TERMOS DE SERVIÇO

Os termos deste acordo (“Termos de Serviço”) regem o relacionamento entre você e a PILI STARSHIP PTE. LTD., uma empresa de Singapura (ID comercial 202346742E), com sede em 152 BEACH ROAD #11-05, GATEWAY EAST, SINGAPURA (189721), (“PILI” ou “nós”), em relação ao uso dos jogos, sites e serviços relacionados da PILI (“Serviços”). O uso dos Serviços também é regido pela Política de Privacidade da PILI e outras políticas relevantes, que estão incorporadas neste documento como referência.
Antes de acessar ou usar os Serviços, incluindo navegar em sites ou acessar jogos da PILI, você deve concordar com esses Termos de Serviço e com a Política de Privacidade. Você também pode precisar fazer registro em uma conta dos Serviços (“Conta”). Ao fazer registro em uma Conta ou usar os Serviços de outra forma, você concorda que tem 13 anos ou mais. Se a sua idade for entre 13 e 17 anos, você concorda que seu guardião legal revisou e concordou com os Termos. Se você acessar os Serviços de um Site de Rede Social (“SSR”), como Facebook ou Google+, deverá estar em conformidade com os termos de serviço/uso deles, além destes Termos de Serviço.
AO INSTALAR, USAR OU ACESAR DE OUTRA FORMA OS SERVIÇOS, VOCÊ CONCORDA COM ESTES TERMOS DE SERVIÇO. SE VOCÊ NÃO CONCORDAR COM ESTES TERMOS DE SERVIÇO, NÃO INSTALE, USE OU ACESSE DE OUTRA FORMA OS SERVIÇOS. O USO DOS SERVIÇOS É NULO ONDE ELES FOREM PROIBIDOS.
A PILI se reserva o direito, a seu critério, de alterar, modificar, adicionar ou remover partes destes Termos de Serviço, da Política de Privacidade e outras políticas relevantes da PILI a qualquer momento, publicando os termos alterados nos Serviços da PILI. Você terá aceitado tais alterações, se continuar a usar os Serviços. Se, em qualquer momento, você não concordar com alguma parte da versão atual de nossos Termos de Serviço, a Política de Privacidade da PILI, ou quaisquer outras políticas, regras ou códigos de conduta da PILI relacionados ao uso dos Serviços, a sua licença de uso dos Serviços será terminada e você deverá deixar de usar os Serviços imediatamente.
1. Licença
1.1. Concessão de uma Licença Limitada para usar os Serviços
Sujeita à sua concordância e conformidade constante com estes Termos de Serviço e quaisquer políticas relevantes da PILI, a PILI concede a você uma licença não exclusiva, intransferível, não sublicenciável, revogável e limitada para acessar e usar os Serviços para seus próprios fins de entretenimento e não comerciais. Você concorda em não usar os Serviços por outros motivos que não sejam aqueles previstos nestes Termos.
As restrições a seguir são válidas para o uso dos Serviços:
•	Você não criará uma Conta ou acessará os Serviços se for menor de 13 anos de idade; Você restringirá o uso dos Serviços por menores, negando o acesso de crianças menores de 13 anos. Nós nos reservamos o direito de requisitar comprovante de idade a qualquer momento para verificar se pessoas menores de idade estão usando ou acessando os Serviços. Você será responsável pelo uso não autorizado dos Serviços por menores. Você será responsável por usos de seu cartão de crédito ou outras formas de pagamento, como o PayPal, por menores.
•	Você não deverá (ou tentará) comprar, vender, revender, alugar ou dar a sua Conta, criar uma Conta usando identidade ou informações falsas, ou em nome de outra pessoa que não seja você mesmo; Você não usará os Serviços de tiver sido removido anteriormente pela PILI ou banido anteriormente de jogar os jogos da PILI.
•	Você usará a sua Conta apenas por motivos não comerciais; Você não usará os Serviços para fazer propaganda, solicitar ou transmitir propagandas comerciais, incluindo correntes, lixo eletrônico ou email de spam ou mensagens repetitivas ou enganosas para qualquer pessoa.
Nós nos reservamos todos os direitos e recursos legais disponíveis para prevenir o uso não autorizado dos Serviços, incluindo, entre outros, barreiras tecnológicas, mapeamento de IP e, em casos mais graves, entrar em contato diretamente com o seu Provedor de Serviços de Internet (PSI) em relação a esse uso não autorizado.
Informações de Login e sua Conta
Pode ser necessário selecionar uma senha para a sua Conta ou usar outras credenciais para acessar a Conta (“Informações de Login”). Você não compartilhará a Conta ou as Informações de Login, ou deixará qualquer pessoa acessar a Conta ou fazer algo com ela que possa colocar em risco a segurança da Conta. Caso descubra ou suspeite de alguma violação de segurança, incluindo, entre outros, perdas, roubos ou divulgações não autorizadas das Informações de Login, você deverá notificar imediatamente a PILI e modificar as suas Informações de Login. Você é o único responsável por manter a confidencialidade de suas Informações de Login, e será responsável por todos os usos das Informações de Login, incluindo compras autorizadas ou não por você. Você é responsável por tudo o que acontece em sua Conta, mesmo que não saiba.
A PILI se reserva o direito de remover ou reivindicar nomes de usuários a qualquer momento e por qualquer motivo, incluindo, ente outros, reivindicações de terceiros de um nome de usuário que viola os direitos de terceiros.
Os Serviços suportam apenas uma Conta por jogo em um dispositivo compatível.
Limitações da Licença
Usos dos Serviços que violam as Limitações da Licença são estritamente proibidos, podendo resultar na imediata revogação de sua licença limitada, além de sujeitá-lo à responsabilidade por violações da lei.
Você concorda que não irá, em nenhuma circunstância:
•	Envolver-se em qualquer ato que a PILI considere estar em conflito com o espírito ou a intenção dos Serviços ou fazer uso indevido dos serviços de suporte da PILI.
•	Desenvolver, distribuir, usar ou participar, direta ou indiretamente, do uso de trapaças, explorações, software de automação, bots, hacks, mods ou qualquer software de terceiros não autorizado projetado para modificar ou interferir nos Serviços, em qualquer jogo da PILI ou em qualquer experiência de jogo da PILI.
•	Modificar ou fazer com que sejam modificados quaisquer arquivos que façam parte dos Serviços ou de qualquer jogo da PILI, sem o consentimento expresso e por escrito da PILI. Interromper, interferir ou afetar adversamente de outra forma o fluxo normal dos Serviços ou agir de maneira que possa afetar negativamente a experiência de outros usuários ao utilizar os Serviços ou jogar os jogos da PILI. Isso inclui negociação de vitórias e qualquer outro tipo de manipulação de classificações, aproveitamento de erros nos Serviços para obter uma vantagem injusta sobre outros jogadores e qualquer outro ato que intencionalmente abuse ou vá contra o design dos Serviços.
•	Interromper, sobrecarregar, ajudar ou auxiliar na interrupção ou sobrecarga de qualquer computador ou servidor (“Servidor”) usado para oferecer ou suportar os Serviços ou qualquer ambiente de jogo da PILI.
•	Instituir, auxiliar ou envolver-se em qualquer tipo de ataque, incluindo, entre outros, a distribuição de vírus, ataques de negação de serviço aos Serviços ou outras tentativas de interromper os Serviços ou o uso ou aproveitamento dos Serviços por qualquer outra pessoa.
•	Tentar obter acesso não autorizado aos Serviços, às Contas registradas em nome de terceiros ou a computadores, aos Servidores ou redes conectadas aos Serviços por qualquer meio que não seja a interface de usuário fornecida pela PILI, incluindo, entre outros, contornando ou modificando, tentando contornar ou modificar, ou incentivando ou auxiliando qualquer outra pessoa a contornar ou modificar qualquer segurança, tecnologia, dispositivo ou software que faça parte dos Serviços.
•	Publicar, fazer upload, transmitir ou disseminar de outra forma qualquer informação abusiva, violenta, ameaçadora, obscena, difamatória, caluniosa, racial, sexual, religiosa ou de outra forma censurável, ofensiva ou envolver-se em comportamento tóxico contínuo, como a publicação repetida de informações não solicitadas.
•	Tentar assediar, abusar ou prejudicar, ou defender ou incitar o assédio, abuso ou prejuízo de outra pessoa ou grupo, incluindo funcionários da PILI (como os representantes de atendimento ao cliente da PILI).
•	Disponibilizar por meio dos Serviços qualquer material ou informação que infrinja qualquer direito autoral, marca registrada, patente, segredo comercial, direito de privacidade, direito de publicidade ou outro direito de qualquer pessoa ou entidade ou que se faça passar por outra pessoa, incluindo, entre outros, um funcionário da PILI.
•	Fazer engenharia reversa, descompilar, desmontar, decifrar ou tentar derivar o código-fonte de qualquer software subjacente ou outra propriedade intelectual usada para fornecer os Serviços ou qualquer jogo da PILI, ou obter qualquer informação dos Serviços ou de qualquer jogo da PILI usando qualquer método não expressamente permitido pela PILI.
•	Solicitar ou tentar solicitar Informações de Login ou quaisquer outras credenciais de login ou informações pessoais de outros usuários dos Serviços ou de qualquer jogo da PILI.
•	Coletar ou publicar informações privadas de qualquer pessoa, inclusive informações de identificação pessoal (seja em forma de texto, imagem ou vídeo), documentos de identificação ou informações financeiras por meio dos Serviços.
A PILI se reserva o direito de determinar qual conduta considera estar violando as regras de uso ou de outra forma fora da intenção ou do espírito destes Termos de Serviço ou dos próprios Serviços. A PILI se reserva o direito de tomar medidas como resultado, que podem incluir o encerramento de sua Conta e a proibição de usar os Serviços no todo ou em parte.
1.2. Suspensão ou encerramento da Conta e dos Serviços
SEM LIMITAR QUAISQUER OUTROS RECURSOS, A PILI PODERÁ LIMITAR, SUSPENDER, ENCERRAR, MODIFICAR OU EXCLUIR CONTAS OU O ACESSO AOS SERVIÇOS, OU A PARTES DELES, SE O USUÁRIO, OU SE A PILI SUSPEITAR QUE O USUÁRIO, NÃO ESTIVER CUMPRINDO QUALQUER UM DESTES TERMOS DE SERVIÇO OU POR QUALQUER USO ILEGAL OU IMPRÓPRIO, REAL OU SUSPEITO DOS SERVIÇOS, COM OU SEM AVISO PRÉVIO AO USUÁRIO. VOCÊ PODE PERDER SEU NOME DE USUÁRIO E SUA PERSONALIDADE NOS SERVIÇOS COMO RESULTADO DO ENCERRAMENTO OU LIMITAÇÃO DA CONTA, BEM COMO QUAISQUER BENEFÍCIOS, PRIVILÉGIOS, ITENS GANHOS E ITENS COMPRADOS ASSOCIADOS AO SEU USO DOS SERVIÇOS, E A PILI NÃO TEM OBRIGAÇÃO DE COMPENSÁ-LO POR TAIS PERDAS OU RESULTADOS.
ALÉM DISSO, PODEMOS, EM CIRCUNSTÂNCIAS APROPRIADAS E A NOSSO CRITÉRIO EXCLUSIVO, SUSPENDER OU ENCERRAR CONTAS DE USUÁRIOS QUE POSSAM SER INFRATORES REINCIDENTES DE NOSSOS TERMOS, POLÍTICAS OU REQUISITOS LEGAIS, OU INFRATORES REINCIDENTES DE DIREITOS DE PROPRIEDADE INTELECTUAL DE TERCEIROS.
A PILI SE RESERVA O DIREITO DE ENCERRAR QUALQUER CONTA QUE TENHA FICADO INATIVA POR 180 DIAS.
A PILI se reserva o direito de parar de oferecer e/ou apoiar os Serviços ou um determinado jogo ou parte dos Serviços a qualquer momento, o que fará com que a sua licença de uso dos Serviços ou de parte deles seja automaticamente rescindida. Nesse caso, a PILI não será obrigada a fornecer reembolsos, benefícios ou outras compensações aos usuários em relação a tais Serviços descontinuados. O encerramento da sua Conta pode incluir a desativação do seu acesso aos Serviços ou a qualquer parte deles, incluindo qualquer conteúdo enviado por você ou por outras pessoas.
2. Propriedade
2.1. Jogos e Serviços
Todos os direitos, títulos e interesses em relação aos Serviços (incluindo, entre outros, quaisquer jogos, títulos, códigos de computador, temas, objetos, personagens, nomes de personagens, histórias, diálogos, frases de efeito, conceitos, obras de arte, animações, sons, composições musicais, efeitos audiovisuais, métodos de operação, direitos morais, documentação, transcrições de bate-papo no jogo, informações de perfil de personagem, gravações de jogos jogados usando um cliente de jogo da PILI e os clientes de jogo e software de servidor da PILI) são de propriedade da PILI. A PILI se reserva todos os direitos, incluindo, entre outros, todos os direitos de propriedade intelectual ou outros direitos de propriedade, relacionados aos seus jogos e aos Serviços.
2.2. Contas
NÃO OBSTANTE QUALQUER DISPOSIÇÃO EM CONTRÁRIO NESTE DOCUMENTO, VOCÊ RECONHECE E CONCORDA QUE NÃO TERÁ NENHUMA PROPRIEDADE OU OUTRO INTERESSE DE PROPRIEDADE NA CONTA, E TAMBÉM RECONHECE E CONCORDA QUE TODOS OS DIREITOS EM RELAÇÃO À CONTA SÃO E SERÃO PARA SEMPRE DE PROPRIEDADE DA PILI E REVERTERÃO EM SEU BENEFÍCIO.
2.3. Itens virtuais
A PILI é proprietária, licenciou ou, de outra forma, tem direitos de uso de todo o conteúdo que aparece nos Serviços ou nos jogos da PILI. Não obstante qualquer disposição em contrário neste documento, você concorda que não tem nenhum direito ou título sobre qualquer conteúdo que apareça nos Serviços, incluindo, entre outros, os bens virtuais ou a moeda que apareça ou se origine em qualquer jogo da PILI, seja ganho em um jogo ou comprado da PILI, ou quaisquer outros atributos associados a uma Conta ou armazenados nos Serviços.
3. Conteúdo do usuário
3.1. Submissão de Conteúdo do Usuário
“Conteúdo do Usuário” significa quaisquer comunicações, imagens, sons e todo o material, dados e informações que você carregue, ou transmita por meio de um cliente, de jogo da PILI ou dos Serviços, ou que outros usuários carreguem ou transmitam, incluindo, entre outros, qualquer texto de bate-papo. Ao transmitir ou enviar qualquer Conteúdo do Usuário durante o uso dos Serviços, você afirma, concorda e garante que tal transmissão ou envio é (a) preciso e não confidencial ou enganoso; (b) não viola nenhuma lei, restrição contratual ou outros direitos de terceiros, e que você tem permissão de qualquer terceiro cujas informações pessoais ou propriedade intelectual estejam incluídas no Conteúdo do Usuário; (c) livre de vírus, adware, spyware, worms ou outros códigos maliciosos; e (d) você reconhece e concorda que quaisquer de suas informações pessoais contidas em tal conteúdo serão sempre processadas pela PILI de acordo com a Política de Privacidade.
3.1.1. Triagem de conteúdo
A PILI não assume nenhuma responsabilidade pela conduta de qualquer usuário que envie qualquer Conteúdo do Usuário e não assume nenhuma responsabilidade por monitorar os Serviços quanto a conteúdo ou conduta inadequados. Não fazemos, e não podemos fazer, uma triagem prévia ou monitorar todo o Conteúdo do Usuário. Use os Serviços por sua própria conta e risco. Ao usar os Serviços, você poderá ser exposto a Conteúdos do Usuário que sejam ofensivos, indecentes ou que não estejam de acordo com suas expectativas. Você assume todos os riscos associados ao uso de qualquer Conteúdo do Usuário disponível em conexão com os Serviços. A nosso critério, nossos representantes ou
tecnologia poderão monitorar e/ou gravar sua interação com os Serviços ou comunicações (incluindo, entre outros, texto de bate-papo) quando você estiver usando os Serviços.
Ao aceitar estes Termos de Serviço, você dá seu consentimento irrevogável para esse monitoramento e gravação. Você reconhece e concorda que não tem nenhuma expectativa de privacidade em relação à transmissão de qualquer Conteúdo do Usuário, incluindo, entre outros, textos de bate-papo ou comunicações de voz.
A PILI reserva-se o direito, a seu exclusivo critério, de revisar, monitorar, proibir, editar, excluir, desativar o acesso ou, de outra forma, tornar indisponível qualquer Conteúdo do Usuário (incluindo, entre outros, o seu Conteúdo do Usuário) sem aviso prévio, por qualquer motivo ou sem motivo, a qualquer momento. Se, a qualquer momento, a PILI optar, a seu exclusivo critério, por monitorar os Serviços, a PILI não assume nenhuma responsabilidade pelo Conteúdo do Usuário e não assume nenhuma obrigação de modificar ou remover qualquer Conteúdo do Usuário inadequado. Temos o direito, mas não a obrigação, a nosso critério exclusivo, de editar, recusar a publicação ou remover qualquer Conteúdo do Usuário.
3.2. Uso de informações por outros membros dos Serviços
3.2.1. Discurso público
Os Serviços podem incluir vários fóruns, blogs e recursos de bate-papo nos quais você pode publicar Conteúdo do Usuário, incluindo suas observações e comentários sobre tópicos designados. A PILI não pode garantir que outros membros não usarão as ideias e informações que você compartilhar. Portanto, se você tiver uma ideia ou informação que gostaria de manter em sigilo e/ou não quer que outras pessoas a utilizem, não a publique nos Serviços. A PILI não terá nenhuma responsabilidade de avaliar, usar ou compensar você por quaisquer ideias ou informações que você decida enviar.
3.2.2. Responsabilidade pelo seu próprio conteúdo
Você é o único responsável pelas informações que publicar nos Serviços, por meio deles ou em conexão com eles, e que fornecer a terceiros. A PILI pode rejeitar, recusar-se a publicar ou excluir qualquer Conteúdo do Usuário por qualquer ou nenhum motivo, incluindo, entre outros, Conteúdo do Usuário que, a critério exclusivo da PILI, viole estes Termos de Serviço.
3.2.3. A sua licença para a PILI
Por meio deste instrumento, você concede à PILI uma licença mundial irrevogável, perpétua, transferível, totalmente paga, livre de royalties (incluindo o direito de sublicenciar e ceder a terceiros) e o direito de copiar, reproduzir, corrigir, adaptar, modificar, criar trabalhos derivados, fabricar, comercializar, publicar, distribuir, vender, licenciar, sublicenciar, transferir, arrendar, transmitir, exibir publicamente executar publicamente ou fornecer acesso a eletronicamente, transmitir, comunicar ao público por telecomunicação, exibir, executar, inserir na memória do computador e usar e praticar, de qualquer forma, o seu Conteúdo do Usuário, bem como todos os trabalhos modificados e derivados dele em conexão com a nossa prestação dos Serviços, incluindo marketing e promoções dos Serviços. Por meio deste instrumento, você também concede à PILI o direito de autorizar outras pessoas a exercerem qualquer um dos direitos concedidos à PILI sob estes Termos de Serviço. Além disso, você concede à PILI o direito incondicional e irrevogável de usar e explorar seu nome, imagem e qualquer outra informação ou material incluído em qualquer Conteúdo do Usuário e em conexão com qualquer Conteúdo do Usuário, sem qualquer obrigação para com você. Exceto quando proibido por lei, você renuncia a quaisquer direitos de atribuição e/ou quaisquer direitos morais que possa ter em seu Conteúdo do Usuário, independentemente de seu Conteúdo do Usuário ser alterado ou modificado de qualquer maneira. A PILI não reivindica quaisquer direitos de propriedade sobre o seu Conteúdo do Usuário e nenhum aspecto destes Termos de Serviço tem a intenção de restringir quaisquer direitos que você possa ter de usar e explorar o seu Conteúdo do Usuário. A PILI não tem nenhuma obrigação de monitorar ou fazer valer seus direitos de propriedade intelectual sobre o seu Conteúdo do Usuário.
3.3. Interações entre usuários
Você é o único responsável por suas interações com outros usuários dos Serviços e com quaisquer outras partes com as quais interaja por meio dos Serviços e/ou dos jogos da PILI. A PILI se reserva o direito, mas não tem a obrigação, de se envolver de alguma forma com essas disputas. Você cooperará totalmente com a PILI para investigar qualquer suspeita de atividade ilegal, fraudulenta ou imprópria, incluindo, entre outros, a concessão de acesso à PILI a qualquer parte de sua Conta protegida por senha.
Se você tiver uma disputa com um ou mais usuários, você nos isenta (e a nossos executivos, diretores, agentes, subsidiárias, joint ventures e funcionários) de reivindicações, demandas e danos (reais e consequentes) de todo tipo e natureza, conhecidos e desconhecidos, decorrentes de ou de alguma forma relacionados a tais disputas.
4. Taxas e termos de compra
4.1.Compras
Nos Serviços, você pode adquirir, com dinheiro do “mundo real”, uma licença limitada, pessoal, intransferível, não sublicenciável e revogável para usar (a) “moeda virtual”, incluindo, entre outros, dinheiro virtual ou diamantes para uso nos jogos da PILI; (b) “itens virtuais no jogo” (juntamente com a “moeda virtual”, “Itens Virtuais”); e (c) outros bens ou serviços (“Mercadoria”). Você só tem permissão para comprar Itens Virtuais de nós ou de nossos parceiros autorizados por meio dos Serviços, e não de qualquer outra forma.
A PILI poderá gerenciar, regular, controlar, modificar ou eliminar Itens Virtuais e/ou Mercadorias a qualquer momento, com ou sem aviso prévio. A PILI não terá nenhuma responsabilidade perante você ou qualquer terceiro caso a PILI exerça tais direitos.
A transferência de Itens Virtuais e Mercadorias é proibida, exceto quando expressamente autorizada nos Serviços. Além do que foi expressamente autorizado nos Serviços, você não deverá vender, comprar, resgatar ou de outra forma transferir Itens Virtuais ou Mercadorias para qualquer pessoa ou entidade ou tentar fazer qualquer uma das coisas acima mencionadas, incluindo, entre outros, a PILI, outro usuário ou qualquer terceiro.
TODAS AS COMPRAS E RESGATES DE ITENS VIRTUAIS FEITOS POR MEIO DOS SERVIÇOS SÃO FINAIS E NÃO REEMBOLSÁVEIS.
O fornecimento de Itens Virtuais para uso nos jogos da PILI é um serviço prestado pela PILI que começa imediatamente após a aceitação de sua compra pela PILI.
4.2. Pagamento de taxas
Você concorda em pagar todas as taxas e impostos aplicáveis incorridos por você ou por qualquer pessoa que utilize uma Conta registrada em seu nome. A PILI poderá revisar os preços dos bens e serviços oferecidos por meio dos Serviços a qualquer momento. VOCÊ RECONHECE QUE A PILI NÃO É OBRIGADA A FORNECER UM REEMBOLSO POR QUALQUER MOTIVO E QUE VOCÊ NÃO RECEBERÁ DINHEIRO OU OUTRA COMPENSAÇÃO POR ITENS VIRTUAIS NÃO UTILIZADOS QUANDO UMA CONTA FOR ENCERRADA, SEJA ESSE ENCERRAMENTO VOLUNTÁRIO OU INVOLUNTÁRIO.
5. Atualizações dos Serviços
Você entende que os Serviços estão em constante evolução. A PILI poderá exigir que você aceite atualizações dos Serviços e dos jogos da PILI que você instalou em seu dispositivo ou computador. Você reconhece e concorda que a PILI poderá atualizar os Serviços e os jogos da PILI, com ou sem notificação. Talvez seja necessário atualizar o software de terceiros de tempos em tempos para receber os Serviços e jogar os jogos da PILI.
6. Isenção de garantias
SEM LIMITAR A RESPONSABILIDADE DA PILI NOS TERMOS DA SEÇÃO 7 ABAIXO, OS SERVIÇOS SÃO FORNECIDOS “NO ESTADO EM QUE SE ENCONTRAM” E “CONFORME DISPONÍVEIS” PARA SEU USO, SEM GARANTIAS DE QUALQUER TIPO, EXPRESSAS OU IMPLÍCITAS, INCLUINDO, ENTRE OUTROS, AS GARANTIAS DE COMERCIALIZAÇÃO, ADEQUAÇÃO A UMA FINALIDADE ESPECÍFICA, TÍTULO, NÃO VIOLAÇÃO E AQUELAS DECORRENTES DO CURSO DE NEGOCIAÇÃO OU USO DO COMÉRCIO. Você concorda em indenizar, defender e manter a PILI (e nossos executivos, diretores, agentes, subsidiárias, afiliadas, agentes, licenciadores, joint ventures e funcionários) isenta de qualquer reivindicação, demanda, danos ou outras perdas, incluindo honorários advocatícios razoáveis, reivindicados por qualquer terceiro resultante ou decorrente do seu uso do Serviço, ou qualquer violação por você destes Termos de Serviço, no entanto, o precedente não é válido se a violação de direitos não for atribuível ao seu comportamento intencional ou negligente.
8. Resolução de disputas e Direito

Se você for residente dos Estados Unidos, estes Termos de Serviço e qualquer disputa decorrente ou relacionada a eles, à Política de Privacidade ou aos Serviços serão regidos, em todos os aspectos, pela legislação da Califórnia, sem levar em conta as disposições sobre conflitos de leis. 9. Gravidade
Você e a PILI concordam que, se qualquer parte destes Termos de Serviço ou da Política de Privacidade da PILI for considerada ilegal ou inexequível, no todo ou em parte, por qualquer tribunal de jurisdição competente, tal disposição deverá, no que diz respeito a tal jurisdição, ser ineficaz apenas na medida de tal determinação de invalidade ou inexequibilidade, sem afetar a validade ou exequibilidade da mesma de qualquer outra maneira ou jurisdição e sem afetar as disposições restantes dos termos, que continuarão em pleno vigor e efeito.
10. Disposições gerais
10.1. Atribuição
A PILI poderá ceder ou delegar estes Termos de Serviço e/ou a Política de Privacidade da PILI, no todo ou em parte, a qualquer pessoa ou entidade, a qualquer momento, com ou sem o seu consentimento. Você não pode ceder ou delegar quaisquer direitos ou obrigações sob os Termos de Serviço ou a Política de Privacidade sem o consentimento prévio por escrito da PILI, e qualquer cessão ou delegação não autorizada por você é ineficaz.
10.2. Políticas complementares
A PILI poderá publicar políticas adicionais relacionadas a serviços específicos, como fóruns, concursos ou programas de fidelidade. Seu direito de usar esses serviços está sujeito a essas políticas específicas e a estes Termos de Serviço.
10.3. Contrato integral

The terms of this agreement ("Terms of Service") govern the relationship between you and PILI STARSHIP PTE. LTD., a Singaporean company (business ID 202346742E) having its registered office at 152 BEACH ROAD #11-05, GATEWAY EAST SINGAPORE (189721), (hereinafter "PILI" or "us" or "we") regarding your use of PILI's games, websites and related services (the "Service"). Use of the Service is also governed by PILI's Privacy Policy and other relevant policies, which are incorporated herein by reference.

Before accessing or using the Service, including browsing any PILI website or accessing a game, you must agree to these Terms of Service and the Privacy Policy. You may also be required to register an account on the Service (an "Account"). By registering for an Account or otherwise using the Service, you represent that you are age 13 or older. If you are between the ages of 13 and 17, you represent that your legal guardian has reviewed and agreed to these Terms. If you access the Service from a Social Networking Site ("SNS"), such as Facebook or Google+, you shall comply with its terms of service/use as well as these Terms of Service.

BY INSTALLING, USING OR OTHERWISE ACCESSING THE SERVICE, YOU AGREE TO THESE TERMS OF SERVICE. IF YOU DO NOT AGREE TO THESE TERMS OF SERVICE, PLEASE DO NOT INSTALL, USE OR OTHERWISE ACCESS THE SERVICE. USE OF THE SERVICE IS VOID WHERE PROHIBITED.

PILI reserves the right, at its discretion, to change, modify, add or remove portions of these Terms of Service, its Privacy Policy and other relevant PILI policies at any time by posting the amended terms on the PILI Service. You will be deemed to have accepted such changes by continuing to use the Service. If at any point you do not agree to any portion of the then-current version of our Terms of Service, the PILI Privacy Policy, or any other PILI policy, rules or codes of conduct relating to your use of the Service, your license to use the Service shall immediately terminate, and you must immediately stop using the Service.

1. License
1.1. Grant of a Limited License to Use the Service
Subject to your agreement and continuing compliance with these Terms of Service and any other relevant PILI policies, PILI grants you a non-exclusive, non-transferable, non-sublicensable, revocable and limited license to access and use the Service for your own non-commercial entertainment purposes. You agree not to use the Service for any other purpose other than as provided for by these Terms.

The following restrictions apply to the use of the Service:

You shall not create an Account or access the Service if you are under the age of 13; You shall restrict use by minors, and you will deny access to children under the age of 13. We reserve the right to request proof of age at any stage to verify that persons not of legal age are not using or accessing the Service. You accept full responsibility for any unauthorized use of the Service by minors. You are responsible for any use of your credit card or other payment instrument (e.g. paypal) by minors.
You shall not (or attempt to) purchase, sell, resell, rent or give away your Account, create an Account using a false identity or information, or on behalf of someone other than yourself; You shall not use the Service if you have previously been removed by PILI, or previously been banned from playing any PILI game.
 You shall use your Account only for non-commercial purposes; You shall not use the Service to advertise, or solicit, or transmit any commercial advertisements, including chain letters, junk or spam e-mail or repetitive or misleading messages to anyone.
We reserve all available legal rights and remedies to prevent unauthorized use of the Service, including, but not limited to, technological barriers, IP mapping, and, in serious cases, directly contacting your Internet Service Provider (ISP) regarding such unauthorized use.

Login information and Your Account
You may be required to select a password for your Account or you may also use other credentials to access the Account ("Login Information"). You shall not share the Account or the Login Information, nor let anyone else access your Account or do anything else that might jeopardize the security of your Account. In the event you become aware of or reasonably suspect any breach of security, including without limitation any loss, theft, or unauthorized disclosure of the Login Information, you must immediately notify PILI and modify your Login Information. You are solely responsible for maintaining the confidentiality of the Login Information, and you will be responsible for all uses of the Login Information, including purchases, whether or not authorized by you. You are responsible for anything that happens through your Account, whether or not you know about it.

PILI reserves the right to remove or reclaim any usernames at any time and for any reason, including but not limited to claims by a third party that a username violates the third party's rights.

The Service supports only one Account per game on a supported device.

License Limitations
Any use of the Service in violation of these License Limitations is strictly prohibited, can result in the immediate revocation of your limited license and may subject you to liability for violations of law.

You agree that you will not, under any circumstances:

Engage in any act that PILI deems to be in conflict with the spirit or intent of the Service or make improper use of PILI's support services.
Develop, distribute, use or take part (directly or indirectly) in the use of cheats, exploits, automation software, bots, hacks, mods or any unauthorized third-party software designed to modify or interfere with the Service, any PILI game or any PILI game experience.
Modify or cause to be modified any files that are a part of the Service or any PILI game without PILI's express written consent. Disrupt, interfere with or otherwise adversely affect the normal flow of the Service or otherwise act in a manner that may negatively affect other users' experience when using the Service or playing PILI's games. This includes win trading and any other kind of manipulation of rankings, taking advantage of errors in the Service to gain an unfair edge over other players and any other act that intentionally abuses or goes against the design of the Service.
Disrupt, overburden, or aid or assist in the disruption or overburdening of any computer or server ("Server") used to offer or support the Service or any PILI game environment.
Institute, assist, or become involved in any type of attack, including without limitation distribution of a virus, denial of service attacks upon the Service, or other attempts to disrupt the Service or any other person's use or enjoyment of the Service.
Attempt to gain unauthorized access to the Service, Accounts registered to others or to the computers, Servers, or networks connected to the Service by any means other than the user interface provided by PILI, including but not limited to, by circumventing or modifying, attempting to circumvent or modify, or encouraging or assisting any other person to circumvent or modify, any security, technology, device, or software that is part of the Service.
Post, upload, transmit or otherwise disseminate any information that is abusive, violent, threatening, obscene, defamatory, libelous, racial, sexual, religious, or otherwise objectionable, offensive or engage in ongoing toxic behavior, such as by repeatedly posting information on an unsolicited basis.
Attempt to, or harass, abuse, or harm, or advocate or incite harassment, abuse, or harm of another person, group, including PILI employees (such as PILI's customer service representatives).
Make available through the Service any material or information that infringes any copyright, trademark, patent, trade secret, right of privacy, right of publicity, or other right of any person or entity or impersonates any other person, including without limitation a PILI employee.
 Reverse engineer, decompile, disassemble, decipher or otherwise attempt to derive the source code for any underlying software or other intellectual property used to provide the Service or any PILI game, or to obtain any information from the Service or any PILI game using any method not expressly permitted by PILI.
Solicit or attempt to solicit Login Information or any other login credentials or personal information from other users of the Service or any PILI game.
Collect or post anyone's private information, including personally identifiable information (whether in text, image or video form), identification documents, or financial information through the Service.
PILI reserves the right to determine what conduct it considers to be in violation of the rules of use or otherwise outside the intent or spirit of these Terms of Service or the Service itself. PILI reserves the right to take action as a result, which may include terminating your Account and prohibiting you from using the Service in whole or in part.

1.2. Suspension and Termination of Account and Service
WITHOUT LIMITING ANY OTHER REMEDIES, PILI MAY LIMIT, SUSPEND, TERMINATE, MODIFY, OR DELETE ACCOUNTS OR ACCESS TO THE SERVICE OR PORTIONS THEREOF IF YOU ARE, OR PILI SUSPECTS THAT YOU ARE, FAILING TO COMPLY WITH ANY OF THESE TERMS OF SERVICE OR FOR ANY ACTUAL OR SUSPECTED ILLEGAL OR IMPROPER USE OF THE SERVICE, WITH OR WITHOUT NOTICE TO YOU. YOU CAN LOSE YOUR USER NAME AND PERSONA IN THE SERVICE AS A RESULT OF ACCOUNT TERMINATION OR LIMITATION, AS WELL AS ANY BENEFITS, PRIVILEGES, EARNED ITEMS AND PURCHASED ITEMS ASSOCIATED WITH YOUR USE OF THE SERVICE, AND PILI IS UNDER NO OBLIGATION TO COMPENSATE YOU FOR ANY SUCH LOSSES OR RESULTS.

ADDITIONALLY, WE MAY, IN APPROPRIATE CIRCUMSTANCES AND AT OUR SOLE DISCRETION, SUSPEND OR TERMINATE ACCOUNTS OF USERS WHO MAY BE REPEAT VIOLATORS OF OUR TERMS, POLICIES OR LEGAL REQUIRMENTS, OR REPEAT INFRINGERS OF THIRD PARTY INTELLECTUAL PROPERTY RIGHTS.

PILI RESERVES THE RIGHT TO TERMINATE ANY ACCOUNT THAT HAS BEEN INACTIVE FOR 180 DAYS.

PILI reserves the right to stop offering and/or supporting the Service or a particular game or part of the Service at any time, at which point your license to use the Service or a part thereof will be automatically terminated. In such event, PILI shall not be required to provide refunds, benefits or other compensation to users in connection with such discontinued Service . Termination of your Account can include disabling your access to the Service or any part thereof including any content you submitted or others submitted.

2. Ownership
2.1. Games and Service
All rights, title and interest in and to the Service (including without limitation any games, titles, computer code, themes, objects, characters, character names, stories, dialogue, catch phrases, concepts, artwork, animations, sounds, musical compositions, audio-visual effects, methods of operation, moral rights, documentation, in-game chat transcripts, character profile information, recordings of games played using a PILI game client, and the PILI game clients and server software) are owned by PILI. PILI reserves all rights, including without limitation, all intellectual property rights or other proprietary rights, in connection with its games and the Service.

2.2. Accounts
NOTWITHSTANDING ANYTHING TO THE CONTRARY HEREIN, YOU ACKNOWLEDGE AND AGREE THAT YOU SHALL HAVE NO OWNERSHIP OR OTHER PROPERTY INTEREST IN THE ACCOUNT, AND YOU FURTHER ACKNOWLEDGE AND AGREE THAT ALL RIGHTS IN AND TO THE ACCOUNT ARE AND SHALL FOREVER BE OWNED BY AND INURE TO THE BENEFIT OF PILI.

2.3. Virtual Items
PILI owns, has licensed, or otherwise has rights to use all of the content that appears in the Service or in PILI games. Notwithstanding any provision to the contrary herein, you agree that you have no right or title in or to any content that appears in the Service, including without limitation the virtual goods or currency appearing or originating in any PILI game, whether earned in a game or purchased from PILI, or any other attributes associated with an Account or stored on the Service.

3. User Content
3.1. Submission of User Content
"User Content" means any communications, images, sounds, and all the material, data, and information that you upload or transmit through a PILI game client or the Service, or that other users upload or transmit, including without limitation any chat text. By transmitting or submitting any User Content while using the Service, you affirm, represent and warrant that such transmission or submission is (a) accurate and not confidential or misleading; (b) not in violation of any laws, contractual restrictions or other third party rights, and that you have permission from any third party whose personal information or intellectual property is comprised in the User Content; (c) free of viruses, adware, spyware, worms or other malicious code; and (d) you acknowledge and agree that any of your personal information within such content will at all times be processed by PILI in accordance with its Privacy Policy.

3.1.1. Content Screening
PILI assumes no responsibility for the conduct of any user submitting any User Content, and assumes no responsibility for monitoring the Service for inappropriate content or conduct. We do not, and cannot, pre-screen or monitor all User Content. Your use of the Service is at your own risk. By using the Service, you may be exposed to User Content that is offensive, indecent or otherwise not in line with your expectations. You bear all risks associated with the use of any User Content available in connection with the Service. At our discretion, our representatives or

technology may monitor and/or record your interaction with the Service or communications (including without limitation chat text) when you are using the Service.

By entering into these Terms of Service, you hereby provide your irrevocable consent to such monitoring and recording. You acknowledge and agree that you have no expectation of privacy concerning the transmission of any User Content, including without limitation chat text or voice communications.

PILI reserves the right in its sole discretion to review, monitor, prohibit, edit, delete, disable access to or otherwise make unavailable any User Content (including without limitation your User Content) without notice for any reason or for no reason at any time. If at any time PILI chooses, in its sole discretion, to monitor the Service, PILI nonetheless assumes no responsibility for User Content and assumes no obligation to modify or remove any inappropriate User Content. We have the right, but not the obligation, in our sole discretion to edit, refuse to post, or remove any User Content.

3.2. Information Use by Other Members of the Service
3.2.1. Public Discourse
The Service may include various forums, blogs and chat features where you can post User Content, including your observations and comments on designated topics. PILI cannot guarantee that other members will not use the ideas and information that you share. Therefore, if you have an idea or information that you would like to keep confidential and/or don't want others to use, do not post it on the Service. PILI shall have no responsibility to evaluate, use or compensate you for any ideas or information you may choose to submit.

3.2.2. Responsible For Your Own Content
You are solely responsible for the information that you post on, through or in connection with the Service and that you provide to others. PILI may reject, refuse to post or delete any User Content for any or no reason, including, but not limited to, User Content that in the sole judgment of PILI violates these Terms of Service.

3.2.3. Your License to PILI
You hereby grant to PILI an irrevocable, perpetual, transferable, fully paid-up, royalty-free, worldwide license (including the right to sublicense and assign to third party) and right to copy, reproduce, fix, adapt, modify, create derivative works from, manufacture, commercialize, publish, distribute, sell, license, sublicense, transfer, lease, transmit, publicly display, publicly perform, or provide access to electronically, broadcast, communicate to the public by telecommunication, display, perform, enter into computer memory, and use and practice, in any way, your User Content as well as all modified and derivative works thereof in connection with our provision of the Service, including marketing and promotions of the Service. You also hereby grant to PILI the right to authorize others to exercise any of the rights granted to PILI under these Terms of Service. You further hereby grant to PILI the unconditional, irrevocable right to use and exploit your name, likeness and any other information or material included in any User Content and in connection with any User Content, without any obligation to you. Except as prohibited by law, you waive any rights of attribution and/or any moral rights you may have in your User Content, regardless of whether your User Content is altered or changed in any manner. PILI does not claim any ownership rights in your User Content and nothing in these Terms of Service is intended to restrict any rights that you may have to use and exploit your User Content. PILI has no obligation to monitor or enforce your intellectual property rights in or to your User Content.

3.3. User Interactions
You are solely responsible for your interactions with other users of the Service and any other parties with whom you interact through the Service and/or PILI games. PILI reserves the right, but has no obligation, to become involved in any way with these disputes. You will fully cooperate with PILI to investigate any suspected unlawful, fraudulent or improper activity, including, without limitation, granting PILI access to any password-protected portions of your Account.

If you have a dispute with one or more users, you release us (and our officers, directors, agents, subsidiaries, joint ventures and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.

4. Fees and Purchase Terms
4.1.Purchases
In the Service you may purchase, with "real world" money, a limited, personal, non-transferable, non-sublicensable, revocable license to use (a) "virtual currency", including but not limited to virtual cash or diamonds, all for use in PILI games; (b) "virtual in-game items" (together with "virtual currency", "Virtual Items"); and (c) other goods or services ("Merchandise"). You are only allowed to purchase Virtual Items from us or our authorised partners through the Service, and not in any other way.

PILI may manage, regulate, control, modify or eliminate Virtual Items and/or Merchandise at any time, with or without notice. PILI shall have no liability to you or any third party in the event that PILI exercises any such rights./p>

The transfer of Virtual Items and Merchandise is prohibited except where expressly authorized in the Service. Other than as expressly authorized in the Service, you shall not sell, purchase, redeem or otherwise transfer Virtual Items or Merchandise to any person or entity or attempt any of the aforesaid, including but not limited to PILI, another user or any third party.

ALL PURCHASES AND REDEMPTIONS OF VIRTUAL ITEMS MADE THROUGH THE SERVICE ARE FINAL AND NON-REFUNDABLE.

The provision of Virtual Items for use in PILI games is a service provided by PILI that commences immediately upon acceptance by PILI of your purchase.

4.2. Payment of Fees
You agree to pay all fees and applicable taxes incurred by you or anyone using an Account registered to you. PILI may revise the pricing for the goods and services offered through the Service at any time. YOU ACKNOWLEDGE THAT PILI IS NOT REQUIRED TO PROVIDE A REFUND FOR ANY REASON, AND THAT YOU WILL NOT RECEIVE MONEY OR OTHER COMPENSATION FOR UNUSED VIRTUAL ITEMS WHEN AN ACCOUNT IS CLOSED, WHETHER SUCH CLOSURE WAS VOLUNTARY OR INVOLUNTARY.

5. Updates to the Service
You understand that the Service is an evolving one. PILI may require that you accept updates to the Service and to PILI's games you have installed on your device or computer. You acknowledge and agree that PILI may update the Service and PILI games, with or without notifying you. You may need to update third party software from time to time in order to receive the Service and play PILI games.

6. Disclaimer of Warranties
WITHOUT LIMITING PILI'S LIABILITY UNDER SECTION 7 BELOW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS FOR YOUR USE, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND THOSE ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. PILI DOES NOT WARRANT THAT YOU WILL BE ABLE TO ACCESS OR USE THE SERVICE AT THE TIMES OR LOCATIONS OF YOUR CHOOSING; THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; OR THAT THE GAME OR THE SERVICE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. Some jurisdictions do not allow the exclusion of certain warranties. Accordingly, some of the above disclaimers may not apply to you.

7. Limitation of Liability; Sole and Exclusive Remedy; Indemnification
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PILI SHALL NOT BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE OR OTHER SIMILAR DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUES, LOST PROFITS, LOST DATA OR BUSINESS INTERRUPTION OR OTHER INTANGIBLE LOSSES (HOWEVER SUCH LOSSES ARE QUALIFIED), ARISING OUT OF OR RELATING IN ANY WAY TO THESE TERMS OF SERVICE OR THE SERVICE ITSELF, WHETHER BASED ON CONTRACT, TORT OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT PILI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT NOT PROHIBITED BY LAW, PILI SHALL NOT BE LIABLE TO YOU FOR MORE THAN THE AMOUNT YOU HAVE PAID TO PILI IN ACCORDANCE WITH THESE TERMS OF SERVICE IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE DATE ON WHICH YOU FIRST ASSERT A CLAIM. YOU ACKNOWLEDGE AND AGREE THAT IF YOU HAVE NOT PAID ANYTHING TO PILI DURING SUCH TIME PERIOD, YOUR SOLE REMEDY (AND PILI'S EXCLUSIVE LIABILITY) FOR ANY DISPUTE WITH PILI IS TO STOP USING THE SERVICE AND TO CANCEL YOUR ACCOUNT.

NOTHING IN THESE TERMS OF SERVICE SHALL AFFECT THE STATUTORY RIGHTS OF ANY CONSUMER OR EXCLUDE OR RESTRICT ANY LIABILITY RESULTING FROM GROSS NEGLIGENCE OR WILLFUL MISCONDUCT OF PILI OR FOR DEATH OR PERSONAL INJURY ARISING FROM ANY NEGLIGENCE OR FRAUD OF PILI.

You agree to indemnify, defend and hold PILI (and our officers, directors, agents, subsidiaries, affiliates, agents, licensors, joint ventures and employees) harmless from any claim, demand, damages or other losses, including reasonable attorneys' fees, asserted by any third-party resulting from or arising out of your use of the Service, or any breach by you of these Terms of Service, however the foregoing does not apply if the infringement of rights is not attributable to your intentional or negligent behavior.

8. Dispute Resolution and Law
If a dispute arises between you and PILI, we strongly encourage you to first contact us directly to seek a resolution. If you are a resident of the United States, these Terms of Service and any dispute arising out of or related to it or Privacy Policy or the Service shall be governed in all respects by California law, without regard to conflict of law provisions. You agree that any claim or dispute you may have against PILI must be resolved exclusively by a court located in San Francisco, California. If you are a resident outside of the United States, you agree that all disputes between you and PILI shall be governed by the laws of Singapore, without regard to conflict of law provisions. You agree that any claim or dispute you may have against PILI must be resolved exclusively by a court located in Singapore.

9. Severability
You and PILI agree that if any portion of these Terms of Service or of the PILI Privacy Policy is found illegal or unenforceable, in whole or in part by any court of competent jurisdiction, such provision shall, as to such jurisdiction, be ineffective solely to the extent of such determination of invalidity or unenforceability without affecting the validity or enforceability thereof in any other manner or jurisdiction and without affecting the remaining provisions of the terms, which shall continue to be in full force and effect.

10. General Provisions
10.1. Assignment
PILI may assign or delegate these Terms of Service and/or the PILI Privacy Policy, in whole or in part, to any person or entity at any time with or without your consent. You may not assign or delegate any rights or obligations under the Terms of Service or Privacy Policy without PILI's prior written consent, and any unauthorized assignment and delegation by you is ineffective.

10.2. Supplemental Policies
PILI may publish additional policies related to specific services such as forums, contests or loyalty programs. Your right to use such services is subject to those specific policies and these Terms of Service.

10.3. Entire Agreement
These Terms of Service, any supplemental policies and any documents expressly incorporated by reference herein (including the PILI Privacy Policy), contain the entire understanding of you and PILI, and supersede all prior understandings of the parties hereto relating to the subject matter hereof, whether electronic, oral or written, or whether established by custom, practice, policy or precedent, between you and us with respect to the Service.

10.4. No Waiver
The failure of PILI to require or enforce strict performance by you of any provision of these Terms of Service or the PILI Privacy Policy or failure to exercise any right under them shall not be construed as a waiver or relinquishment of PILI's right to assert or rely upon any such provision or right in that or any other instance.

The express waiver by PILI of any provision, condition, or requirement of these Terms of Service or the PILI Privacy Policy shall not constitute a waiver of any future obligation to comply with such provision, condition or requirement.

Except as expressly and specifically set forth in this these Terms of Service, no representations, statements, consents, waivers, or other acts or omissions by PILI shall be deemed a modification of these Terms of Service nor legally binding, unless documented in physical writing, hand signed by yourself and a duly appointed officer of PILI.

10.5. Notices
We may notify you via postings on https://www.pilistarship.com, and via e-mail or any other communications means to contact information you provide to us. All notices given by you or required from you under these Terms of Service or the PILI Privacy Policy shall be in writing and addressed to: 152 BEACH ROAD #11-05, GATEWAY EAST SINGAPORE (189721). Any notices that you provide without compliance with this Section on Notices shall have no legal effect.

10.6. Equitable Remedies
You acknowledge that the rights granted and obligations made under these Terms of Service to PILI are of a unique and irreplaceable nature, the loss of which shall irreparably harm PILI and which cannot be replaced by monetary damages alone so that PILI shall be entitled to injunctive or other equitable relief (without the obligations of posting any bond or surety or proof of damages) in the event of any breach or anticipatory breach by you.

You irrevocably waive all rights to seek injunctive or other equitable relief, or to enjoin or restrain the operation of the Service or any PILI game, exploitation of any advertising or other materials issued in connection therewith, or exploitation of the Service or any content or other material used or displayed through the Service and agree to limit your claims to claims for monetary damages, limited by Section 7 (if any).

10.7. Force Majeure
PILI shall not be liable for any delay or failure to perform resulting from causes outside the reasonable control of PILI, including without limitation any failure to perform hereunder due to unforeseen circumstances or cause beyond PILI's control such as acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor or materials.
