These Terms of Use, together with our Privacy Policy and all supplemental terms and other documents referenced in these terms as amended from time to time (together, the "Terms") govern your downloading and/or use of our Games, Virtual Content (each as defined below), applications, websites and any other services made available by us from time to time (together, the "Services").

1 ABOUT US

1.1 We are 10:10 Games Limited, a company registered in England and Wales under company number 13443989, and whose registered offices are at Fourth Floor, Unit 5b The Parklands, Bolton, United Kingdom, BL6 4SD.  In these Terms, we will refer to ourselves as "we", "us", "our" or "10:10 Games".

1.2 Per “Giochi” intendiamo i giochi sviluppati o messi di volta in volta a vostra disposizione da noi, tra cui Funko Fusion.

1.2 When we refer to our "Games", we are referring to any games developed or made available by us and made available to you from time to time including Funko Fusion.

1.3 Non garantiamo la fornitura ininterrotta dei nostri Servizi o che i nostri Servizi siano sempre disponibili, ovunque o in un dato momento o che continueremo a offrire tali Servizi per una durata specifica.

2.1 Please read these terms carefully as they form a legally binding contract between you and 10:10 Games and govern your use of our Services.  By accessing or using any of our Services, you accept and agree to these Terms.  If you do not agree to these Terms, you may not access, purchase or use our Services. Whilst you should read these Terms in full, please pay particular attention to:

• Licence (section 5). When you use and/or purchase one of our Services, you receive a licence to use that Service. You do not own any of the Services provided to you.  
• Community Guidelines (section 9). You agree that you will follow the Community Guidelines relating to your conduct while using our Services.

3 CHI SIETE

3.1 Utilizzando i nostri Servizi, dichiarate di (i) avere almeno 18 anni o, se avete meno di 18 anni, che avete preso visione delle presenti Condizioni insieme al(i) vostro(i) genitore(i) o tutore(i) e che questi ultimi le hanno accettate per vostro conto e si assumono la piena responsabilità del loro rispetto da parte vostra. Se un genitore/tutore ci informa che il(la) proprio(a) figlio(a) ha mentito sulla propria età al momento della registrazione e/o dell’utilizzo dei nostri Servizi, Chiuderemo il suo Account (come qui di seguito definito) a condizione che disponiamo di informazioni sufficienti in merito al fatto che la persona che ha effettuato la segnalazione sia effettivamente il genitore o il tutore di quel(quella) ragazzo(a). Dichiarate altresì che avete l’età minima per acconsentire al trattamento dei dati ai sensi delle leggi in vigore nella vostra giurisdizione (per es. 13 anni negli Stati Uniti e 16 anni in alcune giurisdizioni dell’UE) e che non vi è precluso l’accesso ai Servizi ai sensi della legge applicabile.
 
3.2 Se un sistema di valutazione dell’età applicabile (per es. PEGI, ESRB) o piattaforma (per es. Steam) classifica un determinato Gioco come adatto solo agli utenti di un’età specifica, in tali circostanze, gli utenti aventi un’età inferiore a quella classificata non avranno diritto a giocare o ad accedere a quel determinato Gioco fino a quando non avranno raggiunto l’età specificata nella classificazione.

3 ABOUT YOU

3.1 By using our Services, you agree that you (i) are at least 18 years of age, or (ii) if you are younger than 18, that you have reviewed these Terms with your parent(s) or guardian(s) and they have agreed to these Terms on your behalf and take full responsibility for your compliance with them. If we are informed by a parent/guardian that their child has misrepresented their age when registering for and/or using our Services, we will Stop their Account (as defined below) provided we have information which satisfies us that the reporting person is indeed the parent or guardian of that child. You also represent that you are at least the minimum age to consent to data processing under the laws of your jurisdiction (e.g. 13 years old in the United States and 16 years old in some EU jurisdictions) and are not barred from accessing the Services under applicable law.

3.2 Where an applicable age rating body (e.g. PEGI, ESRB) or platform (e.g. Steam) classifies a particular Game as suitable to be played only by users of a specified age then, in such circumstances, users below this classified age shall not be entitled to play, use or access the particular Game until they have reached the specified age classification.

3.4 Per i Genitori/Tutori Vi invitiamo a prendere conoscenza dei sistemi di controllo genitori disponibili nei dispositivi e sulle piattaforme su cui sono offerti i nostri Giochi. Questi sistemi di controllo possono essere utilizzati per limitare la quantità di tempo trascorso e di denaro spesa giocando e per gestire le funzionalità, quali la messaggistica utente-utente. 4 IL VOSTRO ACCOUNT

3.3 If you access our Services through a third-party platform or site, you may be required to comply with their terms and conditions in addition to these Terms, please read these carefully.

4.1 Per accedere ai nostri Servizi, vi potrebbe essere richiesto di creare un account presso di noi e/o presso una piattaforma di terzi (per es. Steam) o il gestore di un sito (“Account”).
 
4.2 Quando create il vostro Account, dovete scegliere e conservare le vostre credenziali di accesso (il vostro username e la vostra password). 3.4 For Parents/Guardians. Please familiarise yourself with any parental controls available on the devices and platforms on which our Games our offered. These controls may be used to limit the amount of time and money spent on the Game and manage features such as user-to-user messaging. To find out more about parental controls, in most cases the manufacturer of the relevant device and the provider of the platform will include further guidance on their respective websites. 4 YOUR ACCOUNT

4.1 You may be required to make an account with us and/or with a third-party platform (e.g. Steam) or site operator to access our Services ("Account"). 

4.3 Dovete assicurarvi di:

• Non vendere, trasferire o altrimenti fornire l’accesso al vostro Account a nessuno. 
• Mantenere segrete le credenziali del vostro Account.
 
4.4 Essere l’unico responsabile di tutta l’attività svolta sul vostro Account, anche quando un’altra persona ha effettuato l’accesso al vostro Account nel caso in cui abbiate condiviso con lei le vostre credenziali di accesso (intenzionalmente o involontariamente). 10:10 Games declina ogni responsabilità per le eventuali perdite o gli eventuali danni da voi subiti a causa dell’uso non autorizzato del vostro Account o di qualsiasi account di terzi che voi utilizzate per accedere ai nostri Servizi. Ci riserviamo il diritto di modificare il nome del vostro Account qualora dovessimo ritenere che il vostro Account o qualsiasi account di terzi da voi utilizzato per accedere ai nostri Servizi utilizza nickname e/o profili ingiuriosi, offensivi o diffamatori.

4.2 When you create your Account, you must choose and maintain your login details (including your username and password). Your Account must include truthful and accurate information about yourself (e.g. your name) and this information must be kept up to date.

4.5 Per “Chiudere” o “Chiusura” dell’Account intendiamo disabilitare, sospendere o bloccare, temporaneamente o permanentemente, un Account (incluso un account su una piattaforma di terzi che voi avete utilizzato per accedere ai nostri Servizi). Se il vostro Account è disabilitato o bloccato, non potrete accedervi e le licenze di utilizzare i nostri Servizi che vi sono state precedentemente concesse saranno temporaneamente o permanentemente revocate.
 
4.6 Potremo Chiudere il vostro Account se:

• You do not share your Account details with anyone.
• You do not sell, transfer or otherwise provide access to your Account to anyone. 
• You keep your Account details secret. 

4.7 Faremo sempre del nostro meglio per darvi un ragionevole preavviso prima di Chiudere il vostro Account. Tuttavia, se avete commesso una grave violazione delle nostre Condizioni o vi sono stati già inviati degli avvertimenti, potremo Chiudere immediatamente il vostro Account. In tali circostanze, ve lo comunicheremo per iscritto via e-mail o all’interno dei Servizi come opportuno e la licenza concessa nelle presenti Condizioni sarà revocata e voi dovete cessare di utilizzare tutti i relativi Servizi.

4.4 You are solely responsible for all activity on your Account, including where your Account has been accessed by another person if you have shared your login details (intentionally or unintentionally). 10:10 Games accepts no responsibility for any losses or harm you suffer from any unauthorised use of your Account or any third-party account that you use to access our Services. We reserve the right to change your Account name if we find that your Account or any third-party account you use to access our Services uses abusive, offensive, or defamatory screen names and/or personas.

4.8 Vi preghiamo di contattarci immediatamente all’indirizzo [email protected] se ritenete che qualcuno abbia rubato il vostro Account o credete che qualcuno diverso da voi abbia ottenuto l’accesso al vostro Account.
 
5 PIATTAFORME DI TERZI
 
5.1 I nostri Servizi potrebbero essere forniti tramite una piattaforma di terzi, ivi comprese alcune piattaforme di gioco (per es. Steam), che avranno i propri termini e condizioni che voi dovrete accettare prima di utilizzare detta piattaforma. Tali termini e condizioni costituiranno un contratto separato tra voi e la piattaforma in questione e si aggiungeranno alle presenti Condizioni. Anche se avete acquistato i nostri Servizi separatamente da un terzo, dovete accettare le presenti Condizioni prima di utilizzarli.
 
5.2 Qualsiasi violazione delle condizioni e delle regole di una piattaforma di terzi o di un editore terzo sarà considerata una violazione delle presenti Condizioni da parte vostra e noi potremo Chiudere il vostro Account.
5.3	Se i nostri Servizi contengono dei link a, e si collegano a, altri servizi e risorse forniti da terzi, noi non abbiamo alcun controllo sul contenuto di tali servizi o risorse e non prestiamo alcuna garanzia né rendiamo alcuna dichiarazione in merito alla legittimità, accuratezza o qualità di tali servizi o risorse di terzi. La visita da parte vostra di siti esterni cliccando su un link presente sui nostri Servizi è interamente a vostro rischio. Decliniamo ogni responsabilità per il loro contenuto, il loro comportamento, la loro sicurezza o il loro trattamento dei vostri dati personali.

4.5 When we refer to "Stopping" or to "Stop" Account, this includes temporarily or permanently disabling, suspending or banning an Account (including a third-party platform account that you have used to access our Services). If your Account is disabled or banned, you will not be able to access your Account and any licences previously granted to you to use our Services will be either temporarily or permanently revoked. 

6 LICENZA 

6.1 Se accettate e rispettate le presenti Condizioni, vi concediamo una licenza personale, limitata, non trasferibile, non sublicenziabile, revocabile e non esclusiva di utilizzare i nostri Servizi per vostro uso personale e non commerciale. Se Chiudiamo il vostro Account, la vostra licenza d’uso dei nostri Servizi terminerà.
  
6.2 10:10 Games è la titolare esclusiva di tutta la proprietà intellettuale e gli altri diritti sui Servizi. Non avete alcun diritto di proprietà, titolo o altro diritto reale sui Servizi, indipendentemente dal fatto che abbiate acquisito e/o acquistato i nostri Servizi.

4.6 We may Stop your Account if:

7 CONTENUTI VIRTUALI

7.1 Nell’utilizzare i nostri Giochi, potreste avere l’opportunità di acquistare o acquisire contenuti di gioco aggiuntivi, cosmetici di gioco, oggetti virtuali e valute virtuali che possono essere utilizzati per acquistare altri contenuti da utilizzare all’interno dei nostri Giochi (da noi denominati “Contenuti Virtuali”). I Contenuti Virtuali che ottenete o di cui fate uso all’interno dei nostri Servizi sono soggetti alle presenti Condizioni.
  
7.2 Quando ricevete Contenuti Virtuali, vi concediamo una licenza limitata, non trasferibile, non sublicenziabile, revocabile e non esclusiva di accedere ai Contenuti Virtuali in questione. Non avete alcun diritto di proprietà sui Contenuti Virtuali che ottenete.
 
7.3 Non vi è consentito vendere, commerciare o trasferire i Contenuti Virtuali ad altre persone o scambiarli con denaro reale, beni o servizi o qualsiasi altra cosa esterna ai Servizi. Vi è fatto rigoroso divieto di utilizzare i Contenuti Virtuali come posta in una scommessa o puntata con chiunque altro.
 
7.4 Abbiamo il diritto di rimuovere, modificare o cambiare il prezzo dei Contenuti Virtuali in qualsiasi momento per qualunque motivo nella misura consentita dalla legge.
 
7.5 Tutti gli acquisti di Contenuti Virtuali sono definitivi e non rimborsabili, salvo diversamente richiesto dalla legge applicabile.

• You have breached these Terms (including our Community Guidelines below).
• We reasonably believe it is necessary in order to prevent or stop any harm or damage to us, to any of our Services, to other users of our Services, to the general public, or to you.
• We no longer provide the Services for which you have an Account (we will give you reasonable notice before this happens).
4.7 We will always do our best to give you reasonable notice before Stopping your Account. However, if you have seriously breached our Terms or have been issued with previous warnings, we may immediately Stop your Account. Under such circumstances we will notify you in writing by email or within the Services as appropriate and the licence granted in these Terms will terminate and you must cease all use of the applicable Services.

8 I VOSTRI DIRITTI E LE VOSTRE RESPONSABILITÀ

8.1 Vi impegnate a risarcirci se dovessimo essere costretti a pagare dei danni o se dovessimo subire altre perdite o incorrere in spese (incluse le spese legali) a causa di un reclamo presentato da un terzo in merito a una violazione delle presenti Condizioni da voi commessa, da qualsiasi vostro utilizzo contrario ad altre leggi e disposizioni o tale da pregiudicare i diritti di un terzo. 

4.8 Please contact us immediately at [email protected] if you believe that someone has stolen your Account or you believe someone other than you has gained access to your Account. 

8.2 Dovete rispettare le leggi applicabili a voi nel Paese o Stato in cui vivete o da cui accedete ai nostri Servizi. Dovete smettere di utilizzare i nostri Servizi se una qualsiasi legge applicabile a voi dovesse limitare l’utilizzo da parte vostra dei nostri Servizi o vietarvelo.

5 THIRD PARTY PLATFORMS 

5.1 Our Services may be provided through a third-party platform, including game platforms (e.g. Steam) which will have their own terms and conditions which you will need to agree to before using that platform. Those terms and conditions will form a separate agreement between you and the relevant platform and are in addition to these Terms. Even if you have purchased our Services separately from a third party, you must accept these Terms before you may use our Services. 

8.3 Il vostro dispositivo potrebbe dover rispettare alcuni requisiti di hardware, software e rete per utilizzare i nostri Giochi. È possibile accedere ai nostri Giochi anche su alcune piattaforme (come Steam). Non possiamo garantire che i nostri Giochi funzionino o siano compatibili con un particolare dispositivo, piattaforma, sistema operativo o apparecchiatura o in combinazione con altri software o servizi di connettività o che i nostri Servizi siano disponibili ovunque. Le specifiche tecniche minime e le informazioni sulla compatibilità sono disponibili nello store in cui acquistate i nostri Giochi.

5.2 Any breach of the terms and rules of any third-party platform or publisher shall be deemed to be a breach of these Terms by you and we may Stop your Account.

8.4 Quando apportiamo delle modifiche ai nostri Servizi, potremmo chiedervi di installare patch, aggiornamenti ed eventualmente contenuti aggiuntivi affinché possiate continuare a utilizzare i nostri Servizi. 5.3 Where our Services contain links to, and connect with, other services and resources provided by third parties, we have no control over the content of those services or resources and we make no warranties or representations as to the legitimacy, accuracy or quality of such third-party services or resources. Any external site that you visit by clicking through a link on the Services is entirely at your own risk. We accept no responsibility for their content, behaviour, safety or treatment of your personal data.

9 LINEE GUIDA DELLA COMMUNITY

9.1 Quando utilizzate i nostri Servizi, avete la possibilità di interagire con altri utenti dei Servizi.  Vogliamo assicurarci che i nostri Giochi siano un ambiente sicuro, divertente e inclusivo, quindi abbiamo pubblicato le presenti Linee guida della community che tutti gli utenti devono rispettare.  Le presenti Linee guida della community hanno lo scopo di assicurare che i nostri utenti agiscano con gentilezza e rispetto e che non utilizzino i nostri Servizi per fini illeciti.  Accettando le presenti Condizioni, vi impegnate a rispettare anche le Linee guida della community.  Qualsiasi violazione delle Linee guida della community sarà considerata una violazione delle presenti Condizioni e potrà determinare la Chiusura del vostro Account.

6 LICENCE 

6.1 By agreeing to and complying with these Terms, we grant you a personal, limited, non-transferable, non-sub-licensable, revocable and non-exclusive licence to use our Services for your own personal and non-commercial use. If we Stop your Account, your licence to use our Services will end.  

9.2 Vi impegnate a non utilizzare i Servizi (o qualsiasi piattaforma di terzi da voi utilizzata per accedere ai nostri Servizi) per:
• utilizzare o consentire l’utilizzo dei Servizi per finalità o attività illegali, fraudolente o in violazione delle presenti Condizioni;
• riprodurre, diffondere, esporre o rappresentare in pubblico, tradurre, modificare, adattare, creare opere derivate da, decostruire, decodificare, decompilare o disassemblare in qualsiasi modo i Servizi o una loro parte; 
• vendere, acquistare, commerciare o altrimenti cedere od offrire di cedere il vostro Account, qualsiasi accesso personale ai nostri Servizi, o i contenuti associati al vostro Account, inclusi i Contenuti Virtuali, all’interno dei nostri Servizi o su un sito web di terzi, o in relazione a qualsiasi transazione esterna al gioco; 
• accedere o tentare di accedere agli Account di altri utenti o penetrare o tentare di penetrare le misure di sicurezza relative ai Servizi; 
• promuovere la violenza o la discriminazione, promuovere o sostenere attività illegali o altrimenti essere sgradevole; 
• molestare, minacciare, ingannare, umiliare, inviare messaggi indesiderati o compiere qualsiasi altro atto sgradito nei confronti di un’altra persona o fare attacchi personali o dichiarazioni riguardanti la razza, l’orientamento sessuale o la religione; 
• organizzare o partecipare a un’attività o a un gruppo lesivo, ingiurioso, offensivo, osceno, minaccioso, intimidatorio, volgare, sessualmente esplicito (inclusa la nudità e qualsiasi forma di esposizione inappropriata), diffamatorio, invasivo della privacy personale o che incoraggia una condotta tale da violare una legge o che, a ragionevole giudizio di una persona, è sgradevole e/o inappropriato;
• utilizzare nickname e/o profili ingiuriosi, offensivi o diffamatori, a prescindere dal fatto che siano creati attraverso i nostri Servizi o tramite dispositivi o piattaforme di terzi.
• caricare file contenenti virus, trojan, worm, spyware, sistemi di disattivazione a tempo, dati corrotti o altri programmi informatici che possono danneggiare, interferire con o interrompere uno dei Servizi.
• violare i diritti di terzi, tra cui (senza limitazione alcuna) i diritti d’autore, i marchi di fabbrica, i brevetti, i diritti sui disegni, i diritti morali, i diritti alla privacy, i diritti di pubblicità o qualsiasi altro diritto di proprietà;
• caricare pubblicità, promozioni o inviti a carattere commerciale di qualsiasi natura, tra cui (senza limitazione alcuna) posta indesiderata, e-mail spazzatura, catene di Sant’Antonio, schemi a piramide o simili;
• utilizzare i nostri Servizi per realizzare un servizio o un gioco tale da fare concorrenza ai nostri Servizi o aiutare un’altra persona a realizzare un servizio o un gioco tale da fare concorrenza ai nostri Servizi.
• tentare o pretendere di spacciarsi per una persona o mentire sulla vostra identità, il vostro legame o il vostro rapporto con un’altra persona;
• controllare, scansionare o testare la vulnerabilità dei nostri Servizi o eludere o violare le misure di sicurezza o di autenticazione dei nostri Servizi;
• utilizzare in modo improprio l’assistenza interna al gioco o i pulsanti di reclamo o inviarci segnalazioni false;
• utilizzare qualsiasi robot, spider, applicazione di ricerca/reperimento di siti o altro dispositivo manuale o automatico o processo per reperire, indicizzare, “estrarre dati” o in qualsiasi modo riprodurre o eludere i contenuti, la struttura di navigazione o la presentazione dei nostri Servizi; 
• utilizzare, sviluppare, ospitare o diffondere trucchi, software di automazione (“bot”), lobby modificate, violazioni, mod o altri software di terzi non autorizzati in relazione ai Servizi, o prendere parte a qualsiasi forma di trucco, esecuzione di bot, potenziamento o avvio, o altrimenti tentare di eludere le misure tecnologiche volte a controllare gli accessi ai, o gli elementi dei, nostri Servizi;
• compiere qualsiasi atto che, a nostro giudizio, vìola o può violare lo spirito delle presenti Condizioni.

5 OUR RIGHTS AND RESPONSIBILITIES 

We cannot guarantee that our Services will be available at all times, and we may have to pause your access to our Services to complete any maintenance, repairs or upgrades. We will try to let you know as soon as possible if we plan to pause access to one of our Services and make our Services available as soon as we can. We may also stop providing certain Services in the future (including if we shut down one of our games) but we will try to give you as much notice as possible before we do this.

You understand that if your account is deleted for any reason, you will no longer have access to your account data (including game progress and Virtual Content). 

8 SUSPENDING YOUR ACCESS TO OUR SERVICES

We can suspend your accounts with us and/or your access to our Services if we believe you are in breach of these terms. If you are suspended, we will investigate your breach and, depending on our findings, either lift the suspension or ban you from using our Services without any refund.

Our games may only be accessed through third-party platforms (including Steam, Epic Games Store, PlayStation 4 and 5, and Xbox Series X/S and Nintendo Switch). These platforms will have their own terms and conditions which you will need to read and agree to in order to access our games on that platform. If you breach the platform's terms, we will treat that breach as a breach of these terms. 

If any of our Services link to another website or platform, we have no control over the content of that website or platform. Therefore, we are not responsible for that third party content, and you visit these third party websites and platforms at your own risk.
