END USER LICENCE AGREEMENT   

CONTRATO DE LICENCIA PARA EL USUARIO FINAL 

PLEASE READ CAREFULLY 

El presente contrato de licencia para el usuario final («Licencia») es un contrato legal entre usted y Team17 Digital Limited, domiciliada en 3 Red Hall Avenue, Paragon Business Park, Wakefield, Inglaterra, WF1 2UL en relación con los programas de software de los videojuegos de Team17, publicados por Team17 de forma periódica, en sus versiones actuales o futuras, y todos sus complementos, variaciones, paquetes de expansión, contenido virtual, moneda virtual, actualizaciones, mejoras, parches u otras modificaciones realizadas a los programas de software de forma periódica (en conjunto, el «Software»).  

This end user licence agreement ("Licence") is a legal agreement between you and Team17 Digital Limited of 3 Red Hall Avenue, Paragon Business Park, Wakefield, England, WF1 2UL relating to the software programs of Team17's videogames as published by Team17 from time to time, whether existing now or in the future and any add-ons, variations, expansions packs, virtual content, virtual currency, updates, upgrades, patches or other modifications made to the software programs from time to time (collectively referred to as "Software").    

En esta Licencia, «usted» «su», «suyo» hace referencia a usted, el usuario del Software, y «Team17», «nosotros», o «nuestro» hace referencia a nosotros. 

In this Licence you, the user of the Software, are referred to as "you" "your", "yours" and we are referred to as "Team17", "we", "us" or "our".   

Por medio la presente Licencia, Team17 le otorga el uso del Software, el cual no es objeto de venta y seguirá siendo propiedad de Team17 en todo momento.

We licence use of the Software to you on the basis of this Licence. We do not sell the Software to you and we remain the owners of the Software at all times.

IMPORTANT NOTICE TO ALL USERS:  

La presente Licencia rige los términos por los cuales Team17 pone el Software a su disposición y establece su uso permitido. Al descargar o de otro modo acceder al software (ya sea como parte de la creación de una Cuenta (según se define a continuación) o de otra forma y ya sea que se descargue o acceda desde una plataforma de Team17 o la de un tercero), usted confirma que tiene 18 años de edad o más y que ha leído y aceptado los términos de esta Licencia, o bien, si tiene entre 13 y 18 años de edad, que su padre, madre o tutor legal ha leído y aceptado los términos de esta Licencia. Podemos cancelar la presente Licencia de inmediato e interrumpir su acceso al Software si no nos consta que se haya otorgado tal aceptación por parte del padre o el tutor legal. Usted y su(s) padre(s) o tutor(es) legal(es) debe(n) leer los términos de esta Licencia juntos. Los padres y tutores legales son responsables por los actos de los niños menores de 18 años al usar el Software.

This Licence governs the terms on which the Software is made available to you and the permitted use by you.  By downloading or accessing the Software in any way (whether as part of the creation of an Account (defined below) or not and whether on any Team17 or third-party platform), you confirm that you are aged 18 years old or over and have read and accept the terms of this Licence, or if you are aged between 13 and 18, your parent or legal guardian has read and accepted the terms of this Licence.  We may immediately terminate this Licence and stop your access to the Software if we are not satisfied that such acceptance by the parent or legal guardian has been given. You and your parent(s) or legal guardian(s) must review the terms of this Licence together. Parents and legal guardians are responsible for the acts of children under 18 years of age when using the Software.

Además de los términos de esta Licencia,  todo uso del Software se rige por nuestra política de privacidad, que puede consultarse en https://www.team17.com/privacy-policy/  («Política de Privacidad») y los términos y condiciones de uso del Juego,  disponibles en: www.team17.com/terms-conditions («Términos y Condiciones»), que se incorporan a esta Licencia por referencia. Al indicar que está de acuerdo con esta Licencia, acepta quedar legalmente vinculado por la Política de Privacidad y Términos y Condiciones.

Usted entiende y acuerda que podemos agregar o modificar los términos de esta Licencia en cualquier momento. Podemos cambiar los términos de esta Licencia para reflejar lo siguiente: (a) cambios en las leyes aplicables; (b) requerimientos regulatorios o de seguridad; (c) pautas o códigos de práctica relevantes; (d) modificaciones técnicas; (e) para mejorar la claridad y coherencia; (f) para reflejar cambios en las necesidades de nuestros usuarios y nuestras prioridades comerciales, o (g) por cualquier otro motivo.

DO NOT USE THE SOFTWARE IN ANY WAY. IN SUCH CIRCUMSTANCES WE WILL NOT LICENCE THE SOFTWARE TO YOU AND YOU WILL NOT BE PERMITTED TO INSTALL, DOWNLOAD, ACCESS, COPY OR USE THE SOFTWARE IN ANY WAY WHATSOEVER. YOUR CONTINUED USE OF THE SOFTWARE IN ANY WAY (INCLUDING INSTALLATION OF THE SOFTWARE), WILL INDICATE YOUR ACCEPTANCE OF THE TERMS OF THIS LICENCE.   

1   OTORGAMIENTO Y ALCANCE DE LA LICENCIA

In addition to the terms of this Licence, any and all uses of the Software are subject to our privacy policy located at https://www.team17.com/privacy-policy/  ("Privacy Policy") and the Game terms and conditions of use available at: www.team17.com/terms-conditions ("Terms and Conditions"), all of which are incorporated into this Licence by reference. By agreeing to this Licence, you agree to be legally bound by the Privacy Policy and the Terms and Conditions.   

1.1 Por medio del presente documento, le otorgamos una licencia limitada, revocable, sin regalías, no exclusiva, intransferible y que no podrá ceder en régimen de sublicencia para el uso del Software exclusivamente para fines personales y no comerciales, sujeto a su cumplimiento de los términos de esta Licencia. Para mayor claridad, consideramos que la creación de una Cuenta (definida en la Sección 4) para acceder al Software a fin de entender, analizar, descompilar, reflejar, alterar, adaptar, variar, realizar ingeniería inversa, copiar, reproducir o transmitir dicho Software autorizado o adoptar cualquier otra acción similar o equivalente, queda excluido del alcance de «uso personal y no comercial» y constituye un incumplimiento sustancial de los términos de esta Licencia. 

You understand and agree that we may add to or change the terms of this Licence at any time. We may change the terms of this Licence to reflect: (a) changes in applicable laws; (b) regulatory or security requirements; (c) relevant guidance or codes of practice; (d) technical alterations; (e) to improve clarity and consistency; (f) to reflect changes to our users’ needs and our business priorities, or (g) for any other reason.   

1.2. Es posible que se apliquen cargos estándares de red y/o banda ancha al descargar y acceder al Software, o cargar contenido del Software. Asimismo, es posible que incurra en cargos adicionales por uso de datos cobrado por su operador de red, de conformidad con el contrato celebrado con su proveedor de Internet correspondiente, que serán de su exclusiva responsabilidad.

Any change to the terms of this Licence shall be effective immediately and your continued use of the Software in any way (whether on any Team17 or third-party platform) shall constitute on-going acceptance of the updated terms of this Licence, as updated or varied from time to time.  We therefore recommend that you check the terms and conditions of this Licence regularly. The current Licence is available at the link below.   

2   RESTRICCIONES

2.1 Excepto según se disponga de forma expresa en esta Licencia, usted se compromete a no hacer lo siguiente (y a no permitir o alentar a otros a hacer lo siguiente, ya sea de forma directa o indirecta):

1   GRANT AND SCOPE OF LICENCE  

a. copiar, reproducir, desensamblar, descompilar, hacer ingeniería inversa o crear obras derivadas, en todo o en parte, del Software (o cualquier parte de este), excepto en el caso en que dicha copia sea inherente al uso normal del Software; 

1.1 Subject to you complying with this Licence, we grant you a limited, revocable, royalty-free, non-exclusive, non-transferable, non-sub-licensable licence to use the Software, solely for your personal and non-commercial use. To be clear, we consider the creation of an Account (defined below in Section 4) to access the Software in order to understand, analyse, decompile, reflect, alter, adapt, vary, reverse engineer, copy, reproduce, or transmit such authorised Software or do anything similar or equivalent, falls outside the scope of “personal and non-commercial use” and constitutes a material breach of the terms of this Licence.   

b. rentar, vender, alquilar, otorgar una sublicencia, prestar, publicar, mostrar, distribuir o de otro modo transferir a un tercero el Software y una copia del mismo, en todo o en parte; 

1.2 When downloading and accessing the Software, or uploading content from the Software, standard network and/or broadband charges may apply. You may incur additional data charges from your network operator according to your contract with your relevant internet provider which you are solely responsible for.  

c. reflejar, traducir, alterar, modificar, fusionar, adaptar, variar o hacer modificaciones al Software, en todo o en parte, ni permitir que el Software o una parte del mismo se combine con otro programa o se incorpore en él; 

2   RESTRICTIONS  

d. combinar, asociar, envolver, integrar o alinear cualquier software, componentes o complementos de terceros con el Software o cualquier parte de este, de forma alguna;    

2.1 Except as expressly set out in this Licence you undertake that you will not (and will not permit or encourage or procure others directly or indirectly to):  

e. explotar o poner el Software o cualquiera de sus partes a disposición para fines cualquier tipo, incluidos los fines comerciales; 

in whole or in part, copy, reproduce, disassemble, decompile, reverse-engineer or create derivative works of the Software (or any part of it), except where such copying is incidental to normal use of the Software;   

f. desensamblar, descompilar, hacer ingeniería inversa o crear obras derivadas basadas en todo o en parte del Software o intentar llevar a cabo cualquiera de estas acciones, excepto en la medida en que tales acciones no puedan prohibirse por ley; y

rent, sell, lease, sub-licence, loan, publish, display, distribute or otherwise transfer to a third party the Software, any copy thereof, in whole or in part;  

g. pasar por alto o intentar pasar por alto medidas de seguridad o técnicas (incluida la deofuscación de un código) relacionada con el Software, incluida la adopción de técnicas y tecnologías actuales o desarrolladas en el futuro. 

reflect, translate, alter, modify, merge, adapt, vary or make alterations to, or modifications of, the whole or any part of the Software, nor permit the Software or any part of it to be combined with, or become incorporated in, any other programs;   

2.2 Usted no debe usar en relación con el Juego, software de terceros (incluidos clientes de videojuegos que no hayan sido desarrollados por Team17 u otorgados en licencia en virtud de esta Licencia) que realice o permita cualquiera de las actividades restringidas especificadas en la Sección 2.1 en relación con el Software. 

combine, associate, wrap-around, integrate, or align, any third-party software, components or add-on features with the Software or any part of it, in any manner whatsoever;     

2.3 Todo uso del Software que no se autorice de forma expresa en los términos de esta Licencia queda expresamente prohibido. Todo uso del Software que infrinja la Licencia y las restricciones se considerará como un incumplimiento de los términos de esta Licencia y/o como una violación de nuestros derechos de propiedad intelectual sobre el Software (según se detalla a continuación).

exploit or otherwise make available the Software or any of its parts for any purpose including any commercial purpose;   

3. DERECHOS DE PROPIEDAD INTELECTUAL

disassemble, decompile, reverse-engineer or create derivative works based on the whole or any part of the Software or attempt to do any such things, except to the extent that such actions cannot be prohibited by law; and  

3.1 Usted reconoce, acepta y acuerda que la titularidad, los derechos de propiedad y los derechos de propiedad intelectual respecto del Software y las copias de este (como los títulos, códigos informáticos, temas, objetos, personajes, hilos argumentales, eslóganes, ubicaciones, conceptos, ilustraciones, diseños de paisajes, animaciones, sonidos, composiciones musicales, grabaciones y efectos audiovisuales) en cualquier parte del mundo son propiedad nuestra y/o de nuestros terceros licenciantes.

bypass or seek to bypass any security or technical measures (including de-obfuscating any code) relating to the Software, including by the adoption of techniques and technologies now known or hereafter developed.   

3.2 Usted reconoce que los derechos en relación con el Software se le otorgan en licencia (no se le venden) y que no tiene derechos respecto del Software más allá del derecho de uso, de conformidad con los términos de esta Licencia.

You must not use in connection with the Game any third-party software (including any game client which has not been developed by Team17 or licensed under this Licence) which undertakes or enables any of the restricted activities specified at Section 2.1 above in relation to the Software.   

3.3 Usted reconoce que no tiene derecho o acceso al Software en formato de código fuente a menos que se disponga lo contrario de forma expresa en esta Licencia.

Any use of the Software not expressly authorised by the terms of this Licence is expressly prohibited. Any use of the Software in violation of the Licence and restrictions will be regarded both as a breach of the terms of this Licence and/or as an infringement of our intellectual property rights in and to the Software (as detailed below).  

3.4 En ningún caso se considerará al Software como software de «código abierto» o «disponible al público».

3   INTELLECTUAL PROPERTY RIGHTS

3.1 You acknowledge, accept and agree that all title, ownership rights and intellectual property rights in and to the Software and all copies thereof (including without limitation any titles, computer code, themes, objects, characters, storylines, catch phrases, locations, concepts, artwork, landscape designs, animations, sounds, musical compositions, recordings and audio-visual effects) anywhere in the world belong to us and/or our thirdparty licensors.  

4.1 Es posible que deba registrarse y abrir una cuenta («Cuenta») y proporcionar cierta información personal, como, por ejemplo, su nombre y dirección de correo electrónico («Registro») para poder acceder y usar el Software y acceder al Juego (ya sea a través de la plataforma de Team17 o la plataforma de un tercero). Nuestra Política de Privacidad explica la forma en que se puede recopilar y utilizar dicha información. Si la Cuenta se crea en una plataforma de Team17, dicha Cuenta se regirá por los Términos y Condiciones. Los términos de esta Licencia se incorporan de forma automática a los Términos y Condiciones. 

3.2 You acknowledge that rights in the Software are licensed (not sold) to you, and that you have no rights in, or to, the Software other than the right to use them in accordance with the terms of this Licence.  

4.2 Nos esforzamos por mejorar constantemente los productos que desarrollamos y/o publicamos. Para conseguirlo a veces recopilamos datos sobre cómo juegas al juego, ya sea las acciones que realizas o las elecciones que haces, así como cuánto tiempo juegas o el rendimiento de la conexión de nuestros juegos/sistemas (incluida información técnica sobre tu dispositivo y la conexión que usas para acceder). 3.3 You acknowledge that you have no right in or have access to the Software in source code format unless otherwise as expressly provided within this Licence.  

5.  INTEGRACIÓN DE OTROS SERVICIOS DE TERCEROS Y RECONOCIMIENTOS DE SOFTWARE DE TERCEROS

3.4 In no event will the Software be deemed to be "open-source" or "publicly available" software.  

5.1 El Software puede integrarse con otros servicios o plataformas de terceros de forma periódica.  

ACCOUNTS AND ANALYTICS  

5.2 Estos servicios o plataformas de terceros en general pueden solicitarle que indique que está de acuerdo con los términos y condiciones de dicho tercero proveedor y que cree una Cuenta separada o se registre con el tercero proveedor para recibir los servicios o acceder a las plataformas de dicho tercero. Los términos conforme a los cuales dichos servicios o plataformas de terceros se relacionan con usted o comparten información o datos con el Software o con nosotros son específicos para cada tercero proveedor. Debe leer los términos y condiciones del tercero proveedor antes de aceptar recibir los servicios o acceder a las plataformas de dicho tercero.

In order to access and use the Software and access the Game (and this could be via a Team17 platform or a third-party platform), you may be asked to register and open an account ("Account") and provide certain personal information such as, for example, your name and email address ("Registration"). Our Privacy Policy explains how such information may be collected and used. Where the Account is created on a Team17 platform then the Account is governed by the Terms and Conditions. The terms of this Licence are automatically incorporated as part of the Terms and Conditions.   

5.3 El Software puede usar o incluir software de terceros («Software de Terceros»). El Anexo de esta Licencia incluye una lista de Software de Terceros utilizado en los juegos de Team17, junto con las condiciones o restricciones de uso. Nos reservamos el derecho a actualizar, cambiar y agregar elementos a esta lista de Software de Terceros, según corresponda, de forma periódica.  

We are constantly striving to improve the products we develop and/or publish. To help us achieve this we sometimes collect data relating to how you play the game, including what actions you take or selections you make, how long you play for and the performance of the online connectivity of our games/systems when you connect, (including technical information about the device and connection you are using to access the games/systems). This data is handled in compliance with applicable data protection laws and regulations, is anonymised and/or aggregated, and only kept for a reasonable period for analysis. 6.   SUSCRIPCIONES Y CANCELACIONES 

6.1 Es posible que necesite suscribirse y/o hacer algún pago para acceder y usar ciertas funciones del Software. Las suscripciones y los pagos, junto con los reintegros o cancelaciones, se rigen estrictamente de conformidad con los términos de esta Licencia y los Términos y Condiciones.

5.  OTHER THIRD-PARTY SERVICES INTEGRATION AND THIRD-PARTY SOFTWARE ACKNOWLEDGMENTS  

7.   EXCLUSIÓN DE GARANTÍAS

5.1 From time to time the Software may integrate with other third-party services or platforms.    

7.1 HASTA EL GRADO MÁXIMO PERMITIDO POR LA LEY APLICABLE, EL SOFTWARE SE PROPORCIONA «TAL CUAL», CON TODAS SUS FALLAS, SIN GARANTÍAS, GARANTÍA DE FUNCIONAMIENTO O GARANTÍA DE CUALQUIER TIPO, YA SEA EXPRESA O IMPLÍCITA, INCLUIDAS LAS GARANTÍAS IMPLÍCITAS DE CONDICIÓN, CALIDAD, SATISFACCIÓN, USO ININTERRUMPIDO, COMERCIABILIDAD, IDONEIDAD PARA UN PROPÓSITO DETERMINADO O NO INFRACCIÓN DE DERECHOS. SU USO DEL SOFTWARE ES BAJO SU EXCLUSIVO RIESGO. TEAM17 NO GARANTIZA QUE EL SOFTWARE ESTARÁ LIBRE DE ERRORES O QUE FUNCIONARÁ O SERÁ COMPATIBLE CON CUALQUIER OTRO SOFTWARE O QUE SE CORREGIRÁ CUALQUIER ERROR EN EL SOFTWARE. 

5.2 These third-party services or platforms may generally require you to agree to the terms and conditions of such third-party supplier and set up a separate Account or register with the third-party supplier in order to receive the third-party services or platform(s). The terms on which those third-party services or platforms engage with you and share information or data with the Software or us, are specific to each third-party provider. You should make yourself aware of the terms and conditions of the third-party provider before agreeing to receive such third-party services or platforms.  

7.2 HASTA EL GRADO MÁXIMO PERMITIDO POR LA LEY APLICABLE, NO DECLARAMOS NI GARANTIZAMOS QUE SE PODRÁ ACCEDER DE FORMA ININTERRUMPIDA AL SOFTWARE O QUE NO HABRÁ FALLAS, ERRORES U OMISIONES O PÉRDIDA DE INFORMACIÓN TRANSMITIDA, O QUE NO SE TRANSMITIRÁN VIRUS AL SOFTWARE.  NO GARANTIZAMOS QUE PODRÁ ACCEDER O USAR EL SOFTWARE EN TODO MOMENTO O EN CUALQUIER LUGAR DE SU ELECCIÓN, O QUE TENDREMOS UNA CAPACIDAD ADECUADA PARA EL SOFTWARE EN SU TOTALIDAD O EN CUALQUIER ÁREA GEOGRÁFICA ESPECÍFICA.

5.3 The Software may use or include third-party software ("Third-Party Software"). A list of the current ThirdParty Software used within Team17's games is  included at the Annex to this Licence, along with any conditions or restrictions to use. We reserve the right to update, change and add to this list of Third-Party Software, as applicable, from time to time.    

7.3 USTED RECONOCE Y ACUERDA QUE EL SOFTWARE NO HA SIDO DESARROLLADO PARA SATISFACER SUS REQUERIMIENTOS INDIVIDUALES Y QUE ES SU RESPONSABILIDAD ASEGURARSE DE QUE EL SOFTWARE SATISFACE SUS REQUERIMIENTOS. 

6   SUBSCRIPTIONS AND CANCELLATIONS   

8.   LIMITACIÓN DE RESPONSABILIDAD

6.1 You may need a subscription and/or make payments to access and use certain features of the Software. Subscriptions and payments with any refund and cancellations are governed strictly in accordance with the terms of this Licence and the Terms and Conditions.  

8.1 DE CONFORMIDAD CON LA SECCIÓN 8.3, TEAM17 NO TENDRÁ RESPONSABILIDAD ALGUNA POR PÉRDIDAS O DAÑOS DE NINGÚN TIPO QUE SURJAN DEL SOFTWARE O DEL USO DE ESTE, INCLUIDOS LA PÉRDIDA DE DATOS, LA FALLA O EL MAL FUNCIONAMIENTO DEL ORDENADOR O CUALQUIER OTRO TIPO DE DAÑO O PÉRDIDA. ASIMISMO, TEAM17 NO SERÁ RESPONSABLE EN MODO ALGUNO POR PÉRDIDAS O DAÑOS A ACTIVOS DIGITALES COMO PERSONAJES, BIENES VIRTUALES O MONEDA DEL JUEGO, CUENTAS O ESTADÍSTICAS. TEAM17 NO SERÁ RESPONSABLE POR LAS INTERRUPCIONES DEL SERVICIO, INCLUIDAS LAS INTERRUPCIONES EN LAS REDES DE PROVEEDORES DE SERVICIOS DE INTERNET (ISP, POR SUS SIGLAS EN INGLÉS), LAS FALLAS DE SOFTWARE O HARDWARE, O CUALQUIER OTRO EVENTO QUE PUEDA CAUSAR UNA PÉRDIDA DE DATOS O INTERRUPCIÓN DEL SERVICIO. TEAM17 NO SERÁ RESPONSABLE ANTE USTED BAJO NINGUNA CIRCUNSTANCIA POR DAÑOS INDIRECTOS, INCIDENTALES, ESPECIALES, PUNITIVOS O EMERGENTES.

7   DISCLAIMER OF WARRANTIES  

8.2 Se le proporciona el Software sin cargo, conforme a los términos de esta Licencia. Hasta el grado máximo permitido por la ley, nuestra responsabilidad total, ya sea derivada de responsabilidad contractual, extracontractual, objetiva u otro, e incluida la responsabilidad por pérdidas, costos, gastos o daños, no excederá (en total) un monto equivalente a las tarifas de Suscripción, en relación con el Juego, abonadas por usted a Team17 durante los doce (12) meses anteriores a la fecha de la causal de acción que hubiese surgido en primer lugar.  

7.1 TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, THE SOFTWARE IS PROVIDED "AS IS" WITH ALL FAULTS, WITHOUT WARRANTY, PERFORMANCE ASSURANCES OR GUARANTEES OF ANY KIND, EITHER  

8.3 Las disposiciones de esta Licencia no limitarán ni excluirán nuestra responsabilidad por: (a) muerte o lesiones personales producto de nuestra negligencia; (b) fraude o declaraciones fraudulentas; o (c) cualquier otra responsabilidad que no pueda excluirse o limitarse de conformidad con la ley inglesa.

9.   EXTINCIÓN

SATISFACTION, UNINTERRUPTED USE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT. YOUR USE IS AT YOUR SOLE RISK. TEAM17 DOES NOT WARRANT THAT THE SOFTWARE WILL BE  

9.1. Podemos cancelar esta Licencia y las Cuentas del usuario en el Juego de inmediato si usted incumple la Licencia.

ERROR-FREE, OR THAT THE SOFTWARE WILL INTEROPERATE OR BE COMPATIBLE WITH ANY OTHER SOFTWARE OR THAT ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.   

9.2. Ante la Extinción del acuerdo por cualquier motivo: (a) cesarán de inmediato todos los derechos otorgados a usted en virtud de esta Licencia; (b) deberá interrumpir de inmediato todas las actividades autorizadas por esta Licencia; (c) deberá borrar o eliminar el Software de todos los equipos informáticos en su poder, y (d) se interrumpirá y cancelará de inmediato su acceso al Juego y su uso de conformidad con los Términos y Condiciones.

7.2 TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DO NOT REPRESENT OR WARRANT THAT  

10.   GENERAL

ACCESS TO THE SOFTWARE WILL BE UNINTERRUPTED OR THAT THERE WILL BE NO FAILURES, ERRORS OR  

10.1 Cada una de las garantías y condiciones (o derechos y obligaciones) de esta Licencia se aplican de forma independiente. 

OMISSIONS OR LOSS OF TRANSMITTED INFORMATION, OR THAT NO VIRUSES WILL BE TRANSMITTED ON THE SOFTWARE.  WE DO NOT GUARANTEE THAT YOU WILL BE ABLE TO ACCESS OR USE THE SOFTWARE AT TIMES  

10.2 Si se determina que una disposición, o parte de una disposición, de esta Licencia, incluidas las garantías y las condiciones (o los derechos y obligaciones) es ilegal, inválida o que un tribunal o autoridad competente no puede exigir su cumplimento, la legalidad, validez y exigencia de las restantes disposiciones, incluidas las garantías y condiciones de esta Licencia, no se verán afectadas.

OR LOCATIONS OF YOUR CHOOSING, OR THAT WE WILL HAVE ADEQUATE CAPACITY FOR THE SOFTWARE AS A WHOLE OR IN ANY SPECIFIC GEOGRAPHIC AREA.  

10.3 Podemos transferir nuestros derechos y obligaciones en virtud de esta Licencia a otra organización, pero esto no afectará sus derechos o nuestras obligaciones conforme a esta Licencia. Usted no puede transferir o ceder sus derechos y obligaciones en virtud de esta Licencia a un tercero.

7.3 YOU ACKNOWLEDGE AND AGREE THAT THE SOFTWARE HAS NOT BEEN DEVELOPED TO MEET YOUR INDIVIDUAL REQUIREMENTS AND THAT IT IS YOUR RESPONSIBILITY TO ENSURE THAT THE SOFTWARE MEETS YOUR REQUIREMENTS.   

10.4 El hecho de que no le exijamos el cumplimiento de alguna de sus obligaciones en virtud de esta Licencia, o que no ejerzamos nuestros derechos para iniciar una acción en su contra o lo demoremos, no se entenderá como una renuncia a nuestros derechos ni que usted no está obligado a cumplir con dichas obligaciones.

8   LIMITATION OF LIABILITY  

10.5 Esta Licencia, su objeto y su formación, se rigen por las leyes de Inglaterra y Gales. Usted y nosotros acordamos que los tribunales de Inglaterra tienen jurisdicción exclusiva respecto de cualquier controversia relacionada con esta Licencia o el Juego. 

8.1 SUBJECT TO SECTION 8.3, TEAM17 SHALL NOT BE LIABLE IN ANY WAY FOR ANY LOSS OR DAMAGE OF ANY KIND ARISING OUT OF THE SOFTWARE OR ANY USE OF THE SOFTWARE, INCLUDING WITHOUT LIMITATION LOSS OF DATA, COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER DAMAGES OR LOSSES. FURTHER,  

10.6 Esta Licencia constituye y contiene el entendimiento completo entre las partes con respecto a su objeto, con la condición de que esta Licencia coexistirá con los Términos y Condiciones y la Política de Privacidad y no los reemplazará.

TEAM17 SHALL NOT BE LIABLE IN ANY WAY FOR ANY LOSS OR DAMAGE TO DIGITAL ASSETS SUCH AS CHARACTERS, VIRTUAL GOODS OR CURRENCY IN THE GAME, ACCOUNTS OR STATISTICS. TEAM17 SHALL NOT BE RESPONSIBLE FOR ANY INTERRUPTIONS OF SERVICE, INCLUDING WITHOUT LIMITATION ISP DISRUPTIONS,  

Esta Licencia se ha redactado en idioma inglés y puede traducirse a otros idiomas. La versión en idioma inglés de esta Licencia prevalecerá en caso de conflicto, inconsistencias o si es necesario aclarar las versiones redactadas en otros idiomas.

SOFTWARE OR HARDWARE FAILURES, OR ANY OTHER EVENT WHICH MAY RESULT IN A LOSS OF DATA OR DISRUPTION OF SERVICE. IN NO EVENT WILL TEAM17 BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES.  

8.2 The Software is provided to you free of charge under the terms of this Licence. To the maximum extent permissible by law our total liability, whether arising in contract, tort, strict liability or otherwise and including liability for losses, costs, expenses or damages shall not exceed (in the aggregate) an amount equivalent to the Subscription fees, relating to the Game, actually paid by you to Team17 during the twelve (12) months prior to the date of the cause of action first arising.   

8.3 Nothing in this Licence shall limit or exclude our liability for: (a) death or personal injury resulting from our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited by English law.  

9   TERMINATION  

9.1 We may terminate this Licence and any user Account in the Game immediately if you commit a breach of this Licence.  

9.2 Upon termination for any reason: (a) all rights granted to you under this Licence shall immediately cease; (b) you must immediately cease all activities authorised by this Licence; (c) you must immediately delete or remove the Software from all computer equipment in your possession, and (d) your access to and use of the Game under the Terms and Conditions will immediately cease and be terminated.  

10   GENERAL  

10.1 Each of the warranties and conditions (or rights and obligations) of this Licence operates separately.   

10.2 If any provision, or part provision, of this Licence, including each of the warranties and conditions (or rights and obligations) is found to be illegal, invalid or unenforceable by any court or competent authority, the legality, validity and enforceability of the remaining provisions, including the warranties and conditions of this Licence will not be affected.  

10.3 We may transfer our rights and obligations under this Licence to another organisation, but this will not affect your rights or our obligations under this Licence. You may not transfer or assign your rights and obligations under this Licence to a third party.  

10.4 If we fail to insist that you perform any of your obligations under this Licence, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations.  

10.5 This Licence, its subject matter and its formation, are governed by the laws of England and Wales. You and we both agree that the courts of England will have exclusive jurisdiction in relation to any dispute connected with this License or the Game.   

10.6 This Licence constitutes and contains the entire agreement between the parties with respect to the subject matter hereof, provided, however, that this Licence shall co-exist with, and shall not supersede, the Terms and Conditions and the Privacy Policy.  

This Licence is drafted in the English language and may be translated into other languages. The English language version of this Licence shall prevail if there is a conflict or inconsistency or clarification required with other language versions.
