This End User License Agreement (this “Agreement”) is a contract between you and either Bandai Namco Entertainment Inc. (“BNEI”), Bandai Namco Entertainment America Inc. (“BNEA”) or Bandai Namco Entertainment Europe S.A.S. (“BNEE”) as applicable (in either case, “Bandai Namco”, “us”, “we” or “our”) and applies to your access to, and use of, the game in uno Stato membro dell'Unione Europea, è soggetto ad alcune clausole aggiuntive. IN THE EVENT OF SLIGHT OR ORDINARY NEGLIGENCE, OR BREACH OF BANDAI NAMCO’S ESSENTIAL OBLIGATIONS UNDER THIS AGREEMENT, THE BANDAI NAMCO PARTIES’ LIABILITY SHALL BE LIMITED TO DIRECT AND FORESEEABLE DAMAGES SUFFERED BY YOU. IN NO EVENT SHALL THE AGGREGATE LIABILITY OF THE BANDAI NAMCO PARTIES, WHETHER IN CONTRACT, WARRANTY, TORT, PRODUCT LIABILITY, STRICT LIABILITY, INTELLECTUAL PROPERTY INFRINGEMENT OR OTHER THEORY, ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE THE GAME OR TO THESE TERMS EXCEED THE GREATER OF: (i) ONE HUNDRED DOLLARS ($100); OR (ii) THE AMOUNT PAID BY YOU TO BANDAI NAMCO FOR THE GAME (INCLUDING ANY GAME CURRENCY OR CONTENT) IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE DATE ON WHICH YOU FIRST ASSERT A CLAIM. IN CASO DI COLPA DI LIEVE O MODESTA ENTITÀ O DI VIOLAZIONE DEGLI OBBLIGHI FONDAMENTALI DI BANDAI NAMCO PREVISTI DAL PRESENTE ACCORDO, LA RESPONSABILITÀ DI BANDAI NAMCO SI LIMITA AL RISARCIMENTO DEI DANNI DIRETTI E PREVEDIBILI SUBITI DALL'UTENTE. IN NESSUN CASO LA RESPONSABILITÀ AGGREGATA DELLE PARTI DI BANDAI NAMCO, PREVISTA DA CLAUSOLE CONTRATTUALI, GARANZIE, ILLECITI CIVILI, RESPONSABILITÀ DI PRODOTTO, RESPONSABILITÀ OGGETTIVA, VIOLAZIONE DELLA PROPRIETÀ INTELLETTUALE O ALTRE DOTTRINE GIURIDICHE E DERIVANTE DA O CONNESSA ALL'UTILIZZO O AL MANCATO UTILIZZO DEL GIOCO E AI PRESENTI TERMINI, PUÒ SUPERARE: (i) I CENTO DOLLARI (100 $) O (ii) LA SOMMA PAGATA DALL'UTENTE A BANDAI NAMCO PER UTILIZZARE IL GIOCO (IVI COMPRESI LA VALUTA O I CONTENUTI DEL GIOCO) NEI SEI (6) MESI IMMEDIATAMENTE PRECEDENTI LA DATA IN CUI L'UTENTE HA AVANZATO IL RECLAMO LA PRIMA VOLTA. SE L'UTENTE NON HA CORRISPOSTO ALCUN PAGAMENTO NEI CONFRONTI DI BANDAI NAMCO DURANTE TALE PERIODO DI TEMPO, L'UNICO RIMEDIO A DISPOSIZIONE DELL'UTENTE (E LA RESPONSABILITÀ ESCLUSIVA DI BANDAI NAMCO) PER QUALSIASI CONTROVERSIA CON BANDAI NAMCO CONSISTE NELL'INTERROMPERE L'UTILIZZO DEL GIOCO.
