End User License Agreement (“EULA”)
YOU SHOULD CAREFULLY READ THE ENTIRE FOLLOWING END USER LICENSE AGREEMENT BEFORE DOWNLOADING, INSTALLING, USING OR PLAYING THE GAME OR ANY RELATED SOFTWARE (collectively, the “GAME”).  THIS AGREEMENT CONTAINS IMPORTANT TERMS THAT AFFECT YOUR LEGAL RIGHTS.  BY DOWNLOADING, INSTALLING, USING OR PLAYING THE GAME, YOU AGREE TO BE BOUND BY ALL THE TERMS OF THIS AGREEMENT.  IF YOU DO NOT AGREE TO ALL THE TERMS OF THIS AGREEMENT, PLEASE DO NOT (AND YOU ARE NOT PERMITTED TO) DOWNLOAD, INSTALL, USE OR PLAY THE GAME.  
IN ORDER TO PLAY THE GAME AND/OR ACCESS CERTAIN FEATURES, YOU MAY BE REQUIRED TO HAVE AND MAINTAIN A VALID AND ACTIVE USER ACCOUNT WITH ZENIMAX (“ACCOUNT”).  
BY DOWNLOADING, INSTALLATION, USING OR PLAYING THE GAME YOU CONFIRM THAT YOU HAVE READ THIS END USER LICENSE AGREEMENT, THE ZENIMAX TERMS OF SERVICE AND THE ZENIMAX PRIVACY POLICY AND THAT YOU AGREE TO THE TERMS IN THIS AGREEMENT AND THE TERMS OF SERVICE, (COLLECTIVELY, THIS “AGREEMENT”).  YOU FURTHER ACKNOWLEDGE AND UNDERSTAND THAT ZENIMAX WILL PROCESS YOUR PERSONAL DATA IN ACCORDANCE WITH THE ZENIMAX PRIVACY POLICY (available at https://bethesda.net/#/privacypolicy). IF YOU DO NOT ACCEPT THE TERMS OF THIS AGREEMENT, OR YOU HAVE NOT READ AND UNDERSTOOD THE ZENIMAX PRIVACY POLICY, DO NOT DOWNLOAD, INSTALL OR USE THE GAME.

This Agreement is between you and ZeniMax Media Inc. (“ZeniMax”). 
AS SET OUT IN SECTION 1 OF THE TERMS OF SERVICE, IF YOU ARE RESIDENT IN THE EEA, UNITED KINGDOM, SWITZERLAND, RUSSIA, AUSTRALIA, NEW ZEALAND, TURKEY, JAPAN OR BRAZIL, ZENIMAX ACKNOWLEDGES THAT THERE ARE CERTAIN GUARANTEES, WARRANTIES, TERMS AND CONDITIONS (INCLUDING IN RESPECT OF REFUNDS AND RETURNS AND UNFAIR TERMS) IMPOSED BY THE LAWS RELATING TO THE SUPPLY OF GOODS, SERVICES AND DIGITAL CONTENT WHICH THE LAWS EXPRESSLY PROVIDE MAY NOT BE EXCLUDED, RESTRICTED OR MODIFIED OR MAY ONLY BE LIMITED TO A CERTAIN EXTENT (THE "STATUTORY OBLIGATIONS").  NOTHING IN THIS EULA EXCLUDES, RESTRICTS OR MODIFIES THE STATUTORY OBLIGATIONS OTHERWISE THAN ACCORDING TO SUCH LAWS.
PHOTO-SENSITIVITY WARNING: 
A very small percentage of individuals may experience epileptic seizures or blackouts when exposed to certain visual images, including without limitation light patterns or flashing lights.  If you experience any of the following symptoms while playing the Game, immediately discontinue use and consult your physician before resuming play: blackouts, seizures, dizziness, altered vision, eye or muscle twitches, jerking or shaking of arms or legs, loss of awareness, disorientation, confusion, any involuntary movement, or convulsions.
VIRTUAL REALITY: HEALTH AND SAFETY PRECAUTIONS AND DISCLAIMERS
If the Software provides for virtual reality gameplay and/or the use of third-party virtual reality headsets and/or related equipment, the following health and safety precautions and disclaimers apply.  
Failing to review and adhere to the health and safety precautions set forth below and the precautions given by the manufacturer of your VR headset may cause damage to property, personal injury to you or others, or death.  
As with all virtual reality games, please also carefully read and follow all health and safety precautions from your virtual reality headset manufacturer before use.  
PLEASE READ THE FOLLOWING CAREFULLY BEFORE PLAYING 
Please note that certain people are susceptible to various symptoms and conditions when playing a game with virtual reality headsets, including:
•	epileptic seizures or loss of consciousness;
•	altered vision;
•	motion sickness, dizziness, disorientation or nausea; and/or
•	repetitive motion injuries and eye strain.
Immediately stop playing if you do not feel well or if you experience any of the above symptoms.  
In any event, we strongly recommend that you take reasonable breaks from gameplay every 10 to 15 minutes and that you do not play for excessive overall periods.
If you are pregnant or if you have any pre-existing medical condition, you should talk with a physician to obtain professional advice before playing the game.  
You should not play the game under the influence of alcohol or drugs or while using prescription or non-prescription medication.
Always be aware of your surroundings when playing the game.  When playing with a virtual reality headset or other headset it is best to remain seated if that mode is supported.  Since the game is an immersive reality experience, you may not be able to fully see or hear your surroundings while playing.  Whether or not you remain seated during gameplay, give yourself plenty of room and make sure the play area is clear of objects and people that could be bumped into during gameplay.  Ensure you are in a safe environment and not near stairs, balconies, windows, walls, furniture, objects that could cause tripping hazards or other objects or people that may pose a danger to you or them or could be damaged or cause injury during gameplay.  Sound volume for the game should be kept at a low enough level so that you can be aware of your surroundings while playing, and to avoid any damage to your hearing.
YOU HEREBY RELEASE ZENIMAX, ITS AFFILIATES AND THEIR RESPECTIVE OFFICERS, DIRECTORS AND EMPLOYEES FROM ANY AND ALL LIABILITY IN CONNECTION WITH THE USE OF A VIRTUAL REALITY HEADSET, RELATED EQUIPMENT, OR THE SOFTWARE.
In no event shall ZeniMax be liable for any damage to property, injury, or death (or for direct, indirect, punitive, incidental, or consequential damages) arising out of the use or misuse of the Software or any virtual reality headset or related equipment, including, without limitation, arising out of or connected with interactions between you and other people or objects in or around the play area during gameplay.  You understand that misuse of the Software includes (without limitation) violations of any instructions or any warnings set forth on the packaging, documentation, and screen shots for your virtual reality headset, in this document, in other documentation accompanying the Software or the packaging for the Software.  Failure to carefully read and follow those instructions and warnings could lead to property damage, injury or death.  You expressly assume and accept any and all risks inherent in (or that may be associated with) the use of the Software, and/or of the virtual reality headsets or related equipment.  Some, but not all, of those risks are discussed in the warnings set forth above or the warnings accompanying the Software and the virtual reality headset.  Please also see the section on “Limitation of Liability" below in this Agreement.
The ZeniMax Terms of Service contain a Dispute Resolution and Arbitration Provision, including a Class Action Waiver, (the “Disputes Provision”) that - if you reside in a jurisdiction outside of the EEA/United Kingdom/Switzerland/Australia/New Zealand/Turkey/Japan or Brazil that permits class actions or other collective disputes - affects your rights under the ZeniMax Terms of Service and this End User License Agreement with respect to disputes you may have with ZeniMax.  That Disputes Provision is incorporated into this End User License Agreement by this reference and forms a part of this End User License Agreement as if such provision was fully restated in this End User License Agreement.  You may opt out of the binding individual arbitration and class action waiver as provided in the ZeniMax Terms of Service.  
Any and all uses of the Game are governed by the terms of this Agreement and the ZeniMax Terms of Service.  The ZeniMax Terms of Service are hereby incorporated into and form a part of this Agreement by this reference as if such provisions were fully restated in this Agreement.  The End User License Agreement is a “EULA” and constitutes “Supplemental Terms” as contemplated by the ZeniMax Terms of Service.  The Game is made available and distributed solely for use by authorized end users according to the terms of this Agreement, including the ZeniMax Terms of Service.  Any use, reproduction, modification or distribution of the Game not expressly authorized by the terms of this Agreement is expressly prohibited.  You agree that the Game, the Game Client, other Game related software, Content (as defined in the Terms of Service) specific to the Game and your access to and use of the Game are all a “Service” for the purposes of this Agreement, including the ZeniMax Terms of Service.  Any rights not granted to you in this Agreement are reserved by ZeniMax. 
You acknowledge that ZeniMax may process your personal data in accordance with the ZeniMax Privacy Policy which is available at https://bethesda.net/#/privacypolicy and you agree to the ZeniMax Code of Conduct which is available at https://bethesda.net/#/codeofconduct.  The Privacy Policy and Code of Conduct are incorporated into this End User License Agreement by this reference and form a part of this End User License Agreement as if such provisions were fully restated in this End User License Agreement.  All personal information collected and processed by ZeniMax in connection with this End User License Agreement will be collected and processed in accordance with the ZeniMax Privacy Policy. 
YOU SHOULD PRINT A COPY OF THIS END USER LICENSE AGREEMENT, THE TERMS OF SERVICE, THE PRIVACY POLICY AND THE CODE OF CONDUCT FOR YOUR RECORDS AND FOR FUTURE REFERENCE.
All software programs and any and all files that are delivered to you or made available to you by ZeniMax, directly or indirectly through a ZeniMax authorized reseller or distributor, (via on-line access, transmission, download or otherwise), including any “patcher”, “installer”, and any updates and modifications to such software programs, and any and all copies and derivative works of such software programs (collectively, with the Game Client (defined below), the “Game”) is the copyrighted work of ZeniMax and its affiliates.  THE GAME IS LICENSED, NOT SOLD, TO YOU.  
1.	LIMITED LICENSE; RESTRICTIONS AND OWNERSHIP
If you agree to this Agreement, you may, as applicable, download, install and use the software (hereafter referred to as the “Game Client”) on your computer or console (each hereafter referred to as a “computer”) for the sole purpose of playing the Game.  Subject to your compliance with all the terms and conditions in this Agreement, ZeniMax hereby grants, and you hereby accept, a limited, non-transferable, non-exclusive license (a) to download, install or use the Game Client on one or more computers owned by you or under your legitimate control for your non-commercial entertainment purposes only, and (b) to use the Game Client solely as part of the Service, if applicable.  
The ZeniMax Terms of Service include terms and conditions applicable to Virtual Currency (as such term is defined in the ZeniMax Terms of Service), including terms that grant to you a non-exclusive, limited license for Virtual Currency.  Such terms and conditions apply to the Virtual Currency (if any) licensed to you for use with the Game.  
Subject to the Statutory Obligations (as defined in Section 1 of the Terms of Service), this Agreement does not give you any right to obtain reissues or replacements of the Game at any time and ZeniMax is not obliged to supply software updates, upgrades, or expansions for the Game, or even to operate or continue to support the Game for an indefinite period.  
As further described in the ZeniMax Terms of Service, but subject to the Statutory Obligations (as defined in Section 1 of the ZeniMax Terms of Service), ZeniMax may change, modify, suspend, or discontinue any aspect of the Game at any time and ZeniMax may also impose limits on certain features or restrict your access to parts or all of the Game without notice or liability.
In all cases, the licenses granted to you in this Agreement will terminate upon the earlier of termination of this Agreement or termination of your Account, if any, with ZeniMax.  
The ZeniMax Terms of Service include terms and conditions applicable to user generated Content, downloadable Content and other Content and you agree to comply with such terms and conditions. 
2.	SOFTWARE UPDATES AND ANTI-CHEATING AND SECURITY TOOLS.  
ZeniMax may deploy or provide patches, updates, improvements, upgrades and modifications to the Game (“Updates”) that must be installed by you in the manner described by ZeniMax in its discretion before you may continue to play the Game.  All such Updates are part of the Game for purposes of this Agreement, the licenses granted to you and the License Limitations set forth in this Agreement.  The terms of this Agreement will govern any Updates provided by ZeniMax that replace and/or supplement the original Game, unless such Updates is accompanied by a separate license agreement in which case the terms of that license agreement will govern.  ZENIMAX HAS IMPLEMENTED TOOLS AND SOFTWARE (“ANTI-CHEAT TOOLS”) DESIGNED TO DETECT AND PREVENT CHEATING AND FRAUD; THESE TECHNOLOGIES MAY SCAN ANY COMPUTER OR DEVICE FROM WHICH YOU DOWNLOAD OR PLAY THE GAME TO DETECT OR IDENTIFY ANY PROGRAMS OR PROCESSES DESIGNED TO “CHEAT,” GAIN AN UNFAIR ADVANTAGE IN THE GAME OR OTHERWISE CIRCUMVENT ANY SECURITY, ANTI-CHEAT OR FRAUD DETECTION PROCESSES  OR TOOLS WE HAVE IMPLEMENTED (“CHEAT PROGRAMS”).  BY USING OR DOWNLOADING THE GAME OR ACCEPTING THIS AGREEMENT, YOU ACKNOWLEDGE AND EXPRESSLY AGREE TO THE ACCESS TO YOUR COMPUTER OR DEVICE  BY THESE ANTI-CHEAT TOOLS TO IDENTIFY OR DETECT CHEAT PROGRAMS.
3.	LIMITATIONS AND RESTRICTIONS.
The Game and/or certain features are a Service offered by ZeniMax and may only be playable online.  In such cases, a persistent Internet connection (which is not supplied by ZeniMax) is required to play the Game or access these features.  You are responsible for all costs and expenses associated with acquiring any hardware, software (e.g., Internet browsers) or other products or services required to play the Game or access these features.  
In addition to the restrictions, conditions and limitations set forth in the ZeniMax Terms of Service and the ZeniMax Code of Conduct, the license granted to you in this End User License Agreement is subject to the conditions, restrictions and limitations set forth in Section 1 and this Section 3 of this End User License Agreement (collectively, the “License Limitations”). Any use of the Game in violation of the License Limitations will be regarded as an infringement of ZeniMax’s copyrights in and to the Game and will be a breach of this Agreement.  You agree that you will not and will not assist any other person, under any circumstances, to:
A.	in whole or in part, distribute, publicly perform or display, sell, transmit, publish, edit, reproduce, sublicense, rent, lease, loan or otherwise transfer the Game or Content, including without limitation any access keys;
B.	in whole or in part, modify, adapt, translate, reverse engineer, attempt to derive source code from, modify, disassemble, decompile, or create derivative works based on the Game; provided, however, that you may make one (1) copy of the Game Client and the manuals that accompany it for archival purposes only and you may install the relevant Game Client on one or more computers owned by you or under your legitimate control as described in Section 1 above; 
C.	remove any proprietary notices or labels on the Game; or attempt in any manner to circumvent any security measures designed to control access to the Game or any part thereof;  
D.	use cheats, automation software (bots), hacks, mods or any other unauthorized third-party software designed to modify the Game or adversely impact any other persons playing of the Game or his/her experience of playing the Game; 
E.	exploit the Game or any of its parts, including without limitation the Game Client, for any commercial purpose (including without limitation renting, leasing or licensing the Game to others), including without limitation (a) for gathering Virtual Currency (as defined in the ZeniMax Terms of Service), items or resources for sale outside the Game; or (b) performing in-game services in exchange for payment outside the Game, e.g., power-leveling; 
F.	use any unauthorized third-party software that intercepts, “mines”, or otherwise collects information from or through the Game or the Service, including without limitation any software that reads areas of RAM used by the Game to store information about a character or the game environment; provided, however, that ZeniMax may, at its sole and absolute discretion, allow the use of certain third party user interfaces and other third party software; 
G.	modify or cause to be modified any files that are a part of the Game Client in any way not expressly authorized by ZeniMax; 
H.	host, provide or develop matchmaking services for the Game or intercept, emulate or redirect the communication protocols used by ZeniMax in any way, for any purpose, including without limitation unauthorized play over the internet, network play, or as part of content aggregation networks;   
I.	facilitate, create or maintain any unauthorized connection to the Game or the Service, including without limitation (a) any connection to any unauthorized server that emulates, or attempts to emulate, the Service; and (b) any connection using programs or tools not expressly approved by ZeniMax; 
J.	take any action or upload, post, transmit, promote, or distribute any illegal content; 
K.	take any action or upload, post, transmit, promote, or distribute any content that infringes or violates any third-party rights; 
L.	engage in, take any action associated with, or participate in any type of child solicitation, grooming behavior, pedophilia, or predatory behavior in any form;  
M.	harass, stalk, threaten, embarrass, spam or do anything else to another user of the Game that is unwanted, such as repeatedly sending unwanted messages or making personal attacks or statements about race, sexual orientation, religion, heritage, etc.; 
N.	take any action or upload, post, transmit, distribute, or communicate your or any person’s real-world personal information; 
O.	impersonate any person or entity, including, but not limited to, ZeniMax, ZeniMax’s partners’ or affiliates’ employees, or falsely state or otherwise misrepresent your affiliation with a person or entity; 
P.	take any action, organize, transmit any content, effectuate or participate in any activity, group, or guild that is harmful, tortuous, abusive, hateful (including “hate speech”), racially, ethnically, religiously or otherwise offensive, obscene, threatening, bullying, vulgar, sexually explicit, defamatory, libelous, infringing, invasive of personal privacy or publicity rights, encourages conduct that would violate a law or is, in a reasonable person's view, objectionable and/or deemed to be in the sole discretion of ZeniMax inappropriate;  
Q.	promote, upload, transmit, encourage or take part in any activity involving hacking, cracking, phishing, taking advantage of exploits or cheats and/or distribution of counterfeit software and/or Virtual Currency or virtual items.  In an effort to continuously improve the Game, you and other users/players discovering exploits, cheats, cracks or other inconsistencies are required to report them to ZeniMax; or 
R.	take any action or upload, post, transmit, promote, or distribute any content that may contain a Trojan horse, virus, worm, spyware, time bombs, cancelbots, corrupted data or other computer programs that you do not own or have permission to freely distribute that may damage, interfere with, intercept, expropriate or disrupt the Game.
Any attempt to do any of the foregoing is a breach of this Agreement and may be a violation of intellectual property rights in the Game.  If you breach these restrictions, you may be subject to prosecution and damages.  
The Game is licensed to you as a single product. Its component parts may not be separated for use on more than one computer.  The Game is licensed, not sold.  Your license confers no title or ownership in the Game or copies thereof.  
4.	OWNERSHIP OF THE GAME.  
ZeniMax and its licensors are and will continue to be the owner of all right, title, and interest in and to the Game and the Service, including without limitation all intellectual property rights and moral rights in and to the Game and all copies thereof (including without limitation any titles, software programs and code, Game related themes, characters, character names, character likenesses, stories, dialog, catch phrases, locations, concepts, artwork, character inventories, structural, landscape and other designs in the Game, animations, sounds, musical compositions and recordings, audio-visual effects, storylines, methods of operation, and any related documentation).  You shall take no action inconsistent with such title or ownership.  The Game is protected by the copyright laws of the United States, international treaties and conventions, and other laws.  The Game may contain materials licensed by third parties, and the licensors of those materials may enforce their rights in the event of any violation of this Agreement.  You acknowledge and agree that you have no interest, monetary or otherwise, in any feature or Content contained in the Game.  This paragraph will survive the termination of this Agreement.  
5.	COLLECTION AND USE OF DATA
YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THE ZENIMAX PRIVACY POLICY [https://bethesda.net/en/document/privacy-policy] WHICH EXPLAINS HOW WE MAY COLLECT, USE AND DISCLOSE DATA ABOUT YOU (INCLUDING PERSONAL DATA). IN PARTICULAR ZENIMAX WILL USE YOUR DATA (INCLUDING PERSONAL DATA) TO OPERATE THE SERVICES, TO FACILITATE PRODUCT SUPPORT, DEVELOPMENT AND IMPROVEMENT, TO TAILOR AND CUSTOMIZE YOUR EXPERIENCES AND UNDERSTAND WHICH ZENIMAX PRODUCTS YOU ARE USING, AS WELL AS TO PROVIDE OTHER SERVICES TO YOU.  YOU FURTHER ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD OUR COOKIE POLICY [http://bethesda.net/en/document/cookie-policy] AND AGREE THAT WE MAY USE COOKIES, WEB BEACONS AND OTHER ANALYTIC TECHNOLOGIES (HEREIN, COLLECTIVELY “COOKIES”) – INCLUDING THOSE PROVIDED BY THIRD PARTIES – TO COLLECT, USE, STORE AND TRANSMIT TECHNICAL AND OTHER INFORMATION REGARDING YOUR MOBILE OR OTHER DEVICE (INCLUDING MAC ADDRESS UNIQUE DEVICE ID OR OTHER IDENTIFIER, UDID, XUID, AND/OR PUID), GAME CENTER ID, GAME CENTER NAME, IP ADDRESS, GEO-LOCATION, DEVICE MAKE AND MODEL, OPERATING SYSTEM, SOFTWARE AND APPLICATIONS, GAME PLAY/USAGE DATA, THIRD PARTY ACCOUNT AUTHORIZATION DATA, SESSION DATA, BROWSER IDENTIFIERS, CONNECTION TYPE AND CARRIER INFORMATION.   YOU AGREE TO OUR USE OF COOKIES AS DESCRIBED HEREIN AND IN MORE DETAIL IN OUR COOKIE POLICY, WHICH EXPLAINS YOUR OPTIONS ON OUR USE OF COOKIES. 
You also acknowledge and understand that ZeniMax offers the Game and conducts business in many countries.  As a result, personal information collected from or submitted by you through a Game or otherwise may be transferred to and stored on servers and equipment located in a destination outside your country of residence.  The servers and equipment on which your data is stored and processed may be owned and operated by third parties with whom ZeniMax has contracted to receive, store and process your personal information.  ZeniMax and those third parties that ZeniMax has designated, may further transfer, store and process your personal information on servers and equipment located in other countries. You should be aware that the data protection laws of other countries may not be the same as the data protection laws of your country of residence. This Section 5 shall survive the termination of this Agreement. 
6.	MONITORING AND UPDATES.	
If you request any technical support from ZeniMax, subject to your consent ZeniMax may remotely access and review the computer onto which you have loaded the Game Client for purposes of providing technical support and debugging.  As further described in the ZeniMax Terms of Service, ZeniMax may update the Game remotely including without limitation the Game Client residing on your computer, and you hereby grant to ZeniMax your consent to deploy and apply such Updates.  
You understand and agree that (a) any and all Game related character data is stored and is resident on ZeniMax computers and servers and (b) any and all communications that you make within the Game (including, but not limited to, messages solely directed at another player or group of players) traverse through ZeniMax computers and servers and may or may not be monitored by ZeniMax or ZeniMax’s agents.  You expressly consent to such monitoring of such communications that you send and receive.  The ZeniMax Terms of Service and the ZeniMax Privacy Policy include further terms and conditions applicable to the accessing, monitoring and recording of activities and communications on and relating to the Service, including but not limited to when ZeniMax may report incidents to law enforcement and other authorities. All personal data collected and processing by ZeniMax as part of the activities set out in this clause 6 will be collected and processing accordance with the ZeniMax Privacy Policy[https://bethesda.net/#/privacypolicy] and the terms of the Agreement.   
7.	TERMINATION.  
This End User License Agreement starts at the time you accept this End User License Agreement and it will remain effective until terminated.  You may terminate this End User License Agreement at any time by (i) permanently destroying all copies of the Game in your possession or control and (ii) removing the Game Client from your hard drive.  Subject to the Statutory Obligations (as defined in Section 1 of the ZeniMax Terms of Service),  ZeniMax may terminate this End User License Agreement at any time for any reason or no reason (including at such time as ZeniMax elects to discontinue offering the Game).  Upon termination by ZeniMax for any reason, all licenses granted in this Agreement (including in the ZeniMax Terms of Service) with respect to the Game that is the subject of this End User License Agreement shall immediately terminate and you must immediately do (i) and (ii) above.  Termination for no reason will be communicated to you by ZeniMax.  
8.	EXPORT RESTRICTIONS.  
The Game may not be exported, re-exported, downloaded or otherwise transferred (i) to or into (collectively, an “Export”) any country which requires an Export license or which the United States Government prohibits Exports, including any such country subject to economic sanctions or (ii) to any person or entity prohibited from receiving goods or services of U.S. origin.  You represent and warrant that you are not located in, under the control of, or a national or resident of any such country or on any such list.  This Section 8 will survive the termination of this Agreement.
9.	WARRANTY.  
If you, the original purchaser, purchased the Game on a physical media (such as a disc) your use of the Game is subject to the limited warranty included with the manual or other packaging material that came with your purchase.
THE ZENIMAX TERMS OF SERVICE INCLUDE PROVISIONS REGARDING THE DISCLAIMER OF REPRESENTATIONS, WARRANTIES AND GUARANTEES (SUBJECT TO THE STATUTORY OBLIGATIONS (AS DEFINED IN SECTION 1 OF THE ZENIMAX TERMS OF SERVICE)) AND SUCH PROVISIONS ARE INCORPORATED INTO THIS END USER LICENSE AGREEMENT BY THIS REFERENCE AND FORMS A PART OF THIS END USER LICENSE AGREEMENT AS IF SUCH PROVISIONS WERE FULLY RESTATED IN THIS END USER LICENSE AGREEMENT.  THIS SECTION 9  SHALL SURVIVE THE TERMINATION OF THIS AGREEMENT.
With respect to software that is enabled for use on or over the Internet, you acknowledge that ZeniMax is not responsible for the Internet or whether it should continue to exist in its present form or whether or not a government or governmental agency, either foreign or domestic, will control, regulate or disband the Internet.  Use of the Internet is at your sole risk.
10.	LIMITATION OF LIABILITY, REIMBURSEMENT.
To the maximum extent permitted by applicable law, and subject to the Statutory Obligations (as defined in Section 1 of the Terms of Service), IN NO EVENT SHALL ZENIMAX OR ANY OF LICENSORS BE LIABLE FOR ANY (I) SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, EXEMPLARY OR OTHER INDIRECT DAMAGES, (II) THIRD PARTY CLAIMS, OR (III) LOSS OR DAMAGE TO ANY SYSTEMS, HARDWARE OR SOFTWARE, RECORDS OR DATA, EVEN IF ADVISED OF OR AWARE OF THE POSSIBILITY OF ANY SUCH DAMAGES AND EVEN IF A LIMITED REMEDY IN THIS AGREEMENT FAILS OF ITS ESSENTIAL PURPOSE.  
SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY.  ACCORDINGLY, SOME OF THE ABOVE MAY NOT APPLY TO YOU.
THE ZENIMAX TERMS OF SERVICE INCLUDE OTHER PROVISIONS REGARDING THE LIMITATION OF LIABILITY AND REMEDIES (SUBJECT TO THE STATUTORY OBLIGATIONS (AS DEFINED IN SECTION 1 OF THE ZENIMAX TERMS OF SERVICE)) AND SUCH PROVISIONS ARE INCORPORATED INTO THIS END USER LICENSE AGREEMENT BY THIS REFERENCE AND FORMS A PART OF THIS END USER LICENSE AGREEMENT AS IF SUCH PROVISIONS WERE FULLY RESTATED IN THIS END USER LICENSE AGREEMENT.  
If (i) you misuse the Game Service or breach this Agreement or (ii) any contributions, actions or omissions by you in connection with your use of the Game Service results in ZeniMax incurring any liabilities, damages, losses, costs and expenses (including without limitation attorneys’ fees and court costs), then you agree to reimburse ZeniMax and its affiliates and other participants of the Service from all such liabilities, damages, losses, costs and expenses.  If a third party sues ZeniMax for either or both of (i) or (ii) above, ZeniMax reserves the right to control the defense and settlement of such third party lawsuit, and you agree to reimburse ZeniMax for the cost of the defense, including, but not limited to, reasonable and documented attorneys’ fees. 
This Section 10 shall survive termination of this Agreement.  
11.	CHANGES TO THE AGREEMENT.  ZeniMax may replace this End User License Agreement with new versions (each a “New EULA”) over time as the Game and the law evolve.  This End User License Agreement will terminate immediately upon the introduction of a New EULA, and you will be given an opportunity to review the New EULA in accordance with the change provisions set out in the ZeniMax Terms of Service.  New EULAs will not be applied retroactively.  Your continued use of the Software and play of the Game after a modification of the EULA will be deemed as your acceptance of any modified terms.
12.	U.S. GOVERNMENT RESTRICTED RIGHTS.  The Game is a Commercial Item developed exclusively at private expense and comprised of “commercial computer software” and “commercial computer software documentation”, as these terms are defined in the applicable acquisition regulations, including without limitation the Federal Acquisition Regulation (“FAR”) at 48 C.F.R. 2.101.  The Game is licensed to U.S. Government End Users subject to the terms of this Agreement, as specified in 48 C.F.R. 12.212 (Computer Software) and 12.211 (Technical Data) ( for civilian agencies), and as specified in 48 C.F.R. 227.7202-3 and 48 C.F.R. 227.7202-4, consistent with 48 C.F.R. 227.7202 (for Department of Defense entities).  Solely with respect to the U.S. Government’s rights in the Game, this U.S. Government License Rights clause is in lieu of, and supersedes, any other FAR, DFARS, or other clause or provision of the contract under which this Game is obtained.  The Manufacturer is ZeniMax.  
13.	GOVERNING LAW.
For residents of North America, this Agreement and all Disputes (as defined in the Disputes Provision) shall be governed by the laws of the State of Delaware, USA, excluding its conflicts of laws rules and principles that would result in another State’s or country’s laws applying to this Agreement or any Disputes, and excluding the United Nations Convention on Contracts for the International Sale of Goods, the Uniform Computer Information Transactions Act (“UCITA”), and any laws based on UCITA.  For clarity, the terms in this paragraph shall control over any conflicting terms in the ZeniMax Terms of Service, including without limitation any terms that would result in another State’s or country’s laws applying to this Agreement or any Disputes.
If you reside outside of North America, then this Agreement and all Disputes shall be governed by the laws of England, excluding its conflicts-of-law rules and principles that would result in another State or country’s laws applying to this Agreement or any Disputes, and excluding the United Nations Convention on Contracts for the International Sale of Goods.  Local mandatory laws may be applied.
Notwithstanding the Disputes Provision, you agree that ZeniMax shall be entitled to injunctive relief, specific performance and equitable remedies with respect to breaches of Sections 1 or 3 of this Agreement, in addition to such other remedies as ZeniMax may otherwise have under applicable law.  
This Section 13 will survive the termination of this Agreement.
14.	MISCELLANEOUS.  This End User License Agreement along with the ZeniMax Terms of Service, ZeniMax Privacy Policy and the ZeniMax Code of Conduct constitute and contain the entire agreement between you and ZeniMax with respect to the subject matter hereof and supersedes any prior oral or written agreements. This End User License Agreement shall coexist with, and shall not supersede, the ZeniMax Terms of Service or the ZeniMax Privacy Policy.  To the extent that the provisions of this End User License Agreement conflict with the provisions of the ZeniMax Terms of Service, and unless expressly indicated otherwise in this Agreement, the conflicting provisions in this End User License Agreement shall control and shall govern.  Except as specifically provided in the Disputes Provision, if any part of this Agreement is held invalid or unenforceable, that portion shall be interpreted in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of such part, and the remaining portions of this Agreement shall remain in full force and effect.  The failure of ZeniMax to exercise or enforce any right or provision of this Agreement will not constitute waiver of such right or provision.  Any waiver of any provision of this Agreement will be effective only if in a writing signed by ZeniMax.  You agree that this Agreement and ZeniMax’s enforcement of this Agreement, are not intended to confer and do not confer any rights or remedies upon any person other than you and ZeniMax.  This Section 14 shall survive the termination of this Agreement for any reason.  
I hereby acknowledge that I have read and understand all the terms and conditions in this Agreement and agree that by clicking “Agree”, installing the Game Client or otherwise playing the Game I am acknowledging my agreement to be bound by all the terms and conditions of this Agreement, which includes my express consent to ZeniMax’s use of Anti-Cheat Tools as described herein.

USTED DEBERÁ LEER ATENTAMENTE LA TOTALIDAD DEL PRESENTE CONTRATO DE LICENCIA DE USUARIO FINAL ANTES DE DESCARGAR, INSTALAR O UTILIZAR EL JUEGO O CUALQUIER SOFTWARE RELACIONADO (conjuntamente, el “JUEGO”). EL PRESENTE CONTRATO CONTIENE CLÁUSULAS IMPORTANTES QUE AFECTAN A SUS DERECHOS LEGALES. AL DESCARGAR, INSTALAR O UTILIZAR EL JUEGO USTED ACEPTA QUEDAR OBLIGADO POR LA TOTALIDAD DE LAS CLÁUSULAS DEL PRESENTE CONTRATO. SI USTED NO ESTÁ DE ACUERDO CON TODAS LAS CLÁUSULAS DEL CONTRATO, LE ROGAMOS QUE NO DESCARGUE, INSTALE NI UTILICE EL JUEGO (NO ESTANDO USTED AUTORIZADO PARA HACERLO).
PARA PODER JUGAR AL JUEGO Y/O ACCEDER A DETERMINADAS FUNCIONALIDADES DEL MISMO, ES POSIBLE QUE DEBA CREAR Y MANTENER UNA CUENTA DE USUARIO DE ZENIMAX VÁLIDA Y EN ACTIVO (LA “CUENTA”).

MEDIANTE LA DESCARGA, LA INSTALACIÓN O LA UTILIZACIÓN DEL JUEGO USTED CONFIRMA QUE HA LEÍDO EL PRESENTE CONTRATO DE LICENCIA DE USUARIO FINAL, LAS CONDICIONES DE SERVICIO DE ZENIMAX Y LA POLÍTICA DE PRIVACIDAD DE ZENIMAX Y QUE ACEPTA LAS CLÁUSULAS RECOGIDAS EN EL PRESENTE CONTRATO, Y LAS CONDICIONES DE SERVICIO (CONJUNTAMENTE, EL PRESENTE “CONTRATO”). ASIMISMO, RECONOCE Y ENTIENDE QUE ZENIMAX LLEVARÁ A CABO EL TRATAMIENTO DE SUS DATOS DE CARÁCTER PERSONAL DE CONFORMIDAD CON LA POLÍTICA DE PRIVACIDAD DE ZENIMAX (puede consultarse en https://bethesda.net/es/document/privacy-policy). SI USTED NO ACEPTA LAS CLÁUSULAS DEL PRESENTE CONTRATO, O NO HA LEÍDO Y ENTENDIDO LA POLÍTICA DE PRIVACIDAD DE ZENIMAX, NO DESCARGUE, INSTALE NI UTILICE EL JUEGO.

El presente Contrato se celebra entre usted y ZeniMax Media Inc. (“ZeniMax”). 
TAL Y COMO SE ESTABLECE EN EL APARTADO 1 DE LAS CONDICIONES DE SERVICIO, EN CASO DE QUE USTED SEA RESIDENTE EN EL ESPACIO ECONÓMICO EUROPEO, REINO UNIDO, SUIZA, RUSIA, AUSTRALIA, NUEVA ZELANDA, TURQUÍA, JAPÓN O BRASIL, ZENIMAX RECONOCE QUE HAY DETERMINADAS GARANTÍAS, TÉRMINOS Y CONDICIONES (INCLUIDAS LAS RELATIVAS A REEMBOLSOS O DEVOLUCIONES Y CONDICIONES INJUSTAS) IMPUESTAS POR LAS LEYES SOBRE EL SUMINISTRO DE BIENES, SERVICIOS Y CONTENIDO DIGITAL, CUYA EXCLUSIÓN, LIMITACIÓN O MODIFICACIÓN LAS LEYES EXPRESAMENTE PROHÍBEN O LIMITAN EN CIERTA MEDIDA (LAS “OBLIGACIONES PREVISTAS EXPRESAMENTE POR LEY”). NADA DE LO DISPUESTO EN EL PRESENTE CLUF EXCLUIRÁ, LIMITARÁ O MODIFICARÁ LAS OBLIGACIONES PREVISTAS EXPRESAMENTE POR LEY EN MODO DISTINTO DEL PREVISTO EN DICHAS LEYES 
ADVERTENCIA SOBRE FOTOSENSIBILIDAD:
Es posible que un porcentaje muy reducido de personas sufra crisis epilépticas o desmayos cuando se exponen a algunas imágenes, incluyendo, entre las que se incluyen patrones de luz o luces parpadeantes.Si usted experimenta cualquiera de los siguientes síntomas mientras juega con el Juego, interrumpa inmediatamente su uso y consulte a su médico antes de volver a jugar: desmayos, ataques, mareos, alteraciones de la visión, espasmos oculares o musculares, tirones o temblores de brazos o piernas, pérdida de conciencia, desorientación, confusión, cualquier movimiento involuntario o convulsiones.
REALIDAD VIRTUAL: PRECAUCIONES DE SALUD Y SEGURIDAD Y DESCARGOS DE RESPONSABILIDAD
Si el Software ofrece una modalidad de juego de realidad virtual y/o el uso de dispositivos de realidad virtual de terceros y/o equipo relacionado, las siguientes precauciones de seguridad y de salud, y descargos de responsabilidad, serán de aplicación.
La falta de revisión y adopción de las precauciones en materia de salud y seguridad establecidas a continuación, así como de las precauciones del fabricante de su dispositivo de realidad virtual, puede resultar en daños a la propiedad, lesiones a usted o a otros, o la muerte.
Al igual que con todos los juegos de realidad virtual, lea y adopte cuidadosamente todas las precauciones de seguridad y salud de su fabricante de dispositivos de realidad virtual antes de usarlo.
POR FAVOR, PROCEDA A LEER LO SIGUIENTE ANTES DE COMENZAR A JUGAR
Tenga en cuenta que ciertas personas son susceptibles de padecer varios síntomas al jugar un juego con dispositivos de realidad virtual, entre los que se incluyen los siguientes:
·       ataques epilépticos o pérdida del conocimiento;
·       alteración de la visión;
·       mareos, desorientación o náuseas; y/ o
·       lesiones por movimiento repetitivo y fatiga ocular.
Deje de jugar de inmediato si no se encuentra bien o si experimenta cualquiera de los síntomas descritos anteriormente.
En cualquier caso, le recomendamos encarecidamente que tome descansos razonables cuando juegue cada 10 o 15 minutos y que no lo haga por períodos de duración excesivos.
Si está embarazada o padece cualquier problema de salud, consulte con su médico para obtener asesoramiento profesional antes de jugar.
El juego no deberá utilizarse bajo la influencia del alcohol o drogas, o mientras se esté haciendo uso de un medicamento, sujeto o no a prescripción médica.
Tenga siempre en cuenta los objetos a su alrededor cuando se disponga a jugar. Cuando juegue con dispositivos de realidad virtual, lo mejor será permanecer sentado, si ese modo es compatible con el juego. Dado que el juego es una experiencia de realidad inmersiva, es posible que no pueda ver u oír su entorno completamente mientras está jugando. Tanto si permanece sentado como si no durante el juego, se recomienda permanecer en un espacio amplio y libre de objetos y personas con los que pueda impactar. Asegúrese de que se encuentra en un entorno seguro y libre de escaleras, balcones, ventanas, paredes, muebles, objetos con los que pueda tropezar, u otros objetos o personas que puedan representar un peligro para usted o que puedan sufrir daños o lesiones durante el transcurso del juego. El volumen de sonido para el juego debe mantenerse a un nivel lo suficientemente bajo para que pueda ser consciente de lo que le rodea mientras juega, y para evitar cualquier tipo de daño auditivo.
POR EL PRESENTE, USTED LIBERA A ZENIMAX, A SUS FILIALES Y A SUS RESPECTIVOS AGENTES, DIRECTORES Y EMPLEADOS, DE TODA RESPONSABILIDAD RELACIONADA CON EL USO DE DISPOSITIVOS DE REALIDAD VIRTUAL O EQUIPAMIENTO RELACIONADO, O CON EL PROPIO SOFTWARE.
En ningún caso, Zenimax será responsable por daños materiales, lesiones, o muerte (o por daños directos, indirectos, punitivos, accidentales o consecuentes) que surjan por el uso incorrecto del Software, o del dispositivo de realidad virtual o equipamiento relacionado, incluidos sin limitación, aquellos daños que puedan surgir o estén relacionados con las interacciones entre usted y otras personas u objetos que se encuentren presentes en el área de juego durante el desarrollo del mismo. Usted queda informado de que el uso incorrecto del Software incluye (sin limitación) el incumplimiento de las instrucciones y advertencias incluidas en el empaquetado, documentación y capturas de pantalla del dispositivo de realidad virtual, en esta documentación o en cualquier otra documentación que acompañe al Software o al empaquetado del mismo. El hecho de no leer ni seguir de forma cuidadosa estas instrucciones y advertencias podría ocasionar daños materiales, lesiones o la muerte. Usted asume y acepta expresamente todos y cada uno de los riesgos inherentes al uso del Software y/o del dispositivo de realidad virtual o equipamiento relacionado, y aquellos riesgos relacionados con estos. Algunos de esos riesgos, pero no todos, están incluidos en las advertencias establecidas anteriormente o en las advertencias que acompañan al Software o al dispositivo de realidad virtual. Por favor, le rogamos que consulte también el apartado de “Limitación de Responsabilidad” de este acuerdo.
Las Condiciones de Servicio de ZeniMax contienen una Cláusula de Resolución de Conflictos y Arbitraje, que incluye una Renuncia a Demanda Colectiva, (“Cláusula sobre Conflictos”) que –en caso de que usted resida en un país fuera del EEE/Reino Unido/Suiza/Australia/Nueva Zelanda/Turquía/Japón o Brasil que permita demandas colectivas u otros litigios colectivos– afecta a sus derechos derivados de las Condiciones de Servicio de ZeniMax y de este Contrato de Licencia de Usuario Final con respecto a las disputas que usted pudiera tener con ZeniMax. Dicha Cláusula sobre Disputas queda incorporada al presente Contrato de Licencia de Usuario Final mediante esta referencia y forma parte del mismo como si dicha cláusula estuviese íntegramente reproducida en el presente contrato. Usted puede excluirse del arbitraje individual vinculante y de la renuncia a demanda colectiva conforme a lo dispuesto en las Condiciones de Servicio de ZeniMax.  
Todos y cada uno de los usos del Juego se rigen por los términos del presente Contrato y las Condiciones de Servicio de ZeniMax. Las Condiciones de Servicio de ZeniMax quedan incorporadas al presente Contrato y forman parte del mismo mediante esta referencia como si dichas disposiciones estuviesen reproducidas íntegramente aquí. El Contrato de Licencia de Usuario Final es un “CLUF” y constituye “Condiciones Adicionales” en el sentido establecido por las Condiciones de Servicio de ZeniMax. El Juego se pone a disposición y se distribuye exclusivamente para su uso por los usuarios finales autorizados de conformidad con los términos del presente Contrato, incluyendo las Condiciones de Servicio de ZeniMax. Cualquier uso, reproducción, modificación o distribución del Juego no autorizado expresamente por los términos del presente Contrato queda expresamente prohibido. Usted acepta que el Juego, el programa Cliente del Juego, otro software relacionado con el Juego, el Contenido (según se define en las Condiciones de Servicio) específico del Juego y el acceso y uso que usted haga del Juego constituyen conjuntamente un “Servicio” a los efectos del presente Contrato, incluyendo las Condiciones de Servicio de ZeniMax. ZeniMax se reserva todos los derechos no concedidos a usted en el presente Contrato. 
Usted reconoce que Zenimax podrá realizar el tratamiento de sus datos de carácter personal conforme a la Política de Privacidad de ZeniMax, que se puede consultar en https://bethesda.net/es/document/privacy-policy, y acepta el Código de Conducta de ZeniMax, que se puede consultar en https://bethesda.net/es/document/code-of-conduct. La Política de Privacidad y el Código de Conducta se incorporan al presente Contrato de Licencia de Usuario Final mediante esta referencia y forman parte del mismo como si dichas disposiciones estuviesen reproducidas íntegramente aquí. Todos los datos personales recogidos y tratados por ZeniMax en relación con el presente Contrato de Licencia de Usuario Final se recogerán y se tratarán de conformidad con la Política de Privacidad de ZeniMax. 
USTED DEBE IMPRIMIR UNA COPIA DEL PRESENTE CONTRATO DE LICENCIA DE USUARIO FINAL, LAS CONDICIONES DE SERVICIO, LA POLÍTICA DE PRIVACIDAD Y EL CÓDIGO DE CONDUCTA PARA SU CONSTANCIA Y FUTURA REFERENCIA.
Todos los programas de software y todos y cada uno de los archivos que se le entreguen o se pongan a su disposición por parte de ZeniMax, directamente o indirectamente a través de un revendedor o distribuidor autorizado de ZeniMax, (mediante acceso on-line, transmisión, descarga o por otro medio), incluyendo cualquier “parcheador”, “instalador”, y las actualizaciones y modificaciones de dichos programas de software, así como todas y cada una de las copias y obras derivadas de dichos programas de software (colectivamente, junto con el programa Cliente del Juego (que se define más adelante), el “Juego”) constituyen una obra protegida por derechos de autor de ZeniMax y sus filiales. EL JUEGO SE LE CEDE A USTED EN RÉGIMEN DE LICENCIA, Y NO CONSTITUYE UNA VENTA.  
1.	LICENCIA LIMITADA; RESTRICCIONES Y TITULARIDAD
Si acepta el presente Contrato, usted podrá, según corresponda, descargar, instalar y utilizar el software (en lo sucesivo denominado el “Cliente del Juego”) en su ordenador o videoconsola (en lo sucesivo denominados “ordenador” en ambos casos) con la única finalidad de jugar al Juego. Con sujeción a que usted cumpla todos los términos y condiciones del presente Contrato, mediante el presente ZeniMax le concede, y usted acepta, una licencia limitada, no transmisible y no exclusiva (a) para descargar, instalar o usar el Cliente del Juego en uno o varios ordenadores de su propiedad o bajo su control legítimo con fines de entretenimiento suyo no comercial exclusivamente, y (b) para utilizar el Cliente del Juego únicamente como parte del Servicio cuando corresponda.
Las Condiciones de Servicio de ZeniMax incluyen términos y condiciones aplicables a Moneda Virtual (según se define dicho término en las Condiciones de Servicio de ZeniMax), incluyendo términos que le conceden a usted una licencia limitada y no exclusiva para Moneda Virtual. Dichos términos y condiciones son aplicables a la Moneda Virtual (en su caso) que se le concede en régimen de licencia para ser utilizada con el Juego.
Sin perjuicio de las Obligaciones Previstas Expresamente por la Ley (según se definen en el Apartado 1 de las Condiciones de Servicio), el presente Contrato no le concede a usted ningún derecho a obtener nuevas ediciones o sustituciones del Juego y ZeniMax no estará obligada a facilitar actualizaciones de software, mejoras o ampliaciones del Juego, ni tan siquiera a explotar ni continuar prestando el soporte del Juego por un periodo de tiempo indefinido.  
Tal y como se describe con más detalle en las Condiciones de Servicio de ZeniMax, pero sin perjuicio de las Obligaciones Previstas Expresamente por la Ley (según se definen en el Apartado 1 de las Condiciones de Servicio), ZeniMax podrá cambiar, modificar, suspender o interrumpir cualquier aspecto del Juego en cualquier momento, pudiendo asimismo imponer límites a determinadas características o restringir su acceso a algunas partes o a la totalidad del Juego sin necesidad de notificación y sin ninguna responsabilidad.
En todos los casos, las licencias concedidas a usted en el presente Contrato se extinguirán en el momento de la extinción del presente Contrato o de la cancelación de su Cuenta en ZeniMax, lo que ocurra primero.  
Las Condiciones de Servicio de ZeniMax incluyen términos y condiciones aplicables al Contenido generado por el usuario, al Contenido descargable y a otros Contenidos y usted se compromete a cumplir dichos términos y condiciones. 
2.	ACTUALIZACIONES DE SOFTWARE Y HERRAMIENTAS DE SEGURIDAD Y ANTITRAMPAS. ZeniMax podrá instalar o proporcionar parches, actualizaciones, mejoras y modificaciones para el Juego (“Actualizaciones”) que usted deberá instalar de la manera descrita por ZeniMax, a su discreción, antes de poder continuar utilizando el Juego. Todas estas Actualizaciones forman parte del Juego a efectos del presente contrato, las licencias que se le otorgan a usted y las limitaciones de las mismas previstas en el presente Contrato. Los Términos del presente Contrato regirán las Actualizaciones proporcionadas por ZeniMax que sustituyan y/o complementen al Juego original, salvo si dichas Actualizaciones van acompañadas de un contrato de licencia independiente, en cuyo caso se aplicarán los términos de dicho contrato de licencia. ZENIMAX HA INCORPORADO HERRAMIENTAS Y SOFTWARE (“HERRAMIENTAS ANTITRAMPAS”) DISEÑADOS PARA DETECTAR E IMPEDIR TRAMPAS Y ENGAÑOS; ESTAS TECNOLOGÍAS PUEDEN ESCANEAR CUALQUIER ORDENADOR O DISPOSITIVO UTILIZADO PARA DESCARGAR O JUGAR AL JUEGO, CON EL PROPÓSITO DE DETECTAR O IDENTIFICAR PROGRAMAS O PROCESOS DISEÑADOS PARA “HACER TRAMPAS”, OBTENER UNA VENTAJA INJUSTA EN EL JUEGO O ELUDIR DE ALGÚN OTRO MODO CUALQUIER PROCESO O HERRAMIENTA DE SEGURIDAD, ANTITRAMPAS O DE DETECCIÓN DE ENGAÑOS QUE HAYAMOS INCORPORADO (“PROGRAMAS PARA HACER TRAMPAS”). AL USAR O DESCARGAR EL JUEGO, O AL ACEPTAR ESTE CONTRATO, USTED RECONOCE Y AUTORIZA EXPRESAMENTE EL ACCESO DE ESTAS HERRAMIENTAS ANTITRAMPAS A SU ORDENADOR O DISPOSITIVO CON EL PROPÓSITO DE IDENTIFICAR O DETECTAR PROGRAMAS PARA HACER TRAMPAS.
3.	LIMITACIONES Y RESTRICCIONES.
El Juego y/o determinadas funcionalidades del mismo son un Servicio ofrecido por ZeniMax y puede que solo estén disponibles online. En tal caso, para jugar al Juego o acceder a dichas funcionalidades se requiere una conexión permanente a internet (que no proporciona ZeniMax). Usted es responsable de todos los costes y gastos asociados a la adquisición de cualquier hardware, software (como pueden ser navegadores de internet) u otros productos o servicios requeridos para jugar al Juego o acceder a dichas funcionalidades.
Además de las restricciones, condiciones y limitaciones establecidas en las Condiciones de Servicio de ZeniMax y en el Código de Conducta de ZeniMax, la licencia que se le concede a usted en el presente Contrato de Licencia de Usuario Final está sujeta a las condiciones, restricciones y limitaciones establecidas en el Apartado 1 y en el presente Apartado 4 del presente Contrato de Licencia de Usuario Final (conjuntamente, las “Limitaciones de la Licencia”). Todo uso del Juego que vulnere las Limitaciones de la Licencia será considerado como una infracción de los derechos de autor de ZeniMax sobre el Juego y constituirá un incumplimiento del presente Contrato. Usted se compromete a abstenerse de, y a no ayudar a ninguna otra persona para, bajo ninguna circunstancia:
A.	distribuir, explotar o exhibir públicamente, vender, transmitir, publicar, editar, reproducir, sublicenciar, arrendar, alquilar, prestar o transferir de otro modo, total o parcialmente, el Juego o los Contenidos, incluyendo, a título enunciativo y no limitativo, las claves de acceso;
B.	modificar, adaptar, traducir, aplicar ingeniería inversa sobre, intentar derivar el código fuente de, modificar, desmontar, descompilar o crear obras derivadas basadas en, total o parcialmente, el Juego; no obstante, usted podrá realizar una (1) copia del Cliente del Juego y de los manuales que lo acompañan a efectos de archivo únicamente y podrá instalar el correspondiente Cliente del Juego en uno o varios ordenadores de su propiedad o bajo su control legítimo conforme se describe en el Apartado 1 de este documento; 
C.	suprimir avisos de propiedad intelectual o etiquetas del Juego, o intentar de alguna manera sortear las medidas de seguridad diseñadas para controlar el acceso al Juego o a alguna parte del mismo;  
D.	recurrir a estafas, software de automatización (bots), hacks, mods y demás software de terceros no autorizado que estén diseñados para modificar el Juego o afectar negativamente en el uso que hagan otras personas del Juego y/o su experiencia de uso del Juego; 
E.	explotar el Juego o cualquiera de sus parte, incluyendo, a título enunciativo y no limitativo, el Cliente del Juego con fines comerciales (incluyendo, a título enunciativo y no limitativo, el arrendamiento, alquiler o el otorgamiento de licencias sobre el Juego a favor de otros), incluyendo, a título enunciativo y no limitativo, (a) para acumular Moneda Virtual (según se define en las Condiciones de Servicio de ZeniMax), artículos o recursos para su venta fuera del Juego; o (b) prestar servicios dentro del juego a cambio de un pago fuera del Juego, por ejemplo, el caso de la nivelación de energía (power-leveling); 
F.	utilizar software de terceros no autorizado que intercepte, “mine” o recopile de otro modo información del Juego, o a través del mismo, incluyendo, a título enunciativo y no limitativo, cualquier software que lea áreas de RAM utilizadas por el Juego para el almacenamiento de información sobre un personaje o el entorno del juego; entendiéndose, no obstante, que ZeniMax podrá, a su absoluta y exclusiva discreción, permitir el uso de determinadas interfaces de usuario de terceros y otro software de terceros; 
G.	modificar o facilitar que se modifiquen archivos que formen parte del Cliente del Juego de cualquier manera no autorizada expresamente por ZeniMax; 
H.	alojar, prestar o desarrollar servicios de enlace (matchmaking) para el Juego o interceptar, emular o redirigir los protocolos de comunicación utilizados por ZeniMax de cualquier forma, con cualquier finalidad, incluyendo, a título enunciativo y no limitativo, el juego no autorizado en Internet, el juego en red, o como parte de redes de agregación de contenidos;
I.	facilitar, crear o mantener una conexión no autorizada con el Juego o el Servicio, incluyendo, a título enunciativo y no limitativo, (a) cualquier conexión con un servidor no autorizado que emule, o intente emular, el Servicio; y (b) cualquier conexión que emplee programas o herramientas que no hayan sido aprobadas expresamente por ZeniMax;
J.	subir, publicar, transmitir, promover, distribuir o realizar acción alguna relacionada con contenido ilegal; 
K.	subir, publicar, transmitir, promover, distribuir o realizar acción alguna relacionada con contenido que infrinja o viole los derechos de terceros; 
L.	dedicarse a, llevar a cabo cualquier acto asociado con, o participar en modo alguno en la captación o seducción de menores, pedofilia o comportamiento abusivo de cualquier tipo; 
M.	acosar, acechar, amenazar, avergonzar, enviar correo basura o hacer cualquier otra cosa a otro usuario del Juego, que no fuera deseada por éste, como, por ejemplo, repetidamente enviar mensajes no deseados o realizar ataques personales o comentarios sobre la raza, orientación sexual, religión, ascendencia, etc.; 
N.	subir, publicar, transmitir, distribuir o comunicar su información de carácter personal o la de cualquier otra persona real; 
O.	hacerse pasar por otra persona o entidad, incluidos, a modo enunciativo que no limitativo, ZeniMax, empleados de socios o de filiales de ZeniMax, o hacer manifestaciones falsas o tergiversar de otro modo su relación con cualquier persona o entidad; 
P.	realizar cualquier acto, organizar, transmitir cualquier contenido, efectuar o participar en cualquier actividad, grupo o colectivo que sea peligroso, tortuoso, abusivo, cargado de odio (incluidos los "discursos que incitan al odio”), de modo étnico, religioso o, de cualquier otro modo ofensivo, obsceno, amenazador,  intimidatorio, vulgar, sexualmente explícito, difamatorio, calumnioso, infractor,invasivo de la privacidad personal o de los derechos de publicidad, que fomente conductas que podrían infringir leyes o sea, a juicio de una persona razonable, objetable y/o considerado, a entera discreción de Zenimax, como inapropiado;  
Q.	promover, subir, transmitir, animar a tomar parte en cualquier actividad que implique piratería o phishing, aprovechándose de la vulnerabilidad o trampas y/o distribución de software falsificado y/o Moneda Virtual o artículos virtuales. En un esfuerzo por mejorar continuamente el Juego, tanto usted como otros usuarios/jugadores que descubran el aprovechamiento de alguna vulnerabilidad, trampa, descifrado u otras incoherencias, están obligados a comunicarlas a ZeniMax; o
R.	realizar cualquier acto o subir, publicar, transmitir, promover o distribuir cualquier contenido que pudiera incluir troyanos, virus, worms, spyware, time bombs, cancelbots, datos alterados u otros programas informáticos, que no sea de su propiedad o no disponga de permiso para su libre distribución, y que pudiera dañar, interferir con el Juego, o expropiar o perturbar el mismo.
Cualquier intento de hacer algo de lo anterior constituirá un incumplimiento del presente Contrato y podrá constituir una infracción de derechos de propiedad intelectual sobre el Juego. Si usted incumple estas restricciones podrá ser objeto de procesamiento e indemnización por daños y perjuicios.  
El Juego se le concede a usted en régimen de licencia como un solo producto. Sus componentes no pueden ser separados para ser usados en varios ordenadores. A usted se le concede una licencia sobre el Juego, sin que constituya una venta. Su licencia no otorga ninguna titularidad ni propiedad sobre el Juego ni sobre sus copias. 
4.	TITULARIDAD DEL JUEGO.  
ZeniMax y sus otorgantes de licencias son, y continuarán siendo, los propietarios de todos los derechos, títulos e intereses sobre el Juego y el Servicio, incluyendo, a título enunciativo y no limitativo, todos los derechos de propiedad intelectual y derechos morales sobre el Juego y todas las copias del mismo (incluyendo, a título enunciativo y no limitativo, cualesquiera títulos, programas y códigos de software, temas relacionados con el Juego, personajes, nombres de personajes, parecidos de personajes, historias, diálogos, eslóganes, ubicaciones, conceptos, ilustraciones, inventarios de personajes, diseños de estructuras, paisajes y de otro tipo dentro del Juego, animaciones, sonidos, composiciones y grabaciones musicales, efectos audiovisuales, argumentos, métodos de funcionamiento y cualquier documentación relacionada). Usted no emprenderá ninguna acción que contradiga dicha titularidad. El Juego está protegido por las leyes sobre derechos de autor de Estados Unidos, los tratados y convenios internacionales y otras leyes. El Juego podrá contener materiales licenciados por terceros, y los otorgantes de licencias sobre esos materiales podrán hacer valer sus derechos en el caso de producirse cualquier incumplimiento del presente Contrato. Usted reconoce y acepta no tener ningún interés, económico o de otro tipo, en cualquier funcionalidad o Contenido incluido en el Juego. Este párrafo continuará surtiendo efectos incluso después de la extinción del presente Contrato.  
5.	RECOGIDA Y USO DE DATOS POR PARTE DE ZENIMAX.  
RECONOCE USTED QUE HA LEÍDO Y HA ENTENDIDO LA POLÍTICA DE PRIVACIDAD DE ZENIMAX [https://bethesda.net/es/document/privacy-policy], QUE EXPLICA CÓMO PODEMOS RECOPILAR, UTILIZAR Y DIVULGAR DATOS SOBRE USTED (INCLUIDOS DATOS PERSONALES). EN PARTICULAR, ZENIMAX UTILIZARÁ SUS DATOS PERSONALES (INCLUIDOS DATOS PERSONALES) PARA LA EXPLOTACIÓN DE LOS SERVICIOS, PARA FACILITAR ASISTENCIA, DESARROLLO Y MEJORA DE LOS PRODUCTOS, PARA ADAPTAR Y PERSONALIZAR SUS EXPERIENCIAS Y ENTENDER QUÉ PRODUCTOS DE ZENIMAX UTILIZA USTED, ASÍ COMO PARA PRESTARLE SERVICIO. RECONOCE USTED ASIMISMO QUE HA LEÍDO Y HA ENTENDIDO NUESTRA POLÍTICA DE COOKIES [http://bethesda.net/es/document/cookie-policy] Y ACEPTA USTED QUE PODEMOS UTILIZAR COOKIES, BALIZAS WEB Y OTRAS TECNOLOGÍAS ANALÍTICAS (EN EL PRESENTE, COLECTIVAMENTE “COOKIES”) –INCLUIDAS LAS PROPORCIONADAS POR TERCEROS– PARA RECOGER UTILIZAR, ALMACENAR Y TRANSMITIR INFORMACIÓN TÉCNICA Y DE OTRO TIPO EN RELACIÓN A SU DISPOSITIVO MÓVIL U OTRO DISPOSITIVO (INCLUIDA LA ID ÚNICA DE DISPOSITIVO DE LA DIRECCIÓN MAC U OTRO IDENTIFICADOR, UDID, XUID, Y/O PUID), ID DEL CENTRO DE JUEGO, NOMBRE DEL CENTRO DE JUEGO, DIRECCIÓN IP, GEOLOCALIZACIÓN, MARCA Y MODELO DEL DISPOSITIVO, SISTEMA OPERATIVO, SOFTWARE Y APLICACIONES, DATOS DE JUEGO/USO, DATOS DE AUTORIZACIÓN DE CUENTA DE TERCEROS, DATOS DE SESIÓN, IDENTIFICADORES DE NAVEGADORES, TIPO DE CONEXIÓN E INFORMACIÓN DEL PROVEEDOR INALÁMBRICO. ACEPTA USTED EL USO QUE HACEMOS DE COOKIES CONFORME A LO DESCRITO EN EL PRESENTE DOCUMENTO Y DE MANERA MÁS DETALLADA EN NUESTRA POLÍTICA DE COOKIES, QUE EXPLICA SUS OPCIONES EN RELACIÓN CON EL USO QUE HACEMOS DE COOKIES.
Asimismo, reconoce y entiende usted que Zenimax ofrece el Juego y desarrolla actividades en numerosos países.  En consecuencia, la información personal que se recopile de usted, o que usted nos envíe, a través de un Juego o de otra forma podrá ser transferida a servidores o equipos ubicados en un destino fuera de su país de residencia, pudiendo también ser almacenada por estos.  Los servidores y equipos en los que se almacenen y se traten sus datos podrán ser propiedad de (y operados por) terceros con los que Zenimax haya contratado recibir, almacenar y tratar su información de carácter personal.   Zenimax y dichos terceros que esta haya designado podrán a su vez transferir, almacenar y tratar su información de carácter personal en servidores y equipos ubicados en otros países. Debe tener en cuenta que es posible que las leyes sobre la protección de datos de otros países no sean iguales que las leyes sobre la protección de datos de su país de residencia. Esta cláusula 5 continuará vigente después de la extinción del presente contrato.
6.	SUPERVISIÓN Y ACTUALIZACIONES.
Si usted solicita soporte técnico a ZeniMax, esta podrá, con sujeción a su consentimiento, acceder remotamente y analizar el ordenador en el que usted haya descargado el Cliente del Juego con el fin de prestar soporte técnico y reparar errores.  
Tal y como se describe con más detalle en las Condiciones de Servicio de ZeniMax, ésta podrá actualizar el Juego remotamente, incluyendo, a título enunciativo y no limitativo, el Cliente del Juego descargado en su ordenador, y usted mediante el presente da su consentimiento a ZeniMax para instalar y aplicar dichas Actualizaciones.  
Usted entiende y acepta que (a) todos los datos de personajes relacionados con el Juego están almacenados y alojados en ordenadores y servidores de ZeniMax, y (b) todas las comunicaciones que usted realice dentro del Juego (incluyendo, a título enunciativo y no limitativo, mensajes dirigidos exclusivamente a otro jugador o grupo de jugadores) se realizarán a través de ordenadores y servidores de ZeniMax y podrán ser supervisadas o no por ZeniMax o por agentes de ZeniMax. Usted consiente expresamente dicha supervisión de las comunicaciones que envíe y reciba.  Las Condiciones de Servicio de ZeniMax y la Política de Privacidad de ZeniMax incluyen otros términos y condiciones aplicables al acceso, supervisión y registro de actividades y comunicaciones en relación con el Servicio, incluyendo, a título enunciativo y no limitativo, que ZeniMax pueda informar de incidentes a las autoridades policiales y de otro tipo. Todos los datos personales recogidos y tratados por ZeniMax como parte de las actividades enunciadas en la presente cláusula 6 serán recogidos y tratados conforme a lo dispuesto en la Política de Privacidad de ZeniMax [https://bethesda.net/es/document/privacy-policy] y las condiciones del Contrato.
7.	RESOLUCIÓN. El presente Contrato de Licencia de Usuario Final entrará en vigor en el momento en que usted acepte dicho Contrato de Licencia de Usuario Final y continuará vigente hasta que sea resuelto. Usted podrá resolver el presente Contrato de Licencia de Usuario Final en cualquier momento (i) destruyendo permanentemente todas las copias del Juego en su poder o bajo su control y (ii) eliminando el Cliente del Juego de su disco duro.  Sin perjuicio de las Obligaciones Previstas Expresamente por la Ley (según se definen en el Apartado 1 de las Condiciones de Servicio), ZeniMax podrá resolver el presente Contrato de Licencia de Usuario Final en cualquier momento, por cualquier causa o sin causa (incluso en el momento en que ZeniMax opte por dejar de ofrecer el Juego). A partir de la resolución por parte de ZeniMax por cualquier causa, todas las licencias otorgadas en el presente Contrato (incluyendo en las Condiciones de Servicio de ZeniMax) con respecto al Juego objeto del presente Contrato de Licencia de Usuario Final quedarán extinguidas inmediatamente y usted deberá hacer de inmediato lo estipulado en los puntos (i) y (ii) de este párrafo. ZeniMax le comunicará a usted la resolución sin causa.
8.	RESTRICCIONES A LA EXPORTACIÓN.El Juego no podrá ser objeto de exportación, reexportación, descarga ni otro tipo de transmisión (i) a, o dentro de, (en conjunto, una “Exportación”) un país que requiera una licencia de Exportación o sobre el que exista una prohibición del Gobierno de Estados Unidos a las Exportaciones, incluyendo cualquier país sujeto a sanciones económicas o (ii) a cualquier persona o entidad sobre la que exista una prohibición de recibir bienes o servicios que tengan su origen en Estados Unidos.Usted declara y garantiza no estar ubicado en, bajo el control de, o ser un ciudadano o residente de, cualquiera de estos países, ni figurar en cualquiera de estas listas. La presente Cláusula 8 continuará surtiendo efectos incluso después de la extinción del presente Contrato.
9.	GARANTÍA.  
Si usted, comprador original, adquirió el Juego en un medio físico (como, por ejemplo, un disco) el uso por su parte del Juego estará sujeto a la garantía limitada incluida con el manual u otro material de embalaje que viniera con su compra.
LAS CONDICIONES DE SERVICIO DE ZENIMAX INCLUYEN DISPOSICIONES RELATIVAS A LA EXCLUSIÓN DE DECLARACIONES Y GARANTÍAS (SIN PERJUICIO DE LAS OBLIGACIONES PREVISTAS EXPRESAMENTE POR LA LEY (SEGÚN SE DEFINEN EN EL APARTADO 1 DE LAS CONDICIONES DE SERVICIO DE ZENIMAX)) Y DICHAS DISPOSICIONES SE INCORPORAN AL PRESENTE CONTRATO DE LICENCIA DE USUARIO FINAL MEDIANTE ESTA REFERENCIA Y FORMAN PARTE DE ESTE CONTRATO DE LICENCIA DE USUARIO FINAL COMO SI DICHAS DISPOSICIONES ESTUVIESEN REPRODUCIDAS ÍNTEGRAMENTE EN EL PRESENTE CONTRATO. LA PRESENTE CLÁUSULA 9 SEGUIRÁ SURTIENDO EFECTOS INCLUSO DESPUÉS DE LA EXTINCIÓN DEL PRESENTE CONTRATO.
Con respecto al software que está habilitado para su uso en Internet, usted reconoce que ZeniMax no es responsable de Internet ni de si continuará existiendo en su forma actual ni si un gobierno u organismo púbico, ya sea nacional o extranjero, controlará, regulará o desmantelará Internet. El uso de Internet es por su cuenta y riesgo.
10.	LIMITACIÓN DE RESPONSABILIDAD, REEMBOLSO.
En la medida máxima permitida por la legislación aplicable, y con sujeción a las Obligaciones Previstas Expresamente por la Ley (según se definen en el Apartado 1 de las Condiciones de Servicio), EN NINGÚN CASO NI ZENIMAX NI NINGUNO DE SUS OTORGANTES DE LICENCIAS ASUMIRÁN NINGUNA RESPONSABILIDAD POR (I) DAÑOS INCIDENTALES, ESPECIALES, CONSECUENTES, EJEMPLARES, PUNITIVOS U OTROS DAÑOS INDIRECTOS, (II) RECLAMACIONES DE TERCEROS, NI (III) PÉRDIDAS O DAÑOS QUE AFECTEN A SISTEMAS, HARDWARE O SOFTWARE, REGISTROS O DATOS, AUN CUANDO HUBIESE SIDO INFORMADO O CONOCIESE LA POSIBILIDAD DE DICHOS DAÑOS Y AUNQUE UNA ACCIÓN LEGAL RECOGIDA EN EL PRESENTE CONTRATO NO CUMPLA SU FINALIDAD ESENCIAL.  
ALGUNOS PAÍSES NO PERMITEN LA LIMITACIÓN O EXCLUSIÓN DE RESPONSABILIDAD. EN CONSECUENCIA, ES POSIBLE QUE ALGUNAS DE LAS DISPOSICIONES ANTERIORES NO SEAN APLICABLES A USTED.
LAS CONDICIONES DE SERVICIO DE ZENIMAX INCLUYEN OTRAS DISPOSICIONES RELATIVAS A LA LIMITACIÓN DE RESPONSABILIDAD Y ACCIONES (CON SUJECIÓN A LAS OBLIGACIONES PREVISTAS EXPRESAMENTE POR LA LEY (SEGÚN SE DEFINEN EN EL APARTADO 1 DE LAS CONDICIONES DE SERVICIO DE ZENIMAX)) Y DICHAS DISPOSICIONES SE INCORPORAN AL PRESENTE CONTRATO DE LICENCIA DE USUARIO FINAL MEDIANTE ESTA REFERENCIA Y FORMAN PARTE DE ESTE CONTRATO DE LICENCIA DE USUARIO FINAL COMO SI DICHAS DISPOSICIONES ESTUVIESEN REPRODUCIDAS ÍNTEGRAMENTE EN EL PRESENTE CONTRATO.  
En caso de que (i) usted haga un uso indebido del Servicio del Juego o incumpla el presente Contrato o (ii) alguna contribución, acción u omisión por su parte en relación con su uso del Servicio del Juego dé lugar a que ZeniMax incurra en responsabilidades, daños y perjuicios, pérdidas, costes y gastos (incluyendo, a título enunciativo y no limitativo, honorarios de abogados y costas judiciales), usted se compromete a reembolsar a ZeniMax y a sus filiales y otros participantes de los Servicios por todas las responsabilidades, daños y perjuicios, pérdidas, costes y gastos. En caso de que un tercero demande a ZeniMax por cualquiera o por ambos de los puntos (i) o (ii) de este párrafo, ZeniMax se reserva el derecho a asumir el control de la defensa y resolución de dicha demanda de tercero, y usted se compromete a reembolsar a ZeniMax el coste de la defensa, incluyendo, a título enunciativo y no limitativo, los honorarios razonables de abogados y acreditados documentalmente. 
La presente Cláusula 10 continuará surtiendo efectos incluso después de la extinción del presente Contrato.  
11.	MODIFICACIONES EN EL CONTRATO. ZeniMax podrá sustituir el presente Contrato de Licencia de Usuario Final por nuevas versiones (cada una de ellas un “Nuevo CLUF”) a medida que evolucionen el Juego y las leyes. El presente Contrato de Licencia de Usuario Final se extinguirá de inmediato tras la introducción de un Nuevo CLUF, y usted tendrá la oportunidad de estudiar el Nuevo CLUF de conformidad con las disposiciones sobre modificaciones recogidas en las Condiciones de Servicio de ZeniMax. Los Nuevos CLUF no se aplicarán con carácter retroactivo. Su uso continuado del Software y del Juego después de una modificación del CLUF será considerado como una aceptación por su parte de los términos modificados.
12.	DERECHOS RESTRINGIDOS DEL GOBIERNO DE ESTADOS UNIDOS. El Juego es un Artículo Comercial desarrollado exclusivamente con fondos privados que comprende “software informático comercial” y “documentación de software informático comercial”, tal y como se definen estos términos en la normativa aplicable sobre adquisiciones, incluyendo, a título enunciativo y no limitativo, el Federal Acquisition Regulation (Reglamento Federal de Adquisiciones de Estados Unidos, o “FAR”, por sus siglas en inglés), en 48 C.F.R. 2.101.El Juego cedido bajo licencia se otorga bajo de licencia para Usuarios Finales del Gobierno de Estados Unidos, con sujeción a lo dispuesto en el presente Contrato, tal y como se prevé en 48 C.F.R. 12.212 (Software Informático) y 12.211 (Datos Técnicos) (para entidades civiles), y en la forma prevista en 48 C.F.R. 227.7202-3 y 48 C.F.R. 227.7202-4, de conformidad con 48 C.F.R. 227.7202 (para entidades del Departamento de Defensa).Únicamente por lo que respecta a los derechos del Gobierno de Estados Unidos sobre el Juego, esta cláusula de Derechos de Licencia del Gobierno de Estados Unidos reemplaza y deroga cualquier otro FAR, DFARS (Suplemento del Reglamento Federal de Adquisiciones de Defensa, por sus siglas en inglés) u otra cláusula o disposición del contrato en virtud del cual se obtenga este Juego. El Fabricante es ZeniMax.
13.	LEY APLICABLE.
Para los residentes en Estados Unidos, el presente Contrato y todos los Conflictos (tal y como se define este término en la Disposición sobre Conflictos) se regirán por las leyes del Estado de Delaware (Estados Unidos), excluyéndose sus normas y principios relativos a los conflictos de leyes que, de aplicarse, supusieran la aplicación de las leyes de otro Estado o país a este Contrato o a cualquier Conflicto, y excluyéndose asimismo la Convención de las Naciones Unidas sobre los Contratos de Compraventa Internacional de Mercaderías, la Ley Uniforme de Transacciones de Información Computerizada (o “UCITA”, por sus siglas en inglés) y cualesquiera leyes que emanen de la UCITA. Con fines aclaratorios, las condiciones recogidas en el presente párrafo prevalecerán sobre cualesquiera condiciones contenidas en las Condiciones de Servicio de ZeniMax que entren en conflicto con las mismas, incluidas, de manera no exhaustiva, cualesquiera condiciones que, de aplicarse, supusieran la aplicación de las leyes de otro Estado o país a este Contrato o a cualquier Conflicto.
Si usted reside fuera de Estados Unidos, el presente Contrato y todos los Conflictos se regirán por las leyes de Inglaterra, excluyéndose sus normas y principios relativos a los conflictos de leyes que, de aplicarse, supusieran la aplicación de las leyes de otro Estado o país a este Contrato o a cualquier Disputa, y excluyéndose asimismo la Convención de las Naciones Unidas sobre los Contratos de Compraventa Internacional de Mercaderías. Podrían resultar de aplicación leyes locales de obligado cumplimiento.
Sin perjuicio de la Disposición sobre Conflictos, usted acepta que ZeniMax está legitimada para solicitar medidas cautelares, un cumplimiento específico y recursos de equidad en relación a incumplimientos de los Apartados 1 a 4 del presente Contrato, además de cualquier otro recurso legal del que pueda disponer ZeniMax en virtud de las leyes aplicables.  
La presente Cláusula 13 continuará surtiendo efectos incluso después de la extinción del presente Contrato.
14.	DISPOSICIONES VARIAS.El presente Contrato de Licencia de Usuario Final junto con las Condiciones de Servicio de ZeniMax, la Política de Privacidad de ZeniMax y el Código de Conducta de ZeniMax constituyen y contienen el acuerdo íntegro entre usted y ZeniMax con respecto al objeto que aquí se trata, sustituyendo a cualquier otro acuerdo anterior verbal o escrito. El presente Contrato de Licencia de Usuario Final se aplicará simultáneamente, sin sustituirlas, con las Condiciones de Servicio de ZeniMax o la Política de Privacidad de ZeniMax. En la medida en que las disposiciones de este Contrato de Licencia de Usuario Final entren en conflicto con las disposiciones de las Condiciones de Servicio de ZeniMax, y salvo que se indique expresamente otra cosa en este Contrato, prevalecerán las disposiciones de este Contrato de Licencia de Usuario Final. Salvo que se establezca expresamente otra cosa en la Disposición sobre Conflictos, si se declara nula o inaplicable una parte de este Contrato, dicha parte se interpretará de una manera congruente con las leyes aplicables de manera que se reflejen, lo más aproximadamente posible, las intenciones iniciales de dicha parte, conservando toda su eficacia el resto de disposiciones del Contrato. La falta de ejercicio o ejecución de cualquier derecho o disposición del presente Contrato por parte de ZeniMax no será interpretada como una renuncia a dicho derecho o disposición. Cualquier renuncia a una disposición del presente Contrato será efectiva únicamente si se realiza por escrito y con la firma de ZeniMax. Usted acepta que este Contrato y la ejecución del mismo por parte de ZeniMax no tienen por objeto conferir, y no confieren, derechos o reparaciones a cualquier otra persona que no sea usted o ZeniMax. La presente Cláusula 14 continuará surtiendo efectos incluso después de la extinción del presente Contrato por cualquier causa.
Por el presente confirmo que he leído y entendido todos los términos y condiciones recogidos en el presente Contrato y acepto que, al hacer clic en “Aceptar”, instalar el Cliente del Juego o jugar al Juego estoy dando mi consentimiento a quedar obligado por todos los términos y condiciones del presente Contrato, lo que incluye mi consentimiento expreso al uso aquí descrito de las herramientas antitrampas por parte de ZeniMax.
