ESTOS TÉRMINOS SE SUMAN A CUALESQUIERA TÉRMINOS Y CONDICIONES DE CUALQUIER PLATAFORMA EN LA QUE OFREZCAMOS EL JUEGO (“TÉRMINOS DE PLATAFORMAS”). SE CONSIDERA, POR LO TANTO, QUE LOS TÉRMINOS DE PLATAFORMAS ESTÁN INCLUIDOS EN ESTOS TÉRMINOS. <br>LEA LA TOTALIDAD DE LOS TÉRMINOS CON DETENIMIENTO ANTES DE USAR, DESCARGAR, COMPRAR O INSTALAR EL JUEGO (LO QUE INCLUYE EL SERVICIO EN LÍNEA RELACIONADO).                 CUMPLE CON LOS REQUISITOS SUFICIENTES DE HARDWARE, SOFTWARE Y MEMORIA AL OBJETO DE JUGAR, ALMACENAR EL JUEGO Y USAR EL SERVICIO EN LÍNEA.<br>EL JUEGO HA SIDO DESARROLLADO PARA FUNCIONAR CON LA VERSIÓN MÁS RECIENTE DE STEAM, PLAYSTATION®, XBOX, NINTENDO SWITCH™, AMAZON LUNA Y EPIC GAMES STORE EN EL MOMENTO DE SU LANZAMIENTO. ES POSIBLE QUE LOS TITULARES DE PLATAFORMA ACTUALICEN SU SOFTWARE DE FORMA OCASIONAL Y NOSOTROS INTENTAREMOS, SIN QUE EXISTA OBLIGACIÓN POR NUESTRA PARTE, ACTUALIZAR EL JUEGO SI ES NECESARIO PARA ASEGURAR QUE SU FUNCIONALIDAD Y RENDIMIENTO CONTINÚEN CON CUALQUIER FUTURA ACTUALIZACIÓN. USTED TIENE LA OBLIGACIÓN DE ASEGURARSE DE QUE ESTÁ USANDO LA ÚLTIMA VERSIÓN PUBLICADA COMPATIBLE DE CUALQUIER SISTEMA OPERATIVO EN SU CONSOLA O PC.<br>EL JUEGO SE COMPONE DE OBRAS PROTEGIDAS POR DERECHOS DE AUTOR DE MILESTONE O SUS LICENCIANTES. EL JUEGO NO SE VENDE, SOLO SE OFRECE UNA LICENCIA PARA SU USO. ESTA LICENCIA NO LE CONFIERE LA TITULARIDAD NI LA PROPIEDAD SOBRE EL JUEGO. EL JUEGO ESTÁ DESTINADO ÚNICAMENTE A USUARIOS FINALES DE ACUERDO CON ESTOS TÉRMINOS. LICENCIA DE USO LIMITADO.<br><br>1.1 Por la presente, Milestone le otorga una licencia y el derecho limitado y no exclusivo para descargar, instalar y usar el juego únicamente para su uso personal y no comercial, solo en consolas y dispositivos compatibles que sean de su propiedad, según estos términos.<br>1.2 Estos términos y el uso que usted haga del juego no le otorgan ningún derecho de propiedad sobre ninguna pertenencia en el juego, ya sea tangible o intangible (lo que incluye cualquier pista o diseño de motocicleta o moto/piloto personalizado que usted cree).<br>1.3 Esta cláusula se aplica si ofrecemos el juego a través de la plataforma Steam (“Steam”), que hospedan Valve S.A.R.L. (en la UE) y Valve Corporation (en los EE. UU.). Eso significa que se necesita una cuenta de Steam para jugar al juego, estando el uso de Steam sujeto al acuerdo de suscriptor de Steam, que se puede encontrar en línea aquí.

IF YOU DO NOT AGREE WITH THESE TERMS YOU MAY NOT USE, DOWNLOAD OR INSTALL THE GAME.<br>PLEASE NOTE THAT THE GAME REQUIRES AN INTERNET CONNECTION AND THE AVAILABILITY OF OUR ONLINE SERVICE FOR MOST OF ITS FUNCTIONS.<br>YOU ARE RESPONSIBLE FOR ENSURING THAT YOU HAVE AN INTERNET CONNECTION, AND THAT THE DEVICE YOU USE HAS SUFFICIENT HARDWARE AND SOFTWARE REQUIREMENTS AND MEMORY IN ORDER TO PLAY AND STORE THE GAME AND USE THE ONLINE SERVICE.<br>THE GAME HAS BEEN DEVELOPED TO WORK ON THE LATEST VERSION OF STEAM, PLAYSTATION®, XBOX, NINTENDO SWITCH™, AMAZON LUNA AND EPIC GAMES STORE AT THE TIME OF ITS RELEASE. THE PLATFORM HOLDERS MAY OCCASIONALLY UPDATE THEIR SOFTWARE; WE WILL ENDEAVOR, BUT NOT BE OBLIGATED, TO UPDATE THE GAME IF NECESSARY, TO ENSURE THAT ITS FUNCTIONS AND PERFORMANCE CONTINUE WITH ANY UPDATE RELEASE. IT IS YOUR OBLIGATION TO ENSURE THAT YOU ARE USING THE LATEST COMPATIBLE PUBLIC RELEASE OF ANY OPERATING SYSTEM FOR YOUR CONSOLE OR
                El acuerdo de suscriptor de Steam cambia de vez en cuando y, si entra en contradicción con este CLUF, donde haya conflictos prevalecerá el acuerdo de suscriptor de Steam. Steam le permite conseguir el reembolso del juego en determinados casos. El acceso al juego estará vinculado a su cuenta de Google y se le requerirá que acate las políticas de Google para usar el juego.  <br><br>2. OBLIGACIONES DEL USUARIO FINAL.<br><br>2.1 Puede disponer del juego para su propio uso personal y no comercial como se describe en estos términos, pero no tiene derecho ni debe hacer ninguna de las acciones siguientes excepto en la medida en que estos términos lo permitan de forma expresa:<br>2.1.1 vender, transferir, copiar, reproducir, traducir, comunicar, realizar ingeniería inversa, publicar, retransmitir, distribuir, alquilar, prestar, sublicenciar, extraer código fuente, modificar, adaptar, mezclar, desensamblar, descompilar, crear obras derivadas basadas en, transferir o traficar con copias o reproducciones del juego o de cualquier parte o interés con terceros y en modo alguno, excepto cuando el juego se lo permita de forma expresa a través de la compartición de contenidos del juego en redes sociales;<br>2.1.2 quitar, modificar o alterar cualquier copyright, marca registrada u otro tipo de aviso;<br>2.1.3 participar en cualquier actuación que estimemos que entra en conflicto con el espíritu o el propósito del juego o el servicio en línea, lo que incluye, entre otras, usar trampas, exploits, software de automatización, bots, hackeos, mods o cualquier software de terceros no autorizado diseñado para modificar o interferir en el juego;<br>2.1.4 intentar obtener acceso no autorizado al servicio en línea o a los ordenadores, dispositivos, servidores o redes conectadas al servicio en línea por cualquier otro medio que no sea la interfaz de usuario que nosotros proporcionamos; o<br>2.1.5 usar el juego para cualquier propósito ilegal o inmoral.   <br>2.2 El usuario no podrá utilizar los productos, acceder a ellos, exportarlos o reexportarlos de cualquier otra forma, excepto donde esté autorizado por la legislación de los Estados Unidos y por las leyes de la jurisdicción en la que se obtuvieron los Servicios. En particular, como ejemplo pero sin limitarse a ello, los Juegos no pueden ser exportados, reexportados o puestos a disposición de otro modo (a) en los países o regiones que estén sometidos a embargo por el Gobierno de Estados Unidos, o (b) a personas que figuren en las listas negras de Estados Unidos, como la Specially Designated Nationals List del Departamento del Tesoro y la Denied Persons List o la Entity List del Departamento del Comercio, o que hagan parte de las personas designadas en la lista consolidada de sanciones de la Unión Europea. Al utilizar los Juegos, usted declara y garantiza que no se encuentra en ninguno de esos países y que no está incluido en ninguna de esas listas.<br><br>3. RESOLUCIÓN.<br><br>3.1 Estos términos y las licencias que nosotros le concedemos a usted permanecerán en vigor hasta su resolución.<br>3.2 Usted podrá resolver estos términos en cualquier momento y por cualquier razón eliminando o borrando el juego de su consola o
                 PC.<br>
                THE GAME COMPRISES COPYRIGHT WORKS OF MILESTONE AND/OR ITS LICENSORS. THE GAME IS LICENSED, NOT SOLD.
                3.3 Nosotros podemos resolver estos términos si usted no los acatase en cualquier momento y por cualquier razón, o cuando tengamos una sospecha razonable de que usted no acata cualquier parte de estos términos. Podemos llevar a cabo acciones que nosotros juzguemos razonables a nuestra sola discreción contra usuarios que no cumplan estos términos, lo que puede incluir la prohibición a los usuarios de utilizar o acceder al juego o al servicio en línea. Para más información sobre las infracciones que podría cometer, le recomendamos que lea detenidamente todo el apartado 5.11 “Reglas del Contenido del usuario”. En función del tipo, pero sobre todo del número de denuncias recibidas, Milestone se reserva el derecho de suspender al usuario durante un número variable de días: un día, tres días, siete días, quince días, un mes. Si se supera este último límite, es posible incurrir en la suspensión permanente.<br>3.4 Milestone se reserva el derecho de determinar qué conducta se considera que viola o está fuera del espíritu o el propósito de estos términos, el juego o el servicio en línea. Sin embargo, si lo que usted haya hecho puede enmendarse, le daremos una oportunidad razonable para hacerlo. <br>3.5 Tras la resolución, usted ya no tendrá permiso para usar el juego y se le exigirá que lo borre de su consola o dispositivo.<br>3.6 Los Servicios de Milestone no están más disponibles en una región. En dicha circunstancia, publicaremos un aviso en nuestro sitio web y/o en el propio juego, para comunicar la interrupción de una funcionalidad sustancial de un juego o de todos los Servicios de Milestone en una región.<br><br>4. SERVICIO EN LÍNEA.<br><br>4.1 Milestone puede, aunque no está obligado a hacerlo, proveer y mantener cierta funcionalidad en línea, interactividad y conectividad de juego de red en línea y otras características en línea relacionadas con el juego, entre otras, los modos de juego “Prueba individual” y “Campeonato personalizado” (“Servicio en línea”), siempre sujetos a estos términos..<br>4.2 No podemos garantizar que el servicio en línea o una parte en particular del servicio en línea, lo que incluye cualquier posible contenido generado por el usuario, vaya a estar siempre disponible. <br>4.3 El servicio en línea solo es para uso personal y en las condiciones en las que se encuentre, y cualquier uso debe ser conforme a estos términos.<br><br>Restricciones de edad<br>4.4 Para jugar es necesario aceptar el acuerdo con el usuario de Milestone y reconocer la política de privacidad y de cookies de Milestone. Para acceder a las funciones online se requieren una conexión a Internet y una cuenta de plataforma, además es necesario que el registro pertinente lo efectúe una persona que tenga al menos trece años.<br><br>Reglas de usuario<br>4.5 Está además de acuerdo en que no tendrá en ningún caso una conducta que sea ilegal, que acarree responsabilidades penales o civiles, o que pueda desprestigiarnos a nosotros o al juego. <br>4.6 Cuando el juego le permita compartir mensajes predeterminados con otros usuarios, tendremos derecho a borrar, restringir, suspender o alterar esa capacidad por cualquier razón, a nuestra sola y absoluta discreción.<br>4.7 Usted cooperará totalmente con nosotros cuando investiguemos cualquier sospecha de actividad ilegal, fraudulenta o inapropiada.<br>4.8 Si cree que el comportamiento de otro usuario infringe estos términos, le rogamos que nos lo haga saber contactando con nosotros a través del servicio al cliente, con detalles sobre la potencial infracción o el usuario responsable. Tomaremos los pasos razonables para lidiar con cualquier infracción. <br><br>Tenga en cuenta lo siguiente:
                  
                YOUR LICENSE CONFERS NO TITLE OR OWNERSHIP IN THE GAME.
                <br>Cuando existe el servicio en línea, usted lo usa exclusivamente por su cuenta y riesgo. Es un riesgo conocido del uso de Internet que la gente no es siempre quien dice ser. La gente puede proporcionar información o comportarse de forma engañosa, ilícita, ilegal o en la que no se puede confiar. Milestone no puede saber de ninguna forma si las declaraciones hechas por otros usuarios del juego o el servicio en línea son ciertas. Esa es una decisión que solo usted puede tomar y se recomienda ejercer cierta precaución. Al jugar al juego y usar el servicio en línea y sus partes, usted acepta que esto es así y acepta el riesgo asociado a ello. Los usuarios deben tener especial cuidado a la hora de divulgar su propia información personal. <br><br>5. CREACIÓN Y PERSONALIZACIÓN DEL CONTENIDO GENERADO POR EL USUARIO.<br><br>5.1 El Juego puede incluir una función de editor que permite al usuario o a otros usuarios del Juego generar Contenidos de Usuario (tal y como se define en la cláusula 5.1.1 siguiente) para utilizar en el mismo Juego, para cargar, compartir, poner a disposición o publicar en el Servicio en línea, para sí mismo y/o para otros jugadores. Además, el usuario puede enviar comunicaciones a nosotros o a terceros y/o proporcionar los Contenidos de Usuario y/o la información para su uso dentro del Juego o de otro género por parte nuestra o de terceros.<br><br>A los efectos de las presentes Condiciones:<br> 5.1.1 La definición de «Contenidos de Usuario» (en singular «Contenido de Usuario») incluye cualquier contenido generado por el usuario utilizando las funciones del editor que puedan incluirse en el Juego, incluyendo pero no limitándose a circuitos, libreas, cascos, pegatinas, adhesivos de piloto, números, monos y vehículos, y cargado, puesto a disposición o enviado por el usuario al Servicio en línea, para sí mismo y/o para que otros usuarios lo utilicen en el Juego.<br>5.1.2 «Distribuir» significa utilizar, vender, comercializar, promocionar, conceder en sublicencia a usuarios finales, distribuir o, de otra manera, poner a disposición de terceros..<br>5.2 En relación con el SOLO uso del Juego y del Servicio en línea (cuando dicho servicio exista) y de conformidad con los presentes Términos y Condiciones, el usuario podrá (y se le concede una licencia limitada y no exclusiva y el derecho para) utilizar el software que forma parte del Juego y del Servicio en línea para comunicarse con otros usuarios del Juego utilizando el Servicio en línea y para publicar, transmitir, comunicar y poner a disposición los Contenidos de Usuario. De este modo, por la presente, el usuario nos concede un derecho ilimitado, transferible, concedido en sublicencia, libre de derechos, perpetuo, irrevocable, no exclusivo y la licencia para utilizar y poner a disposición estos Contenidos de Usuario en relación con el Juego en cualquier forma o soporte.<br>5.3 Nos comprometemos en la actividad de marketing y en la publicación del Juego y en el suministro de los servicios de entretenimiento relacionados en forma de Servicio en línea. Además, nos dedicamos a la transmisión, almacenamiento, recuperación, alojamiento, formateo o traducción de los Contenidos de Usuario sin seleccionar ni alterar el contenido de la comunicación para la que actuamos meramente como conducto. <br>5.4 Al instalar y utilizar el Juego, el usuario acepta y confirma que no somos responsables de revisar ningún Contenido de Usuario que se ponga a disposición sobre la base de que no estaremos obligados a ejercer ningún control o juicio sobre el contenido o material publicado o sobre su contenido.

These shall include, by way of example, the online ‘Single Event’ and ‘Custom Championship’ game modes (“Online Service”).<br>4.2 We cannot guarantee that the Online Service or a particular part of the Online Service, including any User Content, will always be available. <br>4.3 The Online Service is for personal use only, on an “as is” basis and all use must be in accordance with these Terms.<br><br>Age Restrictions<br>4.4 To be able to play, you must first accept the Milestone user agreement and confirm that you have read MIlestone's privacy and cookie policy. In order to use online functions, you must have an Internet connection and an account on the platform; it is also necessary for a person aged at least thirteen to complete the registration process.<br><br>User Rules<br>4.5 You also agree that you will not in any way behave in a manner which is unlawful or which gives rise to civil or criminal liability, or which might call us or the Game into disrepute. <br>4.6 Where the Game allows you to share pre-determined messages with other users, we shall be entitled to remove, restrict, suspend or alter that ability for any reason at our sole and absolute discretion.  <br>4.7 You will cooperate fully with us to investigate any suspected unlawful, fraudulent or improper activity.<br>4.8 If you feel that the behavior of another user breaches these Terms, please let us know by contacting us via the Support Services with details of the potential breach and/or the user responsible. We will take reasonable steps to deal with any breach. <br><br>Please note: <br>Where the Online Service is available, you use it at entirely your own risk. It is a known risk of internet usage that people are not necessarily who they say they are. People may provide information or behave in a way that is unreliable, misleading, unlawful or illegal. By playing the Game and using the Online Service and its parts, you accept that this is the case and accept the associated risk. We shall be entitled to remove, restrict, suspend or alter any User Content (and the ability to share or create User Content, including any Track or Bike Livery) for any reason at our sole and absolute discretion.<br>5.5 We have the right to remove, limit, suspend or alter any User Content (and the ability to share or create User Content) for any reason, at our sole and absolute discretion.<br>5.6 The user accepts that we can use, publish, amend, vary and adapt any User Content which the user should make available, publish or transmit to the Game and/or the Online Service for any reason, at our sole discretion. <br>5.7 To the extent that User Content derives from the Game or material supplied by us, the user hereby assigns us all intellectual property rights subsisting in the User Content which are owned by them, including all intellectual property rights in any User Content created by them.<br>5.8 We do not supply any guarantee, and shall not issue any declaration regarding the accuracy, evaluation or validity of the information and material contained in the User Content or Online Service; nor can we be held responsible for any losses or damage caused by the use of said information or material.<br>5.9 If the user discovers any User Content which they feel contravenes these Terms and Conditions, we would ask them to notify us via support Services and submit details of the User Content concerned..<br><br>User Rules of User Content (applicable where the Online Service exists)<br>5.10 The user agrees and undertakes to have the right to make available, or publish or transmit, their User Contents to the Game, and to grant us the rights specified in clause 5.8. The user shall not make available, nor indeed publish or transmit to the Game, any statement, material or other User Content, or use the Online Service or Game in any way which:<br>5.10.1 is abusive, seditious, pornographic, aggressive, homophobic, defamatory, false, instigates hatred, is discriminatory, obscene, offensive, provocative, sexist or racist;<br>5.10.2 molests or intimidates any person, or inhibits or prevents the ability of other users to communicate or read conversations (including the use of any macros/SPAM for the general base of gamers, or a single individual, in order to interrupt the chat);<br>5.10.3 breaches any Intellectual Property Right or other rights of any person (on condition that the User Content is derived from the Game or the material supplied by us);<br>5.10.4 gives rise to any behaviour involving exploitation through, but not limited to, third-party programmes, bots, scripts, viruses or other means reasonably prohibited by us on an as-and-when basis, or that exploits bugs, unforeseen errors or undocumented features to access restricted parts of the game, or otherwise engages in activities that we reasonably deem are contrary to the "spirit" of the Game;<br>5.10.5 encourages any breach of these Terms and Conditions, or the terms of service of a third-party service provider;<br>5.10.6 are Illegal, malicious, misleading (including impersonation), discriminatory, or give rise to civil or criminal liability, or which might jeopardise the reputation of Milestone, the Online Service or the Game;<br>5.10.7 breaches the intellectual property or other rights of third parties, or facilitates or encourages such a breach, or involves the distribution of personal information of any gamer (other than one’s own, such as private messages);<br>5.10.8 is technically damaging, such as introducing computer viruses, worms, logic bombs or other harmful software or data, or otherwise attempting or effectively modifying or interfering with the Game, or overloading or disrupting any computer or server used by the Game;<br>5.10.9 may be considered commercial or marketing communication;<br>5.10.10 promotes illegal or unlawful activities, including but not limited to solicitation, gambling or the sale of prescription medication;<br>5.10.11 is directed at individuals under the age of 18 or those seeking or attempting to arrange to meet a person under the age of 18;<br>5.10.12 contains any restricted material, including but not limited to passwords, medical information or confidential information of any person; <br>5.10.13 constitutes, in our reasonable opinion, misuse of the Game or an attempt to gain unauthorised access to the Game or its parts, or the accounts of other users or networks, or their console or device; or<br>5.10.14 solicits, invites, encourages, supports, incites or provokes - in whole or in part - any of the above.<br><br>User Contents which can be created using the Editor (applicable where the Online Service exists)<br>5.11 According to Clause 5.8 above, in relation to any User Content created and uploaded by the user on the Online Service, the user shall grant us the right and licence, on a non-exclusive basis, which shall be deemed free of royalties, perpetual and irrevocable, on a worldwide basis, for:<br>5.11.1 distributing their User Content via the Online Service;;<br>5.11.2 using and making available screenshots and video sequences of their User Content, and creating and making available (also through third-party services) any such further promotional and marketing materials at our discretion, for the purposes of promoting the Track or Livery of the motorcycle they have created, the Game and/or the Online Service on all media;<br>5.11.3 distributing the demo or free versions of the User Content with an end to reviewing, promoting and marketing solely the customised User Content; and; <br>5.11.4 using any commercial brand or commercial name of which the user is aware, or their User Content in relation to the distribution of the User Content below. 	<br>5.12 The user guarantees and declares the following to us (on condition that the User Content derives from the Game, or the material supplied by Milestone):<br>5.12.1 that they are the owner or licence holder of the User Content, and all the Intellectual Property Rights pertaining to it;<br>5.12.2 that they have the full power to enter into these Conditions and the Terms herein, and are entitled to grant the rights, licences and assignments contained in them, and that they hold all licences and assignments required to do so;<br>5.13 The user shall indemnify (agree to compensate) and hold Milestone harmless against all actions, claims, proceedings, costs and damages (including any damages or settlements paid by us on the advice of our legal advisors to settle or resolve any claim), and all legal fees or other expenses arising from any breach of the above warranties, or these Terms and Conditions.<br><br>6. WARRANTY AND LIMITATION OF LIABILITY.<br><br>6.1 We warrant that we have used and will use reasonable efforts to ensure that:<br>6.1.1 we are entitled to grant the rights and licenses granted herewith;<br>6.1.2 the Game will be of satisfactory quality;<br>6.1.3 we have used and will use reasonable efforts to ensure that the Game and/or the Online Service will be available for six (6) months from the date on which you purchase the Game; and<br>6.1.4 the Online Service, when made available by us, shall be of satisfactory quality, as described and fit for purpose.<br>6.2 To the maximum extent permitted by law, and save as expressly provided in these Terms, we give no warranty in connection with the Online Service and exclude liability for any loss or damage of any kind, regardless of how it arises, including without limitation any direct, indirect, punitive or consequential loss, regardless of whether it arises from any issue you notify to us, and we shall have no liability to pay any money by way of compensation, including without limitation all liability in relation to:<br>6.2.1 the availability of the Online Service;<br>6.2.2 any incorrect or inaccurate information on the Online Service and all errors, interruptions to or delays in updating the Online Service;<br>6.2.3 the infringement by any person of any Intellectual Property Rights of any third party caused by their use of the Online Service;<br>6.2.4 any amount or kind of loss or damage due to viruses or other malicious software that may infect a user's computer equipment, software, data or other property caused by persons accessing, using or downloading the Online Service; <br>6.2.5 all representations, warranties, conditions and other terms which but for this notice would have effect.<br>6.3 Except as specifically provided in these terms, and to the maximum extent permitted by law:<br>6.3.1 The Game is provided on an "as is" and “as available” basis without warranty or guarantee of any kind (express or implied) other than those set out in these terms;<br>6.3.2 We only accept liability for direct loss as a result of our breach of the warranties in Clause 6.1 above;<br>6.3.3 Our and our licensors’ maximum liability will be limited to €100;<br>6.3.4 We and our licensors will not in any event be liable in any way for any consequential or indirect loss or damage (save to the extent that damage to your console, PC or other digital content which you own is caused by the Game as a result of our failure to use reasonable care and skill in which case you may be entitled to compensation or we may be obliged to repair your device);<br>6.3.5 We do not warrant or guarantee that the operation of the Game and/or the Online Service will be uninterrupted or error-free, or that errors can or will be corrected, or that the Game or the Online Service are free of viruses or other harmful components;<br>6.3.6 You install and use the Game at your own risk.<br><br>7. INDEMNITY AND REMEDIES. <br><br>7.1 You hereby indemnify (agree to compensate), defend and hold harmless Milestone and our affiliates, officers, directors, owners, licensors, service providers, partners, contractors, employees, agents and licensees (collectively, the "Indemnified Parties") from and against any and all any liabilities, claims, costs and expenses (including legal expenses and attorney fees) incurred by the Indemnified Parties in connection with any claim arising out of any breach by you of these Terms, or claims arising directly or indirectly from your use or misuse of the Game (which includes Virtual Items and the Online Service, where existing), and any User Content; and/or any use other than that set out in these Terms. You shall fully cooperate with us in the defense of any such claim and we reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you.<br>7.2 You further agree that the subject matter of these Terms is of a unique character with special value, and that we would suffer irreparable damage if these Terms were not specifically enforced; as a result you agree that we shall be entitled, without bond, other security, or proof of damages, to appropriate equitable remedies (including injunctive relief) with respect to breaches of these Terms, in addition to other remedies as we may otherwise have available under applicable laws.<br>7.3 Our licensors shall be third-party beneficiaries under these Terms and shall be entitled to enforce its provisions and enjoy the benefits of its protections.<br><br>8. OWNERSHIP. <br><br>8.1 All right, title, interest and ownership rights in the Game and any copyright, design right, database right, patents and any rights to inventions, know-how, trade and business names, trade secrets and trade marks (whether registered or unregistered) and any related applications and other intellectual property rights (“Intellectual Property Rights”), in or connected with the Game and each part thereof (including, by way of example only, any titles, code, themes, objects, characters, stories, catchphrases, concepts, artworks, animations, sounds, music, audio-visual effects and methods of operation) are owned by, belong to and vest in us or our licensors. <br>8.2 The Game may contain certain licensed materials and our licensors may act to protect their rights in the event of any breach of these Terms. All trademarks are the property of their respective owners.<br><br>9. SEVERABILITY.<br><br>In the event that any provision of these Terms shall be held by a court or other tribunal of competent jurisdiction to be unenforceable, this provision will be enforced to the maximum extent permissible and the remaining parts of these Terms shall remain in full force and effect. <br><br>10.
