                appreciates your interest in Konami’s application entitled
                agradece o seu interesse na aplicação da Konami intitulada
                 “eFootball™” 
                (together with any Materials,
                (juntamente com quaisquer Materiais, conforme abaixo definido, a “Aplicação”). Ao aceder ou utilizar a Aplicação, concorda em cumprir estes termos e condições (“Termos da Konami”), além dos termos e condições fornecidos pelos Plataformistas (“Termos da Plataforma”). Se não concordar com os Termos da Konami e com os Termos da Plataforma, não poderá aceder ou utilizar a Aplicação. Note-se que a Konami não é afiliada aos Platformers, não tem controlo sobre os Termos da Plataforma; e não é responsável pelos actos ou omissões do Platformer e que a Konami é a única responsável pela Aplicação e não pelos Platformers. Para os fins destes termos, “Platformers” significa o provedor da Plataforma, e “Plataforma” significa a plataforma através da qual o utilizador acede ou usa a aplicação.<br><br>AFIRMA QUE TEM CAPACIDADE LEGAL PARA ENTRAR NOS TERMOS DA KONAMI, SE NÃO TEM CAPACIDADE LEGAL, (1) TEM DE OBTER O CONSENTIMENTO PARENTAL OU DO GUARDIÃO LEGAL, OU (2)  O SEU PROGENITOR OU GUARDIÃO LEGAL TEM DE AGIR EM SEU NOME, PARA ENTRAR NOS TERMOS DA KONAMI. TEM DE CONFIRMAR OS TERMOS DA KONAMI COM O SEU PROGENITOR OU GUARDIÃO LEGAL, SE VIVE NUM DOS PAÍSES OU REGIÕES, E TEM AS IDADES, SEPARADAMENTE DESIGNADAS PELA KONAMI. TEM DE CONCORDAR QUE O SEU ID DE UTILIZADOR EMITIDO DE ACORDO COM OS “Termos e Condições do site de diversão eletrónica” PARA MENORES (“CONTA DE CRIANÇAS”) ESTÁ VINCULADO AO ID DE UTILIZADOR DO SEU PROGENITOR OU GUARDIÃO LEGAL, PARA EFEITOS DE CONTROLO PARENTAL.<br><br>Sem isto, não poderá utilizar a Aplicação a não ser que os termos da plataforma permitam que aceda e utilize a mesma. Pode utilizar a Aplicação apenas em conformidade com os Termos da Plataforma e os Termos da Konami.<br><br>Quaisquer informações ou dados pessoais recolhidos e usados pela Konami em relação à sua utilização da aplicação serão geridas de acordo com a política de privacidade da Konami ou com a notificação de privacidade que lhe foi apresentada separadamente.<br><br>1. Propriedade intelectual e licença.                 titular desse direito; (f) relacionado com álcool ou a venda de produtos de tabaco, munições ou armas de fogo; ou (g) relacionado com apostas ou jogos de azar.<br><br>-  Qualquer material que possa dar lugar a responsabilidade civil ou penal; que incentive condutas que possa constituir um delito penal; ou que incentive ou proporcione instruções sobre atividades ilegais ou atividades tais como “invasão”, “quebra” ou “discussão”.<br><br>-  Qualquer vírus, worm, cavalo de Troia, ovo de Páscoa, bomba de tempo, spyware ou outro código de computador, ficheiro ou programa que seja potencialmente prejudicial ou invasivo ou possa ou tenha a intenção de danificar ou sequestrar o funcionamento ou monitorizar a utilização de qualquer hardware, software ou equipamento.<br><br>-  Qualquer publicidade não solicitada ou não autorizada, materiais promocionais, “lixo eletrónico”, “spam”, “cartas em cadeia”, “esquema de pirâmide”, oportunidade de inversão ou qualquer outra forma de solicitação.<br><br>-  Quaisquer informações privadas materiais sobre uma empresa sem a devida autorização para o fazer.<br><br>• Usa a Aplicação para qualquer finalidade fraudulenta ou ilegal, incluindo qualquer ato ou tentativa de pagamento realizado através da conexão à aplicação.<br><br>• Tenta obter para si ou para qualquer outra pessoa qualquer vantagem injusta em relação ao uso da Aplicação, incluindo pelo uso de cheats, exploits, software de automação, bots, hacks, mods ou qualquer software de terceiros não autorizados, ou através da exploração de quaisquer defeitos ou erros na Aplicação. Também concorda em não informar qualquer pessoa (que não a Konami) de tais defeitos ou erros.<br><br>• Utiliza a Aplicação em conexão com a criação ou assistência na conceção de cheats, software de automação, bots, hacks, mods ou qualquer outro software de terceiros não autorizado.<br><br>• Utiliza a Aplicação para difamar, abusar, assediar, perseguir, ameaçar ou violar os direitos legais de outros, incluindo, sem limitação, direitos de privacidade ou direitos de publicidade de outros, ou recolher informações pessoalmente identificáveis sobre outros utilizadores da Aplicação.<br><br>• Personifica qualquer pessoa ou entidade, incluindo, sem limitação, qualquer representante da Konami; declara falsamente ou deturpa a sua afiliação com qualquer pessoa ou entidade em conexão com a Aplicação; ou expressa ou sugere que a

                apoia qualquer declaração que faça.<br><br>• Interferir ou perturbar o funcionamento da Aplicação ou dos servidores ou redes utilizados para disponibilizar a Aplicação, incluindo, sem limitação, tomar qualquer ação que imponha uma carga não razoável ou desproporcionadamente grande sobre a Aplicação ou sobre tais servidores ou redes; ou violar quaisquer requisitos, procedimentos, políticas ou regulamentos de tais redes.<br><br>• Restringe ou inibe qualquer outra pessoa de utilizar a Aplicação (incluindo, sem limitação, por hacking ou deformação de qualquer parte da Aplicação).<br><br>• Usa a Aplicação para anunciar ou oferecer a venda ou compra de bens ou serviços.<br><br>• Licencia, sublicencia, transfere, cede, reproduz, duplica, copia, vende, revende, distribui ou explora para quaisquer fins comerciais, qualquer parte, uso da ou acesso à Aplicação.<br><br>• Reproduzir, modificar, adaptar, publicar, distribuir, difundir, criar trabalhos derivados de, traduzir, efetuar engenharia inversa, descompilar ou desmontar qualquer porção da aplicação sem a aprovação prévia da Konami.<br><br>• Remove quaisquer direitos de autor, marcas comerciais ou outros avisos de direitos de propriedade da Aplicação ou de materiais provenientes da Aplicação.<br><br>• Enquadre ou espelhe qualquer parte da Aplicação sem o consentimento prévio por escrito expresso da Konami.<br><br>• Cria uma base de dados através da transferência e armazenamento de Materiais de forma sistemática.<br><br>• Utilizar qualquer robô, aranha (spider), aplicação de pesquisa/recuperação do site ou outro dispositivo manual ou automático para recuperar, indexar, “raspar”, “mina de dados” ou de qualquer forma recolher Materiais ou reproduzir ou contornar a estrutura de navegação ou apresentação da Aplicação sem o expresso consentimento prévio por escrito da Konami.<br><br>• Prostituir uma criança, explorar uma criança para pornografia ou praticar atos suscetíveis de constituir abuso de menores; ou praticar atos que terão ou poderão ter uma má influência ou encorajar um mau comportamento entre pessoas com menos de 20 anos de idade (incluindo encorajar essas pessoas a beber, fumar ou jogar, publicar informações relacionadas com a indústria de entretenimento adulto ou sexual e solicitar o acesso a sites impróprios para uso próprio). <br><br>• Envolver-se em atos que encorajem ou auxiliem o suicídio ou a toxicodependência, ou qualquer ato que conduza a reuniões para efeitos de atos sexuais ou obscenos. <br><br>• Procura uma relação com outra pessoa ou execute ações de uma forma que a

Compras de Bens Virtuais. A Aplicação pode fornecer-lhe uma oportunidade para adquirir licenças pessoais, limitadas, revogáveis e intransmissíveis para aceder a e usar os bens virtuais (coletivamente “Bens Virtuais”) exclusivamente dentro da Aplicação e unicamente para os seus fins pessoais e não comerciais. Estas aquisições podem ser efetuadas utilizando uma moeda virtual (por exemplo, moedas virtuais, tokens ou pontos) (“Moeda Virtual”) ganha ou adquirida através da Aplicação ou de um dos fornecedores de moeda virtual aprovados pela Konami. Deve realizar o pagamento através de um método especificado separadamente por nós. A Konami não será obrigada a fornecer-lhe reembolsos, benefícios ou outra compensação, exetuando nos casos em que exista alguma violação por parte da Konami dos presentes termos devido a negligência intencional ou grave da mesma. Não pode sublicenciar, alugar, emprestar, vender, presentear, legar, trocar, transferir ou fornecer a utilização ou acesso a quaisquer Bens Virtuais e/ou Moeda Virtual, exceto conforme fornecidos expressamente pela Konami, e qualquer ato ou tentativa de ato desse tipo é proibido e nulo. Não pode tentar usar ou aceder a quaisquer Bens Virtuais e/ou Moeda Virtual não licenciados por nós ou adquirido pessoalmente por si de nós ou de fornecedores de moeda terceiros aprovados pela Konami. Se deixar um saldo de Moeda Virtual adquirida sem uso durante um período de tempo ou se terminarmos ou suspendermos o seu acesso e/ou utilização à Aplicação, podemos processar o seu saldo de acordo com as obrigações legais da Konami, incluindo submeter os fundos associados à sua Moeda Virtual adquirida e ao órgão administrador onde for exigido pela lei aplicável.<br><br>4. Comprar e Utilizar a Moeda Virtual. Se pretender adquirir Moeda Virtual disponibilizados pela Konami através da Aplicação (cada compra desse tipo denomina-se uma “Transação”), pode ser-lhe pedido que forneça determinadas informações relevantes para a sua Transação. Tais informações podem incluir o seu número de cartão de crédito e a sua data de validade e a morada de faturação, bem como outras informações associadas aos métodos de pagamento do proprietário. A compra e o uso de Moeda Virtual são regidos pelos Termos e Condições dos “Termos de uso da Moeda Virtual” que se encontram na Aplicação. DEMONSTRA E GARANTE QUE TEM O DIREITO LEGAL DE USAR QUALQUER MÉTODO DE PAGAMENTO UTILIZADO EM CONEXÃO COM QUALQUER TRANSAÇÃO E QUE CUMPRE QUAISQUER TERMOS E CONDIÇÕES APLICÁVEIS A TAIS MÉTODOS DE PAGAMENTO, E CONCORDA QUE É RESPONSÁVEL POR QUALQUER UTILIZAÇÃO DOS SEUS MÉTODOS DE PAGAMENTO POR MENORES. Com respeito a qualquer registo deste tipo, a Konami pode recusar-se a conceder-lhe, e não pode utilizar, um ID de conta (ou endereço de e-mail) que já esteja a ser utilizado por outra pessoa; que possa ser interpretado como fazendo-se passar por outra pessoa; que pertença a outra pessoa; que o identifique pessoalmente; que viole a propriedade intelectual ou outros direitos de qualquer pessoa; que seja ofensivo; ou que a Konami rejeite por qualquer outro motivo à discrição exclusiva da Konami. Não poderá registar um ID de conta em nome de qualquer outro indivíduo. Manifesta e garante que toda a informação que envie em relação a algum tipo de registo (incluindo, sem limitação, a informação relacionada com a sua identidade) seja precisa e completa, e que não tenha sido restringido anteriormente o acesso ou o uso de qualquer sítio web da Konami, ou de outros bens, ou qualquer jogo de Internet Konami ou outra aplicação.<br><br>O seu ID de conta e senha são apenas para seu uso pessoal, e não para utilização por qualquer outra pessoa. Não poderá sublicenciar, arrendar, emprestar, vender, oferecer, legar, negociar, transferir ou fornecer uso ou acesso a quaisquer IDs ou passwords de conta ou definições de conta associadas (incluindo qualquer informação relacionada com o jogo), exceto conforme expressamente fornecido pela Konami, e qualquer ato ou tentativa de ato deste tipo é proibido e nulo. The Application, including information and materials available in the Application, which may include video games and other software applications, and all components thereof such as audio-visual materials, Virtual Currency (as defined below) and Virtual Goods (as defined below) (collectively, “Materials”) are protected by copyright, trademark and other intellectual property rights, which are owned and controlled by Konami, its affiliated or related entities or its or their third-party content licensors or suppliers.<br>Subject to your compliance with Konami Terms, Konami hereby grants to you a personal, limited, revocable non-transferable licence to access and use the Application and Materials solely as incorporated therein, solely for your personal, non-commercial purposes. Nothing contained in the Application grants or should be construed as granting any licence or right to make commercial use of any Materials or other Konami or third-party copyrighted materials, trademarks or intellectual property without Konami’s prior written permission.<br>Konami may also modify (with an effort to be made known in advance to the user in a suitable manner), suspend, discontinue or prohibit (to be made known well in advance to the user in a suitable manner) you from accessing the Application (or any portion of the Application). In such instances, your licence to access and use Materials (including any Virtual Currency and Virtual Goods) shall be automatically terminated or suspended, as applicable. Konami shall not be required to provide refunds, benefits or other compensation to you in connection with such termination or suspension. <br>“eFootball™ logo”, “eFootball™” and “e-Football” are registered trademarks or trademarks of Konami in Japan and other countries and regions.<br><br>2. Rules of Conduct. While using the Application, you will comply with all applicable laws, rules and regulations. Konami expects users of the Application to respect the rights and dignity of others. In addition to other terms and conditions of Konami Terms, your use of the Application is conditioned upon your compliance with rules of conduct set forth in this section; your failure to comply with such rules may result in termination of your licence to use and access the Application. You agree that you will not:<br>• Post, transmit or otherwise make available, through or in connection with the Application:<br>- Anything that is or may be (a) threatening, harassing, degrading, hateful or intimidating; (b) defamatory; (c) fraudulent or tortious; (d) obscene, indecent, pornographic or otherwise objectionable; (e) protected by copyright, trademark, trade secret, right of publicity or other proprietary rights without the express prior consent of the owner of such right; (f) related to alcohol or the sale of tobacco products, ammunition or firearms; or (g) related to wagering or gambling.<br>- Any material that would give rise to criminal or civil liability; that encourages conduct that would constitute a criminal offence; or that encourages or provides instructional information about illegal activities or activities such as “hacking”, “cracking” or “phreaking”.<br>- Any virus, worm, Trojan horse, Easter egg, time bomb, spyware or other computer code, file or program that is potentially harmful or invasive or may or is intended to damage or hijack the operation of, or to monitor the use of, any hardware, software or equipment.<br>- Any unsolicited or unauthorized advertising, promotional material, “junk mail”, “spam”, “chain letter”, “pyramid scheme” or investment opportunity, or any other form of solicitation.<br>- Any material, non-public information about a company without proper authorization to do so.<br>• Use the Application for any fraudulent or unlawful purpose, including any such act or attempted act with respect to payments made in connection with the Application.<br>• Attempt to gain for yourself or any other person any unfair advantage with respect to use of the Application, including use of cheats, exploits, automation software, bots, hacks, mods or any unauthorized third-party software, or by exploiting any bugs or errors in the Application. You also agree not to inform any person (other than Konami) of such bugs or errors.<br>• Use the Application in connection with designing or assisting in the design of cheats, automation software, bots, hacks, mods or any other unauthorized third-party software.<br>• Use the Application to defame, abuse, harass, stalk, threaten or otherwise violate the legal rights of others, including without limitation others' privacy rights or rights of publicity, or harvest or collect personally identifiable information about other users of the Application.<br>• Impersonate any person or entity, including without limitation any representative of Konami; falsely state or otherwise misrepresent your affiliation with any person or entity in connection with the Application; or express or imply that Konami endorses any statement that you make.<br>• Interfere with or disrupt operation of the Application or servers or networks used to make the Application available, including without limitation taking any action that imposes an unreasonable or disproportionately large load upon the Application or upon such servers or networks; or violate any requirements, procedures, policies or regulations of such networks.<br>• Restrict or inhibit any other person from using the Application (including without limitation by hacking or defacing any portion of the Application).<br>• Use the Application to advertise or offer to sell or buy any goods or services.<br>• License, sublicense, transfer, assign, reproduce, duplicate, copy, sell, resell, distribute or otherwise exploit for any commercial purposes, any portion of, use of or access to the Application.<br>• Reproduce, modify, adapt, publish, distribute, broadcast, make derivative works of, translate, reverse engineer, decompile or disassemble any portion of the Application without Konami’s prior approval.<br>• Remove any copyright, trademark or other proprietary rights notice from the Application or materials originating from the Application.<br>• Frame or mirror any part of the Application without Konami’s express prior written consent.<br>• Create a database by systematically downloading and storing Materials.<br>• Use any robot, spider, site search/retrieval application or other manual or automatic device to retrieve, index, “scrape”, “data mine” or in any way gather Materials or reproduce or circumvent the navigational structure or presentation of the Application without Konami’s express prior written consent.<br>• Prostitute a child, exploit a child for pornography or engage in acts likely to constitute child abuse; or engage in acts that will or may have a bad influence on or encourage bad behaviour among persons under 20 years of age (including encouraging those persons to drink, smoke or gamble, posting information relating to the adult or sex entertainment industry and soliciting them to access sites inappropriate for use by themselves).<br>• Engage in acts that encourage or assist suicide or drug abuse, or any act leading to meetings for the purpose of sexual or obscene acts.<br>• Seek a relationship with another person, or engage in acts that Konami determines is made for the main purpose of causing a relationship (including relationships, acts and socializing limited to within the Application).<br>• Post or ask for information that can identify or enable direct access to an individual (such as a telephone number, e-mail address and SNS service account).<br>• Campaign for Pre-election campaign, campaign or participate in politics or other similar acts.<br>• Post, publish, collect or accumulate personal information of third parties (including addresses, e-mail addresses, telephone numbers, credit card numbers and account numbers).<br>• Conduct real money trading, convert Account IDs, data, characters or items in the Application into cash, purchase or sale of property or information through the foregoing or any act or statement comparable to the foregoing.<br>• Unless explicitly permitted by Konami, assign, exchange, lend or license data, characters or items in the Application, or act or state something comparable to the foregoing.<br>• Use any program defects of the Application or any other problematic phenomenon or effect to gain a benefit or for other improper purpose.<br>• Engage in any act that instigates, encourages or abets any acts set forth in this Section.<br>• Engage in any other acts Konami determines to be inappropriate with rational reason.<br>You shall be responsible for your use of the Application and/or any information that you post or otherwise make available through your use of the Application.<br><br>You shall be solely responsible for the compensation for any and all losses or damages, including reasonable attorney’s fees, suffered by Konami or any third party, including but not limited to, any and all losses or damages suffered by Konami or any third party due to your incompliance with these Konami Terms.<br><br>3. Purchases of Virtual Goods. The Application may provide you with an opportunity to aquire personal, limited, revocable, non-transferable licences to access and use virtual goods (collectively, “Virtual Goods”) solely within the Application and solely for your personal, non-commercial purposes. These acquisition may be made using virtual currency (e.g., virtual coins, tokens, or points) (“Virtual Currency”) earned or acquired through the Application or from one of Konami’s approved third-party virtual currency providers. You shall make the payment therefor in a method separately specified by us. To the extent of applicable law, Konami shall not be required to provide refunds, benefits or other compensation to you, except in cases where there is a breach by Konami of these Konami Terms due to intentional or gross negligence on the part of Konami. Notwithstanding anything to the contrary in Konami Terms or in the Application, you agree that you have no right or title to any Materials, including without limitation any Virtual Goods and/or “earned” or “purchased” Virtual Currency, and that such Virtual Goods and/or Virtual Currency do not constitute or represent any balance of real currency or other stored value or its equivalent. Konami shall not be required to provide refunds, benefits or other compensation to you, except in cases where there is a breach by Konami of these Konami Terms due to intentional or gross negligence on the part of Konami. You may not sublicense, lease, lend, sell, gift, bequeath, trade, transfer or provide use or access to any Virtual Goods and/or Virtual Currency, except as expressly provided by Konami, and any such act or attempted act is prohibited and void. Purchase and Use of Virtual Currency. If you wish to purchase Virtual Currency made available by Konami through the Application (each such purchase, a "Transaction"), you may be asked to supply certain information relevant to your Transaction. The purchase and use of Virtual Currency are governed by terms and conditions of the “Virtual Currency Terms of Use” located in the Application. YOU REPRESENT AND WARRANT THAT YOU HAVE THE LEGAL RIGHT TO USE ANY PAYMENT METHOD UTILISED IN CONNECTION WITH ANY TRANSACTION AND THAT YOU ARE IN COMPLIANCE WITH ANY TERMS AND CONDITIONS APPLICABLE TO SUCH PAYMENT METHODS, AND YOU AGREE THAT YOU ARE RESPONSIBLE FOR ANY USE OF YOUR PAYMENT METHODS BY MINORS. By submitting such information, you grant Konami the right to provide such information to third parties for purposes of facilitating completion of Transactions initiated by you or on your behalf. Verification of information may be required prior to acknowledgment or completion of any Transaction.<br><br>5. Accounts and Passwords. You may be required to register in order to access certain Materials or areas of the Application or to purchase licences to Virtual Goods. You may not register an Account ID on behalf of any other individual. Konami may suspend or terminate the Application, in whole or in part, and with or without notifying you, if it becomes impossible, in the common sense, to provide the Application due to strikes, labor trouble, acts of God, war, legal restrictions, inevitable accidents, or any other cause similar thereto which is beyond Konami’s control (“Force Majeure Event”). Konami shall not be responsible for any losses, damages, or other disadvantages suffered by you in relation to any Force Majeure Event.<br><br>15. TERMINATION BY YOU.
