                Konami Digital Entertainment Co., Ltd. (“Konami”) 
                appreciates your interest
                apprezza il vostro interesse per l’applicazione Konami denominata “eFootball™” (insieme a tutti i Materiali, come definiti di seguito, “Applicazione”). Accedendo o usando l’Applicazione, l’utente accetta di rispettare questi termini e condizioni (“Termini Konami”),
                 in 
                Konami’s application entitled
                aggiunta ai termini e alle condizioni forniti dai Rivenditori della piattaforma (“Termini di piattaforma”). L’utente che non accetti i Termini Konami né i Termini di piattaforma non può accedere all’Applicazione né usarla. Si prega di notare che Konami non è in alcun modo affiliata ai Rivenditori delle piattaforme, non possiede alcuna capacità di controllo sui Termini di piattaforma né è responsabile degli atti o delle omissioni dei Rivenditori delle piattaforme stessi, e che Konami è l’unica responsabile per l’Applicazione, non i Rivenditori delle piattaforme. Ai fini di questi termini, “Rivenditori di piattaforma” indica il rivenditore della Piattaforma, mentre “Piattaforma” indica la piattaforma attraverso la quale l’utente accede o utilizza l’Applicazione.<br><br>L’UTENTE AFFERMA DI ESSERE IN POSSESSO DELLA CAPACITÀ LEGALE DI ACCETTARE I TERMINI KONAMI. SE L’UTENTE NON È IN POSSESSO DELLA CAPACITÀ LEGALE, (1) DEVE OTTENERE IL CONSENSO DEL GENITORE O DEL TUTORE O (2) IL GENITORE O IL TUTORE DEVONO AGIRE IN SUA VECE PER ACCETTARE I TERMINI KONAMI.<br><br>NEL CASO IN CUI L’UTENTE RISIEDA IN UNO DEI PAESI O DELLE REGIONI E ABBIA L'ETÀ RISPETTIVAMENTE INDICATA DA KONAMI SEPARATAMENTE, DOVRÀ CONFERMARE I TERMINI KONAMI CON IL PROPRIO GENITORE O TUTORE. DOVRÀ ACCETTARE CHE IL PROPRIO ID UTENTE RILASCIATO IN BASE A "Termini e condizioni del sito e-amusement" PER I MINORI ("ACCOUNT BAMBINI") SIA COLLEGATO ALL’ID UTENTE DEL PROPRIO GENITORE O TUTORE, IN MODO DA POTERLO TENERE SOTTO CONTROLLO. Nonostante quanto sopra, l’utente non potrà accedere o utilizzare l'Applicazione a meno che i Termini della piattaforma non gli consentano di accedere e utilizzare la Piattaforma. L’utente potrà utilizzare l'Applicazione solo in conformità ai Termini della piattaforma e ai Termini Konami.<br><br>Tutte le informazioni o i dati personali raccolti e utilizzati da Konami in relazione all’uso dell’Applicazione saranno gestiti in conformità alla politica sulla privacy di Konami o alla informativa sulla privacy presentate separatamente all’utente.<br><br>1. Proprietà intellettuale e licenza. L’Applicazione, che comprende le informazioni e i materiali disponibili nell’Applicazione, che possono includere videogiochi e altre applicazioni di software, e tutti i loro componenti quali materiali audiovisivi Valuta virtuale (come definita di seguito) e beni virtuali (“Beni virtuali”) (come definiti di seguito) (collettivamente, “Materiali”) è protetta da copyright, marchi di fabbrica e altri diritti di proprietà intellettuale, che sono detenuti e controllati da Konami, dalle sue controllate o enti/entità connessi o ancora dai concessionari di licenza o fornitori del contenuto di terze parti suoi o di tali controllate o enti/entità.<br><br>Subordinatamente all’osservanza dei Termini Konami, con il presente documento Konami concede all’utente la licenza personale, limitata, revocabile e non trasferibile per accedere e usare l’Applicazione e i Materiali esclusivamente come in questa incorporati e unicamente per scopi personali e non commerciali. Nulla di quanto contenuto nell’Applicazione conferisce o può essere interpretato come conferimento di licenza o diritto all’uso commerciale dei Materiali o di altri materiali, marchi o proprietà intellettuale di Konami o di terzi, protetti da copyright, senza il preventivo consenso scritto di Konami.<br><br> Konami si riserva inoltre il diritto di modificare (facendo in modo che ciò sia reso noto all'utente in anticipo e in modo adeguato), sospendere, cessare o proibire (facendo in modo che ciò sia reso noto all'utente in anticipo e in modo adeguato) all’utente di accedere all’Applicazione (o anche solo a parte di essa). In tali circostanze, a seconda dei casi, la licenza concessa all’utente di accedere e usare i Materiali (compresi la Valuta virtuale e i Beni virtuali) sarà automaticamente revocata o sospesa. In relazione a tale revoca o sospensione, Konami non sarà tenuta a fornire all’utente alcun rimborso, corresponsione o altro tipo di compensazione.<br><br>“eFootball™ logo”,

Oltre agli altri termini e condizioni dei Termini Konami, l’uso dell’Applicazione è subordinato al rispetto da parte dell’utente delle norme di condotta qui oltre riportate. La mancata osservanza di tali norme può divenire causa di revoca della licenza di accesso e uso dell’Applicazione. L’utente s’impegna a non:<br><br>• Pubblicare, trasmettere o comunque rendere disponibile attraverso o in connessione con l’Applicazione:<br><br>-  Tutto ciò che sia o possa risultare (a) minaccioso, molesto, svilente, spregevole o intimidatorio; (b) diffamatorio; (c) fraudolento o illecito; (d) osceno, indecente, pornografico o comunque sgradevole; (e) protetto da copyright, marchio di fabbrica, segreto commerciale, diritto di pubblicità o altri diritti di proprietà senza il preventivo ed espresso consenso scritto del titolare di tale diritto; (f) relativo all’uso di bevande alcoliche o alla vendita di prodotti a base di tabacco, munizioni o armi da fuoco; o (g) connesso alle scommesse o al gioco d’azzardo.<br><br>-  Qualsiasi materiale che possa dar luogo a responsabilità criminale o civile, incoraggiare una condotta riconducibile al crimine o incoraggiare o fornire informazioni istruttive su attività illegali o relative alla pirateria informatica (“hacking”), alla pirateria telematica (“phreaking”) o all’intrusione (“cracking”).<br><br>-  Qualsiasi virus, baco informatico (worm), cavallo di Troia (Trojan horse), Easter egg, time bomb, spyware o altro codice, file o programma informatico potenzialmente pericoloso o invasivo o che possa o intenda danneggiare o appropriarsi (effettuare l’hijack) dell’uso, o anche solo monitorarlo, di hardware, software o apparecchi.<br><br>-  Qualsiasi pubblicità non richiesta o non autorizzata, materiale promozionale, “junk mail”, “spam”, “catene di Sant’Antonio”, “schema piramidale” o opportunità di investimento, o qualsiasi altra forma di sollecitazione.<br><br>-  Qualsiasi materiale o informazione di carattere privato, cioè non resa pubblica, riguardante una data azienda senza averne preventivamente ottenuto l’autorizzazione.<br><br>• Usare l’Applicazione per scopi fraudolenti o illegali, incluso qualsiasi atto o tentativo in merito ai pagamenti effettuati in relazione all'Applicazione.<br><br>• Tentare di ottenere slealmente vantaggi per sé o altre persone nell’ambito dell’uso dell’Applicazione, anche a mezzo d’imbroglio, sfruttamento, automazione software, robot, inserimento abusivo (hack), alterazione software (mod) o con software di terzi non autorizzati, oppure ancora sfruttando gli eventuali bachi (bug) o errori presenti nell’Applicazione. L’utente acconsente inoltre a non informare altre persone ed entità, ad eccezione di Konami, dell’eventuale presenza in essa di tali bachi o errori.<br><br>• Usare l’Applicazione con il proposito o assistendo il proposito di attuare truffe, automazioni software, robot, inserimenti abusivi, alterazioni o software di terzi non autorizzati.<br><br>• Usare l’Applicazione per diffamare, maltrattare, molestare, insidiare, minacciare oppure violare i diritti legittimi di altre persone, inclusi in via esemplificativa ma non esaustiva i diritti alla privacy e alla pubblicità, nonché raccogliere informazioni che permettano d’identificare personalmente gli altri utenti dell’Applicazione.<br><br>• Impersonare altri individui o enti/entità compresi in via esemplificativa ma non esaustiva i rappresentanti di Konami, dichiarare il falso oppure travisare la propria affiliazione a persone o enti/entità in relazione all’Applicazione, oppure ancora esprimere o sottintendere l’avallo di Konami a dichiarazioni o affermazioni fatte dall’utente.<br><br>• Interferire con o intralciare l’uso dell’Applicazione o dei server/reti attraverso i quali essa è resa disponibile, compresa in via esemplificativa ma non esaustiva ogni azione che imponga un carico irragionevole o sproporzionatamente grande sull’Applicazione stessa, i server e le reti stesse, nonché violare le necessità, le procedure, le politiche o le norme riguardanti tali reti.<br><br>• Limitare o inibire l’uso dell’Applicazione da parte di altre persone, compreso in via esemplificativa ma non esaustiva il ricorso ad atti di pirateria informatica (hacking) o di danneggiamento anche solo parziale dell’Applicazione stessa.<br><br>• Usare l’Applicazione per promuovere, vendere o acquistare beni o servizi.<br><br>• Concedere in licenza o sub-licenza, trasferire, cedere, riprodurre, duplicare, copiare, vendere, rivendere, distribuire oppure sfruttare per scopi commerciali una parte qualsiasi dell’Applicazione o l’uso/accesso ad essa.<br><br>• Riprodurre, modificare, adattare, pubblicare, distribuire, trasmettere, creare opere derivate, tradurre, decodificare, decompilare o disassemblare qualsiasi parte dell’Applicazione senza previa approvazione da parte di Konami.<br><br>• Rimuovere dall’Applicazione o dai materiali da essa originati qualsiasi avviso di copyright, marchio o diritto di proprietà.<br><br>• Ricalcare o rispecchiare qualsiasi parte dell’Applicazione senza il preventivo ed espresso consenso scritto di Konami.<br><br>• Creare banche dati per scaricarvi e archiviarvi sistematicamente i Materiali.<br><br>• Usare robot, spider, applicazioni di ricerca o reperimento dati e in ogni caso qualsiasi altro dispositivo manuale o automatico per reperire, indicizzare, accumulare (“scrape”), estrarre (“data mine”) o in qualsiasi altro modo raccogliere i Materiali oppure riprodurre o aggirare la struttura di navigazione o la presentazione dell’Applicazione senza il preventivo consenso scritto di Konami.<br><br>• Prostituire o sfruttare i bambini a scopi pornografici o comunque compiere atti che ne causino il maltrattamento od esercitino o possano esercitare su di essi un’influenza negativa, nonché incoraggiare persone di età inferiore ai 20 anni ad assumere comportamenti erronei o malvagi (compreso incoraggiare tali persone a bere, fumare o giocare d’azzardo, trasmettere informazioni relative all’industria del sesso o d’intrattenimento per adulti, oppure ancora invitare tali persone a visitare esse stesse siti inappropriati). <br><br>• Compiere atti volti a incoraggiare o assistere il suicidio o l’abuso di farmaci/droghe, oppure che conducano a incontri a contenuto sessuale od osceno. <br><br>• Richiedere o sollecitare relazioni con altre persone, oppure compiere atti il cui scopo principale secondo Konami sia causare tali relazioni (compresi rapporti interpersonali, atti e attività di socializzazione limitatamente all’ambito dell’Applicazione).<br><br>• Pubblicare o richiedere informazioni che permettano di identificare o accedere direttamente ad altre persone (come numeri di telefono, indirizzi di posta elettronica e account di servizi SNS).<br><br>• Partecipare a campagne pre-elettorali ed elettorali, attività politiche o di natura analoga.<br><br>• Trasmettere, pubblicare, raccogliere o accumulare informazioni personali di terzi (compresi indirizzi anagrafici e/o di posta elettronica, numeri telefonici o di carte di credito e dati di account). <br><br>• Effettuare transazioni monetarie reali, convertire in denaro contante ID account, dati, caratteri o altri elementi ancora dell’Applicazione, acquistare o vendere proprietà o informazioni attraverso le attività appena descritte e comunque, sempre attraverso tali attività, compiere ogni atto analogo o fornire dichiarazioni della medesima natura. <br><br>• Senza il consenso espresso di Konami, cedere, scambiare, concedere in prestito o fornire in licenza dati, caratteri o elementi dell’Applicazione, oppure agire o fornire dichiarazioni comparabili con tali attività. <br><br>• Sfruttare eventuali difetti dell’Applicazione od ogni altro fenomeno o effetto problematico ad essa correlato per trarre benefici o per altri usi impropri.<br><br>• Agire in modi che possano istigare, incoraggiare o favoreggiare gli atti descritti in questa Sezione.<br><br>• Agire in ogni altro modo che Konami possa ritenere ragionevolmente inappropriato.<br>L’utente sarà responsabile del suo utilizzo dell'Applicazione e/o di qualsiasi informazione pubblicata o resa altrimenti disponibile tramite il suo utilizzo dell'Applicazione. Egli sarà l'unico responsabile del risarcimento per tutte le perdite o i danni, comprese spese legali ragionevoli, subiti da Konami o da terzi, inclusi, a titolo esemplificativo ma non esaustivo, tutte le perdite o i danni subiti da Konami o da terzi a causa dell’inosservanza dei presenti Termini Konami da parte dell’utente.<br><br>3.  Acquisti di Beni Virtuali. L’Applicazione può fornire all’utente l’opportunità di acquisire licenze personali, limitate, revocabili e non trasferibili per accedere e usare i beni virtuali (collettivamente, “Beni Virtuali”) esclusivamente all’interno dell’Applicazione ed esclusivamente per scopi personali e non commerciali. Queste acquisizioni possono essere effettuate utilizzando valuta virtuale (es. monete virtuali, buoni o punti) (“Valuta virtuale”) guadagnata o acquisita attraverso l’Applicazione o da uno dei fornitori di valuta virtuale di terze parti approvati da Konami. Il pagamento dovrà essere effettuato con un metodo specificato da noi separatamente. Nella misura della legge applicabile, Konami non sarà tenuta a fornire rimborsi, benefici o altri compensi all’utente, tranne nei casi in cui vi sia una violazione di questi Termini Konami da parte di Konami dovuta a negligenza intenzionale o grave da parte di Konami. Indipendentemente da qualsiasi affermazione contraria nei Termini Konami o nell’Applicazione, l’utente accetta di non avere alcun diritto o titolo a qualsiasi Materiale, inclusi senza limitazione i Beni Virtuali e/o la Valuta virtuale “guadagnata” o “acquistata”, e che tali Beni Virtuali e/o la Valuta virtuale non costituiscono né rappresentano alcun saldo di moneta reale o altro valore conservato o suo equivalente. Konami non è tenuta a rimborsare o fornire qualsiasi altro tipo di beneficio o compenso fatta eccezione per i casi in cui Konami violi i presenti Termini Konami a causa di negligenza intenzionale o grave da parte di Konami. L’utente non può concedere in sublicenza, noleggiare, prestare, vendere, regalare, lasciare in eredità, commerciare, trasferire o fornire il diritto di usare o accedere a qualunque Bene Virtuale e/o Valuta virtuale, tranne come espressamente previsto da Konami, e qualsiasi atto o tentativo di questo tipo è vietato e nullo. L’utente non deve tentare di usare o accedere a qualunque Bene Virtuale e/o Valuta virtuale non acquistati o dei quali non ha personalmente ottenuto la licenza da noi o da uno dei fornitori di valuta di terze parti approvati da Konami. Se l’utente lascia un saldo di Valuta virtuale acquistata inutilizzato per un periodo di tempo o se termina o sospende l’accesso e/o l’uso dell’Applicazione, possiamo elaborare il suo saldo in conformità con gli obblighi legali di Konami, anche presentando i fondi associati al saldo di Valuta virtuale acquistata all’ente governativo appropriato, ove richiesto dalla legge vigente.<br><br>4. Acquisto e uso di Valuta virtuale. Se l’utente desidera acquistare Valuta virtuale resa disponibile da Konami tramite l’Applicazione (ciascun acquisto simile è una “Transazione”), potrebbe essergli richiesto di fornire informazioni pertinenti alla Transazione. Tali informazioni possono includere il numero della carta di credito, la data di scadenza e l’indirizzo di fatturazione dell’utente, nonché altre informazioni associate ai metodi di pagamento proprietari. L’acquisto e l’uso di Valuta virtuale sono disciplinati dai termini e dalle condizioni di “Termini e condizioni d’uso della Valuta virtuale” riportati nell’Applicazione. L’UTENTE DICHIARA E GARANTISCE DI AVERE IL DIRITTO LEGALE A USARE QUALSIASI METODO DI PAGAMENTO UTILIZZATO IN CONNESSIONE CON QUALUNQUE TRANSAZIONE E DI ESSERE CONFORME CON I TERMINI E LE CONDIZIONI APPLICABILI A TALI METODI DI PAGAMENTO, E ACCETTA DI ESSERE RESPONSABILE PER QUALSIASI USO DEI PROPRI METODI DI PAGAMENTO DA PARTE DI MINORI. Inviando tali informazioni, l’utente concede a Konami il diritto di fornire tali informazioni a terze parti agli scopi di assistere il completamento delle Transazioni iniziate da lui o per suo conto. Potrebbe essere richiesta la verifica delle informazioni prima del riconoscimento o del completamento delle Transazioni.<br><br>5. Account e password. Potrebbe essere necessario registrarsi per accedere a determinati Materiali o aree dell’Applicazione o per acquistare licenze per i Beni virtuali. In relazione a tale registrazione Konami potrà tuttavia rifiutarsi di accordare - e l’utente non potrà perciò usare - un ID account (o un indirizzo e-mail) eventualmente già utilizzato da altri che possa essere interpretato come possibilità d’impersonare un altro individuo, che appartenga a un’altra persona, che identifichi personalmente l’utente stesso, che violi la proprietà intellettuale o i diritti di altre persone, che sia offensivo o per eventuali altri motivi, e in ogni caso a esclusiva discrezione di Konami. All’utente è fatto divieto di registrare un ID account per conto di altre persone. L’utente dichiara e garantisce che tutte le informazioni fornite durante la registrazione (comprese in via esemplificativa ma non esaustiva le informazioni relative alla propria identità) sono veritiere e complete e di non essere mai stato soggetto a restrizioni d’accesso o uso dei siti, altre proprietà Internet, giochi e altre applicazioni Konami.<br><br>L’ID account e la password sono strettamente personali e non possono essere utilizzati da altre persone. All’utente è fatto divieto di fornire in sub-licenza, cedere in prestito, vendere, regalare, cedere mediante lascito testamentario, trasferire o fornire a terzi l’uso o l’accesso all’ID account, alla password o alle impostazioni associate al proprio account (compresa ogni informazione relativa al gioco), ad eccezione di quanto espressamente stabilito da Konami, e che tali atti o tentativi di agire in tali modi sono proibiti e comunque privi di validità. All’utente è altresì fatto divieto di usare o accedere all’Applicazione usando un ID account o una password che non abbia registrato personalmente presso Konami. L’utente è responsabile del mantenimento della riservatezza di qualsiasi password usata per accedere ai Materiali o ad aree dell’Applicazione, ed è totalmente responsabile di tutte le interazioni con l’Applicazione che si verificano in connessione con la password o l’ID account (comprese, senza limitazioni, tutte le Transazioni, come definite sopra). L’utente si impegna a notificare immediatamente Konami in merito a qualsiasi uso non autorizzato della propria password o del proprio ID account o a qualsiasi altra violazione della sicurezza del proprio account o dell’Applicazione, e di compiere tutti gli sforzi possibili per rimediare a tali violazioni (comprese eventuali violazioni,

                o sospette, del copyright in connessione con l’Applicazione), e di “disconnettersi”/uscire dal proprio account dell’Applicazione (se applicabile) alla fine di ogni sessione.

                al fine di poter identificare l’utente in funzione del suo utilizzo dell'Applicazione ("ID utente") è ad esclusivo uso personale dell’utente e deve essere mantenuto riservato, e l’utente (e non Konami) è responsabile per qualsiasi uso o abuso del suo ID utente. L’ID utente viene gestito collegando reciprocamente l’ID utente e l’Account piattaforma dell’utente. I dati relativi all’utilizzo dell'Applicazione ("Dati salvati") da parte dell’utente saranno archiviati sulla base dell’ID utente su un server stabilito da Konami.<br>Konami non garantisce né si impegna che i Dati salvati saranno salvati o letti senza errori, né che non saranno eliminati o altrimenti persi. Konami può, a sua ragionevole discrezione, cambiare, modificare o eliminare i Dati salvati dell’utente nei seguenti casi senza ottenerne l’approvazione.<br><br>  (a) Se l’utente viola i presenti Termini Konami o qualsiasi altro termine applicabile al suo utilizzo dell'Applicazione.<br>  (b) Se è inevitabile per Konami per il funzionamento dell'Applicazione o a causa di un suo obbligo ai sensi del contratto con terzi.<br>  (c) Se Konami non può confermare il pagamento dell’utente ai sensi della Sezione 3.1 di cui sopra.<br>  (d) Se i Dati salvati dell’utente non sono stati utilizzati o consultati per almeno sei (6) mesi.<br><br>Nel caso in cui dovesse esserci un cambio di fornitore dell'Applicazione, incluso il caso in cui Konami trasferisca la sua attività relativa all'Applicazione a terzi, Konami potrà assegnare o trasferire i presenti Termini Konami, i suoi diritti e obblighi e qualsiasi informazione in possesso di Konami, incluso l’ID utente, al cessionario o a terzi che subentrino nella fornitura dell'Applicazione. Con la presente l’utente accetta tale assegnazione o trasferimento.<br><br>7. Monitoraggio, cancellazione e blocco. Konami si riserva il diritto, pur senza obbligo, di monitorare e a propria unica discrezione rimuovere i materiali e le informazioni trasmesse nonché bloccare (o richiedere ai Rivenditori delle piattaforme di bloccare) gli utenti che abbiano inviato/trasmesso materiali oppure agito in un modo che caso per caso Konami stessa ritenga abbiano violato i Termini Konami, o non ritenga comunque adatti all’Applicazione. L’eventuale decisione di Konami di non adire le vie legali per qualsiasi violazione dei Termini Konami non potrà essere interpretata come rinuncia ai Termini Konami o ai diritti legali di Konami. Konami si riserva altresì il diritto di rendere pubblica ogni trasmissione di materiale, comprese in via esemplificativa ma non esaustiva le circostanze relative a tali trasmissioni e l’identità di chi le ha effettuate, nonché ogni altra eventuale informazione ancora al fine di garantire il corretto uso dell’Applicazione, proteggere Konami stessa, le proprie controllate e ogni altro utente dell’Applicazione, nonché ottemperare ad ogni obbligo legale o richiesta governativa. L’UTENTE CONVIENE DI ESSERE RESPONSABILE DELL’OTTENIMENTO E DEL MANTENIMENTO DEGLI APPARECCHI NECESSARI ALL’ACCESSO E ALL’USO DELL’APPLICAZIONE QUALI, A TITOLO D’ESEMPIO, OGNI DISPOSITIVO TELEFONICO E HARDWARE PER COMPUTER NECESSARIO, NONCHÉ DELL’ONERE DEI RELATIVI COSTI. SOSPENSIONE O CESSAZIONE. Qualora l’utente violi i Termini Konami o qualsiasi altro termine applicabile, oppure qualora Konami sospetti, a propria unica discrezione, un’attività fraudolenta, non autorizzata o illecita associata all’account dell’utente stesso, Konami si riserva il diritto immediatamente di (a) sospendere, limitare l’accesso o cessare l’utilizzo, del tutto o in parte,dell’Applicazione da parte dell’utente o (b) cancellarne l’account senza preavviso, nel caso in cui:<br><br>(a) l’utente violi i presenti Termini Konami o qualsiasi altro termine applicabile al suo utilizzo dell'Applicazione;<br>(b) l’utente violi qualsiasi accordo o contratto di qualsiasi forma con Konami, inclusi ma non limitati a, termini di utilizzo, termini di servizio o altro, che sia applicabile ai prodotti e servizi Konami diversi dall'Applicazione;<br>(c) l’utilizzo di uno qualsiasi dei prodotti o servizi Konami da parte dell’utente o il suo account per lo stesso sia stato cancellato per un motivo a lui attribuibile;<br>(d) Konami non possa confermare il pagamento del corrispettivo di qualsiasi forma, come commissioni e canoni di abbonamento, pagabili per l’utilizzo di prodotti e/o servizi a pagamento da parte dell’utente, inclusi ma non limitati a, Beni virtuali e Valuta virtuale;<br>(e) siano trascorsi sei (6) mesi dall’ultimo accesso all'Applicazione da parte dell’utente;<br>(f) l’utente sia un membro di, o abbia relazioni con un membro o qualsiasi persona o entità che abbia una relazione con un membro di, forze antisociali; o<br>(g) nel caso in cui Konami sospetti ragionevolmente che l’utente rientri in una delle precedenti voci da (a) a (f)<br>La sospensione o la risoluzione da parte di Konami ai sensi della presente Sezione non impedirà a Konami di richiedere i danni da essa derivanti, e la presente Sezione si applicherà a qualsiasi danno da essa derivante, il che significa che Konami non sarà tenuto a fornire rimborsi, benefici o qualsiasi altro risarcimento all’utente in relazione a tale sospensione o risoluzione.<br><br>Fermo restando quanto in deroga a ogni altra disposizione dei Termini Konami o di altri termini applicabili, Konami si riserva il diritto di ridurre, liquidare, sospendere, disattivare, rimuovere l’accesso a e/o cessare qualsiasi e tutti i Beni virtuali qualora sospetti, a propria unica discrezione, che (a) l’utente abbia usato i Beni virtuali stessi in violazione dei Termini Konami e/o di altri termini applicabili e/o (b) l’utente abbia usato uno o più Beni virtuali per porre in essere attività fraudolente o illegali. Konami può sospendere o cessare l'Applicazione, del tutto o in parte, con o senza notifica all'utente, nel caso in cui diventi impossibile, nel senso comune, fornire l'Applicazione a causa di scioperi, problemi sindacali, calamità naturali, guerre, restrizioni legali, incidenti inevitabili o qualsiasi altra causa simile che sia al di fuori del controllo di Konami ("Evento di forza maggiore"). Konami non sarà responsabile per eventuali perdite, danni o altri svantaggi subiti dall'utente in relazione a qualsiasi Evento di forza maggiore.<br><br>15. CESSAZIONE DA PARTE DELL’UTENTE. In seguito all’eventuale rimozione dell’Applicazione dal dispositivo dell’utente, la disponibilità dei Beni virtuali potrebbe cessare. A meno che non sia stato notificato altrimenti tramite una notifica separata da parte di Konami, l’utente non può trasferire, assegnare, cedere o richiedere un rimborso per i Beni virtuali.<br><br>16. Legge applicabile. L’utente conviene che l’accesso e l’uso dell’Applicazione sono regolati dalle leggi del Giappone e rinuncia a qualsiasi scelta di norma legale che darebbe luogo al ricorso a leggi di giurisdizioni diverse da quella del Giappone stesso. Tutte le dispute e le controversie derivanti da o in connessione con l’Applicazione sono di esclusiva competenza dei tribunali del Distretto di Tokyo con sede a Tokyo e a questo riguardo l’utente accetta di assoggettarsi alla giurisdizione di detti tribunali convenendo altresì che ad essi solo spetta la scelta della sede.<br><br>17. Divieto di cessione. L’utente non può prestare, cedere in licenza, trasferire o subentrare a terzi tutti o parte dei propri diritti, obblighi, stati o interessi relativi all’uso dell’Applicazione.<br><br>18. Variazioni a seconda dei Paesi/regioni. L’utente conviene e accetta che l’Applicazione stessa potrebbe variare a seconda del Paese/regione per rispettare le leggi e i regolamenti applicabili.<br><br>19. Clausola salvatoria. Qualora una qualsiasi disposizione dei Termini Konami o la sua applicazione a persone, luoghi o circostanze sia ritenuta non valida, nulla o altrimenti inapplicabile, tale disposizione sarà applicata nella misura massima possibile in modo da realizzare l’intento delle parti o, nell’impossibilità di tale applicazione, si considera rimossa dai Termini Konami mentre rimarranno in pieno vigore ed efficacia i restanti termini e disposizioni applicabili ad altre persone, luoghi e circostanze.<br><br>20. RINUNCIA. You also agree not to inform any person (other than Konami) of such bugs or errors.<br>• Use the Application in connection with designing or assisting in the design of cheats, automation software, bots, hacks, mods or any other unauthorized third-party software.<br>• Use the Application to defame, abuse, harass, stalk, threaten or otherwise violate the legal rights of others, including without limitation others' privacy rights or rights of publicity, or harvest or collect personally identifiable information about other users of the Application.<br>• Impersonate any person or entity, including without limitation any representative of Konami; falsely state or otherwise misrepresent your affiliation with any person or entity in connection with the Application; or express or imply that Konami endorses any statement that you make.<br>• Interfere with or disrupt operation of the Application or servers or networks used to make the Application available, including without limitation taking any action that imposes an unreasonable or disproportionately large load upon the Application or upon such servers or networks; or violate any requirements, procedures, policies or regulations of such networks.<br>• Restrict or inhibit any other person from using the Application (including without limitation by hacking or defacing any portion of the Application).<br>• Use the Application to advertise or offer to sell or buy any goods or services.<br>• License, sublicense, transfer, assign, reproduce, duplicate, copy, sell, resell, distribute or otherwise exploit for any commercial purposes, any portion of, use of or access to the Application.<br>• Reproduce, modify, adapt, publish, distribute, broadcast, make derivative works of, translate, reverse engineer, decompile or disassemble any portion of the Application without Konami’s prior approval.<br>• Remove any copyright, trademark or other proprietary rights notice from the Application or materials originating from the Application.<br>• Frame or mirror any part of the Application without Konami’s express prior written consent.<br>• Create a database by systematically downloading and storing Materials.<br>• Use any robot, spider, site search/retrieval application or other manual or automatic device to retrieve, index, “scrape”, “data mine” or in any way gather Materials or reproduce or circumvent the navigational structure or presentation of the Application without Konami’s express prior written consent.<br>• Prostitute a child, exploit a child for pornography or engage in acts likely to constitute child abuse; or engage in acts that will or may have a bad influence on or encourage bad behaviour among persons under 20 years of age (including encouraging those persons to drink, smoke or gamble, posting information relating to the adult or sex entertainment industry and soliciting them to access sites inappropriate for use by themselves).<br>• Engage in acts that encourage or assist suicide or drug abuse, or any act leading to meetings for the purpose of sexual or obscene acts.<br>• Seek a relationship with another person, or engage in acts that Konami determines is made for the main purpose of causing a relationship (including relationships, acts and socializing limited to within the Application).<br>• Post or ask for information that can identify or enable direct access to an individual (such as a telephone number, e-mail address and SNS service account).<br>• Campaign for Pre-election campaign, campaign or participate in politics or other similar acts.<br>• Post, publish, collect or accumulate personal information of third parties (including addresses, e-mail addresses, telephone numbers, credit card numbers and account numbers).<br>• Conduct real money trading, convert Account IDs, data, characters or items in the Application into cash, purchase or sale of property or information through the foregoing or any act or statement comparable to the foregoing.<br>• Unless explicitly permitted by Konami, assign, exchange, lend or license data, characters or items in the Application, or act or state something comparable to the foregoing.<br>• Use any program defects of the Application or any other problematic phenomenon or effect to gain a benefit or for other improper purpose.<br>• Engage in any act that instigates, encourages or abets any acts set forth in this Section.<br>• Engage in any other acts Konami determines to be inappropriate with rational reason.<br>You shall be responsible for your use of the Application and/or any information that you post or otherwise make available through your use of the Application.<br><br>You shall be solely responsible for the compensation for any and all losses or damages, including reasonable attorney’s fees, suffered by Konami or any third party, including but not limited to, any and all losses or damages suffered by Konami or any third party due to your incompliance with these Konami Terms.<br><br>3. Purchases of Virtual Goods. The Application may provide you with an opportunity to aquire personal, limited, revocable, non-transferable licences to access and use virtual goods (collectively, “Virtual Goods”) solely within the Application and solely for your personal, non-commercial purposes. These acquisition may be made using virtual currency (e.g., virtual coins, tokens, or points) (“Virtual Currency”) earned or acquired through the Application or from one of Konami’s approved third-party virtual currency providers. You shall make the payment therefor in a method separately specified by us. To the extent of applicable law, Konami shall not be required to provide refunds, benefits or other compensation to you, except in cases where there is a breach by Konami of these Konami Terms due to intentional or gross negligence on the part of Konami. Notwithstanding anything to the contrary in Konami Terms or in the Application, you agree that you have no right or title to any Materials, including without limitation any Virtual Goods and/or “earned” or “purchased” Virtual Currency, and that such Virtual Goods and/or Virtual Currency do not constitute or represent any balance of real currency or other stored value or its equivalent. Konami shall not be required to provide refunds, benefits or other compensation to you, except in cases where there is a breach by Konami of these Konami Terms due to intentional or gross negligence on the part of Konami. You may not sublicense, lease, lend, sell, gift, bequeath, trade, transfer or provide use or access to any Virtual Goods and/or Virtual Currency, except as expressly provided by Konami, and any such act or attempted act is prohibited and void. You shall not attempt to use or access any Virtual Goods and/or Virtual Currency that you have not personally licensed or acquired from us or from one of Konami’s approved third-party currency providers. If you leave a balance of purchased Virtual Currency unused for a period of time or if we terminate or suspend your access to and/or use of the Application, we may process your balance in accordance with Konami’s legal obligations, including by submitting funds associated with your purchased Virtual Currency balance to the appropriate governing body where required by applicable law.<br><br>4. Purchase and Use of Virtual Currency. If you wish to purchase Virtual Currency made available by Konami through the Application (each such purchase, a "Transaction"), you may be asked to supply certain information relevant to your Transaction. The purchase and use of Virtual Currency are governed by terms and conditions of the “Virtual Currency Terms of Use” located in the Application. You agree to immediately notify Konami of any unauthorized use of your password or Account ID or any other breach of security related to your account or to the Application, and to make reasonable efforts to remedy such breaches (including any breaches relating to known or suspected copyright infringement in connection with the Application), and to ensure that you “log off”/exit from your account with the Application (if applicable) at the end of each session. Konami is not liable for any loss or damage arising from your failure to comply with any of the foregoing obligations.<br><br>6. Saved Data. An identifier automatically issued to you by Konami for Konami to identify you for your use of the Application (“User ID”) is for your personal use only and should be kept confidential, and you (and not Konami) are responsible for any use or misuse of your User ID. Konami shall not be responsible for any losses, damages, or other disadvantages suffered by you in relation to any Force Majeure Event.<br><br>15. TERMINATION BY YOU. If you delete the Application from your device, your Virtual Goods may no longer be usable. Unless otherwise notified via a separate notification from Konami, you cannot transfer, assign, give away or request refund for your Virtual Goods.<br><br>16. Governing Law. You agree that your access to and use of the Application is governed by the laws of Japan without giving effect to any choice of legal rule that would cause application of laws of any jurisdiction other than Japan. All disputes and controversies arising out of or in connection with the Application shall be resolved exclusively by the Tokyo District Court in Tokyo, and you hereto agree to submit to the jurisdiction of said courts and agree that the venue shall lie exclusively with such courts.<br><br>17. Variations Depending on Countries/Regions. If any provision of these Konami Terms, or the application thereof to any person, place or circumstance, shall be held to be invalid, void or otherwise unenforceable, such provision shall be enforced to the maximum extent possible so as to effect the intent of the parties, or, if incapable of such enforcement, shall be deemed to be deleted from these Konami Terms, and the remainder of these Konami Terms and such provisions as applied to other persons, places and circumstances shall remain in full force and effect.<br><br>20. WAIVER. No waiver by Konami of any term, provision or condition of Konami Terms, whether by conduct or otherwise, in any one or more instance, shall be deemed to be or be construed as a further or continuing waiver of any such term, provision or condition or as a waiver of any other term, provision or condition of Konami Terms.<br><br>21. Contact Information for Inquiries.<br>The method for making any inquiries concerning Konami Terms is stipulated in the Application.<br><br>22. Language. Konami Terms have been prepared in, and will be construed in, English language. Translated versions have been prepared for the convenience of users whose mother language is the relevant translation language; if there is any discrepancy in the meaning or interpretation between the English version and any translated version of Konami Terms, the meaning and interpretation of Konami Terms prepared in English shall prevail.<br><br>23. Changes to These Konami Terms. Konami reserves the right to change or amend these Konami Terms in the following cases, to the extent permitted by law.<br><br>(a)  If such change or amendment to these Konami Terms conforms to your general interest.<br><br>(b)  If such change or amendment to these Konami Terms (A) does not run afoul of the purpose of these Konami Terms, and (B) is reasonable in light of the circumstances concerning such change or amendment, such as, the necessity, the appropriateness, and the details of, the changed or amended conditions.<br><br>Any change or amendment to these Konami Terms will be made known well in advance to the user in a suitable manner (including but not limited to by email or by display of the notice in the Application) and shall become effective as of the effective date set forth in such notice (“Amendment Effective Date”).<br><br>Your access to or use of the Application following the Amendment Effective Date shall constitute your acceptance of those changes or amendments. If you do not agree to any such change or amendment, you shall terminate your use of the Application.<br><br>Konami is not responsible for any damages arising out of the change or amendment to these Konami Terms, or the termination of your use of the Application pursuant to this Section, except for the cases such damages arising from gross negligence or willful misconduct.<br><br>24. ADDITIONAL TERMS. This section applies to users who own or control the Application on OS smart devices provided by Apple, Inc. (“Apple”). In the event of conflict between this section and any other section in Konami Terms, this section shall prevail. In the case where any section in Konami Terms other than this section is less restrictive than this section, this section shall prevail.<br>24-1. Konami grants you a licence only, for the non-transferable right to download and use the Application for your personal, non-commercial purposes, according to the terms of the Apple Media Services Terms and Conditions.<br>24-2. Apple has no obligation to provide any maintenance and support services for the Application.<br>24-3. In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Application to you; and that, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatever with respect to the Application.<br>24-4. Apple bears no responsibility for any claims by you or a third party related to your possession or use of the Application, including, but not limited to: (i) A claim of product liability; (ii) A claim that the Application fails to conform to any applicable legal or regulatory requirement; (iii) A claim arising under consumer protection or similar legislation; and (iv) A claim by you or a third party that the Application or the use of the Application by you infringes the intellectual property rights of you or a third party.<br>24-5. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a ”terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.<br>24-6. The Application is provided by Konami Digital Entertainment Co., Ltd., headquartered at 1-11-1 Ginza, Chuo-Ku, Tokyo 104-0061.<br>24-7. You must comply with any applicable third-party terms of agreement when using the Application.<br>24-8. You acknowledge and agree that Apple Inc. and its subsidiaries are third-party beneficiaries to Konami Terms, and on your acceptance of Konami Terms, you acknowledge that Apple has the right (and will be deemed to have acknowledged the right) to enforce Konami Terms against you as third-party beneficiary.
