Concessão de Licença Limitada<br><br>Sujeito à sua concordância e total conformidade com os termos e disposições deste Contrato, a CRYTEK concede ao Licenciado o direito limitado, pessoal, revogável, intransferível e não exclusivo (a “Licença”) durante a Vigência, conforme definida abaixo, para usar o HUNT: SHOWDOWN 1896 de acordo com as instruções apresentadas no manual ou na embalagem

Direitos de Propriedade Intelectual<br><br>O HUNT: SHOWDOWN 1896 é licenciado, não vendido. O HUNT: SHOWDOWN 1896 e todos os direitos autorais, marcas registradas e todos os demais direitos de propriedade intelectual relacionados a eles são de propriedade da CRYTEK (ou dos seus licenciadores, conforme aplicável) e estão protegidos pelas leis de direitos autorais alemãs e internacionais e outras leis aplicáveis. O Licenciado não terá direitos de propriedade ou de propriedade intelectual sobre ou relativos ao HUNT: SHOWDOWN 1896, inclusive, entre outros, todos os direitos autorais relacionados a ele. <br><br>4. Reserva de direitos<br><br>A CRYTEK (ou os seus licenciadores, conforme aplicável) reserva-se expressamente todos os direitos não concedidos neste Contrato. Você não está recebendo nenhum direito ou licença para copiar, distribuir, executar publicamente, exibir ou fazer qualquer outro uso do HUNT: SHOWDOWN 1896, de qualquer elemento dele ou as marcas registradas CRYTEK, HUNT: SHOWDOWN, HUNT: SHOWDOWN 1896, CRYENGINE ou outras marcas registradas da CRYTEK ou de qualquer outra empresa.<br>5. Restrições de uso do software<br><br>Qualquer uso pelo Licenciado do HUNT: SHOWDOWN 1896 não expressamente permitido na Seção 2 acima é expressamente proibido e qualquer uso não autorizado constituirá violação relevante deste Contrato por parte do Licenciado. <br><br>Essa proibição inclui (entre outras): <br>• copiar, reproduzir, produzir ou distribuir (gratuitamente ou de outra forma) o HUNT: SHOWDOWN 1896, total ou parcialmente, em qualquer mídia; <br>• transferir, vender, sublicenciar ou arrendar direitos sobre e com relação ao HUNT: SHOWDOWN 1896 para terceiros; <br>• usar o HUNT: SHOWDOWN 1896 contrariamente à legislação aplicável; <br>• criar trabalhos derivados ou modificar o HUNT: SHOWDOWN 1896 - – inclusive, por exemplo, criar, desenvolver, distribuir ou usar programas de software não autorizados (“cheats”, “hacks” etc.) para obter vantagens em qualquer modo de jogo ou para executar ou usar métodos que interfiram com o resultado e/ou curso de jogo do HUNT: SHOWDOWN 1896 inclusive cheats, bots, scripts etc.); <br>• descompilar, fazer engenharia reversa ou desmantar o HUNT: SHOWDOWN

                2. Grant of Limited License<br><br>Subject to your agreement to, and full compliance with, the terms and provisions of this Agreement,

Intellectual Property Rights<br><br>HUNT: SHOWDOWN 1896 is licensed, not sold. HUNT: SHOWDOWN 1896 and all copyrights, trademarks, and all other intellectual property rights related thereto are owned by CRYTEK (or its licensors, as applicable) and are protected by German and international copyright law and other applicable law. Licensee shall have no ownership or intellectual property rights in or to HUNT: SHOWDOWN 1896, including, without limitation, all copyrights related thereto. <br><br>4. Reservation of Rights<br><br>CRYTEK (or its licensors, as applicable) expressly reserves all rights not granted in this Agreement. You are not receiving any right or license hereunder to copy, distribute, publicly perform, display or make any other use of the HUNT: SHOWDOWN 1896, or any element thereof, or the trademarks CRYTEK, HUNT: SHOWDOWN, HUNT: SHOWDOWN 1896, CRYENGINE, or any other trademark of CRYTEK or any other company.<br>5. Software Use Restrictions<br><br>Any use by Licensee of HUNT: SHOWDOWN 1896 not expressly permitted in Section 2 above is expressly prohibited and any such unauthorized use shall constitute a material breach of this Agreement by Licensee. <br><br>This prohibition includes (but is not limited to): <br>- to copy, reproduce, manufacture or distribute (free of charge or otherwise) HUNT: SHOWDOWN 1896, in whole or in part, in any media; <br>- to transfer, sell, sublicense or lease any rights in and to HUNT: SHOWDOWN 1896 to third parties; <br>- to use HUNT: SHOWDOWN 1896 contrary to applicable law; <br>- to create any derived work or to modify HUNT: SHOWDOWN 1896 - – including but not limited to create, develop, distribute, or use any unauthorized software programs (“cheats”, “hacks”, etc.) to gain any advantage in any game mode or to run or use methods which interfere with the outcome and/or the course of the gameplay of HUNT: SHOWDOWN 1896 including cheats, bots, scripts, etc.); <br>- to decompile, reverse engineer or disassemble HUNT: SHOWDOWN 1896. <br>Licensee shall not alter or remove any legal notices, such as trademark and copyright notices, affixed by CRYTEK on or within HUNT: SHOWDOWN 1896. <br><br>6. Digital Rights Management (DRM)<br><br>HUNT: SHOWDOWN 1896 may use DRM systems as indicated on the packaging or during the download process or otherwise (e.g. provided by Steam). Please check the terms and requirements of such DRM systems carefully before buying, installing or downloading HUNT: SHOWDOWN 1896 (e.g. on

                Caso não concorde com esses termos e requisitos, você não tem permissão para usar o HUNT: SHOWDOWN 1896 de qualquer forma. <br><br>7. Suporte<br><br>A CRYTEK e os provedores da plataforma (por exemplo, Microsoft, Sony) ou suas respectivas afiliadas não estarão obrigadas a prestar suporte ao HUNT: SHOWDOWN 1896. Qualquer suporte prestado pela CRYTEK está sujeito a seu exclusivo critério e poderá ser encerrado a qualquer momento.<br>8. Vigência e rescisão<br><br>A vigência deste Contrato e a licença aqui concedida começam a partir da data em que você baixar, instalar, carregar ou de outra forma usar pela primeira vez o HUNT: SHOWDOWN 1896 e continuarão perpetuamente até serem rescindidas em conformidade com este Contrato. <br><br>A CRYTEK reserva-se o direito de encerrar os recursos on-line
                 do

                ao Licenciado, em caso de descumprimento ou violação pelo Licenciado das restrições de uso do software mencionadas na Seção 5 (“Restrições de Uso do Software”) deste Contrato.<br><br>Por ocasião da rescisão ou expiração deste Contrato, todos e quaisquer direitos do Licenciado nos termos deste instrumento serão rescindidos sem prejuízo de direitos ou reivindicações e o Licenciado não terá o direito de usar o HUNT: SHOWDOWN 1896 de qualquer forma. O Licenciado destruirá imediatamente todas as cópias do HUNT: SHOWDOWN 1896 em sua posse, custódia ou controle, e todos os direitos aqui concedidos reverterão, sem notificação, e serão atribuídos à CRYTEK. <br><br>A rescisão em conformidade com este Contrato não criará responsabilidade contra a CRYTEK e não isentará o Licenciado de qualquer responsabilidade que surja antes da rescisão. As disposições deste Contrato que, por seus termos ou sentido, se destinem a subsistir subsistirão ao cancelamento, expiração ou rescisão deste Contrato. <br><br>9. Limitação da garantia da CRYTEK<br><br>NA MEDIDA MÁXIMA PERMITIDA PELA LEGISLAÇÃO APLICÁVEL, VOCÊ CONCORDA EXPRESSAMENTE QUE O USO DOS SERVIÇOS/JOGOS DE VÍDEO CRYTEK, DO SOFTWARE CRYTEK E DA INTERNET É POR SUA CONTA E RISCO. SERVIÇOS/JOGOS DE VÍDEO CRYTEK, SOFTWARE CRYTEK, PRODUTOS CRYTEK E SERVIÇOS E PRODUTOS DE TERCEIROS SÃO PROVIDOS “NO ESTADO” E “CONFORME DISPONÍVEIS” PARA O SEU USO, SEM GARANTIAS DE QUALQUER TIPO, EXPRESSAS OU IMPLÍCITAS, A MENOS QUE TAIS GARANTIAS NÃO POSSAM SER EXCLUÍDAS LEGALMENTE. A CRYTEK PROVÊ SERVIÇOS/JOGOS DE VÍDEO DA CRYTEK EM BASE COMERCIALMENTE RAZOÁVEL E NÃO GARANTE QUE VOCÊ PODERÁ ACESSAR OU USAR SERVIÇOS/JOGOS DE VÍDEO DA CRYTEK EM HORÁRIOS OU LOCAIS DE SUA ESCOLHA, OU QUE A CRYTEK TERÁ CAPACIDADE ADEQUADA PARA SERVIÇOS/JOGOS DE VÍDEO DA CRYTEK COMO UM TODO OU EM QUALQUER ÁREA GEOGRÁFICA ESPECÍFICA.<br>10. Limitação de responsabilidade da CRYTEK<br><br>NA MÁXIMA MEDIDA PERMITIDA PELA LEGISLAÇÃO APLICÁVEL, VOCÊ RECONHECE E CONCORDA QUE O SEU ÚNICO E EXCLUSIVO RECURSO PARA QUALQUER CONTROVÉRSIA COM A CRYTEK E/OU SUAS AFILIADAS, LICENCIADORES DA CRYTEK E/OU SUAS AFILIADAS, SEUS LICENCIADORES E/OU SUAS AFILIADAS OU SEUS LICENCIADORES É PARAR DE USAR OS SERVIÇOS/JOGOS DE VÍDEO DA CRYTEK E CANCELAR A SUA CONTA DA CRYTEK. VOCÊ RECONHECE E CONCORDA QUE A CRYTEK E SUAS AFILIADAS, OS LICENCIADORES DA CRYTEK E SUAS AFILIADAS, SEUS LICENCIADORES E SUAS AFILIADAS NÃO SÃO RESPONSÁVEIS POR ATOS OU FALHAS DE ATUAÇÃO DELES OU DE OUTRAS PESSOAS COM RELAÇÃO À CONDUTA, COMUNICAÇÃO OU CONTEÚDO NOS SERVIÇOS/JOGOS DE VÍDEO DA CRYTEK OU AO USO DO SOFTWARE DA CRYTEK. EM NENHUM CASO A RESPONSABILIDADE DA CRYTEK E SUAS AFILIADAS, OS LICENCIADORES DA CRYTEK E SUAS AFILIADAS, SEUS LICENCIADORES E SUAS AFILIADAS OU SEUS RESPECTIVOS FUNCIONÁRIOS, DIRETORES OU CONSELHEIROS (COLETIVAMENTE, “AFILIADAS DA CRYTEK”) EXCEDERÁ O VALOR QUE TENHA PAGADO À CRYTEK POR SERVIÇOS/JOGOS DE VÍDEO DA CRYTEK E/OU SOFTWARES DA CRYTEK. EM NENHUM CASO A CRYTEK E SUAS AFILIADAS, OS LICENCIADORES DA CRYTEK E SUAS AFILIADAS, SEUS LICENCIADORES E SUAS AFILIADAS SERÃO RESPONSÁVEIS POR DANOS INCIDENTAIS OU CONSEQUENCIAIS DECORRENTES DO SEU USO DOS SERVIÇOSJOGOS DE VÍDEO DA CRYTEK, DOS SOFTWARES DA CRYTEK, DA INTERNET OU POR OUTRAS RECLAMAÇÕES RELACIONADAS A QUALQUER MANEIRA DE USAR OS SERVIÇOS/JOGOS DE VÍDEO, SOFTWARES OU CONTAS DA CRYTEK. UMA VEZ QUE ALGUNS ESTADOS OU JURISDIÇÕES NÃO PERMITEM A EXCLUSÃO OU LIMITAÇÃO DE RESPONSABILIDADE POR DANOS CONSEQUENCIAIS OU INCIDENTAIS, EM TAIS ESTADOS OU JURISDIÇÕES A RESPONSABILIDADE DA CRYTEK E SUAS AFILIADAS, DOS LICENCIADORES DA CRYTEK E SUAS AFILIADAS, A RESPONSABILIDADE DOS SEUS LICENCIADORES E SUAS AFILIADAS SERÁ LIMITADA À MÁXIMA MEDIDA PERMITIDA POR LEI. A CRYTEK NÃO ENDOSSA NEM GARANTE QUALQUER PRODUTO OU SERVIÇO DE TERCEIROS OFERECIDO POR MEIO DA CRYTEK E NÃO SERÁ PARTE OU DE QUALQUER FORMA RESPONSÁVEL POR MONITORAR TRANSAÇÕES ENTRE VOCÊ E TERCEIROS FORNECEDORES DE PRODUTOS OU PROVEDORES SERVIÇOS.<br><br>Não obstante o acima exposto, nada contido neste Contrato limita a responsabilidade da CRYTEK perante você por declarações falsas fraudulentas, morte ou danos pessoais causados por negligência da CRYTEK, ou qualquer outra responsabilidade na medida em que tal responsabilidade não possa ser excluída ou limitada por uma questão de legislação aplicável. <br><br>11. Garantias e indenidade do Licenciado<br><br>O Licenciado garante e declara que: <br>a) O Licenciado tem plenos direitos e autoridade legais para celebrar e obrigar-se aos termos deste Contrato; <br>b) O Licenciado tem plenos direitos e autoridade legais para exercer os direitos do Licenciado aqui concedidos e cumprir as obrigações do Licenciado ao amparo deste instrumento; <br>c) O Licenciado cumprirá, em todos os momentos durante a Vigência, todas as leis aplicáveis. <br><br>O Licenciado por este meio concorda em indenizar, defender e isentar a CRYTEK e/ou seus sucessores, cessionários, diretores, conselheiros, funcionários, agentes, representantes e licenciados (mas não incluindo o Licenciado) de e contra todos os danos, reclamações, perdas, causas de ação e ações judiciais decorrentes e/ou relacionadas a violação deste Contrato por parte do Licenciado.<br>12. Modificações do HUNT: SHOWDOWN 1896 (aplicável somente se você comprar o HUNT: SHOWDOWN 1896 da CRYTEK; não se aplicam caso você tenha comprado o HUNT:SHOWDOWN 1896 de uma loja ou plataforma etc. e a CRYTEK não seja o seu parceiro contratual)<br><br>a. Você reconhece que o HUNT: SHOWDOWN 1896 é um “jogo de serviço ao vivo”. Isso significa que o HUNT: SHOWDOWN 1896 e seu conteúdo, modo de jogo etc. estão em desenvolvimento constante. Isso também inclui alterações no nome do HUNT: SHOWDOWN 1896. As alterações mencionadas acima não afetam a versão então em vigor deste Contrato. Esses “desenvolvimentos de jogos de serviços ao vivo” típicos são, portanto, um pré-requisito do jogo, elementar para o HUNT: SHOWDOWN 1896 e não são considerados “Modificações” conforme estabelecido abaixo nesta Seção 12. <br><br>b. Além disso, a CRYTEK reserva-se o direito de modificar o HUNT: SHOWDOWN 1896 por um bom motivo (por exemplo, adicionando ou excluindo recursos) além do necessário para manter o HUNT: SHOWDOWN 1896 em conformidade com o Contrato. Tal bom motivo inclui, entre outros, modificações: (i) para cumprir a legislação ou jurisprudência aplicáveis; (ii) para fazer valer ordens judiciais ou outras ordens oficiais; (iii) para se adaptar a requisitos técnicos alterados, (iv) para se ajustar a condições de mercado alteradas, como, por exemplo, aumento do número de usuários; (v) causadas por violação de direitos de terceiros; (vi) causadas por rescisão de licenças de terceiros e/ou modificações de tais termos de licença de terceiros que sejam necessárias para disponibilizar o HUNT:SHOWDOWN 1896; (vii) causadas por eventos de inadimplência de prestadores de serviços terceirizados; ou (viii) em benefício de todos os jogadores do HUNT:SHOWDOWN 1896 (as “Modificações”). <br><br>c. Tais Modificações não têm nenhum custo para você. A CRYTEK notificará os usuários do HUNT: SHOWDOWN 1896 sobre tais Modificações de forma clara e compreensível. <br><br>d. Caso uma Modificação afete negativamente o seu acesso ou uso do HUNT: SHOWDOWN 1896 de uma forma mais do que apenas secundária (a “Modificação Negativa”), a CRYTEK compromete-se a notificá-lo com oito semanas de antecedência e informá-lo sobre a respectiva Modificação Negativa, sua data e os seus direitos descritos abaixo. <br><br>e. No caso de uma Modificação Negativa, você tem o direito de rescindir o Contrato no prazo de 30 dias, sem custos, após o recebimento da notificação. O prazo para rescindir o Contrato começa a contar a partir da data em que você tenha recebido a notificação ou quando a Modificação for feita, o que ocorrer posteriormente. Você não tem o direito de rescindir o Contrato se ainda puder acessar e usar o HUNT: SHOWDOWN 1896 sem custos adicionais.<br>13. Violação do Contrato<br><br>Em caso de violação deste Contrato pela CRYTEK, o único recurso do Licenciado será rescindir o Contrato, enviando uma notificação de rescisão por escrito à CRYTEK. <br><br>Em caso de violação deste Contrato pelo Licenciado, a CRYTEK (e seus licenciantes, conforme aplicável) poderá recorrer a todos os recursos aos quais tenha direito ao amparo da legislação da aplicável e/ou deste Contrato, inclusive, entre outros, compensação por todos e quaisquer danos que possam surgir em conexão com tal violação. <br><br>O Licenciado concorda que o seu uso não autorizado do HUNT: SHOWDOWN 1896, ou qualquer parte dele, pode prejudicar imediata e irreparavelmente a CRYTEK de tal forma que a CRYTEK não possa ser compensada adequadamente por uma adjudicação monetária e nesse caso, e a critério da CRYTEK, esta terá direito a uma medida liminar, além de todos os demais recursos disponíveis, inclusive uma adjudicação monetária, para proibir tal uso não autorizado, sem necessidade de a CRYTEK depositar fiança ou outra garantia. <br><br>14. Disposições gerais.<br><br>a. Contrato definitivo: Este Contrato (inclusive a Política de Privacidade, Código de Conduta, o manual e outros termos suplementares apresentados pela CRYTEK e as regras ou instruções publicadas sobre o HUNT: SHOWDOWN 1896 constituem o contrato definitivo entre você e a CRYTEK em relação aos seus direitos e obrigações no uso do HUNT: SHOWDOWN 1896. Este Contrato substitui completamente suas versões anteriores. Se houver qualquer conflito entre este Contrato e outras regras ou instruções publicadas pela CRYTEK, tais outras regras ou instruções prevalecerão. <br><br>As disposições aplicáveis nos seus contratos com os provedores da plataforma para a qual você tenha comprado o HUNT: SHOWDOWN 1896 (por exemplo,
                 Microsoft 
                or
                e
                 Sony) 
                or their respective affiliates shall not be obliged to provide any support
                permanecerão inalteradas. <br><br>b. Recursos. Este Contrato não se destina a conferir e não confere direitos ou recursos a qualquer pessoa além das partes contratantes deste instrumento. <br><br>c. Transferência de direitos. A CRYTEK terá o direito de transferir direitos e obrigações ao amparo deste Contrato ou todo o Contrato a terceiros. O Licenciado não transferirá direitos e obrigações ao amparo deste Contrato sem aprovação prévia por escrito da CRYTEK. <br><br>d. Desvinculação. Se qualquer parte deste Contrato

                considerada inválida ou inexequível, a CRYTEK e o Licenciado trabalharão juntos de boa-fé para substituir a disposição inválida por uma disposição válida que mais se aproxime do propósito econômico da disposição inválida. As disposições remanescentes deste Contrato não serão alteradas. <br><br>e. Renúncia. O não exercício ou imposição pela CRYTEK de qualquer direito ou disposição deste Contrato não constituirão renúncia a tal direito ou disposição. Qualquer renúncia disposições deste Contrato vigerá somente se for por escrito e assinada pela CRYTEK. <br><br>f. A CRYTEK fornece este Contrato a você em todos os idiomas em que esteja localizada. Uma vez que não se pode excluir totalmente a possibilidade de haver uma discrepância no significado de determinados termos, em caso de tais discrepâncias a versão em inglês prevalecerá.<br>g. Legislação Aplicável e Jurisdição. (i) As leis da Alemanha regem este Contrato, excluindo as suas regras de conflitos de legislações; essa escolha de legislação, no entanto, não o priva da proteção que lhe é conferida por disposições que não podem ser derrogadas por contrato em virtude da legislação que, na ausência de escolha, teria sido aplicável. (ii) Se a CRYTEK for a ré, as partes concordam expressamente com a jurisdição exclusiva do judiciário de Frankfurt a. M./Alemanha. CRYTEK SERVICES/ VIDEO GAMES, CRYTEK SOFTWARE, CRYTEK’S PRODUCTS AND THIRD-PARTY SERVICES AND PRODUCTS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS FOR YOUR USE, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, UNLESS SUCH WARRANTIES ARE LEGALLY INCAPABLE OF EXCLUSION. IN NO CASE SHALL CRYTEK AND ITS AFFILIATES, CRYTEK’S LICENSORS AND THEIR AFFILIATES, YOUR LICENSORS AND THEIR AFFILIATES BE LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF CRYTEK SERVICES / VIDEO GAMES, CRYTEK SOFTWARE , THE INTERNET OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF CRYTEK SERVICES / VIDEO GAMES, CRYTEK SOFTWARE OR ACCOUNTS. Licensee’s Warranties and Indemnification<br><br>Licensee warrants and represents that: <br>a) Licensee has full legal rights and authority to enter into and become bound by the terms of this Agreement; <br>b) Licensee has full legal rights and authority to exercise Licensee’s rights granted herein and to comply with Licensee’s obligations hereunder; <br>c) Licensee will comply, at all times during the Term, with all applicable laws. <br><br>Licensee hereby agrees to indemnify, defend, and hold harmless CRYTEK and/or their successors, assigns, officers, directors, employees, agents, representatives and licensees (but not including Licensee) from and against all damages, claims, losses, causes of action and lawsuits arising from and/or relating to a breach of this Agreement by Licensee.<br>12. Modifications of HUNT: SHOWDOWN 1896 (only applicable if you purchase HUNT: SHOWDOWN 1896 from CRYTEK; it does not apply if you purchase HUNT: SHOWDOWN 1896 from a store or platform etc. and CRYTEK is not your contractual partner)<br><br>a. You acknowledge that HUNT: SHOWDOWN 1896 is a “live service game”. This means that HUNT: SHOWDOWN 1896 and its content, game mode etc. is under constant development. This also includes a change of the name of HUNT: SHOWDOWN 1896. The aforementioned changes do not affect the then current version of this Agreement. Such typical “live services game developments” are therefore a prerequisite of the game, elementary for HUNT: SHOWDOWN 1896 and not considered “Modifications” as set out below in this Section 12. <br><br>b. Furthermore, CRYTEK reserves the right to modify HUNT: SHOWDOWN 1896 for good reason (e.g. by adding or removing features) beyond what is necessary to maintain HUNT: SHOWDOWN 1896 in conformity with the Agreement. Such good reason includes but is not limited to modifications (i) to comply with applicable law or case-law, (ii) to implement court or other official orders, (iii) to adapt to changed technical requirements, (iv) to adjust to altered market conditions e.g. increased user numbers, (v) caused by infringement of third party rights, (vi) caused by termination of third party licenses and/or modifications of such third party license terms that are necessary to provide HUNT:SHOWDOWN 1896, (vii) caused by default event of third party service providers, or (viii) for the benefit of all players of HUNT:SHOWDOWN 1896 (the “Modifications”). <br><br>c. Such Modifications are at no cost for you. CRYTEK will notify users of HUNT: SHOWDOWN 1896 about such Modifications in a clear and comprehensible manner. <br><br>d. In the event that a Modification negatively impacts your access to or usage of HUNT: SHOWDOWN 1896 in a more than just minor way (the “Negative Modification”), CRYTEK will undertake to notify you 8 weeks upfront and inform you about the respective Negative Modification, its date and your rights described below. <br><br>e. In the event of a Negative Modification, you have the right to terminate the Agreement within 30 days at no costs upon receipt of the notification. The period to terminate the Agreement begins to run from the date on which you have received the notification, or when the Modification is made, whichever is later. You do not have a right to terminate the Agreement if you still can access and use HUNT: SHOWDOWN 1896 without additional costs.<br>13. Breach of the Agreement<br><br>In the event of a breach of this Agreement by CRYTEK, Licensee's sole remedy shall be to terminate this Agreement by delivering written notice of termination to CRYTEK. <br><br>In the event of a breach by Licensee of this Agreement, CRYTEK (and its licensors, as applicable) may pursue all remedies to which CRYTEK is entitled under applicable law and/or this Agreement, including without limitation the compensation for any and all damages which may arise in connection with such breach. <br><br>Licensee agrees that Licensee's unauthorized use of HUNT: SHOWDOWN 1896, or any part thereof, may immediately and irreparably damage CRYTEK such that CRYTEK could not be adequately compensated by a monetary award, and in such event, and at CRYTEK's option, CRYTEK shall be entitled to an injunctive order, in addition to all other remedies available including a monetary award, to prohibit such unauthorized use, without the necessity of CRYTEK posting bond or other security. <br><br>14. General Provisions<br><br>a. Entire Agreement: This Agreement (including the Privacy Policy, Code of Conduct, manual and other supplemental terms provided by CRYTEK and any posted rules or instructions regarding HUNT: SHOWDOWN 1896) constitute the entire agreement between you and CRYTEK relating to your rights and obligations in the use of HUNT: SHOWDOWN 1896. This Agreement completely replaces older versions of this Agreement. If there is any conflict between this Agreement and any other rules or instructions posted by CRYTEK, such other rules or instructions shall prevail. <br><br>Applicable provisions in your agreements with the providers of the platform for which you purchased HUNT: SHOWDOWN 1896 (e.g. Microsoft, Sony) shall remain unaffected. <br><br>b. Remedies. This Agreement is not intended to confer and does not confer any rights or remedies upon any person other than the parties to this Agreement. <br><br>c. Transfer of Rights. CRYTEK shall be entitled to transfer any rights and obligations under this Agreement or the whole Agreement to third parties. Licensee shall not transfer any rights and obligations under this Agreement without CRYTEK 's prior written approval. <br><br>d. Severability. If any part of this Agreement is held invalid or unenforceable, CRYTEK and Licensee will work together in good faith to replace the invalid provision with a valid provision that comes closest to the economic purpose of the invalid provision. The remaining provisions of this Agreement shall not be affected. <br><br>e. Waiver. The failure of CRYTEK to exercise or enforce any right or provision of this Agreement will not constitute waiver of such right or provision. Any waiver of any provision of this Agreement will be effective only if in a writing signed by CRYTEK. <br><br>f. CRYTEK provides you this Agreement in all languages it is localized. Since it cannot be fully ruled out that there might be a discrepancy in the meaning of certain terms, in case of such discrepancies the English version shall prevail.<br>g. Governing Law and Jurisdiction. (i) The laws of Germany, excluding its conflicts-of-law rules, govern this Agreement; This choice of law, however, does not deprive you of the protection afforded to you by provisions that cannot be derogated from by agreement by virtue of the law which, in the absence of choice, would have been applicable. (ii) If CRYTEK is the defendant the parties expressively agree on the exclusive jurisdiction of the courts of Frankfurt a. M./Germany. This Agreement on jurisdiction applies to all claims, be they based on contract, on tort or on any other legal basis, arising under or in connection with this agreement. In all other cases, the place of jurisdiction shall be determined in accordance with the general rules. <br><br>h. CRYTEK's licensors/ providers of the platform (e.g. Microsoft or Sony) shall be third-party beneficiaries under this Agreement and shall have the express right to enforce its provisions and to enjoy the benefits of its protections. <br><br>i. HUNT: SHOWDOWN 1896 may include third party code provided under different license. Please check the credits for further information. <br><br>j. Amendments of this Agreement.<br>(i) Amendments of this Agreement shall become effective upon active acceptance by the Licensee or as described as follows: <br>(ii) CRYTEK reserves the right to amend this Agreement in case that this becomes necessary due to the further development of HUNT: SHOWDOWN 1896 or because new functionalities will be implemented. <br>(iii) CRYTEK will notify you of the modified terms before they will enter into force.<br>(iv) At the same time, CRYTEK will grant you an adequate period of at least six weeks to terminate the Agreement, in case that you do not agree with the modified Agreement. Please note that after such termination you are no longer entitled to use HUNT: SHOWDOWN 1896. <br>(v) If you do not terminate the Agreement within the aforementioned period, the modified terms shall apply as of the planned date specified in the notification described above.
