END USER LICENCE AGREEMENT

PLEASE READ CAREFULLY 

본 최종 사용자 라이선스 계약("라이선스")은 현재 또는 미래에 존재하는지 여부와 상관없이 Team17이 수시로 퍼블리싱하는 Team17의 소프트웨어 프로그램 및 모든 추가 기능, 변형, 확장 팩, 가상 콘텐츠, 가상 화폐, 업데이트, 업그레이드, 패치 또는 수시로 소프트웨어 프로그램에 적용한 기타 수정사항(통칭 "소프트웨어")과 관련한 귀하와 3 Red Hall Avenue, Paragon Business Park, Wakefield, England, WF1 2UL에 위치한 Team17 Digital Limited 사이의 법적 계약입니다.  

This end user licence agreement ("Licence") is a legal agreement between you and Team17 Digital Limited of 3 Red Hall Avenue, Paragon Business Park, Wakefield, England, WF1 2UL relating to the software programs of Team17's videogames as published by Team17 from time to time, whether existing now or in the future and any add-ons, variations, expansions packs, virtual content, virtual currency, updates, upgrades, patches or other modifications made to the software programs from time to time (collectively referred to as "Software").    

본 라이선스 계약에서는 소프트웨어의 사용자를 "귀하", "고객", "여러분"으로 칭하며 당사는 "Team17", "당사", "자사" 또는 "우리"라고 칭합니다. 

In this Licence you, the user of the Software, are referred to as "you" "your", "yours" and we are referred to as "Team17", "we", "us" or "our".   

당사는 본 라이선스에 기초하여 귀하에게 소프트웨어를 사용할 라이선스를 부여합니다. 당사는 귀하에게 소프트웨어를 판매하지 않으며 당사는 언제나 소프트웨어의 소유자입니다.

We licence use of the Software to you on the basis of this Licence. We do not sell the Software to you and we remain the owners of the Software at all times.

본 라이선스는 귀하가 소프트웨어를 사용할 수 있는 조건과 귀하에게 허용한 사용권을 관리합니다.  어떤 방식으로든 소프트웨어를 다운로드하거나 접속함으로써(계정(아래에 정의됨) 생성의 일부인지 아닌지나 모든 Team17 또는 타사 플랫폼에 상관없이), 귀하는 귀하가 18세 이상이며 본 라이선스의 조건을 읽고 동의하거나, 귀하가 13세에서 18세 사이인 경우, 귀하의 부모 또는 법정후견인이 본 라이선스의 조건을 읽고 동의한 것입니다.  당사가 부모 또는 법정후견인이 동의한 것을 납득할 수 없는 경우, 당사는 즉시 본 라이선스를 해지하고 소프트웨어에 대한 귀하의 접속을 중지할 수 있습니다. 귀하와 귀하의 부모 또는 법정후견인은 반드시 본 라이선스의 조건을 함께 검토하셔야 합니다. 부모 또는 법정후견인은 이 소프트웨어를 사용할 때 18세 미만 미성년의 행동에 대한 책임이 있습니다. 
* “예” 또는 “설치” 버튼을 클릭하거나 소프트웨어에 접속, 다운로드 또는 설치하는 경우, 그 외 어떤 방식으로든 소프트웨어나 관련 게임을 사용하는 경우, 귀하는 라이선스(및 참조에 포함된 모든 조건)의 조건에 동의하고 그러한 라이선스 조건이 귀하에게 법적 구속력이 있음을 인정하는 것입니다.

This Licence governs the terms on which the Software is made available to you and the permitted use by you.  By downloading or accessing the Software in any way (whether as part of the creation of an Account (defined below) or not and whether on any Team17 or third-party platform), you confirm that you are aged 18 years old or over and have read and accept the terms of this Licence, or if you are aged between 13 and 18, your parent or legal guardian has read and accepted the terms of this Licence.  We may immediately terminate this Licence and stop your access to the Software if we are not satisfied that such acceptance by the parent or legal guardian has been given. You and your parent(s) or legal guardian(s) must review the terms of this Licence together. Parents and legal guardians are responsible for the acts of children under 18 years of age when using the Software.

본 라이선스의 조건 외에도 소프트웨어의 모든 사용은 https://www.team17.com/privacy-policy/에 있는 당사의 개인정보 취급방침("개인정보 취급방침") 및 www.team17.com/terms-conditions 에 있는 게임 이용약관("이용약관")의 적용을 받으며, 이 모든 내용은 참조를 통해 본 라이선스에 포함됩니다. 본 라이선스에 동의함으로써 귀하는 개인정보 취급방침 및 이용약관을 따르는 것을 동의하는 것입니다. 

OF THIS LICENCE (AND ALL TERMS INCORPORATED BY REFERENCE) AND ACKNOWLEDGE THAT SUCH LICENCE TERMS ARE LEGALLY BINDING ON YOU.  

귀하는 당사가 본 라이선스의 조건을 언제든지 추가하거나 바꿀 수 있다는 점을 이해하고 동의합니다. 당사는 다음 사항을 반영하기 위해 본 라이선스 조건을 변경할 수 있습니다. (a) 준거법의 변경, (b) 규제 또는 보안 요구사항, (c) 관련 지침 또는 관행 법규, (d) 기술적 변경, (e) 명확성과 일관성 향상을 위해, (f) 사용자의 요구사항 및 자사 비즈니스 우선순위에 대한 변경 사항을 반영하기 위해, (g) 기타 다른 사유로.

DO NOT USE THE SOFTWARE IN ANY WAY. IN SUCH CIRCUMSTANCES WE WILL NOT LICENCE THE SOFTWARE TO YOU AND YOU WILL NOT BE PERMITTED TO INSTALL, DOWNLOAD, ACCESS, COPY OR USE THE SOFTWARE IN ANY WAY WHATSOEVER. YOUR CONTINUED USE OF THE SOFTWARE IN ANY WAY (INCLUDING INSTALLATION OF THE SOFTWARE), WILL INDICATE YOUR ACCEPTANCE OF THE TERMS OF THIS LICENCE.   

1   라이선스의 허가 및 범위

In addition to the terms of this Licence, any and all uses of the Software are subject to our privacy policy located at https://www.team17.com/privacy-policy/  ("Privacy Policy") and the Game terms and conditions of use available at: www.team17.com/terms-conditions ("Terms and Conditions"), all of which are incorporated into this Licence by reference. By agreeing to this Licence, you agree to be legally bound by the Privacy Policy and the Terms and Conditions.   

1.1 귀하는 본 라이선스를 준수해야 하며, 당사는 귀하에게 개인 및 비상업적 용도로만 소프트웨어를 사용할 수 있는 제한적, 취소 가능, 무료 로열티, 비독점적, 양도 불가, 재허가 불가한 라이선스를 허가해드립니다. 명확히 하기 위해, 당사는 그러한 허가된 소프트웨어를 이해, 분석, 역컴파일, 재현, 변경, 개조, 수정, 역설계, 복사, 재생산, 전송하거나 이와 유사하거나 동등한 작업을 수행하기 위해 소프트웨어에 접속하기 위한 계정(제4조에서 정의)의 생성은 "개인 및 비상업적 용도"의 범위 밖에 있으며, 이는 본 라이선스 조건의 중대한 위반입니다. 

You understand and agree that we may add to or change the terms of this Licence at any time. We may change the terms of this Licence to reflect: (a) changes in applicable laws; (b) regulatory or security requirements; (c) relevant guidance or codes of practice; (d) technical alterations; (e) to improve clarity and consistency; (f) to reflect changes to our users’ needs and our business priorities, or (g) for any other reason.   

1.2 소프트웨어를 다운로드 및 접속하거나 소프트웨어에서 콘텐츠를 업로드하는 경우, 표준 네트워크 및/또는 광대역 요금이 적용될 수 있습니다. 귀하가 전적으로 책임을 지고 있는 관련 인터넷 공급자와의 계약에 따라 네트워크 운영사로부터 추가 데이터 요금이 발생할 수 있습니다.

Any change to the terms of this Licence shall be effective immediately and your continued use of the Software in any way (whether on any Team17 or third-party platform) shall constitute on-going acceptance of the updated terms of this Licence, as updated or varied from time to time.  We therefore recommend that you check the terms and conditions of this Licence regularly. The current Licence is available at the link below.

1   GRANT AND SCOPE OF LICENCE  

a.  소프트웨어의 정상적인 사용으로 인한 경우를 제외하고, 소프트웨어 전체 또는 일부를 복사, 재생산, 역어셈블, 역컴파일, 역설계 또는 소프트웨어(또는 소프트웨어의 일부)의 이차적 저작물을 생성하는 행위. 

1.1 Subject to you complying with this Licence, we grant you a limited, revocable, royalty-free, non-exclusive, non-transferable, non-sub-licensable licence to use the Software, solely for your personal and non-commercial use. To be clear, we consider the creation of an Account (defined below in Section 4) to access the Software in order to understand, analyse, decompile, reflect, alter, adapt, vary, reverse engineer, copy, reproduce, or transmit such authorised Software or do anything similar or equivalent, falls outside the scope of “personal and non-commercial use” and constitutes a material breach of the terms of this Licence.   

b.  소프트웨어, 소프트웨어의 모든 사본, 소프트웨어 전체 또는 그 일부를 제삼자에게 대여, 판매, 임대, 라이선스 재허가, 대급, 공표, 게시, 유통 또는 양도하는 행위.

1.2 When downloading and accessing the Software, or uploading content from the Software, standard network and/or broadband charges may apply. You may incur additional data charges from your network operator according to your contract with your relevant internet provider which you are solely responsible for.  

c.  소프트웨어 전체 또는 일부를 재현, 변환, 변경, 수정, 병합, 개량, 변조 또는 개조하거나 조정하는 행위, 소프트웨어나 소프트웨어의 일부를 다른 프로그램과 결합하거나 통합시키는 행위를 허용하지 않음. 

2   RESTRICTIONS  

d.  타사 소프트웨어, 구성 요소 또는 추가 기능을 소프트웨어 또는 소프트웨어의 일부와 어떤 방식으로든 결합, 연결, 랩 어라운드, 통합, 조정하는 행위.   

2.1 Except as expressly set out in this Licence you undertake that you will not (and will not permit or encourage or procure others directly or indirectly to):  

e.  모든 상업적 목적을 포함한 어떤 목적으로든 소프트웨어 또는 소프트웨어의 일부를 부당하게 이용 또는 이용할 수 있게 하는 행위. 

in whole or in part, copy, reproduce, disassemble, decompile, reverse-engineer or create derivative works of the Software (or any part of it), except where such copying is incidental to normal use of the Software;   

f.  다음의 행위를 법으로 금지할 수 없는 경우를 제외하고 소프트웨어 전체 또는 일부에 기초하여 역어셈블, 역컴파일, 역설계 또는 이차적 저작물을 생성하는 행위나 그러한 일을 시도하는 행위.

rent, sell, lease, sub-licence, loan, publish, display, distribute or otherwise transfer to a third party the Software, any copy thereof, in whole or in part;  

g.   현재 알려졌거나 이후에 개발된 기술 및 채택한 기술을 포함한 소프트웨어와 관련된 모든 보안 또는 기술적 조치(코드 난독화를 푸는 모든 행위 포함)를 우회하거나 우회를 시도하는 행위. 

reflect, translate, alter, modify, merge, adapt, vary or make alterations to, or modifications of, the whole or any part of the Software, nor permit the Software or any part of it to be combined with, or become incorporated in, any other programs;   

2.2 소프트웨어와 관련하여 위의 제2.1조에 명시된 제한 행위를 수행하거나 가능하게 만드는 모든 타사 소프트웨어(Team17이 개발하지 않았거나 본 라이선스에 따라 허가되지 않은 모든 게임 클라이언트 포함)를 게임과 관련하여 절대 사용해서는 안 됩니다. 

combine, associate, wrap-around, integrate, or align, any third-party software, components or add-on features with the Software or any part of it, in any manner whatsoever;     

2.3 본 라이선스 조건에 명시적으로 허가되지 않은 소프트웨어의 모든 사용은 명시적으로 금지됩니다. 라이선스 및 제한을 위반하는 소프트웨어의 사용은 본 라이선스의 조건을 위반 및/또는 소프트웨어와 소프트웨어에 대한 당사의 지식 재산권 침해로 간주할 것입니다(아래에 자세하게 설명됨).

exploit or otherwise make available the Software or any of its parts for any purpose including any commercial purpose;   

3   지식 재산권

disassemble, decompile, reverse-engineer or create derivative works based on the whole or any part of the Software or attempt to do any such things, except to the extent that such actions cannot be prohibited by law; and  

3.1 귀하는 소프트웨어 및 소프트웨어의 모든 사본에 대한 모든 권리, 소유권 및 지식 재산권(권리, 컴퓨터 코드, 테마, 객체, 문자, 구상, 캐치프레이즈, 장소, 개념, 삽화, 랜드스케이프 디자인, 애니메이션, 소리, 음악 구성, 녹화 및 시청각 효과를 제한 없이 포함)이 전 세계 어디서든 당사 및/또는 당사의 타사 라이선스 제공자의 소유라는 것을 인정하고, 받아들이며 동의합니다.

bypass or seek to bypass any security or technical measures (including de-obfuscating any code) relating to the Software, including by the adoption of techniques and technologies now known or hereafter developed.   

3.2 귀하는 본 소프트웨어의 권리가 귀하에게 허가(판매되지 않음)되어 있으며, 본 라이선스의 조건에 따른 소프트웨어에 대한 사용권 이외에는 귀하에게 권한이 없음을 인정합니다.

You must not use in connection with the Game any third-party software (including any game client which has not been developed by Team17 or licensed under this Licence) which undertakes or enables any of the restricted activities specified at Section 2.1 above in relation to the Software.   

3.3 귀하는 본 라이선스에 명시적으로 규정되어 있지 않는 한, 귀하가 소스 코드 형식의 소프트웨어에 대한 권리를 보유하거나 접속할 수 없다는 것을 인정합니다.

Any use of the Software not expressly authorised by the terms of this Licence is expressly prohibited. Any use of the Software in violation of the Licence and restrictions will be regarded both as a breach of the terms of this Licence and/or as an infringement of our intellectual property rights in and to the Software (as detailed below).  

3.4 어떤 경우에도 소프트웨어는 "오픈 소스" 또는 "공개적으로 이용 가능한" 소프트웨어로 간주하지 않습니다.

3   INTELLECTUAL PROPERTY RIGHTS

3.1 You acknowledge, accept and agree that all title, ownership rights and intellectual property rights in and to the Software and all copies thereof (including without limitation any titles, computer code, themes, objects, characters, storylines, catch phrases, locations, concepts, artwork, landscape designs, animations, sounds, musical compositions, recordings and audio-visual effects) anywhere in the world belong to us and/or our thirdparty licensors.  

4.1 소프트웨어에 접속하여 사용하고, 게임에 접속하기 위해(이는 Team17 플랫폼 또는 타사 플랫폼을 통해서도 가능함), 귀하는 계정("계정")을 등록 및 개설하고 귀하의 성함 및 이메일 주소와 같은 특정 개인 정보를 제공("등록")하도록 요청받을 수 있습니다.. 당사의 개인정보 취급방침은 이러한 정보가 어떻게 수집되고 사용되는지를 설명합니다. 계정이 Team17 플랫폼에서 생성되는 경우, 해당 계정은 이용약관에 의해 관리됩니다. 이 라이선스의 조건은 자동으로 이용약관의 일부에 포함됩니다. 

3.2 You acknowledge that rights in the Software are licensed (not sold) to you, and that you have no rights in, or to, the Software other than the right to use them in accordance with the terms of this Licence.

3.3 You acknowledge that you have no right in or have access to the Software in source code format unless otherwise as expressly provided within this Licence.  

5.  기타 타사 서비스 통합 및 타사 소프트웨어 승인

3.4 In no event will the Software be deemed to be "open-source" or "publicly available" software.  

5.1 소프트웨어는 수시로 기타 타사 서비스 또는 플랫폼과 통합될 수 있습니다.  

ACCOUNTS AND ANALYTICS  

5.2 이러한 타사 서비스 또는 플랫폼은 일반적으로 귀하가 타사 서비스 또는 플랫폼을 받기 위해 타사 공급자의 이용약관에 동의하고 별도의 계정을 설정하거나 타사 공급자에 등록하도록 요구될 수 있습니다. 이러한 타사 서비스 또는 플랫폼이 귀하와 거래하고 정보와 데이터를 소프트웨어 또는 당사와 공유하는 조건은 타사 공급자마다 다릅니다. 타사 서비스나 플랫폼을 받기로 동의하기 전에 타사 공급자의 이용약관을 귀하가 스스로 숙지하셔야 합니다.

In order to access and use the Software and access the Game (and this could be via a Team17 platform or a third-party platform), you may be asked to register and open an account ("Account") and provide certain personal information such as, for example, your name and email address ("Registration"). Our Privacy Policy explains how such information may be collected and used. Where the Account is created on a Team17 platform then the Account is governed by the Terms and Conditions. The terms of this Licence are automatically incorporated as part of the Terms and Conditions.   

5.3소프트웨어는 타사 소프트웨어("타사 소프트웨어")를 사용 또는 포함할 수 있습니다. Team17의 게임 내에서 현재 사용되는 타사 소프트웨어의 목록은 사용 시 조건 또는 제한과 함께 이 라이선스의 부록에 포함되어 있습니다. 당사는 이 타사 소프트웨어 목록을 경우에 따라 수시로 업데이트, 변경, 추가할 권리를 보유합니다.  

We are constantly striving to improve the products we develop and/or publish. To help us achieve this we sometimes collect data relating to how you play the game, including what actions you take or selections you make, how long you play for and the performance of the online connectivity of our games/systems when you connect, (including technical information about the device and connection you are using to access the games/systems). This data is handled in compliance with applicable data protection laws and regulations, is anonymised and/or aggregated, and only kept for a reasonable period for analysis. 6   구독 및 취소 

6.1 소프트웨어의 특정 기능에 접속하고 사용하기 위해 구독 및/또는 결제가 필요할 수 있습니다. 모든 환불 및 취소를 포함한 구독 및 결제는 이 라이선스의 조건 및 이용약관에 따라 엄격하게 관할됩니다.

5.  OTHER THIRD-PARTY SERVICES INTEGRATION AND THIRD-PARTY SOFTWARE ACKNOWLEDGMENTS  

7   보증에 대한 면책

5.1 From time to time the Software may integrate with other third-party services or platforms.    

7.1 준거법에 따라 허용 가능한 최대 범위까지, 명시적이든 묵시적이든 소프트웨어는 보증, 성능 보증, 모든 종류의 보장 없이, 조건, 품질, 만족도, 끊김 없는 사용, 상품성, 특정 목적에 대한 적합성 또는 비침해성에 대한 모든 묵시적 보증을 제한 없이 포함하여 모든 결함과 함께 "있는 그대로" 제공됩니다. 귀하의 사용으로 일어난 모든 일은 전적으로 귀하의 책임입니다. TEAM17은 소프트웨어에 오류가 없거나 소프트웨어가 다른 소프트웨어와 연동 또는 호환되거나 소프트웨어의 오류가 수정되는 것을 보증하지 않습니다. 

5.2 These third-party services or platforms may generally require you to agree to the terms and conditions of such third-party supplier and set up a separate Account or register with the third-party supplier in order to receive the third-party services or platform(s). The terms on which those third-party services or platforms engage with you and share information or data with the Software or us, are specific to each third-party provider. You should make yourself aware of the terms and conditions of the third-party provider before agreeing to receive such third-party services or platforms.  

7.2 준거법에 따라 허용 가능한 최대 범위까지, 당사는 소프트웨어에 대한 접속이 중단되지 않거나 전송된 정보의 실패, 오류, 누락, 손실이 없거나 소프트웨어에서 바이러스가 전송되지 않을 것이라고 진술하거나 보증하지 않습니다.  당사는 귀하가 원하는 시간 또는 위치에서 소프트웨어에 접속하거나 사용할 수 있다고 보장하지 않으며, 전체 또는 특정 지리적 지역에서 소프트웨어에 적합한 용량이 보유된다고 보장하지 않습니다.

5.3 The Software may use or include third-party software ("Third-Party Software"). A list of the current ThirdParty Software used within Team17's games is  included at the Annex to this Licence, along with any conditions or restrictions to use. We reserve the right to update, change and add to this list of Third-Party Software, as applicable, from time to time.    

7.3 귀하는 소프트웨어가 귀하의 개별적인 요구 사항을 충족하도록 개발되지 않았으며 소프트웨어가 귀하의 요구 사항을 충족하는지 확인하는 것은 귀하의 책임임을 인정하고 동의합니다. 

6   SUBSCRIPTIONS AND CANCELLATIONS   

8   책임의 제한

6.1 You may need a subscription and/or make payments to access and use certain features of the Software. Subscriptions and payments with any refund and cancellations are governed strictly in accordance with the terms of this Licence and the Terms and Conditions.  

8.1 제8.3조에 따라, TEAM17은 데이터 손실, 컴퓨터 고장, 오작동 또는 그 밖의 기타 모든 손해, 손실을 제한 없이 모두 포함하여 소프트웨어 또는 소프트웨어 사용에 기초한 모든 종류의 손실 또는 손해에 대해 어떤 방식으로든 책임을 지지 않습니다. 그뿐만 아니라 TEAM17은 게임, 계정, 통계에서 캐릭터, 가상 상품 또는 통화와 같은 디지털 자산에 대한 모든 손실 또는 손해에 대해 어떤 방식으로든 책임을 지지 않습니다. TEAM17은 ISP 중단, 소프트웨어 또는 하드웨어 고장 또는 데이터 손실, 서비스 중단을 초래할 수 있는 기타 모든 사고를 제한 없이 포함하여 서비스 중단에 대한 책임을 지지 않습니다. 어떤 경우에도 TEAM17은 모든 간접적, 부수적, 특수한, 전형적 또는 필연적인 피해에 대해 귀하에게 책임을 지지 않습니다.

7   DISCLAIMER OF WARRANTIES  

8.2 소프트웨어는 본 라이선스 조건에 따라 귀하에게 무료로 제공됩니다. 준거법에 따라 허용 가능한 최대 범위까지, 계약, 불법 행위, 무과실책임 또는 기타 사유로 발생하거나 손실, 경비, 비용 또는 손해에 대한 책임을 포함하여 당사의 총 책임은 원인이 처음 발생한 날짜로부터 이전 12개월 동안 귀하가 Team17에 실제로 지불한 게임 관련 구독료에 해당하는 금액(총계)을 초과할 수 없습니다. 

7.1 TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, THE SOFTWARE IS PROVIDED "AS IS" WITH ALL FAULTS, WITHOUT WARRANTY, PERFORMANCE ASSURANCES OR GUARANTEES OF ANY KIND, EITHER

9.1 당사는 귀하가 본 라이선스를 위반하는 경우, 본 라이선스 및 게임 내 모든 사용자 계정을 즉시 해지할 수 있습니다.

ERROR-FREE, OR THAT THE SOFTWARE WILL INTEROPERATE OR BE COMPATIBLE WITH ANY OTHER SOFTWARE OR THAT ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.   

9.2 어떤 사유로든 해지 시: (a) 본 라이선스에 의해 귀하에게 부여된 모든 권리가 즉시 중단됨, (b) 본 라이선스에 의해 귀하에게 허가된 모든 활동을 중단해야 함, (c) 귀하가 소유하고 있는 모든 컴퓨터 장비에서 소프트웨어를 즉시 삭제 또는 제거해야 함, (d) 이용약관에 따라 귀하의 게임 접속 및 사용이 즉시 중단되고 해지됨.

7.3 YOU ACKNOWLEDGE AND AGREE THAT THE SOFTWARE HAS NOT BEEN DEVELOPED TO MEET YOUR INDIVIDUAL REQUIREMENTS AND THAT IT IS YOUR RESPONSIBILITY TO ENSURE THAT THE SOFTWARE MEETS YOUR REQUIREMENTS.   

10.4 당사가 귀하에게 본 라이선스에 따른 귀하의 의무를 수행하도록 주장하지 않거나, 당사가 귀하에 대한 당사의 권리를 집행하지 않거나, 그렇게 하는 것을 지연한다고 해서 당사가 귀하에 대한 당사의 권리를 포기했거나 귀하가 이러한 의무를 준수할 필요가 없음을 의미하는 것은 아닙니다.

8   LIMITATION OF LIABILITY  

10.5 본 라이선스 및 본 라이선스의 주제와 구성은 영국과 웨일스 법률에 따라 관리됩니다. 귀하와 당사, 양측은 영국 법원이 이 라이선스나 게임과 관련한 모든 분쟁과 관련하여 독점적인 관할권을 갖게 될 것이라는 데 동의합니다. 

8.1 SUBJECT TO SECTION 8.3, TEAM17 SHALL NOT BE LIABLE IN ANY WAY FOR ANY LOSS OR DAMAGE OF ANY KIND ARISING OUT OF THE SOFTWARE OR ANY USE OF THE SOFTWARE, INCLUDING WITHOUT LIMITATION LOSS OF DATA, COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER DAMAGES OR LOSSES. FURTHER,  

10.6 본 라이선스는 이 라이선스의 주제에 관해 당사자 간의 전체적인 합의로 구성되고 포함하지만, 이 라이선스는 약관 및 개인정보 취급방침과 공존하며 대체하지 않습니다.

TEAM17 SHALL NOT BE LIABLE IN ANY WAY FOR ANY LOSS OR DAMAGE TO DIGITAL ASSETS SUCH AS CHARACTERS, VIRTUAL GOODS OR CURRENCY IN THE GAME, ACCOUNTS OR STATISTICS. TEAM17 SHALL NOT BE RESPONSIBLE FOR ANY INTERRUPTIONS OF SERVICE, INCLUDING WITHOUT LIMITATION ISP DISRUPTIONS,  

본 라이선스의 초안은 영어로 작성되었으며 다른 언어로 번역될 수 있습니다. 영어 버전과 다른 언어 버전의 라이선스가 상충, 불일치하거나 또는 명확성이 필요한 경우, 본 라이선스의 영어 버전이 우선됩니다. 

SOFTWARE OR HARDWARE FAILURES, OR ANY OTHER EVENT WHICH MAY RESULT IN A LOSS OF DATA OR DISRUPTION OF SERVICE. IN NO EVENT WILL TEAM17 BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES.  

8.2 The Software is provided to you free of charge under the terms of this Licence. To the maximum extent permissible by law our total liability, whether arising in contract, tort, strict liability or otherwise and including liability for losses, costs, expenses or damages shall not exceed (in the aggregate) an amount equivalent to the Subscription fees, relating to the Game, actually paid by you to Team17 during the twelve (12) months prior to the date of the cause of action first arising.   

8.3 Nothing in this Licence shall limit or exclude our liability for: (a) death or personal injury resulting from our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited by English law.  

9   TERMINATION  

9.1 We may terminate this Licence and any user Account in the Game immediately if you commit a breach of this Licence.  

9.2 Upon termination for any reason: (a) all rights granted to you under this Licence shall immediately cease; (b) you must immediately cease all activities authorised by this Licence; (c) you must immediately delete or remove the Software from all computer equipment in your possession, and (d) your access to and use of the Game under the Terms and Conditions will immediately cease and be terminated.  

10   GENERAL  

10.1 Each of the warranties and conditions (or rights and obligations) of this Licence operates separately.   

10.2 If any provision, or part provision, of this Licence, including each of the warranties and conditions (or rights and obligations) is found to be illegal, invalid or unenforceable by any court or competent authority, the legality, validity and enforceability of the remaining provisions, including the warranties and conditions of this Licence will not be affected.  

10.3 We may transfer our rights and obligations under this Licence to another organisation, but this will not affect your rights or our obligations under this Licence. You may not transfer or assign your rights and obligations under this Licence to a third party.  

10.4 If we fail to insist that you perform any of your obligations under this Licence, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations.  

10.5 This Licence, its subject matter and its formation, are governed by the laws of England and Wales. You and we both agree that the courts of England will have exclusive jurisdiction in relation to any dispute connected with this License or the Game.   

10.6 This Licence constitutes and contains the entire agreement between the parties with respect to the subject matter hereof, provided, however, that this Licence shall co-exist with, and shall not supersede, the Terms and Conditions and the Privacy Policy.  

This Licence is drafted in the English language and may be translated into other languages. The English language version of this Licence shall prevail if there is a conflict or inconsistency or clarification required with other language versions.
