Concessione di licenza limitata<br><br>Subordinatamente all'accettazione e al pieno rispetto dei termini e delle disposizioni del presente Contratto, CRYTEK concede al Licenziatario un diritto limitato, personale, revocabile, non trasferibile e non esclusivo (la "Licenza") nel corso della Durata, come definita di seguito, di utilizzare HUNT: SHOWDOWN 1896,

Diritti di proprietà intellettuale<br><br>HUNT: SHOWDOWN 1896 è concesso in licenza, non venduto. La titolarità di HUNT: SHOWDOWN 1896 e di tutti i diritti d'autore, dei marchi nonché di tutti gli altri diritti di proprietà intellettuale ad esso correlati rimane in capo a CRYTEK (o ai suoi licenzianti, a seconda dei casi) e sono protetti dalle leggi tedesche e internazionali in materia di diritto d'autore e da altre leggi applicabili. Il Licenziatario non avrà alcun diritto di proprietà o di proprietà intellettuale rispetto a HUNT: SHOWDOWN 1896, ivi compresi, a titolo esemplificativo e non esaustivo, tutti i diritti d'autore ad esso correlati. <br><br>4. Riserva di diritti<br><br>CRYTEK (o i suoi licenzianti, a seconda dei casi) si riserva espressamente tutti i diritti non concessi nel presente Contratto. L'Utente non acquisisce alcun diritto o licenza di copiare, distribuire, eseguire pubblicamente, mostrare o fare qualsiasi altro uso di HUNT: SHOWDOWN 1896 o di qualsiasi suo elemento o dei marchi CRYTEK, HUNT: SHOWDOWN, HUNT: SHOWDOWN 1896, CRYENGINE o di qualsiasi altro marchio di CRYTEK o di qualsiasi altra società.<br>5. Limitazioni all'uso del software<br><br>Qualsiasi uso da parte del Licenziatario di HUNT: SHOWDOWN 1896 non espressamente consentito nella Sezione 2 di cui sopra è espressamente vietato e qualsiasi uso non autorizzato costituirà una violazione sostanziale del presente Contratto da parte del Licenziatario. <br><br>Il presente divieto include (ma non si limita a): <br>• copiare, riprodurre, produrre o distribuire (gratuitamente o in altro modo) HUNT: SHOWDOWN 1896, in tutto o in parte, su qualsiasi supporto; <br>• trasferire, vendere, sublicenziare o concedere in locazione a terzi qualsiasi diritto su HUNT: SHOWDOWN 1896; <br>• utilizzare HUNT: SHOWDOWN 1896 in contrasto con le leggi vigenti; <br>• creare qualsiasi opera derivata o modificare HUNT: SHOWDOWN 1896 nonché, a titolo esemplificativo e non esaustivo, creare, sviluppare, distribuire o utilizzare programmi software non autorizzati ("cheat", "hack", ecc.) al fine di ottenere vantaggi in qualsiasi modalità di gioco o eseguire o utilizzare metodi che interferiscano con l'esito e/o lo svolgimento del gioco di HUNT: SHOWDOWN 1896, ivi compresi cheat, bot, script, ecc.; <br>• decompilare, decodificare o disassemblare HUNT: SHOWDOWN

                <br>2. Grant of Limited License<br><br>Subject to your agreement to, and full compliance with, the terms and provisions of this Agreement,

Unless set forth otherwise in the manual or on the packaging or otherwise indicated to you are allowed to install and use HUNT: SHOWDOWN 1896 on one (1) device at the same time only. <br><br>3. Intellectual Property Rights<br><br>HUNT: SHOWDOWN 1896 is licensed, not sold. HUNT: SHOWDOWN 1896 and all copyrights, trademarks, and all other intellectual property rights related thereto are owned by CRYTEK (or its licensors, as applicable) and are protected by German and international copyright law and other applicable law. Licensee shall have no ownership or intellectual property rights in or to HUNT: SHOWDOWN 1896, including, without limitation, all copyrights related thereto. <br><br>4. Reservation of Rights<br><br>CRYTEK (or its licensors, as applicable) expressly reserves all rights not granted in this Agreement. You are not receiving any right or license hereunder to copy, distribute, publicly perform, display or make any other use of the HUNT: SHOWDOWN 1896, or any element thereof, or the trademarks CRYTEK, HUNT: SHOWDOWN, HUNT: SHOWDOWN 1896, CRYENGINE, or any other trademark of CRYTEK or any other company.<br>5. Software Use Restrictions<br><br>Any use by Licensee of HUNT: SHOWDOWN 1896 not expressly permitted in Section 2 above is expressly prohibited and any such unauthorized use shall constitute a material breach of this Agreement by Licensee. <br><br>This prohibition includes (but is not limited to): <br>- to copy, reproduce, manufacture or distribute (free of charge or otherwise) HUNT: SHOWDOWN 1896, in whole or in part, in any media; <br>- to transfer, sell, sublicense or lease any rights in and to HUNT: SHOWDOWN 1896 to third parties; <br>- to use HUNT: SHOWDOWN 1896 contrary to applicable law; <br>- to create any derived work or to modify HUNT: SHOWDOWN 1896 - – including but not limited to create, develop, distribute, or use any unauthorized software programs (“cheats”, “hacks”, etc.) to gain any advantage in any game mode or to run or use methods which interfere with the outcome and/or the course of the gameplay of HUNT: SHOWDOWN 1896 including cheats, bots, scripts, etc.); <br>- to decompile, reverse engineer or disassemble HUNT: SHOWDOWN 1896. <br>Licensee shall not alter or remove any legal notices, such as trademark and copyright notices, affixed by CRYTEK on or within HUNT: SHOWDOWN 1896. <br><br>6. Digital Rights Management (DRM)<br><br>HUNT: SHOWDOWN 1896 may use

Limitazione della garanzia di CRYTEK<br><br>NELLA MISURA MASSIMA CONSENTITA DALLA LEGGE APPLICABILE, L'UTENTE ACCETTA ESPRESSAMENTE CHE L'USO DEI SERVIZI/VIDEOGIOCHI CRYTEK, DEL SOFTWARE CRYTEK E DI INTERNET SIA A PROPRIO ESCLUSIVO RISCHIO. I SERVIZI/VIDEOGIOCHI CRYTEK, IL SOFTWARE CRYTEK, I PRODOTTI CRYTEK E I SERVIZI E PRODOTTI DI TERZI SONO FORNITI "COSÌ COME SONO" E "COME DISPONIBILI" PER L’USO DELL'UTENTE, SENZA GARANZIE DI ALCUN TIPO, SIA ESPRESSE CHE IMPLICITE, SALVO CHE TALI GARANZIE NON SIANO ESCLUDIBILI PER LEGGE. CRYTEK FORNISCE I SERVIZI/VIDEOGIOCHI CRYTEK SU UNA BASE COMMERCIALMENTE RAGIONEVOLE E NON GARANTISCE CHE L'UTENTE SARÀ IN GRADO DI ACCEDERE O UTILIZZARE I SERVIZI/VIDEOGIOCHI CRYTEK NEI TEMPI O NEI LUOGHI DI PROPRIA SCELTA, O CHE CRYTEK DISPORRÀ DI UN'ADEGUATA CAPACITÀ DI EROGAZIONE DEI SERVIZI/VIDEOGIOCHI CRYTEK NEL LORO COMPLESSO O IN UNA SPECIFICA AREA GEOGRAFICA.<br>10. Limitazione della responsabilità di CRYTEK<br><br>NELLA MISURA MASSIMA CONSENTITA DALLA LEGGE APPLICABILE, L'UTENTE RICONOSCE E ACCETTA CHE IL PROPRIO UNICO ED ESCLUSIVO RIMEDIO IN CASO DI CONTROVERSIA CON CRYTEK E/O CON LE SUE AFFILIATE, CON I LICENZIANTI DI CRYTEK E/O CON LE LORO AFFILIATE, CON I PROPRI LICENZIANTI E/O CON LE LORO AFFILIATE O I LORO LICENZIANTI CONSISTE NELL'INTERROMPERE L'UTILIZZO DEI SERVIZI/VIDEOGIOCHI CRYTEK E NEL CANCELLARE IL PROPRIO ACCOUNT CRYTEK. L'UTENTE RICONOSCE E ACCETTA CHE CRYTEK E LE SUE AFFILIATE, I LICENZIANTI DI CRYTEK E LE LORO AFFILIATE, I PROPRI LICENZIANTI E LE LORO AFFILIATE NON SIANO RESPONSABILI PER QUALSIASI AZIONE O OMESSA AZIONE DA PARTE LORO O DI QUALSIASI ALTRA PERSONA RIGUARDO ALLA CONDOTTA, ALLA COMUNICAZIONE O AL CONTENUTO DEI SERVIZI/VIDEOGIOCHI CRYTEK O ALL'USO DEL SOFTWARE CRYTEK. IN NESSUN CASO LA RESPONSABILITÀ DI CRYTEK E DELLE SUE AFFILIATE, DEI LICENZIANTI DI CRYTEK E DELLE LORO AFFILIATE, DEI PROPRI LICENZIANTI E DELLE LORO AFFILIATE O DEI RISPETTIVI DIPENDENTI, DIRIGENTI O AMMINISTRATORI (COLLETTIVAMENTE, ""AFFILIATE DI CRYTEK"") NEI CONFRONTI DELL’UTENTE POTRÀ ECCEDERE L’AMMONTARE DI QUANTO HA CORRISPOSTO A CRYTEK PER I SERVIZI/VIDEOGIOCHI CRYTEK E/O IL SOFTWARE CRYTEK. IN NESSUN CASO CRYTEK E LE SUE AFFILIATE, I LICENZIANTI DI CRYTEK E LE LORO AFFILIATE, I PROPRI LICENZIANTI E LE LORO AFFILIATE SARANNO RESPONSABILI PER DANNI INCIDENTALI O CONSEGUENTI DERIVANTI DALL'USO DEI SERVIZI/VIDEOGIOCHI CRYTEK, DEL SOFTWARE CRYTEK, DI INTERNET O PER QUALSIASI ALTRA PRETESA IN QUALSIASI MODO CONNESSA ALL'USO DEI SERVIZI/VIDEOGIOCHI CRYTEK, DEL SOFTWARE O DEGLI ACCOUNT CRYTEK POICHÉ ALCUNI STATI O GIURISDIZIONI NON CONSENTONO L'ESCLUSIONE O LA LIMITAZIONE DI RESPONSABILITÀ PER DANNI CONSEGUENTI O INCIDENTALI, IN TALI STATI O GIURISDIZIONI, LA RESPONSABILITÀ DI CRYTEK E DELLE SUE AFFILIATE, DEI LICENZIANTI DI CRYTEK E DELLE LORO AFFILIATE, DEI PROPRI LICENZIANTI E DELLE LORO AFFILIATE SARÀ LIMITATA NELLA MISURA MASSIMA CONSENTITA DALLA LEGGE. CRYTEK NON APPROVA, NON GARANTISCE NÉ ASSICURA ALCUN PRODOTTO O SERVIZIO DI TERZI OFFERTO ATTRAVERSO CRYTEK E NON PARTECIPERÀ NÉ SARÀ IN ALCUN MODO RESPONSABILE DEL MONITORAGGIO DI QUALSIASI TRANSAZIONE TRA L’UTENTE E FORNITORI TERZI DI PRODOTTI O SERVIZI. <br><br>Nonostante quanto sopra, nulla di quanto contenuto nel presente Contratto limita la responsabilità di CRYTEK nei confronti dell’Utente per dichiarazioni fraudolente, morte o lesioni personali causate da negligenza di CRYTEK, o qualsiasi altra responsabilità nella misura

Garanzie e indennizzi del Licenziatario<br><br>Il Licenziatario garantisce e dichiara che: <br>a) dispone di tutti i diritti e dell'autorità legale per stipulare ed essere vincolato dai termini del presente Contratto; <br>b) dispone di tutti i diritti e dell'autorità legali per esercitare i diritti che gli sono stati concessi con il presente Contratto e per adempiere agli obblighi rivenienti dal presente Contratto; <br>c) rispetterà, in ogni momento nel corso della Durata, tutte le leggi vigenti. <br><br>Il Licenziatario accetta di manlevare, difendere e tenere indenne
                 CRYTEK 
                and shall not relieve Licensee from any liability which arises prior to termination. The provisions of this Agreement which by their terms or sense are intended to survive shall survive cancellation, expiration or termination of this Agreement. <br><br>9. Limitation of CRYTEK’s Warranty<br><br>TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU EXPRESSLY AGREE THAT THE USE OF
                e/o i suoi successori, aventi diritto, dirigenti, amministratori, dipendenti, agenti, rappresentanti e licenziatari (ad esclusione del Licenziatario) da e contro tutti i danni, le pretese, le perdite, le cause di azione e i procedimenti legali derivanti da e/o relativi a una violazione del presente Contratto da parte del Licenziatario.<br>12. Modifiche di HUNT: SHOWDOWN 1896 (applicabile solo in caso di acquisto di HUNT: SHOWDOWN 1896 presso CRYTEK; non applicabile in caso di acquisto di HUNT: SHOWDOWN 1896 in un negozio o piattaforma ecc. e se
                 CRYTEK 
                SERVICES / VIDEO GAMES,
                non è partner contrattuale dell'Utente)<br><br>a. L’Utente riconosce che HUNT:SHOWDOWN 1896 è un "gioco con servizio live". Ciò significa che HUNT:SHOWDOWN 1896 e i suoi contenuti, le modalità di gioco ecc. sono in costante sviluppo. Si intende inclusa anche la modifica del nome HUNT:SHOWDOWN 1896. Tali sviluppi tipici di un "gioco con servizio live" sono pertanto una condizione necessaria del gioco, un elemento basilare per HUNT:SHOWDOWN 1896, da non considerarsi "Modifiche" come di seguito indicato nella presente Sezione 12. <br><br>b. Inoltre,
                 CRYTEK 
                SOFTWARE, AND THE INTERNET IS AT YOUR SOLE RISK.
                si riserva il diritto di modificare HUNT:SHOWDOWN 1896 per validi motivi (ad esempio aggiungendo o eliminando funzionalità) oltre a quanto necessario per mantenere la conformità di HUNT:SHOWDOWN 1896 al Contratto. Tali validi motivi comprendono, a titolo esemplificativo e non esaustivo, le modifiche (i) per ottemperare alla legge o alla giurisprudenza applicabile, (ii) per dare esecuzione a ordinanze del tribunale o di altre autorità, (iii) per adattarsi a mutati requisiti tecnici, (iv) per adeguarsi a mutate condizioni di mercato, ad es. un aumento del numero di utenti, (v) causate da violazioni di diritti di terzi, (vi) causate dalla cessazione di licenze di terzi e/o da modifiche dei termini di licenza di terzi necessari per fornire HUNT:SHOWDOWN 1896, (vii) causate da eventi di insolvenza/fallimento di fornitori di servizi terzi o (viii) a beneficio di tutti i giocatori di HUNT:SHOWDOWN 1896 (le "Modifiche"). <br><br>c. Tali Modifiche non comportano alcun costo a carico dell’Utente.
                 CRYTEK 
                SERVICES/ VIDEO GAMES,
                informerà gli utenti di HUNT:SHOWDOWN 1896 di tali Modifiche in modo chiaro e comprensibile. <br><br>d. Nel caso in cui una modifica abbia un impatto negativo sull'accesso o sull'utilizzo di HUNT:SHOWDOWN 1896 da parte dell’Utente in maniera non trascurabile (una "Modifica Negativa"),
                 CRYTEK 
                SOFTWARE, CRYTEK’S PRODUCTS AND THIRD-PARTY SERVICES AND PRODUCTS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS FOR YOUR USE, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, UNLESS SUCH WARRANTIES ARE LEGALLY INCAPABLE OF EXCLUSION.
                si impegnerà a darne comunicazione all’Utente con un anticipo di 8 settimane e a informarlo sulla Modifica Negativa in questione, sulla sua data e sui diritti spettanti come di seguito descritto. <br><br>e. In caso di Modifica Negativa, l’Utente ha il diritto di recedere dal Contratto entro 30 giorni dal ricevimento della comunicazione, senza alcun costo a proprio carico. Il periodo di recesso dal Contratto decorre dalla data di ricezione della comunicazione o dalla data di esecuzione della Modifica, a seconda di quale sia la data più recente. L’Utente non ha il diritto di recedere dal Contratto se può ancora accedere e utilizzare HUNT:SHOWDOWN 1896 senza costi aggiuntivi.<br>13. Violazione del Contratto<br><br>In caso di violazione del presente Contratto da parte di CRYTEK, l'unico rimedio a disposizione del Licenziatario sarà la risoluzione del Contratto mediante comunicazione scritta a CRYTEK. <br><br>In caso di violazione del presente Contratto da parte del Licenziatario,
                 CRYTEK 
                PROVIDES

                abbia diritto ai sensi della legge applicabile e/o del presente Contratto, ivi compreso, a titolo esemplificativo e non esaustivo, il risarcimento di tutti i danni eventualmente insorti in relazione a tale violazione. <br><br>Il Licenziatario conviene che il proprio uso non autorizzato di HUNT: SHOWDOWN 1896, o di qualsiasi sua parte, può comportare un danno immediato e irreparabile a
                 CRYTEK 
                SERVICES/VIDEO GAMES AT TIMES OR LOCATIONS OF YOUR CHOOSING, OR THAT
                tale da non poter essere adeguatamente risarcito con un indennizzo monetario; in tal caso, e a discrezione di CRYTEK,
                 CRYTEK 
                WILL HAVE ADEQUATE CAPACITY FOR
                avrà diritto all’emissione di un provvedimento ingiuntivo, oltre a tutti gli altri rimedi disponibili, compreso l’indennizzo monetario, per vietare tale uso non autorizzato, senza la necessità che
                 CRYTEK 
                SERVICES/ VIDEO GAMES AS A WHOLE OR IN ANY SPECIFIC GEOGRAPHIC AREA.<br>10. Limitation of CRYTEK’s Liability<br><br>TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU ACKNOWLEDGE AND AGREE THAT YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY DISPUTE WITH

                e qualsiasi regola o istruzione pubblicata relativa a HUNT: SHOWDOWN 1896) costituiscono la manifestazione integrale delle intese intervenute tra l’Utente e
                 CRYTEK 
                SERVICES/VIDEO GAMES, AND TO CANCEL YOUR
                in merito ai diritti e obblighi dell'Utente per l'uso di HUNT: SHOWDOWN 1896. Il presente Contratto annulla e sostituisce ogni altra precedente versione. In caso di conflitto tra il presente Contratto e altre regole o istruzioni pubblicate da CRYTEK, prevarranno tali regole o istruzioni. <br><br>Le disposizioni applicabili nei contratti stipulati con i fornitori della piattaforma con cui l’Utente ha acquistato HUNT: SHOWDOWN 1896 (ad esempio Microsoft, Sony) rimarranno inalterate. <br><br>b. Rimedi. Il presente Contratto non è inteso a conferire e non conferisce alcun diritto o rimedio a persone diverse dalle parti contrattuali. <br><br>c. Trasferimento dei diritti.
                 CRYTEK 
                ACCOUNT. YOU ACKNOWLEDGE AND AGREE THAT
                avrà la facoltà di trasferire a terzi i diritti e gli obblighi derivanti dal presente Contratto o dall'intero Contratto. Il Licenziatario non potrà trasferire alcun diritto e obbligo derivante dal presente Contratto senza la preventiva approvazione scritta di CRYTEK. <br><br>d. Separabilità. Se una qualsiasi parte del presente Contratto dovesse essere ritenuta non valida o inapplicabile,
                 CRYTEK 
                AND ITS AFFILIATES, CRYTEK’S LICENSORS AND THEIR AFFILIATES, YOUR LICENSORS AND THEIR AFFILIATES ARE NOT LIABLE FOR ANY ACT OR FAILURE TO ACT BY THEM OR ANY OTHER PERSON REGARDING CONDUCT, COMMUNICATION OR CONTENT ON
                e il Licenziatario collaboreranno in buona fede per sostituire la disposizione non valida con una disposizione valida il cui intento sia il più possibile prossimo allo scopo economico della disposizione non valida. Le restanti disposizioni del Contratto rimarranno impregiudicate. <br><br>e. Rinuncia. L'inerzia da parte di
                 CRYTEK 
                SERVICES/VIDEO GAMES OR USE OF
                nell'esercizio o nell'applicazione di un diritto o di una disposizione del presente Contratto non costituirà una rinuncia a far valere tale diritto o disposizione. Qualsiasi rinuncia a una disposizione del presente Contratto non sarà valida ed efficace ove non risulti da atto scritto firmato da CRYTEK. <br><br>f.
                 CRYTEK 
                SOFTWARE. IN NO CASE SHALL
                mette a disposizione il presente Contratto in tutte le lingue in cui è commercializzato. Poiché non è possibile escludere completamente la possibilità di discrepanze nel significato di alcuni termini, in tale ipotesi prevarrà la versione inglese.<br>g. Legge regolatrice e foro competente. (i) Il presente Contratto è disciplinato dal diritto tedesco, a prescindere delle norme sui conflitti di legge; tale scelta di legge, tuttavia, non priva l'Utente della tutela offerta dalle disposizioni che non possono essere derogate per accordo in virtù del diritto che, in assenza di scelta, sarebbe stato applicabile. (ii) Nelle controversie in cui
                 CRYTEK 
                AND ITS AFFILIATES, CRYTEK’S LICENSORS AND THEIR AFFILIATES, YOUR LICENSORS AND THEIR AFFILIATES OR THEIR RESPECTIVE EMPLOYEES’, OFFICERS’, OR DIRECTORS’ (COLLECTIVELY, “CRYTEK AFFILIATES”) LIABILITY TO YOU EXCEED THE AMOUNT THAT YOU PAID TO
                sia parte convenuta, le parti concordano espressamente la competenza esclusiva dei tribunali di Francoforte sul Meno/Germania. Il presente accordo sulla giurisdizione si applica a tutte le richieste di risarcimento, siano esse basate su contratto, su fatto illecito o su qualsiasi altra base giuridica, derivanti o in relazione al presente Contratto. In tutti gli altri casi, il foro competente sarà determinato in base alle norme generali. <br><br>h. I licenzianti di CRYTEK/ i fornitori della piattaforma (ad esempio Microsoft o Sony) saranno terzi beneficiari del presente Contratto e avranno il diritto esplicito di farne valere le disposizioni e di godere dei benefici delle sue tutele. <br><br>i. HUNT: SHOWDOWN 1896 può includere un codice di terze parti fornito con licenze diverse. Per ulteriori informazioni, si invita a consultare i crediti. <br><br>j. Modifica del presente Contratto. <br>(i) Le modifiche al presente Contratto acquisteranno efficacia al momento dell'accettazione attiva da parte del Licenziatario, o come descritto di seguito:. <br>(ii)

                comunicherà all’Utente le modifiche apportate alle condizioni prima della loro entrata in vigore. <br>(iv) Allo stesso tempo,
                 CRYTEK 
                SOFTWARE. IN NO CASE SHALL CRYTEK AND ITS AFFILIATES, CRYTEK’S LICENSORS AND THEIR AFFILIATES, YOUR LICENSORS AND THEIR AFFILIATES BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF CRYTEK SERVICES / VIDEO GAMES, CRYTEK SOFTWARE , THE INTERNET OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF CRYTEK SERVICES / VIDEO GAMES, CRYTEK SOFTWARE OR ACCOUNTS. BECAUSE SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR THE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, IN SUCH STATES OR JURISDICTIONS, CRYTEK’S AND ITS AFFILIATES’, CRYTEK’S LICENSORS’ AND THEIR AFFILIATES’, YOUR LICENSORS’ AND THEIR AFFILIATES’ LIABILITY SHALL BE LIMITED TO THE FULL EXTENT PERMITTED BY LAW. CRYTEK DOES NOT ENDORSE, WARRANT OR GUARANTEE ANY THIRD-PARTY PRODUCT OR SERVICE OFFERED THROUGH CRYTEK AND WILL NOT BE A PARTY TO OR IN ANY WAY BE RESPONSIBLE FOR MONITORING ANY TRANSACTION BETWEEN YOU AND THIRD-PARTY PROVIDERS OF PRODUCTS OR SERVICES. <br><br>Notwithstanding the foregoing, nothing contained
                concederà all’Utente un periodo congruo di almeno sei settimane per recedere dal Contratto, nel caso

                this Agreement limits ’CRYTEK’s liability to you for fraudulent misrepresentations, death or personal injury caused by ’CRYTEK’s negligence, or any other liability to the extent such liability cannot be excluded or limited as

Licensee’s Warranties and Indemnification<br><br>Licensee warrants and represents that: <br>a) Licensee has full legal rights and authority to enter into and become bound by the terms of this Agreement; <br>b) Licensee has full legal rights and authority to exercise Licensee’s rights granted herein and to comply with Licensee’s obligations hereunder; <br>c) Licensee will comply, at all times during the Term, with all applicable laws. <br><br>Licensee hereby agrees to indemnify, defend, and hold harmless CRYTEK and/or their successors, assigns, officers, directors, employees, agents, representatives and licensees (but not including Licensee) from and against all damages, claims, losses, causes of action and lawsuits arising from and/or relating to
                utilizzare HUNT:SHOWDOWN 1896. <br>(v) Se l’Utente non recede dal Contratto entro il periodo sopra indicato, le condizioni modificate si applicheranno con decorrenza dalla data prevista specificata nella comunicazione di cui sopra. L'uso continuativo del Video gioco Hunt: Showdown 1896 da parte dell’Utente equivarrà all'accettazione della versione modificata o rinnovata del presente Contratto. <br><br>k. La Commissione europea mette
                 a 
                breach of this Agreement by Licensee.<br>12. Modifications of HUNT: SHOWDOWN 1896 (only applicable if you purchase HUNT: SHOWDOWN 1896 from CRYTEK; it does not apply if you purchase HUNT: SHOWDOWN 1896 from a store or platform etc. and CRYTEK is not your contractual partner)<br><br>a. You acknowledge that HUNT: SHOWDOWN 1896 is a “live service game”. This means that HUNT: SHOWDOWN 1896 and its content, game mode etc. is under constant development. This also includes a change of the name of HUNT: SHOWDOWN 1896. The aforementioned changes do not affect the then current version of this Agreement. Such typical “live services game developments” are therefore a prerequisite of the game, elementary for HUNT: SHOWDOWN 1896 and not considered “Modifications” as set out below in this Section 12. <br><br>b. Furthermore, CRYTEK reserves the right to modify HUNT: SHOWDOWN 1896 for good reason (e.g. by adding or removing features) beyond what is necessary to maintain HUNT: SHOWDOWN 1896 in conformity with the Agreement. Such good reason includes but is not limited to modifications (i) to comply with applicable law or case-law, (ii) to implement court or other official orders, (iii) to adapt to changed technical requirements, (iv) to adjust to altered market conditions e.g. increased user numbers, (v) caused by infringement of third party rights, (vi) caused by termination of third party licenses and/or modifications of such third party license terms that are necessary to provide HUNT:SHOWDOWN 1896, (vii) caused by default event of third party service providers, or (viii) for the benefit of all players of HUNT:SHOWDOWN 1896 (the “Modifications”). <br><br>c. Such Modifications are at no cost for you. CRYTEK will notify users of HUNT: SHOWDOWN 1896 about such Modifications in a clear and comprehensible manner. <br><br>d. In the event that a Modification negatively impacts your access to or usage of HUNT: SHOWDOWN 1896 in a more than just minor way (the “Negative Modification”), CRYTEK will undertake to notify you 8 weeks upfront and inform you about the respective Negative Modification, its date and your rights described below. <br><br>e. In the event of a Negative Modification, you have the right to terminate the Agreement within 30 days at no costs upon receipt of the notification. The period to terminate the Agreement begins to run from the date on which you have received the notification, or when the Modification is made, whichever is later. You do not have a right to terminate the Agreement if you still can access and use HUNT: SHOWDOWN 1896 without additional costs.<br>13. Breach of the Agreement<br><br>In the event of a breach of this Agreement by CRYTEK, Licensee's sole remedy shall be to terminate this Agreement by delivering written notice of termination to CRYTEK. <br><br>In the event of a breach by Licensee of this Agreement, CRYTEK (and its licensors, as applicable) may pursue all remedies to which CRYTEK is entitled under applicable law and/or this Agreement, including without limitation the compensation for any and all damages which may arise in connection with such breach. <br><br>Licensee agrees that Licensee's unauthorized use of HUNT: SHOWDOWN 1896, or any part thereof, may immediately and irreparably damage CRYTEK such that CRYTEK could not be adequately compensated by a monetary award, and in such event, and at CRYTEK's option, CRYTEK shall be entitled to an injunctive order, in addition to all other remedies available including a monetary award, to prohibit such unauthorized use, without the necessity of CRYTEK posting bond or other security. <br><br>14. General Provisions<br><br>a. Entire Agreement: This Agreement (including the Privacy Policy, Code of Conduct, manual and other supplemental terms provided by CRYTEK and any posted rules or instructions regarding HUNT: SHOWDOWN 1896) constitute the entire agreement between you and CRYTEK relating to your rights and obligations in the use of HUNT: SHOWDOWN 1896. This Agreement completely replaces older versions of this Agreement. If there is any conflict between this Agreement and any other rules or instructions posted by CRYTEK, such other rules or instructions shall prevail. <br><br>Applicable provisions in your agreements with the providers of the platform for which you purchased HUNT: SHOWDOWN 1896 (e.g. Microsoft, Sony) shall remain unaffected. <br><br>b. Remedies. This Agreement is not intended to confer and does not confer any rights or remedies upon any person other than the parties to this Agreement. <br><br>c. Transfer of Rights. CRYTEK shall be entitled to transfer any rights and obligations under this Agreement or the whole Agreement to third parties. Licensee shall not transfer any rights and obligations under this Agreement without CRYTEK 's prior written approval. <br><br>d. Severability. If any part of this Agreement is held invalid or unenforceable, CRYTEK and Licensee will work together in good faith to replace the invalid provision with a valid provision that comes closest to the economic purpose of the invalid provision. The remaining provisions of this Agreement shall not be affected. <br><br>e. Waiver. The failure of CRYTEK to exercise or enforce any right or provision of this Agreement will not constitute waiver of such right or provision. Any waiver of any provision of this Agreement will be effective only if in a writing signed by CRYTEK. <br><br>f. CRYTEK provides you this Agreement in all languages it is localized. Since it cannot be fully ruled out that there might be a discrepancy in the meaning of certain terms, in case of such discrepancies the English version shall prevail.<br>g. Governing Law and Jurisdiction. (i) The laws of Germany, excluding its conflicts-of-law rules, govern this Agreement; This choice of law, however, does not deprive you of the protection afforded to you by provisions that cannot be derogated from by agreement by virtue of the law which, in the absence of choice, would have been applicable. (ii) If CRYTEK is the defendant the parties expressively agree on the exclusive jurisdiction of the courts of Frankfurt a. M./Germany. This Agreement on jurisdiction applies to all claims, be they based on contract, on tort or on any other legal basis, arising under or in connection with this agreement. In all other cases, the place of jurisdiction shall be determined in accordance with the general rules. <br><br>h. CRYTEK's licensors/ providers of the platform (e.g. Microsoft or Sony) shall be third-party beneficiaries under this Agreement and shall have the express right to enforce its provisions and to enjoy the benefits of its protections. <br><br>i. HUNT: SHOWDOWN 1896 may include third party code provided under different license. Please check the credits for further information. <br><br>j. Amendments of this Agreement.<br>(i) Amendments of this Agreement shall become effective upon active acceptance by the Licensee or as described as follows: <br>(ii) CRYTEK reserves the right to amend this Agreement in case that this becomes necessary due to the further development of HUNT: SHOWDOWN 1896 or because new functionalities will be implemented. <br>(iii) CRYTEK will notify you of the modified terms before they will enter into force.<br>(iv) At the same time, CRYTEK will grant you an adequate period of at least six weeks to terminate the Agreement, in case that you do not agree with the modified Agreement. Please note that after such termination you are no longer entitled to use HUNT: SHOWDOWN 1896. <br>(v) If you do not terminate the Agreement within the aforementioned period, the modified terms shall apply as of the planned date specified in the notification described above. Your continued use of the video game HUNT:SHOWDOWN 1896 will demonstrate your acceptance of the amended any new version of this Agreement. <br><br>k. The European Commission provides a platform to facilitate the independent and out-of-court resolution of

                Instead of Section 10 ""Limitation of CRYTEK's Liability"" the following shall apply: <br>i. All liability of CRYTEK,

La Sezione 13 ("Violazione del Contratto") non si applica. <br><br>d. La Sezione 14c. si applica come segue: <br>Trasferimento dei diritti. CRYTEK avrà la facoltà di trasferire qualsiasi diritto e obbligazione derivante dal presente Contratto o l'intero Contratto alle proprie affiliate o a terze parti. In tal caso, il Licenziatario avrà il diritto di risolvere il Contratto. Il Licenziatario non potrà trasferire alcun diritto e obbligazione derivante dal presente Contratto senza la preventiva approvazione scritta di CRYTEK; questa disposizione non si applica alle pretese di natura pecuniaria o nel caso

Easy Anti-Cheat dispone di un software client ("Client") integrato
                 in 
                connection with the supply of digital products (Sections 327 et seq. German Civil Code (BGB), CRYTEK is not liable for the compensation of damages. <br>iii. CRYTEK is liable

Instead of Section 11 (“Licensee's Warranties and Indemnification”) the following shall apply: <br>Licensee warrants and represents that: <br>a) Licensee has full legal rights and authority to enter into and become bound by the terms of this Agreement; <br>b) Licensee has full legal rights and authority to exercise Licensee's rights granted herein and to comply with Licensee's obligations hereunder. <br><br>c. Section 13 (“Breach of the Agreement”) shall not apply. <br><br>d. Section 14 c. shall apply as follows: <br><br>Transfer of Rights. CRYTEK shall be entitled to transfer any rights and obligations under this Agreement or the whole Agreement to its affiliates or third parties. In this case, Licensee shall have the right to terminate the Agreement. Licensee shall not transfer any rights and obligations under this Agreement without CRYTEK's prior written approval; this does not apply to any money-related claims or if the Licensee has any interest worthy of protection in the exclusion of assignment or their legitimate interests in the assignability of the right outweigh CRYTEK’s interest worthy of protection in the exclusion of assignment.<br>16.

                is using Easy Anti-Cheat anti-cheat service (“Easy Anti-Cheat“), which is operated by a third-party service provider offering services to Publisher. Easy Anti-Cheat has a client software (“Client”) that is integrated into HUNT: SHOWDOWN 1896. When you start a new game session the Client will automatically load and install its latest version to your computer. When you are using HUNT: SHOWDOWN 1896 on your computer Easy Anti-Cheat is monitoring the computer, analysing HUNT: SHOWDOWN 1896's binaries and scanning the memory of the computer for the purpose of detecting and preventing cheating in the HUNT: SHOWDOWN 1896 (“Purpose""). For the Purpose Easy Anti-Cheat is storing information regarding cheating methods used in the HUNT: SHOWDOWN 1896 (“Data""). By installing, copying, or otherwise using HUNT: SHOWDOWN 1896, you give your consent that Easy Anti-Cheat may gather, store, share and publish Data for the sole purpose of the Purpose. The Data will be used solely for the Purpose including but not limited to identifying and banning players who are cheating in computer games, analysing cheating behaviour and cheating codes as well as sharing data about cheats with affiliates of Easy Anti-Cheat.
