IN ORDER TO PLAY THE GAME AND/OR ACCESS CERTAIN FEATURES, YOU MAY BE REQUIRED TO HAVE AND MAINTAIN A VALID AND ACTIVE USER ACCOUNT WITH ZENIMAX (“ACCOUNT”).  
BY DOWNLOADING, INSTALLATION, USING OR PLAYING THE GAME YOU CONFIRM THAT YOU HAVE READ THIS END USER LICENSE AGREEMENT, THE ZENIMAX TERMS OF SERVICE AND THE ZENIMAX PRIVACY POLICY AND THAT YOU AGREE TO THE TERMS IN THIS AGREEMENT AND THE TERMS OF SERVICE, (COLLECTIVELY, THIS “AGREEMENT”).  YOU FURTHER ACKNOWLEDGE AND UNDERSTAND THAT ZENIMAX WILL PROCESS YOUR PERSONAL DATA IN ACCORDANCE WITH THE ZENIMAX PRIVACY POLICY (available at https://bethesda.net/#/privacypolicy). IF YOU DO NOT ACCEPT THE TERMS OF THIS AGREEMENT, OR YOU HAVE NOT READ AND UNDERSTOOD THE ZENIMAX PRIVACY POLICY, DO NOT DOWNLOAD, INSTALL OR USE THE GAME.

This Agreement is between you and ZeniMax Media Inc. (“ZeniMax”). 
AS SET OUT IN SECTION 1 OF THE TERMS OF SERVICE, IF YOU ARE RESIDENT IN THE EEA, UNITED KINGDOM, SWITZERLAND, RUSSIA, AUSTRALIA, NEW ZEALAND, TURKEY, JAPAN OR BRAZIL, ZENIMAX ACKNOWLEDGES THAT THERE ARE CERTAIN GUARANTEES, WARRANTIES, TERMS AND CONDITIONS (INCLUDING IN RESPECT OF REFUNDS AND RETURNS AND UNFAIR TERMS) IMPOSED BY THE LAWS RELATING TO THE SUPPLY OF GOODS, SERVICES AND DIGITAL CONTENT WHICH THE LAWS EXPRESSLY PROVIDE MAY NOT BE EXCLUDED, RESTRICTED OR MODIFIED OR MAY ONLY BE LIMITED TO A CERTAIN EXTENT (THE "STATUTORY OBLIGATIONS").  NOTHING IN THIS EULA EXCLUDES, RESTRICTS OR MODIFIES THE STATUTORY OBLIGATIONS OTHERWISE THAN ACCORDING TO SUCH LAWS.
PHOTO-SENSITIVITY WARNING: 
A very small percentage of individuals may experience epileptic seizures or blackouts when exposed to certain visual images, including without limitation light patterns or flashing lights.  If you experience any of the following symptoms while playing the Game, immediately discontinue use and consult your physician before resuming play: blackouts, seizures, dizziness, altered vision, eye or muscle twitches, jerking or shaking of arms or legs, loss of awareness, disorientation, confusion, any involuntary movement, or convulsions.
VIRTUAL REALITY: HEALTH AND SAFETY PRECAUTIONS AND DISCLAIMERS
If the Software provides for virtual reality gameplay and/or the use of third party virtual reality headsets and/or related equipment, the following health and safety precautions and disclaimers apply.  
Failing to review and adhere to the health and safety precautions set forth below and the precautions given by the manufacturer of your VR headset may cause damage to property, personal injury to you or others, or death.  
As with all virtual reality games, please also carefully read and follow all health and safety precautions from your virtual reality headset manufacturer before use.  
PLEASE READ THE FOLLOWING CAREFULLY BEFORE PLAYING 
Please note that certain people are susceptible to various symptoms and conditions when playing a game with virtual reality headsets, including:
•	epileptic seizures or loss of consciousness;
•	altered vision;
•	motion sickness, dizziness, disorientation or nausea; and/or
•	repetitive motion injuries and eye strain.
Immediately stop playing if you do not feel well or if you experience any of the above symptoms.  
In any event, we strongly recommend that you take reasonable breaks from gameplay every 10 to 15 minutes and that you do not play for excessive overall periods.
If you are pregnant or if you have any pre-existing medical condition, you should talk with a physician to obtain professional advice before playing the game.  
You should not play the game under the influence of alcohol or drugs or while using prescription or non-prescription medication.
Always be aware of your surroundings when playing the game.  When playing with a virtual reality headset or other headset it is best to remain seated if that mode is supported.  Since the game is an immersive reality experience, you may not be able to fully see or hear your surroundings while playing.  Whether or not you remain seated during gameplay, give yourself plenty of room and make sure the play area is clear of objects and people that could be bumped into during gameplay.  Ensure you are in a safe environment and not near stairs, balconies, windows, walls, furniture, objects that could cause tripping hazards or other objects or people that may pose a danger to you or them or could be damaged or cause injury during gameplay.  Sound volume for the game should be kept at a low enough level so that you can be aware of your surroundings while playing, and to avoid any damage to your hearing.
YOU HEREBY RELEASE ZENIMAX, ITS AFFILIATES AND THEIR RESPECTIVE OFFICERS, DIRECTORS AND EMPLOYEES FROM ANY AND ALL LIABILITY IN CONNECTION WITH THE USE OF A VIRTUAL REALITY HEADSET, RELATED EQUIPMENT, OR THE SOFTWARE.
In no event shall ZeniMax be liable for any damage to property, injury, or death (or for direct, indirect, punitive, incidental, or consequential damages) arising out of the use or misuse of the Software or any virtual reality headset or related equipment, including, without limitation, arising out of or connected with interactions between you and other people or objects in or around the play area during gameplay.  You understand that misuse of the Software includes (without limitation) violations of any instructions or any warnings set forth on the packaging, documentation, and screen shots for your virtual reality headset, in this document, in other documentation accompanying the Software or the packaging for the Software.  Failure to carefully read and follow those instructions and warnings could lead to property damage, injury or death.  You expressly assume and accept any and all risks inherent in (or that may be associated with) the use of the Software, and/or of the virtual reality headsets or related equipment.  Some, but not all, of those risks are discussed in the warnings set forth above or the warnings accompanying the Software and the virtual reality headset.  Please also see the section on “Limitation of Liability" below in this Agreement.
The ZeniMax Terms of Service contain a Dispute Resolution and Arbitration Provision, including a Class Action Waiver, (the “Disputes Provision”) that - if you reside in a jurisdiction outside of the EEA/United Kingdom/Switzerland/Australia/New Zealand/Turkey/Japan or Brazil that permits class actions or other collective disputes - affects your rights under the ZeniMax Terms of Service and this End User License Agreement with respect to disputes you may have with ZeniMax.  That Disputes Provision is incorporated into this End User License Agreement by this reference and forms a part of this End User License Agreement as if such provision was fully restated in this End User License Agreement.  You may opt out of the binding individual arbitration and class action waiver as provided in the ZeniMax Terms of Service.  
Any and all uses of the Game are governed by the terms of this Agreement and the ZeniMax Terms of Service.  The ZeniMax Terms of Service are hereby incorporated into and form a part of this Agreement by this reference as if such provisions were fully restated in this Agreement.  The End User License Agreement is a “EULA” and constitutes “Supplemental Terms” as contemplated by the ZeniMax Terms of Service.  The Game is made available and distributed solely for use by authorized end users according to the terms of this Agreement, including the ZeniMax Terms of Service.  Any use, reproduction, modification or distribution of the Game not expressly authorized by the terms of this Agreement is expressly prohibited.  You agree that the Game, the Game Client, other Game related software, Content (as defined in the Terms of Service) specific to the Game and your access to and use of the Game are all a “Service” for the purposes of this Agreement, including the ZeniMax Terms of Service.  Any rights not granted to you in this Agreement are reserved by ZeniMax. 
You acknowledge that ZeniMax may process your personal data in accordance with the ZeniMax Privacy Policy which is available at https://bethesda.net/#/privacypolicy and you agree to the ZeniMax Code of Conduct which is available at https://bethesda.net/#/codeofconduct.  The Privacy Policy and Code of Conduct are incorporated into this End User License Agreement by this reference and form a part of this End User License Agreement as if such provisions were fully restated in this End User License Agreement.  All personal information collected and processed by ZeniMax in connection with this End User License Agreement will be collected and processed in accordance with the ZeniMax Privacy Policy. 
YOU SHOULD PRINT A COPY OF THIS END USER LICENSE AGREEMENT, THE TERMS OF SERVICE, THE PRIVACY POLICY AND THE CODE OF CONDUCT FOR YOUR RECORDS AND FOR FUTURE REFERENCE.
All software programs and any and all files that are delivered to you or made available to you by ZeniMax, directly or indirectly through a ZeniMax authorized reseller or distributor, (via on-line access, transmission, download or otherwise), including any “patcher”, “installer”, and any updates and modifications to such software programs, and any and all copies and derivative works of such software programs (collectively, with the Game Client (defined below), the “Game”) is the copyrighted work of ZeniMax and its affiliates.  THE GAME IS LICENSED, NOT SOLD, TO YOU.  
1.	LIMITED LICENSE; RESTRICTIONS AND OWNERSHIP
If you agree to this Agreement, you may, as applicable, download, install and use the software (hereafter referred to as the “Game Client”) on your computer or console (each hereafter referred to as a “computer”) for the sole purpose of playing the Game.  Subject to your compliance with all the terms and conditions in this Agreement, ZeniMax hereby grants, and you hereby accept, a limited, non-transferable, non-exclusive license (a) to download, install or use the Game Client on one or more computers owned by you or under your legitimate control for your non-commercial entertainment purposes only, and (b) to use the Game Client solely as part of the Service, if applicable.  
The ZeniMax Terms of Service include terms and conditions applicable to Virtual Currency (as such term is defined in the ZeniMax Terms of Service), including terms that grant to you a non-exclusive, limited license for Virtual Currency.  Such terms and conditions apply to the Virtual Currency (if any) licensed to you for use with the Game.  
Subject to the Statutory Obligations (as defined in Section 1 of the Terms of Service), this Agreement does not give you any right to obtain reissues or replacements of the Game at any time and ZeniMax is not obliged to supply software updates, upgrades, or expansions for the Game, or even to operate or continue to support the Game for an indefinite period.  
As further described in the ZeniMax Terms of Service, but subject to the Statutory Obligations (as defined in Section 1 of the ZeniMax Terms of Service), ZeniMax may change, modify, suspend, or discontinue any aspect of the Game at any time and ZeniMax may also impose limits on certain features or restrict your access to parts or all of the Game without notice or liability.
In all cases, the licenses granted to you in this Agreement will terminate upon the earlier of termination of this Agreement or termination of your Account, if any, with ZeniMax.  
The ZeniMax Terms of Service include terms and conditions applicable to user generated Content, downloadable Content and other Content and you agree to comply with such terms and conditions. 
2.	SOFTWARE AND ANTI-TAMPERING AND SECURITY TOOLS.  ZeniMax may deploy or provide patches, updates, improvements, upgrades and modifications to the Game (“Updates”) that must be installed by you in the manner described by ZeniMax in its discretion before you may continue to play the Game.  All such Updates are part of the Game for purposes of this Agreement, the licenses granted to you and the License Limitations set forth in this Agreement.  The terms of this Agreement will govern any Updates provided by ZeniMax that replace and/or supplement the original Game, unless such Updates is accompanied by a separate license agreement in which case the terms of that license agreement will govern.  ZENIMAX HAS IMPLEMENTED TOOLS AND SOFTWARE (“ANTI-TAMPER TOOLS”) DESIGNED TO DETECT AND PREVENT TAMPERING AND FRAUD; THESE TECHNOLOGIES MAY SCAN ANY COMPUTER OR DEVICE FROM WHICH YOU DOWNLOAD OR PLAY THE GAME TO DETECT OR IDENTIFY ANY PROGRAMS OR PROCESSES DESIGNED TO “TAMPER,” GAIN AN UNFAIR ADVANTAGE IN THE GAME OR OTHERWISE CIRCUMVENT ANY SECURITY, ANTI-TAMPER OR FRAUD DETECTION PROCESSES  OR TOOLS WE HAVE IMPLEMENTED (“TAMPER PROGRAMS”).  BY USING OR DOWNLOADING THE GAME OR ACCEPTING THIS AGREEMENT, YOU ACKNOWLEDGE AND EXPRESSLY AGREE TO THE ACCESS TO YOUR COMPUTER OR DEVICE BY THESE ANTI-TAMPER TOOLS TO IDENTIFY OR DETECT TAMPER PROGRAMS.
3.	LIMITATIONS AND RESTRICTIONS.
The Game and/or certain features are a Service offered by ZeniMax and may only be playable online.  In such cases, a persistent Internet connection (which is not supplied by ZeniMax) is required to play the Game or access these features.  You are responsible for all costs and expenses associated with acquiring any hardware, software (e.g., Internet browsers) or other products or services required to play the Game or access these features.  
In addition to the restrictions, conditions and limitations set forth in the ZeniMax Terms of Service and the ZeniMax Code of Conduct, the license granted to you in this End User License Agreement is subject to the conditions, restrictions and limitations set forth in Section 1 and this Section 3 of this End User License Agreement (collectively, the “License Limitations”). Any use of the Game in violation of the License Limitations will be regarded as an infringement of ZeniMax’s copyrights in and to the Game and will be a breach of this Agreement.  You agree that you will not and will not assist any other person, under any circumstances, to:
A.	in whole or in part, distribute, publicly perform or display, sell, transmit, publish, edit, reproduce, sublicense, rent, lease, loan or otherwise transfer the Game or Content, including without limitation any access keys;
B.	in whole or in part, modify, adapt, translate, reverse engineer, attempt to derive source code from, modify, disassemble, decompile, or create derivative works based on the Game; provided, however, that you may make one (1) copy of the Game Client and the manuals that accompany it for archival purposes only and you may install the relevant Game Client on one or more computers owned by you or under your legitimate control as described in Section 1 above; 
C.	remove any proprietary notices or labels on the Game; or attempt in any manner to circumvent any security measures designed to control access to the Game or any part thereof;  
D.	use cheats, automation software (bots), hacks, mods or any other unauthorized third-party software designed to modify the Game or adversely impact any other persons playing of the Game or his/her experience of playing the Game; 
E.	exploit the Game or any of its parts, including without limitation the Game Client, for any commercial purpose (including without limitation renting, leasing or licensing the Game to others), including without limitation (a) for gathering Virtual Currency (as defined in the ZeniMax Terms of Service), items or resources for sale outside the Game; or (b) performing in-game services in exchange for payment outside the Game, e.g., power-leveling; 
F.	use any unauthorized third-party software that intercepts, “mines”, or otherwise collects information from or through the Game or the Service, including without limitation any software that reads areas of RAM used by the Game to store information about a character or the game environment; provided, however, that ZeniMax may, at its sole and absolute discretion, allow the use of certain third party user interfaces and other third party software; 
G.	modify or cause to be modified any files that are a part of the Game Client in any way not expressly authorized by ZeniMax; 
H.	host, provide or develop matchmaking services for the Game or intercept, emulate or redirect the communication protocols used by ZeniMax in any way, for any purpose, including without limitation unauthorized play over the internet, network play, or as part of content aggregation networks;   
I.	facilitate, create or maintain any unauthorized connection to the Game or the Service, including without limitation (a) any connection to any unauthorized server that emulates, or attempts to emulate, the Service; and (b) any connection using programs or tools not expressly approved by ZeniMax; 
J.	take any action or upload, post, transmit, promote, or distribute any illegal content; 
K.	take any action or upload, post, transmit, promote, or distribute any content that infringes or violates any third party rights; 
L.	engage in, take any action associated with, or participate in any type of child solicitation, grooming behavior, pedophilia, or predatory behavior in any form;  
M.	harass, stalk, threaten, embarrass, spam or do anything else to another user of the Game that is unwanted, such as repeatedly sending unwanted messages or making personal attacks or statements about race, sexual orientation, religion, heritage, etc.; 
N.	take any action or upload, post, transmit, distribute, or communicate your or any person’s real-world personal information; 
O.	impersonate any person or entity, including, but not limited to, ZeniMax, ZeniMax’s partners’ or affiliates’ employees, or falsely state or otherwise misrepresent your affiliation with a person or entity; 
P.	take any action, organize, transmit any content, effectuate or participate in any activity, group, or guild that is harmful, tortuous, abusive, hateful (including “hate speech”), racially, ethnically, religiously or otherwise offensive, obscene, threatening, bullying, vulgar, sexually explicit, defamatory, libelous, infringing, invasive of personal privacy or publicity rights, encourages conduct that would violate a law or is, in a reasonable person's view, objectionable and/or deemed to be in the sole discretion of ZeniMax inappropriate;  
Q.	promote, upload, transmit, encourage or take part in any activity involving hacking, cracking, phishing, taking advantage of exploits or cheats and/or distribution of counterfeit software and/or Virtual Currency or virtual items.  In an effort to continuously improve the Game, you and other users/players discovering exploits, cheats, cracks or other inconsistencies are required to report them to ZeniMax; or 
R.	take any action or upload, post, transmit, promote, or distribute any content that may contain a Trojan horse, virus, worm, spyware, time bombs, cancelbots, corrupted data or other computer programs that you do not own or have permission to freely distribute that may damage, interfere with, intercept, expropriate or disrupt the Game.
Any attempt to do any of the foregoing is a breach of this Agreement and may be a violation of intellectual property rights in the Game.  If you breach these restrictions, you may be subject to prosecution and damages.  
The Game is licensed to you as a single product. Its component parts may not be separated for use on more than one computer.  The Game is licensed, not sold.  Your license confers no title or ownership in the Game or copies thereof.  
4.	OWNERSHIP OF THE GAME.  
ZeniMax and its licensors are and will continue to be the owner of all right, title, and interest in and to the Game and the Service, including without limitation all intellectual property rights and moral rights in and to the Game and all copies thereof (including without limitation any titles, software programs and code, Game related themes, characters, character names, character likenesses, stories, dialog, catch phrases, locations, concepts, artwork, character inventories, structural, landscape and other designs in the Game, animations, sounds, musical compositions and recordings, audio-visual effects, storylines, methods of operation, and any related documentation).  You shall take no action inconsistent with such title or ownership.  The Game is protected by the copyright laws of the United States, international treaties and conventions, and other laws.  The Game may contain materials licensed by third parties, and the licensors of those materials may enforce their rights in the event of any violation of this Agreement.  You acknowledge and agree that you have no interest, monetary or otherwise, in any feature or Content contained in the Game.  This paragraph will survive the termination of this Agreement.  
5.	COLLECTION AND USE OF DATA
YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THE ZENIMAX PRIVACY POLICY [https://bethesda.net/en/document/privacy-policy] WHICH EXPLAINS HOW WE MAY COLLECT, USE AND DISCLOSE DATA ABOUT YOU (INCLUDING PERSONAL DATA). IN PARTICULAR ZENIMAX WILL USE YOUR DATA (INCLUDING PERSONAL DATA) TO OPERATE THE SERVICES, TO FACILITATE PRODUCT SUPPORT, DEVELOPMENT AND IMPROVEMENT, TO TAILOR AND CUSTOMIZE YOUR EXPERIENCES AND UNDERSTAND WHICH ZENIMAX PRODUCTS YOU ARE USING, AS WELL AS TO PROVIDE OTHER SERVICES TO YOU.  YOU FURTHER ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD OUR COOKIE POLICY [http://bethesda.net/en/document/cookie-policy] AND AGREE THAT WE MAY USE COOKIES, WEB BEACONS AND OTHER ANALYTIC TECHNOLOGIES (HEREIN, COLLECTIVELY “COOKIES”) – INCLUDING THOSE PROVIDED BY THIRD PARTIES – TO COLLECT, USE, STORE AND TRANSMIT TECHNICAL AND OTHER INFORMATION REGARDING YOUR MOBILE OR OTHER DEVICE (INCLUDING MAC ADDRESS UNIQUE DEVICE ID OR OTHER IDENTIFIER, UDID, XUID, AND/OR PUID), GAME CENTER ID, GAME CENTER NAME, IP ADDRESS, GEO-LOCATION, DEVICE MAKE AND MODEL, OPERATING SYSTEM, SOFTWARE AND APPLICATIONS, GAME PLAY/USAGE DATA, THIRD PARTY ACCOUNT AUTHORIZATION DATA, SESSION DATA, BROWSER IDENTIFIERS, CONNECTION TYPE AND CARRIER INFORMATION.   YOU AGREE TO OUR USE OF COOKIES AS DESCRIBED HEREIN AND IN MORE DETAIL IN OUR COOKIE POLICY, WHICH EXPLAINS YOUR OPTIONS ON OUR USE OF COOKIES.

Le présent Contrat est conclu entre vous et ZeniMax Media Inc. (« ZeniMax »). 
TEL QUE PREVU A L'ARTICLE 1 DES CONDITIONS D'UTILISATION, SI VOUS RESIDEZ AU SEIN DE L'EEE, LE ROYAUME-UNI, LA SUISSE, LA RUSSIE, L'AUSTRALIE, LA NOUVELLE-ZELANDE, LA TURQUIE, LE JAPON OU LE BRESIL, ZENIMAX RECONNAIT QU'IL EXISTE CERTAINES GARANTIES, TERMES ET CONDITIONS (Y COMPRIS EN RELATION AVEC LES REMBOURSEMENTS ET RETOURS ET AVEC LES CLAUSES ABUSIVES) IMPOSEES PAR LA LOI EN RELATION AVEC LA FOURNITURE DE PRODUITS, SERVICES ET CONTENU DIGITAL QUE LA LOI INTERDIT EXPRESSEMENT D'EXCLURE, RESTREINDRE OU MODIFIER, OU QUI NE PUISSENT ETRE LIMITES QUE DANS UNE CERTAINE MESURE (LES « OBLIGATIONS LEGALES »).  RIEN DANS CE CLUF N'EXCLUT, NE RESTREINT OU NE MODIFIE LES OBLIGATIONS LEGALES AUTREMENT QU'EN CONFORMITE AVEC CES DERNIERES.
AVERTISSEMENT RELATIF A LA PHOTOSENSIBILITE : 
Un pourcentage très faible d'individus peut être sujet à des crises d'épilepsie ou à des évanouissements lorsqu'ils sont exposés à certaines images visuelles, y compris, sans toutefois s’y limiter, aux lumières ou clignotements.  Si vous présentez l'un des symptômes suivants en jouant au Jeu, arrêtez immédiatement de jouer et consultez votre médecin avant de reprendre le Jeu : évanouissements, crises d'épilepsie, vertiges, trouble de la vision, contraction des yeux ou des muscles, tremblements ou secousses des bras ou des jambes, perte de conscience, trouble de l'orientation, confusion, mouvements involontaires ou convulsions.
RÉALITE VIRTUELLE : CONSIGNES DE SANTÉ ET DE SÉCURITÉ ET LIMITATIONS DE RESPONSABILITÉ
Si le Logiciel permet le jeu en réalité virtuelle et/ou l'utilisation de casques de réalité virtuelle de tiers et/ou d'équipement apparenté, les consignes de santé et de sécurité suivantes ainsi que des limitations de responsabilité s'appliquent.  
La non-connaissance et le non-respect des consignes de santé et de sécurité exposées ci-dessous, ainsi que des consignes données par le fabricant de votre casque de réalité virtuelle, peuvent entraîner des dommages matériels, des dommages corporels envers vous ou des tiers, ou un décès.   
Comme avec tous les jeux de réalité virtuelle, veuillez lire et respecter toutes les consignes de santé et de sécurité du fabricant de votre casque de réalité virtuelle avant utilisation.  
VEUILLEZ LIRE ATTENTIVEMENT LES CONSIGNES SUIVANTES AVANT DE JOUER 
Veuillez noter que certaines personnes peuvent être sujettes à certains symptômes et certaines pathologies lorsqu'elles jouent avec un casque de réalité virtuelle, notamment :
•	crises d'épilepsie et perte de conscience ;
•	vision altérée ;
•	mal des transports, vertiges, désorientation ou nausée ; et/ou
•	blessures dues à des mouvements répétés et fatigue visuelle.
Cessez immédiatement de jouer si vous ne vous sentez pas bien ou si vous présentez l'un des symptômes ci-dessus.  
En tout état de cause, nous vous recommandons de faire des pauses raisonnables du jeu toutes les 10 à 15 minutes, et de ne pas jouer pendant des périodes excessivement longues.
Si vous êtes enceinte ou si vous avez un problème médical préexistant, vous devriez consulter votre médecin et obtenir un avis médical avant de jouer.  
Vous ne devriez pas jouer sous l'influence de l'alcool ou de drogues, ou d'un médicament en vente libre ou sur ordonnance. 
Prenez systématiquement conscience de votre environnement lorsque vous jouez.  Lorsque vous jouez avec un casque de réalité virtuelle ou tout autre casque, il est préférable de rester assis si cela est supporté par le jeu.  Puisque le jeu est une expérience immersive totale, vous pourriez ne pas voir ou entendre l'intégralité de votre environnement lorsque vous jouez.  Que vous restiez assis ou non pendant que vous jouez, installez-vous dans un espace suffisamment grand, et assurez-vous que la zone de jeu soit libre d'objets ou de personnes que vous pourriez percuter pendant le jeu.  Assurez-vous d'être dans un environnement sécurisé et loin d'escaliers, de balcons, de fenêtres, de murs, de meubles, d'objets sur lesquels vous pourriez trébucher ou d'autres objets ou personnes qui pourraient présenter un danger pour vous ou eux ou qui pourraient être endommagés ou vous blesser pendant le jeu.  Le volume devrait être maintenu à un niveau suffisamment bas pour entendre votre environnement lorsque vous jouez, et pour prévenir tout dommage à votre audition. 
VOUS DÉCHARGEZ ZENIMAX, SES FILIALES ET LEURS DIRIGEANTS, DIRECTEURS ET EMPLOYÉS RESPECTIFS DE TOUTE RESPONSABILITÉ LIÉE À L’UTILISATION D’UN CASQUE DE RÉALITÉ VIRTUELLE, D’UN ÉQUIPEMENT APPARENTÉ OU DU LOGICIEL.
ZeniMax ne peut en aucun cas être tenu responsable de dommages matériels, corporels ou mortels (ou de dommages directs, indirects, punitifs, accessoires ou consécutifs) résultant de l'utilisation ou de la mauvaise utilisation du logiciel ou de tout casque de réalité virtuelle ou équipement apparenté, y compris et sans limitation, découlant des interactions entre vous et d'autres personnes ou objets dans ou autour de l'aire de jeu pendant le jeu.  Vous comprenez que l'utilisation abusive du logiciel inclut (sans limitation) les violations des instructions ou des avertissements indiqués sur l'emballage, la documentation et les captures d'écran de votre casque de réalité virtuelle, dans ce document, dans toute autre documentation accompagnant le logiciel ou sur l'emballage du logiciel.  Si vous ne lisez pas attentivement ces instructions et avertissements et si vous ne les suivez pas, il existe un risque de dommages matériels, de blessure ou de mort.  Vous assumez et acceptez expressément tous les risques inhérents (ou qui peuvent être liés) à l'utilisation du Logiciel, et/ou du casque de réalité virtuelle ou d'un équipement apparenté.  Certains de ces risques, pas leur totalité, sont décrits dans les avertissements présentés ci-dessus ou dans les avertissements joints au Logiciel et au casque de réalité virtuelle.  Veuillez vous référer à la section intitulée "Limitation de Responsabilité" ci-dessous dans cet Accord.
Les Conditions d’Utilisation de ZeniMax contiennent une clause relative au Règlement des Litiges et à l’Arbitrage, comprenant une Renonciation aux Recours Collectifs (la « Clause de Litiges »), qui - si vous résidez en dehors de l’EEE, du Royaume-Uni, de la Suisse, de l’Australie, de la Nouvelle-Zélande, de la Turquie, du Japon ou du Brésil, dans un pays qui admet les recours collectifs ou toute autre forme d’action collective - affecte vos droits en vertu des Conditions d’Utilisation de ZeniMax et du présent Contrat de Licence d'Utilisateur Final concernant les différends que vous pourriez avoir avec ZeniMax.  Cette Clause de Litige est incorporée par référence dans le présent Contrat de Licence d'Utilisateur Final et fait partie intégrante du présent Contrat, comme si cette clause était intégralement reprise dans le présent Contrat.  Vous pouvez décider de ne pas être lié(e) par la procédure d’arbitrage individuel et par la renonciation aux recours collectifs, conformément aux Conditions d’Utilisation de ZeniMax.  
Tout usage du Jeu est régi par les termes du présent Contrat et les Conditions d'Utilisation de ZeniMax.  Les Conditions d’Utilisation de ZeniMax sont incorporées par référence dans le présent Contrat et font partie intégrante de ce dernier, comme si ces conditions étaient intégralement reprises dans le présent Contrat.  Le Contrat de Licence d'Utilisateur Final est un « CLUF » et constitue des « Conditions Supplémentaires » comme le prévoient les Conditions d’Utilisation de ZeniMax.  Le Jeu est disponible et distribué uniquement pour une utilisation par des utilisateurs finaux autorisés conformément aux termes du présent Contrat, y compris les Conditions d’Utilisation de ZeniMax.  Toute utilisation, reproduction, modification ou distribution du Jeu qui n'est pas expressément autorisée par les termes du présent Contrat est expressément interdite.  Vous acceptez que le Jeu, le Client de Jeu, tout autre logiciel relatif au Jeu, Contenu (tel que défini dans les Conditions d'Utilisation) spécifique au Jeu et votre accès et usage du Jeu soient tous un « Service » aux fins du présent Contrat, y compris les Conditions d’Utilisation de ZeniMax.  ZeniMax se réserve tous les droits qui ne vous sont pas accordés dans le présent Contrat. 
Vous reconnaissez que ZeniMax peut traiter vos données à caractère personnel conformément à la Politique de Confidentialité de ZeniMax qui est disponible sur https://bethesda.net/fr/privacypolicy et acceptez le Code de Conduite de ZeniMax disponible sur https://bethesda.net/fr/codeofconduct.  La Politique de Confidentialité et le Code de Conduite sont incorporés par référence dans le présent Contrat et en font partie intégrante, comme si ces documents étaient intégralement repris dans le présent Contrat.  L’ensemble des données personnelles collectées et traitées par ZeniMax dans le cadre du présent Contrat de Licence d'Utilisateur Final seront collectées et traitées conformément à la Politique de Confidentialité de ZeniMax. 
VOUS DEVRIEZ IMPRIMER UNE COPIE DU PRESENT CONTRAT DE LICENCE D'UTILISATEUR FINAL, DES CONDITIONS D'UTILISATION ET DU CODE DE CONDUITE POUR VOS ARCHIVES ET POUR CONSULTATION ULTERIEURE.
Tous les programmes logiciels et tout fichier qui vous sont délivrés ou qui sont mis à votre disposition par ZeniMax, directement ou indirectement par un revendeur ou distributeur autorisé ZeniMax (via accès en ligne, transmission, téléchargement ou autrement), y compris tout "patch", "installer", et toute mise à jour ou modification de ces programmes logiciels, et toute copie et œuvres dérivées de ces programmes logiciels (ensemble, avec le Client de Jeu (défini ci-dessous), le « Jeu ») est une œuvre protégée par droit d'auteur et copyright dont les titulaires sont ZeniMax et ses affiliées.   LE JEU VOUS EST CONCEDE EN LICENCE, ET NON PAS VENDU.  
1.	LICENCE LIMITEE ; RESTRICTIONS ET TITULARITE
Si vous acceptez le présent Contrat, vous pouvez, si applicable, télécharger, installer et utiliser le logiciel informatique (désigné ci-après le « Client de Jeu ») sur votre ordinateur ou votre console (désigné ci-après « l'Ordinateur ») dans l’unique but de jouer au Jeu.  Sous réserve du respect de l'ensemble des Conditions d'utilisation du présent Contrat, ZeniMax vous accorde et vous acceptez, par les présentes, une licence limitée, non transférable, non exclusive (a) pour télécharger, installer ou utiliser le Client de Jeu sur un ou plusieurs ordinateurs détenus par vous ou sous votre contrôle légitime à des seules fins de divertissement à usage non commercial, et (b) pour utiliser le Client de Jeu uniquement dans le cadre du Service.  
Les Conditions d’Utilisation de ZeniMax contiennent des termes et conditions applicables à la Monnaie Virtuelle (ainsi que ce terme est défini dans les Conditions d’Utilisation de ZeniMax), y compris des termes vous concédant une licence limitée non exclusive sur la Monnaie Virtuelle.  Ces termes et conditions s'appliquent à la Monnaie Virtuelle (le cas échéant) qui vous est concédée en licence pour une utilisation dans le Jeu.  
Sous réserve des Obligations Légales (telles que définies à l'Article 1 des Conditions d'Utilisation), le présent Contrat ne donne à aucun moment le droit d'obtenir des rééditions ou des remplacements du Jeu, et ZeniMax n'est pas tenue de fournir des mises à jour logicielles, améliorations ou extensions du Jeu, ni même d'opérer ou de continuer à maintenir le Jeu pour une période indéterminée.  
Comme décrit plus en détail dans les Conditions d’Utilisation de ZeniMax, mais sous réserve des Obligations Légales (telles que définies à l'Article 1 des Conditions d’Utilisation de ZeniMax), ZeniMax peut changer, modifier, interrompre ou cesser tout aspect du Jeu à tout moment, et ZeniMax peut également imposer des limites sur certaines fonctionnalités ou restreindre votre accès à certaines parties du Jeu sans préavis ou responsabilité.
Dans tous les cas, les licences qui vous sont concédées au titre du présent Contrat prendront fin à la première échéance entre la résiliation du présent Contrat et la clôture de votre compte auprès de ZeniMax.  
Les Conditions d’Utilisation de ZeniMax comprennent des termes et conditions applicables au Contenu généré par l'utilisateur, au Contenu téléchargeable et à tout autre Contenu, et vous acceptez de respecter ces termes et conditions. 
2.	MISES A JOUR LOGICIELLES, ANTI-PIRATAGE ET OUTILS DE SÉCURITÉ.  ZeniMax peut déployer ou fournir des correctifs, mises à jour, améliorations, mises à niveau et modifications au Jeu (« Mises à Jour ») que vous devez installer selon les indications données par ZeniMax, à sa discrétion, avant de pouvoir continuer de jouer au Jeu.  Toutes ces Mises à Jour font partie du Jeu aux fins du présent Contrat, des licences qui vous sont concédées et des Limitations de Licence prévues par le présent Contrat.  Les termes du présent Contrat s'appliqueront à toutes les Mises à Jour fournies par ZeniMax qui viennent remplacer et/ou suppléer le Jeu original, à moins que de telles Mises à Jour ne soient accompagnées d'un contrat de licence spécifique, auquel cas les termes dudit contrat de licence spécifique s'appliqueront. ZENIMAX A MIS EN PLACE DES OUTILS ET LOGICIELS (« OUTILS ANTI-PIRATAGE ») CRÉÉS POUR DÉTECTER ET PRÉVENIR LE PIRATAGE ET LA FRAUDE ; CES TECHNOLOGIES PEUVENT ÊTRE AMENÉES À SCANNER L'ORDINATEUR OU L'APPAREIL SUR LEQUEL VOUS TÉLÉCHARGEZ OU JOUEZ AU JEU AFIN DE DÉTECTER OU IDENTIFIER TOUT PROGRAMME OU PROCESSUS VISANT À « PIRATAGE », OBTENIR UN AVANTAGE INJUSTE DANS LE JEU OU CONTOURNER DE TOUTE MANIÈRE QUE CE SOIT LES PROCESSUS ET OUTILS  DE SÉCURITÉ, ANTI-PIRATAGE OU DE DÉTECTION DES FRAUDES QUE NOUS AVONS MIS EN PLACE (« PROGRAMMES DE PIRATAGE »). EN UTILISANT OU TÉLÉCHARGEANT LE JEU OU EN ACCEPTANT CE CONTRAT, VOUS RECONNAISSEZ ET AUTORISEZ EXPRESSÉMENT L'ACCÈS À VOTRE ORDINATEUR OU APPAREIL À CES OUTILS ANTI- PIRATAGE AFIN D'IDENTIFIER OU DE DÉTECTER DES PROGRAMMES DE PIRATAGE.
3.	LIMITATIONS ET RESTRICTIONS.
Le Jeu et/ou certaines fonctionnalités sont un Service fourni par ZeniMax et ne peuvent être utilisables qu'en ligne.  Dans ce cas, une connexion Internet permanente (qui n'est pas fournie par ZeniMax) est requise pour jouer au Jeu ou accéder à ces fonctionnalités.  Tous les frais et dépenses associés à l'acquisition de matériel informatique, de logiciels (par ex. navigateurs Internet) ou d'autres produits ou services nécessaires pour jouer au Jeu sont à votre charge.  
En sus des restrictions, conditions et limitations énoncées dans les Conditions d’Utilisation de ZeniMax et dans le Code de Conduite de ZeniMax, la licence qui vous est concédée dans le présent Contrat de Licence d'Utilisateur Final est soumise aux conditions, restrictions et limitations énoncées à l'Article 1 et au présent Article 3 du présent Contrat de Licence d'Utilisateur Final (collectivement, les « Limitations de Licence »). Toute utilisation du Jeu en violation de ces Limitations de Licence sera considéré comme une violation des droits d'auteurs de ZeniMax relatifs au Jeu et constituera une violation du présent Contrat.  Vous convenez que vous ne devrez en aucun cas (et n'aiderez aucune autre personne à) :
A.	en tout ou partie, distribuer, présenter ou afficher publiquement, vendre, transmettre, publier, éditer, reproduire, concéder en sous-licence, louer, prêter ou transférer de tout autre manière le Jeu ou le Contenu, y compris, sans limitation, toute clé d'accès ;
B.	en tout ou partie, modifier, adapter, traduire, procéder à une ingénierie inverse, tenter d'en déterminer le code source, désassembler, décompiler, ou créer des œuvres dérivées du Jeu ; sous réserve, toutefois, de ce que vous pouvez faire une (1) copie du Client de Jeu et des manuels qui l'accompagnent à des fins d'archivage uniquement et que vous pouvez installer le Client de Jeu concerné sur un ou plusieurs ordinateurs détenus par vous ou sous votre contrôle légitime comme décrit à l'Article 1 ci-dessus ; 
C.	retirer toute mention de propriété ou étiquette du Jeu ; ou tenter de quelque manière que ce soit de contourner toute mesure de sécurité destinée à contrôler l'accès à tout ou partie du Jeu ;  
D.	tricher (utilisation de « cheats »), utiliser des logiciels d'automatisation (bots), hacks, mods ou autres logiciels tiers non-autorisés destinés à modifier le Jeu ou nuire à l’utilisation du Jeu par toute autre personne ou à l’expérience qu’elle en retire ; 
E.	exploiter tout ou partie du Jeu, y compris, sans toutefois s’y limiter, le Client de Jeu, à des fins commerciales (y compris, sans toutefois s’y limiter, la location, la location-vente ou la concession de licence du Jeu à des tiers), y compris, sans toutefois s’y limiter, pour (a) collecter de la Monnaie Virtuelle (telle que définie dans les Conditions d’Utilisation de ZeniMax), des articles ou des ressources dans le but de les vendre en dehors du Jeu ; ou (b) assurer des services dans le Jeu en échange d’un paiement en dehors du Jeu, p. ex., power-leveling ; 
F.	utiliser un quelconque logiciel tiers non autorisé qui intercepte, recherche (« mining ») ou collecte de toute autre manière des informations à travers le Jeu ou le Service ou relatives au Jeu ou au Service, y compris, sans toutefois s’y limiter, tout logiciel qui lit des parties de mémoire vive (RAM) utilisées par le Jeu pour stocker les informations portant sur un personnage ou l'environnement du jeu ; sous réserve toutefois que ZeniMax peut, à sa seule et entière discrétion, permettre l’utilisation de certaines interfaces de tiers et d’autres logiciels de tiers ; 
G.	modifier ou faire modifier tout fichier faisant partie du Client de Jeu d'une manière qui ne soit pas expressément autorisée par ZeniMax ; 
H.	héberger, fournir ou développer des services de mise en relation de joueurs pour le Jeu ou intercepter, émuler ou rediriger les protocoles de communication utilisés par ZeniMax de quelque façon et à quelque fin que ce soit, y compris, sans toutefois s’y limiter, tout jeu non autorisé sur Internet, utilisation non autorisée en réseau ou dans le cadre de réseaux agrégateurs de contenus ;   
I.	faciliter, créer ou maintenir toute connexion non autorisée au Jeu ou au Service, y compris, sans toutefois s’y limiter, (a) toute connexion à un serveur non autorisé qui émule, ou tente d'émuler, le Service ; et (b) toute connexion utilisant des programmes ou outils qui ne sont pas expressément approuvés par ZeniMax ; 
J.	effectuer toute action ou télécharger, publier, transmettre, promouvoir, ou distribuer tout contenu illicite ; 
K.	effectuer toute action ou télécharger, publier, transmettre, promouvoir, ou distribuer tout contenu qui enfreint ou viole tout droit de tiers ; 
L.	être impliqué dans, effectuer toute action associée à, ou participer à toute forme de sollicitation d’enfant, de séduction d’enfant, de pédophilie, ou de comportement prédateur sous quelque forme que ce soit ;  
M.	harceler, traquer, menacer, gêner, envoyer des courriers indésirables (« spams »), ou faire quoi que ce soit d’importun à un autre utilisateur du Jeu, tel que l’envoi répété de messages non sollicités, ou la formulation d’attaques personnelles ou de déclarations fondées sur la race, l’orientation sexuelle, la religion, les origines, etc. ; 
N.	effectuer toute action ou télécharger, publier, transmettre, distribuer ou communiquer vos données à caractère personnel réelles ou celles d’un tiers ; 
O.	usurper l’identité de toute personne physique ou morale, notamment ZeniMax, les salariés des partenaires et affiliés de ZeniMax, ou faire de fausses déclarations ou tromper de toute autre manière au sujet de votre affiliation à une personne physique ou morale ; 
P.	effectuer toute action, organiser, transmettre tout contenu, réaliser ou participer à tout(e) activité, groupe ou association qui serait préjudiciable, tortueux, abusif, haineux (notamment les « discours de haine »), raciste, offensant d’un point de vue ethnique, religieux ou autrement, obscène, menaçant, intimidant, vulgaire, sexuellement explicite, diffamant, portant atteinte à un droit quelconque, à la vie privée ou aux droits de la personnalité, encourage un comportement qui violerait une loi ou est, du point de vue d’une personne raisonnable, répréhensible et/ou est réputée être inappropriée, à l’entière discrétion de ZeniMax ;  
Q.	promouvoir, télécharger, transmettre, encourager ou prendre part à toute activité qui implique le piratage, le craquage informatique, le hameçonnage (« phishing »), le fait de profiter d’exploits ou d’outils de triche et/ou la distribution de logiciels et/ou de Monnaie Virtuelle ou d’éléments virtuels contrefaits.  Afin d’améliorer continuellement le Jeu, si vous et les autres utilisateurs/joueurs découvrez des exploits, des outils de triche, des craquages informatiques ou toute autre incohérence, vous êtes tenus de les signaler à ZeniMax ; ou 
R.	effectuer toute action ou télécharger, publier, transmettre, promouvoir, ou distribuer tout contenu qui peut contenir un cheval de Troie, un virus, un ver informatique, un logiciel espion, une bombe à retardement (« time bomb »), un robot d’annulation (« cancelbots »), des fichiers corrompus ou d’autres programmes informatiques que vous ne possédez pas ou que vous n’êtes pas autorisés à distribuer librement qui pourraient endommager, interférer avec, intercepter, exproprier ou perturber le Jeu.
Toute tentative d’effectuer l’une quelconque de ces actions est une violation du présent Contrat et peut constituer une violation de droits de propriété intellectuelle relatifs au Jeu.  Si vous violez ces restrictions, des poursuites pourront être engagées contre vous.  
Le Jeu vous est concédé en licence comme un produit unique. Les éléments le composant ne peuvent être séparées pour une utilisation sur plus d'un ordinateur.  Le Jeu est concédé en licence, et non vendu.  Votre licence ne vous confère aucun droit de propriété sur le Jeu ou ses copies.  
4.	DROITS DE PROPRIETE SUR LE JEU  
ZeniMax et ses concédants de licence sont et continueront d'être titulaires de tous droits, titres et intérêts relatifs au Jeu et au Service, y compris, sans toutefois s’y limiter, tous les droits de propriété intellectuelle et droits moraux relatifs au Jeu et à toutes les copies de celui-ci (y compris, sans toutefois s’y limiter, tous les titres, programmes logiciels et codes, thèmes relatifs au Jeu, personnages, noms de personnage, apparence des personnages, histoires, dialogues, phrases d'accroche, lieux, concepts, illustrations, inventaires de personnage, conceptions de structure, de paysage ou autre dans le Jeu, animations, sons, compositions et enregistrements musicaux, effets audiovisuels, scenarios, méthodes de fonctionnement et toute documentation associée).  Vous ne prendrez aucune mesure non-conforme avec de tels titres ou droits de propriété.  Le Jeu est protégé par les lois sur le copyright des États-Unis, les conventions et traités internationaux et par d'autres lois.  Le Jeu peut contenir des éléments concédés sous licence par des tiers et les concédants de licence de ces éléments peuvent faire valoir leurs droits en cas de violation du présent Contrat.  Vous acceptez et reconnaissez que vous n'avez aucun intérêt, monétaire ou autre, sur un quelconque élément ou Contenu figurant dans le Jeu.  Le présent Article restera en vigueur après la résiliation du présent Contrat.

DE PLUS, VOUS RECONNAISSEZ QUE VOUS AVEZ LU ET COMPRIS NOTRE POLITIQUE DE COOKIES [http://bethesda.net/fr/document/cookie-policy] ET ACCEPTEZ QUE NOUS PUISSIONS UTILISER DES COOKIES, DES BALISES INTERNET (WEB BEACONS) ET D’AUTRES TECHNOLOGIES ANALYTIQUES (CI-APRÈS COLLECTIVEMENT DÉSIGNÉS « COOKIES ») - Y COMPRIS CEUX FOURNIS PAR DES TIERS - POUR COLLECTER, UTILISER, STOCKER ET TRANSMETTRE DES INFORMATIONS TECHNIQUES ET AUTRES QUI CONCERNENT VOTRE APPAREIL MOBILE OU TOUT AUTRE APPAREIL (DONT L’ID UNIQUE DE L’ADRESSE MAC DE L’APPAREIL OU UN AUTRE IDENTIFIANT, L’UDID, LE XUID, ET/OU LE PUID), L’ID DU GAME CENTER, LE NOM DU GAME CENTER, L’ADRESSE IP, LA GÉO-LOCALISATION, ET LA MARQUE ET LE MODÈLE DE L’APPAREIL, LE SYSTÈME D’EXPLOITATION, LES LOGICIELS ET LES APPLICATIONS, DES DONNÉES SUR LE JEU/L’UTILISATION DU JEU, DES DONNÉES D’AUTORISATION DE COMPTES TIERS, DES DONNÉES DE SESSION, DES IDENTIFIANTS DE NAVIGATEUR, LE TYPE DE CONNEXION ET DES INFORMATIONS SUR L’OPÉRATEUR.   VOUS CONSENTEZ À NOTRE UTILISATION DES COOKIES TELLE QUE DÉCRITE CI-AVANT AINSI QUE PLUS PRÉCISÉMENT DANS NOTRE POLITIQUE DE COOKIES, QUI EXPLIQUE LES OPTIONS QUI S’OFFRENT À VOUS EN LIEN AVEC NOTRE UTILISATION DES COOKIES.

You also acknowledge and understand that ZeniMax offers the Game and conducts business in many countries.  As a result, personal information collected from or submitted by you through a Game or otherwise may be transferred to and stored on servers and equipment located in a destination outside your country of residence.  The servers and equipment on which your data is stored and processed may be owned and operated by third parties with whom ZeniMax has contracted to receive, store and process your personal information.  ZeniMax and those third parties that ZeniMax has designated, may further transfer, store and process your personal information on servers and equipment located in other countries. You should be aware that the data protection laws of other countries may not be the same as the data protection laws of your country of residence. This Section 5 shall survive the termination of this Agreement. 
6.	MONITORING AND UPDATES.	
If you request any technical support from ZeniMax, subject to your consent ZeniMax may remotely access and review the computer onto which you have loaded the Game Client for purposes of providing technical support and debugging.  As further described in the ZeniMax Terms of Service, ZeniMax may update the Game remotely including without limitation the Game Client residing on your computer, and you hereby grant to ZeniMax your consent to deploy and apply such Updates.  
You understand and agree that (a) any and all Game related character data is stored and is resident on ZeniMax computers and servers and (b) any and all communications that you make within the Game (including, but not limited to, messages solely directed at another player or group of players) traverse through ZeniMax computers and servers and may or may not be monitored by ZeniMax or ZeniMax’s agents.  You expressly consent to such monitoring of such communications that you send and receive.  The ZeniMax Terms of Service and the ZeniMax Privacy Policy include further terms and conditions applicable to the accessing, monitoring and recording of activities and communications on and relating to the Service, including but not limited to when ZeniMax may report incidents to law enforcement and other authorities. All personal data collected and processing by ZeniMax as part of the activities set out in this clause 6 will be collected and processing accordance with the ZeniMax Privacy Policy[https://bethesda.net/#/privacypolicy] and the terms of the Agreement.   
7.	TERMINATION.  
This End User License Agreement starts at the time you accept this End User License Agreement and it will remain effective until terminated.  You may terminate this End User License Agreement at any time by (i) permanently destroying all copies of the Game in your possession or control and (ii) removing the Game Client from your hard drive.  Subject to the Statutory Obligations (as defined in Section 1 of the ZeniMax Terms of Service),  ZeniMax may terminate this End User License Agreement at any time for any reason or no reason (including at such time as ZeniMax elects to discontinue offering the Game).  Upon termination by ZeniMax for any reason, all licenses granted in this Agreement (including in the ZeniMax Terms of Service) with respect to the Game that is the subject of this End User License Agreement shall immediately terminate and you must immediately do (i) and (ii) above.  Termination for no reason will be communicated to you by ZeniMax.  
8.	EXPORT RESTRICTIONS.  
The Game may not be exported, re-exported, downloaded or otherwise transferred (i) to or into (collectively, an “Export”) any country which requires an Export license or which the United States Government prohibits Exports, including any such country subject to economic sanctions or (ii) to any person or entity prohibited from receiving goods or services of U.S. origin.  You represent and warrant that you are not located in, under the control of, or a national or resident of any such country or on any such list.  This Section 8 will survive the termination of this Agreement.
9.	WARRANTY.  
If you, the original purchaser, purchased the Game on a physical media (such as a disc) your use of the Game is subject to the limited warranty included with the manual or other packaging material that came with your purchase.
THE ZENIMAX TERMS OF SERVICE INCLUDE PROVISIONS REGARDING THE DISCLAIMER OF REPRESENTATIONS, WARRANTIES AND GUARANTEES (SUBJECT TO THE STATUTORY OBLIGATIONS (AS DEFINED IN SECTION 1 OF THE ZENIMAX TERMS OF SERVICE)) AND SUCH PROVISIONS ARE INCORPORATED INTO THIS END USER LICENSE AGREEMENT BY THIS REFERENCE AND FORMS A PART OF THIS END USER LICENSE AGREEMENT AS IF SUCH PROVISIONS WERE FULLY RESTATED IN THIS END USER LICENSE AGREEMENT.  THIS SECTION 9  SHALL SURVIVE THE TERMINATION OF THIS AGREEMENT.
With respect to software that is enabled for use on or over the Internet, you acknowledge that ZeniMax is not responsible for the Internet or whether it should continue to exist in its present form or whether or not a government or governmental agency, either foreign or domestic, will control, regulate or disband the Internet.  Use of the Internet is at your sole risk.
10.	LIMITATION OF LIABILITY, REIMBURSEMENT.
To the maximum extent permitted by applicable law, and subject to the Statutory Obligations (as defined in Section 1 of the Terms of Service), IN NO EVENT SHALL ZENIMAX OR ANY OF LICENSORS BE LIABLE FOR ANY (I) SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, EXEMPLARY OR OTHER INDIRECT DAMAGES, (II) THIRD PARTY CLAIMS, OR (III) LOSS OR DAMAGE TO ANY SYSTEMS, HARDWARE OR SOFTWARE, RECORDS OR DATA, EVEN IF ADVISED OF OR AWARE OF THE POSSIBILITY OF ANY SUCH DAMAGES AND EVEN IF A LIMITED REMEDY IN THIS AGREEMENT FAILS OF ITS ESSENTIAL PURPOSE.  
SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY.  ACCORDINGLY, SOME OF THE ABOVE MAY NOT APPLY TO YOU.
THE ZENIMAX TERMS OF SERVICE INCLUDE OTHER PROVISIONS REGARDING THE LIMITATION OF LIABILITY AND REMEDIES (SUBJECT TO THE STATUTORY OBLIGATIONS (AS DEFINED IN SECTION 1 OF THE ZENIMAX TERMS OF SERVICE)) AND SUCH PROVISIONS ARE INCORPORATED INTO THIS END USER LICENSE AGREEMENT BY THIS REFERENCE AND FORMS A PART OF THIS END USER LICENSE AGREEMENT AS IF SUCH PROVISIONS WERE FULLY RESTATED IN THIS END USER LICENSE AGREEMENT.  
If (i) you misuse the Game Service or breach this Agreement or (ii) any contributions, actions or omissions by you in connection with your use of the Game Service results in ZeniMax incurring any liabilities, damages, losses, costs and expenses (including without limitation attorneys’ fees and court costs), then you agree to reimburse ZeniMax and its affiliates and other participants of the Service from all such liabilities, damages, losses, costs and expenses.  If a third party sues ZeniMax for either or both of (i) or (ii) above, ZeniMax reserves the right to control the defense and settlement of such third party lawsuit, and you agree to reimburse ZeniMax for the cost of the defense, including, but not limited to, reasonable and documented attorneys’ fees. 
This Section 10 shall survive termination of this Agreement.  
11.	CHANGES TO THE AGREEMENT.  ZeniMax may replace this End User License Agreement with new versions (each a “New EULA”) over time as the Game and the law evolve.  This End User License Agreement will terminate immediately upon the introduction of a New EULA, and you will be given an opportunity to review the New EULA in accordance with the change provisions set out in the ZeniMax Terms of Service.  New EULAs will not be applied retroactively.  Your continued use of the Software and play of the Game after a modification of the EULA will be deemed as your acceptance of any modified terms.
12.	U.S. GOVERNMENT RESTRICTED RIGHTS.  The Game is a Commercial Item developed exclusively at private expense and comprised of “commercial computer software” and “commercial computer software documentation”, as these terms are defined in the applicable acquisition regulations, including without limitation the Federal Acquisition Regulation (“FAR”) at 48 C.F.R. 2.101.  The Game is licensed to U.S. Government End Users subject to the terms of this Agreement, as specified in 48 C.F.R. 12.212 (Computer Software) and 12.211 (Technical Data) ( for civilian agencies), and as specified in 48 C.F.R. 227.7202-3 and 48 C.F.R. 227.7202-4, consistent with 48 C.F.R. 227.7202 (for Department of Defense entities).  Solely with respect to the U.S. Government’s rights in the Game, this U.S. Government License Rights clause is in lieu of, and supersedes, any other FAR, DFARS, or other clause or provision of the contract under which this Game is obtained.  The Manufacturer is ZeniMax.  
13.	GOVERNING LAW.
For residents of North America, this Agreement and all Disputes (as defined in the Disputes Provision) shall be governed by the laws of the State of Delaware, USA, excluding its conflicts of laws rules and principles that would result in another State’s or country’s laws applying to this Agreement or any Disputes, and excluding the United Nations Convention on Contracts for the International Sale of Goods, the Uniform Computer Information Transactions Act (“UCITA”), and any laws based on UCITA.  For clarity, the terms in this paragraph shall control over any conflicting terms in the ZeniMax Terms of Service, including without limitation any terms that would result in another State’s or country’s laws applying to this Agreement or any Disputes.
If you reside outside of North America, then this Agreement and all Disputes shall be governed by the laws of England, excluding its conflicts-of-law rules and principles that would result in another State or country’s laws applying to this Agreement or any Disputes, and excluding the United Nations Convention on Contracts for the International Sale of Goods.  Local mandatory laws may be applied.
Notwithstanding the Disputes Provision, you agree that ZeniMax shall be entitled to injunctive relief, specific performance and equitable remedies with respect to breaches of Sections 1 or 3 of this Agreement, in addition to such other remedies as ZeniMax may otherwise have under applicable law.  
This Section 13 will survive the termination of this Agreement.
14.	MISCELLANEOUS.  This End User License Agreement along with the ZeniMax Terms of Service, ZeniMax Privacy Policy and the ZeniMax Code of Conduct constitute and contain the entire agreement between you and ZeniMax with respect to the subject matter hereof and supersedes any prior oral or written agreements. This End User License Agreement shall coexist with, and shall not supersede, the ZeniMax Terms of Service or the ZeniMax Privacy Policy.  To the extent that the provisions of this End User License Agreement conflict with the provisions of the ZeniMax Terms of Service, and unless expressly indicated otherwise in this Agreement, the conflicting provisions in this End User License Agreement shall control and shall govern.  Except as specifically provided in the Disputes Provision, if any part of this Agreement is held invalid or unenforceable, that portion shall be interpreted in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of such part, and the remaining portions of this Agreement shall remain in full force and effect.  The failure of ZeniMax to exercise or enforce any right or provision of this Agreement will not constitute waiver of such right or provision.  Any waiver of any provision of this Agreement will be effective only if in a writing signed by ZeniMax.  You agree that this Agreement and ZeniMax’s enforcement of this Agreement, are not intended to confer and do not confer any rights or remedies upon any person other than you and ZeniMax.  This Section 14 shall survive the termination of this Agreement for any reason.  
I hereby acknowledge that I have read and understand all the terms and conditions in this Agreement and agree that by clicking “Agree”, installing the Game Client or otherwise playing the Game I am acknowledging my agreement to be bound by all the terms and conditions of this Agreement, which includes my express consent of ZeniMax’s use of Anti-Tamper Tools as described herein.

En conséquence, les informations personnelles que nous recueillons auprès de vous ou que vous envoyez par l’intermédiaire d’un Jeu ou autrement peuvent être transférées et stockées sur des serveurs et du matériel situés en dehors de votre pays de résidence.  Les serveurs et le matériel sur lesquels vos données sont stockées et traitées peuvent appartenir à des tiers qui en assurent l’exploitation et auxquels ZeniMax a sous-traité la réception, le stockage et le traitement de vos informations personnelles.  ZeniMax et les tiers qu’elle a désignés, peuvent à leur tour transférer, stocker et traiter vos informations personnelles sur des serveurs et du matériel situés dans d’autres pays. Vous devez savoir que la législation d’autres pays sur la protection des données n’est pas nécessairement la même que celle en vigueur dans votre pays de résidence. Le présent article 5 restera en vigueur après la résiliation ou la fin du présent Contrat. 
6.	SURVEILLANCE ET MISE A JOUR.	
Si vous demandez une assistance technique de la part de ZeniMax, sous réserve de votre consentement, ZeniMax pourra accéder à distance et examiner l'ordinateur sur lequel vous avez chargé le Client de Jeu dans le but de vous fournir une assistance technique et pour le débogage.  Comme décrit plus en détail dans les Conditions d’Utilisation de ZeniMax, ZeniMax pourra mettre à jour le Jeu à distance, notamment le Client de Jeu résidant sur votre ordinateur, et vous accordez par la présente à ZeniMax votre consentement pour le déploiement et l'application de telles Mises à Jour.  
Vous comprenez et acceptez que (a) toutes les données de personnage associées au Jeu sont stockées et enregistrées sur les ordinateurs et serveurs de ZeniMax et (b) toutes les communications que vous faites dans le Jeu (y compris, sans toutefois s’y limiter, les messages uniquement destinés à un autre joueur ou groupe de joueurs) transitent par les ordinateurs ou serveurs ZeniMax et puissent être ou non suivies par ZeniMax ou les agents de ZeniMax.  Vous consentez expressément au suivi de telles communications que vous envoyez ou recevez.  Les Conditions d’Utilisation de ZeniMax et la Politique de Confidentialité de ZeniMax comprennent d’autres conditions applicables à l'accès, au suivi et à l'enregistrement d'activités et de communications sur ou en lien avec le Service, y compris, sans toutefois s’y limiter, lorsque ZeniMax signale des incidents aux services de police ou à d’autres autorités. Toute donnée personnelle collectée et traitée par ZeniMax comme activité définie dans cette clause 6 sera collectée et traitée en accord avec la Politique de Confidentialité de ZeniMax [https://bethesda.net/#/privacypolicy] et les Conditions d’Utilisation.   
7.	RESILIATION  
Le présent Contrat de Licence d'Utilisateur Final prend effet à la date à laquelle vous acceptez le présent Contrat et restera en vigueur jusqu'à sa résiliation.  Vous pouvez résilier le Contrat à tout moment en (i) détruisant de façon permanente toutes les copies du Jeu en votre possession ou sous votre contrôle et (ii) supprimant le Client de Jeu de votre disque dur.  Sous réserve des Obligations Légales (telles que définies à l'Article 1 des Conditions d’Utilisation de ZeniMax), ZeniMax pourra résilier le présent Contrat de Licence d'Utilisateur Final à tout moment pour quelque raison que ce soit ou même sans raison (y compris dès lors que ZeniMax choisit de cesser de proposer le Jeu).  À la résiliation par ZeniMax du présent Contrat pour quelque raison que ce soit, toutes les licences concédées aux présentes seront immédiatement résiliées et vous devrez procéder sans délai aux opérations (i) et (ii) ci-dessus.  La résiliation sans motif vous sera communiquée par ZeniMax.  
8.	CONTROLE DES EXPORTATIONS.  
Le Jeu ne peut pas être exporté, ré-exporté, téléchargé ou transféré d'une quelconque manière (i) vers ou dans (ensemble, une « Exportation ») un pays qui requiert une licence d'Exportation ou vers lequel le gouvernement des États-Unis interdit les Exportations, y compris les pays soumis à des sanctions économiques ou (ii) à toute personne ou entité qui n'a pas été autorisée à recevoir des produits ou des services provenant des États-Unis.  Vous déclarez et garantissez que vous ne vous trouvez pas dans un tel pays, que vous n'êtes pas sous le contrôle d'un tel pays et que vous n'êtes pas ressortissant ou résident d'un tel pays et que vous ne figurez pas sur une telle liste.  Le présent Article 8 restera en vigueur après la résiliation du présent Contrat.
9.	GARANTIE.  
Si vous, l’acheteur d’origine, avez acheté le Jeu sur un support physique (tel qu’un disque) votre utilisation du Jeu est soumise à la garantie limitée fournie avec le manuel ou tout autre matériau d’emballage fourni avec votre achat.
LES CONDITIONS D’UTILISATION DE ZENIMAX CONTIENNENT DES STIPULATIONS CONCERNANT L’EXCLUSION DES DECLARATIONS ET GARANTIES (SOUS RESERVE DES OBLIGATIONS LEGALES (TELLES QUE DEFINIES A L’ARTICLE 1 DES CONDITIONS D’UTILISATION DE ZENIMAX)) ET CES STIPULATIONS SONT INCORPOREES DANS LE PRESENT CONTRAT PAR REFERENCE ET FONT PARTIE INTEGRANTE DU PRESENT CONTRAT, COMME SI CES STIPULATIONS ETAIENT INTEGRALEMENT REPRISES DANS LE PRESENT CONTRAT.  LE PRESENT ARTICLE 9 RESTERA EN VIGUEUR APRES LA RESILIATION DU PRESENT CONTRAT.
En ce qui concerne le logiciel qui est conçu pour un usage sur et par Internet, vous reconnaissez que ZeniMax ne saurait être responsable d'Internet ou du point de savoir s'il devrait continuer à exister en sa forme actuelle ou si un gouvernement ou une agence gouvernementale, qu'elle soit étrangère ou non, contrôlera, règlementera ou démantèlera Internet.  L'utilisation d'Internet se fait à vos propres risques.
10.	LIMITE DE RESPONSABILITE, INDEMNISATION.
Dans les limites autorisées par la loi, et sous réserve des Obligations Légales (telles que définies à l'Article 1 des Conditions d'Utilisation), EN AUCUN CAS ZENIMAX OU L’UN QUELCONQUE DE SES CONCEDANTS DE LICENCE NE SERONT RESPONSABLES (I) D’UN QUELCONQUE DOMMAGE SPECIAL, ACCESSOIRE, CONSECUTIF, PUNITIF, EXEMPLAIRE OU TOUT AUTRE DOMMAGE INDIRECT, (II) D’UNE QUELCONQUE RECLAMATION DE TIERS, OU (III) D’UNE QUELCONQUE PERTE OU D’UN QUELCONQUE DOMMAGE A TOUT SYSTEME, MACHINE OU LOGICIEL, REGISTRES OU DONNEES, MEME SI ILS ONT ETE AVERTIS OU AVAIENT CONNAISSANCE DE LA POSSIBILITE DE TELS DOMMAGES, ET MEME SI UN RECOURS LIMITE DANS LE PRESENT CONTRAT NE PERMET PAS DE REMPLIR SON OBJET ESSENTIEL.  
CERTAINS PAYS INTERDISENT LES LIMITATIONS OU EXCLUSIONS DE RESPONSABILITE.  EN CONSEQUENCE, CERTAINES STIPULATIONS CI-DESSUS PEUVENT NE PAS S’APPLIQUER À VOUS.
LES CONDITIONS D’UTILISATION DE ZENIMAX CONTIENNENT D'AUTRES STIPULATIONS CONCERNANT LA LIMITATION DE RESPONSABILITE ET LES RECOURS (SOUS RESERVE DES OBLIGATIONS LEGALES (TELLES QUE DEFINIES A L’ARTICLE 1 DES CONDITIONS D’UTILISATION DE ZENIMAX)) ET CES STIPULATIONS SONT INCORPOREES DANS LE PRESENT CONTRAT PAR REFERENCE ET FONT PARTIE INTEGRANTE DU PRESENT CONTRAT, COMME SI CES STIPULATIONS ETAIENT INTEGRALEMENT REPRISES DANS LE PRESENT CONTRAT.  
Si (i) vous faites une mauvaise utilisation du Service de Jeu ou violez le présent Contrat ou (ii) une quelconque contribution, action ou omission de votre part en relation avec votre utilisation du Service de Jeu résulte en un dommage, responsabilité, perte, coût ou dépense pour ZeniMax (y compris, sans toutefois s’y limiter, les honoraires d'avocats et frais judiciaires), vous acceptez de rembourser ZeniMax et ses affiliés et autres participants aux Services pour ces dommages, responsabilités, pertes, coûts et dépenses.  Si un tiers agit contre ZeniMax en justice pour l'un des motifs susmentionnés (i) ou (ii) ou les deux, ZeniMax se réserve le droit de contrôler la défense et le règlement d'une telle action en justice de tiers, et vous acceptez de rembourser à ZeniMax les coûts de la défense, y compris, sans toutefois s’y limiter, les honoraires d'avocats raisonnables et avec justificatif. 
Le présent Article 10 restera en vigueur après la résiliation du présent Contrat.  
11.	MODIFICATIONS DU CONTRAT.  ZeniMax peut remplacer le présent Contrat par de nouvelles versions (chacune étant un « Nouveau CLUF ») au fur et à mesure que le Jeu et la législation évoluent.  Le présent Contrat sera résilié immédiatement lors de l'introduction d'un Nouveau CLUF et vous aurez la possibilité d'examiner le Nouveau CLUF conformément aux stipulations relatives aux modifications, énoncées dans les Conditions d’Utilisation de ZeniMax.  Les nouveaux CLUF ne s'appliqueront pas rétroactivement.  Le fait que vous continuiez à utiliser le Jeu après avoir été informé(e) d’un Nouveau CLUF vaudra acceptation du Nouveau CLUF.
12.	DROITS RESTREINTS DE L'ADMINISTRATION DES ETATS-UNIS.  Le Jeu est un article commercial développé exclusivement avec des fonds privés et comprenant un « logiciel commercial » et de la « documentation sur le logiciel commercial », tels que ces termes sont définis dans les règlementations d’acquisition en vigueur, y compris, sans toutefois s’y limiter, la Federal Acquisition Regulation (« FAR ») à l’article 48 C.F.R. 2.101.  Le Jeu est concédé sous licence aux utilisateurs finaux du gouvernement des États-Unis, sous réserve des stipulations du présent Contrat, conformément aux articles 48 C.F.R. 12.212 (logiciel) et 12.211 (données techniques) (pour les agences civiles), ainsi qu’aux articles 48 C.F.R. 227.7202-3 et 48 C.F.R. 227.7202-4, en accord avec l’article 48 C.F.R. 227.7202 (pour les entités du Département de la Défense).  Concernant uniquement les droits de l'administration des États-Unis sur le Jeu, le présent Article relatif aux droits de licence du gouvernement des États-Unis remplace tout autre FAR, DFARS ou toute autre clause ou stipulation du contrat en vertu desquels ce Jeu est obtenu.  Le fabricant est ZeniMax.  
13.	LOI APPLICABLE.
Pour les résidents d'Amérique du Nord, le présent Contrat et tous les Litiges (tels que définis dans la Clause de Litiges) seront régis par les lois de l'État du Delaware, États-Unis, à l'exclusion de ses règles et principes de conflit de lois qui entraîneraient l'application de lois d'un autre État ou pays au présent Contrat ou à un Litige, exclusion faite de la Convention des Nations unies sur les contrats de vente internationale de marchandises, l'Uniform Computer Information Transactions Act (« UCITA ») et toutes les lois qui en découlent.  Par souci de clarté, les termes de ce paragraphe prévaudront sur tous les termes contradictoires des Conditions d’utilisation de ZeniMax, y compris et sans limitation, ceux qui entraineraient l'application des lois d’un autre État ou pays au présent Contrat ou à tout Litige.
Si vous ne résidez pas en Amérique du Nord, le présent Contrat et tous les Litiges seront régis par le droit anglais, à l'exclusion de ses règles et principes de conflit de lois qui entraîneraient l'application de lois d'un autre État ou pays au présent Contrat ou à un Litige, exclusion faite de la Convention des Nations unies sur les contrats de vente internationale de marchandises.  Des dispositions locales obligatoires peuvent s’appliquer.
Nonobstant la Clause de Litiges, vous acceptez que ZeniMax ait le droit de recourir à des mesures d'injonction, d'exécution forcée et à des recours en équité concernant le non-respect des Articles 1 ou 3 du présent Contrat, en plus des autres recours dont dispose ZeniMax en vertu de la loi applicable.  
Le présent Article 13 restera en vigueur après la résiliation du présent Contrat.
14.	DIVERS.  Le présent Contrat, avec les Conditions d’Utilisation de ZeniMax, la Politique de Confidentialité de ZeniMax et le Code de Conduite de ZeniMax, constituent et contiennent l'intégralité de l'accord entre vous et ZeniMax concernant l’objet des présentes et remplacent tout accord oral ou écrit antérieur. Le présent Contrat coexistera avec les Conditions d'Utilisation et le Code de Conduite et ne les remplacera pas.  Dans la mesure où les stipulations du présent Contrat seraient contraires aux stipulations des Conditions d'Utilisation, et sauf indication contraire expresse dans le présent Contrat, les stipulations contradictoires énoncées dans le présent Contrat prévaudront et s'appliqueront.  Sauf dans les cas prévus expressément par la Clause de Litiges, si une partie du présent Contrat est jugée invalide ou inapplicable, ladite partie sera interprétée dans un sens conforme à la loi applicable afin de refléter, autant que possible, les intentions initiales de ladite partie, et les autres parties du présent Contrat resteront pleinement en vigueur et continueront de produire leurs effets.  Le fait que ZeniMax n'exerce pas ou ne fasse pas valoir un droit ou une stipulation du présent Contrat ne saurait constituer une renonciation à ce droit ou à cette stipulation.  Toute renonciation à une stipulation du présent Contrat ne prendra effet que si elle est formulée par écrit et signée par ZeniMax.  Vous acceptez que le présent Contrat et l'application du présent Contrat par ZeniMax ne visent pas à conférer et ne confèrent ni droit ni recours à une quelconque personne autre que vous-même et ZeniMax.  Le présent Article 14 restera en vigueur après la résiliation du présent Contrat.  
Je reconnais par les présentes avoir lu et compris l'ensemble des stipulations du présent Contrat, et j'accepte qu'en cliquant sur « Accepter », en téléchargeant ou installant le Jeu, je donne mon consentement à être lié(e) par les stipulations du présent Contrat, y compris mon autorisation expresse à l'usage des Outils Anti-Piratage de ZeniMax comme décrit précédemment.
