Réserve de droits<br><br>CRYTEK (ou ses concédants de licence, le cas échéant) se réserve expressément tous les droits non accordés dans le présent Contrat. Vous ne recevez aucun droit ou licence en vertu des présentes pour copier, distribuer, exécuter publiquement, afficher ou faire tout autre usage de HUNT: SHOWDOWN 1896, ou de tout élément de celui-ci, ou des marques CRYTEK, HUNT: SHOWDOWN, HUNT: SHOWDOWN 1896, CRYENGINE ou de toute autre marque de CRYTEK ou de toute autre société.<br>5. Restrictions d’utilisation du logiciel<br><br>Toute utilisation par le Titulaire de la licence de HUNT: SHOWDOWN 1896 n’étant expressément autorisée à l’article 2 ci-dessus est expressément interdite et toute utilisation non autorisée constitue une violation substantielle du présent Contrat par le Titulaire de la licence. <br><br>Cette interdiction inclut (sans toutefois s’y limiter) : <br>- copier, reproduire, fabriquer ou distribuer (gratuitement ou non) HUNT: SHOWDOWN 1896, en tout ou en partie, sur quelque support que ce soit ; <br>- transférer, vendre, concéder en sous-licence ou louer tout droit relatif à HUNT: SHOWDOWN 1896 à des tiers ; <br>- utiliser HUNT: SHOWDOWN 1896 de manière contraire à la législation applicable ; <br>- créer une œuvre dérivée ou modifier HUNT: SHOWDOWN 1896 – y compris, sans toutefois s’y limiter, créer, développer, distribuer ou utiliser tout programme logiciel non autorisé (« cheats », « hacks », etc.) pour obtenir un avantage dans n’importe quel mode de jeu ou pour exécuter ou utiliser des méthodes qui interfèrent avec le résultat et/ou le déroulement de la partie de HUNT: SHOWDOWN 1896 y compris les cheats, bots, scripts, etc.) ; <br>- décompiler, faire de l’ingénierie inverse ou désassembler HUNT: SHOWDOWN 1896. <br>Le Titulaire de la licence ne doit pas modifier ou supprimer les mentions légales, telles que les mentions de marque déposée et de droits d’auteur, apposées par CRYTEK sur ou à l’intérieur de HUNT: SHOWDOWN 1896. <br><br>6. Grant of Limited License<br><br>Subject to your agreement to, and full compliance with, the terms and provisions of this Agreement, CRYTEK hereby grants to Licensee a limited, personal, revocable, non-transferable and non-exclusive right (the “License”) during the Term, as defined below, to use HUNT: SHOWDOWN

                in accordance with the instructions provided in the manual or on the packaging of HUNT: SHOWDOWN 1896 or indicated otherwise. Unless set forth otherwise in the manual or on the packaging or otherwise indicated to you are allowed to install and use HUNT: SHOWDOWN 1896 on one (1) device at the same time only. <br><br>3. Intellectual Property Rights<br><br>HUNT: SHOWDOWN 1896 is licensed, not sold. HUNT: SHOWDOWN 1896 and all copyrights, trademarks, and all other intellectual property rights related thereto are owned by CRYTEK (or its licensors, as applicable) and are protected by German and international copyright law and other applicable law. Licensee shall have no ownership or intellectual property rights in or to HUNT: SHOWDOWN 1896, including, without limitation, all copyrights related thereto. <br><br>4. Reservation of Rights<br><br>CRYTEK (or its licensors, as applicable) expressly reserves all rights not granted in this Agreement. You are not receiving any right or license hereunder to copy, distribute, publicly perform, display or make any other use of the HUNT: SHOWDOWN 1896, or any element thereof, or the trademarks CRYTEK, HUNT: SHOWDOWN, HUNT: SHOWDOWN 1896, CRYENGINE, or any other trademark of CRYTEK or any other company.<br>5. Software Use Restrictions<br><br>Any use by Licensee of HUNT: SHOWDOWN 1896 not expressly permitted in Section 2 above is expressly prohibited and any such unauthorized use shall constitute a material breach of this Agreement by Licensee. <br><br>This prohibition includes (but is not limited to): <br>- to copy, reproduce, manufacture or distribute (free of charge or otherwise) HUNT: SHOWDOWN 1896, in whole or in part, in any media; <br>- to transfer, sell, sublicense or lease any rights in and to HUNT: SHOWDOWN 1896 to third parties; <br>- to use HUNT: SHOWDOWN 1896 contrary to applicable law; <br>- to create any derived work or to modify HUNT: SHOWDOWN 1896 - – including but not limited to create, develop, distribute, or use any unauthorized software programs (“cheats”, “hacks”, etc.) to gain any advantage in any game mode or to run or use methods which interfere with the outcome and/or the course of the gameplay of HUNT: SHOWDOWN 1896 including cheats, bots, scripts, etc.); <br>- to decompile, reverse engineer or disassemble HUNT: SHOWDOWN 1896. <br>Licensee shall not alter or remove any legal notices, such as trademark and copyright notices, affixed by CRYTEK on or within HUNT: SHOWDOWN 1896. <br><br>6. Digital Rights Management (DRM)<br><br>HUNT: SHOWDOWN 1896 may use DRM systems as indicated on the packaging or during the download process or otherwise (e.g. provided by Steam). Please check the terms and requirements of such DRM systems carefully before buying, installing or downloading HUNT: SHOWDOWN 1896 (e.g. on

LES SERVICES/JEUX VIDÉO DE CRYTEK, LES LOGICIELS DE CRYTEK, LES PRODUITS DE CRYTEK ET LES SERVICES ET PRODUITS DE TIERS SONT FOURNIS « EN L’ÉTAT » ET « TELS QUE DISPONIBLES » POUR VOTRE UTILISATION, SANS GARANTIE D’AUCUNE SORTE, QU’ELLE SOIT EXPRESSE OU IMPLICITE, SAUF SI CES GARANTIES NE PEUVENT ÊTRE EXCLUES EN VERTU DE LA LOI. CRYTEK FOURNIT LES SERVICES/JEUX VIDÉO DE CRYTEK SUR UNE BASE COMMERCIALEMENT RAISONNABLE ET NE GARANTIT PAS QUE VOUS POURREZ ACCÉDER OU UTILISER LES SERVICES/JEUX VIDÉO DE CRYTEK AU MOMENT OU À L’ENDROIT DE VOTRE CHOIX, OU QUE CRYTEK AURA UNE CAPACITÉ ADÉQUATE POUR LES SERVICES/JEUX VIDÉO DE CRYTEK DANS LEUR ENSEMBLE OU DANS TOUTE ZONE GÉOGRAPHIQUE SPÉCIFIQUE.<br>10.                 <br><br>Termination in accordance with this Agreement shall not create any liability against

EN AUCUN CAS, LA RESPONSABILITÉ DE CRYTEK ET DE SES AFFILIÉS, DES CONCÉDANTS DE LICENCE DE CRYTEK ET DE LEURS AFFILIÉS, DE VOS CONCÉDANTS DE LICENCE ET DE LEURS AFFILIÉS OU DE LEURS EMPLOYÉS, DIRIGEANTS OU ADMINISTRATEURS RESPECTIFS (COLLECTIVEMENT, LES « AFFILIÉS DE CRYTEK ») ENVERS VOUS NE DÉPASSERA LE MONTANT QUE VOUS AVEZ PAYÉ À CRYTEK POUR LES SERVICES/JEUX VIDÉO DE CRYTEK ET/OU LES LOGICIELS/JEUX VIDÉO DE CRYTEK. EN AUCUN CAS CRYTEK ET SES AFFILIÉS, LES CONCÉDANTS DE LICENCE DE CRYTEK ET LEURS AFFILIÉS, VOS CONCÉDANTS DE LICENCE ET LEURS AFFILIÉS NE SERONT RESPONSABLES DES DOMMAGES ACCESSOIRES OU INDIRECTS RÉSULTANT DE VOTRE UTILISATION DES SERVICES/JEUX VIDÉO DE CRYTEK, DES LOGICIELS DE JEUX VIDÉO DE CRYTEK, D’INTERNET OU DE TOUTE AUTRE RÉCLAMATION LIÉE DE QUELQUE MANIÈRE QUE CE SOIT À VOTRE UTILISATION DES SERVICES/JEUX VIDÉO, DES LOGICIELS DE CRYTEK OU DES COMPTES CRYTEK. CERTAINS ÉTATS OU JURIDICTIONS N’AUTORISANT PAS L’EXCLUSION OU LA LIMITATION DE LA RESPONSABILITÉ POUR LES DOMMAGES CONSÉCUTIFS OU ACCESSOIRES, DANS DE TELS ÉTATS OU JURIDICTIONS, LA RESPONSABILITÉ DE CRYTEK ET DE SES AFFILIÉS, DES CONCÉDANTS DE LICENCE DE CRYTEK ET DE LEURS AFFILIÉS, DE VOS CONCÉDANTS DE LICENCE ET DE LEURS AFFILIÉS SERA LIMITÉE DANS TOUTE LA MESURE PERMISE PAR LA LOI. CRYTEK N’APPROUVE PAS OU NE GARANTIT PAS LES PRODUITS OU

Garanties et indemnisation du Titulaire de la licence<br><br>Le Titulaire de la licence garantit et déclare que : <br>a) Le Titulaire de la licence dispose de tous les droits légaux et de l’autorité nécessaire pour conclure le présent Contrat et être lié par ses conditions ; <br>b) Le Titulaire de la licence dispose de tous les droits légaux et de l’autorité nécessaire pour exercer les droits qui lui sont conférés aux présentes et pour se conformer aux obligations qui lui incombent en vertu des présentes ; <br>c) Le Titulaire de la licence se conformera, à tout moment pendant la durée de la licence, à toutes les lois applicables. <br><br>Le Titulaire de la licence accepte par la présente d’indemniser, de défendre et de dégager de toute responsabilité

                SOFTWARE, CRYTEK’S PRODUCTS AND THIRD-PARTY SERVICES AND PRODUCTS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS FOR YOUR USE, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, UNLESS SUCH WARRANTIES ARE LEGALLY INCAPABLE OF EXCLUSION.

In the event that a Modification negatively impacts your access to or usage of HUNT: SHOWDOWN 1896 in a more than just minor way (the “Negative Modification”), CRYTEK will undertake to notify you 8 weeks upfront and inform you about the respective Negative Modification, its date and your rights described below. <br><br>e. In the event of a Negative Modification, you have the right to terminate the Agreement within 30 days at no costs upon receipt of the notification. The period to terminate the Agreement begins to run from the date on which you have received the notification, or when the Modification is made, whichever is later. You do not have a right to terminate the Agreement if you still can access and use HUNT: SHOWDOWN 1896 without additional costs.<br>13. Breach of the Agreement<br><br>In the event of a breach of this Agreement by CRYTEK, Licensee's sole remedy shall be to terminate this Agreement by delivering written notice of termination to CRYTEK. <br><br>In the event of a breach by Licensee of this Agreement, CRYTEK (and its licensors, as applicable) may pursue all remedies to which CRYTEK is entitled under applicable law and/or this Agreement, including without limitation the compensation for any and all damages which may arise in connection with such breach. <br><br>Licensee agrees that Licensee's unauthorized use of HUNT: SHOWDOWN 1896, or any part thereof, may immediately and irreparably damage CRYTEK such that CRYTEK could not be adequately compensated by a monetary award, and in such event, and at CRYTEK's option, CRYTEK shall be entitled to an injunctive order, in addition to all other remedies available including a monetary award, to prohibit such unauthorized use, without the necessity of CRYTEK posting bond or other security. <br><br>14. General Provisions<br><br>a. Entire Agreement: This Agreement (including the Privacy Policy, Code of Conduct, manual and other supplemental terms provided by CRYTEK and any posted rules or instructions regarding HUNT: SHOWDOWN 1896) constitute the entire agreement between you and CRYTEK relating to your rights and obligations in the use of HUNT: SHOWDOWN 1896. This Agreement completely replaces older versions of this Agreement. If there is any conflict between this Agreement and any other rules or instructions posted by CRYTEK, such other rules or instructions shall prevail. <br><br>Applicable provisions in your agreements with the providers of the platform for which you purchased HUNT: SHOWDOWN 1896 (e.g. Microsoft, Sony) shall remain unaffected. <br><br>b. Remedies. This Agreement is not intended to confer and does not confer any rights or remedies upon any person other than the parties to this Agreement. <br><br>c. Transfer of Rights. CRYTEK shall be entitled to transfer any rights and obligations under this Agreement or the whole Agreement to third parties. Licensee shall not transfer any rights and obligations under this Agreement without CRYTEK 's prior written approval. <br><br>d. Severability. If any part of this Agreement is held invalid or unenforceable, CRYTEK and Licensee will work together in good faith to replace the invalid provision with a valid provision that comes closest to the economic purpose of the invalid provision. The remaining provisions of this Agreement shall not be affected. <br><br>e. Waiver. The failure of CRYTEK to exercise or enforce any right or provision of this Agreement will not constitute waiver of such right or provision. Any waiver of any provision of this Agreement will be effective only if in a writing signed by CRYTEK. <br><br>f. CRYTEK provides you this Agreement in all languages it is localized. Since it cannot be fully ruled out that there might be a discrepancy in the meaning of certain terms, in case of such discrepancies the English
