 — CONTRATO DE LICENÇA DE USUÁRIO FINAL

Thank you for your interest in Magic: The Gathering Arena ("MTGArena")! This End User License Agreement ("Agreement") is a contract between you and Wizards of the Coast, LLC (“Wizards”) and, together with the general Terms, explains the terms and conditions under which you are licensed to download, install, and use MTG Arena and related services.

Este Contrato de Licença de Usuário Final ("Contrato") é um contrato entre você e a Wizards of the Coast LLC ("Wizards") e, junto com os Termos Gerais, explica os termos e as condições sob as quais você está licenciado para baixar, instalar e usar o MTG Arena e serviços relacionados.

By accessing or using the Game Services (defined below) you: (1) acknowledge and agree that you have read and understand this Agreement, the General Terms as well as Wizards' Privacy Policy, Code of Conduct, and Fan Content Policy which are incorporated herein by this reference (for purposes of this Agreement, collectively, the "Terms"); (2) agree to be bound by them; and (3) represent and warrant that you have the authority to accept them. If you don't agree with or can't accept all of the terms of this Agreement, you MAY NOT download, install, use, or participate in the Game Services.

Ao acessar ou utilizar os Serviços de Jogo (definidos abaixo), você: (1) reconhece e concorda que leu e entendeu este Contrato, os Termos Gerais, bem como a  Política de Privacidade, Código de Conduta da Wizards, e Política de Conteúdo de Fã, os quais são incorporados aqui por esta referência (para fins deste Contrato, coletivamente os "Termos"); (2) concorda em ser vinculado por eles; e (3) declara e garante que você tem autoridade para aceitá-los. MTG ARENA; THIS AGREEMENT
1.1. This Agreement is a legally binding contract between you and Wizards and applies to MTG Arena, the Software (defined below), and all related Services (defined below) regardless of how (e.g., different platform, medium, online, offline) you access or use them (all these collectively are the "GameServices").

1.1. Este Contrato é um contrato legalmente vinculativo entre você e a Wizards e se aplica ao MTG Arena, ao Software (definido abaixo) e a todos os Serviços relacionados (definidos abaixo), independentemente de como (p. e., plataforma diferente, meio, online, offline) você os acessa ou usa (todos esses são coletivamente os "Serviços de Jogo").

1.2. Defined Terms.

1.2.1. "Software" means the proprietary software application known as Magic: The Gathering Arena, and any patches, updates, and upgrades to the application, and all related content and documentation made available to you by Wizards under this Agreement, including but not limited to all software code, titles, themes, objects, characters, names, dialogue, catch phrases, locations, stories, artwork, animation, concepts, sounds, audio-visual effects, methods of operation, and musical compositions that are related to the application, and any copies of any of the foregoing. Software specifically includes all Virtual Currency and Virtual Items for which you have paid the associated fee or otherwise acquired a license under Section 2.

1.2.1. "Software" significa o aplicativo de software proprietário conhecido como Magic: The Gathering Arena, e quaisquer patches, atualizações e upgrades para o aplicativo e todo o conteúdo e documentação relacionados disponibilizados para você pela Wizards sob este Contrato, incluindo, mas não se limitando a todos os códigos de software, títulos, temas, objetos, personagens, nomes, diálogos, bordões, locais, histórias, obras de arte, animação, conceitos, sons, efeitos audiovisuais, métodos de operação e composições musicais relacionadas ao aplicativo e a quaisquer cópias de qualquer um dos acima expostos. O Software especificamente inclui toda a Moeda Virtual e Itens Virtuais pelos quais você pagou os custos correspondentes ou conseguiu uma licença de outra forma de acordo com a Seção 2.

1.2.2. "Services" means any services made available to you through or in connection with the Software, including but not limited to services to acquire, maintain and use Virtual Currency and Virtual Items, user accounts, customer support, forums, websites, and other services we provide you.
VIRTUAL ITEMS AND CURRENCY
2.1. Availability. From time to time, we may allow you to acquire a limited license to access virtual in-game currency or items related to the Game Services. Wizards is the sole provider an issuing authority of Virtual Items and Virtual Currencies related to the Game Services and only MTG Arena users can use them. Please see Section 7 of the General Terms for the full rules regarding Virtual Items and Virtual Currencies.

1.2.2. "Serviços" significa quaisquer serviços disponibilizados a você por meio ou em conexão com o Software, incluindo, mas não se limitando a, serviços para adquirir, manter e usar Moeda Virtual e Itens Virtuais, contas de usuário, suporte ao cliente, fóruns, sites, e outros serviços que oferecemos a você.

2.2. Virtual In-Game Currency. Virtual Currency in the Game Services may include:
Gold, which you can earn by playing the Game; or
Gems, which you can purchase with real-world money or earn by completing certain in-game activities or achievements.
2.3. Virtual In-Game Items. We may, from time to time, allow you to acquire a limited license to access virtual items related to the Game Services, which may include but are not limited to virtual Magic: The Gathering cards, booster packs, draft packs, cosmetics and enhancements (i.e., vanity items), events, and other downloadable content ("VirtualItems"). We may allow you to access Virtual Items in various ways including but not limited to (a) purchasing a limited license to use the Virtual Item for a fee (i.e., "real-world" money); (b) redeeming a limited license to use Virtual Item with Virtual Currency; or (c) earning a limited license to use Virtual Items by performing or accomplishing specific tasks in the Game Services (e.g., event rewards, Vault rewards, Wildcard Rewards etc.).

2.2. Moeda Virtual em Jogo. Moeda Virtual nos Serviços de Jogo podem incluir:

2.4. Distribution and Drop Rates for Virtual Items. Wizards publishes the rarity distribution and drop rates of Virtual Items you may redeem or unlock in the Game Services. You will find information regarding the distribution and drop rates of Virtual Items and Virtual Currency here. From time to time, may run special events or promotions with special features or offerings in connection with the Game Services. Specific details and terms regarding the Virtual Items and Virtual Currency related to such promotions are detailed in applicable point of sale information or on our promotions page and are incorporated by this reference.
TOURNAMENTS; EVENTS.
3.1. Availability. Wizards may offer many types of events, leagues, tournaments, formats, promotions and game types (collectively, "Events") in connection with the Game Services. Certain types of Events may not be available in all locations or jurisdictions. By using the Game Services, you acknowledge and agree that Wizards may, in its sole discretion, start, end, modify, or limit any Event at any time and for any reason or for no reason with no liability to you. Wizards reserves the right, at its sole discretion, to adjudicate any Event result. As an example, if a player drops from a match during a tournament or event, we may award the match win and any accompanying Virtual Items or Virtual Currency to the non-dropping player.

2.4. Distribuição e Taxas de Ocorrência para Itens Virtuais. A Wizards publica a raridade de distribuição e as chances de encontro dos Itens Virtuais que você pode resgatar ou desbloquear nos Serviços de Jogo. De tempos em tempos, podemos organizar eventos especiais ou promoções com funções ou ofertas especiais em conjunto com os Serviços de Jogo. TORNEIOS; EVENTOS.
3.1. A Wizards pode oferecer muitos tipos de eventos, ligas, torneios, formatos, promoções e tipos de jogos (coletivamente, "Eventos") em conexão com os Serviços de Jogo. Certos tipos de Eventos podem não estar disponíveis em todos os locais e jurisdições. 3.2. Eligibility. By participating in an Event, you represent and warrant that you are eligible to participate and are physically located in a region in which participation in the tournaments offered through the Game Service is unrestricted by law. You are subject to all laws of the state, province, country, and region in which you reside and from which you access the Game Service and you are solely responsible for obeying those laws. You agree that Wizards cannot be held liable if laws applicable to you restrict or prohibit your participation. Wizards makes no representations or warranties, implicit or explicit, as to your legal right to participate in any tournament offered on or through the Game Service, nor will any person affiliated with or claiming affiliation with Wizards have authority to make any such representations or warranties. LICENSE GRANT. Subject to your compliance with the Terms, Wizards grants you a limited, non-exclusive, non-transferable, revocable, non-sublicensable license to download and install a copy of the Software on a compatible device that you own or control and to run such copy of the Software solely for your personal entertainment and non-commercial purposes. You may not copy the Software, except for making a reasonable number of copies for backup or archival purposes. Wizards reserves all rights in and to the Game Services not expressly granted to you under this Agreement. Additional Terms for Software Distributed Via Google Play or Apple App Store. If you accessed or downloaded the Software from the Apple App Store, then you agree to use the Software only: (i) on an Apple-branded product or device that runs iOS (Apple’s proprietary operating system software); and (ii) as permitted by the “Usage Rules” stated in the Apple Media Services Terms and Conditions. If you accessed or downloaded the Software from any app store or distribution platform (like the Apple App Store or Google Play) (each, an “AppProvider”), then you acknowledge and agree that: This Agreement is between you and Wizards, and not with the App Provider; between Wizards and the App Provider, Wizards is solely responsible for the Software. It is not the App Provider’s responsibility to provide any maintenance or support services for the Software. If the Software fails to conform to any applicable warranty, you may notify the App Provider and the App Provider may refund the purchase price for the Software to you (if applicable) and, to the maximum extent permitted by applicable law, the App Provider will have no other warranty obligation whatsoever with respect to the Software. Any other claims, losses, liabilities, damages, costs or expenses attributable to any failure of the Software to conform to any warranty will be the sole responsibility of Wizards. The App Provider is not responsible for addressing any of your claims or any third party’s claims relating to the Software or your possession and use of the Software, including, but not limited to: (1) product liability claims; (2) any claim that the Software fails to conform to any legal or regulatory requirement; and (3) claims arising under consumer protection or similar legislation. If there is a third-party claim that the Software or your possession and use of the Software infringes that third party’s intellectual property rights Wizards will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim to the extent required by this Agreement. The App Provider and its subsidiaries are third-party beneficiaries of these Terms as they relate to your license of the Software. Upon your acceptance of these Terms, the App Provider will have the right (and will be viewed to have accepted the right) to enforce these Terms as related to your license of the Software against you as a third party beneficiary of these Terms. You must also comply with all applicable third-party terms of service and policies when using the Software. 6. OTHER TERMS.

3.2. Elegibilidade. Ao participar de um Evento, você representa e garante que você é elegível para participar e está fisicamente localizado na região em que a participação nos torneios oferecidos através dos Serviços de Jogo estão liberados pela lei. Você está sujeito a todas as leis do estado, província, país, e região em que reside e de onde acessará os Serviços de Jogo e é o único responsável por obedecer tais leis. Você concorda que a Wizards não pode ser responsabilizada se as leis aplicáveis a você restringem ou proíbem sua participação. A Wizards não se compromete ou dá garantias, implícitas ou explicitas, quanto ao seu direito legal de participar de qualquer torneio oferecido pelo ou através dos Serviços de Jogo, o mesmo valendo para qualquer pessoa afiliada a ou alegando afiliação com a Wizards tem autoridade a fazer tais compromissos ou garantias. GARANTIA DE LICENÇA. Sujeito à sua conformidade com os Termos, a Wizards concede a você uma licença limitada, não exclusiva, não transferível, revogável e não sublicenciável para baixar e instalar uma cópia do Software em um dispositivo compatível que você possui ou controla e para executar tal cópia do Software exclusivamente para seu entretenimento pessoal e fins não comerciais. Você não pode copiar o Software, exceto para fazer um número razoável de cópias para fins de backup ou arquivamento. A Wizards reserva todos os direitos nos e para os Serviços de Jogo não expressamente concedidos a você sob este Contrato. Termos Adicionais para Software Distribuído via Google Play ou Apple App Store. Se você acessou ou baixou o Software da Apple App Store, concorda em usar o Software apenas: (i) em um produto ou dispositivo da marca Apple que execute iOS (software de sistema operacional proprietário da Apple); e (ii) conforme permitido pelas “Regras de Uso” declaradas nos Termos e Condições dos Serviços de Mídia da Apple. Se você acessou ou baixou o Software de qualquer loja de aplicativos ou plataforma de distribuição (como a Apple App Store ou Google Play) (cada um, um "Provedorde Aplicativos”), então você reconhece e concorda que: Este Contrato é entre você e a Wizards, e não com o Provedor de Aplicativos; entre a Wizards e o Provedor de Aplicativos, a Wizards é a única responsável pelo Software. Não é responsabilidade do Provedor de Aplicativos fornecer qualquer serviço de manutenção ou suporte para o Software. Se o Software não estiver em conformidade com qualquer garantia aplicável, você pode notificar o Provedor de Aplicativos e o Provedor de Aplicativos pode reembolsar o preço de compra do Software para você (se aplicável) e, na extensão máxima permitida pela lei aplicável, o Provedor de Aplicativos não terá nenhuma outra obrigação de garantia com relação ao Software. Após sua aceitação destes Termos, o Provedor de Aplicativos terá o direito (e será considerado como tendo aceitado o direito) de fazer cumprir estes Termos relacionados à sua licença do Software contra você como terceiro beneficiário destes Termos. Você também deve cumprir todos os termos de serviço e políticas de terceiros aplicáveis ao usar o Software. 6. OUTROS TERMOS.

6.1. Entire Agreement. This Agreement, together with the General Terms, constitutes and contains the entire agreement between the parties with respect to the Game Services and supersedes any prior agreements.

Copyright and Trademark Notice: Wizards of the Coast, Magic: The Gathering Arena, Magic: The Gathering, and their respective logos are trademarks or registered trademarks of Wizards and its affiliates in the United States and elsewhere. The MTG Arena interactive game and all files that are made available to you by Wizards (via any medium) to "patch," update, or otherwise modify the software together with all copies and derivative works of that software program is the copyrighted work of Wizards or its licensors. MTG Arena is protected by United States law and international treaties, conventions, and other laws, and may contain certain licensed materials in which Wizards' licensors may enforce their rights in the event this Agreement is violated. Any rights not expressly granted herein are reserved to Wizards.

6.2. Aviso de copyright e marca registrada: Wizards of the Coast, Magic: The Gathering Arena, Magic: The Gathering, e seus respectivos logos são marcas comerciais ou marcas registradas da Wizards e suas afiliadas nos Estados Unidos e em outros lugares. O jogo interativo MTG Arena e todos os arquivos disponibilizados a você pela Wizards (via qualquer meio) para "corrigir", atualizar ou modificar o software, juntamente com todas as cópias e trabalhos derivados desse programa de software, são trabalhos com direitos autorais da Wizards ou seus licenciadores. MTG Arena está protegido pelas leis dos Estados Unidos e tratados fiscais internacionais, convenções, e outras leis, e pode conter certos materiais licenciados que dão à Wizards poderes de fazer valer seus direitos caso este Contrato seja violado.
