YOU SHOULD CAREFULLY READ THE ENTIRE FOLLOWING END USER LICENSE AGREEMENT BEFORE DOWNLOADING, INSTALLING, USING OR PLAYING THE GAME OR ANY RELATED SOFTWARE (collectively, the “GAME”).  THIS AGREEMENT CONTAINS IMPORTANT TERMS THAT AFFECT YOUR LEGAL RIGHTS.  BY DOWNLOADING, INSTALLING, USING OR PLAYING THE GAME, YOU AGREE TO BE BOUND BY ALL THE TERMS OF THIS AGREEMENT.  IF YOU DO NOT AGREE TO ALL THE TERMS OF THIS AGREEMENT, PLEASE DO NOT (AND YOU ARE NOT PERMITTED TO) DOWNLOAD, INSTALL, USE OR PLAY THE GAME.

L’UTENTE È INVITATO A LEGGERE ATTENTAMENTE L’INTERO CONTRATTO DI LICENZA PRIMA DI SCARICARE, INSTALLARE, GIOCARE E UTILIZZARE IL GIOCO E I SOFTWARE AD ESSO RELATIVI (collettivamente, il “GIOCO”). BY DOWNLOADING, INSTALLATION, USING OR PLAYING THE GAME YOU CONFIRM THAT YOU HAVE READ THIS END USER LICENSE AGREEMENT, THE ZENIMAX TERMS OF SERVICE AND THE ZENIMAX PRIVACY POLICY AND THAT YOU AGREE TO THE TERMS IN THIS AGREEMENT AND THE TERMS OF SERVICE, (COLLECTIVELY, THIS “AGREEMENT”).  YOU FURTHER ACKNOWLEDGE AND UNDERSTAND THAT ZENIMAX WILL PROCESS YOUR PERSONAL DATA IN ACCORDANCE WITH THE ZENIMAX PRIVACY POLICY (available at https://bethesda.net/#/privacypolicy). IF YOU DO NOT ACCEPT THE TERMS OF THIS AGREEMENT, OR YOU HAVE NOT READ AND UNDERSTOOD THE ZENIMAX PRIVACY POLICY, DO NOT DOWNLOAD, INSTALL OR USE THE GAME.

This Agreement is between you and ZeniMax Media Inc. (“ZeniMax”).

AS SET OUT IN SECTION 1 OF THE TERMS OF SERVICE, IF YOU ARE RESIDENT IN THE EEA, UNITED KINGDOM, SWITZERLAND, RUSSIA, AUSTRALIA, NEW ZEALAND, TURKEY, JAPAN OR BRAZIL, ZENIMAX ACKNOWLEDGES THAT THERE ARE CERTAIN GUARANTEES, WARRANTIES, TERMS AND CONDITIONS (INCLUDING IN RESPECT OF REFUNDS AND RETURNS AND UNFAIR TERMS) IMPOSED BY THE LAWS RELATING TO THE SUPPLY OF GOODS, SERVICES AND DIGITAL CONTENT WHICH THE LAWS EXPRESSLY PROVIDE MAY NOT BE EXCLUDED, RESTRICTED OR MODIFIED OR MAY ONLY BE LIMITED TO A CERTAIN EXTENT (THE "STATUTORY OBLIGATIONS").  NOTHING IN THIS EULA EXCLUDES, RESTRICTS OR MODIFIES THE STATUTORY OBLIGATIONS OTHERWISE THAN ACCORDING TO SUCH LAWS.

COME PREVISTO ALL’ARTICOLO 1 DELLE CONDIZIONI DI SERVIZIO, NEL CASO IN CUI L’UTENTE RISIEDA NELLA COMUNITÀ EUROPEA, NEL REGNO UNITO, IN SVIZZERA, RUSSIA, AUSTRALIA, NUOVA ZELANDA, TURCHIA, GIAPPONE O BRASILE, ZENIMAX PRENDE ATTO DELL’ESISTENZA DI GARANZIE, TERMINI E CONDIZIONI (IVI INCLUSI QUELLI CONCERNENTI I RIMBORSI, I RESI E LE CLAUSOLE ABUSIVE) IMPOSTI DALLE NORMATIVE INERENTI ALLA FORNITURA DI BENI, SERVIZI E CONTENUTI DIGITALI CHE, COME ESPRESSAMENTE PREVISTO DALLA LEGGE, NON POSSONO ESSERE ESCLUSI, LIMITATI O MODIFICATI O IL CUI AMBITO PUO’ ESSERE LIMITATO SOLO IN PARTE (GLI “OBBLIGHI DI LEGGE”). A very small percentage of individuals may experience epileptic seizures or blackouts when exposed to certain visual images, including without limitation light patterns or flashing lights.  If you experience any of the following symptoms while playing the Game, immediately discontinue use and consult your physician before resuming play: blackouts, seizures, dizziness, altered vision, eye or muscle twitches, jerking or shaking of arms or legs, loss of awareness, disorientation, confusion, any involuntary movement, or convulsions.

If the Software provides for virtual reality gameplay and/or the use of third-party virtual reality headsets and/or related equipment, the following health and safety precautions and disclaimers apply.

Always be aware of your surroundings when playing the game.  When playing with a virtual reality headset or other headset it is best to remain seated if that mode is supported.  Since the game is an immersive reality experience, you may not be able to fully see or hear your surroundings while playing.  Whether or not you remain seated during gameplay, give yourself plenty of room and make sure the play area is clear of objects and people that could be bumped into during gameplay.  Ensure you are in a safe environment and not near stairs, balconies, windows, walls, furniture, objects that could cause tripping hazards or other objects or people that may pose a danger to you or them or could be damaged or cause injury during gameplay.  Sound volume for the game should be kept at a low enough level so that you can be aware of your surroundings while playing, and to avoid any damage to your hearing.

YOU HEREBY RELEASE ZENIMAX, ITS AFFILIATES AND THEIR RESPECTIVE OFFICERS, DIRECTORS AND EMPLOYEES FROM ANY AND ALL LIABILITY IN CONNECTION WITH THE USE OF A VIRTUAL REALITY HEADSET, RELATED EQUIPMENT, OR THE SOFTWARE.

In no event shall ZeniMax be liable for any damage to property, injury, or death (or for direct, indirect, punitive, incidental, or consequential damages) arising out of the use or misuse of the Software or any virtual reality headset or related equipment, including, without limitation, arising out of or connected with interactions between you and other people or objects in or around the play area during gameplay.  You understand that misuse of the Software includes (without limitation) violations of any instructions or any warnings set forth on the packaging, documentation, and screen shots for your virtual reality headset, in this document, in other documentation accompanying the Software or the packaging for the Software.  Failure to carefully read and follow those instructions and warnings could lead to property damage, injury or death.  You expressly assume and accept any and all risks inherent in (or that may be associated with) the use of the Software, and/or of the virtual reality headsets or related equipment.  Some, but not all, of those risks are discussed in the warnings set forth above or the warnings accompanying the Software and the virtual reality headset.  Please also see the section on “Limitation of Liability" below in this Agreement.

ZeniMax non sarà mai responsabile per danni a proprietà, lesioni o morte (o per danni diretti, indiretti, casuali o conseguenti) derivanti dall’utilizzo corretto o scorretto del Software, di un qualsiasi visore per la realtà virtuale o equipaggiamento ad esso collegato. The ZeniMax Terms of Service contain a Dispute Resolution and Arbitration Provision, including a Class Action Waiver, (the “Disputes Provision”) that - if you reside in a jurisdiction outside of the EEA/United Kingdom/Switzerland/Australia/New Zealand/Turkey/Japan or Brazil that permits class actions or other collective disputes - affects your rights under the ZeniMax Terms of Service and this End User License Agreement with respect to disputes you may have with ZeniMax.  That Disputes Provision is incorporated into this End User License Agreement by this reference and forms a part of this End User License Agreement as if such provision was fully restated in this End User License Agreement.  You may opt out of the binding individual arbitration and class action waiver as provided in the ZeniMax Terms of Service.

Nelle Condizioni di Servizio ZeniMax è prevista una Clausola Compromissoria inclusiva della Rinuncia alla Class Action (la “Clausola Compromissoria”) che – nel caso in cui l’utente risieda in una giurisdizione posta al di fuori dell’Area Economica Europea, nel Regno Unito, in Svizzera, Australia, Nuova Zelanda, Turchia, Giappone o Brasile, i.e., Paesi in cui è possibile promuovere una class action o altre forme di procedimenti legali di natura collettiva – incide sui diritti dell’Utente previsti nelle Condizioni di Servizio ZeniMax e nel presente Contratto in relazione a controversie che potrebbero eventualmente sorgere tra l’utente e ZeniMax. La Clausola Compromissoria è incorporata per riferimento nel presente Contratto e forma parte dello stesso come se qui integralmente riportata e trascritta. Any and all uses of the Game are governed by the terms of this Agreement and the ZeniMax Terms of Service.  The ZeniMax Terms of Service are hereby incorporated into and form a part of this Agreement by this reference as if such provisions were fully restated in this Agreement.  The End User License Agreement is a “EULA” and constitutes “Supplemental Terms” as contemplated by the ZeniMax Terms of Service.  The Game is made available and distributed solely for use by authorized end users according to the terms of this Agreement, including the ZeniMax Terms of Service.  Any use, reproduction, modification or distribution of the Game not expressly authorized by the terms of this Agreement is expressly prohibited.  You agree that the Game, the Game Client, other Game related software, Content (as defined in the Terms of Service) specific to the Game and your access to and use of the Game are all a “Service” for the purposes of this Agreement, including the ZeniMax Terms of Service.  Any rights not granted to you in this Agreement are reserved by ZeniMax.

Ogni e qualsiasi uso del Gioco è disciplinato dalle condizioni del presente Contratto e dalle Condizioni di Servizio di ZeniMax. Le Condizioni di Servizio ZeniMax sono incorporate per riferimento nel presente Contratto e formano parte dello stesso come se qui integralmente riportate e trascritte. Il presente Contratto è un “Atto Integrativo” come contemplato nelle Condizioni di Servizio ZeniMax. Il Gioco è reso disponibile e distribuito per l’uso dei soli utenti autorizzati ai sensi delle condizioni del presente Contratto, ivi incluse le Condizioni di Servizio ZeniMax. Ogni uso, riproduzione, modifica o distribuzione non autorizzata del Gioco ai sensi delle condizioni del presente Contratto è espressamente proibito. L’utente accetta che, ai fini del presente Contratto, ivi incluse le Condizioni di Servizio ZeniMax, il Gioco, il Game Client e ogni altro Gioco connesso al software, il Contenuto specifico (come definito nelle Condizioni di Servizio) del Gioco, l’accesso al Gioco da parte dell’utente e il suo utilizzo costituiscono, nel loro insieme, il “Servizio”. I diritti non concessi all’utente nel presente Contratto si intenderanno riservati a ZeniMax.

You acknowledge that ZeniMax may process your personal data in accordance with the ZeniMax Privacy Policy which is available at https://bethesda.net/#/privacypolicy and you agree to the ZeniMax Code of Conduct which is available at https://bethesda.net/#/codeofconduct.  The Privacy Policy and Code of Conduct are incorporated into this End User License Agreement by this reference and form a part of this End User License Agreement as if such provisions were fully restated in this End User License Agreement.  All personal information collected and processed by ZeniMax in connection with this End User License Agreement will be collected and processed in accordance with the ZeniMax Privacy Policy.

L’utente riconosce che Zenimax possa trattare i suoi dati personali in conformità con quanto previsto nell’Informativa Privacy ZeniMax disponibile sul sito https://bethesda.net/it/document/privacy-policy e accetta le previsioni contenute nel Codice di Condotta ZeniMax disponibile sul sito https://bethesda.net/it/document/code-of-conduct. YOU SHOULD PRINT A COPY OF THIS END USER LICENSE AGREEMENT, THE TERMS OF SERVICE, THE PRIVACY POLICY AND THE CODE OF CONDUCT FOR YOUR RECORDS AND FOR FUTURE REFERENCE.

SI CONSIGLIA DI STAMPARE E CONSERVARE COPIA DEL PRESENTE CONTRATTO, DELLE CONDIZIONI DI SERVIZIO, DELL’INFORMATIVA PRIVACY E DEL CODICE DI CONDOTTA, PER RIFERIMENTI FUTURI.

All software programs and any and all files that are delivered to you or made available to you by ZeniMax, directly or indirectly through a ZeniMax authorized reseller or distributor, (via on-line access, transmission, download or otherwise), including any “patcher”, “installer”, and any updates and modifications to such software programs, and any and all copies and derivative works of such software programs (collectively, with the Game Client (defined below), the “Game”) is the copyrighted work of ZeniMax and its affiliates.  THE GAME IS LICENSED, NOT SOLD, TO YOU.

Tutti i programmi software, ogni e qualsiasi file che ZeniMax abbia consegnato o messo a disposizione dell’utente sia direttamente che indirettamente tramite rivenditori o distributori autorizzati (mediante accesso online, trasmissione, download o in altro modo), ivi inclusi “patcher”, “installer”, aggiornamenti e modifiche apportate a detti programmi software, ogni e qualsiasi copia e opera da essi derivata (collettivamente, assieme al Game Client (come di seguito definito), il “Gioco”) sono protetti dal diritto d’autore di ZeniMax e delle sue consociate. IL GIOCO È CONCESSO IN LICENZA, NON VENDUTO, ALL’UTENTE.

1.	LIMITED LICENSE; RESTRICTIONS AND OWNERSHIP

1.	LIMITAZIONI DI LICENZA; RESTRIZIONI E TITOLARITÀ

If you agree to this Agreement, you may, as applicable, download, install and use the software (hereafter referred to as the “Game Client”) on your computer or console (each hereafter referred to as a “computer”) for the sole purpose of playing the Game.  Subject to your compliance with all the terms and conditions in this Agreement, ZeniMax hereby grants, and you hereby accept, a limited, non-transferable, non-exclusive license (a) to download, install or use the Game Client on one or more computers owned by you or under your legitimate control for your non-commercial entertainment purposes only, and (b) to use the Game Client solely as part of the Service, if applicable.

L’accettazione del presente Contratto da parte dell’utente consentirà allo stesso, ove applicabile, di scaricare, installare e utilizzare il software (qui di seguito il “Game Client”) sul proprio computer o sulla propria console (qui di seguito “computer”) al solo fine di giocare al gioco. Subordinatamente al rispetto da parte dell’utente di tutti i termini e condizioni del presente Contratto, ZeniMax concede sin d’ora, e l’utente sin d’ora accetta, una licenza limitata, non trasferibile e non esclusiva per (a) scaricare, installare o utilizzare il Game Client su uno o più computer di sua proprietà o posti sotto il suo legittimo controllo al solo fine di intrattenimento non commerciale e (b) utilizzare il Game Client solo come parte del Servizio, se applicabile.

The ZeniMax Terms of Service include terms and conditions applicable to Virtual Currency (as such term is defined in the ZeniMax Terms of Service), including terms that grant to you a non-exclusive, limited license for Virtual Currency.  Such terms and conditions apply to the Virtual Currency (if any) licensed to you for use with the Game.

Le Condizioni di Servizio ZeniMax includono termini e condizioni applicabili alla Valuta Virtuale (come definita nelle Condizioni di Servizio ZeniMax), ivi incluse le disposizioni in virtù delle quali viene concessa all’utente una licenza limitata, non esclusiva per la Valuta Virtuale. Tali termini e condizioni si applicano alla Valuta Virtuale, da utilizzare in connessione al Gioco, (eventualmente) concessa in licenza all’utente.

Subject to the Statutory Obligations (as defined in Section 1 of the Terms of Service), this Agreement does not give you any right to obtain reissues or replacements of the Game at any time and ZeniMax is not obliged to supply software updates, upgrades, or expansions for the Game, or even to operate or continue to support the Game for an indefinite period.

Subordinatamente agli Obblighi di Legge (come definiti all’Articolo 1 delle Condizioni di Servizio), con il presente Contratto non si concede all’utente alcun diritto grazie al quale lo stesso potrà ottenere in qualunque momento riedizioni o sostituzioni del Gioco e ZeniMax non è tenuta a fornire, a tempo indeterminato, aggiornamenti, potenziamenti o espansioni per il Gioco e neanche a gestire o continuare a supportare il Gioco.

As further described in the ZeniMax Terms of Service, but subject to the Statutory Obligations (as defined in Section 1 of the ZeniMax Terms of Service), ZeniMax may change, modify, suspend, or discontinue any aspect of the Game at any time and ZeniMax may also impose limits on certain features or restrict your access to parts or all of the Game without notice or liability.

Come descritto in maggiore dettaglio nelle Condizioni di Servizio ZeniMax, e subordinatamente agli Obblighi di Legge (come definiti all’Articolo 1 delle Condizioni di Servizio ZeniMax), ZeniMax può, in qualunque momento, modificare, sospendere o interrompere ogni aspetto del Gioco e perfino limitarne alcune caratteristiche o l’accesso, in tutto o in parte, da parte dell’utente senza preavviso e senza alcuna responsabilità.

In all cases, the licenses granted to you in this Agreement will terminate upon the earlier of termination of this Agreement or termination of your Account, if any, with ZeniMax.

Le licenze concesse all’utente con il presente Contratto diverranno in ogni caso inefficaci alla risoluzione del presente Contratto o alla chiusura dell’Account, eventuale, aperto dall’utente con ZeniMax, quale dei due eventi si verifichi per primo.

The ZeniMax Terms of Service include terms and conditions applicable to user generated Content, downloadable Content and other Content and you agree to comply with such terms and conditions.

Le Condizioni di Servizio ZeniMax contengono disposizioni applicabili al Contenuto generato dall’utente, al Contenuto scaricabile e ad altri Contenuti. L’utente accetta di rispettare tali disposizioni.

2.	SOFTWARE UPDATES AND ANTI-CHEATING AND SECURITY TOOLS.

2.	AGGIORNAMENTI DEL SOFTWARE E DEGLI STRUMENTI DI SICUREZZA E ANTI-CHEATING. ZeniMax può installare o fornire patch, aggiornamenti, miglioramenti, potenziamenti e modifiche al Gioco (“Aggiornamenti”) che l’utente è tenuto ad installare come indicato a sua sola discrezione da ZeniMax prima che l’utente possa continuare a giocare. Tutti questi Aggiornamenti sono parte del Gioco per le finalità del presente Contratto, delle licenze concesse e delle Limitazioni di Licenza previste nel presente Contratto. Le condizioni del presente Contratto disciplineranno gli Aggiornamenti forniti da ZeniMax che andranno a sostituire e/o integrare il Gioco originario, salvo nei casi in cui tali Aggiornamenti siano corredati da un contratto di licenza specifico, in tal caso gli Aggiornamenti saranno disciplinati dalle condizioni di detto contratto di licenza. ZENIMAX HA IMPLEMENTATO STRUMENTI E SOFTWARE (“STRUMENTI ANTI-CHEATING”) FINALIZZATI A RICONOSCERE E PREVENIRE COMPORTAMENTI SCORRETTI VOLTI AL BARO: QUESTO TIPO DI TECNOLOGIA PUÒ SCANSIONARE QUALUNQUE COMPUTER O DISPOSITIVO SU CUI IL GIOCO VIENE SCARICATO O GIOCATO, AL FINE DI RICONOSCERE E IDENTIFICARE PROGRAMMI O PROCESSI VOLTI AL CHEAT (BARARE), ALL’OTTENIMENTO DI UN VANTAGGIO INDEBITO NEL GIOCO O COMPROMETTERE IN ALTRO MODO I PROCESSI E GLI STRUMENTI DI SICUREZZA ANTI-CHEAT IMPLEMENTATI (“PROGRAMMI CHEAT”). UTILIZZANDO O SCARICANDO IL GIOCO O ACCETTANDO QUESTO ACCORDO, RICONOSCI E ACCETTI ESPRESSAMENTE L’ACCESSO AL TUO COMPUTER O DISPOSITIVO DA PARTE DI QUESTI STRUMENTI ANTI-CHEATING PER RICONOSCERE E IDENTIFICARE I PROGRAMMI CHEAT.

ZeniMax may deploy or provide patches, updates, improvements, upgrades and modifications to the Game (“Updates”) that must be installed by you in the manner described by ZeniMax in its discretion before you may continue to play the Game.  All such Updates are part of the Game for purposes of this Agreement, the licenses granted to you and the License Limitations set forth in this Agreement.  The terms of this Agreement will govern any Updates provided by ZeniMax that replace and/or supplement the original Game, unless such Updates is accompanied by a separate license agreement in which case the terms of that license agreement will govern.  ZENIMAX HAS IMPLEMENTED TOOLS AND SOFTWARE (“ANTI-CHEAT TOOLS”) DESIGNED TO DETECT AND PREVENT CHEATING AND FRAUD; THESE TECHNOLOGIES MAY SCAN ANY COMPUTER OR DEVICE FROM WHICH YOU DOWNLOAD OR PLAY THE GAME TO DETECT OR IDENTIFY ANY PROGRAMS OR PROCESSES DESIGNED TO “CHEAT,” GAIN AN UNFAIR ADVANTAGE IN THE GAME OR OTHERWISE CIRCUMVENT ANY SECURITY, ANTI-CHEAT OR FRAUD DETECTION PROCESSES  OR TOOLS WE HAVE IMPLEMENTED (“CHEAT PROGRAMS”).  BY USING OR DOWNLOADING THE GAME OR ACCEPTING THIS AGREEMENT, YOU ACKNOWLEDGE AND EXPRESSLY AGREE TO THE ACCESS TO YOUR COMPUTER OR DEVICE  BY THESE ANTI-CHEAT TOOLS TO IDENTIFY OR DETECT CHEAT PROGRAMS.

3.	LIMITAZIONI E RESTRIZIONI.

3.	LIMITATIONS AND RESTRICTIONS.

Il Gioco e/o alcune sue funzioni sono un Servizio offerto da ZeniMax a cui potrebbe essere possibile giocare solo online. In tal caso, per giocare al Gioco o accedere alle sue funzioni è necessaria una connessione Internet permanente (non fornita da ZeniMax). Tutti i costi e le spese per l’hardware, il software (i.e., browser), per gli altri prodotti e Servizi che sia necessario possedere per poter utilizzare il Gioco o accedere alle sue funzioni sono a carico dell’utente.

The Game and/or certain features are a Service offered by ZeniMax and may only be playable online.  In such cases, a persistent Internet connection (which is not supplied by ZeniMax) is required to play the Game or access these features.  You are responsible for all costs and expenses associated with acquiring any hardware, software (e.g., Internet browsers) or other products or services required to play the Game or access these features.

Oltre alle restrizioni, condizioni e limitazioni di cui alle Condizioni di Servizio ZeniMax e al Codice di Condotta ZeniMax, la licenza concessa all’utente ai sensi del presente Contratto è soggetta alle condizioni, restrizioni e limitazioni previste all’Articolo 1 e all’Articolo 3 di quest’ultimo (collettivamente, le “Limitazioni di Licenza”). Ogni utilizzo del Gioco effettuato in violazione delle Limitazioni di Licenza sarà ritenuto una violazione del copyright di ZeniMax sul Gioco e del presente Contratto. L’utente accetta di astenersi dall’attuare, da solo o con altri, quanto segue:

In addition to the restrictions, conditions and limitations set forth in the ZeniMax Terms of Service and the ZeniMax Code of Conduct, the license granted to you in this End User License Agreement is subject to the conditions, restrictions and limitations set forth in Section 1 and this Section 3 of this End User License Agreement (collectively, the “License Limitations”). Any use of the Game in violation of the License Limitations will be regarded as an infringement of ZeniMax’s copyrights in and to the Game and will be a breach of this Agreement.  You agree that you will not and will not assist any other person, under any circumstances, to:

A.	distribuire, eseguire o mostrare in pubblico, vendere, trasmettere, pubblicare, editare, riprodurre, concedere in sub-licenza, noleggiare, affittare, dare in prestito o in altro modo trasferire, in tutto o in parte, il Gioco o il Contenuto, ivi incluse, a mero titolo esemplificativo ma non esaustivo, le chiavi di accesso;

A.	in whole or in part, distribute, publicly perform or display, sell, transmit, publish, edit, reproduce, sublicense, rent, lease, loan or otherwise transfer the Game or Content, including without limitation any access keys;

B.	in tutto o in parte, modificare, adattare, tradurre, eseguire il reverse engineering, tentare di modificare, disassemblare, decompilare, derivare il codice sorgente, ovvero creare opere derivate dal Gioco; restando inteso che l’utente potrà effettuare una (1) copia del Game Client e dei manuali forniti a corredo dello stesso unicamente per i propri file ed installare il relativo Game Client su uno o più computer di sua proprietà o posti sotto il suo legittimo controllo come descritto al precedente Articolo 1;

B.	in whole or in part, modify, adapt, translate, reverse engineer, attempt to derive source code from, modify, disassemble, decompile, or create derivative works based on the Game; provided, however, that you may make one (1) copy of the Game Client and the manuals that accompany it for archival purposes only and you may install the relevant Game Client on one or more computers owned by you or under your legitimate control as described in Section 1 above;

C.	rimuovere eventuali informazioni proprietarie o etichette presenti sul Gioco; tentare in qualunque modo di eludere le misure di sicurezza atte a controllare l’accesso al Gioco o a parti di esso;

C.	remove any proprietary notices or labels on the Game; or attempt in any manner to circumvent any security measures designed to control access to the Game or any part thereof;

D.	usare cheat, software di automazione (bot), hack, mod o altri software di terzi non autorizzati allo scopo di modificare il Gioco, danneggiare gli altri giocatori o pregiudicarne la loro partecipazione;

D.	use cheats, automation software (bots), hacks, mods or any other unauthorized third-party software designed to modify the Game or adversely impact any other persons playing of the Game or his/her experience of playing the Game;

E.	sfruttare il Gioco o parti di esso, compreso, senza limitazione alcuna, il Game Client, a scopi commerciali (quali, a mero titolo esemplificativo ma non esaustivo, noleggiare, dare in prestito o concedere in licenza il Gioco ad altri), ivi incluso, senza limitazione (a) per accumulare Valuta Virtuale (come definita nelle Condizioni di Servizio ZeniMax), articoli o risorse da vendere al di fuori del Gioco; (b) per fornire servizi all’interno del gioco a fronte di un corrispettivo pagato al di fuori del Gioco, quali, i cosiddetti servizi di power-leveling;

E.	exploit the Game or any of its parts, including without limitation the Game Client, for any commercial purpose (including without limitation renting, leasing or licensing the Game to others), including without limitation (a) for gathering Virtual Currency (as defined in the ZeniMax Terms of Service), items or resources for sale outside the Game; or (b) performing in-game services in exchange for payment outside the Game, e.g., power-leveling;

F.	usare software di terzi non autorizzati che intercettino, “estraggano”, o in altro modo raccolgano informazioni da o attraverso il Gioco o il Servizio, ivi inclusi, a mero titolo esemplificativo ma non esaustivo, software capaci di leggere le aree RAM utilizzate dal Gioco per salvare informazioni su di un personaggio o sull’ambiente di Gioco; a condizione tuttavia che ZeniMax possa, a sua sola ed assoluta discrezione, consentire l’uso di certe interfacce utenti di terzi e altri software di terzi;

F.	use any unauthorized third-party software that intercepts, “mines”, or otherwise collects information from or through the Game or the Service, including without limitation any software that reads areas of RAM used by the Game to store information about a character or the game environment; provided, however, that ZeniMax may, at its sole and absolute discretion, allow the use of certain third party user interfaces and other third party software;

G.	modificare o fare in modo che siano modificati file facenti parte del Game Client in modi non espressamente autorizzati da ZeniMax;

G.	modify or cause to be modified any files that are a part of the Game Client in any way not expressly authorized by ZeniMax;

H.	ospitare, fornire o sviluppare servizi di matchmaking per il Gioco ovvero intercettare, emulare o reindirizzare i protocolli di comunicazione utilizzati da ZeniMax in qualunque modo, per qualunque finalità, compresi, senza alcuna limitazione, il gioco non autorizzato su Internet, il gioco di rete o come parte di reti di aggregazione di contenuti;

H.	host, provide or develop matchmaking services for the Game or intercept, emulate or redirect the communication protocols used by ZeniMax in any way, for any purpose, including without limitation unauthorized play over the internet, network play, or as part of content aggregation networks;

I.	facilitare, creare o mantenere connessioni non autorizzate con il Gioco o il Servizio, ivi incluse, senza limitazione (a) connessioni verso server non autorizzati che emulino, o tentino di emulare, il Servizio; e (b) connessioni che utilizzino programmi o attrezzature non espressamente approvate da ZeniMax;

I.	facilitate, create or maintain any unauthorized connection to the Game or the Service, including without limitation (a) any connection to any unauthorized server that emulates, or attempts to emulate, the Service; and (b) any connection using programs or tools not expressly approved by ZeniMax;

J.	in qualsiasi modo caricare, pubblicare, promuovere o distribuire qualsiasi contenuto illecito;

J.	take any action or upload, post, transmit, promote, or distribute any illegal content;

K.	in qualsiasi modo caricare, pubblicare, promuovere o distribuire qualsiasi contenuto che infranga o violi qualsiasi diritto di terze parti;

K.	take any action or upload, post, transmit, promote, or distribute any content that infringes or violates any third-party rights;

L.	commettere, agire in associazione o partecipare in qualsiasi tipo di sollecitazione o adescamento di minori, condotta di pedofilia o comportamento violento in qualsiasi forma esso sia;

L.	engage in, take any action associated with, or participate in any type of child solicitation, grooming behavior, pedophilia, or predatory behavior in any form;

M.	molestare, perseguitare, minacciare, imbarazzare, o commettere qualsiasi altra azione indesiderata nei confronti di un altro utente del Gioco quale, ad esempio, inviare ripetutamente messaggi indesiderati o effettuare attacchi personali o insulti riguardanti l’etnia, l’orientamento sessuale, la religione, l’eredità culturale, ecc.;

M.	harass, stalk, threaten, embarrass, spam or do anything else to another user of the Game that is unwanted, such as repeatedly sending unwanted messages or making personal attacks or statements about race, sexual orientation, religion, heritage, etc.;

N.	caricare, pubblicare, trasmettere, distribuire o comunicare le sue vere informazioni personali o quelle di qualsiasi altra persona;

N.	take any action or upload, post, transmit, distribute, or communicate your or any person’s real-world personal information;

O.	personificare qualsiasi altro soggetto o ente, inclusi - ma non limitatamente riferito a questi - i dipendenti di ZeniMax, dei partner commerciali o delle società affiliate di ZeniMax, o rappresentare falsamente o comunque far apparire che l’utente sia affiliato con un soggetto o un ente;

O.	impersonate any person or entity, including, but not limited to, ZeniMax, ZeniMax’s partners’ or affiliates’ employees, or falsely state or otherwise misrepresent your affiliation with a person or entity;

P.	organizzare, trasmettere qualsiasi contenuto, effettuare o partecipare in qualsiasi attività, gruppo o associazione che sia nocivo, dannoso, offensivo, spregevole (compreso l’ “incitamento all’odio”) per la razza, l’etnia, la religione o che sia, ad ogni modo, offensivo, osceno, minaccioso, violento, volgare, sessualmente esplicito, diffamatorio, falso, in violazione e invasivo della propria vita privata o dei diritti pubblici e che incoraggi condotte che sarebbero, altrimenti, in violazione di leggi o, secondo il ragionevole pensiero comune, discutibili e/o ritenute inappropriate a sola discrezione di ZeniMax;

P.	take any action, organize, transmit any content, effectuate or participate in any activity, group, or guild that is harmful, tortuous, abusive, hateful (including “hate speech”), racially, ethnically, religiously or otherwise offensive, obscene, threatening, bullying, vulgar, sexually explicit, defamatory, libelous, infringing, invasive of personal privacy or publicity rights, encourages conduct that would violate a law or is, in a reasonable person's view, objectionable and/or deemed to be in the sole discretion of ZeniMax inappropriate;

Q.	promuovere, caricare, trasmettere, incoraggiare o prendere parte a qualsiasi attività che coinvolga il cracking, il phishing, la pirateria informatica, che permetta all’utente di trarre vantaggio dallo sfruttamento o frode e/o dalla distribuzione del software contraffatto e/o della Valuta Virtuale o di altro articolo virtuale. Nello sforzo di migliorare costantemente il Gioco, gli utenti/giocatori che scoprano sfruttamenti, imbrogli o altre incongruenze sono tenuti a riferirlo a ZeniMax; o,

Q.	promote, upload, transmit, encourage or take part in any activity involving hacking, cracking, phishing, taking advantage of exploits or cheats and/or distribution of counterfeit software and/or Virtual Currency or virtual items.  In an effort to continuously improve the Game, you and other users/players discovering exploits, cheats, cracks or other inconsistencies are required to report them to ZeniMax; or

R.	caricare, pubblicare, trasmettere, promuovere o distribuire qualsiasi contenuto che possa contenere Trojan, malware, virus, worm, spyware, bombe ad orologeria, dati corrotti o altri programmi che l’utente non possiede o non ha l’autorizzazione a distribuire liberamente e che possono danneggiare, interferire, intercettare, espropriare o interrompere il Gioco.

R.	take any action or upload, post, transmit, promote, or distribute any content that may contain a Trojan horse, virus, worm, spyware, time bombs, cancelbots, corrupted data or other computer programs that you do not own or have permission to freely distribute that may damage, interfere with, intercept, expropriate or disrupt the Game.

Ogni tentativo di attuare quanto precede costituisce violazione del presente Contratto e potenziale violazione dei diritti di proprietà intellettuale inerenti al Gioco. L’utente sarà perseguibile e tenuto a risarcire i danni in caso di violazione delle presenti limitazioni.

Any attempt to do any of the foregoing is a breach of this Agreement and may be a violation of intellectual property rights in the Game.  If you breach these restrictions, you may be subject to prosecution and damages.

Il Gioco viene concesso in licenza all’utente come un solo ed unico prodotto. Le componenti del Gioco devono essere utilizzate sullo stesso computer e non possono essere separate. Il Gioco viene concesso in licenza e non venduto. La licenza non conferisce all’utente alcun diritto o titolarità sul Gioco o sulle copie dello stesso.

The Game is licensed to you as a single product. Its component parts may not be separated for use on more than one computer.  The Game is licensed, not sold.  Your license confers no title or ownership in the Game or copies thereof.

4.	TITOLARITÀ DEL GIOCO.

4.	OWNERSHIP OF THE GAME.

Tutti i diritti, titoli e interessi sul Gioco e sul Servizio, ivi inclusi, a mero titolo esemplificativo ma non esaustivo, tutti i diritti di proprietà intellettuale e i diritti morali sul Gioco e su tutte le copie dello stesso (compresi, senza alcuna limitazione, i titoli, i programmi e il codice del software, i temi inerenti al Gioco, i personaggi, i loro nomi, le somiglianze, le storie, i dialoghi, gli slogan, gli esterni, i concetti, le illustrazioni, i tratti caratteristici, il design strutturale del Gioco, il design paesaggistico e ogni altro tipo di design, le animazioni, i suoni, le composizioni e registrazioni musicali, gli effetti audio-visivi, le trame, la modalità di funzionamento e ogni documento ad essi relativo) sono e continueranno ad essere di proprietà di ZeniMax e dei suoi danti causa. L’utente non attuerà alcuna azione che sia in contrasto con tale titolarità. Il Gioco è protetto dalla legge sul diritto d’autore vigente negli Stati Uniti d’America, dai trattati e dalle convenzioni internazionali e da altre leggi. Il Gioco può contenere materiali concessi in licenza da terzi che possono far valere i loro diritti in caso di violazione del presente Contratto. L’utente riconosce ed accetta di non avere interessi economici o di altro tipo nelle caratteristiche o nel Contenuto del Gioco. Le disposizioni del presente articolo resteranno pienamente valide ed efficaci anche dopo la risoluzione del presente Contratto.

ZeniMax and its licensors are and will continue to be the owner of all right, title, and interest in and to the Game and the Service, including without limitation all intellectual property rights and moral rights in and to the Game and all copies thereof (including without limitation any titles, software programs and code, Game related themes, characters, character names, character likenesses, stories, dialog, catch phrases, locations, concepts, artwork, character inventories, structural, landscape and other designs in the Game, animations, sounds, musical compositions and recordings, audio-visual effects, storylines, methods of operation, and any related documentation).  You shall take no action inconsistent with such title or ownership.  The Game is protected by the copyright laws of the United States, international treaties and conventions, and other laws.  The Game may contain materials licensed by third parties, and the licensors of those materials may enforce their rights in the event of any violation of this Agreement.  You acknowledge and agree that you have no interest, monetary or otherwise, in any feature or Content contained in the Game.  This paragraph will survive the termination of this Agreement.

L’UTENTE RICONOSCE DI AVER LETTO E COMPRESO L’INFORMATIVA SUL TRATTAMENTO DEI DATI PERSONALI DI ZENIMAX [https://bethesda.net/it/document/privacy-policy] CHE ILLUSTRA COME ZENIMAX PUÒ RACCOGLIERE, TRATTARE E DIVULGARE I DATI (IVI INCLUSI DATI PERSONALI) DELL’UTENTE. IN PARTICOLARE, ZENIMAX TRATTERÀ I DATI (IVI INCLUSI DATI PERSONALI) DELL’UTENTE PER RENDERE I SERVIZI, FACILITARE IL SUPPORTO, LO SVILUPPO E IL MIGLIORAMENTO DEI PRODOTTI, ADATTARE E PERSONALIZZARE L’ESPERIENZA DELL’UTENTE E CAPIRE QUALI PRODOTTI DI ZENIMAX SONO UTILIZZATI, NONCHÉ PER FORNIRE ALTRI SERVIZI ALL’UTENTE. Inoltre, l’Utente riconosce e accetta che ZeniMax offre il Gioco conduce il proprio business in diversi paesi. Ne consegue che le informazioni personali raccolte o fornite dall’Utente attraverso il Gioco o diversa modalità possano essere trasferite e conservate sui server o strumentazione ubicata al di fuori del paese di residenza dell’Utente. I server e la strumentazione sui quali i dati dell’Utente sono conservati e trattati possono essere di proprietà e operati da terzi con i quali ZeniMax ha sottoscritto accordi per la ricezione, conservazione e trattamento delle informazioni personali dell’Utente. ZeniMax e tali terze parti debitamente designate da ZeniMax possono altresì trasferire, conservare e trattare le informazioni personali su server e strumentazione ubicati in altri paesi. L’Utente deve sapere che potrebbero essere applicabili le normative in materia di protezione di dati personali di altri paesi, i quali potrebbero non garantire il medesimo livello di tutela della normativa in materia di protezione dei dati personali del paese di residenza dell’Utente. La presente Sezione 3 sopravvivrà in caso di risoluzione della presente Licenza.

You also acknowledge and understand that ZeniMax offers the Game and conducts business in many countries.  As a result, personal information collected from or submitted by you through a Game or otherwise may be transferred to and stored on servers and equipment located in a destination outside your country of residence.  The servers and equipment on which your data is stored and processed may be owned and operated by third parties with whom ZeniMax has contracted to receive, store and process your personal information.  ZeniMax and those third parties that ZeniMax has designated, may further transfer, store and process your personal information on servers and equipment located in other countries. You should be aware that the data protection laws of other countries may not be the same as the data protection laws of your country of residence. This Section 5 shall survive the termination of this Agreement.

ZeniMax, in caso di richiesta di assistenza tecnica da parte dell’utente e subordinatamente al consenso di quest’ultimo, può accedere da remoto al computer su cui l’utente ha caricato il Game Client per fornire l’assistenza tecnica richiesta e la messa a punto. Come descritto in maggiore dettaglio nelle Condizioni di Servizio ZeniMax, ZeniMax potrà aggiornare il Gioco da remoto ivi incluso, senza alcuna limitazione, il Game Client collocato sul computer dell’utente. L’utente acconsente sin d’ora al fatto che ZeniMax possa installare e applicare tali Aggiornamenti.

If you request any technical support from ZeniMax, subject to your consent ZeniMax may remotely access and review the computer onto which you have loaded the Game Client for purposes of providing technical support and debugging.  As further described in the ZeniMax Terms of Service, ZeniMax may update the Game remotely including without limitation the Game Client residing on your computer, and you hereby grant to ZeniMax your consent to deploy and apply such Updates.

L’utente è consapevole ed accetta che (a) ogni e qualsiasi informazione inerente ai personaggi del Gioco è memorizzata e residente sui computer e sui server ZeniMax, e (b) ogni e qualsiasi comunicazione effettuata dall’utente nel contesto del Gioco (ivi inclusi, senza limitazione alcuna, i messaggi indirizzati unicamente a un altro giocatore o a un gruppo di giocatori) transita sui computer e sui server ZeniMax e può essere o meno monitorata da quest’ultima o dai suoi agenti. L’utente acconsente espressamente al suddetto monitoraggio delle informazioni da esso inviate e ricevute. Le Condizioni di Servizio ZeniMax e l’Informativa Privacy ZeniMax prevedono altri termini e condizioni applicabili all’accesso, al monitoraggio e alla registrazione di attività e di comunicazioni inerenti al Servizio, ivi incluse, a mero titolo esemplificativo ma non esaustivo, le segnalazioni da parte di ZeniMax di incidenti alle forze dell’ordine e ad altre autorità. I dati personali raccolti e trattati da ZeniMax come parte delle attività indicate nel presente Articolo 6 saranno raccolti e trattati in conformità con quanto previsto dall’Informativa Privacy di ZeniMax https://bethesda.net/it/document/privacy-policy e dai termini del Contratto.

You understand and agree that (a) any and all Game related character data is stored and is resident on ZeniMax computers and servers and (b) any and all communications that you make within the Game (including, but not limited to, messages solely directed at another player or group of players) traverse through ZeniMax computers and servers and may or may not be monitored by ZeniMax or ZeniMax’s agents.  You expressly consent to such monitoring of such communications that you send and receive.  The ZeniMax Terms of Service and the ZeniMax Privacy Policy include further terms and conditions applicable to the accessing, monitoring and recording of activities and communications on and relating to the Service, including but not limited to when ZeniMax may report incidents to law enforcement and other authorities. All personal data collected and processing by ZeniMax as part of the activities set out in this clause 6 will be collected and processing accordance with the ZeniMax Privacy Policy[https://bethesda.net/#/privacypolicy] and the terms of the Agreement.

7.	RISOLUZIONE.

7.	TERMINATION.

Il presente Contratto avrà efficacia dalla data di accettazione dello stesso da parte dell’utente fino alla data della sua risoluzione. L’utente può risolvere il presente Contratto in qualunque momento (i) distruggendo, in modo permanente, tutte le copie del Gioco in suo possesso o poste sotto il suo controllo e (ii) rimuovendo il Game Client dal suo disco rigido. Subordinatamene agli Obblighi di Legge (come definiti all’Articolo 1 delle Condizioni di Servizio ZeniMax), ZeniMax può risolvere il presente Contratto in qualunque momento, anche senza giusta causa (anche in caso di decisione da parte di ZeniMax di cessare l’offerta del Gioco). Alla risoluzione, per qualunque motivo, del presente Contratto da parte di ZeniMax, tutte le licenze concesse in virtù del presente Contratto (e delle Condizioni di Servizio ZeniMax) in relazione al Gioco oggetto del presente Contratto perderanno immediatamente efficacia e l’utente sarà tenuto a porre immediatamente in essere quanto previsto ai precedenti paragrafi (i) e (ii). La risoluzione immotivata del presente Contratto sarà comunicata all’utente da ZeniMax.

This End User License Agreement starts at the time you accept this End User License Agreement and it will remain effective until terminated.  You may terminate this End User License Agreement at any time by (i) permanently destroying all copies of the Game in your possession or control and (ii) removing the Game Client from your hard drive.  Subject to the Statutory Obligations (as defined in Section 1 of the ZeniMax Terms of Service),  ZeniMax may terminate this End User License Agreement at any time for any reason or no reason (including at such time as ZeniMax elects to discontinue offering the Game).  Upon termination by ZeniMax for any reason, all licenses granted in this Agreement (including in the ZeniMax Terms of Service) with respect to the Game that is the subject of this End User License Agreement shall immediately terminate and you must immediately do (i) and (ii) above.  Termination for no reason will be communicated to you by ZeniMax.

8.	RESTRIZIONI SULLE ESPORTAZIONI.

Il Gioco non può essere esportato, ri-esportato, scaricato o in altro modo trasferito (i) verso/in (collettivamente, l’“Esportazione”) paesi che richiedano una licenza di Esportazione o rispetto ai quali le Esportazioni siano proibite ai sensi delle leggi statunitensi, ivi inclusi paesi soggetti a sanzioni economiche o (ii) persone fisiche o giuridiche a cui è proibito ricevere beni o servizi di origine statunitense. L’utente dichiara e garantisce di non abitare, di non essere sottoposto al controllo, di non essere nativo o residente in tali paesi o incluso in tali elenchi. Le disposizioni del presente Articolo 8 resteranno valide ed efficaci anche dopo la risoluzione del presente Contratto.

The Game may not be exported, re-exported, downloaded or otherwise transferred (i) to or into (collectively, an “Export”) any country which requires an Export license or which the United States Government prohibits Exports, including any such country subject to economic sanctions or (ii) to any person or entity prohibited from receiving goods or services of U.S. origin.  You represent and warrant that you are not located in, under the control of, or a national or resident of any such country or on any such list.  This Section 8 will survive the termination of this Agreement.

Qualora l’utente, nonché acquirente originario, abbia acquistato il Gioco su un supporto fisico (come, ad esempio, un cd), l’utilizzo del Gioco da parte dell’utente è soggetto ad una garanzia limitata che include i manuali e qualsiasi altro imballaggio ricevuto con l’acquisto.

If you, the original purchaser, purchased the Game on a physical media (such as a disc) your use of the Game is subject to the limited warranty included with the manual or other packaging material that came with your purchase.

LE CONDIZIONI DI SERVIZIO ZENIMAX INCLUDONO CLAUSOLE DI ESONERO DA RESPONSABILITA’ INERENTI A DICHIARAZIONI E GARANZIE (SUBORDINATAMENTE AGLI OBBLIGHI DI LEGGE (COME DEFINITI ALL’ARTICOLO 1 DELLE CONDIZIONI DI SERVIZIO ZENIMAX)). TALI CLAUSOLE SONO INCORPORATE NEL PRESENTE CONTRATTO PER RIFERIMENTO E FORMANO PARTE DELLO STESSO COME SE IN ESSO integralmente riportate e trascritte. LE DISPOSIZIONI DEL PRESENTE ARTICOLO RESTERANNO VALIDE ED EFFICACI ANCHE DOPO LA RISOLUZIONE DEL PRESENTE CONTRATTO.

THE ZENIMAX TERMS OF SERVICE INCLUDE PROVISIONS REGARDING THE DISCLAIMER OF REPRESENTATIONS, WARRANTIES AND GUARANTEES (SUBJECT TO THE STATUTORY OBLIGATIONS (AS DEFINED IN SECTION 1 OF THE ZENIMAX TERMS OF SERVICE)) AND SUCH PROVISIONS ARE INCORPORATED INTO THIS END USER LICENSE AGREEMENT BY THIS REFERENCE AND FORMS A PART OF THIS END USER LICENSE AGREEMENT AS IF SUCH PROVISIONS WERE FULLY RESTATED IN THIS END USER LICENSE AGREEMENT.  THIS SECTION 9  SHALL SURVIVE THE TERMINATION OF THIS AGREEMENT.

In relazione al software abilitato ad essere utilizzato su/in Internet, l’utente riconosce che ZeniMax non sarà in alcun modo responsabile riguardo a Internet e al fatto che essa possa continuare a esistere nella forma attuale o al fatto che un governo o un’agenzia governativa, italiana o straniera, possa controllare, disciplinare o sopprimere Internet. L’uso di Internet è interamente a rischio dell’utente.

With respect to software that is enabled for use on or over the Internet, you acknowledge that ZeniMax is not responsible for the Internet or whether it should continue to exist in its present form or whether or not a government or governmental agency, either foreign or domestic, will control, regulate or disband the Internet.  Use of the Internet is at your sole risk.

10.	LIMITAZIONE DI RESPONSABILITÀ, RIMBORSO.

10.	LIMITATION OF LIABILITY, REIMBURSEMENT.

Nella misura massima consentita dalla legge applicabile e subordinatamente agli Obblighi di Legge (come definiti all’Articolo 1 delle Condizioni di Servizio), ZENIMAX E I SUOI LICENZIANTI NON SARANNO IN ALCUN MODO RESPONSABILI PER (I) DANNI SPECIALI, INCIDENTALI, CONSEQUENZIALI, PUNITIVI, ESEMPLARI O ALTRI DANNI INDIRETTI, (II) PRETESE DI TERZI, (III) PERDITA O DANNEGGIAMENTO DI IMPIANTI, HARDWARE, SOFTWARE, REGISTRAZIONI O DATI, ANCHE SE AVVISATI O CONSAPEVOLI DELLA POSSIBILITA’ DI TALI DANNI E ANCHE OVE UN RIMEDIO LIMITATO IN QUESTO ACCORDO NON DOVESSE RAGGIUNGERE LO SCOPO PER CUI E’ PREVISTO.

To the maximum extent permitted by applicable law, and subject to the Statutory Obligations (as defined in Section 1 of the Terms of Service), IN NO EVENT SHALL ZENIMAX OR ANY OF LICENSORS BE LIABLE FOR ANY (I) SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, EXEMPLARY OR OTHER INDIRECT DAMAGES, (II) THIRD PARTY CLAIMS, OR (III) LOSS OR DAMAGE TO ANY SYSTEMS, HARDWARE OR SOFTWARE, RECORDS OR DATA, EVEN IF ADVISED OF OR AWARE OF THE POSSIBILITY OF ANY SUCH DAMAGES AND EVEN IF A LIMITED REMEDY IN THIS AGREEMENT FAILS OF ITS ESSENTIAL PURPOSE.

TALI DISPOSIZIONI SONO INCORPORATE NEL PRESENTE CONTRATTO PER RIFERIMENTO E FORMANO PARTE DELLO STESSO COME SE FOSSERO IN ESSO INTEGRALMENTE RIPORTATE E TRASCRITTE.

THE ZENIMAX TERMS OF SERVICE INCLUDE OTHER PROVISIONS REGARDING THE LIMITATION OF LIABILITY AND REMEDIES (SUBJECT TO THE STATUTORY OBLIGATIONS (AS DEFINED IN SECTION 1 OF THE ZENIMAX TERMS OF SERVICE)) AND SUCH PROVISIONS ARE INCORPORATED INTO THIS END USER LICENSE AGREEMENT BY THIS REFERENCE AND FORMS A PART OF THIS END USER LICENSE AGREEMENT AS IF SUCH PROVISIONS WERE FULLY RESTATED IN THIS END USER LICENSE AGREEMENT.

Nel caso in cui l’utente (i) usi scorrettamente il Gioco Servizio o violi il presente Contratto (ii) partecipi, ometta o ponga in essere azioni in relazione all’utilizzo da esso fatto del Gioco Servizio e da ciò ne derivino per ZeniMax passività, danni, perdite, costi e spese (comprese, senza limitazione alcuna, le spese legali e giudiziali), l’utente accetta di rimborsare ZeniMax, le sue consociate e gli altri partecipanti ai Servizi da tutte queste passività, danni, perdite, costi e spese. In caso di procedimenti legali avviati da terzi nei confronti di ZeniMax a causa di quanto previsto in uno dei precedenti paragrafi (i) o (ii) o in entrambi, ZeniMax si riserva il diritto di assumere il controllo della difesa e risolvere la controversia con il terzo, mentre l’utente accetta di rimborsare a ZeniMax i costi da essa sostenuti per tale difesa, ivi inclusi, a mero titolo esemplificativo ma non esaustivo, le ragionevoli spese legali debitamente documentate.

If (i) you misuse the Game Service or breach this Agreement or (ii) any contributions, actions or omissions by you in connection with your use of the Game Service results in ZeniMax incurring any liabilities, damages, losses, costs and expenses (including without limitation attorneys’ fees and court costs), then you agree to reimburse ZeniMax and its affiliates and other participants of the Service from all such liabilities, damages, losses, costs and expenses.  If a third party sues ZeniMax for either or both of (i) or (ii) above, ZeniMax reserves the right to control the defense and settlement of such third party lawsuit, and you agree to reimburse ZeniMax for the cost of the defense, including, but not limited to, reasonable and documented attorneys’ fees.

Il presente Articolo 10 resterà valido ed efficace anche successivamente alla risoluzione del presente Contratto.

This Section 10 shall survive termination of this Agreement.

11.	MODIFICHE AL CONTRATTO. ZeniMax può sostituire il presente Contratto con nuove versioni dello stesso (ciascuna, un “Nuovo Contratto”) secondo l’evolversi del Gioco e della legislazione. Il presente Contratto sarà risolto con effetto immediato all’atto dell’introduzione di un Nuovo Contratto che l’utente potrà visionare in conformità a quanto previsto in tema di modifiche nelle Condizioni di Servizio ZeniMax. I Nuovi Contratti non avranno effetto retroattivo. Il Nuovo Contratto si intenderà accettato dall’utente se, successivamente alle modiche, l’utente continua ad utilizzare il Software o a giocare.

11.	CHANGES TO THE AGREEMENT.  ZeniMax may replace this End User License Agreement with new versions (each a “New EULA”) over time as the Game and the law evolve.  This End User License Agreement will terminate immediately upon the introduction of a New EULA, and you will be given an opportunity to review the New EULA in accordance with the change provisions set out in the ZeniMax Terms of Service.  New EULAs will not be applied retroactively.  Your continued use of the Software and play of the Game after a modification of the EULA will be deemed as your acceptance of any modified terms.

12.	LIMITAZIONE DEI DIRITTI PER IL GOVERNO DEGLI STATI UNITI. Il Gioco è un “Commercial Item” (Articolo Commerciale) sviluppato esclusivamente da soggetti privati che ne hanno sostenuto le relative spese, consistente di un “commercial computer software” (software commerciale per computer) e della “commercial computer software documentation” (documentazione del software commerciale per computer) come definiti nei regolamenti di acquisizione applicabili, ivi inclusi, a mero titolo esemplificativo ma non esaustivo, nel Federal Acquisition Regulation (“FAR”) all’Articolo 48 C.F.R. 2.101. Il Gioco viene concesso in licenza a utenti finali del Governo degli Stati Uniti subordinatamente alle condizioni del presente Contratto, come specificato all’Articolo 48 C.F.R. 12.212 (Computer Software) e 12.211 (Technical Data) (per civilian agencies – agenzie statunitensi non rientranti nel Dipartimento della Difesa), e come specificato all’Articolo 48 C.F.R. 227.7202-3 e 48 C.F.R. 227.7202-4, in conformità all’Articolo 48 C.F.R. 227.7202 (Department of Defense entities – enti del Dipartimento della Difesa). Questo articolo concernente i Diritti di Licenza del Governo Statunitense sostituisce, solo relativamente ai diritti del Governo Statunitense sul Gioco, ogni altra clausola FAR, DFARS, o altro articolo o disposizione del contratto ai sensi del quale il presente Gioco è ottenuto. Il Produttore è ZeniMax.

12.	U.S. GOVERNMENT RESTRICTED RIGHTS.  The Game is a Commercial Item developed exclusively at private expense and comprised of “commercial computer software” and “commercial computer software documentation”, as these terms are defined in the applicable acquisition regulations, including without limitation the Federal Acquisition Regulation (“FAR”) at 48 C.F.R. 2.101.  The Game is licensed to U.S. Government End Users subject to the terms of this Agreement, as specified in 48 C.F.R. 12.212 (Computer Software) and 12.211 (Technical Data) ( for civilian agencies), and as specified in 48 C.F.R. 227.7202-3 and 48 C.F.R. 227.7202-4, consistent with 48 C.F.R. 227.7202 (for Department of Defense entities).  Solely with respect to the U.S. Government’s rights in the Game, this U.S. Government License Rights clause is in lieu of, and supersedes, any other FAR, DFARS, or other clause or provision of the contract under which this Game is obtained.  The Manufacturer is ZeniMax.

13.	LEGGE APPLICABILE.

13.	GOVERNING LAW.

Per gli utenti residenti in Nord America, il presente Contratto e tutte le Controversie (come definite all’art. Risoluzione delle Controversie) sarà disciplinato dalla legge dello Stato del Maryland, USA, senza l’applicazione delle disposizioni di diritto internazionale privato di tale Stato, della Convenzione sulla vendita internazionale di beni, dello Uniform Computer Information Transactions Act (“UCITA”) e di qualsiasi legge basata sull’UCITA. Per chiarezza, i termini di questo paragrafo prevarranno su qualsiasi termine in conflitto dei termini di servizio di ZeniMax, ivi inclusi, a mero titolo esemplificativo ma non esaustivo, gli eventuali termini che risulterebbero nell’applicazione delle leggi di un altro stato o nazione per questo accordo o eventuali controversie.

For residents of North America, this Agreement and all Disputes (as defined in the Disputes Provision) shall be governed by the laws of the State of Delaware, USA, excluding its conflicts of laws rules and principles that would result in another State’s or country’s laws applying to this Agreement or any Disputes, and excluding the United Nations Convention on Contracts for the International Sale of Goods, the Uniform Computer Information Transactions Act (“UCITA”), and any laws based on UCITA.  For clarity, the terms in this paragraph shall control over any conflicting terms in the ZeniMax Terms of Service, including without limitation any terms that would result in another State’s or country’s laws applying to this Agreement or any Disputes.

Per gli utenti residenti in paesi diversi dal Nord America, il presente Contratto e tutte le Controversie saranno disciplinati dal diritto inglese, senza l’applicazione delle disposizioni di diritto internazionale privato di tale paese e della Convenzione sulla vendita internazionale di beni.

If you reside outside of North America, then this Agreement and all Disputes shall be governed by the laws of England, excluding its conflicts-of-law rules and principles that would result in another State or country’s laws applying to this Agreement or any Disputes, and excluding the United Nations Convention on Contracts for the International Sale of Goods.  Local mandatory laws may be applied.

Fatte salve le disposizioni di cui all’art. Risoluzione delle Controversie, l’utente accetta che ZeniMax è autorizzata a ottenere, in relazione a violazioni dell’art. 1 o dell’art. 3 del presente Contratto, decreti ingiuntivi, esecuzioni in forma specifica ed equitable remedies, oltre ad altri rimedi per essa disponibili ai sensi della legge applicabile.

Notwithstanding the Disputes Provision, you agree that ZeniMax shall be entitled to injunctive relief, specific performance and equitable remedies with respect to breaches of Sections 1 or 3 of this Agreement, in addition to such other remedies as ZeniMax may otherwise have under applicable law.

Il presente Articolo 13 resterà valido ed efficace anche successivamente alla risoluzione del presente Contratto.

This Section 13 will survive the termination of this Agreement.

14.	ALTRE DISPOSIZIONI. Il presente Contratto, le Condizioni di Servizio ZeniMax, l’Informativa Privacy ZeniMax e il Codice di condotta ZeniMax costituiscono l’intero accordo esistente tra l’utente e ZeniMax in relazione all’oggetto dello stesso e sostituiscono ogni precedente accordo scritto o verbale. Il presente Contratto coesisterà e non sostituirà le Condizioni di Servizio ZeniMax o l’Informativa Privacy ZeniMax. In ipotesi di divergenza tra le disposizioni del presente Contratto e le Condizioni di Servizio ZeniMax, se non diversamente ed espressamente indicato nel presente Contratto, prevarranno le disposizioni del presente Contratto. Se non specificatamente previsto all’articolo Risoluzione delle Controversie, nel caso in cui una qualsiasi disposizione del presente Contratto sia ritenuta invalida o non eseguibile, tale disposizione sarà interpretata in modo tale da risultare conforme alla legge applicabile e conseguire, quanto più possibile, l’intento iniziale della disposizione invalida o non eseguibile. Le restanti disposizioni resteranno pienamente valide ed efficaci. Il mancato esercizio da parte di ZeniMax di qualsiasi diritto, potere o privilegio derivante dal presente Contratto non avrà valore di rinuncia agli stessi. Le disposizioni del presente Contratto si intenderanno rinunciate solo mediante atto debitamente sottoscritto da ZeniMax. L’utente accetta che il presente Contratto e l’impugnazione dello stesso da parte di ZeniMax, non intendono conferire, e non conferiscono, diritti o rimedi a nessuno tranne che all’utente e a ZeniMax. Il presente Articolo 14 rimarrà efficace anche successivamente alla risoluzione, per qualunque motivo, del presente Contratto

14.	MISCELLANEOUS.  This End User License Agreement along with the ZeniMax Terms of Service, ZeniMax Privacy Policy and the ZeniMax Code of Conduct constitute and contain the entire agreement between you and ZeniMax with respect to the subject matter hereof and supersedes any prior oral or written agreements. This End User License Agreement shall coexist with, and shall not supersede, the ZeniMax Terms of Service or the ZeniMax Privacy Policy.  To the extent that the provisions of this End User License Agreement conflict with the provisions of the ZeniMax Terms of Service, and unless expressly indicated otherwise in this Agreement, the conflicting provisions in this End User License Agreement shall control and shall govern.  Except as specifically provided in the Disputes Provision, if any part of this Agreement is held invalid or unenforceable, that portion shall be interpreted in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of such part, and the remaining portions of this Agreement shall remain in full force and effect.  The failure of ZeniMax to exercise or enforce any right or provision of this Agreement will not constitute waiver of such right or provision.  Any waiver of any provision of this Agreement will be effective only if in a writing signed by ZeniMax.  You agree that this Agreement and ZeniMax’s enforcement of this Agreement, are not intended to confer and do not confer any rights or remedies upon any person other than you and ZeniMax.  This Section 14 shall survive the termination of this Agreement for any reason.

L’utente dà sin d’ora atto di aver letto e compreso tutti i termini e condizioni del presente Contratto e accetta il fatto che, cliccando su “Acconsento”, installando il Game Client o utilizzando in altro modo il Gioco, riconosce di avere accettato di essere vincolato da tutti i termini e condizioni del presente Contratto, incluso il consenso esplicito all’uso da parte di ZeniMax degli strumenti anti-cheating descritti in precedenza.

I hereby acknowledge that I have read and understand all the terms and conditions in this Agreement and agree that by clicking “Agree”, installing the Game Client or otherwise playing the Game I am acknowledging my agreement to be bound by all the terms and conditions of this Agreement, which includes my express consent to ZeniMax’s use of Anti-Cheat Tools as described herein.
