under this Agreement.

5. Fan Content

Ki-nodes Studio permits the non-commercial sharing of screenshots, gameplay footage, and fan art on social media platforms, provided such content:

Clearly credits the original Game;

Does not misrepresent official branding or imply endorsement;

Remains free and publicly accessible.

You may not create or distribute derivative works—including fan games, rebranded assets, or modifications—for commercial purposes without prior written permission. An official fan content policy may be released in the future.

6. Restrictions on Use with Artificial Intelligence

Licensee may not:

Use any portion of the Game — including but not limited to its assets, code, audio, visual elements, narrative structure, or gameplay mechanics — as input for training, fine-tuning, or prompting any artificial intelligence or machine learning system.

Use any artificial intelligence or machine learning system to generate, synthesize, or create derivative content that mimics, replicates, or is substantially based on the Game or its components.

Employ generative AI tools to produce artwork, music, dialogue, game mechanics, or other content that imitates or is inspired by the Game, whether for commercial or non-commercial purposes.

These restrictions apply regardless of whether the AI system is publicly available, privately hosted, open-source, or proprietary.

7. Warranty Disclaimer

The Game is provided “as is” without warranties. Ki-nodes Studio does not guarantee uninterrupted or error-free performance.

8. Limitation of Liability

Ki-nodes Studio is not liable for indirect, incidental, or consequential damages. Total liability is limited to the amount paid for the Game, if any.

9. Termination

This Agreement terminates immediately upon breach. You must uninstall the Game and discontinue use upon termination.

10. Language

This Agreement and the Game are provided in English only. No official translations are available.

11. Governing Law

This Agreement is governed by the laws of the Hong Kong Special Administrative Region (HKSAR). Disputes are subject to the exclusive jurisdiction of its courts.
