                Ltd. (“Konami”) appreciates your interest in Konami’s
                Ltd (« Konami ») apprécie votre intérêt pour l’application de Konami intitulée «eFootball™» (ainsi que tous les contenus, ci-après nommés, «l’Application»). En accédant ou en utilisant l'Application, vous acceptez de respecter ces termes et conditions (« Conditions Konami ») en plus des conditions fournies par Platformers (« Conditions de la plateforme »). Si vous n'acceptez pas les termes et conditions Konami et Platfom, vous ne pouvez pas accéder à l'Application ni l'utiliser. Veuillez noter que Konami n'est pas affilié à Platformers, n'a aucun contrôle sur les Conditions Platform, et n'est pas responsable des actes ou omissions de Platformers et que Konami est seul responsable de l'Application, et non Platformers. VOUS DEVEZ CONFIRMER LES CONDITIONS KONAMI AVEC VOS PARENT OU VOTRE TUTEUR SI VOUS HABITEZ DANS LES PAYS OU RÉGIONS ET QUE VOUS AVEZ QUI SONT RESPECTIVEMENT DÉFINIS SÉPARÉMENT PAR KONAMI. VOUS DEVEZ ACCEPTER QUE VOTRE IDENTIFIANT UTILISATEUR CRÉÉ CONFORMÉMENT AUX « Conditions d’utilisation du site e-amusement » POUR LES MINEURS (« COMPTE ENFANT ») SOIT LIÉ À L’IDENTIFIANT UTILISATEUR DE VOS PARENTS OU DE VOTRE TUTEUR ET PLACÉ SOUS LEUR CONTRÔLE. Nonobstant ce qui précède, vous n'êtes pas autorisé à accéder à l'Application ou à l'utiliser, à moins que les Condition de laPlateforme vous permettent d’accéder et d’utiliser la Plateforme. Propriété intellectuelle et licence. L'Application, incluant, les informations et contenus disponibles dans l'Application, qui peut inclure des jeux vidéos et d’autres applications logicielles, et tout ce qui les compose, tels que le contenu audio-visuel, la Monnaie Virtuelle (telle que définie ci-dessous) et les biens virtuels (tels que définis ci-dessous) (collectivement appelés « Contenus ») sont protégés par les droits d'auteur, les marques de commerce et autres droits de propriété intellectuelle, qui sont détenus et contrôlés par Konami, ses sociétés affiliées ou associées ou ses fournisseurs de services tiers ou concédants de licence.<br><br>Sous réserve de votre respect des Conditions de Konami, Konami vous garantit par la présente une licence personnelle, limitée, révocable et non-transférable pour l'accès et l'utilisation de l’Application et des Contenus à partir de l'Application uniquement, et à but personnel et non commercial uniquement. Rien de ce qui est contenu dans l'Application ne garantit ou ne doit être interprété comme garantissant une licence ou un droit pour quelque utilisation commerciale des Contenus que ce soit ni d'autre contenu appartenant à des tiers, marques déposées ou propriétés intellectuelles, protégés par un droit d'auteur sans l'autorisation préalable par écrit de Konami.<br><br>Konami se réserve également le droit de modifier (en faisant l’effort de le faire savoir à l’avance à l’utilisateur de manière appropriée), de suspendre, d'interrompre provisoirement ou de vous interdire  (à faire savoir à l’avance à l’utilisateur de manière appropriée) l'accès à l'Application (ou toute portion de l'Application). Le cas échéant, votre licence d'accès et d'utilisation des Contenus (incluant toute Monnaie virtuelle ou Bien Virtuel) sera automatiquement clôturée ou suspendue. La société Konami ne pourra être tenue de vous assurer le remboursement, bénéfice, ou toute autre compensation en relation avec cette résiliation ou suspension.<br><br>« eFootball™ logo », « eFootball™» et « e-Football » sont des marques déposées ou des marques commerciales de Konami au Japon et dans d'autres pays et régions.<br><br>2. Règles de conduite. En utilisant l'Application, vous aurez l'obligation de vous conformer à toutes les lois, règles et réglementations applicables. Konami compte sur le respect des droits et de la dignité d'autrui de la part des utilisateurs de l'Application. En plus d'autres clauses et conditions aux Conditions Konami, votre utilisation de l'Application est conditionnée au respect des règles de conduite énoncées dans cette section ; le non-respect de ces règlements peut entraîner la résiliation de la licence d'utilisation et de l'accès à l'Application. Vous acceptez de ne pas :<br><br>• Poster, transmettre, ni même mettre à disposition, sur ou en relation avec l'Application :<br><br>-  Tout ce qui est ou peut être (a) menaçant, harcelant, dégradant, haineux ou intimidant ; (b) diffamatoire ; (c) frauduleux ou délictueux ; (d) obscène, indécent, pornographique ou autrement répréhensible ; (e) protégé par les droits d'auteur, marque de commerce, secret commercial, droit de publicité ou autres droits de propriété sans l’autorisation expresse et préalable du propriétaire de ce droit ; (f) lié à l'alcool ou à la vente des produits du tabac, des munitions ou des armes à feu ; ou (g) lié à des paris ou jeux de hasard.<br><br>-  Tout contenu qui pourrait engager des responsabilités pénales ou civiles ; qui encourage une conduite qui constituerait une infraction pénale ; ou qui encourage ou fournisse des instructions relatives à des activités illégales ou à des activités telles que le « hacking » (piratage de réseau de télécommunication), le « cracking » (craquage de protections logicielles des programmes), ou le « phreaking » (sabotage des systèmes téléphoniques).<br><br>-  Tout virus, ver informatique, cheval de Troie (programme pirate à fins malveillantes), Easter egg (fonctions cachées), time bomb (bombe à retardement), spyware (logiciel espion) ou autre code informatique, fichier ou programme qui soit potentiellement nuisible ou intrusif, qui causent ou soient conçus pour causer des dommages, détourner le fonctionnement ou contrôler l'utilisation de tout matériel informatique, logiciel, ou équipement.<br><br>-  Toute publicité non sollicitée ou non autorisée, contenu promotionnel, « courrier poubelle », « courrier indésirable », « chaîne de lettres », « système pyramidal » ou opportunité d'investissement, ou toute autre forme de sollicitation.<br><br>-  Tout contenu, information non publique à propos de la société sans l'autorisation appropriée nécessaire à cela.<br><br>• Utiliser l'Application à des fins frauduleuses ou illégales, incluant tout acte ou tentative d’acte de la sorte concernant les paiements effectués dans le cadre de l’Application.<br><br>• Tenter de tirer un profit indu pour vous-même ou toute autre personne quant à l'utilisation de l'Application, en utilisant notamment des codes de triche, des techniques de piratage, de logiciels d'automatisation, de bot (programme simulant un comportement humain), de piratages, de modules, ou tout logiciel de tiers non autorisés, ou en exploitant tous bugs ou erreurs de l'Application. Vous acceptez également de n'informer personne (d'autre que Konami) à propos de ces bugs et erreurs.<br><br>• Utiliser l'Application en lien avec la conception ou l'aide à la conception de codes de triches, de logiciels d'automatisation, de bot (programme simulant un comportement humain), de piratages, de modules, ou tout autre logiciel de tiers non autorisés.<br><br>• Utiliser l'Application dans le but de diffamer, agresser, harceler, traquer, menacer ou encore violer les droits d'autrui, y compris, sans restriction, tous les droits relatifs à la vie privée ou les droits à l'image, ou recueillir ou collecter des données d'identification personnelles à propos d'autres utilisateurs de l'Application.<br><br>• Vous faire passer pour une personne ou une entité, sans excepter aucun représentant de Konami ; présenter de manière inexacte ou délibérément erronée vos rapports avec des personnes ou entités en relation avec l'Application ; ou exprimer ou insinuer que Konami approuve toute déclaration que vous puissiez faire.<br><br>• Perturber ou interrompre le fonctionnement de l'Application ou des serveurs ou des réseaux servant à la bonne disponibilité de l'Application sans excepter quelque action que ce soit imposant une charge disproportionnée et déraisonnablement lourde à l'Application ou à ces serveurs ou réseaux ; ou violer les conditions, procédures, polices, ou règlementations de ces réseaux.<br><br>• Restreindre ou empêcher d'autres personnes d'utiliser l'Application (y compris, sans restriction, par piratage ou altération de quelque portion de l'Application que ce soit).<br><br>• Utiliser l'Application pour faire de la publicité ou offrir d'acheter ou de vendre quelque bien ou service que ce soit.<br><br>• Céder des licences ou des sous-licences, transférer, attribuer, reproduire, dupliquer, copier, vendre, revendre, distribuer, ou exploiter à des fins commerciales, toute portion ou utilisation de, ou accès à l'Application que ce soit.<br><br>• Reproduire, modifier, adapter, publier, distribuer, diffuser, traduire, inverser la conception, décompiler ou désassembler une portion de l'Application ou en faire des usages dérivés sans l'accord préalable de Konami.<br><br>• Retirer de copyright, marque déposée, ou autre notice de droits à la propriété de l'Application ou de contenus provenant de l'Application.<br><br>• Créer de trame ou de miroir de quelque portion de l'Application que ce soit sans le consentement écrit de Konami au préalable.<br><br>• Créer une base de données en téléchargeant de façon systématique et en stockant des Contenus.<br><br>• Utiliser de robot, de moteur de recherche Web, d'application de recherche interne/ou d'extraction de données, ou d'autres systèmes manuels ou automatiques afin d'extraire, d'indexer, capturer, exploiter, ou par tout autre moyen accumuler des Contenus ou reproduire ou contourner la structure de navigation ou la présentation de l'Application sans l'accord écrit de Konami au préalable.<br><br>• Prostituer d'enfant, exploiter d'enfant à des fins pornographiques ou agir de telle manière qu'elle constitue un acte de maltraitance juvénile ; et d'avoir un comportement qui soit ou puisse relever d'une mauvaise influence ou qui encourage un comportement répréhensible auprès de personnes de moins de 20 ans (y compris l'encouragement de ce personnes à boire, fumer ou jouer de l'argent, poster des informations relatives à l'industrie du divertissement pour adulte ou à l'industrie du sexe, et les solliciter à visiter des sites internet qui soient inappropriés pour eux). <br><br>• Agir de façon à encourager ou à assister au suicide ou à l'abus de drogues, ou tout acte promouvant des rencontres à des fins sexuelles ou obscènes. <br><br>• Rechercher de relation avec une autre personne ou agir d’une manière que Konami estime comme ayant pour but essentiel d’inciter à une relation (sans excepter les relations, comportements, sociabilisations se limitant seulement au contenu).<br><br>• Poster ou demander des informations qui puissent identifier ou qui permettent un accès direct à une personne (telles qu'un numéro de téléphone, une adresse e-mail, et un compte de réseau social).<br><br>• Mener de campagne pré-électorale, militer, faire de la politique ou tout autre agissement similaire.<br><br>• Poster, publier, recueillir ou accumuler d'informations personnelles de tiers (sans excepter les adresses, les adresses e-mail, les numéros de téléphones, les numéros de carte de crédit, et les numéros de compte). <br><br>• Conduire des transactions à montants réels, convertir des identifiants de compte, des données, des caractères ou des articles de l'Application en espèces, l'achat ou la vente de propriété ou d'information par le biais de ce qui précède, ou tout acte ou déclaration comparable à ce qui précède. <br><br>• À moins d'avoir obtenu une permission explicite de Konami, attribuer, échanger, prêter ou céder des données, des personnages, des articles dans l'Application, ou agir de façon ou déclarer quelque chose de comparable à ce qui précède. <br><br>• Utiliser de défauts de programme de l'Application, ou tout autre phénomène ou effet causant des problèmes afin d'en tirer avantage ou pour d'autres fins répréhensibles.<br><br>• Agir de façon qui instigue, encourage ou soutienne tout agissement que ce soit, mentionné dans cette Section.<br><br>• Agir de toute autre manière que Konami juge inappropriée pour des raisons rationnelles.<br><br>Vous serez responsable de votre utilisation de l’Application et/ou de toute information que vous publiez ou rendez publique de toute autre manière à travers l’utilisation de l’Application.<br><br>Vous serez seul responsable des compensations pour toute perte ou tout dommage, y compris les frais d’avocats raisonnables, subits par Konami ou tout autre tiers, y compris, mais sans s’y limiter, toute perte ou tout dommage subit par Konami ou tout autre tiers en raison de votre non-respect des présentes Conditions Konami.<br><br>3.  Achats de biens virtuels. L'Application peut vous donner la possibilité d'acquérir des licences personnelles, limitées, révocables et non transférables pour accéder et utiliser des biens virtuels (collectivement, « Biens virtuels ») uniquement par le biais de l'Application et uniquement à des fins personnelles et non commerciales. Ces acquisitions peuvent être réalisés à l'aide d'une monnaie virtuelle (par exemple, pièces de monnaie virtuelle, jetons ou points) («Monnaie virtuelle») acquise ou obtenue par le biais de l'Application ou de l'un des fournisseurs tiers de monnaie virtuelle agréés par Konami. Vous devrez effectuer le paiement d’après une méthode séparée que nous spécifierons. Konami ne sera pas tenu de vous fournir de remboursement, des avantages ou toute autre forme de compensations, sauf en cas de violation de ces Conditions Konami par Konami en raison de négligences intentionnelles ou graves de la part de Konami. Nonobstant toute disposition contraire dans les Conditions Konami ou dans l'Application, vous acceptez n'avoir aucun droit ni titre sur aucun contenu, y compris, sans limitation, les biens virtuels et/ou une monnaie virtuelle « acquise » ou « achetée », et que ces biens virtuels et/ou monnaie virtuelle ne constituent ni ne représentent aucun solde de monnaie réelle ou autre valeur stockée ou son équivalent. Konami ne sera pas tenu de vous fournir des remboursements, avantages ou autre compensation, sauf en cas de violation de ces Conditions Konami par Konami en raison de négligences intentionnelles ou graves de la part de Konami. Vous ne pouvez pas céder, louer, prêter, vendre, offrir, léguer, commercer, transférer ou fournir l'utilisation ou l'accès aux biens virtuels et/ou à une monnaie virtuelle sauf disposition expresse contraire de Konami, et un tel acte ou tentative d'acte est interdit et nul. Vous ne devez pas tenter d'utiliser ou d'accéder à des biens virtuels et/ou une monnaie virtuelle que vous n'avez pas personnellement acquis ou acquis auprès de nous ou d'un des fournisseurs tiers de monnaie agréés par Konami. Si vous laissez un solde de monnaie virtuelle non utilisé pendant une période de temps ou si nous résilions ou suspendons votre accès et/ou utilisation de l'Application, nous pouvons gérer votre solde conformément aux obligations légales de Konami, y compris en soumettant des fonds associés à votre solde de monnaie virtuelle acquise, à l’organe de direction approprié lorsque la loi l’exige.<br><br>4. Achat et utilisation de monnaie virtuelle. Si vous souhaitez acheter une monnaie virtuelle mise à disposition par Konami via l'Application (chacun de ces achats, une « Transaction »), il peut vous être demandé de fournir certaines informations pertinentes pour votre transaction. De telles informations peuvent inclure votre numéro de carte de crédit et sa date d'expiration et adresse de facturation, ainsi que d'autres informations associées aux méthodes de paiement exclusives. L'achat et l'utilisation de Monnaie virtuelle sont régis par les clauses et conditions des « Conditions d'utilisation de la monnaie virtuelle » figurant dans l'Application. VOUS DÉCLAREZ ET GARANTISSEZ QUE VOUS AVEZ LE DROIT JURIDIQUE D'UTILISER TOUTE MÉTHODE DE PAIEMENT UTILISÉE DANS LE CADRE DE TOUTE TRANSACTION ET QUE VOUS ÊTES EN CONFORMITÉ AVEC L'ENSEMBLE DES MODALITÉS ET CONDITIONS APPLICABLES À CES MÉTHODES DE PAIEMENT, ET VOUS ACCEPTEZ D'ÊTRE RESPONSABLE DE TOUTE UTILISATION DE VOS MÉTHODES DE PAIEMENT PAR DES MINEURS. En soumettant de telles informations, vous accordez à Konami le droit de fournir ces informations à des tiers dans le but de faciliter la réalisation de transactions initiées par vous ou en votre nom. YOU HAVE TO CONFIRM KONAMI TERMS WITH YOUR PARENT OR GUARDIAN, IF YOU LIVE IN THE COUNTRIES OR REGIONS AND ARE OF THE AGE RESPECTIVELY, SEPARATELY DESIGNATED BY KONAMI. YOU HAVE TO AGREE YOUR USER ID ISSUED ACCORDING TO “e-amusement Site Terms and Conditions” FOR MINORS (“CHILDREN  ACCOUNT”) ARE LINKED TO YOUR. USER ID OF YOUR PARENT OR GUARDIAN, TO BE PLACED UNDER CONTROL, Notwithstanding the foregoing, you are not eligible to access or use the Application unless Platform Terms allow you to access and use the Platform.                 hereby grants to you a personal, limited, revocable non-transferable licence to access and use the Application and Materials solely as incorporated therein, solely for your personal, non-commercial purposes. Nothing contained in the Application grants or should be construed as granting any licence or right to make commercial use of any Materials or other Konami or third-party copyrighted materials, trademarks or intellectual property without Konami’s prior written permission.<br>Konami may also modify (with an effort to be made known in advance to the user in a suitable manner), suspend, discontinue or prohibit (to be made known well in advance to the user in a suitable manner) you from accessing the Application (or any portion of the Application). In such instances, your licence to access and use Materials (including any Virtual Currency and Virtual Goods) shall be automatically terminated or suspended, as applicable. In addition to other terms and conditions of Konami Terms, your use of the Application is conditioned upon your compliance with rules of conduct set forth in this section; your failure to comply with such rules may result in termination of your licence to use and access the Application. You agree that you will not:<br>• Post, transmit or otherwise make available, through or in connection with the Application:<br>- Anything that is or may be (a) threatening, harassing, degrading, hateful or intimidating; (b) defamatory; (c) fraudulent or tortious; (d) obscene, indecent, pornographic or otherwise objectionable; (e) protected by copyright, trademark, trade secret, right of publicity or other proprietary rights without the express prior consent of the owner of such right; (f) related to alcohol or the sale of tobacco products, ammunition or firearms; or (g) related to wagering or gambling.<br>- Any material that would give rise to criminal or civil liability; that encourages conduct that would constitute a criminal offence; or that encourages or provides instructional information about illegal activities or activities such as “hacking”, “cracking” or “phreaking”.<br>- Any virus, worm, Trojan horse, Easter egg, time bomb, spyware or other computer code, file or program that is potentially harmful or invasive or may or is intended to damage or hijack the operation of, or to monitor the use of, any hardware, software or equipment.<br>- Any unsolicited or unauthorized advertising, promotional material, “junk mail”, “spam”, “chain letter”, “pyramid scheme” or investment opportunity, or any other form of solicitation.<br>- Any material, non-public information about a company without proper authorization to do so.<br>• Use the Application for any fraudulent or unlawful purpose, including any such act or attempted act with respect to payments made in connection with the Application.<br>• Attempt to gain for yourself or any other person any unfair advantage with respect to use of the Application, including use of cheats, exploits, automation software, bots, hacks, mods or any unauthorized third-party software, or by exploiting any bugs or errors in the Application. You also agree not to inform any person (other than Konami) of such bugs or errors.<br>• Use the Application in connection with designing or assisting in the design of cheats, automation software, bots, hacks, mods or any other unauthorized third-party software.<br>• Use the Application to defame, abuse, harass, stalk, threaten or otherwise violate the legal rights of others, including without limitation others' privacy rights or rights of publicity, or harvest or collect personally identifiable information about other users of the Application.<br>• Impersonate any person or entity, including without limitation any representative of Konami; falsely state or otherwise misrepresent your affiliation with any person or entity in connection with the Application; or express or imply that Konami endorses any statement that you make.<br>• Interfere with or disrupt operation of the Application or servers or networks used to make the Application available, including without limitation taking any action that imposes an unreasonable or disproportionately large load upon the Application or upon such servers or networks; or violate any requirements, procedures, policies or regulations of such networks.<br>• Restrict or inhibit any other person from using the Application (including without limitation by hacking or defacing any portion of the Application).<br>• Use the Application to advertise or offer to sell or buy any goods or services.<br>• License, sublicense, transfer, assign, reproduce, duplicate, copy, sell, resell, distribute or otherwise exploit for any commercial purposes, any portion of, use of or access to the Application.<br>• Reproduce, modify, adapt, publish, distribute, broadcast, make derivative works of, translate, reverse engineer, decompile or disassemble any portion of the Application without Konami’s prior approval.<br>• Remove any copyright, trademark or other proprietary rights notice from the Application or materials originating from the Application.<br>• Frame or mirror any part of the Application without Konami’s express prior written consent.<br>• Create a database by systematically downloading and storing Materials.<br>• Use any robot, spider, site search/retrieval application or other manual or automatic device to retrieve, index, “scrape”, “data mine” or in any way gather Materials or reproduce or circumvent the navigational structure or presentation of the Application without Konami’s express prior written consent.<br>• Prostitute a child, exploit a child for pornography or engage in acts likely to constitute child abuse; or engage in acts that will or may have a bad influence on or encourage bad behaviour among persons under 20 years of age (including encouraging those persons to drink, smoke or gamble, posting information relating to the adult or sex entertainment industry and soliciting them to access sites inappropriate for use by themselves).<br>• Engage in acts that encourage or assist suicide or drug abuse, or any act leading to meetings for the purpose of sexual or obscene acts.<br>• Seek a relationship with another person, or engage in acts that Konami determines is made for the main purpose of causing a relationship (including relationships, acts and socializing limited to within the Application).<br>• Post or ask for information that can identify or enable direct access to an individual (such as a telephone number, e-mail address and SNS service account).<br>• Campaign for Pre-election campaign, campaign or participate in politics or other similar acts.<br>• Post, publish, collect or accumulate personal information of third parties (including addresses, e-mail addresses, telephone numbers, credit card numbers and account numbers).<br>• Conduct real money trading, convert Account IDs, data, characters or items in the Application into cash, purchase or sale of property or information through the foregoing or any act or statement comparable to the foregoing.<br>• Unless explicitly permitted by Konami, assign, exchange, lend or license data, characters or items in the Application, or act or state something comparable to the foregoing.<br>• Use any program defects of the Application or any other problematic phenomenon or effect to gain a benefit or for other improper purpose.<br>• Engage in any act that instigates, encourages or abets any acts set forth in this Section.<br>• Engage in any other acts Konami determines to be inappropriate with rational reason.<br>You shall be responsible for your use of the Application and/or any information that you post or otherwise make available through your use of the Application.<br><br>You shall be solely responsible for the compensation for any and all losses or damages, including reasonable attorney’s fees, suffered by Konami or any third party, including but not limited to, any and all losses or damages suffered by Konami or any third party due to your incompliance with these Konami Terms.<br><br>3. Purchases of Virtual Goods. The Application may provide you with an opportunity to aquire personal, limited, revocable, non-transferable licences to access and use virtual goods (collectively, “Virtual Goods”) solely within the Application and solely for your personal, non-commercial purposes. These acquisition may be made using virtual currency (e.g., virtual coins, tokens, or points) (“Virtual Currency”) earned or acquired through the Application or from one of Konami’s approved third-party virtual currency providers. You shall make the payment therefor in a method separately specified by us. To the extent of applicable law, Konami shall not be required to provide refunds, benefits or other compensation to you, except in cases where there is a breach by Konami of these Konami Terms due to intentional or gross negligence on the part of Konami. Notwithstanding anything to the contrary in Konami Terms or in the Application, you agree that you have no right or title to any Materials, including without limitation any Virtual Goods and/or “earned” or “purchased” Virtual Currency, and that such Virtual Goods and/or Virtual Currency do not constitute or represent any balance of real currency or other stored value or its equivalent. Konami shall not be required to provide refunds, benefits or other compensation to you, except in cases where there is a breach by Konami of these Konami Terms due to intentional or gross negligence on the part of Konami. You may not sublicense, lease, lend, sell, gift, bequeath, trade, transfer or provide use or access to any Virtual Goods and/or Virtual Currency, except as expressly provided by Konami, and any such act or attempted act is prohibited and void. You shall not attempt to use or access any Virtual Goods and/or Virtual Currency that you have not personally licensed or acquired from us or from one of Konami’s approved third-party currency providers. If you leave a balance of purchased Virtual Currency unused for a period of time or if we terminate or suspend your access to and/or use of the Application, we may process your balance in accordance with Konami’s legal obligations, including by submitting funds associated with your purchased Virtual Currency balance to the appropriate governing body where required by applicable law.<br><br>4. Purchase and Use of Virtual Currency. If you wish to purchase Virtual Currency made available by Konami through the Application (each such purchase, a "Transaction"), you may be asked to supply certain information relevant to your Transaction. Such information may include your credit card number and its expiration date and billing address, and other information associated with proprietary payment methods. The purchase and use of Virtual Currency are governed by terms and conditions of the “Virtual Currency Terms of Use” located in the Application. YOU REPRESENT AND WARRANT THAT YOU HAVE THE LEGAL RIGHT TO USE ANY PAYMENT METHOD UTILISED IN CONNECTION WITH ANY TRANSACTION AND THAT YOU ARE IN COMPLIANCE WITH ANY TERMS AND CONDITIONS APPLICABLE TO SUCH PAYMENT METHODS, AND YOU AGREE THAT YOU ARE RESPONSIBLE FOR ANY USE OF YOUR PAYMENT METHODS BY MINORS. By submitting such information, you grant Konami the right to provide such information to third parties for purposes of facilitating completion of Transactions initiated by you or on your behalf. Verification of information may be required prior to acknowledgment or completion of any Transaction.<br><br>5. Accounts and Passwords. You may be required to register in order to access certain Materials or areas of the Application or to purchase licences to Virtual Goods. With respect to any such registration, Konami may refuse to grant you, and you may not use, an Account ID (or e-mail address) that is already being used by someone else; that may be construed as impersonating another person; that belongs to another person; that personally identifies you; that violates intellectual property or other rights of any person; that is offensive; or that Konami rejects for any other reason in Konami’s sole discretion. You may not register an Account ID on behalf of any other individual. You represent and warrant that all information you submit in connection with any registration (including without limitation information related to your identity) is accurate and complete, and that you have not been previously restricted from accessing or using any Konami website or other Konami Internet property or any Konami game or other application.<br><br>Your Account ID and password are for your personal use only, and not for use by any other person. You agree to immediately notify Konami of any unauthorized use of your password or Account ID or any other breach of security related to your account or to the Application, and to make reasonable efforts to remedy such breaches (including any breaches relating to known or suspected copyright infringement in connection with the Application), and to ensure that you “log off”/exit from your account with the Application (if applicable) at the end of each session. Konami is not liable for any loss or damage arising from your failure to comply with any of the foregoing obligations.<br><br>6. Saved Data. An identifier automatically issued to you by Konami for Konami to identify you for your use of the Application (“User ID”) is for your personal use only and should be kept confidential, and you (and not Konami) are responsible for any use or misuse of your User ID. SUSPENSION OR TERMINATION. Konami reserves the right to If you breach Konami Terms or any of the other applicable terms, or if Konami suspects, in Konami’s sole discretion, fraudulent, abusive or unlawful activity associated with your account, Konami may immediately (a) suspend, or limit your access to, or terminate, your use of the Application, in whole or in part, or (b) terminate your account without notifying you in advance, in the case where:<br><br>(a)  you breach these Konami Terms or any other terms applicable to your use of the Application;<br><br>(b)  you breach of any agreement or contract of any form between Konami and you, including but not limited to, terms of use, terms of service, or otherwise, that is applicable to Konami’s products and services other than the Application;<br><br>(c)  your use of any of the Konami products or services or your account therefor has been terminated due to the reason attributable to you;<br><br>(d)  Konami cannot confirm your payment of the consideration of any form, such as, fees and subscription fees, payable for your use of any fee-based products and/or services, including but not limited to, Virtual Goods and Virtual Currency;<br><br>(e)  six (6) months has elapsed after your final access to the Application;<br><br>(f)  you are a member of, or have any relationship with a member or any person or entity having a relationship with a member of, anti-social forces; or<br><br>(g)  If Konami reasonably suspects that you fall under any of the foregoing (a) through (f)<br><br>Suspension or termination by Konami pursuant to this Section shall not preclude Konami from claiming damages that arose therefrom, and this Section shall apply to any damages that arose therefrom, meaning that, Konami shall not be required to provide refunds, benefits or any other compensation to you in connection with such suspension or termination.<br><br>Notwithstanding any other provision in Konami Terms or other applicable terms to the contrary, Konami reserves the right to reduce, liquidate, suspend, deactivate, remove access to and/or terminate any and all Virtual Goods if Konami suspects, at its sole discretion, that (a) you have used any Virtual Good(s) in violation of Konami Terms, and/or any other applicable terms and/or (b) you have otherwise used any Virtual Good(s) to conduct any fraudulent or illegal activity. Konami may suspend or terminate the Application, in whole or in part, and with or without notifying you, if it becomes impossible, in the common sense, to provide the Application due to strikes, labor trouble, acts of God, war, legal restrictions, inevitable accidents, or any other cause similar thereto which is beyond Konami’s control (“Force Majeure Event”). Konami shall not be responsible for any losses, damages, or other disadvantages suffered by you in relation to any Force Majeure Event.<br><br>15. TERMINATION BY YOU. If you delete the Application from your device, your Virtual Goods may no longer be usable. Unless otherwise notified via a separate notification from Konami, you cannot transfer, assign, give away or request refund for your Virtual Goods.<br><br>16. Governing Law. You agree that your access to and use of the Application is governed by the laws of Japan without giving effect to any choice of legal rule that would cause application of laws of any jurisdiction other than Japan. All disputes and controversies arising out of or in connection with the Application shall be resolved exclusively by the Tokyo District Court in Tokyo, and you hereto agree to submit to the jurisdiction of said courts and agree that the venue shall lie exclusively with such courts.<br><br>17. No Assignment. You may not lend, license, assign or succeed to any third party all or part of your rights, obligations, status or interests to use the Application.<br><br>18. Variations Depending on Countries/Regions. You hereby acknowledge and agree that the Application itself may vary depending on countries/regions to comply with applicable laws and regulations.<br><br>19. Severability. Konami grants you a licence only, for the non-transferable right to download and use the Application for your personal, non-commercial purposes, according to the terms of the Apple Media Services Terms and Conditions.<br>24-2. Apple has no obligation to provide any maintenance and support services for the Application.<br>24-3. In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Application to you; and that, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatever with respect to the Application.<br>24-4. Apple bears no responsibility for any claims by you or a third party related to your possession or use of the Application, including, but not limited to: (i) A claim of product liability; (ii) A claim that the Application fails to conform to any applicable legal or regulatory requirement; (iii) A claim arising under consumer protection or similar legislation; and (iv) A claim by you or a third party that the Application or the use of the Application by you infringes the intellectual property rights of you or a third party.<br>24-5. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a ”terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.<br>24-6. The Application is provided by Konami Digital Entertainment Co., Ltd., headquartered at 1-11-1 Ginza, Chuo-Ku, Tokyo 104-0061.<br>24-7. You must comply with any applicable third-party terms of agreement when using the Application.<br>24-8. You acknowledge and agree that Apple Inc. and its subsidiaries are third-party beneficiaries to Konami Terms, and on your acceptance of Konami Terms, you acknowledge that Apple has the right (and will be deemed to have acknowledged the right) to enforce Konami Terms against you as third-party beneficiary.
