                株式会社コナミデジタルエンタテインメント（以下「当社」といいます。）が定める本規約は、お客様の「本コンテンツ」（第１条に定義します。）の利用に関する事項を定めるものです。本規約は、日本国において「本コンテンツ」の利用を開始するお客様に適用されます。お客様は、「本コンテンツ」の利用を開始する前に、十分に本規約および「本プラットフォーム提供者」（第１条に定義します。）が定める諸条件（以下「本プラットフォーム規約」といいます。）の内容を確認し、当該内容に同意の上、「本コンテンツ」の利用を開始するものとします。本コンテンツの利用開始をもって、お客様は、本規約の内容にすべて同意したものとみなします。当社は、本プラットフォーム提供者の関連会社ではなく、本プラットフォーム規約を管理する権利を有しません。また、本プラットフォーム提供者の作為または不作為に関して、当社は一切の責任を負いません。

                Konami Digital Entertainment Co., Ltd. (“Konami”) appreciates your interest in Konami’s application entitled “eFootball™” (together with any Materials, as defined below, the “Application”). By accessing or using the Application, you agree to comply with these terms and conditions (“Konami Terms”) in addition to the terms and conditions provided by Platformers (“Platform Terms”). If you do not agree to Konami Terms and Platform Terms, you may not access or use the Application. Please note that Konami is not affiliated with Platformers, has no control over Platform Terms and is not responsible for Platformer’s acts or omissions and that Konami is solely responsible for the Application, not Platformers. For the purpose of these terms, “Platformers” means the provider of the Platform, and the “Platform” means the platform through which you access or use the Application.

                YOU AFFIRM THAT YOU ARE OF LEGAL CAPACITY TO ENTER INTO KONAMI TERMS. IF YOU ARE NOT OF LEGAL CAPACITY, 
                第13条に定めるとおり、お客様は、自らが未成年者等の制限行為能力者である場合、本規約への同意にあたり事前に法定代理人（親権者等を含みます。以下同じ。）の同意を得なければなりません。<br><br><br>第1条(定義)<br><br>本規約において、次の各号に掲げる用語の意義は、当該各号に定めるところによります。<br><br>

                お客様が本コンテンツを利用するためのプラットフォームをいいます。<br><br>(3)
                 
                PARENTAL
                「本プラットフォーム提供者」
                 
                OR
                本プラットフォームの提供者をいいます。<br><br>(4)
                 
                GUARDIAN
                「ユーザーID」
                 
                CONSENT,
                本コンテンツの初回利用開始時に自動的に発行されるお客様を識別するための符号をいいます。<br><br>(5)
                 
                OR
                「パスワード」
                 
                (2)YOUR
                ユーザーIDの利用者が本人であることを認証するために定める認証用の文字、番号、記号その他の符号またはこれらの結合をいいます。<br><br>(6)
                 
                PARENT
                「プラットフォームアカウント」
                 
                OR
                本コンテンツを利用するために必要となる場合に、お客様が本コンテンツを利用するプラットフォームの運営会社から、お客様が取得するアカウントをいいます。<br><br>(7)
                 
                GUARDIAN
                「お客様コンテンツ」
                 
                HAVE
                お客様が本コンテンツ内に掲載したコンテンツ（書き込みまたはメール等を含みますがこれに限りません。）をいいます。<br><br>(8)
                 
                TO
                「セーブデータ等」
                 
                ACTE ON YOUR BEHALF, TO ENTER INTO KONAMI TERMS. YOU HAVE TO CONFIRM KONAMI TERMS WITH YOUR PARENT OR GUARDIAN, IF YOU LIVE IN THE COUNTRIES OR REGIONS AND ARE OF THE AGE RESPECTIVELY, SEPARATELY DESIGNATED BY KONAMI. YOU HAVE TO AGREE YOUR USER ID ISSUED ACCORDING TO “e-amusement Site Terms and Conditions” FOR MINORS (“CHILDREN  ACCOUNT”) ARE LINKED TO YOUR. USER ID OF YOUR PARENT OR GUARDIAN, TO BE PLACED UNDER CONTROL, Notwithstanding the foregoing, you are not eligible to access or use the Application unless Platform Terms allow you to access and use the Platform. You may use the Application only in accordance with Platform Terms and Konami Terms.
                本コンテンツの利用にかかるデータ、お客様コンテンツ等、お客様が本コンテンツにおいて保存したデータ等または本コンテンツの提供にあたり当社が保存するデータ等をいいます。

                Any personal information or personal data collected and used by Konami in relation to your use of the Application will be handled in accordance with Konami’s privacy policy or the privacy notice separately presented to you.
                <br><br>第2条(お客様の役割および義務)
                <br><br>1. 
                Intellectual Property and Licence. The Application, including information and materials available in the Application, which may include video games and other software applications, and all components thereof such as audio-visual materials, Virtual Currency (as defined below) and Virtual Goods (as defined below) (collectively, “Materials”) are protected by copyright, trademark and other intellectual property rights, which are owned and controlled by Konami, its affiliated or related entities or its or their third-party content licensors or suppliers.<br>Subject to your compliance with Konami Terms, Konami hereby grants to you a personal, limited, revocable non-transferable licence to access and use the Application and Materials solely as incorporated therein, solely for your personal, non-commercial purposes. Nothing contained in the Application grants or should be construed as granting any licence or right to make commercial use of any Materials or other Konami or third-party copyrighted materials, trademarks or intellectual property without Konami’s prior written permission.<br>Konami may also modify (with an effort to be made known in advance to the user in a suitable manner), suspend, discontinue or prohibit (to be made known well in advance to the user in a suitable manner) you from accessing the Application (or any portion of the Application). In such instances, your licence to access and use Materials (including any Virtual Currency and Virtual Goods) shall be automatically terminated or suspended, as applicable. Konami shall not be required to provide refunds, benefits or other compensation to you in connection with such termination or suspension. <br>“eFootball™ logo”, “eFootball™” and “e-Football” are registered trademarks or trademarks of Konami in Japan and other countries and regions.
                お客様は、本規約に従うことを条件に、本コンテンツを利用することができます。
                <br><br>2. 
                Rules of Conduct. While using the Application, you will comply with all applicable laws, rules and regulations. Konami expects users of the Application to respect the rights and dignity of others. In addition to other terms and conditions of Konami Terms, your use of the Application is conditioned upon your compliance with rules of conduct set forth in this section; your failure to comply with such rules may result in termination of your licence to use and access the Application. You agree that you will not:<br>• Post, transmit or otherwise make available, through or in connection with the Application:<br>- Anything that is or may be (a) threatening, harassing, degrading, hateful or intimidating; (b) defamatory; (c) fraudulent or tortious; (d) obscene, indecent, pornographic or otherwise objectionable; (e) protected by copyright, trademark, trade secret, right of publicity or other proprietary rights without the express prior consent of the owner of such right; (f) related to alcohol or the sale of tobacco products, ammunition or firearms; or (g) related to wagering or gambling.<br>- Any material that would give rise to criminal or civil liability; that encourages conduct that would constitute a criminal offence; or that encourages or provides instructional information about illegal activities or activities such as “hacking”, “cracking” or “phreaking”.<br>- Any virus, worm, Trojan horse, Easter egg, time bomb, spyware or other computer code, file or program that is potentially harmful or invasive or may or is intended to damage or hijack the operation of, or to monitor the use of, any hardware, software or equipment.<br>- Any unsolicited or unauthorized advertising, promotional material, “junk mail”, “spam”, “chain letter”, “pyramid scheme” or investment opportunity, or any other form of solicitation.<br>- Any material, non-public information about a company without proper authorization to do so.<br>• Use the Application for any fraudulent or unlawful purpose, including any such act or attempted act with respect to payments made in connection with the Application.<br>• Attempt to gain for yourself or any other person any unfair advantage with respect to use of the Application, including use of cheats, exploits, automation software, bots, hacks, mods or any unauthorized third-party software, or by exploiting any bugs or errors in the Application. You also agree not to inform any person (other than Konami) of such bugs or errors.<br>• Use the Application in connection with designing or assisting in the design of cheats, automation software, bots, hacks, mods or any other unauthorized third-party software.<br>• Use the Application to defame, abuse, harass, stalk, threaten or otherwise violate the legal rights of others, including without limitation others' privacy rights or rights of publicity, or harvest or collect personally identifiable information about other users of the Application.<br>• Impersonate any person or entity, including without limitation any representative of Konami; falsely state or otherwise misrepresent your affiliation with any person or entity in connection with the Application; or express or imply that Konami endorses any statement that you make.<br>• Interfere with or disrupt operation of the Application or servers or networks used to make the Application available, including without limitation taking any action that imposes an unreasonable or disproportionately large load upon the Application or upon such servers or networks; or violate any requirements, procedures, policies or regulations of such networks.<br>• Restrict or inhibit any other person from using the Application (including without limitation by hacking or defacing any portion of the Application).<br>• Use the Application to advertise or offer to sell or buy any goods or services.<br>• License, sublicense, transfer, assign, reproduce, duplicate, copy, sell, resell, distribute or otherwise exploit for any commercial purposes, any portion of, use of or access to the Application.<br>• Reproduce, modify, adapt, publish, distribute, broadcast, make derivative works of, translate, reverse engineer, decompile or disassemble any portion of the Application without Konami’s prior approval.<br>• Remove any copyright, trademark or other proprietary rights notice from the Application or materials originating from the Application.<br>• Frame or mirror any part of the Application without Konami’s express prior written consent.<br>• Create a database by systematically downloading and storing Materials.<br>• Use any robot, spider, site search/retrieval application or other manual or automatic device to retrieve, index, “scrape”, “data mine” or in any way gather Materials or reproduce or circumvent the navigational structure or presentation of the Application without Konami’s express prior written consent.<br>• Prostitute a child, exploit a child for pornography or engage in acts likely to constitute child abuse; or engage in acts that will or may have a bad influence on or encourage bad behaviour among persons under 20 years of age (including encouraging those persons to drink, smoke or gamble, posting information relating to the adult or sex entertainment industry and soliciting them to access sites inappropriate for use by themselves).<br>• Engage in acts that encourage or assist suicide or drug abuse, or any act leading to meetings for the purpose of sexual or obscene acts.<br>• Seek a relationship with another person, or engage in acts that Konami determines is made for the main purpose of causing a relationship (including relationships, acts and socializing limited to within the Application).<br>• Post or ask for information that can identify or enable direct access to an individual (such as a telephone number, e-mail address and SNS service account).<br>• Campaign for Pre-election campaign, campaign or participate in politics or other similar acts.<br>• Post, publish, collect or accumulate personal information of third parties (including addresses, e-mail addresses, telephone numbers, credit card numbers and account numbers).<br>• Conduct real money trading, convert Account IDs, data, characters or items in the Application into cash, purchase or sale of property or information through the foregoing or any act or statement comparable to the foregoing.<br>• Unless explicitly permitted by Konami, assign, exchange, lend or license data, characters or items in the Application, or act or state something comparable to the foregoing.<br>• Use any program defects of the Application or any other problematic phenomenon or effect to gain a benefit or for other improper purpose.<br>• Engage in any act that instigates, encourages or abets any acts set forth in this Section.<br>• Engage in any other acts Konami determines to be inappropriate with rational reason.<br>You shall be responsible for your use of the Application and/or any information that you post or otherwise make available through your use of the Application.<br><br>You shall be solely responsible for the compensation for any and all losses or damages, including reasonable attorney’s fees, suffered by Konami or any third party, including but not limited to, any and all losses or damages suffered by Konami or any third party due to your incompliance with these Konami Terms.
                お客様は、その責任と費用において、ユーザーID、パスワードおよびプラットフォームアカウントの管理を行うものとします。
                <br><br>3. 
                Purchases of Virtual Goods. The Application may provide you with an opportunity to aquire personal, limited, revocable, non-transferable licences to access and use virtual goods (collectively, “Virtual Goods”) solely within the Application and solely for your personal, non-commercial purposes. These acquisition may be made using virtual currency (e.g., virtual coins, tokens, or points) (“Virtual Currency”) earned or acquired through the Application or from one of Konami’s approved third-party virtual currency providers. You shall make the payment therefor in a method separately specified by us. To the extent of applicable law, Konami shall not be required to provide refunds, benefits or other compensation to you, except in cases where there is a breach by Konami of these Konami Terms due to intentional or gross negligence on the part of Konami. Notwithstanding anything to the contrary in Konami Terms or in the Application, you agree that you have no right or title to any Materials, including without limitation any Virtual Goods and/or “earned” or “purchased” Virtual Currency, and that such Virtual Goods and/or Virtual Currency do not constitute or represent any balance of real currency or other stored value or its equivalent. Konami shall not be required to provide refunds, benefits or other compensation to you, except in cases where there is a breach by Konami of these Konami Terms due to intentional or gross negligence on the part of Konami. You may not sublicense, lease, lend, sell, gift, bequeath, trade, transfer or provide use or access to any Virtual Goods and/or Virtual Currency, except as expressly provided by Konami, and any such act or attempted act is prohibited and void. You shall not attempt to use or access any Virtual Goods and/or Virtual Currency that you have not personally licensed or acquired from us or from one of Konami’s approved third-party currency providers. If you leave a balance of purchased Virtual Currency unused for a period of time or if we terminate or suspend your access to and/or use of the Application, we may process your balance in accordance with Konami’s legal obligations, including by submitting funds associated with your purchased Virtual Currency balance to the appropriate governing body where required by applicable law.
                お客様は、ユーザーID、パスワードもしくはプラットフォームアカウントを盗用された場合またはそのおそれがある場合、直ちに当社にその旨を通知するものとします。この通知がなされない間に登録されたユーザーID、パスワードまたはプラットフォームアカウントを利用して行われた一切の行為は、お客様自身の行為とみなします。

                Purchase and Use of Virtual Currency. If you wish to purchase Virtual Currency made available by Konami through the Application (each such purchase, a "Transaction"), you may be asked to supply certain information relevant to your Transaction. Such information may include your credit card number and its expiration date and billing address, and other information associated with proprietary payment methods. The purchase and use of Virtual Currency are governed by terms and conditions of the “Virtual Currency Terms of Use” located in the Application. YOU REPRESENT AND WARRANT THAT YOU HAVE THE LEGAL RIGHT TO USE ANY PAYMENT METHOD UTILISED IN CONNECTION WITH ANY TRANSACTION AND THAT YOU ARE IN COMPLIANCE WITH ANY TERMS AND CONDITIONS APPLICABLE TO SUCH PAYMENT METHODS, AND YOU AGREE THAT YOU ARE RESPONSIBLE FOR ANY USE OF YOUR PAYMENT METHODS BY MINORS. By submitting such information, you grant Konami the right to provide such information to third parties for purposes of facilitating completion of Transactions initiated by you or on your behalf. Verification of information may be required prior to acknowledgment or completion of any Transaction.
                お客様による本コンテンツの利用に際して、当社が収集および利用するお客様の個人情報、および特定の個人を識別し得ないものの、何らかの方法で、ある匿名の個人に関する情報であると識別し得る情報（以下、これらを併せて「本件情報」といいます）に関しては、当社の個人情報等保護方針に基づき取り扱います。お客様は、当該個人情報等保護方針の内容を理解し、同意の上で、本コンテンツを利用することとします。お客様は、当社に対し本件情報を提供した場合には、当社の個人情報等保護方針に同意したものとみなします。

                Accounts and Passwords. You may be required to register in order to access certain Materials or areas of the Application or to purchase licences to Virtual Goods. With respect to any such registration, Konami may refuse to grant you, and you may not use, an Account ID (or e-mail address) that is already being used by someone else; that may be construed as impersonating another person; that belongs to another person; that personally identifies you; that violates intellectual property or other rights of any person; that is offensive; or that Konami rejects for any other reason in Konami’s sole discretion. You may not register an Account ID on behalf of any other individual. You represent and warrant that all information you submit in connection with any registration (including without limitation information related to your identity) is accurate and complete, and that you have not been previously restricted from accessing or using any Konami website or other Konami Internet property or any Konami game or other application.

                本コンテンツ内のデータ、キャラクターもしくはアイテム等の譲渡、交換、貸与もしくは再許諾等の行為、またはそれに準じた行為もしくは発言をする行為<br><br>(17)

                本コンテンツのプログラム上の瑕疵その他の問題のある現象もしくは効果を利用して利益を得る等の目的またはこれらに準ずる不正な目的に利用する行為<br><br>(18)

                同音異義語、派生語、綴り間違いまたは当て字を含んだ様々な形の禁止事項に抵触するメッセージ、情報等を発信する行為<br><br>(19)

                サーバへの不正アクセス、不正ツールの利用、チートコードもしくはチートデバイスの配布その他の本コンテンツの運営に支障を与える行為、またはその運営を妨げるおそれのある行為<br><br>(20)
                 
                bequeath,
                当社、当社の関係会社、他のお客様その他の第三者になりすます、またはなりすまそうとする行為<br><br>(21)
                 
                trade,
                本コンテンツに関連して、もしくは本コンテンツに含まれる形で提供されたソフトウェア、プログラムまたはデータを複製、改変、リバースエンジニアリング、逆コンパイル、逆アセンブル、再現等する行為<br><br>(22)
                 
                transfer
                自動操作ツール、プログラム、マクロその他のツールを利用する行為<br><br>(23)
                 
                or
                本コンテンツの運用または内容に関するプログラムを開発する、開発させる、配布するまたは配布させる行為<br><br>(24)
                 
                provide
                本コンテンツの利用にあたり、虚偽の情報を提供する行為<br><br>(25)
                 
                use
                他人の実名、ブランド名または法人名等、第三者が権利を有する言葉やフレーズを使用する行為<br><br>(26)

                ユーザーID、パスワードおよびプラットフォームアカウントを第三者に貸与、売買、贈与、その他移転等する行為、または、本コンテンツ内に別段の定めがあるときを除き第三者に利用させる行為<br><br>(28)

                当社の指定する地域以外の地域から本コンテンツを利用する行為<br><br>(29)
                 
                any
                公序良俗に反する行為、本コンテンツもしくはその他のサービス等の秩序を乱す行為、または他のお客様に不快感を与える行為<br><br>(30)

                法令、裁判所の判決、決定もしくは命令、または行政機関の命令等に違反する行為<br><br>(31)
                 
                IDs
                本項各号に定める行為を教唆、助長、幇助する行為<br><br>(32)
                 
                or passwords or associated account settings (including any game-related information), except as expressly provided by Konami, and any such act or attempted act is prohibited and void. You shall not attempt to use or access the Application with any Account ID or password that you did not personally register with Konami. You are responsible for maintaining the confidentiality of any password you may use to access Materials or areas of the Application, and you are fully responsible for all interactions with the Application that occur in connection with your password or Account ID (including, without limitation, all Transactions, as defined above). You agree to immediately notify Konami of any unauthorized use of your password or Account ID or any other breach of security related to your account or to the Application, and to make reasonable efforts to remedy such breaches (including any breaches relating to known or suspected copyright infringement in connection with the Application), and to ensure that you “log off”/exit from your account with the Application (if applicable) at the end of each session. Konami is not liable for any loss or damage arising from your failure to comply with any of the foregoing obligations.
                前各号に定めるものの他、当社が不適当と合理的に判断する行為
                <br><br>6. 
                Saved Data. An identifier automatically issued to you by Konami for Konami to identify you for your use of the Application (“User ID”) is for your personal use only and should be kept confidential, and you (and not Konami) are responsible for any use or misuse of your User ID. Your User ID will be managed by mutually linking your User ID and your Platform Account. The data relating to your use of the Application (“Saved Data”) will be stored on a User ID basis on the server designated by Konami.<br><br>Konami does not warrant or covenant that your Saved Data will be saved or read without an error, nor that it will not be deleted or otherwise lost. Konami may, at its reasonable discretion, change, modify, or delete your Saved Data in the following cases without obtaining your approval.<br><br>(a)  If you breach these Konami Terms or any other terms applicable to your use of the Application.<br><br>(b)  It is inevitable for Konami for the operation of the Application or due to its obligation under the contract with third parties.<br><br>(c)  If Konami cannot confirm your payment under Section 3.1 above.<br><br>(d)  Your Saved Data has not been used or accessed to for at least six (6) months.<br><br>In the case where there is a change in the provider of the Application, including where Konami transfers its business related to the Application to any third party, Konami may assign or transfer these Konami Terms, its rights and obligations, and any of your information that Konami has, including your User ID, to the transferee or any third party who takes over the provision of the Application. You hereby agree to such an assignment or transfer.

Konami reserves the right, but is not obligated, to monitor and, in its sole discretion, to delete any materials and postings or to block (or request that Platformers block) users who have posted materials or acted in a manner, in each case, that Konami believes to violate Konami Terms or to be unsuitable for the Application. Konami’s decision not to pursue legal action for any violation of Konami Terms shall not be construed as a waiver of Konami Terms or of Konami’s legal rights. Konami also reserves the right to disclose any posting, the circumstances surrounding its transmission, and the identity of the poster, including without limitation in order to operate the Application properly, to protect Konami, its affiliated companies and other Application users, and to comply with legal obligations or governmental requests. You agree to report any third parties’ violation of these Konami Terms to Konami in a manner separately specified by Konami, provided, however, that the handling of such reported violation, including but not limited to, the investigation, the results of such investigation, and disclosure thereof, shall be determined by Konami in its sole discretion.

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF KONAMI AND/OR ANY OF THE KONAMI ENTITIES, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE, WHETHER ACTIVE, PASSIVE OR IMPUTED), PRODUCT LIABILITY, STRICT LIABILITY OR OTHER THEORY, ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE THE APPLICATION OR ANY SITE OR SERVICE LINKED FROM THE APPLICATION EXCEED THE AMOUNT YOU PAY, IF ANY, TO KONAMI FOR SUCH ACTIVITY.  The foregoing shall not apply to any incidental or consequential damages due to Konami’s intentional act or gross negligence.

                当社は、お客様が他の利用者または第三者によりなされた行為により被った損害に関し、いかなる責任も負いません。また､お客様と他の利用者または第三者の間で生じた紛争について一切関与しないものとし、お客様は、自己の責任と費用で当該紛争を解決するものとします。<br><br>5. お客様は、自己の責任により、健康的な生活を心がけ、健康状態を損ねるような過度の本コンテンツの利用を避けるものとします。本コンテンツの過度な利用により生じた社会的、精神的または肉体的な損傷または損害等に関して、当社は一切の責任を負いません。<br><br>6. 本コンテンツには第三者のコンテンツ・サービス（以下「第三者コンテンツ」といいます。）が含まれる場合があります。第三者コンテンツは、それぞれ当該第三者の責任で提供されるものであり、当社は、第三者コンテンツの内容、またはその利用により生じた損害等について、一切の責任を負いません。<br><br><br>第5条（監視）<br><br>1. 当社は、本コンテンツ（お客様コンテンツを含みます。）を監視する義務を負いません。ただし、当社は、自らの裁量で本コンテンツを利用して発信または受信された情報（お客様コンテンツを含みます。）を監視し、必要に応じて記録し、更には法令等に基づき行政機関その他の第三者に対して開示することができます。<br><br>2. 前項に定める監視の結果、当社が自己の裁量により、好ましくない、または本規約に違反すると判断した場合、当社は、当該情報を削除する権利、および当該情報の発信または受信を拒否する権利を有します。お客様は、前記により当該情報が削除されたことに対し、何らの権利主張および異議の申立てもできないものとします。<br><br><br>第6条 (違反行為)<br><br>お客様は、他の利用者等の第三者が本規約に違反している行為を発見した場合、直ちに別途定める当社への問合せ先にその旨を通知するものとします。ただし、当該行為にかかる調査、対応、対応にかかる公表等は、当社の裁量にて行われます。<br><br><br>第7条(著作権その他の知的財産権)<br><br>1. 本コンテンツ、および本コンテンツに含まれる一切の情報(ソフトウェア、デザイン等のすべての情報をいいます。) に関する著作権その他の知的財産権は、当社、提携先または当該情報の提供元に帰属します。なお、本コンテンツに含まれる「eFootball™ロゴ」および「eFootball™」は、当社の登録商標または商標です。<br><br>2. 前項の定めにかかわらず、お客様コンテンツの著作権は、当社とお客様との間においては、お客様に帰属します。なお、お客様は、当社に対し、お客様コンテンツの著作権その他の一切の権利(お客様コンテンツを第三者に許諾する権利を含みます。）を非独占的に許諾します。また、この場合において、お客様は、お客様コンテンツに関する著作者人格権等一切の権利を行使しないものとします。<br><br><br>第8条(本規約の変更等)<br><br>1. 当社は、以下のいずれかに該当する場合に、法令で定める範囲内で本規約を変更することができます。<br><br>(1) 本規約の変更が、お客様の一般の利益に適合するとき<br><br>(2) 本規約の変更が、本規約の目的に反せず、かつ、変更の必要性、変更後の内容の相当性、変更の内容その他の変更に係る事情に照らして合理的なものであるとき<br><br>2. 当社は、前項による本規約の変更内容および効力発生日を、本コンテンツ内で通知する方法その他の適切な方法により周知します。当該変更は、当該周知に際して、当社が定める効力発生日から適用されるものとします。<br><br>3. お客様が、前項に定める効力発生日以降に本コンテンツを利用した場合には、本規約の変更に同意したとみなされるものとします。本規約の変更に同意できないお客様は、本コンテンツの利用を終了するものとします。<br><br>4. 当社は、本規約の変更および前項に従った本コンテンツの利用終了によりお客様に生じた損害等につき、当社の故意または過失に起因する場合を除いて、一切の責任を負いません。<br><br>5. 本規約の全部または一部の定めが無効または執行力がないとされうる場合であっても、当該定めはこれが有効かつ執行力があるとされるように合理的かつ限定的に解釈されるものとします。<br><br>6. 本規約の一部の定めが無効または執行力がないとされた場合であっても、当該定め以外の定めは影響を及ぼされず、引き続き効力を有します。<br><br><br>第9条（本コンテンツの変更ならびにその利用および提供終了）<br><br>1. 当社は、お客様への事前の通知なく、いつでも本コンテンツの全部または一部を変更することができます。ただし、当社の業務上可能な限り、当社が適当と判断する方法で事前にお客様にその旨を周知するよう努めるものとします。<br><br>2. お客様は、いつでも本コンテンツの利用を終了することができます。<br><br>3. 当社は、お客様に対して合理的な期間を定めて事前の周知をした上で、いつでも本コンテンツの全部または一部の提供を中断または終了することができます。<br><br><br>第10条(特定のお客様に対する本コンテンツの提供終了)<br><br>1. 当社は、お客様が次の各号に該当した場合またはそのおそれがある場合、お客様に催告することなく、当該お客様に対する本コンテンツの全部または一部の提供を中断または終了することができます。<br><br>(1) 本規約その他の本コンテンツに関する約定に違反した場合<br><br>(2) 本コンテンツに関するもの以外の当社との契約に違反した場合<br><br>(3) 過去に当社が提供するサービス、コンテンツ等の会員登録またはその利用がお客様の責に帰すべき事由により終了したことが判明した場合<br><br>(4) 有料で提供されるアイテム、サービス等の利用にかかる対価の支払いが当社において確認できない場合<br><br>(5) 本コンテンツの最後の利用日から6カ月以上経過した場合<br><br>

                (g)  If Konami reasonably suspects that you fall under any of the foregoing (a) through (f)

                Suspension or termination by Konami pursuant to this Section shall not preclude Konami from claiming damages that arose therefrom, and this Section shall apply to any damages that arose therefrom, meaning that, Konami shall not be required to provide refunds, benefits or any other compensation to you in connection with such suspension or termination.

                Notwithstanding any other provision in Konami Terms or other applicable terms to the contrary, Konami reserves the right to reduce, liquidate, suspend, deactivate, remove access to and/or terminate any and all Virtual Goods if Konami suspects, at its sole discretion, that (a) you have used any Virtual Good(s) in violation of Konami Terms, and/or any other applicable terms and/or (b) you have otherwise used any Virtual Good(s) to conduct any fraudulent or illegal activity. Konami may suspend or terminate the Application, in whole or in part, and with or without notifying you, if it becomes impossible, in the common sense, to provide the Application due to strikes, labor trouble, acts of God, war, legal restrictions, inevitable accidents, or any other cause similar thereto which is beyond Konami’s control (“Force Majeure Event”). Konami shall not be responsible for any losses, damages, or other disadvantages suffered by you in relation to any Force Majeure Event.

                15. TERMINATION BY YOU. If you delete the Application from your device, your Virtual Goods may no longer be usable. Unless otherwise notified via a separate notification from Konami, you cannot transfer, assign, give away or request refund for your Virtual Goods.
                天災地変、火災、停電、戦争、暴動および内乱等の不可抗力により本コンテンツの提供が社会通念上不能となった場合、当社は何らの通知なく本コンテンツの提供を中断または終了することができます。当社は、当該事由によって発生した、一切の損害、損失および不利益等に関し、いかなる責任も負いません。

                16. Governing Law. You agree that your access to and use of the Application is governed by the laws of Japan without giving effect to any choice of legal rule that would cause application of laws of any jurisdiction other than Japan. All disputes and controversies arising out of or in connection with the Application shall be resolved exclusively by the Tokyo District Court in Tokyo, and you hereto agree to submit to the jurisdiction of said courts and agree that the venue shall lie exclusively with such courts.

                17. No Assignment. You may not lend, license, assign or succeed to any third party all or part of your rights, obligations, status or interests to use the Application.

If any provision of these Konami Terms, or the application thereof to any person, place or circumstance, shall be held to be invalid, void or otherwise unenforceable, such provision shall be enforced to the maximum extent possible so as to effect the intent of the parties, or, if incapable of such enforcement, shall be deemed to be deleted from these Konami Terms, and the remainder of these Konami Terms and such provisions as applied to other persons, places and circumstances shall remain in full force and effect.

Translated versions have been prepared for the convenience of users whose mother language is the relevant translation language; if there is any discrepancy in the meaning or interpretation between the English version and any translated version of Konami Terms, the meaning and interpretation of Konami Terms prepared in English shall prevail.

                (b)  If such change or amendment to these Konami Terms (A) does not run afoul of the purpose of these Konami Terms, and (B) is reasonable in light of the circumstances concerning such change or amendment, such as, the necessity, the appropriateness, and the details of, the changed or amended conditions.

                change or amendment to these Konami Terms will be made known well in advance to the user in a suitable manner (including but not limited to by email or by display of the notice in the Application) and shall become effective as of the effective date set forth in such notice (“Amendment Effective Date”).

The Application is provided by Konami Digital Entertainment Co., Ltd., headquartered at 1-11-1 Ginza, Chuo-Ku, Tokyo 104-0061.<br>24-7. You must comply with any applicable third-party terms of agreement when using the Application.<br>24-8. You acknowledge and agree that Apple Inc. and its subsidiaries are third-party beneficiaries to Konami Terms, and on your acceptance of Konami Terms, you acknowledge that Apple has the right (and will be deemed to have acknowledged the right) to enforce Konami Terms against you as third-party beneficiary.
