                End User License Agreement 
                (EULA)<br>
                ("EULA") is an agreement between you and SMOOTHEA Corporation, whose head office is in Nagoya, Aichi, Japan ("SMOOTHEA," "we," "us," or "our"), governing your use of LIMSCAPE, including the version distributed through Steam, its software, updates, online features, and related services (collectively, "LIMSCAPE").<br><br>By installing, accessing, or using LIMSCAPE, you agree to this EULA. If you do not agree, do not install or use LIMSCAPE.<br><br>1. Steam and this EULA<br><br>Your use of Steam, your Steam account, and purchases made through Steam are also governed by the Steam Subscriber Agreement and applicable Steam policies.

                EULA supplements those terms. If there is a conflict concerning Steam, your Steam account, or a Steam transaction, the Steam Subscriber Agreement and applicable Steam policies control.<br><br>2. Licence and gameplay videos<br><br>Subject to this EULA and your valid Steam licence, SMOOTHEA grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use LIMSCAPE for personal, non-commercial entertainment and creative use.<br><br>LIMSCAPE is licensed, not sold. SMOOTHEA and its licensors retain all rights, title, and interest in LIMSCAPE and its content that are not expressly granted to you by this EULA.<br><br>You may publish ordinary gameplay videos, livestreams, and screenshots. Indirect monetization such as platform advertising revenue, sponsorships, donations, or viewer tips is permitted. You may not sell, redistribute, or charge for access to LIMSCAPE itself or its assets.<br><br>3. Your responsibilities and prohibited conduct<br><br>You must comply with applicable law and must not:<br><br>- copy, distribute, sell, rent, lease, sublicense, or commercially exploit LIMSCAPE except where applicable law expressly permits it;<br>- reverse engineer, decompile, disassemble, modify, or create derivative works from LIMSCAPE except where applicable law expressly permits it;<br>- bypass licence checks, technical protections, access controls, or session restrictions;<br>- use cheats, automation, malicious code, or any activity that damages, disrupts, overloads, or interferes with LIMSCAPE, its services, or other users;<br>- impersonate another person, provide false information, or use LIMSCAPE to threaten, defame, discriminate against, harass, or otherwise harm others; or<br>- use LIMSCAPE for unlawful, abusive, or infringing activity.<br><br>If you are a minor, you must obtain consent from a parent or legal guardian where required by law. Users under 13 may not use LIMSCAPERS or other online features without parental or guardian consent.<br><br>4. LIMSCAPERS and

                Content<br><br>LIMSCAPE may connect to LIMSCAPERS and related features that let users create, save, upload, download, post, share, or otherwise make available levels, files, text, images, and other material ("User Content"). You are responsible for your User Content and represent that you have all rights and permissions needed to create, use, upload, and share it.<br><br>You must not submit User Content that infringes another person's intellectual property, privacy, publicity, or other rights; is unlawful; is sexual or adult content; is hateful, discriminatory, harassing, excessively violent, or otherwise inappropriate; or contains malware or malicious code.<br><br>You retain any rights you have in your User Content. By making User Content available through LIMSCAPERS or another LIMSCAPE sharing feature, you grant SMOOTHEA a non-exclusive, worldwide, royalty-free licence, including the right to authorize service providers and platform partners where reasonably necessary, to host, reproduce, adapt

                technically necessary, display, distribute, and otherwise use that User Content solely to operate, improve, promote, moderate, and provide those features. Content you choose to publish or share may be available to other users as the relevant feature permits.<br><br>We may refuse to publish, remove, modify, restrict, or make private User Content that we reasonably believe violates this EULA, applicable law, another person's rights, or feature rules. We are not obligated to monitor, store, or back up User Content. Keep your own backups.<br><br>If you make User Content public or enable an Allow Branch or similar setting, you also grant other users a non-exclusive, royalty-free licence to view, download, play, and, only within the permissions shown by LIMSCAPE, branch, remix, or edit that User Content. Content settings and feature permissions apply. Deleting or making content private may not immediately remove technically or legally necessary backups, audit records, or branches that were lawfully created before the change.<br><br>5. Multiplay, privacy, recording, and streaming<br><br>LIMSCAPE may provide optional Multiplay features through LIMSCAPERS. Some Multiplay features are beta features and may change, be unavailable, or be discontinued.<br><br>Open Multiplay rooms may be joined by an unspecified number of participants. Camera and microphone use are off by default. When camera video
                 is 
                enabled in Open Multiplay, LIMSCAPE applies 
                a 
                legal contract
                privacy overlay intended to make you and your background difficult to identify while preserving the feeling of presence. The overlay is a privacy aid, not a guarantee of anonymity.<br><br>Recording, streaming, and sharing gameplay are not generally prohibited. You must not use recordings, videos, streams, voice, video, or any other feature to share personal information, identify or attempt to identify another participant, dox, harass, threaten, or otherwise harm another person. In Private Multiplay, where trusted participants may use video-overlay settings more freely, obtain a participant's permission before recording, sharing, or publishing that participant's voice or video.<br><br>You are responsible for your interactions with other participants. Do not share personal information unless you choose to do so, and respect the privacy and rights of others.<br><br>6. Online services, updates, and availability<br><br>LIMSCAPE may require an internet connection for some features. Online features, LIMSCAPERS, Multiplay, downloads, and related services may be updated, changed, suspended, or discontinued at any time. We do not guarantee that any feature will always be available, uninterrupted, secure, error-free, or compatible with every device, operating system, network, or third-party service.<br><br>Updates may be installed automatically through Steam or otherwise made available. Continued use after an update may be required to access some features.<br><br>You are responsible for confirming that your device and system meet the requirements shown on the Steam store page or other official LIMSCAPE materials.<br><br>7. Third-party services and materials<br><br>LIMSCAPE may include or interact with third-party software, services, content, or websites. Their separate terms and privacy policies may apply. SMOOTHEA is not responsible for third-party services or materials except where liability cannot be excluded under applicable law.<br><br>8. Files, assets, and scripts<br><br>Assets imported into LIMSCAPE may be converted to proprietary formats or encrypted, but we do not guarantee complete protection from extraction or misuse. Some formats or feature paths may remain unencrypted. You are responsible for your originals, backups, and rights clearance.<br><br>Video files, including MP4, MOV, and similar formats, may remain unencrypted. Do not upload, publish, or share an unmodified or insufficiently transformed video file unless you have all rights and permissions required for that distribution. The fact that source material is free to use does not by itself authorize public redistribution through LIMSCAPE or LIMSCAPERS. You are responsible for confirming the licence terms of every included video and other imported asset.<br><br>`.limscape` project files are intended for the LIMSCAPE environment. You may not extract SMOOTHEA or third-party assets for reuse, redistribution, or sale in another product. This does not restrict lawful use of your own original assets.<br><br>If you use JavaScript, script runners, automation, or similar execution features, you are responsible for reviewing code and results and maintaining backups and security. You must not create, distribute, or execute malware, unauthorized access, data theft, service disruption, or code that acts on another user without permission.<br><br>9. Suspension and termination<br><br>If you materially breach this EULA, we may suspend or restrict your access to online services, LIMSCAPERS, Multiplay, or other connected features to the extent reasonably necessary. This EULA ends automatically if you no longer have a valid licence to use LIMSCAPE or if your use is lawfully terminated.<br><br>Sections that by their nature should survive termination, including sections on ownership, User Content, disclaimers, limitations of liability, and governing law, will survive.<br><br>10. Disclaimers and limitation of liability<br><br>To the maximum extent permitted by applicable law, LIMSCAPE is provided "as is" and "as available." SMOOTHEA disclaims all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and uninterrupted or error-free operation.<br><br>To the maximum extent permitted by applicable law, SMOOTHEA will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business opportunity arising from or related to LIMSCAPE. Nothing in this EULA excludes or limits liability that cannot be excluded or limited under applicable law, including mandatory consumer rights.<br><br>11. Changes to this EULA<br><br>We may update this EULA when reasonably necessary, including to reflect changes to LIMSCAPE, law, or our services. The updated EULA will be posted through Steam, LIMSCAPERS, or another official LIMSCAPE channel. For material changes, we will provide notice through Steam or another appropriate official channel where required by applicable law. Continued use after an updated EULA takes effect constitutes acceptance to the extent permitted by applicable law.<br><br>12. Governing law and jurisdiction<br><br>This EULA is governed by the laws of Japan, without regard to conflict-of-law rules. The parties will first attempt good-faith resolution. To the extent permitted by applicable law, disputes arising from or relating to this EULA will be subject to the exclusive jurisdiction of the Nagoya District Court as the court of first instance. Mandatory rights available to consumers in their country of residence remain unaffected where applicable.<br><br>13. Severability and entire agreement<br><br>If any provision of this EULA is held invalid or unenforceable, the remaining provisions remain effective. This EULA, together with applicable Steam terms and any documents expressly incorporated by reference, constitutes the entire agreement

                CORPORATION (hereinafter referred to as "the Company") and the user (hereinafter referred to as "the User") 
                regarding 
                the use of 
                LIMSCAPE 
                (hereinafter referred to as "the Game").<br><br>By installing, copying, or using the Game, the User is deemed to have agreed to comply with the terms of
                and supersedes prior agreements on that subject.<br><br>14. Contact<br><br>For questions about
                 this 
                Agreement.<br><br>1. Grant of License<br>The Company grants the User a limited, non-exclusive, non-transferable, and revocable license to use the Game for personal, non-commercial purposes, subject to the terms of this Agreement.<br><br>The User is permitted to publicly stream or share videos of their gameplay (e.g., on platforms such as YouTube or Twitch), as long as such activities do not involve direct monetization of the Game itself (e.g., reselling the game, charging access to gameplay content). However, indirect monetization such as ad revenue, sponsorships, donations, or tips from viewers is permitted.<br><br>2. Intellectual Property Rights<br>All elements of the Game, including but not limited to its content, code, and design, are the property of SMOOTHEA CORPORATION. However, assets distributed under a Creative Commons (CC) license are subject to their respective license terms.<br><br>The User may not modify, copy, distribute, or reverse engineer the Game.<br><br>3. Restrictions<br>The User agrees not to:<br><br>a. Use the Game for commercial purposes without explicit permission from the Company.<br>b. Modify, hack, or exploit the Game in an unauthorized manner.<br>c. Share or distribute any part or all of the Game to third parties, except in the parts and methods permitted by the Company.<br>d. Engage in activities that cause inconvenience to other players in public settings such as online play or sharing of user-generated content.<br>e. Create, share, or publish content that infringes on copyrights, violates public order and morals, or contains discriminatory expressions.<br><br>※ If any of the above actions are discovered, the Company reserves the right to limit or suspend the User's access to online features.<br><br>4. User-Generated Content (UGC)<br>Regarding content created or shared by the User within the Game (hereinafter referred to as "User Content"), the following conditions apply:<br><br>a. The User is solely responsible for ensuring that their User Content does not infringe any third-party intellectual property rights, including but not limited to copyrights, trademarks, or licenses. The User must not include any materials they do not have the rights to use. The User assumes full legal responsibility for the content they create or upload within the Game.<br><br>b. The User grants the Company a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, distribute, publish, and create derivative works from the User Content, including the right to sublicense to third parties for promotional or operational purposes.<br><br>c. The Company reserves the right to monitor User Content and, at its sole discretion, delete, modify, or refuse to publish it. However, the Company is not obligated to monitor or remove User Content.<br><br>d. The User must not include video files (such as .mp4, .mov, or similar) in their User Content if those files are not significantly modified or transformed. Due to technical limitations, such video files are not encrypted by the Game's content protection system, and may constitute unauthorized redistribution even if the original material is free to use. Users are solely responsible for ensuring that any video content they include does not violate the license terms of the original source.<br><br>e. The User must not create or distribute any User Content that is sexually explicit, obscene, excessively violent, promotes hate speech, or violates laws or public order in any jurisdiction. The User bears full legal responsibility for any consequences resulting from the creation or distribution of such content, including violations of laws in other countries.<br><br>f. Even if certain User Content is created for personal use, the User must not attempt to publish or share content that violates community standards—including sexually explicit, violent, discriminatory, or illegal material—through any public distribution features of the Game, including official sharing websites or in-game publishing tools. The Company reserves the right to reject, remove, or restrict access to such content without prior notice, and the User bears full responsibility for any resulting consequences.<br><br>5. Changes and Interruptions to the Service<br>The Company reserves the right to add, change, suspend, or terminate features of the Game at any time. The Company shall not be liable for any damages incurred by the User due to these changes.<br><br>6. Changes to the Agreement<br>The Company may change the contents of this Agreement.                  and the Steam sales page. In the case of significant changes, the Company will notify the User through their Steam account. If the User continues to use the Game after the changes, they are deemed to have agreed to the changes.<br><br>If the User does not agree to the revised Agreement, they must discontinue the use of the Game.<br><br>7. Disclaimer of Warranties<br>The Game is provided "as is," and the Company makes no warranties regarding the accuracy, reliability, suitability, or completeness of the Game, to the maximum extent permitted by applicable law. The User is solely responsible for ensuring that their system meets the requirements to run the Game.<br><br>8. Limitation of Liability<br>The Company shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages arising from the use or inability to use the Game. Additionally, the Company shall not be responsible for any damage to the User's device, data loss, or security vulnerabilities, to the maximum extent permitted by applicable law.<br><br>9. Governing Law and Dispute Resolution<br>This Agreement is governed by the laws of Japan. In the event of any disputes arising from this Agreement, the parties shall engage in sincere discussions to resolve the issue, and if resolution cannot be achieved, the exclusive jurisdiction of the courts of Japan shall apply.<br><br>10. Severability<br>If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions shall continue in full force and effect.<br><br>11. Entire Agreement<br>This Agreement constitutes the entire agreement between the parties regarding the Game and supersedes all prior agreements, whether oral or written.<br><br>12. Age Restrictions<br>If the User is a minor, they must obtain the consent of a parent or legal guardian to use the Game, and in some jurisdictions, use by minors may be restricted or prohibited by local laws.<br><br>13. Technical and Platform-Specific Notes<br>a. Certain asset types (such as FBX, MP3, and JPG) may be converted into proprietary encrypted formats when imported into the Game to help reduce unauthorized redistribution. However, this protection is not absolute. The Company is not responsible for third-party misuse or extraction of these assets.<br><br>b. Video files (e.g., MP4, MOV) cannot be encrypted by the Game’s system. The inclusion of such files in User Content, especially when unmodified, may constitute unauthorized redistribution—even for free materials. Users must verify and take responsibility for all included content.<br><br>c. Saved project files (.limscape and related formats) are intended for use within the LIMSCAPE ecosystem only. Redistribution or reuse of these files on other platforms or for commercial purposes is prohibited without proper authorization.<br><br>d. If scripting or automation features (e.g., JavaScript or other script runners) are available, the User is fully responsible for the behavior and consequences of any such content. The Company disclaims all liability for data corruption or misuse resulting from script execution.<br><br>e. Official publishing websites and in-game sharing services are provided as optional features. These may be modified, suspended, or discontinued at any time without prior notice. The Company does not guarantee the persistence or availability of any shared content and shall not be liable for losses resulting from such changes.
