CONDITIONS G ÉN ÉRALES D’UTILISATION

Les présentes conditions d'utilisation (les « Conditions ») régissent la relation entre vous et PILI STARSHIP PTE. LTD., société de droit singapourien (numéro d’enregistrement 202346742E), dont le siège social est situé au 152 BEACH ROAD #11-05, GATEWAY EAST SINGAPORE (189721) (ci-après « PILI », « nous » ou « notre »), concernant votre utilisation des jeux, sites internet et services associés de PILI (collectivement, le « Service »). L’utilisation du Service est également régie par la Politique de confidentialité de PILI, ainsi que par d’autres politiques applicables, intégrées aux présentes par renvoi.
Avant d’accéder au Service ou de l’utiliser, y compris en naviguant sur un site internet de PILI ou en accédant à un jeu, vous devez accepter les présentes Conditions et la Politique de confidentialité. Il pourra également vous être demandé de créer un compte sur le Service (un « Compte »). En vous inscrivant ou en utilisant le Service, vous déclarez être âgé de 13 ans ou plus. Si vous avez entre 13 et 17 ans, vous déclarez que votre représentant légal a lu et accepté les présentes Conditions. Si vous accédez au Service via un réseau social (« Réseau social »), tel que Facebook ou Google+, vous vous engagez à respecter ses conditions d'utilisation ainsi que les présentes Conditions.
EN INSTALLANT, UTILISANT OU ACCÉDANT AUTREMENT AU SERVICE, VOUS ACCEPTEZ LES PRÉSENTES CONDITIONS. SI VOUS N’ACCEPTEZ PAS CES CONDITIONS, VEUILLEZ NE PAS INSTALLER, UTILISER OU ACCÉDER AU SERVICE. L’UTILISATION DU SERVICE EST NULLE LORSQU’ELLE EST INTERDITE PAR LA LOI.
PILI se réserve le droit, à sa seule discrétion, de modifier, compléter ou supprimer à tout moment une partie des présentes Conditions, de sa Politique de confidentialité ou de toute autre politique pertinente de PILI, en publiant les conditions modifiées sur le Service. Vous serez réputé avoir accepté ces modifications en continuant d’utiliser le Service. Si, à un moment quelconque, vous n’acceptez pas une partie de la version alors en vigueur des présentes Conditions, de la Politique de confidentialité ou de toute autre politique, règle ou charte de conduite relative à votre utilisation du Service, votre licence d’utilisation sera immédiatement résiliée et vous devrez cesser toute utilisation du Service.
1. Licence
1.1. Octroi d’une licence limitée d’utilisation du Service
Sous réserve de votre acceptation et de votre respect constant des présentes Conditions ainsi que des autres politiques pertinentes de PILI, PILI vous accorde une licence limitée, révocable, non exclusive, non transférable et non sous-licenciable pour accéder au Service et l’utiliser à des fins de divertissement personnel et non commercial uniquement. Vous vous engagez à ne pas utiliser le Service à d’autres fins que celles prévues dans les présentes Conditions.
Restrictions applicables à l’utilisation du Service :
•	Vous ne devez pas créer de Compte ni accéder au Service si vous avez moins de 13 ans ; vous devez restreindre l’accès aux mineurs et refuser l’accès aux enfants de moins de 13 ans. Nous nous réservons le droit de demander à tout moment une preuve d’âge afin de vérifier que les personnes n’ayant pas l’âge légal n’utilisent pas le Service. Vous acceptez l’entière responsabilité de toute utilisation non autorisée du Service par des mineurs. Vous êtes responsable de toute utilisation de votre carte bancaire ou autre moyen de paiement (ex. : PayPal) par un mineur.
•	Vous ne devez pas (et ne tenterez pas de) vendre, revendre, louer ou céder votre Compte ; vous ne devez pas créer de Compte en usurpant l’identité de quelqu’un d’autre ou en fournissant de fausses informations, ni pour le compte d’une autre personne ; vous ne devez pas utiliser le Service si vous avez été précédemment exclu par PILI ou banni de tout jeu édité par PILI.
•	 Vous ne devez utiliser votre Compte qu’à des fins non commerciales ; vous ne devez pas utiliser le Service pour faire de la publicité, solliciter ou transmettre des messages à caractère commercial, y compris des chaînes de lettres, courriels indésirables (« spam »), ou tout message répétitif ou trompeur, à quiconque.
Nous nous réservons tous les droits et recours juridiques à notre disposition pour prévenir toute utilisation non autorisée du Service, notamment par le recours à des barrières technologiques, la localisation par adresse IP, ou, dans les cas graves, en contactant directement votre fournisseur d’accès à internet (FAI).
Informations de connexion et Compte utilisateur
Il pourra vous être demandé de choisir un mot de passe pour votre Compte, ou d’utiliser d’autres identifiants pour y accéder (les « Identifiants de connexion »). Vous ne devez pas partager votre Compte ni vos Identifiants de connexion, ni permettre à quiconque d’accéder à votre Compte, ou poser des actes susceptibles de compromettre sa sécurité. Si vous avez connaissance ou soupçonnez raisonnablement une atteinte à la sécurité, y compris – mais sans s’y limiter – une perte, un vol ou une divulgation non autorisée de vos Identifiants de connexion, vous devez immédiatement en informer PILI et les modifier. Vous êtes seul responsable de la confidentialité de vos Identifiants de connexion et de toute utilisation qui en serait faite, y compris les achats effectués, qu’ils soient ou non autorisés par vous. Vous êtes responsable de tout ce qui se produit via votre Compte, même si vous n’en avez pas connaissance.
PILI se réserve le droit de supprimer ou de récupérer tout nom d’utilisateur à tout moment et pour quelque raison que ce soit, notamment en cas de réclamation d’un tiers indiquant qu’un nom d’utilisateur enfreint ses droits.
Le Service ne prend en charge qu’un seul Compte par jeu et par appareil compatible.
Limitations de licence
Toute utilisation du Service en violation de ces limitations de licence est strictement interdite, et peut entraîner la révocation immédiate de votre licence limitée et peut vous exposer à des poursuites pour violation de la loi.
Vous acceptez de ne pas, en aucune circonstance :
•	Vous livrer à tout acte que PILI considère comme contraire à l’esprit ou à l’objectif du Service, ou faire une utilisation abusive des services d’assistance de PILI.
•	Développer, distribuer, utiliser ou participer (directement ou indirectement) à l’utilisation de triches, d’exploits, de logiciels d’automatisation, de bots, de hacks, de mods ou de tout logiciel tiers non autorisé conçu pour modifier ou interférer avec le Service, un jeu PILI ou toute expérience de jeu PILI.
•	Modifier ou faire modifier tout fichier faisant partie du Service ou d'un jeu de PILI sans l'accord écrit émanent de PILI. Perturber, interférer avec ou nuire de quelque manière que ce soit au fonctionnement normal du Service, ou agir de manière à nuire à l’expérience des autres utilisateurs lors de l’utilisation du Service ou lorsqu’ils jouent aux jeux PILI. Cela inclut les échanges de victoires (« win trading »), toute forme de manipulation des classements, l’exploitation d’erreurs du Service pour obtenir un avantage injuste, ou tout autre acte abusif allant à l’encontre de la conception du Service.
•	Perturber, surcharger ou aider à perturber ou surcharger tout ordinateur ou serveur (« Serveur ») utilisé pour offrir ou maintenir le Service ou un environnement de jeu PILI.
•	Lancer, aider ou participer à toute forme d’attaque, y compris, sans s’y limiter, la diffusion de virus, les attaques par déni de service contre le Service, ou toute autre tentative de perturber le Service ou l’utilisation du Service par d’autres utilisateurs.
•	Tenter d’accéder sans autorisation au Service, à des Comptes enregistrés au nom d’autrui, ou aux ordinateurs, Serveurs ou réseaux connectés au Service par tout moyen autre que l’interface utilisateur fournie par PILI, y compris mais sans s’y limiter, en contournant, modifiant ou en encourageant d’autres personnes à contourner ou modifier tout dispositif ou logiciel de sécurité ou technologie faisant partie du Service.
•	Publier, télécharger, transmettre ou diffuser toute information abusive, violente, menaçante, obscène, diffamatoire, calomnieuse, raciste, sexuelle, religieuse ou autrement répréhensible ou offensante, ou vous livrer à des comportements toxiques répétés comme par exemple en publiant des informations de manière répétée et non sollicitée.
•	Tenter d’harceler, abuser ou nuire, ou inciter à harceler, abuser ou nuire à une personne ou un groupe, y compris les employés de PILI (comme les représentants du service client).
•	Rendre disponible par le biais du Service tout contenu enfreignant un droit d’auteur, une marque, un brevet, un secret commercial, un droit à la vie privée ou à l’image, ou tout autre droit d’une personne ou d’une entité, ou usurper l’identité de toute autre personne, y compris notamment un employé de PILI.
•	 Procéder à de la rétro-ingénierie, décompiler, désassembler, déchiffrer ou tenter d’obtenir le code source de tout logiciel sous-jacent ou propriété intellectuelle sous-jacente utilisé pour fournir le Service ou un jeu PILI, ou obtenir toute information du Service ou d’un jeu PILI par un moyen non expressément autorisé par PILI.
•	Solliciter ou tenter d’obtenir les Informations de connexion ou toute autre information confidentielle d’autres utilisateurs du Service ou de tout jeu PILI.
•	Collecter ou publier les informations personnelles d’autrui, y compris les données permettant une identification (sous forme de texte, d’image ou de vidéo), des documents d’identité ou des informations financières, par le biais du Service.
PILI se réserve le droit de déterminer quels comportements constituent une violation des règles d’utilisation ou sont contraires à l’esprit de ces Conditions ou du Service. PILI se réserve également le droit de prendre les mesures qu’elle juge appropriées, pouvant inclure la résiliation de votre Compte et l’interdiction d’utiliser la totalité ou une partie du Service.
1.2. Suspension et résiliation de Compte et du Service
SANS LIMITER LES AUTRES RECOURS, PILI PEUT LIMITER, SUSPENDRE, RÉSILIER, MODIFIER OU SUPPRIMER DES COMPTES OU L'ACCÈS AU SERVICE OU À DES PARTIES DE CELUI-CI SI VOUS NE RESPECTEZ PAS, OU SI PILI SOUPÇONNE QUE VOUS NE RESPECTEZ PAS, L'UNE DES PRÉSENTES CONDITIONS OU POUR TOUTE UTILISATION ILLÉGALE OU INAPPROPRIÉE, RÉELLE OU SOUPÇONNÉE, DU SERVICE, AVEC OU SANS PRÉAVIS. VOUS POUVEZ PERDRE VOTRE NOM D'UTILISATEUR ET VOTRE PERSONA DANS LE SERVICE À LA SUITE DE LA RÉSILIATION OU DE LA LIMITATION DE VOTRE COMPTE, AINSI QUE TOUS LES AVANTAGES, PRIVILÈGES, ARTICLES GAGNÉS ET ARTICLES ACHETÉS ASSOCIÉS À VOTRE UTILISATION DU SERVICE, ET PILI N'A AUCUNE OBLIGATION DE VOUS INDEMNISER POUR DE TELLES PERTES OU DE TELS RÉSULTATS.
EN OUTRE, NOUS POUVONS, DANS DES CIRCONSTANCES APPROPRIÉES ET À NOTRE SEULE DISCRÉTION, SUSPENDRE OU RÉSILIER LES COMPTES D'UTILISATEURS SUSCEPTIBLES DE VIOLER DE MANIÈRE RÉPÉTÉE NOS CONDITIONS, POLITIQUES OU EXIGENCES LÉGALES, OU DE VIOLER DE MANIÈRE RÉPÉTÉE LES DROITS DE PROPRIÉTÉ INTELLECTUELLE D'UN TIERS.
PILI SE RÉSERVE LE DROIT DE CLÔTURER TOUT COMPTE INACTIF DEPUIS 180 JOURS.
PILI se reserve le droit, à tout moment, décider d’arrêter de proposer et/ou de maintenir le Service ou un jeu spécifique (ou une partie de ceux-ci). Dans ce cas, votre licence d’utilisation du Service (ou de la partie concernée) sera automatiquement résiliée. PILI ne sera pas tenue de rembourser, compenser ou accorder d’avantages aux utilisateurs pour les Services ou éléments désactivés. La résiliation de votre Compte peut inclure la désactivation de votre accès au Service ou à son contenu, y compris les éléments que vous ou d’autres utilisateurs avez soumis.
2. Propriété
2.1. Jeux et Service
Tous les droits, titres et intérêts relatifs au Service (y compris, sans s’y limiter, les jeux, titres, codes informatiques, thèmes, objets, personnages, noms de personnages, scénarios, dialogues, expressions, concepts, illustrations, animations, sons, musiques, effets audiovisuels, modes de fonctionnement, droits moraux, documentations, transcriptions de discussions en jeu, profils de personnages, enregistrements de parties et logiciels clients/serveurs des jeux PILI) sont la propriété de PILI. PILI se réserve tous les droits, y compris les droits de propriété intellectuelle et autres droits exclusifs, liés à ses jeux et au Service.
2.2. Comptes
NONOBSTANT TOUTE DISPOSITION CONTRAIRE DES PRÉSENTES, VOUS RECONNAISSEZ ET ACCEPTEZ QUE VOUS N'AVEZ AUCUN DROIT DE PROPRIÉTÉ OU AUTRE INTÉRÊT DANS LE COMPTE, ET VOUS RECONNAISSEZ ET ACCEPTEZ EN OUTRE QUE TOUS LES DROITS SUR LE COMPTE SONT ET SERONT À JAMAIS LA PROPRIÉTÉ DE PILI ET LUI REVIENDRONT.
2.3. Objets virtuels
PILI détient, a obtenu sous licence ou a autrement le droit d’utiliser l’ensemble des contenus apparaissant dans le Service ou dans les jeux PILI. Nonobstant toute disposition contraire, vous acceptez de ne détenir aucun droit ni titre sur tout contenu apparaissant dans le Service, y compris, sans s’y limiter, les biens ou monnaies virtuels présents ou générés dans tout jeu PILI, qu’ils aient été obtenus en jeu ou achetés, ou tout autre attribut lié à un Compte ou stocké sur le Service.
3. Contenu utilisateur
3.1. Soumission de contenu utilisateur
Par « Contenu utilisateur », nous entendons toute communication, image, son, ainsi que tout matériel, donnée ou information que vous téléversez ou transmettez via un client de jeu PILI ou via le Service, ou que d’autres utilisateurs téléversent ou transmettent, y compris, sans s’y limiter, tout texte de discussion. En transmettant ou en soumettant un Contenu utilisateur via le Service, vous affirmez, déclarez et garantissez que ce contenu (a) est exact, non confidentiel et non trompeur ; (b) ne viole aucune loi, restriction contractuelle ni aucun droit de tiers, et que vous disposez de l’autorisation de toute personne tierce dont les informations personnelles ou la propriété intellectuelle seraient contenues dans ledit contenu ; (c) est exempt de virus, publiciels, logiciels espions, vers ou tout autre code malveillant ; (d) vous reconnaissez et acceptez que toute information personnelle contenue dans ce contenu soit traitée par PILI conformément à sa Politique de confidentialité.
3.1.1. Filtrage du contenu
PILI décline toute responsabilité quant au comportement des utilisateurs qui soumettent un Contenu utilisateur, et n’assume aucune obligation de surveiller le Service pour détecter un contenu ou un comportement inapproprié. Nous ne filtrons ni ne surveillons pas l’ensemble des contenus de manière systématique. Vous utilisez le Service à vos propres risques. En utilisant le Service, vous pouvez être exposé à des contenus que vous pourriez juger offensants, indécents ou contraires à vos attentes. Vous assumez l’entière responsabilité de votre utilisation de tout Contenu utilisateur accessible via le Service. À sa seule discrétion, PILI (par ses représentants ou ses 
technologies) peut surveiller et/ou enregistrer vos interactions avec le Service ou vos communications (notamment mais sans s'y limiter les discussions écrites). 
En acceptant les présentes Conditions d’utilisation, vous donnez votre consentement irrévocable à une telle surveillance et à un tel enregistrement. Vous reconnaissez et acceptez ne pas avoir d’attente raisonnable en matière de confidentialité concernant la transmission de tout Contenu utilisateur, y compris les discussions textuelles ou vocales.
PILI se réserve le droit, à tout moment et sans préavis, de consulter, surveiller, interdire, modifier, supprimer, désactiver ou rendre indisponible tout Contenu utilisateur (y compris mais sans s’y limiter le vôtre), pour tout motif ou sans motif. Même si PILI décide de surveiller le Service, elle n’est nullement tenue de modifier ou de retirer tout contenu jugé inapproprié. Elle peut, à sa seule discrétion, éditer, refuser de publier ou supprimer tout Contenu utilisateur.
3.2. Utilisation des informations par d'Autres membres du Service
3.2.1. Discours public
Le service peut inclure divers forums, blogs et fonctions de chat où vous pouvez publier du contenu utilisateur, y compris vos observations et commentaires sur des sujets désignés. PILI ne peut pas garantir que les autres membres n'utiliseront pas les idées et les informations que vous partagez. Par conséquent, si vous avez une idée ou une information que vous souhaitez garder confidentielle et/ou que vous ne voulez pas que d'autres utilisent, ne la publiez pas sur le service. PILI n'a aucune responsabilité dans l'évaluation, l'utilisation ou la rémunération des idées ou informations que vous choisissez de soumettre.
3.2.2. Responsabilité de votre propre contenu
Vous êtes seul responsable des informations que vous publiez sur, via ou en lien avec le Service, ainsi que de celles que vous communiquez à d'autres. PILI peut refuser, rejeter ou supprimer tout Contenu utilisateur pour quelque raison que ce soit ou sans raison, y compris notamment tout contenu que PILI, à sa seule discrétion, considère comme une violation des présentes Conditions.
3.2.3. Votre licence accordée à PILI
Par les présentes, vous accordez à PILI une licence irrévocable, perpétuelle, transférable, entièrement payée, libre de redevances, mondiale (y compris le droit d'accorder des sous-licences et de céder à des tiers) et le droit de copier, reproduire, fixer, adapter, modifier, créer des œuvres dérivées, fabriquer, commercialiser, publier, distribuer, vendre, accorder des licences, accorder des sous-licences, transférer, louer, transmettre, afficher publiquement, publiquement, ou fournir un accès électronique, diffuser, communiquer au public par télécommunication, afficher, exécuter, entrer dans une mémoire informatique, et utiliser et pratiquer, de quelque manière que ce soit, votre Contenu utilisateur ainsi que toutes les œuvres modifiées et dérivées de celui-ci dans le cadre de notre fourniture du Service, y compris la commercialisation et la promotion du Service. Par les présentes, vous accordez également à PILI le droit d'autoriser d'autres personnes à exercer les droits accordés à PILI en vertu des présentes Conditions. En outre, vous accordez par les présentes à PILI le droit inconditionnel et irrévocable d'utiliser et d'exploiter votre nom, votre image et toute autre information ou matériel inclus dans tout Contenu d'utilisateur et en relation avec tout Contenu d'utilisateur, sans aucune obligation envers vous. Sauf si la loi l'interdit, vous renoncez à tout droit d'attribution et/ou à tout droit moral que vous pourriez avoir sur votre Contenu utilisateur, que celui-ci soit modifié ou non de quelque manière que ce soit. L'IPLI ne revendique aucun droit de propriété sur votre Contenu utilisateur et rien dans les présentes Conditions n'est destiné à restreindre les droits que vous pourriez avoir d'utiliser et d'exploiter votre Contenu utilisateur.
3.3. Interactions entre utilisateurs
ous êtes seul responsable de vos interactions avec les autres utilisateurs du Service et avec tout tiers avec lequel vous interagissez via le Service et/ou les jeux PILI. PILI se réserve le droit, sans y être obligée, d’intervenir dans tout litige.Vous vous engagez à coopérer pleinement avec PILI dans le cadre de toute enquête portant sur une activité suspectée d’être illégale, frauduleuse ou abusive, y compris, sans s’y limiter, en donnant à PILI un accès aux sections protégées par mot de passe de votre Compte.
En cas de litige avec un ou plusieurs utilisateurs, vous déchargez PILI (ainsi que ses dirigeants, administrateurs, agents, filiales, coentreprises et employés) de toute responsabilité en lien avec des réclamations, demandes et dommages (directs ou indirects), de toute nature, connus ou inconnus, résultant de ces litiges ou s’y rapportant de quelque manière que ce soit.
4. Frais et conditions d’achat
4.1. Achats
Dans le cadre du Service, vous pouvez acheter, en utilisant de l'argent « réel », une licence limitée, personnelle, non transférable, non sous-licenciable et révocable vous permettant d’utiliser (a) une « monnaie virtuelle », notamment des espèces virtuelles ou des diamants, exclusivement destinés à une utilisation dans les jeux PILI ; (b) des « objets virtuels en jeu » (désignés conjointement avec la « monnaie virtuelle » comme les « Objets Virtuels ») ; et (c) d'autres biens ou services (les « Produits »). Vous êtes uniquement autorisé à acheter des Objets Virtuels auprès de PILI ou de ses partenaires agréés via le Service, et de aucune autre manière.
PILI se réserve le droit de gérer, réguler, contrôler, modifier ou supprimer les Objets Virtuels et/ou les Produits à tout moment, avec ou sans préavis. PILI ne saurait être tenue responsable envers vous ou tout tiers en cas d’exercice de ces droits.
Le transfert d’Objets Virtuels et de Produits est interdit, sauf autorisation expresse dans le cadre du Service. Sauf disposition contraire expressément prévue dans le Service, vous ne pouvez ni vendre, ni acheter, ni échanger, ni transférer d’une quelconque manière des Objets Virtuels ou des Produits à toute personne ou entité, y compris mais sans s’y limiter à PILI, un autre utilisateur ou tout tiers, ni tenter de le faire.
TOUS LES ACHATS ET UTILISATIONS D’OBJETS VIRTUELS EFFECTUÉS PAR LE BIAIS DU SERVICE SONT DÉFINITIFS ET NON REMBOURSABLES.
La fourniture d’Objets Virtuels pour une utilisation dans les jeux PILI constitue un service fourni par PILI qui commence dès l’acceptation de votre achat par PILI.
4.2. Paiements et frais
Vous acceptez de régler tous les frais et taxes applicables engagés par vous ou toute personne utilisant un Compte enregistré à votre nom. PILI se réserve le droit de modifier les prix des biens et services proposés par le Service à tout moment. VOUS RECONNAISSEZ QUE PILI N’EST PAS TENUE DE PROCÉDER À UN REMBOURSEMENT, QUELLE QU’EN SOIT LA RAISON, ET QUE VOUS NE RECEVREZ AUCUNE COMPENSATION, FINANCIÈRE OU AUTRE, POUR DES OBJETS VIRTUELS NON UTILISÉS EN CAS DE FERMETURE DE COMPTE, QU’ELLE SOIT VOLONTAIRE OU NON.
5. Mises à jour du Service
Vous comprenez que le Service est en constante évolution. PILI peut exiger que vous acceptiez des mises à jour du Service ainsi que des jeux PILI installés sur votre appareil ou ordinateur. Vous reconnaissez et acceptez que PILI puisse procéder à des mises à jour du Service et des jeux PILI, avec ou sans vous en avertir. Il se peut également que vous deviez mettre à jour certains logiciels tiers pour continuer à utiliser le Service et jouer aux jeux PILI.
6. Exclusion de garantie
SANS LIMITER LA RESPONSABILITE DE PILI AU TITRE DE L'ARTICLE 7 CI-DESSOUS, LE SERVICE EST FOURNI « EN L'ETAT » ET « TEL QUE DISPONIBLE » POUR VOTRE USAGE, SANS GARANTIE D'AUCUNE SORTE, EXPRESSE OU IMPLICITE, Y COMPRIS, SANS LIMITATION, LES GARANTIES DE QUALITE MARCHANDE, D'ADEQUATION A UN USAGE PARTICULIER, DE TITRE, D'ABSENCE DE CONTREFACON, ET CELLES DECOULANT DES RELATIONS COMMERCIALES OU DE L'USAGE DU COMMERCE. PILI NE GARANTIT PAS QUE VOUS POURREZ ACCÉDER AU SERVICE OU L'UTILISER AU MOMENT OU À L'ENDROIT DE VOTRE CHOIX, QUE LE SERVICE SERA ININTERROMPU OU EXEMPT D'ERREURS, QUE LES DÉFAUTS SERONT CORRIGÉS OU QUE LE JEU OU LE SERVICE SONT EXEMPTS DE VIRUS OU D'AUTRES ÉLÉMENTS NUISIBLES. Certaines juridictions n’autorisant pas l’exclusion de certaines garanties, il est possible que certaines des exclusions susmentionnées ne vous soient pas applicables.

DANS TOUTE LA MESURE PERMISE PAR LA LOI, PILI NE SERA PAS RESPONSABLE ENVERS VOUS DES DOMMAGES INDIRECTS, ACCIDENTELS, CONSÉCUTIFS, SPÉCIAUX, PUNITIFS OU AUTRES DOMMAGES SIMILAIRES, Y COMPRIS, MAIS SANS S'Y LIMITER, LES PERTES DE REVENUS, DE BÉNÉFICES, DE DONNÉES OU D'INTERRUPTION D'ACTIVITÉ OU AUTRES PERTES INTANGIBLES (QUELLE QUE SOIT LA MANIÈRE DONT CES PERTES SONT QUALIFIÉES), DÉCOULANT DE OU LIÉS DE QUELQUE MANIÈRE QUE CE SOIT AUX PRÉSENTES CONDITIONS D'UTILISATION OU AU SERVICE LUI-MÊME, QU'ILS SOIENT FONDÉS SUR UN CONTRAT, UN DÉLIT OU TOUTE AUTRE THÉORIE JURIDIQUE, ET QUE PILI AIT ÉTÉ OU NON INFORMÉE DE LA POSSIBILITÉ DE TELS DOMMAGES. DANS LES LIMITES NON INTERDITES PAR LA LOI, LA RESPONSABILITÉ TOTALE DE PILI ENVERS VOUS NE POURRA DÉPASSER LE MONTANT QUE VOUS AVEZ EFFECTIVEMENT PAYÉ À PILI EN APPLICATION DES PRÉSENTES CONDITIONS AU COURS DES SIX (6) MOIS PRÉCÉDANT LA DATE À LAQUELLE VOUS AVEZ PRÉSENTÉ VOTRE PREMIÈRE RÉCLAMATION. VOUS RECONNAISSEZ QUE SI VOUS N’AVEZ EFFECTUÉ AUCUN PAIEMENT À PILI DURANT CETTE PÉRIODE, VOTRE SEUL RECOURS (ET LA SEULE RESPONSABILITÉ DE PILI) CONSISTE À CESSER D’UTILISER LE SERVICE ET À SUPPRIMER VOTRE COMPTE.
RIEN DANS CES CONDITIONS DE SERVICE N'AFFECTE LES DROITS STATUTAIRES DE TOUT CONSOMMATEUR, NI N'EXCLUT OU NE LIMITE TOUTE RESPONSABILITÉ RÉSULTANT D'UNE NÉGLIGENCE GRAVE OU D'UNE FAUTE INTENTIONNELLE DE PILI, OU EN CAS DE DÉCÈS OU DE DOMMAGE CORPOREL RÉSULTANT D'UNE NÉGLIGENCE OU D'UNE FRAUDE DE PILI.
Vous acceptez d’indemniser, de défendre et de dégager de toute responsabilité PILI (ainsi que ses dirigeants, administrateurs, agents, filiales, sociétés affiliées, concédants, coentreprises et employés) contre toute réclamation, tout dommage ou toute perte, y compris les frais d’avocats raisonnables, émanant de tiers et résultant de votre utilisation du Service ou de toute violation des présentes Conditions de votre part. Cette disposition ne s’applique pas si l’atteinte aux droits en question ne vous est pas imputable, intentionnellement ou par négligence.
8. Règlement des litiges et droit applicable
En cas de litige entre vous et PILI, nous vous encourageons vivement à nous contacter directement afin de tenter de parvenir à une résolution amiable. Si vous résidez aux États-Unis, les présentes Conditions, ainsi que tout litige en découlant ou lié à la Politique de confidentialité ou au Service, seront régis par les lois de l’État de Californie, sans égard aux règles de conflit de lois. Vous acceptez que toute réclamation ou tout litige que vous pourriez avoir avec PILI soit tranché exclusivement par un tribunal situé à San Francisco, Californie.Si vous résidez en dehors des États-Unis, vous acceptez que tous les litiges entre vous et PILI soient régis par les lois de Singapour, sans égard aux règles de conflit de lois. Vous acceptez que tout litige avec PILI soit exclusivement tranché par un tribunal situé à Singapour.
9. Divisibilité
Vous et PILI acceptez que si une partie des présentes conditions de service ou de la politique de confidentialité de PILI est jugée illégale ou inapplicable, en tout ou en partie, par un tribunal compétent, cette disposition sera, pour cette juridiction, inefficace uniquement dans la mesure de cette décision d'invalidité ou d'inapplicabilité, sans affecter la validité ou l'applicabilité de cette disposition d'une autre manière ou dans une autre juridiction et sans affecter les autres dispositions des conditions, qui resteront pleinement en vigueur.
10. Dispositions générales
10.1. Transfert de contrat
PILI peut céder ou déléguer les présentes Conditions et/ou la Politique de confidentialité, en tout ou en partie, à toute personne ou entité, à tout moment, avec ou sans votre consentement. Vous ne pouvez céder ni déléguer aucun droit ni obligation en vertu des présentes sans l’accord écrit préalable de PILI, et toute cession ou délégation non autorisée sera considérée comme nulle et non avenue.
10.2. Politiques complémentaires
PILI peut publier des politiques additionnelles relatives à certains services spécifiques, tels que les forums, les concours ou les programmes de fidélité. Votre droit d’utiliser ces services est soumis auxdites politiques spécifiques ainsi qu’aux présentes Conditions.
10.3. Intégralité de l’accord
Les présentes Conditions, ainsi que toutes politiques complémentaires et tous documents expressément intégrés par renvoi (y compris la Politique de confidentialité de PILI), constituent l’intégralité de l’accord entre vous et PILI, et remplacent tout accord ou compréhension antérieurs, qu’ils soient électroniques, oraux ou écrits, ou fondés sur des usages, des pratiques, des politiques ou des précédents, entre vous et nous concernant le Service.
10.4. Absence de renonciation
Le fait que PILI n'exige pas ou n'impose pas strictement le respect de l'une quelconque des dispositions des présentes Conditions ou de la Politique de confidentialité de PILI, ou qu'elle n'exerce pas un droit quelconque en vertu de ces documents, ne saurait être interprété comme une renonciation ou un abandon du droit de PILI de faire valoir ou d’invoquer ladite disposition ou ledit droit, que ce soit dans le cas concerné ou dans tout autre.
La renonciation expresse par PILI à toute disposition, condition ou exigence des présentes Conditions ou de la Politique de confidentialité de PILI ne constitue pas une renonciation à toute obligation future de se conformer à ladite disposition, condition ou exigence.
Sauf disposition expresse et spécifique des présentes Conditions, aucune déclaration, affirmation, consentement, renonciation, ou tout autre acte ou omission de la part de PILI ne saurait être interprété comme une modification des présentes Conditions, ni comme étant juridiquement contraignant, à moins qu'il ne soit consigné par écrit, signé de manière manuscrite par vous-même et par un représentant dûment habilité de PILI.
10.5. Notifications
Nous pouvons vous adresser des notifications par le biais de publications sur le site https://www.pilistarship.com, par courrier électronique ou par tout autre moyen de communication utilisant les coordonnées que vous nous avez fournies. Toute notification transmise sans respecter les exigences de la présente clause ne produira aucun effet juridique.
10.6. Mesures équitables
Vous reconnaissez que les droits accordés à PILI et les obligations qui lui incombent en vertu des présentes Conditions sont d'une nature unique et irremplaçable, dont la perte porterait un préjudice irréparable à PILI et ne pourrait être remplacée par de simples dommages-intérêts, de sorte que PILI aurait droit à une injonction ou à d'autres mesures équitables (sans l'obligation de déposer une caution ou une preuve de dommages-intérêts) en cas de rupture ou de rupture anticipé de votre part.
En conséquence, PILI aura le droit d’obtenir une injonction ou toute autre mesure équitable (sans obligation de dépôt de garantie ou de preuve de dommages) en cas de violation ou de menace de violation de votre part. Vous renoncez irrévocablement à tout droit de solliciter une injonction ou toute autre mesure équitable visant à empêcher ou restreindre le fonctionnement du Service ou de tout jeu PILI, ou l’exploitation de toute publicité ou autre élément y afférent. Vous acceptez de limiter vos demandes à des dommages-intérêts pécuniaires, tels que définis dans l’article 7 (le cas échéant).
10.7. Force majeure
PILI ne pourra être tenue responsable d’un quelconque retard ou manquement à ses obligations résultant de circonstances indépendantes de sa volonté raisonnable, y compris, sans s’y limiter, en cas de force majeure, guerre, terrorisme, émeutes, embargos, actes des autorités civiles ou militaires, incendies, inondations, accidents, grèves, ou pénuries de moyens de transport, de carburant, d’énergie, de main-d’œuvre ou de matières premières.

The terms of this agreement ("Terms of Service") govern the relationship between you and PILI STARSHIP PTE. LTD., a Singaporean company (business ID 202346742E) having its registered office at 152 BEACH ROAD #11-05, GATEWAY EAST SINGAPORE (189721), (hereinafter "PILI" or "us" or "we") regarding your use of PILI's games, websites and related services (the "Service"). Use of the Service is also governed by PILI's Privacy Policy and other relevant policies, which are incorporated herein by reference.

Before accessing or using the Service, including browsing any PILI website or accessing a game, you must agree to these Terms of Service and the Privacy Policy. You may also be required to register an account on the Service (an "Account"). By registering for an Account or otherwise using the Service, you represent that you are age 13 or older. If you are between the ages of 13 and 17, you represent that your legal guardian has reviewed and agreed to these Terms. If you access the Service from a Social Networking Site ("SNS"), such as Facebook or Google+, you shall comply with its terms of service/use as well as these Terms of Service.

BY INSTALLING, USING OR OTHERWISE ACCESSING THE SERVICE, YOU AGREE TO THESE TERMS OF SERVICE. IF YOU DO NOT AGREE TO THESE TERMS OF SERVICE, PLEASE DO NOT INSTALL, USE OR OTHERWISE ACCESS THE SERVICE. USE OF THE SERVICE IS VOID WHERE PROHIBITED.

PILI reserves the right, at its discretion, to change, modify, add or remove portions of these Terms of Service, its Privacy Policy and other relevant PILI policies at any time by posting the amended terms on the PILI Service. You will be deemed to have accepted such changes by continuing to use the Service. If at any point you do not agree to any portion of the then-current version of our Terms of Service, the PILI Privacy Policy, or any other PILI policy, rules or codes of conduct relating to your use of the Service, your license to use the Service shall immediately terminate, and you must immediately stop using the Service.

1. License
1.1. Grant of a Limited License to Use the Service
Subject to your agreement and continuing compliance with these Terms of Service and any other relevant PILI policies, PILI grants you a non-exclusive, non-transferable, non-sublicensable, revocable and limited license to access and use the Service for your own non-commercial entertainment purposes. You agree not to use the Service for any other purpose other than as provided for by these Terms.

The following restrictions apply to the use of the Service:

You shall not create an Account or access the Service if you are under the age of 13; You shall restrict use by minors, and you will deny access to children under the age of 13. We reserve the right to request proof of age at any stage to verify that persons not of legal age are not using or accessing the Service. You accept full responsibility for any unauthorized use of the Service by minors. You are responsible for any use of your credit card or other payment instrument (e.g. paypal) by minors.
You shall not (or attempt to) purchase, sell, resell, rent or give away your Account, create an Account using a false identity or information, or on behalf of someone other than yourself; You shall not use the Service if you have previously been removed by PILI, or previously been banned from playing any PILI game.
 You shall use your Account only for non-commercial purposes; You shall not use the Service to advertise, or solicit, or transmit any commercial advertisements, including chain letters, junk or spam e-mail or repetitive or misleading messages to anyone.
We reserve all available legal rights and remedies to prevent unauthorized use of the Service, including, but not limited to, technological barriers, IP mapping, and, in serious cases, directly contacting your Internet Service Provider (ISP) regarding such unauthorized use.

Login information and Your Account
You may be required to select a password for your Account or you may also use other credentials to access the Account ("Login Information"). You shall not share the Account or the Login Information, nor let anyone else access your Account or do anything else that might jeopardize the security of your Account. In the event you become aware of or reasonably suspect any breach of security, including without limitation any loss, theft, or unauthorized disclosure of the Login Information, you must immediately notify PILI and modify your Login Information. You are solely responsible for maintaining the confidentiality of the Login Information, and you will be responsible for all uses of the Login Information, including purchases, whether or not authorized by you. You are responsible for anything that happens through your Account, whether or not you know about it.

PILI reserves the right to remove or reclaim any usernames at any time and for any reason, including but not limited to claims by a third party that a username violates the third party's rights.

The Service supports only one Account per game on a supported device.

License Limitations
Any use of the Service in violation of these License Limitations is strictly prohibited, can result in the immediate revocation of your limited license and may subject you to liability for violations of law.

You agree that you will not, under any circumstances:

Engage in any act that PILI deems to be in conflict with the spirit or intent of the Service or make improper use of PILI's support services.
Develop, distribute, use or take part (directly or indirectly) in the use of cheats, exploits, automation software, bots, hacks, mods or any unauthorized third-party software designed to modify or interfere with the Service, any PILI game or any PILI game experience.
Modify or cause to be modified any files that are a part of the Service or any PILI game without PILI's express written consent. Disrupt, interfere with or otherwise adversely affect the normal flow of the Service or otherwise act in a manner that may negatively affect other users' experience when using the Service or playing PILI's games. This includes win trading and any other kind of manipulation of rankings, taking advantage of errors in the Service to gain an unfair edge over other players and any other act that intentionally abuses or goes against the design of the Service.
Disrupt, overburden, or aid or assist in the disruption or overburdening of any computer or server ("Server") used to offer or support the Service or any PILI game environment.
Institute, assist, or become involved in any type of attack, including without limitation distribution of a virus, denial of service attacks upon the Service, or other attempts to disrupt the Service or any other person's use or enjoyment of the Service.
Attempt to gain unauthorized access to the Service, Accounts registered to others or to the computers, Servers, or networks connected to the Service by any means other than the user interface provided by PILI, including but not limited to, by circumventing or modifying, attempting to circumvent or modify, or encouraging or assisting any other person to circumvent or modify, any security, technology, device, or software that is part of the Service.
Post, upload, transmit or otherwise disseminate any information that is abusive, violent, threatening, obscene, defamatory, libelous, racial, sexual, religious, or otherwise objectionable, offensive or engage in ongoing toxic behavior, such as by repeatedly posting information on an unsolicited basis.
Attempt to, or harass, abuse, or harm, or advocate or incite harassment, abuse, or harm of another person, group, including PILI employees (such as PILI's customer service representatives).
Make available through the Service any material or information that infringes any copyright, trademark, patent, trade secret, right of privacy, right of publicity, or other right of any person or entity or impersonates any other person, including without limitation a PILI employee.
 Reverse engineer, decompile, disassemble, decipher or otherwise attempt to derive the source code for any underlying software or other intellectual property used to provide the Service or any PILI game, or to obtain any information from the Service or any PILI game using any method not expressly permitted by PILI.
Solicit or attempt to solicit Login Information or any other login credentials or personal information from other users of the Service or any PILI game.
Collect or post anyone's private information, including personally identifiable information (whether in text, image or video form), identification documents, or financial information through the Service.
PILI reserves the right to determine what conduct it considers to be in violation of the rules of use or otherwise outside the intent or spirit of these Terms of Service or the Service itself. PILI reserves the right to take action as a result, which may include terminating your Account and prohibiting you from using the Service in whole or in part.

1.2. Suspension and Termination of Account and Service
WITHOUT LIMITING ANY OTHER REMEDIES, PILI MAY LIMIT, SUSPEND, TERMINATE, MODIFY, OR DELETE ACCOUNTS OR ACCESS TO THE SERVICE OR PORTIONS THEREOF IF YOU ARE, OR PILI SUSPECTS THAT YOU ARE, FAILING TO COMPLY WITH ANY OF THESE TERMS OF SERVICE OR FOR ANY ACTUAL OR SUSPECTED ILLEGAL OR IMPROPER USE OF THE SERVICE, WITH OR WITHOUT NOTICE TO YOU. YOU CAN LOSE YOUR USER NAME AND PERSONA IN THE SERVICE AS A RESULT OF ACCOUNT TERMINATION OR LIMITATION, AS WELL AS ANY BENEFITS, PRIVILEGES, EARNED ITEMS AND PURCHASED ITEMS ASSOCIATED WITH YOUR USE OF THE SERVICE, AND PILI IS UNDER NO OBLIGATION TO COMPENSATE YOU FOR ANY SUCH LOSSES OR RESULTS.

ADDITIONALLY, WE MAY, IN APPROPRIATE CIRCUMSTANCES AND AT OUR SOLE DISCRETION, SUSPEND OR TERMINATE ACCOUNTS OF USERS WHO MAY BE REPEAT VIOLATORS OF OUR TERMS, POLICIES OR LEGAL REQUIRMENTS, OR REPEAT INFRINGERS OF THIRD PARTY INTELLECTUAL PROPERTY RIGHTS.

PILI RESERVES THE RIGHT TO TERMINATE ANY ACCOUNT THAT HAS BEEN INACTIVE FOR 180 DAYS.

PILI reserves the right to stop offering and/or supporting the Service or a particular game or part of the Service at any time, at which point your license to use the Service or a part thereof will be automatically terminated. In such event, PILI shall not be required to provide refunds, benefits or other compensation to users in connection with such discontinued Service . Termination of your Account can include disabling your access to the Service or any part thereof including any content you submitted or others submitted.

2. Ownership
2.1. Games and Service
All rights, title and interest in and to the Service (including without limitation any games, titles, computer code, themes, objects, characters, character names, stories, dialogue, catch phrases, concepts, artwork, animations, sounds, musical compositions, audio-visual effects, methods of operation, moral rights, documentation, in-game chat transcripts, character profile information, recordings of games played using a PILI game client, and the PILI game clients and server software) are owned by PILI. PILI reserves all rights, including without limitation, all intellectual property rights or other proprietary rights, in connection with its games and the Service.

2.2. Accounts
NOTWITHSTANDING ANYTHING TO THE CONTRARY HEREIN, YOU ACKNOWLEDGE AND AGREE THAT YOU SHALL HAVE NO OWNERSHIP OR OTHER PROPERTY INTEREST IN THE ACCOUNT, AND YOU FURTHER ACKNOWLEDGE AND AGREE THAT ALL RIGHTS IN AND TO THE ACCOUNT ARE AND SHALL FOREVER BE OWNED BY AND INURE TO THE BENEFIT OF PILI.

2.3. Virtual Items
PILI owns, has licensed, or otherwise has rights to use all of the content that appears in the Service or in PILI games. Notwithstanding any provision to the contrary herein, you agree that you have no right or title in or to any content that appears in the Service, including without limitation the virtual goods or currency appearing or originating in any PILI game, whether earned in a game or purchased from PILI, or any other attributes associated with an Account or stored on the Service.

3. User Content
3.1. Submission of User Content
"User Content" means any communications, images, sounds, and all the material, data, and information that you upload or transmit through a PILI game client or the Service, or that other users upload or transmit, including without limitation any chat text. By transmitting or submitting any User Content while using the Service, you affirm, represent and warrant that such transmission or submission is (a) accurate and not confidential or misleading; (b) not in violation of any laws, contractual restrictions or other third party rights, and that you have permission from any third party whose personal information or intellectual property is comprised in the User Content; (c) free of viruses, adware, spyware, worms or other malicious code; and (d) you acknowledge and agree that any of your personal information within such content will at all times be processed by PILI in accordance with its Privacy Policy.

3.1.1. Content Screening
PILI assumes no responsibility for the conduct of any user submitting any User Content, and assumes no responsibility for monitoring the Service for inappropriate content or conduct. We do not, and cannot, pre-screen or monitor all User Content. Your use of the Service is at your own risk. By using the Service, you may be exposed to User Content that is offensive, indecent or otherwise not in line with your expectations. You bear all risks associated with the use of any User Content available in connection with the Service. At our discretion, our representatives or

technology may monitor and/or record your interaction with the Service or communications (including without limitation chat text) when you are using the Service.

By entering into these Terms of Service, you hereby provide your irrevocable consent to such monitoring and recording. You acknowledge and agree that you have no expectation of privacy concerning the transmission of any User Content, including without limitation chat text or voice communications.

PILI reserves the right in its sole discretion to review, monitor, prohibit, edit, delete, disable access to or otherwise make unavailable any User Content (including without limitation your User Content) without notice for any reason or for no reason at any time. If at any time PILI chooses, in its sole discretion, to monitor the Service, PILI nonetheless assumes no responsibility for User Content and assumes no obligation to modify or remove any inappropriate User Content. We have the right, but not the obligation, in our sole discretion to edit, refuse to post, or remove any User Content.

3.2. Information Use by Other Members of the Service
3.2.1. Public Discourse
The Service may include various forums, blogs and chat features where you can post User Content, including your observations and comments on designated topics. PILI cannot guarantee that other members will not use the ideas and information that you share. Therefore, if you have an idea or information that you would like to keep confidential and/or don't want others to use, do not post it on the Service. PILI shall have no responsibility to evaluate, use or compensate you for any ideas or information you may choose to submit.

3.2.2. Responsible For Your Own Content
You are solely responsible for the information that you post on, through or in connection with the Service and that you provide to others. PILI may reject, refuse to post or delete any User Content for any or no reason, including, but not limited to, User Content that in the sole judgment of PILI violates these Terms of Service.

3.2.3. Your License to PILI
You hereby grant to PILI an irrevocable, perpetual, transferable, fully paid-up, royalty-free, worldwide license (including the right to sublicense and assign to third party) and right to copy, reproduce, fix, adapt, modify, create derivative works from, manufacture, commercialize, publish, distribute, sell, license, sublicense, transfer, lease, transmit, publicly display, publicly perform, or provide access to electronically, broadcast, communicate to the public by telecommunication, display, perform, enter into computer memory, and use and practice, in any way, your User Content as well as all modified and derivative works thereof in connection with our provision of the Service, including marketing and promotions of the Service. You also hereby grant to PILI the right to authorize others to exercise any of the rights granted to PILI under these Terms of Service. You further hereby grant to PILI the unconditional, irrevocable right to use and exploit your name, likeness and any other information or material included in any User Content and in connection with any User Content, without any obligation to you. Except as prohibited by law, you waive any rights of attribution and/or any moral rights you may have in your User Content, regardless of whether your User Content is altered or changed in any manner. PILI does not claim any ownership rights in your User Content and nothing in these Terms of Service is intended to restrict any rights that you may have to use and exploit your User Content. PILI has no obligation to monitor or enforce your intellectual property rights in or to your User Content.

3.3. User Interactions
You are solely responsible for your interactions with other users of the Service and any other parties with whom you interact through the Service and/or PILI games. PILI reserves the right, but has no obligation, to become involved in any way with these disputes. You will fully cooperate with PILI to investigate any suspected unlawful, fraudulent or improper activity, including, without limitation, granting PILI access to any password-protected portions of your Account.

If you have a dispute with one or more users, you release us (and our officers, directors, agents, subsidiaries, joint ventures and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.

4. Fees and Purchase Terms
4.1.Purchases
In the Service you may purchase, with "real world" money, a limited, personal, non-transferable, non-sublicensable, revocable license to use (a) "virtual currency", including but not limited to virtual cash or diamonds, all for use in PILI games; (b) "virtual in-game items" (together with "virtual currency", "Virtual Items"); and (c) other goods or services ("Merchandise"). You are only allowed to purchase Virtual Items from us or our authorised partners through the Service, and not in any other way.

PILI may manage, regulate, control, modify or eliminate Virtual Items and/or Merchandise at any time, with or without notice. PILI shall have no liability to you or any third party in the event that PILI exercises any such rights./p>

The transfer of Virtual Items and Merchandise is prohibited except where expressly authorized in the Service. Other than as expressly authorized in the Service, you shall not sell, purchase, redeem or otherwise transfer Virtual Items or Merchandise to any person or entity or attempt any of the aforesaid, including but not limited to PILI, another user or any third party.

ALL PURCHASES AND REDEMPTIONS OF VIRTUAL ITEMS MADE THROUGH THE SERVICE ARE FINAL AND NON-REFUNDABLE.

The provision of Virtual Items for use in PILI games is a service provided by PILI that commences immediately upon acceptance by PILI of your purchase.

4.2. Payment of Fees
You agree to pay all fees and applicable taxes incurred by you or anyone using an Account registered to you. PILI may revise the pricing for the goods and services offered through the Service at any time. YOU ACKNOWLEDGE THAT PILI IS NOT REQUIRED TO PROVIDE A REFUND FOR ANY REASON, AND THAT YOU WILL NOT RECEIVE MONEY OR OTHER COMPENSATION FOR UNUSED VIRTUAL ITEMS WHEN AN ACCOUNT IS CLOSED, WHETHER SUCH CLOSURE WAS VOLUNTARY OR INVOLUNTARY.

5. Updates to the Service
You understand that the Service is an evolving one. PILI may require that you accept updates to the Service and to PILI's games you have installed on your device or computer. You acknowledge and agree that PILI may update the Service and PILI games, with or without notifying you. You may need to update third party software from time to time in order to receive the Service and play PILI games.

6. Disclaimer of Warranties
WITHOUT LIMITING PILI'S LIABILITY UNDER SECTION 7 BELOW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS FOR YOUR USE, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND THOSE ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. PILI DOES NOT WARRANT THAT YOU WILL BE ABLE TO ACCESS OR USE THE SERVICE AT THE TIMES OR LOCATIONS OF YOUR CHOOSING; THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; OR THAT THE GAME OR THE SERVICE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. Some jurisdictions do not allow the exclusion of certain warranties. Accordingly, some of the above disclaimers may not apply to you.

7. Limitation of Liability; Sole and Exclusive Remedy; Indemnification
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PILI SHALL NOT BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE OR OTHER SIMILAR DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUES, LOST PROFITS, LOST DATA OR BUSINESS INTERRUPTION OR OTHER INTANGIBLE LOSSES (HOWEVER SUCH LOSSES ARE QUALIFIED), ARISING OUT OF OR RELATING IN ANY WAY TO THESE TERMS OF SERVICE OR THE SERVICE ITSELF, WHETHER BASED ON CONTRACT, TORT OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT PILI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT NOT PROHIBITED BY LAW, PILI SHALL NOT BE LIABLE TO YOU FOR MORE THAN THE AMOUNT YOU HAVE PAID TO PILI IN ACCORDANCE WITH THESE TERMS OF SERVICE IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE DATE ON WHICH YOU FIRST ASSERT A CLAIM. YOU ACKNOWLEDGE AND AGREE THAT IF YOU HAVE NOT PAID ANYTHING TO PILI DURING SUCH TIME PERIOD, YOUR SOLE REMEDY (AND PILI'S EXCLUSIVE LIABILITY) FOR ANY DISPUTE WITH PILI IS TO STOP USING THE SERVICE AND TO CANCEL YOUR ACCOUNT.

NOTHING IN THESE TERMS OF SERVICE SHALL AFFECT THE STATUTORY RIGHTS OF ANY CONSUMER OR EXCLUDE OR RESTRICT ANY LIABILITY RESULTING FROM GROSS NEGLIGENCE OR WILLFUL MISCONDUCT OF PILI OR FOR DEATH OR PERSONAL INJURY ARISING FROM ANY NEGLIGENCE OR FRAUD OF PILI.

You agree to indemnify, defend and hold PILI (and our officers, directors, agents, subsidiaries, affiliates, agents, licensors, joint ventures and employees) harmless from any claim, demand, damages or other losses, including reasonable attorneys' fees, asserted by any third-party resulting from or arising out of your use of the Service, or any breach by you of these Terms of Service, however the foregoing does not apply if the infringement of rights is not attributable to your intentional or negligent behavior.

8. Dispute Resolution and Law
If a dispute arises between you and PILI, we strongly encourage you to first contact us directly to seek a resolution. If you are a resident of the United States, these Terms of Service and any dispute arising out of or related to it or Privacy Policy or the Service shall be governed in all respects by California law, without regard to conflict of law provisions. You agree that any claim or dispute you may have against PILI must be resolved exclusively by a court located in San Francisco, California. If you are a resident outside of the United States, you agree that all disputes between you and PILI shall be governed by the laws of Singapore, without regard to conflict of law provisions. You agree that any claim or dispute you may have against PILI must be resolved exclusively by a court located in Singapore.

9. Severability
You and PILI agree that if any portion of these Terms of Service or of the PILI Privacy Policy is found illegal or unenforceable, in whole or in part by any court of competent jurisdiction, such provision shall, as to such jurisdiction, be ineffective solely to the extent of such determination of invalidity or unenforceability without affecting the validity or enforceability thereof in any other manner or jurisdiction and without affecting the remaining provisions of the terms, which shall continue to be in full force and effect.

10. General Provisions
10.1. Assignment
PILI may assign or delegate these Terms of Service and/or the PILI Privacy Policy, in whole or in part, to any person or entity at any time with or without your consent. You may not assign or delegate any rights or obligations under the Terms of Service or Privacy Policy without PILI's prior written consent, and any unauthorized assignment and delegation by you is ineffective.

10.2. Supplemental Policies
PILI may publish additional policies related to specific services such as forums, contests or loyalty programs. Your right to use such services is subject to those specific policies and these Terms of Service.

10.3. Entire Agreement
These Terms of Service, any supplemental policies and any documents expressly incorporated by reference herein (including the PILI Privacy Policy), contain the entire understanding of you and PILI, and supersede all prior understandings of the parties hereto relating to the subject matter hereof, whether electronic, oral or written, or whether established by custom, practice, policy or precedent, between you and us with respect to the Service.

10.4. No Waiver
The failure of PILI to require or enforce strict performance by you of any provision of these Terms of Service or the PILI Privacy Policy or failure to exercise any right under them shall not be construed as a waiver or relinquishment of PILI's right to assert or rely upon any such provision or right in that or any other instance.

The express waiver by PILI of any provision, condition, or requirement of these Terms of Service or the PILI Privacy Policy shall not constitute a waiver of any future obligation to comply with such provision, condition or requirement.

Except as expressly and specifically set forth in this these Terms of Service, no representations, statements, consents, waivers, or other acts or omissions by PILI shall be deemed a modification of these Terms of Service nor legally binding, unless documented in physical writing, hand signed by yourself and a duly appointed officer of PILI.

10.5. Notices
We may notify you via postings on https://www.pilistarship.com, and via e-mail or any other communications means to contact information you provide to us. All notices given by you or required from you under these Terms of Service or the PILI Privacy Policy shall be in writing and addressed to: 152 BEACH ROAD #11-05, GATEWAY EAST SINGAPORE (189721). Any notices that you provide without compliance with this Section on Notices shall have no legal effect.

10.6. Equitable Remedies
You acknowledge that the rights granted and obligations made under these Terms of Service to PILI are of a unique and irreplaceable nature, the loss of which shall irreparably harm PILI and which cannot be replaced by monetary damages alone so that PILI shall be entitled to injunctive or other equitable relief (without the obligations of posting any bond or surety or proof of damages) in the event of any breach or anticipatory breach by you.

You irrevocably waive all rights to seek injunctive or other equitable relief, or to enjoin or restrain the operation of the Service or any PILI game, exploitation of any advertising or other materials issued in connection therewith, or exploitation of the Service or any content or other material used or displayed through the Service and agree to limit your claims to claims for monetary damages, limited by Section 7 (if any).

10.7. Force Majeure
PILI shall not be liable for any delay or failure to perform resulting from causes outside the reasonable control of PILI, including without limitation any failure to perform hereunder due to unforeseen circumstances or cause beyond PILI's control such as acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor or materials.
