This End User Licence Agreement (hereinafter the "Licence Agreement") provides the terms under which you are authorised to install and/or use the Multimedia Program published by Focus Entertainment, a company registered with the RCS of Paris under number 399 856 277, and whose registered office is located at Parc du Pont de Flandre, Bâtiment 28 "Le Beauvaisis", 11 Rue de Cambrai, 75019 Paris, France.

Il presente contratto di licenza per l'utente finale (di seguito il "Contratto di Licenza") stabilisce le condizioni alle quali l'utente è autorizzato a installare e/o utilizzare il Programma Multimediale pubblicato da Focus Entertainment, società registrata presso l'RCS di Parigi con il numero 399 856 277 e con sede legale in Parc du Pont de Flandre, Bâtiment 28 "Le Beauvaisis", 11 Rue de Cambrai, 75019 Parigi, Francia.

YOU MUST CAREFULLY READ THE LICENCE AGREEMENT BEFORE PURCHASING, DOWNLOADING OR INSTALLING THIS MULTIMEDIA PROGRAM. IN ADDITION, CERTAIN MULTIMEDIA PROGRAMS MAY PROVIDE CONDITIONS OF USE SPECIFIC TO THEM (HEREINAFTER THE "SPECIFIC CONDITIONS OF USE"), THE TERMS OF WHICH SHOULD BE REFERRED TO AND ACCEPTED BEFORE PURCHASING, DOWNLOADING OR INSTALLING SAID MULTIMEDIA PROGRAMS ASSOCIATED THEREWITH.

You hereby acknowledge that you have read and understood the Licence Agreement and have agreed that the action of installing the Multimedia Program is a confirmation of your agreement to be contractually bound by the following provisions. You acknowledge and agree that this Licence Agreement states the completeness and exclusivity of the agreement between you and Focus Entertainment and that the Licence Agreement supersedes any prior or current agreement, oral or written, and any other communication between you and Focus Entertainment, including any written licence agreement accompanying the Multimedia Program that is inconsistent with and/or contrary to this Agreement.

Con il presente, l'utente riconosce di aver letto e compreso il Contratto di Licenza e di aver accettato che l'azione di installare il Programma Multimediale equivale alla conferma della sua accettazione di essere contrattualmente vincolato dalle seguenti disposizioni. L'utente riconosce e accetta che il presente Contratto di Licenza rappresenta l’intero ed esclusivo accordo tra Focus Entertainment e l’utente e che il Contratto di Licenza sostituisce qualsiasi accordo precedente o attuale, orale o scritto, nonché qualsiasi altra comunicazione tra Focus Entertainment e l'utente, inclusi eventuali accordi di licenza scritti che accompagnano il Programma Multimediale e che siano incompatibili e/o contrari al presente.

IF YOU DO NOT AGREE TO THE TERMS OF THIS LICENCE AGREEMENT, AS WELL AS THE SPECIFIC TERMS OF USE WHERE APPLICABLE, YOU ARE NOT AUTHORISED TO DOWNLOAD OR INSTALL THE MULTIMEDIA PROGRAM.

LA MANCATA ACCETTAZIONE DEI TERMINI DEL PRESENTE CONTRATTO DI LICENZA, NONCHÉ DEI TERMINI SPECIFICI DI UTILIZZO, SE PRESENTI, NEGA L'AUTORIZZAZIONE A SCARICARE O INSTALLARE IL PROGRAMMA MULTIMEDIALE.

"Multimedia Program" refers to: any video game published by Focus Entertainment: game software, all of their components (including in particular characters, scenario, universe, computer codes, images, animations, videos, music, text, etc.), any downloadable content for said games (including but not limited to DLC, expansion pack, battle pass, add-ons, add-on software, any other game extension, etc.), as well as their documentation.
	
"Seller" means the online sales platform on which you have purchased the Multimedia Program. The provisions applicable to the contract of sale of the Multimedia Program between the Seller and you, in particular in terms of legal guarantee of compliance, guarantee against hidden defects, right of withdrawal, and updates must be communicated to you by the Seller.

Per "Programma Multimediale" si intende qualsiasi videogioco pubblicato da Focus Entertainment: software di gioco, l’insieme dei rispettivi componenti (in particolare personaggi, scenario, universo, codici informatici, immagini, animazioni, video, musica, testo, ecc.), qualsiasi contenuto scaricabile per detti giochi (in particolare ma non solo, i DLC, Expansion Pack, Battle Pass, Add-on, Addiciel, qualsiasi altra estensione di giochi, ecc.), nonché la loro documentazione.

The Multimedia Program is protected by intellectual property rights and in particular by copyright and is the exclusive property of Focus Entertainment, its subsidiaries, its licensors or its suppliers (hereinafter "Focus Entertainment"). The use of the Multimedia Program is subject to the terms of the Licence Agreement.

Per "Venditore" si intende la piattaforma di vendita online sulla quale l'utente ha acquistato il Programma Multimediale. Il Venditore comunica all'utente le disposizioni applicabili al contratto di vendita del Programma Multimediale tra l'utente e il Venditore, in particolare in materia di garanzia legale di conformità, di garanzia contro i vizi occulti, di diritto di recesso e di aggiornamenti.

1.	Limited use licence

Il Programma Multimediale è protetto da diritti di proprietà intellettuale e in particolare da diritti d’autore ed è di proprietà esclusiva di Focus Entertainment, delle sue filiali, dei suoi licenziatari o dei suoi fornitori (di seguito “Focus Entertainment”). L’utilizzo del Programma Multimediale è soggetto ai termini del Contratto di Licenza.

The Multimedia Program is not sold, but rather is licensed to you by Focus Entertainment. As such, your licence does not grant you any title or right to ownership of the Multimedia Program.

1.	Licenza d’uso limitata

Subject to your acceptance of and compliance with this Licence Agreement and the restrictions referred to in Article 3, Focus Entertainment grants you the right to download, install, execute, display and more broadly use one (1) copy of the Multimedia Program on one (1) device only, for personal and non-commercial use. The licence granted is revocable, personal, non-exclusive, non-commercial and assignable under the conditions of Article 7.

Il Programma Multimediale non è venduto, ma è concesso in licenza da Focus Entertainment. Di conseguenza, la licenza dell'utente non gli conferisce alcun titolo o diritto di proprietà sul Programma Multimediale.

This Licence Agreement is strictly limited to the Multimedia Program, to the exclusion  of  any remastered version, any remake or reboot, any sequel (e.g. prequel, sequel, spin-off), any portage or any other version of the Multimedia Program.

Sotto riserva dell'accettazione e del rispetto dell'utente del presente Contratto di Licenza e delle restrizioni di cui alla Sezione 3, Focus Entertainment gli concede il diritto di scaricare, installare, eseguire, visualizzare e, più in generale, utilizzare una (1) copia del Programma Multimediale su un (1) singolo dispositivo, per uso personale e non commerciale. La licenza concessa è revocabile, personale, non esclusiva, non commerciale e cedibile alle condizioni di cui all'articolo 7.

2.	Owned by Focus Entertainment

Il presente Contratto di Licenza è strettamente limitato al Programma Multimediale non copre le versioni rimasterizzate ("Remaster" o "Remastered"), i remake (o "Remade") o reboot, i seguiti (ad es. prequel, sequel, spin off), l'adattamento per un'altra piattaforma, né altre vesioni del Programma Multimediale.

Focus Entertainment is the exclusive owner and/or licensee of all rights, titles and interests relating to the Multimedia Program, as well as all Intellectual Property Rights relating to or connected to the Multimedia Program and all of its features and components.

2.	Proprietà di Focus Entertainment

"Intellectual Property Rights" means all intellectual and/or industrial property rights relating to the Multimedia Program, such as in particular all copyright, related rights, patents, patent applications, rights in databases, designs, trademarks, domain names, know-how, and trade secrets, relating to the following elements, listed in a non-limiting manner:

Focus Entertainment è la proprietaria esclusiva e/o licenziataria di tutti i diritti, titoli e interessi relativi al Programma Multimediale, nonché di tutti i Diritti di Proprietà Intellettuale relativi o collegati al Programma Multimediale e a tutte le sue funzionalità e componenti.

o	All content of the Multimedia Program (such as, in particular, themes, objects, characters, character names, plots, texts, dialogues, hooks, places, illustrations, concepts, graphics, animations, sounds, musical compositions and recordings, audiovisual effects);
o	All data and communications generated by the Multimedia Program;
o	All software, computer codes (source code and object code), titles, modes of operation, all related documentation, applications, integrated interfaces, and any work of the mind, contained and integrated in the Multimedia Program.

Per “Diritti di Proprietà Intellettuale” si intendono tutti i diritti di proprietà intellettuale e/o industriale relativi al Programma Multimediale, in particolare tutti i diritti d’autore, i diritti connessi, i brevetti, le domande di brevetto, i diritti sulle banche dati, sui disegni e modelli, i marchi, i nomi di dominio, il know-how, i segreti commerciali riguardanti gli elementi elencati di seguito, ma senza limitarsi a essi:

3.	Restrictions

o	Tutti i contenuti del Programma Multimediale (in particolare temi, oggetti, personaggi, nomi dei personaggi, trame, testi, dialoghi, luoghi, illustrazioni, concetti, grafica, animazioni, suoni, composizioni e registrazioni musicali, effetti audiovisivi);
o	Tutti i dati e le comunicazioni generati dal Programma Multimediale;
o	Tutti i software, i codici informatici (codice sorgente e codice oggetto), i titoli, le modalità di funzionamento, tutta la relativa documentazione, le applicazioni, le interfacce integrate e ogni creazione intellettuale, contenuti e integrati nel Programma Multimediale.

The licence referred to in Article 1 is granted to you subject to the following reservations:

3.	Limitazioni

-

o	You may not copy, reproduce, translate, reverse engineer, reverse compile, retrieve source code, attempt to extract or use source code, modify, adapt, merge, convert, disassemble, decompile the Multimedia Program or create derivative works based on the Multimedia Program, in whole or in part, or delete an intellectual property notice or mention of the Multimedia Program, without the prior written consent of Focus Entertainment;
o	The Multimedia Program is licensed to you as a single product. Its components must not be dissociated to be used on several computers.

La licenza di cui all'articolo 1 è concessa alle seguenti condizioni:

Under the terms of the licence granted to you, you may use the Multimedia Program for personal and non-commercial use. As such, you are not authorised to:

o	Non è consentito copiare, riprodurre, tradurre, eseguire l'ingegneria inversa, retrocompilare, recuperare il codice sorgente o tentare di estrarlo o utilizzarlo, modificare, adattare, unire, convertire, disassemblare, decompilare il Programma Multimediale o creare opere derivate basate in tutto o in parte su di esso, oppure rimuovere un avviso o una nota sulla proprietà intellettuale
del Programma Multimediale, senza il previo consenso scritto di Focus Entertainment;
o	Il Programma Multimediale è concesso in licenza come prodotto singolo. I suoi componenti non devono essere separati per essere utilizzati su più computer.

o	Sell, distribute or assign copies or reproductions of the Multimedia Program to third parties in any way whatsoever, nor to rent, lease or license the Multimedia Program to third parties, without the prior written consent of Focus Entertainment and/or subject to the provisions of Article 7 of this Licence Agreement;
o	Operate the Multimedia Program in whole or in part for commercial or promotional purposes or in any way whatsoever;
o	Use the Multimedia Program for illegal or immoral purposes; 
o	Use the Multimedia Program for purposes other than those provided by Focus Entertainment under this Licence Agreement;
o	Use the Multimedia Program or allow the use of the Multimedia Program on several computers, games consoles, handhelds, mobile devices or PDAs at the same time, without an additional licence (this licence may be provided by an authorised third party (for example a Seller), provided that you have accepted the terms and conditions of sale or service);
o	Use the Multimedia Program or allow the use of the Multimedia Program in a network, as part of a multi-user system or a remote access system, including any online use, unless otherwise expressly stipulated by Focus Entertainment and subject to the acceptance of the terms and conditions of use of the Multimedia Program;
o	Use any third-party software not expressly authorised by Focus Entertainment that interacts with the Multimedia Program, regardless of the purpose;
o	Delete, disable or circumvent a notice or mention of ownership or copy the protection software contained in the Multimedia Program;
o	Export or re-export the Multimedia Program, a copy or an adaptation, in violation of applicable laws or regulations;
o	Create executable data or Multimedia Programs that reproduce the data or features of the Multimedia Program.

Ai sensi della licenza d’uso concessa all'utente, questi può utilizzare il Programma Multimediale per uso personale e non commerciale. Pertanto, l'utente non è autorizzato a:

The Multimedia Program can only be downloaded from an authorised source. You may not make the Multimedia Program available on a network where it may be downloaded by others.

o	Vendere, distribuire o cedere copie o riproduzioni del Programma Multimediale a terzi, in qualsiasi modo, né affittare, cedere in leasing o concedere in licenza il Programma Multimediale a terzi senza il previo consenso scritto di Focus Entertainment e/o fatte salve le disposizioni dell'articolo 7 del presente Contratto di Licenza;
o	Sfruttare il Programma Multimediale in tutto o in parte per scopi commerciali, promozionali o in qualsiasi altro modo;
o	Utilizzare il Programma Multimediale per scopi illegali o immorali;
o	Utilizzare il Programma Multimediale per scopi diversi da quelli previsti da Focus Entertainment nel presente Contratto di Licenza;
o	Utilizzare o consentire l'utilizzo del Programma Multimediale su più computer, console di gioco, palmari, dispositivi mobili o PDA contemporaneamente, senza ulteriori licenze (questa licenza può essere fornita da terzi autorizzati (ad esempio un Venditore), a condizione che l'utente abbia accettato le condizioni generali di vendita o di servizio);
o	Utilizzare o consentire l'utilizzo del Programma Multimediale in rete, nell'ambito di un sistema multiutente o di un sistema di accesso remoto, in particolare qualsiasi utilizzo online, salvo disposizione contraria espressamente convenuta con Focus Entertainment e previa accettazione dei termini e delle condizioni di utilizzo del Programma Multimediale;
o	Utilizzare qualsiasi software di terze parti non espressamente autorizzato da Focus Entertainment che interagisca in un qualche modo con il Programma Multimediale;
o	Rimuovere, disattivare o eludere un avviso o una nota di proprietà, oppure copiare il software di protezione contenuto nel Programma Multimediale;
o	Esportare o riesportare il Programma Multimediale, oppure una sua copia o adattamento in violazione delle leggi o dei regolamenti applicabili;
o	Creare dati o programmi multimediali eseguibili che riproducano i dati o le funzionalità del Programma Multimediale.

4.	Third-party intellectual property, software and tools

Il Programma Multimediale può essere scaricato solo da una fonte autorizzata. L'utente non deve rendere disponibile il Programma Multimediale su una rete dalla quale potrebbe essere scaricato da altre persone.

The Multimedia Program may contain elements licensed to Focus Entertainment by third parties. As such, the latter may take all measures to assert their rights in the event of a violation, on your part, of this Licence Agreement.

4.	Proprietà intellettuale, software e strumenti di terze parti

As such, third-party software and tools (the "Third-Party Software") have been used in particular for the development of the Multimedia Program and/or are likely to be integrated, as an inseparable element, into the Multimedia Program. Third-Party Software may also be made available to you to enable you to create User-Generated Content (see Article 11).

Il Programma Multimediale può contenere materiale che terzi hanno concesso in licenza a Focus Entertainment. Questi terzi possono quindi adottare tutte le misure al fine di far valere i loro diritti nell'ipotesi di una violazione, da parte dell'utente, del presente Contratto di Licenza.

All rights to the Third-Party Software are reserved and remain the full property of the relevant third parties.

Per lo sviluppo del Programma Multimediale sono stati utilizzati e/o integrati, come elemento inseparabile, software e strumenti di terze parti ("Software di terze parti"). All'utente potrebbero essere messi a disposizione Software di Terze Parti per consentirgli di creare Contenuti Generati dall'Utente (vedere Articolo 11).

Nothing in this licence has the purpose or effect of transferring to you, in any way whatsoever, the ownership of such Third-Party Software or of granting you any right or authorisation over such Third-Party Software.

Tutti i diritti sui Software di Terze Parti sono riservati e rimangono di piena proprietà delle terze parti interessate.

Third-Party Software may be subject to specific additional conditions specific to them. This applies in particular to the Unreal® Engine developed by Epic Games, Inc., the conditions of use of which can be consulted at the following link https://unrealengine.com/fr/eula-reference/unreal-fr and according to the conditions of the Epic Marketplace (https://www.epicgames.com/site/en-US/tos?lang=en-US). By accepting this Licence Agreement, you accept the specific terms and conditions of all Third-Party Software. In the event of inconsistency or contradiction between the provisions relating to a Third-Party Software contained in the terms of this Licence Agreement and in the specific terms and conditions of said Third-Party Software, the specific provisions of the latter shall prevail over that of this Licence Agreement with regard to the aforementioned Third-Party Software.

Third-Party Software is not sold to you or provided with the Multimedia Program and is only an inseparable component thereof. No guarantee is given in relation to the Third-Party Software and no responsibility can be held in this respect.

I Software di Terze Parti possono essere soggetti a ulteriori termini specifici. In particolare, il motore Unreal® Engine sviluppato da Epic Games, Inc. le cui condizioni di utilizzo sono disponibili al seguente link https://unrealengine.com/it/eula-reference/unreal-it e sulle condizioni del Marketplace Epic (https://www.epicgames.com/site/en-US/tos?lang=en-US). Accettando il presente Contratto di Licenza, l’utente accetta i termini e le condizioni specifici di tutti i Software di Terze Parti. In caso di incoerenza o contraddizione tra le disposizioni relative a un Software di Terze Parti contenute nei termini del presente Contratto di Licenza e nei termini e condizioni specifici di tale Software di Terze Parti, prevarranno le disposizioni specifiche rispetto a quelle riferite a tale contenute nel presente Contratto di Licenza che si riferiscono al Software di Terze Parti.

5.	Updates, patches and changes

Il Software di Terze Parti non viene venduto o fornito con il Programma Multimediale e ne è solo un componente inseparabile. Non viene fornita alcuna garanzia, né riconosciuta alcuna responsabilità in relazione ai Software di Terze Parti.

5.1 Focus Entertainment, or an authorised third party, may make improvements, updates, modifications or corrections (hereinafter the "Updates") to the Multimedia Program.

5.	Aggiornamenti, correzioni e modifiche

Focus Entertainment reserves the right to modify the Multimedia Program code at any time at its sole discretion. Such modifications may have an impact on the functionality of the Multimedia Program or its content (e.g. adding or removing features or content, fixing bugs or errors, modifications intended for balancing the game, etc.).

5.1 Focus Entertainment, o una terza parte autorizzata, può apportare miglioramenti, aggiornamenti, modifiche o correzioni (di seguito "Aggiornamenti") al Programma Multimediale.

5.2 If you are subject to a national law other than that of a Member State of the European Union, these Updates may be downloaded automatically in order to allow the execution of the Multimedia Program and may be likely to modify various aspects of the Multimedia Program. You expressly consent to such downloads.

Focus Entertainment si riserva il diritto di modificare il codice del Programma Multimediale in qualsiasi momento a sua esclusiva discrezione. Tali modifiche possono influire in particolare sulla funzionalità del Programma Multimediale o sui suoi contenuti (ad esempio: aggiunta o rimozione di funzionalità o contenuti, riparazione di bug o errori, modifiche destinate al bilanciamento del gioco, ecc.).

5.3 If you are subject to a national law of a Member State of the European Union, the terms of downloading these Updates will be specified by the Seller.

5.2 Se l'utente è soggetto a una legislazione nazionale diversa da quella di uno Stato membro dell'Unione europea, tali Aggiornamenti potrebbero essere scaricati automaticamente per consentire l’esecuzione del Programma Multimediale e possono modificarne alcuni aspetti. L'utente acconsente espressamente a questi download.

The information relating to the nature of these Updates and the duration for which these Updates are available for download are communicated to you by the Seller in the general conditions of sale made available by the Seller or any other contractual document of its choice.

5.3 Se l'utente è soggetto a una legislazione nazionale di uno Stato membro dell'Unione europea, le modalità di download di tali Aggiornamenti saranno precisate dal Venditore.

Information relating to the essential characteristics of each Update (i.e. purpose of the Update, version of the operating system of the Hardware concerned by the Update, storage space required, possible consequences of the Update on the functioning of the Multimedia Program) is communicated to the User before downloading the Update.

Il Venditore comunica le informazioni relative alla natura di questi Aggiornamenti e il periodo per il quale questi sono disponibili per il download nelle condizioni generali di vendita che ha messo a disposizione o in un altro documento contrattuale di sua scelta.

You will also be informed by the Seller if the Update is necessary to maintain the compliance of the Multimedia Program and why. Focus Entertainment strongly encourages you to download and install all Updates necessary to maintain the compliance of the Multimedia Program and cannot be held responsible in the event of malfunction of the Multimedia Program resulting from the failure to download and install this type of Update.

Le informazioni relative alle caratteristiche essenziali di ciascun Aggiornamento (ad esempio oggetto dell'Aggiornamento, funzionalità, versione del sistema operativo dell'Hardware interessato dall'Aggiornamento, spazio di archiviazione richiesto, possibili conseguenze dell'Aggiornamento sul funzionamento del Programma Multimediale) vengono comunicate prima del download dell'Aggiornamento.

5.4 The access and download of these Updates require an active internet connection. Insufficient connection due to your Internet or telecommunications provider may affect access to and downloading of Updates. Focus Entertainment is not responsible for any operating problem resulting from an insufficient connection or correction that is not working and which would be beyond the control of Focus Entertainment.

Il Venditore indicherà inoltre se l'Aggiornamento è necessario per mantenere la conformità del Programma Multimediale e per quali motivi. Focus Entertainment incoraggia fortemente l'utente a scaricare e installare tutti gli Aggiornamenti necessari per mantenere la conformità del Programma Multimediale e declina ogni responsabilità in caso di malfunzionamento del Programma Multimediale causato dal mancato download e installazione di questo tipo di Aggiornamento.

6.	Technical protection devices

5.4 L’accesso e il download di questi Aggiornamenti richiedono una connessione Internet attiva. Una connessione scadente fornita dal provider dei servizi di accesso a Internet o di telecomunicazione può influire sull'accesso e il download degli Aggiornamenti. Focus Entertainment non è responsabile per eventuali problemi di funzionamento legati a una connessione scadente o non funzionante e indipendenti dalla sua volontà.

The Multimedia Program may be protected by technical protection devices. As such, you acknowledge that:

-	The number of installations or activations of the Multimedia Program may be limited; 
-	Certain files and/or data may be downloaded to your device and certain information may be collected for the purpose of authenticating the Multimedia Program; 
-	An internet connection may be required;

Il Programma Multimediale può essere protetto da dispositivi tecnici di protezione. In tale ambito, l'utente riconosce che:

	If necessary, additional information may be communicated to you by the Seller.

-	Il numero di installazioni o di attivazioni del Programma Multimediale può essere limitato; 
-	Sul suo dispositivo possono essere scaricati alcuni file e/o dati e possono essere raccolte informazioni per l'autenticazione del Programma Multimediale; 
-	Può essere necessaria una connessione a Internet;

7.	Assignment of the Multimedia Program

You are authorised to permanently assign all your rights under this Licence Agreement, provided however that the recipient of the transfer agrees to be subject to the terms of this Licence Agreement and that you agree to remove the Multimedia Program from the medium on which it was downloaded/used/copied.

8.	Duration/Termination
This Licence Agreement shall remain in force until terminated. You may terminate the Licence Agreement at any time by removing or uninstalling the Multimedia Program from your media and destroying the copy of the Multimedia Program in your possession.

L'utente ha il diritto di cedere definitivamente tutti i propri diritti ai sensi del presente Contratto di Licenza a condizione che il destinatario del trasferimento accetti di assoggettarsi ai termini del presente Contratto di Licenza e che l'utente accetti di rimuovere il Programma Multimediale dal supporto su cui è stato scaricato/utilizzato/copiato.

In the event that you do not comply with the terms of the Licence Agreement, Focus Entertainment may, depending on whether it is a minor breach (any breach of a legal or regulatory obligation or not constituting a serious breach) or a serious breach (breach of Articles 3 - Restrictions, 4 – Intellectual Property, third-party software and tools, 11 – User-Generated Content, 12 – Code of Conduct and Appendix 2 – Code of Conduct of the Licence Agreement) terminate the Licence Agreement. In the event of a minor breach, Focus Entertainment will ask you in writing to cease any breach within 48 hours of the request. If it is not remedied within the deadlines, Focus Entertainment may automatically terminate the Licence Agreement. In the event of a serious breach, Focus Entertainment may immediately and automatically terminate the Licence Agreement by informing you in writing (an email is sufficient).

8.	Durata / Recesso
Il presente Contratto di Licenza rimarrà in vigore fino alla sua risoluzione. L'utente può risolvere il Contratto di Licenza in qualsiasi momento rimuovendo o disinstallando il Programma Multimediale dal proprio supporto e distruggendo la copia del Programma Multimediale in proprio possesso.

In all cases of termination, you must immediately destroy and delete the Multimedia Program and all or part of the copies in your possession or under your control and stored in any medium whatsoever, and, at the request of Focus Entertainment, certify that you have carried out this destruction.

Nel caso in cui l'utente non rispetti i termini del Contratto di Licenza, Focus Entertainment potrà, a seconda che si tratti di una violazione minore (qualsiasi violazione di un obbligo legale o normativo o che non costituisca una violazione grave) o di una violazione grave (violazione degli articoli 3 - Limitazioni, 4 – Proprietà Intellettuale, software e strumenti di terze parti, 11 – Contenuti Generati dall'Utente, 12 – Codice di Condotta e dell'Allegato 2 – Codice di Condotta del Contratto di Licenza) risolvere il Contratto di Licenza. In caso di violazione minore, Focus Entertainment chiederà per iscritto all'utente di porre rimedio alla violazione entro 48 ore dalla richiesta. Qualora l'utente non vi ponga rimedio entro tale termine, Focus Entertainment potrà validamente risolvere il Contratto di Licenza. In caso di violazione grave, Focus Entertainment potrà validamente risolvere immediatamente il Contratto di Licenza informando l'utente per iscritto (è sufficiente una e-mail).

9.	Warranty limitations

In tutti i casi di risoluzione, l'utente deve immediatamente distruggere e cancellare il Programma Multimediale e tutte o parte delle copie in suo possesso o sotto il suo controllo e memorizzate su un supporto qualsiasi e, su richiesta di Focus Entertainment, dimostrare di averle distrutte.

9.1 To the fullest extent permitted by applicable law, Focus Entertainment does not guarantee the continued or error-free operation of the Multimedia Program or the correction of any error in the Multimedia Program. The Multimedia Program is provided without any guarantee, except those where applicable expressly stipulated in this license and to the extent permitted by applicable law. The warranties set forth below define the scope of Focus Entertainment's liability and warranties and your remedies.

9.	Garanzia limitata

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FOCUS ENTERTAINMENT EXPRESSLY DISCLAIMS ANY WARRANTY WITH RESPECT TO THE MULTIMEDIA PROGRAM. THE MULTIMEDIA PROGRAM IS PROVIDED 'AS IS' AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY OF THE MULTIMEDIA PROGRAM, FITNESS FOR A PARTICULAR PURPOSE, SUFFICIENT QUALITY, PERFORMANCE OR NON-INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS.

9.1 Nella misura massima consentita dalla legge applicabile, Focus Entertainment non garantisce il funzionamento continuo o esente da errori del Programma Multimediale, né la correzione di eventuali errori nel Programma Multimediale. Il Programma Multimediale è fornito senza alcuna garanzia, ad eccezione di quelle espressamente previste nella presente licenza e nella misura consentita dalla legge applicabile. Le garanzie riportate di seguito definiscono la portata della responsabilità e la copertura delle garanzie di Focus Entertainment, nonché le richieste in garanzia che l'utente può far valere.

It is your responsibility to take responsibility for all risks resulting from the use or execution of the Multimedia Program. However, Focus Entertainment guarantees that the physical medium on which the Multimedia Program is installed shall, under normal conditions of use, be free from hidden defects and manufacturing defects for ninety (90) days from the date of purchase of the Multimedia Program.

NELLA MISURA MASSIMA CONSENTITA DALLA LEGGE APPLICABILE, FOCUS ENTERTAINMENT ESCLUDE ESPRESSAMENTE QUALSIASI GARANZIA RELATIVA AL PROGRAMMA MULTIMEDIALE. IL PROGRAMMA MULTIMEDIALE È FORNITO "COSÌ COM'È" E SENZA ALCUNA GARANZIA DI ALCUN TIPO, ESPRESSA O IMPLICITA, IN PARTICOLARE MA SENZA LIMITARSI A ESSE, LE GARANZIE E/O CONDIZIONI IMPLICITE RELATIVE ALLA QUALITA' COMMERCIALE DEL PROGRAMMA MULTIMEDIALE, DI IDONEITÀ PER UNO SCOPO PARTICOLARE, DI QUALITÀ SUFFICIENTE, DI PRESTAZIONI O DI ASSENZA DI TENTATIVI DI VIOLARE DIRITTI DI PROPRIETÀ INTELLETTUALE.

9.2 This limited warranty shall not affect your legal rights, which cannot be excluded or limited in any way under the national law applicable to you.

È l'utente che si assume tutti i rischi derivanti dall'uso o dall'esecuzione del Programma Multimediale. Tuttavia, Focus Entertainment garantisce che il supporto fisico su cui è installato il Programma Multimediale sarà, in condizioni di normale utilizzo, esente da vizi occulti e difetti di fabbricazione per novanta (90) giorni dalla data di acquisto del Programma Multimediale.

9.3 If you are subject to a national law of a Member State of the European Union, the legal guarantees of compliance are communicated to the User by the Seller.

9.2 La presente garanzia limitata non pregiudica i diritti di legge dell'utente che non possono essere esclusi o limitati in alcun modo ai sensi della legge nazionale applicabile.

For all purposes, it is specified that if you reside in France, you benefit in relation to the Multimedia Program from the legal guarantee of compliance provided for by the French Consumer Code and the guarantee of hidden defects provided for by the French Civil Code. These provisions are recalled in Appendix 1.

9.3 Se l'utente è soggetto a una legislazione nazionale di uno Stato membro dell'Unione europea, le garanzie legali di conformità gli vengono comunicate dal Venditore.

If you reside in another country of the European Union, similar provisions specific to your country of residence may apply under Directive (EU) 2019/770.

A tutti gli effetti, si precisa che gli utenti che risiedono in Francia, dispongono di una garanzia legale di conformità prevista dal Codice del consumo e di una garanzia sui vizi occulti del Programma Multimediale prevista dal Codice civile. Tali disposizioni sono illustrate nell'allegato 1.

10.	Limitation of liability

Se l'utente risiede in un altro paese dell'Unione Europea, la direttiva (UE) 2019/770 stabilisce l'applicazione di disposizioni simili specifiche per la nazione di residenza.

Focus Entertainment takes all reasonable measures to ensure the operation of the Multimedia Program and to restore it without delay in the event of disruptions. However, Focus Entertainment is not responsible for disruptions or reductions in performance caused by force majeure events (for example, armed conflicts, epidemics, pandemics (including the Covid-19 pandemic), natural disasters, strikes) or by maintenance, repair or other work on its technical facilities or by third parties providing data, content, information or transmission capabilities.

10.	Responsabilità limitata

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FOCUS ENTERTAINMENT SHALL IN NO EVENT BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, ANY DIRECT, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES RELATING TO BUSINESS INTERRUPTION, CUSTOMER LOSS, LOSS OF PROFIT, LOSS OF DATA, OR ANY ECONOMIC OR FINANCIAL LOSS) ARISING FROM THE USE OF THE MULTIMEDIA PROGRAM, OR THE INABILITY TO USE THE MULTIMEDIA PROGRAM, OR ITS MALFUNCTION, OR EVEN ITS SOLE POSSESSION, AND EVEN IF FOCUS ENTERTAINMENT HAS BEEN INFORMED OF THE EVENTUALITY OF SUCH DAMAGES.

Focus Entertainment adotta tutte le misure ragionevoli per garantire il funzionamento del Programma Multimediale e per ripristinarlo immediatamente in caso di malfunzionamenti. Tuttavia, Focus Entertainment non è responsabile per eventuali interruzioni o riduzioni delle prestazioni causate da eventi di forza maggiore (ad esempio, conflitti armati, epidemie, pandemie - inclusa la pandemia di Covid-19-, catastrofi naturali, scioperi) o da lavori di manutenzione, riparazione o altro sulle sue strutture tecniche o causate da terze parti che forniscono dati, contenuti, informazioni o capacità di trasmissione.

Focus Entertainment shall not be liable for any damage, injury or loss resulting from your negligence, accident or misuse or modification of the Multimedia Program in any way whatsoever, after its purchase. In any event and insofar as the aforementioned limitations were not applicable under certain legislations, the liability of Focus Entertainment may not exceed the purchase price of the Multimedia Program. 
Nothing in this Licence Agreement limits or excludes Focus Entertainment's liability to you for death or personal injury resulting from its negligence, or any other liability that cannot be excluded or limited under the terms of applicable law.

NELLA MISURA MASSIMA CONSENTITA DALLA LEGGE APPLICABILE, FOCUS ENTERTAINMENT NON SARÀ IN ALCUN MODO RESPONSABILE PER QUALSIASI DANNO (INCLUSI, MA SENZA LIMITARSI A ESSI, DANNI DIRETTI, INDIRETTI, INCIDENTALI O CONSEQUENZIALI RELATIVI A INTERRUZIONE DELL'ATTIVITA', PERDITA DI CLIENTI, PERDITA DI PROFITTI, PERDITA DI DATI O QUALSIASI PERDITA ECONOMICA O PECUNIARIA) DERIVANTE DALL'USO DEL PROGRAMMA MULTIMEDIALE, O DALL'IMPOSSIBILITA' DI UTILIZZARLO, NONCHÉ DAL SUO CATTIVO FUNZIONAMENTO, O ANCHE SOLO DEL SUO POSSESSO, ANCHE QUALORA FOCUS ENTERTAINMENT SIA STATA INFORMATA DI TALI DANNI.

To the extent permitted by applicable law, you agree to indemnify, defend and hold Focus Entertainment harmless against all claims, costs and expenses (including attorney's fees), arising, directly or indirectly, from your actions and omissions during use of the Multimedia Program, which are illegal or not in accordance with the terms of this Licence Agreement.

Focus Entertainment non può essere ritenuta responsabile per danni, pregiudizi o perdite derivanti da negligenza, incidente o uso improprio da parte dell'utente, né da qualsiasi modifica del Programma Multimediale dopo l'acquisto del Programma Multimediale. In ogni caso, e nella misura in cui le limitazioni di cui sopra non fossero applicabili in virtù di determinate leggi, la responsabilità di Focus Entertainment non potrà eccedere il prezzo di acquisto del Programma Multimediale.
Nessuna delle disposizioni del presente Contratto di Licenza limita o esclude la responsabilità di Focus Entertainment nei confronti dell'utente per morte o lesioni personali derivanti dalla sua negligenza, né da qualsiasi altra responsabilità che non può essere esclusa o limitata ai sensi della legge applicabile.

11.	User-Generated Content 
Certain Multimedia Programs allow you, by means of tools or Third-Party Software made available by Focus Entertainment or Focus Entertainment licensors (the "Licensors") to choose a pseudonym, create an avatar, exchange and communicate with other players, transmit and share messages, sounds, voices, recordings, texts, images, drawings, photos, documents as well as create and customise games, levels, maps, scenarios, and any other content (hereinafter "UGC"s), which may be used and shared as part of the Multimedia Program. UGCs may be a creation of your imagination (an "Original UGC") or a creation made from pre-existing creations (a "Derivative UGC"), to which Focus Entertainment and Focus Entertainment Licensors may have rights.
   
When the Multimedia Program allows the sharing of UGCs or interaction with other third-party websites and/or online services ("Third-Party Sites"), you agree to comply with the conditions of use of the Third-Party Sites in question. Focus Entertainment is not responsible for their content. The links made available to you are for convenience, without the liability of Focus Entertainment being engaged in this respect. It is your responsibility to ensure that you comply with the conditions of use of the Third-Party Sites and that they are appropriate for your profile. You undertake to relieve and hold harmless Focus Entertainment from all liability relating to a possible violation of the conditions of use of the aforementioned site by you, as well as all damages, direct or indirect, which could result from it.
                                                                                                                           
More generally, you are solely responsible for the use and sharing of the UGC that you create and must in any event comply with the terms of this Licence Agreement when creating/using/sharing a UGC.

Nella misura consentita dalla legge applicabile, l'utente accetta di indennizzare, difendere e manlevare Focus Entertainment da qualsiasi pretesa, costo e spesa (compresi gli onorari degli avvocati) imputabili, direttamente o indirettamente, a sue azioni e omissioni in caso di utilizzo illecito o non conforme del Programma Multimediale secondo i termini del presente Contratto di Licenza.

As such, Focus Entertainment can in no way be held responsible, without any limitation: for any alteration of the quality of the Multimedia Program, for any alteration or loss of one of your UGCs during the creation/use/sharing of a UGC, or for the infringement of an intellectual property right held by a third party.

11.	Contenuti Generati dall'Utente 
Alcuni Programmi Multimediali consentono all'utente, attraverso strumenti o Software Terzi che Focus Entertainment o i suoi fornitori di licenze (i "Concessori di Licenza") mettono a disposizione, di scegliere uno pseudonimo, creare un avatar, avere scambi o comunicare con altri giocatori, trasmettere e condividere messaggi, audio, voci, registrazioni, testi, immagini, disegni, foto, documenti, nonché di creare e personalizzare giochi, livelli, mappe, scenari e qualsiasi altro contenuto (di seguito “CGU”) che possono essere utilizzati e condivisi nell'ambito del Programma Multimediale. I CGU possono consistere in una creazione frutto dell'immaginazione dell'utente (un “CGU Originale”) o in una creazione realizzata a partire da creazioni preesistenti (un “CGU Derivato”) sulle quali Focus Entertainment e i Concessori di Licenza di Focus Entertainment possono vantare dei diritti.
   
Laddove il Programma Multimediale consenta la condivisione dei CGU o l’interazione con altri siti web e/o servizi online di terze parti ("Siti di Terze Parti"), l'utente accetta di rispettare le condizioni di utilizzo dei Siti di Terze Parti in questione. Focus Entertainment non è responsabile per il loro contenuto. I link vengono messi a disposizione dell'utente esclusivamente per sua comodità senza implicare una responsabilità di Focus Entertainment. È responsabilità dell'utente assicurarsi di rispettare i termini di utilizzo dei Siti di Terze Parti e che essi siano appropriati al suo profilo. L'utente accetta di manlevare e indennizzare Focus Entertainment da qualsiasi responsabilità relativa a una possibile violazione delle condizioni di utilizzo di tale sito da parte sua e per tutti i danni, diretti o indiretti, che potrebbero derivarne.
                                                                                                                           
Più in generale, l'utente è l’unico responsabile dell'utilizzo e della condivisione dei CGU che crea e deve in ogni caso rispettare i termini del presente Contratto di Licenza al momento della creazione /utilizzo /condivisione di un CGU.

You agree not to use the UGCs outside the Multimedia Program in which they were generated, regardless of the purpose or means of extracting them from the program. In general, you are prohibited from extracting any component of the Multimedia Program from the latter.

Focus Entertainment non potrà in nessun caso essere ritenuta responsabile, a titolo esemplificativo e non limitativo: di qualsiasi alterazione della qualità del Programma Multimediale, di un'alterazione o della perdita di uno dei CGU dell'utente al momento della sua creazione / utilizzo / condivisione dello stesso, o della violazione di un diritto di proprietà intellettuale detenuto da un terzo.

To the fullest extent permitted by applicable law, you hereby grant Focus Entertainment and Focus Entertainment Licensors a non-exclusive licence, free of charge, for the entire world, and where applicable for the duration of the rights, irrevocable, fully transferable and sub-licensable, in any way whatsoever, of your UGC, whether Original UGCs or Derivative UGCs, and your contributions to them, as they are created and/or shared, including, but not limited to, the rights to use, copy, modify, reproduce in whole or in part, adapt, evolve, translate, carry on any medium, incorporate in other works, extract elements in whole or in part and/or add elements and remove, distribute, display, publish, communicate in any way whatsoever, distribute, sell and market the UGCs, without any restriction, on all media, formats and forms, currently known or subsequently designed, which may be licensed, transferred, rented, made available to the public, or performed publicly and globally, without any prior notice or compensation. 
This operating licence is granted for the purposes of the distribution activities of the Multimedia Program, creations of derivative works of the Multimedia Program, the sharing of UGCs within the framework of the Multimedia Program and the promotion of the Multimedia Program and the derivative works of the Multimedia Program, 
You may terminate this operating licence in the event of a breach by Focus Entertainment of this Licence Agreement, if it has not remedied the breach following the sending of a letter of formal notice to execute the remedy within one (1) month, which has remained without effect. 
Hereby and to the fullest extent permitted by applicable law, you agree never to claim any moral rights of authorship, publication, reputation or attribution over the use of the Terms of Use, by Focus Entertainment, the Focus Entertainment Licensor or other players. Specific conditions of our Licensors may apply to your UGCs and will be communicated to you if necessary.

L'utente si astiene dall'utilizzare i CGU al di fuori del Programma Multimediale nel quale sono stati generati, indipendentemente dallo scopo o dal modo in cui sono stati estratti da esso. Fondamentalmente, l'utente si astiene dall'estrarre qualsiasi componente dal Programma Multimediale.

Notwithstanding the foregoing, you acknowledge and agree that the Derivative UGCs that you create include content, goods and materials owned by Focus Entertainment and/or its licensors. Such UGCs are derivative works of pre-existing works whose rights are owned by Focus or its Licensors. Nothing in this Licence Agreement, or any other document applicable to this contractual relationship, grants or bestows on you an assignment or transfer of rights (including any Intellectual Property Rights) to these pre-existing works used to create Derivative UGCs, which shall remain the property of Focus Entertainment and/or its Licensors. As a result, UGCs resulting from pre-existing creations may not be used without the express authorisation of Focus and/or its Licensors.

Nella misura massima consentita dalla legge applicabile, l'utente concede a Focus Entertainment e ai Concessori di licenza di Focus Entertainment una licenza di utilizzo non esclusiva, a titolo gratuito, per il mondo intero e, se del caso, per tutta la durata dei diritti, irrevocabile, interamente trasferibile e sublicenziabile, in qualsiasi modo, sui propri CGU, siano essi CGU Originali o CGU Derivati, nonché sui suoi contributi a questi ultimi, man mano che vengono creati e/o condivisi, inclusi i diritti riportati a titolo esemplificativo e non limitativo, di utilizzare, copiare, modificare, riprodurre in tutto o in parte, adattare, sviluppare ulteriormente, tradurre, portare su qualsiasi supporto, incorporare in altre opere, estrarre tutti o parte degli elementi e/o aggiungerli, rimuovere, diffondere, visualizzare, pubblicare, comunicare in qualsiasi modo, distribuire, vendere e commercializzare i CGU, senza alcuna restrizione, su qualsiasi supporto, formato e forma, attualmente conosciuti o non ancora progettati, che possono essere concessi in licenza, trasferiti, affittati, messi a disposizione del pubblico, eseguiti pubblicamente e su scala mondiale, e ciò senza alcun preavviso né alcun compenso. 
Questa licenza di utilizzo è concessa ai fini delle attività di distribuzione del Programma Multimediale, di creazione di opere derivate dal Programma Multimediale, di condivisione dei CGU nell'ambito del Programma Multimediale e di promozione del Programma Multimediale e delle opere derivate esso. 
L'utente può risolvere la presente licenza di utilizzo qualora Focus Entertainment violi il presente Contratto di Licenza senza aver rimediato alla violazione dopo aver ricevuto una diffida entro il termine di grazia di un (1) mese. 
Con il presente e nella misura massima consentita dalla legge applicabile, l'utente accetta di astenersi dal rivendicare alcun diritto morale di paternità, pubblicazione, reputazione o attribuzione sull'uso dei CGU da parte di Focus Entertainment, del Concessore di licenza di Focus Entertainment o di altri giocatori. All'occorrenza, all'utente saranno comunicate le condizioni particolari dei nostri Concessori di licenza applicabili ai suoi CGU.

12.	Code of Conduct

Fermo restando quanto sopra, l'utente riconosce e accetta che i CGU derivati che ha creato includono contenuti, beni ed elementi appartenenti a Focus Entertainment e / o ai Concessori di licenza. Questi CGU sono opere derivate da opere preesistenti i cui diritti sono detenuti da Focus o dai suoi Concessori di licenza. Nessuna disposizione del presente Contratto di Licenza, né di qualsiasi altro documento applicabile al presente rapporto contrattuale, concede o assegna all'utente una cessione o un trasferimento di diritti (inclusi tutti i Diritti di Proprietà Intellettuale) su tali opere preesistenti utilizzate per la creazione dei CGU derivati, che rimarranno di proprietà di Focus Entertainment e/o dei suoi Concessori della licenza. Di conseguenza, i CGU derivati da opere preesistenti non potranno essere oggetto di alcun utilizzo senza l’autorizzazione espressa di Focus e/o dei suoi Concessori della licenza.

Focus Entertainment is not required to exercise any control or evaluation of the UGCs.  As such, you declare and accept that you have full and complete responsibility for the UGCs that you create or generate and that Focus Entertainment cannot be held responsible for the latter.

12.	Codice di Condotta

You are solely responsible for the comments, opinions or remarks expressed in a Terms of Use, which do not represent in any way those of Focus Entertainment. In particular, and without limiting the scope of the previous provision, Focus Entertainment cannot be held responsible for comments, opinions or remarks expressed in a UGC and it excludes any liability in this regard within the limit of applicable laws and regulations.

Focus Entertainment non è tenuta a effettuare controlli o valutazioni dei CGU.  In tale ambito, l'utente dichiara e accetta di assumersi la piena e completa responsabilità del CGU che crea o genera e riconosce che Focus Entertainment non può essere ritenuta resposnabile di tale CGU.

In addition, you agree and undertake not to create and share a UGC that, in a non-limiting manner:

L'utente è l'unico responsabile di eventuali commenti, opinioni o osservazioni espressi in un CGU e questi non rappresentano in alcun modo quelli di Focus Entertainment. In particolare, e senza limitare l'estensione di quanto disposto sopra, Focus Entertainment non può essere ritenuta responsabile per eventuali commenti, opinioni o osservazioni espresse in un CGU e declina qualsiasi responsabilità al riguardo nei limiti delle leggi e dei regolamenti applicabili.

o	May be illegal or likely to result in civil or criminal liability;
o	May infringe the copyrights, trademarks, patents or any other intellectual and/or industrial property rights of a third party;
o	May facilitate piracy, including any request for keys, CDs or pirated software;
o	May include computer viruses, worms, logic bombs or other malicious software or harmful data;
o	May be abusive, seditious, pornographic, offensive, homophobic, defamatory, insulting, slanderous, inaccurate, discriminatory, obscene, provocative or racist;
o	May be likely to harass a person;
o	Could be considered marketing or commercial communication or promotion of products or services from someone other than Focus Entertainment;
o	Would be likely to encourage illegal or unlawful activities, including but not limited 
to: solicitation, gambling or the sale of prescription drugs;
o	May be aimed at minors or attempting to arrange meetings with minors with the intention of sexually abusing them, or whose object or effect would be to obtain such a meeting;
o	May contain restricted material, including but not limited to passwords, medical information or confidential information about any person;
o	In general, may contravene any law or regulation in force
in the country of use of the Multimedia Program;
o	May solicit, invite, encourage, recommend, incite or trigger any of the
previous actions.

limitarsi a esse, istigazione, gioco d'azzardo o vendita di medicinali soggetti a prescrizione medica;
o	sia rivolto a persone minorenni o promuova l'organizzazione di incontri con minorenni con l’intenzione di abusarne sessualmente o il cui obiettivo o effetto sia quello di ottenere un tale incontro;
o	contenga elementi riservati, tra cui, a titolo esemplificativo ma non esaustivo, password, informazioni sanitarie o riservate su qualsiasi persona;
o	in generale, violi qualsiasi legge o regolamento in vigore
nella nazione di utilizzo del Programma Multimediale;
o	possa promuovere, invitare, incoraggiare, raccomandare, incitare o innescare una delle
situazioni precedenti.

Focus Entertainment reserves the right to delete, restrict, suspend or modify any UGC (as well as the possibility of sharing or creating the UGC online) as well as to terminate the Licence Agreement, in particular in the event that a UGC is reported to it by a third party, if it appears that such a UGC does not comply with the applicable laws or regulations or the provisions of this Licence Agreement and more particularly Articles 11 and 12 and Appendix 2.

Focus Entertainment may use any other anti-cheat software of its choice, and in particular the Easy Anti-Cheat service implemented by the company Kamu, via client software ("Client Software") integrated into the Multimedia Program. 
In the case of the Easy Anti-Cheat service, when you start a new game session, the latest version of the Client Software is automatically loaded and installed on your computer or any other machine that may read the Multimedia Program ("Unit"). When you use the Multimedia Program on your Unit, it is monitored by Easy Anti-Cheat, which analyses the binary codes of the game and scans the memory for the purpose of detecting and preventing any cheating within the game ("Purpose"). For the requirements of this Purpose, Easy Anti-Cheat retains and processes information relating to the cheating methods used in the game ("Data"). This Data may contain personal data about you, as detailed in the Kamu privacy statement.

14.1.1.	Software anti-truffa

Easy Anti-Cheat's processing activities include automated decision-making, which can have a significant impact on your gaming experience, including game blocking in the event of a proven cheat. The Data will only be used for the Purposes referred to in this Article 9.5.1, including but not limited to the identification and blocking of the accounts of players cheating during a game session, the analysis of cheat codes and behaviour as well as the sharing of Cheat Data with Easy Anti-Cheat affiliates.

Quando l'utente utilizza il Programma Multimediale sulla propria Unità, viene eseguito anche Easy Anti-Cheat che analizza i codici binari del gioco e scansiona la memoria per rilevare e prevenire eventuali truffe all'interno del gioco (“Finalità”). In the event of a malfunction or disruption in the use of the Multimedia Program related to the use of anti-cheat software, you may choose to terminate the Licence Agreement under the conditions provided for in Article 8.

14.1.2.	Additional paid servers

L’utilizzo di software anti-truffa può causare malfunzionamenti o interruzioni nell'utilizzo del Programma Multimediale, ma tali situazioni non sono di competenza e non ricadono nella responsabilità di Focus Entertainment ma dell'editore del Client Software. In caso di malfunzionamento o di interferenza nell'utilizzo del Programma Multimediale legato all'utilizzo di un software anti-truffa, l'utente potrà scegliere di risolvere il Contratto di Licenza alle condizioni previste all'articolo 8.

Certain Multimedia Programs may offer you, on a fee-paying or free basis, the option to create your own server, allowing you in particular to administer games (public or private), to invite or refuse other players, and to set rules specific to each game (hereinafter "Dedicated Servers").

This Licence Agreement may be modified unilaterally by Focus Entertainment if necessary (i) to take into account the technical evolution of the Multimedia Program or the medium on which it is used, (ii) for legal, regulatory, technical or security reasons or (iii) if the modifications made are not to your disadvantage and respect the initial contractual balance.

Changes to the main obligations of this Licence Agreement that may modify the subject of the Agreement, as described in Article 1, are excluded from the right to unilateral modification.

You will be informed at least four (4) weeks in advance of changes to the Licence Agreement by email to the address sent to the Seller when purchasing the Multimedia Program. If you do not object to the changes within four (4) weeks of receipt of the notification, the changes shall be considered accepted with future effect.  If, on the other hand, you oppose the modifications, Focus Entertainment shall reserve the right to terminate this contractual relationship with two (2) weeks' notice, provided that you have been informed of the consequences of refusing the modifications and this right of termination. In this case, you will no longer be able to download and/or use the Multimedia Program.

Le modifiche agli obblighi principali del presente Contratto di Licenza che potrebbero modificare l’oggetto del Contratto descritto all'articolo 1, sono escluse dal diritto alla modifica unilaterale.

Qualora, invece, l'utente si opponga alle modifiche, Focus Entertainment si riserva il diritto di risolvere il presente rapporto contrattuale con un preavviso di due (2) settimane, a condizione che l'utente sia stato informato delle conseguenze del rifiuto delle modifiche e del presente diritto di risoluzione. In tal caso, l'utente non potrà più scaricare e/o utilizzare il Programma Multimediale.

To the extent permitted by the local law applicable in the country where you use and/or have acquired the Multimedia Program, this Licence Agreement is governed by French law.
In the event that the French law cannot be applied in the country where you use and/or have acquired the Multimedia Program, the following provisions shall apply:

o	If the acquisition of this Multimedia Program has taken place in Canada: this Licence Agreement is governed in accordance with the laws in force in the Province of Ontario, Canada, unless expressly prohibited by local law; and, in connection with any dispute arising hereunder, you expressly agree to submit to the jurisdiction of the federal and provincial courts sitting in Toronto, Ontario;
o	If the acquisition of your Multimedia Program took place in a completely different country: the local law shall apply.

Pursuant to Articles 1641 to 1649 of the French Civil Code, consumers and non-specialist professional customers also benefit from the guarantee against hidden defects that occurs when the property is unfit for the use for which it is intended, or that reduces this use so much that you would not have acquired it or would have given only a lower price, if you had known thereof. A defect is said to be hidden when you do not detect it during a simple examination. You have 2 years from its discovery to make a claim in line with the guarantee. In any case, you must provide proof of the hidden defect (i.e. an expert report). This guarantee gives you the right to a price reduction if the Digital Service is retained, or to a full refund in exchange for the waiver of the Digital Service.

Your Creative Content shall only use Game Content as officially released by Focus Entertainment. Any leaks or unauthorized disclosure of Our Game Content prior to official release is strictly prohibited. After the release of any of our game, you shall not post spoilers that would ruin the experience for others without a “Spoiler Alert” mention.

You shall not promote your Creative Content, even implicitly, as official, sponsored, or approved content by Focus Entertainment unless you have been expressly endorsed by Focus Entertainment.
Desynchronized audio assets taken from Our Game Content such as soundtracks, items, and voices  shall not be used separately from the images of Our Game Content. Besides, soundtrack, music and songs used in Our Game Content may not be owned by us, but licensed to Focus Entertainment by a third party. The latter may therefore take all measures to enforce their rights in the event that, in particular, you put a video online reproducing the soundtrack in whole or in part on a video and content sharing site, without having obtained prior special authorization.  Note that if you upload a video on a video and content sharing website reproducing the soundtrack as a whole or partially, your Creative Content may be the subject to a copyright/DMCA strike.

-	Informazioni riservate: per la tua sicurezza, non condividere pubblicamente nessuna delle tue informazioni private, come i registri del tuo account o qualsiasi altra informazione personale (indirizzo postale o e-mail; numero ID; numero di telefono, ecc.), con altri giocatori sui social media o su qualsiasi piattaforma di condivisione dei contenuti.

-	No offensive language: Do not use any language or expressions that upset, embarrass, insult or discriminate people with regards, notably, to their gender, age, origin, ethnicity, physical ability, socioeconomic status, sexual orientation, religion, or political leanings.
-	No violent language: Do not use any  violent, threatening, intimidating, invasive, degrading language or expressions and/or induce fear, shame or blame in other players.
-	Harassment: Any forms of psychological or sexual harassment, attempted intimidation, threats, obscene or inappropriate behavior especially towards minors are strictly prohibited. 
-	Private Information:  For your own safety, do not publicly share any of your private information, such as your account logs or any other personal information (postal or email address; ID number; telephone number,etc.), with other players on social media or any content sharing platforms. 
-	Cheating: No cheating, which includes (without limitation) the exploitation of in-game bugs, use of third-party software or any other methods to create an advantage beyond normal gameplay, will be tolerated
-	Account or Identity Theft: Do not pretend to be someone other than yourself. You may not hack into another player's account or impersonate them on social media, during a competition or while playing one of our games. Similarly, you may not impersonate a representative of Focus Entertainment or speak on our behalf without our express prior consent.

-	Allontanamento dalla modalità online del gioco: possiamo limitare o rimuovere completamente tutti gli accessi alla modalità online/competitiva dei nostri Giochi, sospendere la partecipazione a una competizione per un determinato periodo o permanentemente a seconda della gravità delle violazioni.
-	Allontanamento dalle nostre operazioni di marketing:  possiamo sospendere, temporaneamente o permanentemente, qualsiasi partecipazione a campionati, tornei, test di gioco o qualsiasi altra operazione di marketing.

Any violation of this Code of Conduct is the responsibility of the account holder used to commit it and exposes the perpetrator to any of the following sanctions:
