CONDICIONES DE SERVICIO

Las condiciones de este acuerdo (“Condiciones de servicio”) rigen la relación entre usted y PILI STARSHIP PTE. LTD., una empresa constituida en Singapur (número de identificación comercial 202346742E), con domicilio social en 152 BEACH ROAD #11-05, GATEWAY EAST, SINGAPUR (189721), (en adelante, “PILI”, “nosotros” o “nos”) con respecto al uso que usted haga de los juegos, sitios web y servicios relacionados de PILI (el “Servicio”). El uso del Servicio también se rige por la Política de privacidad de PILI y por otras políticas pertinentes, que se incorporan a este documento por referencia.
Antes de acceder o utilizar el Servicio, incluidos la navegación por cualquier sitio web de PILI o el acceso a un juego, usted debe aceptar estas Condiciones de servicio y la Política de privacidad. También puede requerirse que registre una cuenta en el Servicio (una “Cuenta”). Al registrar una Cuenta o utilizar el Servicio por otros medios, usted declara que tiene 13 años o más. Si tiene entre 13 y 17 años, usted declara que su representante legal leyó y aceptó estas Condiciones. Si accede al Servicio desde un sitio de redes sociales (“SNS”), como Facebook o Google+, deberá cumplir tanto con sus condiciones de uso como con estas Condiciones de servicio.
AL INSTALAR, USAR O ACCEDER AL SERVICIO POR CUALQUIER OTRO MEDIO, USTED ACEPTA ESTAS CONDICIONES DE SERVICIO. SI USTED NO ACEPTA ESTAS CONDICIONES DE SERVICIO, NO INSTALE, UTILICE NI ACCEDA AL SERVICIO POR NINGÚN OTRO MEDIO. EL USO DEL SERVICIO ESTÁ PROHIBIDO CUANDO ASÍ LO DISPONGA LA LEY.
PILI se reserva el derecho, a su exclusivo criterio, de cambiar, modificar, agregar o eliminar partes de estas Condiciones de servicio, de su Política de privacidad y de otras políticas pertinentes de PILI en cualquier momento, publicando las condiciones modificadas en el Servicio de PILI. Se considerará que usted aceptó dichos cambios al continuar utilizando el Servicio. Si en algún momento usted no acepta alguna parte de la versión vigente de nuestras Condiciones de servicio, de la Política de privacidad de PILI o de cualquier otra política, norma o código de conducta de PILI relacionados con el uso del Servicio, su licencia para utilizar el Servicio terminará de inmediato y deberá dejar de utilizarlo de inmediato.
1. Licencia
1.1. Concesión de una licencia limitada para usar el Servicio
Sujeto a su aceptación y cumplimiento continuo de estas Condiciones de servicio y de cualquier otra política pertinente de PILI, PILI le concede una licencia no exclusiva, intransferible, no sublicenciable, revocable y limitada para acceder y utilizar el Servicio con fines de entretenimiento personal y no comercial. Usted acepta no utilizar el Servicio con ningún otro fin que no sea el previsto en estas Condiciones.
Las siguientes restricciones se aplican al uso del Servicio:
•	No deberá crear una Cuenta ni acceder al Servicio si es menor de 13 años; deberá restringir su uso por parte de menores y denegar el acceso a niñas, niños y adolescentes menores de 13 años. Nos reservamos el derecho de solicitar comprobantes de edad en cualquier momento, a fin de verificar que personas sin la edad legal no estén utilizando ni accediendo al Servicio. Usted asume plena responsabilidad por cualquier uso no autorizado del Servicio por parte de menores. Usted es responsable de cualquier uso de su tarjeta de crédito u otro medio de pago (por ejemplo, PayPal) por parte de menores.
•	No deberá (ni intentará) comprar, vender, revender, alquilar ni ceder su Cuenta; crear una Cuenta usando una identidad o información falsa, o en nombre de otra persona que no sea usted mismo; ni utilizar el Servicio si fue previamente eliminado por PILI o se le prohibió jugar a cualquier juego de PILI.
•	 Usted deberá utilizar su Cuenta únicamente con fines no comerciales; no deberá utilizar el Servicio para anunciar, solicitar ni transmitir publicidad comercial, incluidos correos en cadena, mensajes no deseados o de spam, ni mensajes repetitivos o engañosos dirigidos a otras personas.
Nos reservamos todos los derechos legales disponibles y los recursos para prevenir el uso no autorizado del Servicio, incluido, entre otros, barreras tecnológicas, asignación de IP y, en casos graves, contactar directamente a su proveedor de servicios de Internet (ISP) en relación con dicho uso no autorizado.
Información de inicio de sesión y su Cuenta
Es posible que se le solicite establecer una contraseña para su Cuenta, o que utilice otras credenciales para acceder a ella (“Información de inicio de sesión”). Usted no deberá compartir su Cuenta ni la Información de inicio de sesión, ni permitir que otra persona acceda a su Cuenta o realice cualquier otra acción que pueda poner en riesgo la seguridad de la misma. En caso de que tenga conocimiento o sospechas razonables de una violación de la seguridad, incluido, entre otros, la pérdida, el robo o la divulgación no autorizada de la Información de inicio de sesión, deberá notificarlo inmediatamente a PILI y modificar dicha información. Usted es el único responsable de mantener la confidencialidad de su Información de inicio de sesión, así como de todo uso que se haga de ella, incluidas las compras, ya sea que usted las haya autorizado o no. Usted será responsable de todo lo que ocurra a través de su Cuenta, independientemente de si tiene conocimiento de ello.
PILI se reserva el derecho de eliminar o reclamar cualquier nombre de usuario en cualquier momento y por cualquier motivo, incluidas, entre otras cosas, reclamaciones de terceros por vulneración de derechos.
El Servicio admite solo una Cuenta por juego en un dispositivo compatible.
Limitaciones de la licencia
Cualquier uso del Servicio que infrinja estas Limitaciones de la licencia está estrictamente prohibido, puede dar lugar a la revocación inmediata de su licencia limitada y podría implicar responsabilidades legales.
Usted acepta que no realizará, bajo ninguna circunstancia, lo siguiente:
•	participar en actos que PILI considere contrarios al espíritu o propósito del Servicio, o hacer uso indebido de los servicios de atención al cliente de PILI;
•	desarrollar, distribuir, usar o participar (directa o indirectamente) en el uso de trampas, exploits, software de automatización, bots, hacks, modificaciones (mods) o cualquier software de terceros no autorizado diseñado para alterar o interferir con el Servicio, cualquier juego de PILI o su experiencia de juego;
•	modificar o provocar la modificación de archivos que formen parte del Servicio o de cualquier juego de PILI sin el consentimiento expreso y por escrito de PILI; alterar, interferir o afectar negativamente el flujo normal del Servicio o actuar de cualquier modo que afecte negativamente la experiencia de otros usuarios mientras utilizan el Servicio o juegan videojuegos de PILI. Esto incluye la manipulación de partidas o clasificaciones, aprovechar errores del Servicio para obtener ventajas injustas sobre otros jugadores u otras acciones que abusen de forma intencional o vayan en contra del diseño del Servicio;
•	interrumpir, sobrecargar, o ayudar en la interrupción o sobrecarga de cualquier computadora o servidor (“Servidor”) utilizado para ofrecer o mantener el Servicio o el entorno de juego de PILI;
•	iniciar, asistir o participar en cualquier tipo de ataque, incluidos, entre otros, la distribución de virus, ataques de denegación de servicio o cualquier otro intento de interrumpir el Servicio o su uso por parte de otros usuarios;
•	intentar obtener acceso no autorizado al Servicio, a Cuentas registradas por otras personas, o a computadoras, Servidores o redes conectadas al Servicio por medios distintos a la interfaz provista por PILI. Esto incluye, entre otros, la elusión o modificación (o intento de ello), o promover o asistir a otra persona en la elusión o modificación de cualquier medida de seguridad, tecnología, dispositivo o software del Servicio;
•	publicar, cargar, transmitir o difundir información que sea abusiva, violenta, amenazante, obscena, difamatoria, calumniosa, racista, sexual, religiosa, o que de cualquier otro modo resulte objetable, ofensiva o que implique conducta tóxica reiterada, como publicar información de forma repetida sin que se haya solicitado hacerlo;
•	acosar, abusar o dañar (o intentar hacerlo), o fomentar o incitar al acoso, abuso o daño de otra persona o grupo, incluyendo a empleados de PILI (como representantes del servicio de atención al cliente);
•	poner a disposición a través del Servicio cualquier material o información que infrinja derechos de autor, marcas comerciales, patentes, secretos comerciales, derechos de privacidad, derechos de imagen u otros derechos de cualquier persona o entidad; o suplantar a cualquier otra persona, incluidos, entre otros, empleados de PILI;
•	 realizar ingeniería inversa, descompilar, desensamblar, descifrar o intentar obtener el código fuente de cualquier software o propiedad intelectual utilizada para proveer el Servicio o cualquier juego de PILI, o intentar acceder a información del Servicio o de los juegos de PILI usando métodos no autorizados;
•	solicitar o intentar obtener Información de inicio de sesión u otras credenciales o datos personales de otros usuarios del Servicio o de cualquier juego de PILI;
•	recopilar o publicar información privada de otras personas, incluidos datos personales identificables (ya sea en forma de texto, imagen o video), documentos de identidad o información financiera a través del Servicio.
PILI se reserva el derecho de determinar qué conductas considera como violaciones a las normas de uso o contrarias al propósito o espíritu de estas Condiciones de servicio o del propio Servicio. PILI se reserva el derecho de tomar medidas en consecuencia, que pueden incluir la cancelación de su Cuenta y la prohibición de utilizar el Servicio de forma total o parcial.
1.2. Suspensión y cancelación de la Cuenta y del Servicio
SIN PERJUICIO DE CUALQUIER OTRO RECURSO DISPONIBLE, PILI PODRÁ, CON O SIN PREVIO AVISO, LIMITAR, SUSPENDER, CANCELAR, MODIFICAR O ELIMINAR CUENTAS O EL ACCESO AL SERVICIO O A PARTES DE ÉSTE SI USTED INCUMPLE, O PILI SOSPECHA QUE INCUMPLE, ALGUNA DE ESTAS CONDICIONES DE SERVICIO O SI LE DA AL SERVICIO UN USO INDEBIDO O INADECUADO. USTED PODRÁ PERDER SU NOMBRE DE USUARIO Y SU PERSONAJE EN EL SERVICIO COMO RESULTADO DE LA CANCELACIÓN O LIMITACIÓN DE SU CUENTA, ASÍ COMO CUALQUIER BENEFICIO, PRIVILEGIO, OBJETO O ELEMENTO ADQUIRIDO, Y PILI NO ESTÁ OBLIGADA A INDEMNIZARLO POR TALES PÉRDIDAS.
ASIMISMO, PILI PODRÁ, EN CIRCUNSTANCIAS APROPIADAS Y A SU EXCLUSIVO CRITERIO, SUSPENDER O CANCELAR CUENTAS DE USUARIOS QUE INCURRAN REPETIDAMENTE EN INCUMPLIMIENTOS DE NUESTRAS CONDICIONES, POLÍTICAS O NORMATIVAS LEGALES, O QUE VULNEREN DERECHOS DE PROPIEDAD INTELECTUAL DE TERCEROS.
PILI SE RESERVA EL DERECHO DE CANCELAR CUALQUIER CUENTA QUE HAYA PERMANECIDO INACTIVA DURANTE 180 DÍAS.
PILI también se reserva el derecho de dejar de ofrecer o mantener el Servicio, cualquier juego o parte del Servicio, en cualquier momento, en cuyo caso su licencia para usar el Servicio o parte de él quedará automáticamente cancelada. En tal caso, PILI no estará obligada a emitir reembolsos ni compensaciones de ningún tipo en relación con la cancelación del Servicio. La cancelación de su Cuenta podrá incluir la desactivación de su acceso al Servicio o a cualquier parte de él, incluso a cualquier contenido enviado por usted o por otros.
2. Propiedad
2.1. Juegos y Servicio
Todos los derechos, títulos e intereses sobre el Servicio (incluidos, entre otros, juegos, títulos, código fuente, temas, objetos, personajes, nombres de personajes, historias, diálogos, frases, conceptos, obras de arte, animaciones, sonidos, composiciones musicales, efectos audiovisuales, métodos de operación, derechos morales, documentación, transcripciones de chats durante el juego, información de perfiles de personajes, grabaciones de juego mediante el uso de un cliente de juego de PILI, y el software de cliente y servidor de los juegos de PILI) son propiedad de PILI. PILI se reserva todos los derechos, incluidos, a título enunciativo, los de propiedad intelectual, relacionados con sus juegos y el Servicio.
2.2. Cuentas
NO OBSTANTE CUALQUIER DISPOSICIÓN EN CONTRARIO EN ESTAS CONDICIONES, USTED RECONOCE Y ACEPTA QUE NO TIENE NINGÚN DERECHO DE PROPIEDAD NI INTERÉS PROPIETARIO SOBRE LA CUENTA, Y ADEMÁS ACEPTA QUE TODOS LOS DERECHOS SOBRE LA CUENTA PERTENECEN Y PERTENECERÁN EXCLUSIVAMENTE A PILI.
2.3. Objetos virtuales
PILI es propietaria, licenciataria o tiene derecho a usar todo el contenido que aparece en el Servicio o en sus juegos. No obstante cualquier disposición en contrario, usted reconoce que no tiene ningún derecho sobre dicho contenido, incluidos, entre otros, los bienes o monedas virtuales que aparezcan o se originen en los juegos de PILI, ya sea que hayan sido obtenidos jugando o comprados, ni sobre ningún otro atributo asociado a una Cuenta o almacenado en el Servicio.
3. Contenido del usuario
3.1. Envío de contenido del usuario
Se denomina “Contenido del usuario” a cualquier comunicación, imagen, sonido, material, dato o información que usted o cualquier otro usuario cargue o transmita mediante el cliente del juego o el Servicio, incluido, entre otros, texto de chats. Al transmitir o enviar Contenido del usuario mientras utiliza el Servicio, usted declara y garantiza que el contenido (a) es exacto, no confidencial ni engañoso; (b) no infringe ninguna ley, contrato ni derechos de terceros, y que tiene permiso de dichos terceros si el Contenido del usuario incluye su información o propiedad intelectual; (c) está libre de virus, adware, spyware, gusanos o cualquier código malicioso; y (d) acepta que cualquier dato personal incluido en dicho contenido será procesado por PILI en todo momento de conformidad con su Política de privacidad.
3.1.1. Revisión del contenido
PILI no asume responsabilidad alguna por la conducta de los usuarios que envíen Contenido del usuario, ni por la supervisión del Servicio en lo que respecta a contenido o comportamientos inapropiados. No supervisamos ni podemos supervisar o revisar previamente todo el Contenido del usuario. El uso del Servicio se realiza bajo su propio riesgo. Al utilizar el Servicio, usted puede estar expuesto a Contenido del usuario que resulte ofensivo, indecente o que no se ajuste a sus expectativas. Usted asume todos los riesgos asociados al uso de cualquier Contenido del usuario disponible en relación con el Servicio. A nuestro exclusivo criterio, nuestros representantes o
tecnologías podrán monitorear o grabar su interacción con el Servicio o las comunicaciones (incluido, entre otros, el texto de los chats) mientras utilice el Servicio.
Al aceptar estas Condiciones de servicio, usted otorga su consentimiento irrevocable para dicho monitoreo y grabación. Usted reconoce y acepta que no tiene expectativa alguna de privacidad respecto a la transmisión de cualquier Contenido del usuario, incluidos, entre otros, el texto de los chats o las comunicaciones por voz.
PILI se reserva el derecho, a su exclusivo criterio, de revisar, monitorear, prohibir, editar, eliminar, deshabilitar el acceso al Contenido del usuario, o hacer inaccesible cualquier Contenido del usuario (incluido, entre otros, su propio Contenido del usuario), en cualquier momento, con o sin previo aviso, por cualquier motivo o sin motivo alguno. Si en algún momento PILI decide, a su exclusivo criterio, monitorear el Servicio, ello no implicará que asuma responsabilidad alguna por el Contenido del usuario ni la obligación de modificar o eliminar cualquier Contenido del usuario inapropiado. Tenemos el derecho, pero no la obligación, a nuestro exclusivo criterio, de editar, rechazar la publicación o eliminar cualquier Contenido del usuario.
3.2. Uso de la información por parte de otros usuarios del Servicio
3.2.1. Comunicaciones públicas
El Servicio puede incluir diversos foros, blogs y funciones de chat en los que usted puede publicar Contenido del usuario, incluidos sus observaciones y comentarios sobre temas específicos. PILI no puede garantizar que otros usuarios no utilicen las ideas o información que usted comparta. Por lo tanto, si tiene una idea o información que desea mantener confidencial o no quiere que otros utilicen, no la publique en el Servicio. PILI no tendrá responsabilidad alguna de evaluar, utilizar o compensarlo por cualquier idea o información que usted decida enviar.
3.2.2. Responsabilidad sobre su propio contenido
Usted es el único responsable de la información que publique en, a través de, o en relación con el Servicio, así como de la que proporcione a otros usuarios. PILI podrá rechazar, negarse a publicar o eliminar cualquier Contenido del usuario, por cualquier motivo o sin motivo alguno, incluido, entre otros, contenido que, a exclusivo criterio de PILI, infrinja estas Condiciones de servicio.
3.2.3. Tu licencia a favor de PILI
Mediante el presente documento, usted otorga a PILI una licencia irrevocable, perpetua, transferible, completamente pagada, libre de regalías y válida en todo el mundo (incluido el derecho a sublicenciar y ceder a terceros), así como el derecho a copiar, reproducir, corregir, adaptar, modificar, crear obras derivadas, fabricar, comercializar, publicar, distribuir, vender, licenciar, sublicenciar, transferir, arrendar, transmitir, mostrar públicamente, ejecutar públicamente o permitir el acceso electrónico, transmitir, comunicar al público por telecomunicaciones, exhibir, ejecutar, almacenar en memoria informática, y utilizar y ejercer, de cualquier forma, su Contenido del usuario, así como todas las obras derivadas o modificadas del mismo, en relación con la prestación del Servicio, incluidos fines de marketing y promoción del Servicio. Asimismo, usted otorga a PILI el derecho a autorizar a terceros a ejercer cualquiera de los derechos que se le conceden a PILI en virtud de estas Condiciones de servicio. Además, usted otorga a PILI el derecho incondicional e irrevocable de utilizar y explotar su nombre, imagen y cualquier otra información o material incluido en cualquier Contenido del usuario y en relación con éste, sin obligación alguna hacia usted. Salvo que la ley disponga lo contrario, usted renuncia a cualquier derecho de atribución o derecho moral que pudiera tener sobre su Contenido del usuario, independientemente de que su Contenido del usuario haya sido modificado o alterado de cualquier manera. PILI no reclama derechos de propiedad sobre su Contenido del usuario y nada en estas Condiciones de servicio tiene por objeto restringir los derechos que usted pueda tener para utilizar o explotar su Contenido del usuario. PILI no tiene obligación alguna de monitorear ni hacer valer sus derechos de propiedad intelectual sobre su Contenido del usuario.
3.3. Interacciones con otros usuarios
Usted es el único responsable de sus interacciones con otros usuarios del Servicio y con cualquier otra parte con la que interactúe a través del Servicio o los juegos de PILI. PILI se reserva el derecho, pero no asume obligación alguna, de intervenir de cualquier forma en dichas disputas. Usted se compromete a cooperar plenamente con PILI en la investigación de cualquier actividad presuntamente ilegal, fraudulenta o inapropiada, incluido, entre otras cosas, permitir a PILI el acceso a cualquier parte protegida por contraseña de su Cuenta.
Si usted tiene un conflicto con uno o más usuarios, exonera a PILI (y a nuestros directivos, consejeros, agentes, subsidiarias, empresas conjuntas y empleados) de cualquier reclamo, demanda o daños (ya sea real o emergente), de cualquier tipo y naturaleza, conocidos o desconocidos, que surjan de dichos conflictos o estén relacionados de algún modo con ellos.
4. Condiciones de comisiones y compras
4.1. Compras
Dentro del Servicio, usted podrá adquirir, con dinero del mundo real, una licencia limitada, personal, intransferible, no sublicenciable y revocable para utilizar (a) “moneda virtual”, incluidos, entre otros, efectivo o diamantes virtuales, todos para su uso dentro de los juegos de PILI; (b) “objetos virtuales en el juego” (en conjunto con la “moneda virtual”, los “Objetos virtuales”); y (c) otros bienes o servicios (“Mercancía”). Solo se permite adquirir Objetos virtuales a través de nosotros o de nuestros socios autorizados, dentro del Servicio, y no por ningún otro medio.
PILI podrá administrar, regular, controlar, modificar o eliminar los Objetos virtuales o la Mercancía en cualquier momento, con o sin previo aviso. PILI no asumirá responsabilidad alguna frente a usted o frente a terceros en caso de ejercer cualquiera de estos derechos.
La transferencia de Objetos virtuales y Mercancía está prohibida, salvo autorización expresa dentro del Servicio. Salvo autorización expresa dentro del Servicio, usted no podrá vender, canjear ni transferir de ningún modo los Objetos virtuales o la Mercancía a ninguna persona o entidad, ni intentar realizar ninguna de estas acciones, incluido, entre otros, a PILI, a otro usuario o a un tercero.
TODAS LAS COMPRAS Y CANJES DE OBJETOS VIRTUALES REALIZADOS A TRAVÉS DEL SERVICIO SON FINALES Y NO REEMBOLSABLES.
La provisión de Objetos virtuales para su uso en los juegos de PILI constituye un servicio prestado por PILI, el cual comienza de forma inmediata al ser aceptada su compra por PILI.
4.2. Pago de comisiones
Usted acepta pagar todas las comisiones e impuestos aplicables incurridos por usted o por cualquier persona que utilice una Cuenta registrada a su nombre. PILI podrá revisar los precios de los bienes y servicios ofrecidos a través del Servicio en cualquier momento. USTED RECONOCE QUE PILI NO ESTÁ OBLIGADA A OFRECER REEMBOLSOS POR NINGÚN MOTIVO, Y QUE NO RECIBIRÁ DINERO NI NINGUNA OTRA COMPENSACIÓN POR OBJETOS VIRTUALES NO UTILIZADOS EN CASO DE CIERRE DE UNA CUENTA, SEA DICHO CIERRE VOLUNTARIO O INVOLUNTARIO.
5. Actualizaciones del Servicio
Usted entiende que el Servicio está en constante evolución. PILI podrá requerir que usted acepte actualizaciones al Servicio y a los juegos de PILI que tenga instalados en su dispositivo o computadora. Usted reconoce y acepta que PILI podrá actualizar el Servicio y los juegos de PILI, con o sin previo aviso. Es posible que deba actualizar software de terceros ocasionalmente para poder acceder al Servicio y jugar los juegos de PILI.
6. Exención de garantías
SIN PERJUICIO DE LA RESPONSABILIDAD DE PILI CONFORME A LA SECCIÓN 7 MÁS ADELANTE, EL SERVICIO SE PROPORCIONA “TAL CUAL” Y “SEGÚN DISPONIBILIDAD”, SIN GARANTÍAS DE NINGÚN TIPO, YA SEAN EXPRESAS O IMPLÍCITAS, INCLUIDAS, ENTRE OTRAS, LAS GARANTÍAS DE COMERCIABILIDAD, IDONEIDAD PARA UN FIN DETERMINADO, TITULARIDAD, NO INFRACCIÓN Y CUALQUIER GARANTÍA DERIVADA DE LA RELACIÓN COMERCIAL O DEL USO COMÚN EN EL SECTOR. PILI NO GARANTIZA QUE USTED PODRÁ ACCEDER O UTILIZAR EL SERVICIO EN LOS MOMENTOS O LUGARES DE SU ELECCIÓN; QUE EL SERVICIO ESTARÁ LIBRE DE INTERRUPCIONES O ERRORES; QUE LOS DEFECTOS SERÁN CORREGIDOS; O QUE EL JUEGO O EL SERVICIO ESTARÁN LIBRES DE VIRUS U OTROS COMPONENTES DAÑINOS. Algunas jurisdicciones no permiten la exclusión de determinadas garantías. En consecuencia, es posible que algunas de las exenciones anteriores no se apliquen a usted.
7. Limitación de responsabilidad; recurso único y exclusivo; indemnización

EN LA MEDIDA EN QUE LA LEY NO LO PROHÍBA, PILI NO SERÁ RESPONSABLE ANTE USTED POR UNA CANTIDAD SUPERIOR AL MONTO QUE USTED HAYA PAGADO A PILI EN VIRTUD DE ESTAS CONDICIONES DE SERVICIO DURANTE LOS SEIS (6) MESES INMEDIATAMENTE ANTERIORES A LA FECHA EN QUE USTED PRESENTE SU PRIMER RECLAMO. USTED RECONOCE Y ACEPTA QUE, SI NO HA PAGADO NINGUNA CANTIDAD A PILI DURANTE DICHO PERÍODO, SU ÚNICO RECURSO (Y LA ÚNICA RESPONSABILIDAD DE PILI) ANTE CUALQUIER DISPUTA CON PILI SERÁ DEJAR DE UTILIZAR EL SERVICIO Y CANCELAR SU CUENTA.
NINGUNA DISPOSICIÓN DE ESTAS CONDICIONES DE SERVICIO AFECTARÁ LOS DERECHOS LEGALES DE LOS CONSUMIDORES NI EXCLUIRÁ O RESTRINGIRÁ NINGUNA RESPONSABILIDAD DERIVADA DE NEGLIGENCIA GRAVE O CONDUCTA DOLOSA POR PARTE DE PILI, NI POR MUERTE O LESIONES PERSONALES DERIVADAS DE CUALQUIER NEGLIGENCIA O FRAUDE DE PILI.
Usted acepta indemnizar, defender y mantener indemne a PILI (y a sus directivos, consejeros, agentes, subsidiarias, afiliadas, licenciantes, empresas conjuntas y empleados) frente a cualquier reclamo, demanda, daños u otras pérdidas, incluidos honorarios razonables de abogados, presentados por terceros y derivados de su uso del Servicio, o de cualquier incumplimiento de estas Condiciones de servicio. 8. Resolución de disputas y ley aplicable
Si surge una disputa entre usted y PILI, le recomendamos encarecidamente que primero se comunique con nosotros directamente para buscar una solución. Si usted reside en los Estados Unidos, estas Condiciones de servicio, así como cualquier disputa que surja en relación con ellas, la Política de privacidad o el Servicio, se regirán en todos sus aspectos por la legislación del estado de California, sin considerar las disposiciones sobre conflicto de leyes. Usted acepta que cualquier reclamo o disputa que pueda tener contra PILI deberá resolverse exclusivamente ante un tribunal ubicado en San Francisco, California. 9. Divisibilidad

10. Disposiciones generales
10.1. Cesión
PILI podrá ceder o delegar estas Condiciones de servicio o la Política de privacidad de PILI, total o parcialmente, a cualquier persona o entidad en cualquier momento, con o sin su consentimiento. Usted no podrá ceder ni delegar ningún derecho u obligación bajo estas Condiciones de servicio o la Política de privacidad sin el consentimiento previo y por escrito de PILI, y cualquier cesión o delegación no autorizada por su parte será ineficaz.
10.2. Políticas complementarias
PILI podrá publicar políticas adicionales relacionadas con servicios específicos, como foros, concursos o programas de fidelidad. Su derecho a utilizar dichos servicios estará sujeto a dichas políticas específicas y a estas Condiciones de servicio.
10.3. Acuerdo íntegro
Estas Condiciones de servicio, junto con cualquier política complementaria y cualquier documento incorporado expresamente por referencia en este documento (incluida la Política de privacidad de PILI), constituyen el acuerdo completo entre usted y PILI, y reemplazan cualquier entendimiento previo entre las partes relacionado con el objeto de este acuerdo, ya sea electrónico, oral o escrito, y sin importar si fue establecido por costumbre, práctica, política o precedente, entre usted y nosotros con respecto al Servicio.

10.5. Notificaciones

10.6. Recursos en equidad

The terms of this agreement ("Terms of Service") govern the relationship between you and PILI STARSHIP PTE. LTD., a Singaporean company (business ID 202346742E) having its registered office at 152 BEACH ROAD #11-05, GATEWAY EAST SINGAPORE (189721), (hereinafter "PILI" or "us" or "we") regarding your use of PILI's games, websites and related services (the "Service"). Use of the Service is also governed by PILI's Privacy Policy and other relevant policies, which are incorporated herein by reference.

Before accessing or using the Service, including browsing any PILI website or accessing a game, you must agree to these Terms of Service and the Privacy Policy. You may also be required to register an account on the Service (an "Account"). By registering for an Account or otherwise using the Service, you represent that you are age 13 or older. If you are between the ages of 13 and 17, you represent that your legal guardian has reviewed and agreed to these Terms. If you access the Service from a Social Networking Site ("SNS"), such as Facebook or Google+, you shall comply with its terms of service/use as well as these Terms of Service.

BY INSTALLING, USING OR OTHERWISE ACCESSING THE SERVICE, YOU AGREE TO THESE TERMS OF SERVICE. IF YOU DO NOT AGREE TO THESE TERMS OF SERVICE, PLEASE DO NOT INSTALL, USE OR OTHERWISE ACCESS THE SERVICE. USE OF THE SERVICE IS VOID WHERE PROHIBITED.

PILI reserves the right, at its discretion, to change, modify, add or remove portions of these Terms of Service, its Privacy Policy and other relevant PILI policies at any time by posting the amended terms on the PILI Service. You will be deemed to have accepted such changes by continuing to use the Service. If at any point you do not agree to any portion of the then-current version of our Terms of Service, the PILI Privacy Policy, or any other PILI policy, rules or codes of conduct relating to your use of the Service, your license to use the Service shall immediately terminate, and you must immediately stop using the Service.

1. License
1.1. Grant of a Limited License to Use the Service
Subject to your agreement and continuing compliance with these Terms of Service and any other relevant PILI policies, PILI grants you a non-exclusive, non-transferable, non-sublicensable, revocable and limited license to access and use the Service for your own non-commercial entertainment purposes. You agree not to use the Service for any other purpose other than as provided for by these Terms.

The following restrictions apply to the use of the Service:

You shall not create an Account or access the Service if you are under the age of 13; You shall restrict use by minors, and you will deny access to children under the age of 13. We reserve the right to request proof of age at any stage to verify that persons not of legal age are not using or accessing the Service. You accept full responsibility for any unauthorized use of the Service by minors. You are responsible for any use of your credit card or other payment instrument (e.g. paypal) by minors.
You shall not (or attempt to) purchase, sell, resell, rent or give away your Account, create an Account using a false identity or information, or on behalf of someone other than yourself; You shall not use the Service if you have previously been removed by PILI, or previously been banned from playing any PILI game.
 You shall use your Account only for non-commercial purposes; You shall not use the Service to advertise, or solicit, or transmit any commercial advertisements, including chain letters, junk or spam e-mail or repetitive or misleading messages to anyone.
We reserve all available legal rights and remedies to prevent unauthorized use of the Service, including, but not limited to, technological barriers, IP mapping, and, in serious cases, directly contacting your Internet Service Provider (ISP) regarding such unauthorized use.

Login information and Your Account
You may be required to select a password for your Account or you may also use other credentials to access the Account ("Login Information"). You shall not share the Account or the Login Information, nor let anyone else access your Account or do anything else that might jeopardize the security of your Account. In the event you become aware of or reasonably suspect any breach of security, including without limitation any loss, theft, or unauthorized disclosure of the Login Information, you must immediately notify PILI and modify your Login Information. You are solely responsible for maintaining the confidentiality of the Login Information, and you will be responsible for all uses of the Login Information, including purchases, whether or not authorized by you. You are responsible for anything that happens through your Account, whether or not you know about it.

PILI reserves the right to remove or reclaim any usernames at any time and for any reason, including but not limited to claims by a third party that a username violates the third party's rights.

The Service supports only one Account per game on a supported device.

License Limitations
Any use of the Service in violation of these License Limitations is strictly prohibited, can result in the immediate revocation of your limited license and may subject you to liability for violations of law.

You agree that you will not, under any circumstances:


Engage in any act that PILI deems to be in conflict with the spirit or intent of the Service or make improper use of PILI's support services.
Develop, distribute, use or take part (directly or indirectly) in the use of cheats, exploits, automation software, bots, hacks, mods or any unauthorized third-party software designed to modify or interfere with the Service, any PILI game or any PILI game experience.
Modify or cause to be modified any files that are a part of the Service or any PILI game without PILI's express written consent. Disrupt, interfere with or otherwise adversely affect the normal flow of the Service or otherwise act in a manner that may negatively affect other users' experience when using the Service or playing PILI's games. This includes win trading and any other kind of manipulation of rankings, taking advantage of errors in the Service to gain an unfair edge over other players and any other act that intentionally abuses or goes against the design of the Service.
Disrupt, overburden, or aid or assist in the disruption or overburdening of any computer or server ("Server") used to offer or support the Service or any PILI game environment.
Institute, assist, or become involved in any type of attack, including without limitation distribution of a virus, denial of service attacks upon the Service, or other attempts to disrupt the Service or any other person's use or enjoyment of the Service.
Attempt to gain unauthorized access to the Service, Accounts registered to others or to the computers, Servers, or networks connected to the Service by any means other than the user interface provided by PILI, including but not limited to, by circumventing or modifying, attempting to circumvent or modify, or encouraging or assisting any other person to circumvent or modify, any security, technology, device, or software that is part of the Service.
Post, upload, transmit or otherwise disseminate any information that is abusive, violent, threatening, obscene, defamatory, libelous, racial, sexual, religious, or otherwise objectionable, offensive or engage in ongoing toxic behavior, such as by repeatedly posting information on an unsolicited basis.
Attempt to, or harass, abuse, or harm, or advocate or incite harassment, abuse, or harm of another person, group, including PILI employees (such as PILI's customer service representatives).
Make available through the Service any material or information that infringes any copyright, trademark, patent, trade secret, right of privacy, right of publicity, or other right of any person or entity or impersonates any other person, including without limitation a PILI employee.
 Reverse engineer, decompile, disassemble, decipher or otherwise attempt to derive the source code for any underlying software or other intellectual property used to provide the Service or any PILI game, or to obtain any information from the Service or any PILI game using any method not expressly permitted by PILI.
Solicit or attempt to solicit Login Information or any other login credentials or personal information from other users of the Service or any PILI game.
Collect or post anyone's private information, including personally identifiable information (whether in text, image or video form), identification documents, or financial information through the Service.
PILI reserves the right to determine what conduct it considers to be in violation of the rules of use or otherwise outside the intent or spirit of these Terms of Service or the Service itself. PILI reserves the right to take action as a result, which may include terminating your Account and prohibiting you from using the Service in whole or in part.

1.2. Suspension and Termination of Account and Service
WITHOUT LIMITING ANY OTHER REMEDIES, PILI MAY LIMIT, SUSPEND, TERMINATE, MODIFY, OR DELETE ACCOUNTS OR ACCESS TO THE SERVICE OR PORTIONS THEREOF IF YOU ARE, OR PILI SUSPECTS THAT YOU ARE, FAILING TO COMPLY WITH ANY OF THESE TERMS OF SERVICE OR FOR ANY ACTUAL OR SUSPECTED ILLEGAL OR IMPROPER USE OF THE SERVICE, WITH OR WITHOUT NOTICE TO YOU. YOU CAN LOSE YOUR USER NAME AND PERSONA IN THE SERVICE AS A RESULT OF ACCOUNT TERMINATION OR LIMITATION, AS WELL AS ANY BENEFITS, PRIVILEGES, EARNED ITEMS AND PURCHASED ITEMS ASSOCIATED WITH YOUR USE OF THE SERVICE, AND PILI IS UNDER NO OBLIGATION TO COMPENSATE YOU FOR ANY SUCH LOSSES OR RESULTS.

ADDITIONALLY, WE MAY, IN APPROPRIATE CIRCUMSTANCES AND AT OUR SOLE DISCRETION, SUSPEND OR TERMINATE ACCOUNTS OF USERS WHO MAY BE REPEAT VIOLATORS OF OUR TERMS, POLICIES OR LEGAL REQUIRMENTS, OR REPEAT INFRINGERS OF THIRD PARTY INTELLECTUAL PROPERTY RIGHTS.

PILI RESERVES THE RIGHT TO TERMINATE ANY ACCOUNT THAT HAS BEEN INACTIVE FOR 180 DAYS.

PILI reserves the right to stop offering and/or supporting the Service or a particular game or part of the Service at any time, at which point your license to use the Service or a part thereof will be automatically terminated. In such event, PILI shall not be required to provide refunds, benefits or other compensation to users in connection with such discontinued Service . Termination of your Account can include disabling your access to the Service or any part thereof including any content you submitted or others submitted.


2. Ownership
2.1. Games and Service
All rights, title and interest in and to the Service (including without limitation any games, titles, computer code, themes, objects, characters, character names, stories, dialogue, catch phrases, concepts, artwork, animations, sounds, musical compositions, audio-visual effects, methods of operation, moral rights, documentation, in-game chat transcripts, character profile information, recordings of games played using a PILI game client, and the PILI game clients and server software) are owned by PILI. PILI reserves all rights, including without limitation, all intellectual property rights or other proprietary rights, in connection with its games and the Service.

2.2. Accounts
NOTWITHSTANDING ANYTHING TO THE CONTRARY HEREIN, YOU ACKNOWLEDGE AND AGREE THAT YOU SHALL HAVE NO OWNERSHIP OR OTHER PROPERTY INTEREST IN THE ACCOUNT, AND YOU FURTHER ACKNOWLEDGE AND AGREE THAT ALL RIGHTS IN AND TO THE ACCOUNT ARE AND SHALL FOREVER BE OWNED BY AND INURE TO THE BENEFIT OF PILI.

2.3. Virtual Items
PILI owns, has licensed, or otherwise has rights to use all of the content that appears in the Service or in PILI games. Notwithstanding any provision to the contrary herein, you agree that you have no right or title in or to any content that appears in the Service, including without limitation the virtual goods or currency appearing or originating in any PILI game, whether earned in a game or purchased from PILI, or any other attributes associated with an Account or stored on the Service.

3. User Content
3.1. Submission of User Content
"User Content" means any communications, images, sounds, and all the material, data, and information that you upload or transmit through a PILI game client or the Service, or that other users upload or transmit, including without limitation any chat text. By transmitting or submitting any User Content while using the Service, you affirm, represent and warrant that such transmission or submission is (a) accurate and not confidential or misleading; (b) not in violation of any laws, contractual restrictions or other third party rights, and that you have permission from any third party whose personal information or intellectual property is comprised in the User Content; (c) free of viruses, adware, spyware, worms or other malicious code; and (d) you acknowledge and agree that any of your personal information within such content will at all times be processed by PILI in accordance with its Privacy Policy.

3.1.1. Content Screening
PILI assumes no responsibility for the conduct of any user submitting any User Content, and assumes no responsibility for monitoring the Service for inappropriate content or conduct. We do not, and cannot, pre-screen or monitor all User Content. Your use of the Service is at your own risk. By using the Service, you may be exposed to User Content that is offensive, indecent or otherwise not in line with your expectations. You bear all risks associated with the use of any User Content available in connection with the Service. At our discretion, our representatives or

technology may monitor and/or record your interaction with the Service or communications (including without limitation chat text) when you are using the Service.

By entering into these Terms of Service, you hereby provide your irrevocable consent to such monitoring and recording. You acknowledge and agree that you have no expectation of privacy concerning the transmission of any User Content, including without limitation chat text or voice communications.

PILI reserves the right in its sole discretion to review, monitor, prohibit, edit, delete, disable access to or otherwise make unavailable any User Content (including without limitation your User Content) without notice for any reason or for no reason at any time. If at any time PILI chooses, in its sole discretion, to monitor the Service, PILI nonetheless assumes no responsibility for User Content and assumes no obligation to modify or remove any inappropriate User Content. We have the right, but not the obligation, in our sole discretion to edit, refuse to post, or remove any User Content.

3.2. Information Use by Other Members of the Service
3.2.1. Public Discourse
The Service may include various forums, blogs and chat features where you can post User Content, including your observations and comments on designated topics. PILI cannot guarantee that other members will not use the ideas and information that you share. Therefore, if you have an idea or information that you would like to keep confidential and/or don't want others to use, do not post it on the Service. PILI shall have no responsibility to evaluate, use or compensate you for any ideas or information you may choose to submit.

3.2.2. Responsible For Your Own Content
You are solely responsible for the information that you post on, through or in connection with the Service and that you provide to others. PILI may reject, refuse to post or delete any User Content for any or no reason, including, but not limited to, User Content that in the sole judgment of PILI violates these Terms of Service.

3.2.3. Your License to PILI
You hereby grant to PILI an irrevocable, perpetual, transferable, fully paid-up, royalty-free, worldwide license (including the right to sublicense and assign to third party) and right to copy, reproduce, fix, adapt, modify, create derivative works from, manufacture, commercialize, publish, distribute, sell, license, sublicense, transfer, lease, transmit, publicly display, publicly perform, or provide access to electronically, broadcast, communicate to the public by telecommunication, display, perform, enter into computer memory, and use and practice, in any way, your User Content as well as all modified and derivative works thereof in connection with our provision of the Service, including marketing and promotions of the Service. You also hereby grant to PILI the right to authorize others to exercise any of the rights granted to PILI under these Terms of Service. You further hereby grant to PILI the unconditional, irrevocable right to use and exploit your name, likeness and any other information or material included in any User Content and in connection with any User Content, without any obligation to you. Except as prohibited by law, you waive any rights of attribution and/or any moral rights you may have in your User Content, regardless of whether your User Content is altered or changed in any manner. PILI does not claim any ownership rights in your User Content and nothing in these Terms of Service is intended to restrict any rights that you may have to use and exploit your User Content. PILI has no obligation to monitor or enforce your intellectual property rights in or to your User Content.

3.3. User Interactions
You are solely responsible for your interactions with other users of the Service and any other parties with whom you interact through the Service and/or PILI games. PILI reserves the right, but has no obligation, to become involved in any way with these disputes. You will fully cooperate with PILI to investigate any suspected unlawful, fraudulent or improper activity, including, without limitation, granting PILI access to any password-protected portions of your Account.

If you have a dispute with one or more users, you release us (and our officers, directors, agents, subsidiaries, joint ventures and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.

4. Fees and Purchase Terms
4.1.Purchases
In the Service you may purchase, with "real world" money, a limited, personal, non-transferable, non-sublicensable, revocable license to use (a) "virtual currency", including but not limited to virtual cash or diamonds, all for use in PILI games; (b) "virtual in-game items" (together with "virtual currency", "Virtual Items"); and (c) other goods or services ("Merchandise"). You are only allowed to purchase Virtual Items from us or our authorised partners through the Service, and not in any other way.

PILI may manage, regulate, control, modify or eliminate Virtual Items and/or Merchandise at any time, with or without notice. PILI shall have no liability to you or any third party in the event that PILI exercises any such rights./p>

The transfer of Virtual Items and Merchandise is prohibited except where expressly authorized in the Service. Other than as expressly authorized in the Service, you shall not sell, purchase, redeem or otherwise transfer Virtual Items or Merchandise to any person or entity or attempt any of the aforesaid, including but not limited to PILI, another user or any third party.

ALL PURCHASES AND REDEMPTIONS OF VIRTUAL ITEMS MADE THROUGH THE SERVICE ARE FINAL AND NON-REFUNDABLE.

The provision of Virtual Items for use in PILI games is a service provided by PILI that commences immediately upon acceptance by PILI of your purchase.

4.2. Payment of Fees
You agree to pay all fees and applicable taxes incurred by you or anyone using an Account registered to you. PILI may revise the pricing for the goods and services offered through the Service at any time. YOU ACKNOWLEDGE THAT PILI IS NOT REQUIRED TO PROVIDE A REFUND FOR ANY REASON, AND THAT YOU WILL NOT RECEIVE MONEY OR OTHER COMPENSATION FOR UNUSED VIRTUAL ITEMS WHEN AN ACCOUNT IS CLOSED, WHETHER SUCH CLOSURE WAS VOLUNTARY OR INVOLUNTARY.

5. Updates to the Service
You understand that the Service is an evolving one. PILI may require that you accept updates to the Service and to PILI's games you have installed on your device or computer. You acknowledge and agree that PILI may update the Service and PILI games, with or without notifying you. You may need to update third party software from time to time in order to receive the Service and play PILI games.

6. Disclaimer of Warranties
WITHOUT LIMITING PILI'S LIABILITY UNDER SECTION 7 BELOW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS FOR YOUR USE, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND THOSE ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. PILI DOES NOT WARRANT THAT YOU WILL BE ABLE TO ACCESS OR USE THE SERVICE AT THE TIMES OR LOCATIONS OF YOUR CHOOSING; THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; OR THAT THE GAME OR THE SERVICE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. Some jurisdictions do not allow the exclusion of certain warranties. Accordingly, some of the above disclaimers may not apply to you.

7. Limitation of Liability; Sole and Exclusive Remedy; Indemnification
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PILI SHALL NOT BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE OR OTHER SIMILAR DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUES, LOST PROFITS, LOST DATA OR BUSINESS INTERRUPTION OR OTHER INTANGIBLE LOSSES (HOWEVER SUCH LOSSES ARE QUALIFIED), ARISING OUT OF OR RELATING IN ANY WAY TO THESE TERMS OF SERVICE OR THE SERVICE ITSELF, WHETHER BASED ON CONTRACT, TORT OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT PILI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT NOT PROHIBITED BY LAW, PILI SHALL NOT BE LIABLE TO YOU FOR MORE THAN THE AMOUNT YOU HAVE PAID TO PILI IN ACCORDANCE WITH THESE TERMS OF SERVICE IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE DATE ON WHICH YOU FIRST ASSERT A CLAIM. YOU ACKNOWLEDGE AND AGREE THAT IF YOU HAVE NOT PAID ANYTHING TO PILI DURING SUCH TIME PERIOD, YOUR SOLE REMEDY (AND PILI'S EXCLUSIVE LIABILITY) FOR ANY DISPUTE WITH PILI IS TO STOP USING THE SERVICE AND TO CANCEL YOUR ACCOUNT.

NOTHING IN THESE TERMS OF SERVICE SHALL AFFECT THE STATUTORY RIGHTS OF ANY CONSUMER OR EXCLUDE OR RESTRICT ANY LIABILITY RESULTING FROM GROSS NEGLIGENCE OR WILLFUL MISCONDUCT OF PILI OR FOR DEATH OR PERSONAL INJURY ARISING FROM ANY NEGLIGENCE OR FRAUD OF PILI.

You agree to indemnify, defend and hold PILI (and our officers, directors, agents, subsidiaries, affiliates, agents, licensors, joint ventures and employees) harmless from any claim, demand, damages or other losses, including reasonable attorneys' fees, asserted by any third-party resulting from or arising out of your use of the Service, or any breach by you of these Terms of Service, however the foregoing does not apply if the infringement of rights is not attributable to your intentional or negligent behavior.

8. Dispute Resolution and Law
If a dispute arises between you and PILI, we strongly encourage you to first contact us directly to seek a resolution. If you are a resident of the United States, these Terms of Service and any dispute arising out of or related to it or Privacy Policy or the Service shall be governed in all respects by California law, without regard to conflict of law provisions. You agree that any claim or dispute you may have against PILI must be resolved exclusively by a court located in San Francisco, California. If you are a resident outside of the United States, you agree that all disputes between you and PILI shall be governed by the laws of Singapore, without regard to conflict of law provisions. You agree that any claim or dispute you may have against PILI must be resolved exclusively by a court located in Singapore.

9. Severability
You and PILI agree that if any portion of these Terms of Service or of the PILI Privacy Policy is found illegal or unenforceable, in whole or in part by any court of competent jurisdiction, such provision shall, as to such jurisdiction, be ineffective solely to the extent of such determination of invalidity or unenforceability without affecting the validity or enforceability thereof in any other manner or jurisdiction and without affecting the remaining provisions of the terms, which shall continue to be in full force and effect.

10. General Provisions
10.1. Assignment
PILI may assign or delegate these Terms of Service and/or the PILI Privacy Policy, in whole or in part, to any person or entity at any time with or without your consent. You may not assign or delegate any rights or obligations under the Terms of Service or Privacy Policy without PILI's prior written consent, and any unauthorized assignment and delegation by you is ineffective.

10.2. Supplemental Policies
PILI may publish additional policies related to specific services such as forums, contests or loyalty programs. Your right to use such services is subject to those specific policies and these Terms of Service.

10.3. Entire Agreement
These Terms of Service, any supplemental policies and any documents expressly incorporated by reference herein (including the PILI Privacy Policy), contain the entire understanding of you and PILI, and supersede all prior understandings of the parties hereto relating to the subject matter hereof, whether electronic, oral or written, or whether established by custom, practice, policy or precedent, between you and us with respect to the Service.

10.4. No Waiver
The failure of PILI to require or enforce strict performance by you of any provision of these Terms of Service or the PILI Privacy Policy or failure to exercise any right under them shall not be construed as a waiver or relinquishment of PILI's right to assert or rely upon any such provision or right in that or any other instance.

The express waiver by PILI of any provision, condition, or requirement of these Terms of Service or the PILI Privacy Policy shall not constitute a waiver of any future obligation to comply with such provision, condition or requirement.

Except as expressly and specifically set forth in this these Terms of Service, no representations, statements, consents, waivers, or other acts or omissions by PILI shall be deemed a modification of these Terms of Service nor legally binding, unless documented in physical writing, hand signed by yourself and a duly appointed officer of PILI.

10.5. Notices
We may notify you via postings on https://www.pilistarship.com, and via e-mail or any other communications means to contact information you provide to us. All notices given by you or required from you under these Terms of Service or the PILI Privacy Policy shall be in writing and addressed to: 152 BEACH ROAD #11-05, GATEWAY EAST SINGAPORE (189721). Any notices that you provide without compliance with this Section on Notices shall have no legal effect.

10.6. Equitable Remedies
You acknowledge that the rights granted and obligations made under these Terms of Service to PILI are of a unique and irreplaceable nature, the loss of which shall irreparably harm PILI and which cannot be replaced by monetary damages alone so that PILI shall be entitled to injunctive or other equitable relief (without the obligations of posting any bond or surety or proof of damages) in the event of any breach or anticipatory breach by you.

You irrevocably waive all rights to seek injunctive or other equitable relief, or to enjoin or restrain the operation of the Service or any PILI game, exploitation of any advertising or other materials issued in connection therewith, or exploitation of the Service or any content or other material used or displayed through the Service and agree to limit your claims to claims for monetary damages, limited by Section 7 (if any).

10.7. Force Majeure
PILI shall not be liable for any delay or failure to perform resulting from causes outside the reasonable control of PILI, including without limitation any failure to perform hereunder due to unforeseen circumstances or cause beyond PILI's control such as acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor or materials.
