1. Introduction
This End User License Agreement (“Agreement”) is a legal contract between you (“User”) and Smilecoast Games, the owner and developer of the video game BAENANA (“Game”). This license is granted to you only after obtaining a legitimate copy of the Game through Steam or an authorized distributor. By installing, accessing, or using the Game, you agree to be bound by the terms of this Agreement.
2. Grant of License
Smilecoast Games grants you a personal, non‑exclusive, non‑transferable, revocable license to install and use one copy of the Game for your own personal entertainment. You may not sell, rent, lease, sublicense, or distribute the Game. You may not modify, decompile, reverse engineer, or attempt to extract the source code.
3. Ownership
The Game is licensed, not sold. All original rights, title, and interest in the Game — including code, artwork, characters, trademarks, the BAENANA splash logo displayed at game start, the BAENANA game logo, and the Smilecoast Games company logo — remain the exclusive property of Smilecoast Games. The Game may include third‑party assets licensed to Smilecoast Games; all such assets remain the property of their respective owners.
4. Restrictions
You may not bypass, disable, or interfere with any security or technical protection measures. You may not use the Game for commercial purposes without written permission from Smilecoast Games. You may not upload, share, or distribute the Game or any part of it on websites, file‑sharing platforms, or any unauthorized distribution channels.
5. User‑Generated Content
If the Game allows users to create or upload content (“UGC”), you retain ownership of your UGC but grant Smilecoast Games a worldwide, royalty‑free license to use, display, and distribute that content within the Game. You may not upload illegal, harmful, or infringing content.
6. Updates
Smilecoast Games may provide updates, patches, or modifications to improve or change the Game. These updates may be required to continue using the Game.
7. Warranty Disclaimer
The Game is provided “as is” without warranties of any kind. Smilecoast Games does not guarantee that the Game will be error‑free or uninterrupted.
8. Limitation of Liability
To the maximum extent permitted by law, Smilecoast Games is not liable for loss of data, hardware damage, indirect damages, or issues arising from third‑party software or services.
9. Termination
This Agreement is effective until terminated. Smilecoast Games may terminate this Agreement if you violate any of its terms. Upon termination, you must uninstall and stop using the Game.
10. Governing Law
This Agreement is governed by the laws of The Gambia.
